A Letter From our Executive Director and Chair

For over 25 years, the New Hampshire Bar Foundation has been building a foundation for justice through the cooperative and creative efforts of our board, staff, donors and affiliated organizations. We are pleased to present the 2004 Annual Report, a summary of our considerable accomplishments during the past year.

These accomplishments, achieved with the help of our dedicated partners, are encouraging. They reflect a growing commitment that achieving justice for all New Hampshire citizens is the only effective way to ensure that everyone, from long-time residents to newly-arrived refugees, receives the legal support each requires and deserves.

A cornerstone of our support for justice comes from the banking community and is manifested in the Interest on Lawyers Trust Accounts (IOLTA) program. Since its inception, IOLTA has generated over $16 million to create lasting change through our statewide grant program.

Our grant making provides funding for some of the most innovative civil legal services and education programs in New Hampshire. Grantees carry our mission and vision forward into the community in many ways. During the past year we funded organizations that worked to improve access to the family court system for individuals with mental illness; created a self-help center for pro se litigants on the Supreme Court’s website; and provided education and support for prevention of violence in North Country families and communities.

Our most important partnership is with our donors. Your vision and generosityenable the Bar Foundation to work diligently to achieve its mission. From your participation in IOLTA to your support of our giving programs, you are a critical component of the foundation for justice we continue to build.

New Hampshire IOLTA Leadership Banks

Thank you to our IOLTA Leadership Banks!

IOLTA (Interest on Lawyers Trust Accounts) is a unique partnership between attorneys and the banking community in which interest on certain lawyer trust accounts is paid tothe New Hampshire Bar Foundation, resulting in a statewidegrants program.

Many factors influence IOLTA revenue, but the incrediblesupport of our Leadership Banks certainly contributed to the record-setting revenue we enjoyed during the year. Weare truly grateful to these banks and would especially like torecognize four new Leadership Banks this year – Bow MillsBank and Trust, First Colebrook Bank, Siwooganock Bank,and Southern New Hampshire Bank. To those banks we say,“thank you.” To those banks that have IOLTA accounts butare not yet leadership banks, we say, “Please join in, weneed your help.”

Leadership Banks are those New Hampshire banks that havecreated a special status for IOLTA accounts that includes:

• Setting an interest rate that yields 2% or higher• Exceeding the bank’s standard NOW account rate• Waiving routine service charges

The interest earned from these 11 banks accounted for anamazing 89% of the IOLTA revenue earned this past year.

This kind of help reflects a bank’s support for the overallgoals of the New Hampshire Bar Foundation, their authenticcommitment to community-based banking, as well as theirflexibility in “interest on lawyers trust account” processing.

2004 IOLTA Grant AwardsGrants made possible from IOLTA have stayed at an all-timehigh for the 2004 fiscal year.

The New Hampshire Bar Foundation has dedicated itself to exploring, identifying, and ultimately removing barriers tojustice for all New Hampshire citizens. This mission involvessupport for a variety of legal service programs and education-related initiatives that facilitate greater public awarenessabout legal processes, as well as helping the legal systembecome more responsive to the people it serves.

Over $1.4 million has been committed to six different NewHampshire organizations providing legal assistance services toNew Hampshire’s most vulnerable citizens. These services arelargely funded through the resources that IOLTA makes possible.

Grantee SpotlightPro Bono Assists Military Professionals

The New Hampshire Bar Foundation is pleased with theinnovative methods the Pro Bono Referral Program uses toaddress the changing needs of New Hampshire citizens.During 2003 and 2004, the Pro Bono Program organizedthree weekends dedicated to providing more than 125National Guard members with emergency basic estate planning services. The services helped the Guard membersand their families with an essential step in a transition fromcivilian to military life.

Pro Bono also organized a continuing legal education program on military law issues. Entitled, "Military Law andHow it Affects Families," the seminar covered issues such as military pay, medical coverage and retirement benefits. As soldiers return to civilian life, Pro Bono will be preparedto assist them with these and other issues.

“Facing imminent deployment to combat, the prompt execution of a simple will and power of attorney became critical for the servicemen and women we met through this project. Support from the legal community was obviously appreciated. I look forward to their safe return.”

Ruth Ansell of Ansell, Barradale, Newkirk, Anderson & Dwyer, PA and NH Bar Foundation board member volunteered for Pro Bono to assist with the estate planning of the troops being deployed.

The Bar Foundation is proud to support the work of the NewHampshire Bar Association’s Law-Related Education Program.

Law-Related Education encompasses a variety of programsfor students in grades K-12, designed to teach students aboutthe law, legal system, and the fundamental principles of ourconstitutional democracy.

One of the programs coordinated by the Bar Association’sLaw-Related Education Program is the state’s Mock TrialProgram which serves students in grades 6-12, providingcase materials and volunteer attorney resource people inclassrooms to teach the concepts of trial practice, discusscourt procedures and the role of the judicial branch in theirlives. The program develops critical thinking, problem solving,legal research and investigative skills and the ability to think on one’s feet.

The parent of two Mock Trial participants stated: “You shouldall be proud that you played such an important part in encouraging our next generation to be professional, courteous,and assisting them in developing thinking skills to help themlater on in life… We have observed the steady growth andrewards the students receive by participating in this program.” “I think the Mock Trial is a very

valuable program for students formany reasons. It is an interestingapproach to learning about the legal system, public speaking, cooperation and deductive thinking. The hands-on approachis a much more effective tool for learning and I wish there were many more programs like the one you organize… and I would urge you to keep this program running as long as possible.”

On May 27, 2004, the New Hampshire Bar Foundation celebrated the efforts and loyalty of its volunteers anddonors at the Annual Dinner.

A gala Pacesetter Reception kicked off the evening, honoringNew Hampshire firms that served as donor role models forthe Campaign for Legal Services. These firms contributed$500 per attorney, per year for three years, and combinedwith contributions from other generous donors resulted in over$800,000 for New Hampshire Legal Assistance, the LegalAdvice and Referral Center and the Pro Bono Referral Program.

Attorney General Kelly A. Ayotte received the 2004 Robert E. Kirby Award, presented to an attorney 35 years oryounger who demonstrates civility, courtesy, perspective and excellent advocacy.

Jack Middleton, a partner of McLane, Graf, Raulerson &Middleton in Manchester, was honored with the 2004 FrankRowe Kenison Award. The award recognizes an individualwho makes a substantial contribution to the betterment ofNew Hampshire citizens through the administration of justice,the legal profession, or the advancement of legal thought.

The evening was highlighted by featured speaker David Hall,who served as senior vice president for Academic Affairs andprovost of Northeastern School of Law from 1998 to 2002.Hall presented a powerful speech titled “Equal Justice inSilent Times,” which exhorted attendees to join their voices ina collective demand for justice.

It was a fitting way to celebrate a year that reflected greatstrides toward justice for all New Hampshire residents — and it reminded us of the work that lies ahead.

On May 27, 2004, the New Hampshire Bar Foundation celebrated the efforts and loyalty of its volunteers anddonors at the Annual Dinner.

A gala Pacesetter Reception kicked off the evening, honoringNew Hampshire firms that served as donor role models forthe Campaign for Legal Services. These firms contributed$500 per attorney, per year for three years, and combinedwith contributions from other generous donors resulted in over$800,000 for New Hampshire Legal Assistance, the LegalAdvice and Referral Center and the Pro Bono Referral Program.

Paul W. Chant, Chair thanked Past Chair, Emily G. Rice, and outgoing Board members, Alan M. Cantor, Charles A.DeGrandpre, Patrick F. Harrigan, Russell F. Hilliard, andHonorable Edwin W. Kelly for their service, and presentedtwo awards:

Attorney General Kelly A. Ayotte received the 2004 Robert E. Kirby Award, presented to an attorney 35 years oryounger who demonstrates civility, courtesy, perspective and excellent advocacy.

Jack Middleton, a partner of McLane, Graf, Raulerson &Middleton in Manchester, was honored with the 2004 FrankRowe Kenison Award. The award recognizes an individualwho makes a substantial contribution to the betterment ofNew Hampshire citizens through the administration of justice,the legal profession, or the advancement of legal thought.

The evening was highlighted by featured speaker David Hall,who served as senior vice president for Academic Affairs andprovost of Northeastern School of Law from 1998 to 2002.Hall presented a powerful speech titled “Equal Justice inSilent Times,” which exhorted attendees to join their voices ina collective demand for justice.

It was a fitting way to celebrate a year that reflected greatstrides toward justice for all New Hampshire residents — and it reminded us of the work that lies ahead.

Grantee Spotlight

The Bar Foundation is proud to support the work of the NewHampshire Bar Association’s Law-Related Education Program.

Law-Related Education encompasses a variety of programsfor students in grades K-12, designed to teach students aboutthe law, legal system, and the fundamental principles of ourconstitutional democracy.

One of the programs coordinated by the Bar Association’sLaw-Related Education Program is the state’s Mock TrialProgram which serves students in grades 6-12, providingcase materials and volunteer attorney resource people inclassrooms to teach the concepts of trial practice, discusscourt procedures and the role of the judicial branch in theirlives. The program develops critical thinking, problem solving,legal research and investigative skills and the ability to think on one’s feet.

The parent of two Mock Trial participants stated: “You shouldall be proud that you played such an important part in encouraging our next generation to be professional, courteous,and assisting them in developing thinking skills to help themlater on in life… We have observed the steady growth andrewards the students receive by participating in this program.” “I think the Mock Trial is a very

valuable program for students formany reasons. It is an interestingapproach to learning about the legal system, public speaking, cooperation and deductive thinking. The hands-on approachis a much more effective tool for learning and I wish there were many more programs like the one you organize… and I would urge you to keep this program running as long as possible.”

The Bar Foundation is a beneficiary of agency-endowed funds and designated funds held by the New Hampshire Charitable Foundation(NHCF). Pursuant to the terms of the resolution establishing these funds, property contributed to the NHCF is held in separate funds designated for the benefit of the Bar Foundation. In accordance with its spending policy the NHCF makes distributions from these funds to the Bar Foundation. The funds are not included in these financial statements.

Total contributions to the funds held at the NHCF amounted to $10,000 for the NHCF year ended June 30, 2004. The Bar Foundationreceived $10,822 from the funds held at NHCF for the fiscal year ended May 31, 2004. The market value of the New Hampshire BarFoundation assets currently held at NHCF is approximately $386,054 as of June 30, 2004.

The New Hampshire Bar Foundation is a public charitablefoundation supported by the generous contributions ofmembers of the New Hampshire Bar Association and othercommitted individuals, families, and organizations who support our mission. Our mission is to promote philanthropydedicated to ensuring that all people in New Hampshire,especially those with limited means, are able to understandand participate fully in the justice system.

A large portion of our grantmaking and administration is supported through the IOLTA (Interest On Lawyers TrustAccounts) program. The Foundation is also actively buildingother endowed funds that will help us accomplish our mission and fulfill the philanthropic ideals of the NewHampshire legal community.

There are a number of ways you can support ourwork together:

Annual Giving Program. Bar Foundation Members andFellows include the Foundation each year in theircharitable giving plans. There are four giving levels:

The Justice Society. Members of the Bar Foundation’sJustice Society have made major gifts to the Foundation byestablishing a named fund, making significant contributionsto existing funds, and/or making planned giving arrange-ments that benefit the Foundation. To explore participation inthe Justice Society, and learn more about these givingoptions, please call the Foundation office.

Campaign for Legal Services. The Campaign for LegalServices is a three-year campaign on behalf of NewHampshire’s three main legal aid providers: New HampshireLegal Assistance, the Pro Bono Referral Program of theNew Hampshire Bar Association, and the Legal Advice &Referral Center. The campaign was initiated to minimizeduplication of fundraising efforts, as well as to provideessential funding to help stabilize these important frontlineorganizations.
