Surface Water Protection

4 Great Lakes

3,288 miles of Great Lakes shoreline

11,000 inland lakes

36,000 river miles

6.5 million acres of wetlands

MECC 2016

Michigan has:

Over 1,000,000 private drinking water wells. On average 25,000 new domestic wells drilled per year

2X more groundwater supplies than surface water supplies

Almost 2.6 million Michiganders depend on groundwater as

their sole source of drinking water

NPDES Permit Types Individual: Site-Specific Determinations

ó Technology Based (TTBELs) óWater Quality Based (WQBELs) óContested Permits óDenials

25

MECC 2016

NPDES Permit Types General: Similar Discharges

• Hydrostatic Pressure Testing • Sewage Lagoon • Noncontact Cooling Water • Groundwater Cleanup of Petroleum

26

MECC 2016

NPDES Permit Types

Stormwater

óConstruction – Permit by Rule ó Industrial – General or Individual óMunicipal Separate Storm Sewer System (MS4)

MECC 2016

Legal authority

No Federal groundwater discharge permit program

Authority comes from Part 31 of Michigan’s regulations (NREPA) and the associated rules, to regulate both

groundwater and surface water

Surface water and groundwater are both “Waters of the State”

28

Groundwater Discharges

MECC 2016

All groundwater discharges must meet certain general requirements that prohibit nuisance conditions and set isolation standards between polluting sources and drinking water wells Increasing regulations based on the characteristics of the discharge

Groundwater Discharge

LOW IMPACT

HIGH IMPACT

MECC 2016 31

Groundwater - Rule 2210

Exemptions

Permit exemptions apply to discharges that are covered by other statutes (storm water, animal feed lots) and the discharge of things that likely will not cause harm, such as non-contact cooling water, sanitary sewage < 6,000 gpd with local health dept approval

Authorization 2210(y)

Insignificant Discharge

MECC 2016 32

Groundwater - Rule 2211

Notification Only

Application required, but no permit is issued Examples: ó Treated sanitary sewage 6,000 – 10,000 gal/day ó Hydrostatic test water

MECC 2016 33

Groundwater - Rule 2213

Notification with Certification

Application required DEQ Certification issued within 60 days Examples: ó Non-contact cooling water with additives <10,000 gal/day ó Contact cooling water with or without additives <5,000 gal/day ó Groundwater remediation, outside plume <5,000 gal/day

MECC 2016 34

Groundwater - Rule 2215

General Permit

Application required DEQ issues Certificate of Coverage within 180 days Examples: ó Vehicle wash, not open to the public <2,000 gpd ó Slaughterhouse <2,000 gpd (annual average) ó Application of oil field brine <3,000 gpd

MECC 2016 35

Groundwater - Rule 2216

Permit for a Specific Discharge

Application required with Public Notice provided by applicant Design usually requires an environmental consultant Permit issued within 180 days Examples: ó Process wastewater ó Cooling water with additives > 5,000 gal/day

MECC 2016 36

Groundwater Rule 2218 Individual Permit

Application required with ó Basis of design ó Discussion of alternatives ó Wastewater characterization ó Hydro-geological study ó Groundwater monitoring and wastewater management plans Design usually requires an environmental consultant Permit issued within 180 days Examples: ó Sanitary sewage, constructed wetland < 20,000 gal/day ó Laundromat wastewater < 20,000 gal/day
