FRIENDS,The Mortgage Bankers Association continues to be among the most sophisticated and effective
trade associations in Washington, DC and that is in no small part because of your continued
support of MORPAC, MBA’s political action committee.
I am proud to announce that, due to your support, 2016 has been MORPAC’s biggest year yet.
With that in mind, I am pleased to present the 2016 MORPAC Mid-Year Report.
This year, we have raised a record breaking $532,000 in individual donations, outpacing our
previous 2015 pace by over $60,000. This means MORPAC has already raised a total of $1,545,000
for the 2015-2016 political cycle — $111,000 more than any previous full cycle. Together we have
also managed to raise $117,000 in 2016 from first time MORPAC contributors.
We continue to increase our grassroots reach as well. The Mortgage Action Alliance (MAA)
currently enjoys over 12,000 active members and late last year we launched MBA’s new Action
Center, making it easier than ever for MAA members to participate in our advocacy programs.
Under the leadership of MAA Chairman Fowler Williams, we are on pace to continue MAA’s
growth through the rest of 2016.
This report lists all of the individuals and companies who have been part of our 2016 campaign.
In addition, you’ll find itemized information about the goals our political programs achieved,
and a comprehensive summary of MBA’s advocacy team’s legislative and political priorities.
I appreciate and thank you for your dedication to MBA, MORPAC and our collective public

MAA membership is at its highest point ever. Since moving to our new grassroots
advocacy platform, the response rate of MAA members to Calls to Action (CTAs)
has increased from 12 percent in 2015 to over 17 percent so far in 2016.
In 2015 and 2016 we have sent 28 CTAs on federal and state issues affecting the real
estate finance industry. In response to those CTAs, members of the real estate finance
industry have sent 26,628 communications to their elected officials on these issues.

LEGISLATIVE AND POLITICAL UPDATE
Congress adjourned on July 15 for a long summer recess
prior to the political conventions, signaling that election
“silly season” is officially in full swing. They will return after
Labor Day for a brief September session when they will
need to complete work on the annual appropriations bills
and pass a stop-gap measure to keep the government’s
lights on before returning to the campaign trail in October.
Since our last update, House Financial Services Committee
Chairman Jeb Hensarling (R-TX) has unveiled his “Financial
CHOICE Act” (details below), and MBA has continued
to urge Congress to support key GSE reform transition
steps while opposing efforts to recapitalize Fannie Mae
and Freddie Mac. We also continue to beat the drums
on regulatory relief, SAFE Act changes, and changes to
the FHFA’s FHLB membership rule. Given the political
obstacles to making even the most miniscule Dodd Frank
Act changes, much of this remains level setting for the
next occupant of the White House, whoever that may be
— or possibly the “lame duck” session of this Congress
in November/December.
MBA Presence at Political ConventionsMBA staff and officers attended both the Republican
and Democratic National Conventions in Cleveland and
Philadelphia, respectively. At both events, MBA partnered
with other real estate trade groups to host policy forum
brunches in conjunction with the media outlet, The Hill,
with MBA CEO Dave Stevens also discussing mortgage
finance policy at the DNC with POLITICO. MBA also
partnered with the Terwilliger Foundation and Radian
to host housing-focused events during each convention.
GSE ReformIt remains abundantly clear at this point that comprehen-
sive GSE reform will not be addressed this year, punting
the issue until sometime after the elections (absent a
crisis such as a Treasury draw). Still, the issue contin-
ues to percolate on Capitol Hill, and HFSC Chairman
Hensarling has signaled an interest to work with some
of the committee’s Democrats on narrower legislation
that would address a GSE risk sharing pilot program.
As mentioned above, MBA continues to urge Congress to
support key GSE reform transition steps while opposing
efforts to recapitalize Fannie Mae and Freddie Mac. To
this end, Senators Bob Corker (R-TN) and Mark Warner
(D-VA) spearheaded a letter from six Senators to FHFA
Director Mel Watt in early July. The letter urges FHFA
to avoid taking steps that may facilitate the release of
Fannie and Freddie out of conservatorship without com-
prehensive reform. Senators Mike Crapo (R-ID), Dean
Heller (R-NV), John Tester (D-MT), and Heidi Heitkamp
(D-MT) also signed the letter, which further urges FHFA
to continue to take transition steps that would facilitate
reform, and expresses the Senators’ hope that housing
finance reform will be on the agenda in the next Congress.
Uniform Residential Loan ApplicationMBA spearheaded a congressional letter to FHFA Director
Mel Watt in early July that urged the agency to not include
a question about borrowers’ language preference on
the Uniform Residential Loan Application (URLA). The
letter, which was led by Representative Steve Stivers
(R-OH) and was signed by 55 House Republicans, was
in direct response to a letter earlier this year from two
dozen House Democrats who had asked FHFA, as well as
Fannie Mae and Freddie Mac, to include such a question.
The Stivers letter coincided with a meeting MBA, joined
by its sister trades, held with FHFA staff.

In an early August letter to several trade associations,
FHFA Director Mel Watt announced that FHFA will not
include a question about language preference on the
redesigned URLA form. In response, MBA and several
other trade associations submitted a letter to FHFA
stating, that while the industry shares FHFA’s goal of
better understanding the experience of limited English
proficiency (LEP) borrowers, adding the question to
the form would introduce a myriad of unanswered legal
questions. The letter also urged FHFA that such a broad
policy issue should be considered through an open and
transparent dialogue with all relevant stakeholders.
SAFE Act AmendmentsOn May 23, 2016, the full House of Representatives
unanimously passed H.R. 2121, the SAFE Transitional
Licensing Act by voice vote (after the Financial Services
Committee approved it 56-0 in early March). The House-
passed draft of the bill reflects extensive consultation
between MBA and the Conference of State Banking
Supervisors. The bipartisan legislation, originally intro-
duced by Representatives Steve Stivers (R-OH), Terri
Sewell (D-AL), Lynn Westmoreland (R-GA), Joyce Beatty
(D-OH), Luke Messer (R-IN), Kyrsten Sinema (D-AZ),
and Ed Perlmutter (D-CO), would mandate that states
regulators allow MLOs transitional authority to con-
tinue originating mortgages should they leave a federal
depository to take a new job working for a non-bank or
cross state lines to do so. Language substantially simi-
lar to H.R. 2121 was included in Title I of SBC Chairman
Richard Shelby’s regulatory relief package, as well as
his Ranking Member Sherrod Brown’s (D-OH) substitute
small lender relief measure. We are now exploring paths
forward in the Senate.
HUD AppropriationsBoth the Senate and House have now commenced work
on the appropriations bills to fund fiscal year 2017. The
Senate Appropriations Committee unanimously approved
the Transportation-HUD (THUD) appropriations bill, and
the full Senate has now approved that language as a
part of a combined appropriations “minibus” package
by a vote of 89 to 8. Meanwhile, over in the House, the
Appropriations Committee has passed its version of the
legislation. Below are highlights from the Senate and
House bills:
• For the third year in a row, both chambers
have rejected HUD’s unprecedented request
to fund a portion of FHA’s administrative costs
through a fee on residential lenders who use
the program. The Senate bill also earmarks
an additional $13 million specifically for FHA’s
IT needs, as MBA has recommended.

• $130 million for FHA administrative
contract expenses, and $23 million for
Ginnie Mae salaries and expenses.
• In response to MBA’s urging for additional
resources for FHA and Ginnie Mae, the House
bill contains volume-based incentives so FHA
could receive as much as $160 million and Ginnie
Mae could receive as much as $26 million.
• Both bills contain HUD’s full request of $30 billion
in commitment authority for the General and
Special Risk Insurance (GI/SRI) Fund in FY 2017.
• Both bills maintain the statutory prohibition on
the use of Ginnie Mae securitizations in HUD’s risk
sharing programs by Housing Finance Agencies.
• Both bills bar HUD from requiring or
enforcing the Physical Needs Assessment.
• The Senate bill contains $47 million
for housing counseling, while the
House bill provides $55 million.
• Both bills continue the prohibition on federal
funds being used to facilitate eminent domain
seizures of performing mortgage loans.
FHFA Membership RuleLast fall, a bipartisan group of lawmakers introduced H.R.
3808, legislation to require the withdrawal and study of
the Federal Housing Finance Agency’s (FHFA) proposed
rule on Federal Home Loan Bank (FHLB) membership.
The legislation would address a controversial FHFA rule
that limits the ability of mortgage Real Estate Investment
Trusts to access the FHLB System. Since FHFA finalized
the rule earlier this year, MBA has been working with the
bill’s sponsors as well as HFSC leadership to fine-tune
the legislative language so that it appropriately amends,
rather than overturns, the membership rule in order
to preserve access to the System for captive insurers/
REITs. The Shelby regulatory relief package contains
similar language.
CMBS Risk RetentionMBA has worked with a coalition of trades in support of
a new CMBS risk retention bill, H.R. 4620, the Preserving
Access to CRE Capital Act. Introduced by Representative
French Hill (R-AR), the bill would provide for: an exemption
from risk retention for single property, single borrower
commercial real estate loans; for other commercial real
estate loans, qualification parameters for risk retention
exceptions that better reflect customary and prudent
lending practices; in addition to the pari passu structure
provided for in the final risk retention rule, allowance of
a senior/subordinate structure when there are two third-
party risk retention purchasers. The House Financial
Services Committee approved H.R. 4620 by a vote of 39
to 18 — though it enjoyed some bipartisan support, the

sizable opposition from committee Democrats makes
enactment unlikely in this Congress. During a hearing on
H.R. 4620 before the FSC Capital Markets Subcommittee,
MBA submitted testimony in support of the bill.
In May, the SBC Securities, Insurance and Investment
Subcommittee held a hearing on “Improving Communities’
and Businesses’ Access to Capital and Economic
Development.” One of the bills considered under the
hearing rubric was H.R. 4620. Much of the other hearing
dialogue focused on legislation related to the regula-
tory treatment of Money Market Funds and Business
Development Corporations. Subcommittee Ranking
Member Mark Warner (D-VA) expressed concerns about
H.R. 4620 and its potential to “undermine… the risk
retention provisions of Dodd-Frank.” MBA submitted a
statement for this hearing’s record as well.
G-feesIn April, Representatives Mark Sanford (R-SC), Brad
Sherman (D-CA) and Randy Neugebauer (R-TX) intro-
duced H.R. 4893, the Risk Management and Homeowner
Stability Act. The bill would prohibit the use of Fannie
Mae and Freddie Mac guarantee fees (g-fees) as offsets
in spending measures. MBA was instrumental in the draft-
ing and introduction of this legislation — and growing
support for the bill was part of the agenda during the
National Advocacy Conference. MBA also led a joint trade
letter to both the House and Senate Budget Committees
urging them to renew for another year the prohibition
on using g-fees as a spending offset.
Financial Choice ActOn June 17, House Financial Services Committee Chairman
Jeb Hensarling (R-TX) released his Financial CHOICE Act,
which would dramatically alter the financial regulatory
regime and repeal broad swaths of the Dodd-Frank Act.
At its heart is an exemption (or “off ramp”) from the
Dodd-Frank supervisory regime and Basel III capital
and liquidity standards for banking organizations that
choose to maintain high levels of capital. The legislation
also retroactively repeals the authority of the Financial
Stability Oversight Council (FSOC) to designate firms as
systematically important financial institutions (SIFIs). It
repeals Title II of Dodd-Frank and replaces it with a new
chapter of the Bankruptcy code designed to accommo-
date the failure of a large, complex financial institution.
It also changes the CFPB to the Consumer Financial
Opportunity Commission and tasks it with the dual mis-
sion of consumer protection and competitive markets,
with a cost-benefit analysis of rules performed by an
Office of Economic Analysis. It also creates a biparti-
san 5-member commission to govern the agency and

subjects it to congressional appropriations. Finally, the
bill carries a number of regulatory reform provisions that
have previously passed the committee and full House,
including H.R. 2121, the SAFE Transitional Licensing Act,
H.R. 685, the Mortgage Choice Act, and H.R. 1210, the
Portfolio Lending and Mortgage Access Act (QM status
for loans held in portfolio). On July 15, at the commit-
tee’s request, MBA provided its views on the legislation.
MBA’s comments focused on capital requirements, the
CFPB, commercial/multifamily issues, and the inclusion
of regulatory relief measures like H.R. 2121.
High Volatility Commercial Real Estate ExposuresAt the request of MBA and other coalition partners,
Representative Robert Pittenger (R-NC), a HFSC member,
sent a letter to federal banking regulators concerning
the Basel III treatment of high volatility commercial real
estate exposures (HVCRE). HVCRE loan status requires
a higher capital charge for acquisition, development and
construction (ADC) loans that, among other things, have
a loan-to-value ratio of greater than 80 percent and less
than 15 percent equity contribution by the borrower. MBA
is concerned that tight restrictions placed on ADC loans
could result in the unwarranted higher capital treatment
for many ADC loans, which could negatively impact bank
ADC lending decisions.
Flood InsuranceIn April, the House passed H.R. 2901, the Flood Insurance
Market Parity and Modernization Act, by a vote of 419 to
0. The legislation fixes a flaw in a 2012 law that had the
unintended consequence of making it more difficult for
private insurers to provide private flood insurance and
for lenders to accept those policies. H.R. 2901 would
amend the definition of “private flood insurance” to
restore the discretion necessary to allow lenders, private
insurers, and regulators to develop a functional private
insurance market. MBA testified in support of H.R. 2901
in January and sent a letter to the full House urging its
passage. We are optimistic the Senate will consider the
bill later this year.
Regulatory Relief LegislationSBC Chairman Shelby’s regulatory relief proposal, S.1484,
has been stalled in the Senate ever since it passed the
Committee back in May of 2015. The legislation contains
a number of MBA priorities on issues ranging from GSE
transition steps to QM lending standards, FHFA’s FHLB
membership rule, TRID enforcement, Basel III and its
impact on mortgage servicing rights, and preferred
SAFE Act amendments. Given that this is an election year,
we anticipate that if any portions of Chairman Shelby’s
package move, it will be during the post-election lame
duck session.
HUD Program Reforms (H�R� 3700)On July 15, the Senate unanimously passed H.R. 3700,
the Housing Opportunity Through Modernization Act and
President Obama signed the bill into law on July 29. The
House previously approved the legislation unanimously
in February. Among its nearly 20 provisions, this legisla-
tion requires FHA to streamline its condominium project
recertification requirements. The bill also authorizes the
USDA’s Rural Housing Service (RHS) single-family hous-
ing guaranteed loan program to delegate loan approval
authority to preferred lenders, similar to that of existing
FHA and VA delegated approval authority guidelines. H.R.
3700’s condominium provisions expand commercial space
requirements, align recurring private transfer fees to be
consistent with those of the Federal Housing Finance
Agency (FHFA), and decrease the owner-occupancy
requirement from 50 percent to 35 percent.
Unfortunately, the bill also authorizes a fee of up to
$50 per loan on lenders who utilize the USDA Section
502 single-family guarantee loan program. On the mul-
tifamily side, H.R. 3700 also updates and streamlines
HUD’s rental assistance programs. These reforms ease
administrative burdens for public and private sector
participants. In addition, the bill provides new tools
to preserve affordable housing, reduce homelessness,
increase self-sufficiency and expand access. Importantly,
H.R. 3700 would make these improvements while leaving
in place the core characteristics that have helped make
federal rental assistance programs effective. The bill was
signed by President Obama on July 29.
