Authority comes from Part 31 of Michigan’s regulations (NREPA) and the associated rules, to regulate both
groundwater and surface water
Surface water and groundwater are both “Waters of the State”

Permit exemptions apply to discharges that are covered by other statutes (storm water, animal feed lots) and the discharge of things that likely will not cause harm, such as non-contact cooling water, sanitary sewage < 6,000 gpd with local health dept approval
