New York City recently passed a law that will ban polystyrene food containers beginning 2015. With Chicago and other cities contemplating similar laws, it makes one question why these cities aren’t recycling the foam instead. Many recyclers across the country are taking plastic foam and recycling it into new products. And a number of cities, including Los Angeles, are collecting plastic foam from curbsides as part of their recycling effort. Some recycling advocates say that the trend toward bans is more political than practi- cal. Despite the practical advantages of recycling poly- styrene, some elected officials see an advantage in taking a stand against a material that has a negative image from an environmental standpoint. Another explanation is that polystyrene suffers from a widespread misconception that it is not recyclable. How- ever, in fact, the material can be recycled and the process is easier today thanks to improvements in equipment for washing, densifying and otherwise handling it. Generally, the problem seems to involve ban propo- nents who have influence, while recycling proponents don’t, and lack of knowledge about recycling makes it hard for decision makers to vote for recycling. “You have activists saying foam is filling up land- fills,” said Michael Wester- field, corporate director of recycling programs for expanded polystyrene product maker Dart Container Corpo- ration in Mason, Michigan. “And you have elected offi- cials who aren’t experts on it, so it makes sense to them to ban it.” Recyclers, however, know better. Al Valkema, national sales director for Sebright Prod- ucts in Hopkins, Michigan, a maker of a line of compactors including densifiers suitable for expanded polystyrene foam, said his company recycles three million pounds of foam annu- ally. “I wouldn’t be a fan of a ban,” Valkema said. In New York, however, polystyrene foam food con- tainers will be banned starting in 2015 unless recycling pro- ponents can successfully demonstrate that the materials can be recycled. The problem is not so much that foam food containers are inherently hard to recycle, or even that they are contaminated with food. One obstacle is getting enough of the light, bulky containers in one place to make processing or transport- ing them worthwile, according to Westerfield. “The biggest challenge that we face is probably the lack of critical mass at certain facilities,” Westerfield said. MRFs generally sell materials in single lots of 40,000 lbs. Because foamed plastic is light, especially compared to volume, it can take a long time to accumulate enough material to move it. And foam stored outside and exposed to the elements may be so damaged or degraded by the time a full load has been collected that it cannot be recycled. The critical mass problem is one reason why it’s been difficult to replicate at the consumer level the success of recycling polystyrene that has been seen at hospitals, univer- sities and other single-point large generators of poly- styrene containers. However, when enough polystyrene of the proper sort is collected it can be recycled. Dan Helfenbein, presi- dent of Recycling Solutions in Elk Grove Village, Illinois, said 30 percent of his total material volume comes from polystyrene foam collected from industries where it is used mostly for packing. Mar- kets for the recycled materials are good, Helfenbein said. “It goes in the toy market, the sporting goods market and they use it for picture frames.” Helfenbein doesn’t take any coffee cups, clamshell takeout containers or other foodservice, however. So he expects even if nearby Chicago does ban polystyrene food containers, it would have only a small impact on his supply. Westerfield said educat- ing people about the prospects for recycling polystyrene is one of the key challenges fac- ing recycling proponents. Foam, he says, is generally superior to the major foodser- vice alternative, paper, when it comes to energy consumption, air emissions, water emissions and other environmental con- cerns. However, he said, the general belief is the opposite, that paper is far preferable to foam. “Most people’s percep- tion of foam is not positive,” he said. “We have to do a bet- ter job of explaining the reali- ties of it.” When more decision makers are aware of the prac- tical advantages, curbside post-consumer recycling of foodservice and other foam can succeed. Westerfield noted that in 2007 a single commu- nity in California recycled foam. Now, he says, 65 do so. “Most people are told from a very young age that foam is not recyclable,” he said. “We know that’s not true.” One way to introduce food service foam recycling is for large generators such as school districts to implement it. Because they produce large amounts of food service foam at a single location, it’s more practical for them than for curbside collection recycling programs. And many school districts do just that, and have found that recycling foam lunch trays greatly reduces the amount of waste they are sending to landfills. However, according to Dart, most of those districts are in Califor- nia and Michigan. Lack of local examples may be why New York and Chicago are turning to bans instead of recycling. Bans aren’t on the agenda in most places, however, despite the fact that little food service foam recycling occurs in most places. Scott Flagg, an environmental specialist sen- ior with the Iowa Department of Natural Resources, said he isn’t aware of any bans in his state, but he’s also not aware of much recycling going on. Most residential collection of foam is in smaller cities, he said. “The major metro areas haven’t added that to their curbside collection,” Flagg said. U.S. Environmental ProtectionAgency (EPA) regional administratorJudith A. Enck disclosed that the EPAhas begun removing more than 2,000drums and containers of toxic sub-stances from the Superior Barrel &Drum Company facility in Elk Town-ship, New Jersey and sending them outof the area for proper disposal.

The 5.5 acre Superior Barrel andDrum site was a drum recycling andreconditioning business that allegedlycleaned and reconditioned metal andplastic drums for resale, reuse or dis-posal. Information indicates that thefacility began operating in the 1980s andstopped operations sometime in late2012 or early 2013. In August 2013, theEPA found thousands of drums and con-tainers at the site abandoned and left in astate of disrepair. Many had holes, miss-ing tops, bulging on the sides or bottomsor were leaking their contents onto theground. The EPA, after being contactedby the New Jersey Department of Envi-ronmental Protection (DEP), has beenworking for over four months to bringconditions at the site under control andwork toward the removal of the contain-ers and hazardous materials.

“The abysmal storage conditionsand poorly managed toxic chemicalsfound by EPA at this facility are unlaw-ful, threaten the environment and aresimply unacceptable,” said Judith A.Enck, EPA regional administrator. “TheEPA has worked for months with thestate and local governments to get thehazardous materials at this site undercontrol and protect this community.”

Information provided by DEP indi-cates that in early 2010, in response tocomplaints that the number of drumsand containers at the facility was grow-ing, the DEP got the owner to initiate aplan to remove drums, containers andrinse water. DEP stated that this effortwas making slow progress for monthsbut stopped, leading to DEP administra-tive enforcement actions against thecompany. The DEP formally requestedassistance from EPA on August 29,

2013, when it became clear in their viewthat the owner had no intentions ofaddressing the problems at the facility.

EPA was asked by DEP to evaluatethe facility and take appropriate actions toremove any threat posed by substances inthe drums and other containers.

After the facility owner refusedaccess to the site, EPA requested thatU.S. Attorney Paul Fishman in New Jer-sey obtain warrants from a federal judgethat would allow EPA to enter the prop-erty to conduct cleanup work. Under aSeptember 12, 2013 warrant, EPAgained access to the site, installed fenc-ing, warning signs and round-the-clocksurveillance and sampled the contents ofdrums and containers.

The EPA took samples of the contentsof the approximately 2,000 drums andcontainers and stabilized leaking contain-ers and drums by placing them or theircontents into more secure containers. Thesamples revealed that the drums and con-tainers held hazardous materials, includingcorrosive and flammable chemicals, ben-zene, toluene, trichloroethylene, ethylben-zene, xylenes, polychlorinated biphenylsand lead. Exposure to these pollutants canhave serious health effects.

On September 27, 2013, EPAobtained a second federal warrant allow-ing the agency to remove the deterio-rated containers of hazardous materialsfrom the property. The EPA is nowtransporting and properly disposing ofthe contents of the drums and containersat regulated hazardous waste disposalfacilities out of the area. The EPA hasdeveloped a plan to ensure that theremoval of the chemicals is done safely.Fire department and hazardous materialsresponse teams have been consulted.The EPA also continues to monitor theair surrounding the work areas to protectthe public and to keep the municipalgovernment and local communityinformed. The EPA has spent about$800,000 on the cleanup so far andexpects to have completed the removalof drums in the spring.

The EPA is coordinating with ElkTownship, the local fire and policedepartments, the Gloucester CountyHazardous Materials Response Teamand the New Jersey Department ofEnvironmental Protection on the ongo-ing investigation and cleanup at thefacility.

While this site is not on the Super-fund National Priorities List, the Super-fund program operates on the principlethat polluters should pay for thecleanups, rather than passing the costs totaxpayers. The EPA is currently search-ing for parties legally responsible for thecontamination at the site in order to holdthem accountable for the costs of inves-tigation and cleanup.

can’t transport a trailer of 90 percentair,” Flagg said. “They’re going to haveto invest in that second step at the MRFto make it economical.”

When foam isn’t recycled, it goes tothe landfill. Like most materials in alandfill, it will take up space indefinitely.Foam may not be adding to undesirableleachate, Flagg said, but anything thattakes up landfill space is attracting atten-tion. Right now, there is no ban proposedand they are eager to work with busi-nesses that are interested in finding waysto recycle it. “We’re always looking foropportunities for additional recycling,”he said.

Lawmakers in New York and else-where are not as interested in recyclingfoam because banning it makes morepolitical sense, said Betsy Steiner, exec-utive director of the EPS IndustryAlliance, an industry information andadvocacy group in Crofton, Maryland.“For a legislator to get up and say thatthey are doing something to save theenvironment gets them votes. Whether itactually benefits the environment or notis unimportant,” added Steiner.

Since polystyrene foam makes upjust one percent of the material enteringlandfills, she noted, banning it isn’tlikely to make much difference to therate landfills are consumed. “We reallythink they can’t justify these bans for alot of different reasons.” Steiner said.“They’re not reducing solid waste. Sowhat are they accomplishing?”

With its reputation as an environ-mental negative, combined with thewidespread ignorance about its potential

for recycling, a polystyrene foam bancan seem like an accomplishment. Butthat’s not how recycling advocates see it.“It’s a perception issue,” Steiner said.

In New York, recycling advocateshave one year to turn that perceptionaround by showing they can successfullyrecycle the city’s food service foam.Recycling initiatives have support frommany restaurant owners whenever thetopic of bans arises. With paper-basedalternatives costing twice as much asfoam containers, they have good reasonto support recycling efforts.

Westerfield said that recyclingadvocates had received an offer from arecycler to make a long-term commit-ment to take the city’s post-consumerfoam food service material, but the citypursued the ban anyway. Now, given theshort timeline they have to work with,whether or not New York recyclers cando what it will take to avoid the ban isnot clear.

If the city does initiate a ban, itwould go against what environmentallyconscious governments in other coun-tries do to deal with polystyrene, accord-ing to Valkema. “We are one of many

recycling EPS in the world today,” hesaid. “It seems like the U.S. is the onlyplace where you see bans on thematerial.”

In the final analysis, the currenttrend toward expanded polystyrene bansin the U.S. seems primarily driven by acombination of political expediency andinaccurate understandings of how andwhether foam can be recycled. As recy-cling is seen more and more to be aviable alternative, it seems likely thatfewer bans will be enacted and perhapsthat existing ones will be overturned. Itwill take education and effort by recy-cling advocates, but the bottom line isthat both effective recycling techniquesand markets for the recycled materialexist. And that is a double positive thatultimately seems likely to prevail.

“Some materials are more difficultto recycle than others and our material ismore difficult to recycle than some,”said Steiner. “But when you look at itfrom the environmental point of view,saving the environment isn’t alwayseasy. Sometimes you have to put somework and thought behind it. That’s cer-tainly the case with polystyrene.”

Environmental advocates joinedwith business leaders to support Gover-nor Jerry Brown’s plan to invest $30 mil-lion of cap-and-trade proceeds inrecycling, composting, recycled-contentmanufacturing and organic waste toenergy projects. This funding will helpbuild the infrastructure necessary totransition the waste sector from a majorsource of climate pollution to a source ofgreenhouse gas reductions.

Recycling, composting and usingorganic waste to generate renewableelectricity and fuels are proven, costeffective ways to reduce greenhouse gasemissions. Making new products fromrecycled materials helps close the loopby reducing the carbon impact of Cali-fornia’s manufacturing sector, whilesupporting its expansion. These multipleindustries also have a demonstratedtrack record of putting Californians towork, producing twice the environmen-tal benefit when compared to disposal ofthe same materials. Diverting materialsfrom landfills –while expanding domes-tic end uses for the recovered materials –helps achieve multiple state policyobjectives.

“These funds will help create theright economic environment for con-struction of vital anaerobic digestion andcomposting infrastructure that is neces-sary to achieve the state’s 75 percentrecycling goal,” said Mike Sangiacomo,president and chief executive officer ofRecology. “Additionally, the develop-ment of anaerobic digestion will helpcreate green jobs, as well as newmechanical and technological expertisein our industry.”

EPA awards over $460,000for environmental projectsalong the Mexican border

The U.S. Environmental ProtectionAgency (EPA) has awarded $461,368 ingrants to fund 7 environmental projectsalong the California and Arizona U.S-Mexico border.

The projects include restoration ofan important estuary, expansion of amunicipal oil recycling program andseveral efforts to track air pollution inthe region.

The funds were awarded in partner-ship with the Border Environment Coop-eration Commission, under thebi-national U.S.-Mexico EnvironmentalProgram: Border 2020.

The projects selected address thepublic health and environmental protec-tion goals of the Border 2020 Programand are part of the overall environmentalfunding available for the California/BajaCalifornia and Arizona/Sonora regions.The funds will be matched by an addi-tional $354,746 in funding from therecipient organizations.

The bi-national project wasfunded by the San Diego Foundationand EPA’s Border 2020 through a grantto 4walls International. 4walls con-structed bi-national park space usingtrash pulled from the Tijuana RiverValley and tributary canyons. There-purposed trash might have other-wise entered the Tijuana River, harm-ing the fragile ecosystem of theTijuana River National EstuarineResearch Reserve in San Diego. Mex-

Printing-Writing Paper ReportAccording to the report, total print-

•Uncoated free sheet (UFS) papershipments in December increased year-over-year for the fourth time in the last

six months, with shipments 4 percentahead of December 2012. For the year,uncoated free sheet shipments were 2percent below 2012 levels.

Norske Skog and CellMark ABhave agreed to enter into a long termmarketing agreement for sales of pub-lication paper in the Asian markets.

The parties will establish a newdistributor in Singapore, NorCell Asia,which will have the exclusive market-ing rights for all Norske Skog productsto be sold in the Asian markets.

Norske Skog will transfer its currentsales operations and sales staff in Sin-gapore from PanAsia Paper Trading toNorCell Asia.

Norske Skog and CellMark estab-lished a similar long term sales coop-eration for the North Americanmarkets in August 2011. The NorthAmerican sales operations are oper-

ated by NorCell Inc. The parties’ expe-riences from the cooperation in theNorth American markets have trig-gered the expansion of the cooperationbetween the two groups into the Asianmarkets.

Norske Skog expects to releaseapproximately $15 to 20 million inworking capital.

Norske Skog enters agreement with CellMark

United Steelworkers (USW) membersat four paper mill sites in Calhoun, Ten-nessee, Catawba, South Carolina, CoosaPines, Alabama, and Augusta, Georgia,overwhelmingly ratified by a 4 to 1 margina master agreement with Resolute ForestProducts, a producer of newsprint and spe-cialty and coated paper.

The 5 year master agreement covers1,500 members in 7 USW local unions. Italso impacts mill workers who are mem-bers of the International Brotherhood ofElectrical Workers and United Associationof Journeymen and Apprentices of thePlumbing, Pipefitting and Sprinkler FittingIndustry of the U.S. and Canada (UA).

The contract improves wages in eachof the five years of the master agreement,secures high-quality health care andensures the Resolute mills continue to bethe most efficient plants.

This second-generation master agree-ment builds upon the first one negotiatedfour years ago when AbitibiBowater Inc.was undergoing bankruptcy. AbitibiBowa-ter now does business as Resolute ForestProducts. The USW negotiated the firstmaster agreement as part of a strategy toenable Resolute to successfully completeits reorganization and emerge from credi-tor protection under the Companies’ Cred-itors Protection Act in Canada and chapter11 of the U.S. Bankruptcy Code in 2010.

The Alliance of Automobile Manu-facturers (Alliance), the Association ofGlobal Automakers (Global), the Automo-tive Aftermarket Industry Association(AAIA), and the Coalition for AutomotiveRepair Equality (CARE) disclosed theircollective acceptance of a national agree-ment to ensure consumer choice in post-warranty auto repair, decisively ending thelongstanding “Right to Repair” debatewithin the industry.

The national agreement is based on arecent law finalized in the Commonwealthof Massachusetts (Chapter 165 of the Actsof 2013). The signed Memorandum ofUnderstanding (MOU) extends the essen-tial provisions for all light vehicles negoti-ated in the Massachusetts law nationwide;it impacts all companies and organizationsthat are currently members of the signa-tory associations.

This national agreement ensures theAlliance, Global, AAIA, and CARE will

stand down in their fight on “Right toRepair” and work collectively to activelyoppose individual state legislation whileour respective groups work to implementthis MOU. In the meantime, the partiesagree that further state legislation is notneeded and could serve to weaken theeffectiveness and clarity of the MOU.

“Since the first Right to Repair Actwas introduced in Congress in 2001,CARE and the automotive aftermarkethave worked to ensure our customers con-tinue to have the right to choose wherethey buy their parts and have their vehiclesserviced,” said Ray Pohlman, president ofCARE. “This agreement will ensure vehi-cle owners will have competitive and qual-ity choices in their repairs whilestrengthening the auto repair industrynationwide. This agreement illustrateswhat can happen when organizations focuson putting customers and consumers first,”Pohlman said.

Auto inspection business chargedwith falsifying emissions test results

New Jersey acting attorney generalJohn J. Hoffman disclosed that threemen who operate a private auto inspec-tion business in Paterson were chargedwith fraudulently using data simulatorsto generate false results for motor vehi-cle emissions inspections. The menallegedly took payments from customersin return for using the electronic devicesto generate passing results for vehiclesthat had failed emissions inspections.

The charges are the result of a jointinvestigation by the Division of CriminalJustice, the New Jersey Motor VehicleCommission and the New Jersey Depart-ment of Environmental Protection.

The Division of Criminal Justicecharged the following individuals withsecond-degree conspiracy, second-degree computer crimes and third-degreetampering with public records or infor-mation:

•Christopher Alcantara of Paterson,owner of Five Stars Auto Inspection,which is located in Paterson.

•Mariano Alcantara of Clifton. •Lewis Alcantara-Sosa of Paterson.Christopher and Mariano Alcantara

were arrested by detectives of the Divi-sion of Criminal Justice and were lodgedin the Bergen County Jail with bail set at$50,000 for each. Lewis Alcantara wascharged by summons and was releasedwithout posting bail after he wasprocessed on the charges.

Most passenger cars and light-dutyvehicles of model year 1996 or laterhave an onboard diagnostic (OBD) sys-

tem that monitors the vehicle’s emis-sions system. During an OBD inspec-tion, an inspector at a private inspectionfacility or a central inspection facility(CIF) connects state-approved inspec-tion equipment to a standardized datalink connector in the vehicle to retrieveOBD data in order to determine whetherthe vehicle passes or fails.

It is alleged that, on numerous occa-sions during the past year, the defen-dants temporarily installed OBDsimulators in place of the data link con-nector in vehicles that had failed emis-sions inspections. The defendantsallegedly charged customers up to $150in return for using OBD simulators.

During the course of the investiga-tion, investigators conducted surveil-lance of the defendants and Five StarsAuto Inspection. In addition, theyallegedly arranged for the defendants toinstall OBD simulators in two under-cover vehicles so that they would passinspection. Investigators executed asearch warrant today at Five Stars AutoInspection, where they seized evidenceincluding OBD simulators and records.

Second degree crimes carry a sen-tence of 5 to 10 years in state prison anda fine of up to $150,000. In addition, thecharge of second degree computercrimes carries a mandatory period ofparole ineligibility equal to one-third toone-half of the sentence imposed. Thirddegree crimes carry a sentence of 3 to 5years in state prison and a fine of up to$15,000.

project was selected as a model projectfor “verification of the battery storagecontrol to promote renewable energy”for the fiscal year 2013 by the Ministryof the Environment of Japan.

Sumitomo Corporation created thejoint venture company, “4R Energy Cor-poration,” in collaboration with NissanMotor Co., Ltd. in September 2010, toaddress the secondary use of EVlithium-ion batteries. The used EV bat-teries that will be recycled into thislarge-scale storage system have beenrecovered and have gone through thor-ough inspection and maintenance at 4R,to confirm safety and performance. Thisprototype system (600kW/400kWh)consists of 16 used EV batteries.

New York to provide funding todairy farmers to convert waste

New York Governor AndrewCuomo will make available nearly $21million to New York dairy farmers toconvert farm waste to energy.

Cuomo said the project aims to helpdairy farmers convert farm waste toenergy and develop business and envi-ronmental plans to reduce operatingcosts and increase profitability.

Most of the funding targets anaero-bic digestion. “Farmers that utilizeanaerobic digester technology are able toproduce renewable energy and lowertheir costs while providing a number ofenvironmental benefits to their localcommunities,” said John Rhodes, presi-dent and chief executive officer, NewYork State Energy Research and Devel-opment Authority (NYSERDA).

Twenty million dollars will be avail-able through NYSERDA to install anaer-obic digester technology that producesrenewable biogas used to produce elec-tricity and heat from organic waste.Farms, food processing manufacturers ormunicipal wastewater sites will be eligi-ble for up to $2 million per project.

During the past 10 years,NYSERDA and the New York PowerAuthority have awarded nearly $30 mil-lion toward anaerobic digestion projects

and related technology. The funding cur-rently supports 20 operational digesterprojects.

The digester technology fundingwill be available on a first-come, first-served basis for eligible projects.

Funding for the Dairy AccelerationProgram (DAP) will be increased by$850,000, which is in addition to the $1million previously announced by thegovernor in August.

Payments under DAP may include:up to $5,000 per farm to write a businessplan or develop a combination of a busi-ness and facility growth plan; and up to$4,500 to update an existing Compre-hensive Nutrient Management Plan(CNMP) or $6,000 to develop a newone. Additional funds also will be avail-able to design farm practices describedin CNMPs. CNMPs are a conservationsystem for animal feeding operationsdesigned to address soil erosion andwater quality concerns. The CNMPencompasses the storage and handling ofmanure as well as using and applyingmanure nutrients on farm land. ThroughDAP, the state awarded dozens of proj-ects already for farms with an averageherd of about 140 cows.

Dominion begins operations ofenergy facilities in Connecticut

Dominion has begun commercialoperations at its Dominion BridgeportFuel Cell facility located in Bridgeport,Connecticut, and the Dominion SomersSolar Center located in Somers, Connecti-cut. Together, the two facilities produceapproximately 20 MW of clean energy forthe people of Connecticut, enough powerfor approximately 20,000 homes.

Dominion Bridgeport Fuel Cell isproducing 14.9 MW of clean energy usingan electro-chemical process that efficientlyconverts natural gas into electricity.

Dominion Bridgeport Fuel Cell is partof Project 150, a program sponsored bythe state and supported by the CleanEnergy Finance and Investment Authority(CEFIA) to increase renewable and clean

energy projects in Connecticut by 150MW. CEFIA is the nation’s first full-scaleclean energy finance authority that lever-ages public and private funds to driveinvestment and scale up clean energydeployment in Connecticut.

FuelCell Energy Inc. (FCE) willoperate and maintain the facility under aservices contract with Dominion. FCE issupplying five Direct FuelCell stationaryfuel cell power plants and an organicrankine turbine that will convert wasteheat from the fuel cells into additionalelectricity.

Dominion will sell the output of thefuel cell power station and solar center toConnecticut Light & Power under fixedpower purchase agreements.

CONSTRUCTION & DEMOLITIONSurvey finds increased use ofrecycled materials in asphalt

In a survey of the use of recycledmaterials and warm-mix asphalt usageby the U.S. asphalt pavement industry,nearly a quarter of all asphalt mixturesproduced in the 2012 construction sea-son used warm-mix asphalt (WMA)technologies.

The survey, conducted by theNational Asphalt Pavement Association(NAPA) under contract to the FederalHighway Administration (FHWA),found that the 1,141 U.S. asphalt plantsqueried produced about 86.7 milliontons of WMA during the 2012 construc-tion season. This marks a 416 percentincrease in the use of warm mix sincethe survey was first conducted in 2009.

Because WMA is produced at a lowertemperature than traditional asphalt mixes,it uses less energy to produce, reducesemissions, improves worker safety andoffers construction benefits. U.S. Secretaryof Transportation Anthony Foxx com-mented in January during the 2014 Trans-portation Research Board Annual Meetingthat the use of WMA is expected to save$3.6 billion in energy costs alone by 2020.

Asphalt pavements also use increas-ing amounts of recycled materials. Thesurvey found that 68.3 million tons ofreclaimed asphalt pavement (RAP) and1.86 million tons of recycled asphalt shin-gles (RAS) were used in new asphalt pave-ment mixes in 2012. For the first timesince the start of this survey in 2009, theamount of RAP and RAS used by produc-ers exceeded the amount collected.

The use of RAP and RAS duringthe 2012 paving season translates to asavings of 21.2 million barrels of liquidasphalt binder, saving taxpayers some$2.2 billion. When reclaimed asphaltpavement and shingles are reprocessedinto new pavement mixtures, the liquidasphalt binder in the recycled material isreactivated, reducing the need for virginasphalt binder.

Compared to previous surveys, con-ducted annually since the 2009 construc-tion season, the use of recycled materialshas continued to increase.

In 2012, RAS usage reached 1.86million tons – a 56 percent increase over2011, and a 165 percent increase since2009. Since 2009, RAS usage has beenreported in 37 states. RAS includes bothmanufacturer scrap shingles and post-consumer roofing shingles.

RAP usage also continued to climb,increasing to 68.3 million tons in 2012, anearly 22 percent increase from 2009.More than 99 percent of asphalt pavementreclaimed from roads went back into newroads. In the survey, 98 percent of produc-ers reported using RAP in their mixes.

The 2012 survey also asked for thefirst time about the use of ground tirerubber, steel and blast furnace slags, andother recycled materials. Althoughnational estimates of these products’usage were not calculated, more than 1million tons of other recycled materialswas reported as being incorporated intoasphalt mixtures.

A Portland city council task forceproposal would attach a $.10 “wastereduction fee” for each disposable shop-ping bag used in the city of Portland.The proposal has won the endorsementof a special working group and will headto a City Council subcommittee forreview.

Originally, the proposed fee wouldapply to bags given out by grocery andconvenience stores but has beenextended to include dry cleaners, restau-rants and food trucks and farmers markets.

The fee would be charged for bothplastic and paper bags and is intended toencourage the use of reusable shoppingbags and reduce litter.

Opponents of the idea, including agroup representing Maine grocers, hassaid a fee would encourage people toshop outside Portland, and that educa-tion and recycling are better solutions tothe litter problem.

Under the ordinance, stores wouldget to keep 40 percent of the feescharged, in order to administer the pro-gram, train staff, and educate customersabout recycling of disposable bags andalternatives such as reusable ones. Thecity would receive 60 percent of the fees,and would use the funds for a variety ofenvironmental cleanup measures.

The surcharge, if approved, will gointo effect by the end of 2014.

Maryland proposes bottle billThe Maryland Public Interest

Research Group (PIRG) delivered 7,500signed petitions to Gov. Martin O’Mal-ley in support of a bottle bill.

The bottle bill would mean $.05back in consumer’s pockets for each canor bottle recycled in Maryland.

“With the bottle bill, Maryland hasthe opportunity to get to an achievablegoal of 80 percent container recycling by2020,” said Joanna Guy with PIRG.

Under the proposed bottle bill, con-sumers would bring their bottles andcans to deposit spots and redeem themfor cash.

The bill also proposes distributorschange their labels to reflect a $.05

redeemable deposit by April 2015. Ifapproved, the program is expected to gointo effect in 2016.

Maryland’s deposit refund cam-paign is being led by an industry con-sortium. Owens-Illinois and Alcoa arethe driving force between the 2013refund bill, supported by a number ofenvironmental organizations includingthe Chesapeake Bay Foundation, Mary-land League of Conservation Voters,Abell Foundation, EnvironmentalFinance Center at the University ofMaryland, National Aquarium in Balti-more, Alice Ferguson Foundation, BlueWater Baltimore and the AnacostiaWatershed Society.

California court upholds ban The California Court of Appeal has

affirmed California’s cities’ right to bansingle-use plastic bags. The court agreedto publish its unanimous decision touphold San Francisco’s plastic bag banin a December 10 decision, creating alegal precedent on which other citiesmay rely. The ruling sets the stage formore cities to adopt local laws phasingout plastic bags, and to strengthen theirexisting laws by expanding them toinclude restaurants.

Environment California Research &Policy Center, the City and County of SanFrancisco, the California League of Cities,and the California State Association ofCounties all filed motions asking the courtto publish its opinion. Plastics industryplaintiffs may still appeal the decision tothe California Supreme Court.

So far, 90 California local govern-ments have banned single-use plastic bags.Together, these jurisdictions representnearly one in three Californians.

Novelis reported net income attributa-ble to its common shareholder of $13 mil-lion for the third quarter of fiscal 2014.Excluding certain tax-effected items, netincome was $23 million for the quarter, up$14 million compared to $9 millionreported in the same period a year ago.

Adjusted EBITDA for the third quar-ter of fiscal 2014 was $203 million, up 10percent compared to $185 million reportedfor the same period in the prior year. Theincrease was driven primarily by higherglobal shipments partially offset by con-tinued pricing pressures in North Americaand Asia and reduced scrap benefits fromlower aluminum prices.

“Our execution in the third quarterwas excellent,” said Phil Martens, presi-dent and chief executive officer for Nov-elis, “with year-over-year shipment

growth in every operating region. Wehave made great progress in the com-missioning of our major expansions andwe are now seeing the benefits of someof these projects in our results. Whileexternal market pressures partially offsetthe bottom line impact of this volumegrowth, we are confident about the real-izable potential for this business as thenew projects come on-line.”

Shipments of aluminum rolled prod-ucts totaled 721 kilotonnes for the thirdquarter of fiscal 2014, an increase of 11percent compared to 647 kilotonnes forthe same period last year. Despite being aseasonally low production quarter, ship-ments were up one percent sequentiallycompared to the second quarter. Net salesfor the third quarter of fiscal 2014 were$2.4 billion, up 4 percent compared to the

prior year resulting from higher shipmentspartially offset by a 12 percent decrease inaverage aluminum prices and lower con-version premiums.

The Company continues to seestrong demand for aluminum flat rolledproducts globally, particularly in theautomotive segment. In December, theCompany announced a $205 millioninvestment to further expand its globalautomotive aluminum capacity to900,000 tons annually.

For the third quarter of fiscal 2014,Novelis reported liquidity of $806 mil-lion. Free cash flow was negative $61million for the third quarter of fiscal2014, in part due to $107 million insemi-annual bond interest payments and$157 million in capital expenditures.

Novelis reports third quarter results

The Timken Company reportedsales of $4.3 billion for 2013, a decreaseof 13 percent from the prior year. Thedecline reflects lower demand acrossmost of the company’s broad end mar-kets. In addition, a $117 million declinein steel segment raw material surchargesfrom the prior year period furtherdecreased revenues. The reduction insales was partially offset by the benefitof acquisitions of $86 million in thecompany’s Mobile Industries andProcess Industries segments and fromstrength in the steel segment’s automo-tive end-market sector.

In 2013, the company generated netincome of $262.7 million, or $2.74 perdiluted share, compared with $495.5million, or $5.07 per diluted share, ayear ago. Results for 2013 included$32.8 million of after-tax expense, or$0.35 per diluted share related to taxexpense incurred on the repatriation ofoverseas cash, tax benefits associatedwith the reversal of certain income taxreserves from prior years, separationcosts associated with the proposed spin-off of the steel business, costs related topreviously announced plant closures andother unusual items. Excluding these

items, 2013 net income was $295.5 mil-lion, or $3.09 per diluted share. Thiscompares with 2012 net income of$464.6 million, or $4.76 per dilutedshare, excluding costs related to previ-ously announced plant closures andContinued Dumping and Subsidy OffsetAct (CDSOA) receipts. The decrease inearnings primarily reflects lower volumeand manufacturing utilization as well asunfavorable sales mix, which was par-tially offset by lower raw material andselling and administrative expenses aswell as favorable pricing.

Hornell Waste Materials (now knownas Ben Weitsman of Hornell) was foundedin 1908 and is the oldest recycling busi-ness in the Hornell area.

The company is located in a regionunderserved by recycling infrastructure,with other facilities located twenty andthirty miles away; having a state-of-the-artfacility in Hornell will meet this need aswell as stimulate the economy in the localarea.

When adding new scrap yards to theUpstate Shredding-Ben Weitsman feederyard network, several millions of dollarsare spent bringing new yards up to mod-ern operating standards. Typicalimprovements include new scrap recycling equipment, renovation ofexisting facilities, erection of new build-ings, paved yards, new fencing and land-scaping to provide a clean operatingenvironment and aesthetically appealingfacility.

Based on preliminary CensusBureau data, the American Iron andSteel Institute (AISI) reported that theU.S. imported a total of 2,502,000 nettons (NT) of steel in December 2013,including 1,884,000 NT of finished steel(down 3.5 percent and 1.5 percent,respectively, versus November finaldata). 2013 full year total and finishedsteel imports are 32,146,000 and24,825,000 NT, respectively, each down4 percent versus full year 2012. Finishedsteel import market share was an esti-mated 22 percent in December and isestimated at 23 percent for full year2013.

Key finished steel products with asignificant import increase in December2013 compared to November are hotrolled sheets (up 25 percent), hot rolledbars (up 22 percent), standard pipe (up19 percent), sheets and strip hot dippedgalvanized (up 18 percent) and line pipe(up 13 percent). Major products withsignificant full year 2013 importincreases versus full year 2012 include

reinforcing bars (up 23 percent) and hotrolled bars (up 15 percent).

In December, the largest volumes offinished steel imports from offshore wereall from Asia and Europe. They were fromSouth Korea (300,000 NT, up 21 percentversus November final), Japan (146,000NT, up 4 percent), China (143,000 NT,down 12 percent), Germany (94,000 NT,

down 9 percent) and India (65,000 NT, up135 percent). For full year 2013, thelargest offshore suppliers were SouthKorea (3,718,000 NT, up 2 percent versus2012), China (1,898,000 NT, up 15 per-cent), Japan (1,894,000 NT, down 2 per-cent), Turkey (1,204,000 NT, down 11percent) and Germany (1,112,000 NT,down 13 percent).

Steel imports decrease in December

Steel import permit applications increaseBased on the Commerce Depart-

ment’s most recent Steel Import Moni-toring and Analysis (SIMA) data, theAmerican Iron and Steel Institute (AISI)reported that steel import permit applica-tions for the month of January total3,080,000 net tons (NT). This was a 19percent increase from the 2,582,000 per-mit tons recorded in December and 23percent increase from the December pre-liminary imports total of 2,502,000 NT.Import permit tonnage for finished steelin January was 2,414,000, up 28 percentfrom the preliminary imports total of1,884,000 in December. The estimated

finished steel import market share inJanuary was 26 percent.

Finished steel imports with largeincreases in January permits vs. theDecember preliminary included rein-forcing bars (up 165 percent), wire rods(up 151 percent), sheets and strip allother metallic coatings (up 115 percent),plates in coils (up 57 percent), oil coun-try goods (up 36 percent), sheet and stripgalvanized hot dipped (up 30 percent)and hot rolled sheets (up 28 percent).

In January, the largest finished steelimport permit applications for offshorecountries were for South Korea (387,000

NT, up 29 percent from December pre-liminary), China (199,000 NT up 39 per-cent), Japan (179,000 NT, up 22percent), Turkey (172,000 NT, up 280percent) and The Netherlands (99,000NT, up 63 percent).

Raleigh Recycling NC., whichoperates Raleigh Metal Recycling andGoldsboro Metal Recycling has enteredinto a long term operating agreementwith J&G Scrap Metal Recycling inWilson, North Carolina.

“With all the changes in North Car-olina metal theft laws, we wanted topartner with a company that could sup-port us with technology that wouldensure we met all aspects of the lawand when we heard that the RaleighMetal Recycling operation and theirtechnology was written up on CNBC’swebsite and the Wall Street Journal, ithelped us make our decision,” said JeffCharles owner of J&G Scrap MetalRecycling.

The company is now called WilsonMetal Recycling JG. The recyclingcenter will be expanding into electron-ics recycling which will include com-puter recycling and all types of e-wasterecycling. The new Wilson MetalRecycling JG will also be buying alltypes of batteries for recycling. Theywill continue buying from the public aswell as industrial and demolition companies.

Lancaster County acquiresSusquehanna ResourceManagement Complex

The Lancaster County Solid WasteManagement Authority (LCSWMA) inPennsylvania has acquired the Susque-hanna Resource Management Complex(SRMC), formerly known as the Harris-burg Resource Recovery Facility, for atotal purchase price of $129,898,000.

As part of the transaction,LCSWMA receives $16 million towardsthe purchase price: $8 million from theprevious owner and $8 million from theCommonwealth of Pennsylvania. Thepurchase is supported by 20-year wastedisposal contracts with the City of Har-risburg and Dauphin County, in additionto a 20-year power purchase agreementwith the Commonwealth of Pennsylva-nia’s Department of General Services.

This project boasts the first publicto public acquisition of a waste-to-energy (WTE) facility in the UnitedStates and was a key ingredient in reliev-ing the distressed City of Harrisburgfrom over $360 million of debt.LCSWMA’s newly expanded systemwill now manage approximately 900,000tons of solid waste with annual revenuesof approximately $85 million.

As new owner, LCSWMA is nowfully managing the site, which includesan 800 tons-per-day, 3-boiler mass burnWTE facility, a transfer station, and twoash landfills. Covanta Energy will con-tinue operating the WTE facility portion

of the site under an amended agreementwith LCSWMA.

LCSWMA’s business plan includesa series of capital improvements to thesite over the next 4 years totaling$18.25 million, including: installingnew scales and implementing trafficflow patterns to improve on-site timefor customers; constructing a new smallvehicle drop-off building for residentsand deliveries of construction/demoli-tion waste; and purchasing equipmentfor upgrades to the WTE facility, aswell as other improvements.

The SRMC serves as the drop-offlocation for waste haulers who collectrefuse in Dauphin County and the Cityof Harrisburg. The SRMC, originallyconstructed in 1972 and renovated with3 new boilers and a new turbine genera-tor set in mid-2000s, can generate up to23 MW of renewable energy. The facil-ity will process approximately 275,000tons of waste and generate 130,000megawatt-hours of renewable energyeach year. Two ash landfills are alsolocated on the SRMC site – one thatclosed in 1980 and the other whichstages ash from the WTE facility onsite. Once the staged ash is dry, it istransported to LCSWMA’s Frey FarmLandfill and used as alternative dailycover.

New survey data suggests thatAmericans would be open to compost-ing in their homes if it were more con-venient. However, the same nationalsurvey found that they don’t want topay additional fees or taxes to supportsuch services.

While 72 percent of Americans donot compost their food waste, 67 per-cent of these non-composters would bewilling to if it were more convenient todo so in their community, according toa new survey conducted online amongmore than 2,000 adults in December byHarris Interactive and commissioned bythe National Waste & Recycling Asso-ciation, the trade group representingAmerica’s private-sector waste andrecycling industry.

However, the survey also foundthat 62 percent would not support anincrease in the cost of their waste andrecycling service, either in the form of aseparate fee or an increase in taxes, ifnecessary to support separate food andyard waste collection and processing.

“Waste and recycling experts agreethat increased conversion of organicsinto either compost or energy sources isan evolving trend in our industry,” saidSharon H. Kneiss, president and CEOof the National Waste & RecyclingAssociation. “While America’s wasteand recycling industry has developedinnovative composting technologies,there are hurdles inhibiting suchchanges. Challenges include the collec-tion and transportation of food wasteand the siting of food waste compostingfacilities more broadly. But a far greaterhurdle inhibiting an organics revolutionmay involve a lack of understanding bythe American public about the value ofsuch a change.”

Major findings of the surveyinclude:

•More than three-quarters of Amer-icans (77 percent) say that they under-stand the importance of implementing aseparate management process forfood/yard organic material wasteinstead of disposing of it with generalhousehold waste.

•More than two-thirds of those whodo not compost via community pro-grams (68 percent) say they would bewilling to manage another bin to sepa-rate food waste from recyclables andother trash if their community imple-mented a program requiring them to doso.

•Among Americans who have gar-dens or a yard, 4 in 5 (79 percent) saythey would be willing to use gardeningfertilizers, mulch and other productsmade from food waste compost.

This survey was conducted by Har-ris Interactive on behalf of the NationalWaste & Recycling Association among2,051 adults ages 18 and older.

WASTECalifornia introduces greenwaste diversion bill AB 1594

California Assembly member DasWilliams introduced AB 1594, whichwould encourage local governments todivert their green waste from landfills.

Compostable organic materials cur-rently comprise about one-third of what isdisposed in landfills annually. Much ofthis material is used as alternative dailycover (ADC), a temporary overlay on anexposed face of a landfill, which providesa barrier from odor and insects at the endof the work day.

Williams said green waste should beused as compost instead.

“Global warming is the moral issue ofthe next hundred years,” Williams said.

“The major question is: Are we willing tochange business as usual to avoid pro-foundly hurting less fortunate peoplearound the world and in our own country?These materials should be properly com-posted so we as a state can reduce our contribution to global warming.”

Existing law authorizes green wasteto be used as an alternative daily cover andexempts green waste from a statewide dis-posal fee. This exemption, with the recy-cling credit local governments receivetoward their diversion goals, ends upencouraging the use of green materials forADC instead of other more environmen-tally friendly uses.

EPA takes step to implementHazardous Waste ElectronicManifest Establishment Act

The U.S. Environmental ProtectionAgency (EPA) issued a final rule that is acrucial step in the development of anational electronic manifest (e-Manifest)system, which will upgrade the currentpaper-based system of tracking hazardouswaste to an electronic one.

Mathy Stanislaus, EPA assistantadministrator for the Office of Solid Wasteand Emergency Response, said, “Oncefully implemented, the national e-Manifestsystem will provide greater access foremergency responders to informationabout the types and sources of hazardouswaste that are in transit between generatorsites and waste management facilities.”

The final rule authorizes the use of e-Manifests to track hazardous wastes underthe Resource Conservation and RecoveryAct. This will allow the current process,which requires paper forms, to be stream-lined and greatly reduce the millions ofpaper manifests produced each year.

The Hazardous Waste ElectronicManifest Establishment Act requires EPAto issue a regulation authorizing the use ofelectronic manifests as the legal equivalentof the current paper manifest forms used totrack shipments of hazardous waste from agenerator’s site to the ultimate site of dis-posal. EPA’s goal is to promote the great-est possible use of electronic manifests.

The e-Manifest program is the van-guard of the agency-wide initiative todevelop new tools to reduce the reporting

burden on regulated entities, and providethe agency, states and the public with eas-ier access to environmental data. EPA esti-mates the national e-Manifest system willultimately reduce the burden associatedwith preparing shipping manifests bybetween 300,000 and 700,000 hours, andresult in cost savings of more than $75million per year for states and industry. Inline with the agency’s e-Enterprise princi-ples, the e-Manifest system will signifi-cantly improve access to higher qualityand more timely waste shipment data, andwill empower communities throughincreased transparency and more accurateinformation on completed waste ship-ments and management trends.

The final rule will establish the legaland policy framework for using electronicmanifests; however, several more stepswill be needed before the e-Manifest pro-gram can be implemented. These includeestablishing the system and initial feestructure. This year, EPA will work withstates, industry and other stakeholders todevelop plans for many key aspects of thesystem and address concerns of intersys-tem compatibility. The Agency will alsobegin developing the initial fee structure ofthe system, including implementation andcompliance dates, through a rulemaking.Stakeholders and interested parties willhave the opportunity to comment on theproposed rule when it becomes available.

New York City partnerswith WM on organics

New York City Deputy Mayor CasHolloway, department of environmentalprotection (DEP) commissioner CarterStrickland, and sanitation commissionerJohn Doherty disclosed two new partner-ships that will reduce the amount oforganic waste sent to landfills, produce areliable source of clean energy andimprove air quality.

Waste Management has begundelivering pre-processed organic foodwaste to the Newtown Creek WastewaterTreatment Plant where it is added towastewater sludge to increase the pro-duction of biogas. In addition, a first-of-its kind project with National Grid willconvert the biogas by-product intopipeline quality renewable natural gasfor residential and commercial use.Together, these projects have the poten-tial to produce enough energy to heatnearly 5,200 New York City homes,reduce annual greenhouse gas emissionsby more than 90,000 metric tons andhelp city government reach its goal ofreducing municipal greenhouse gasemissions by 30 percent by 2017.

Biogas, which is mostly methane, isa by-product of the wastewater treatmentprocess. Methane is also the main com-ponent of natural gas. DEP currentlyreuses approximately 40 percent of thebiogas produced at the Newtown CreekWastewater Treatment Plant, and thenew partnership with National Grid will

ensure that 100 percent of it goes to ben-eficial reuses and does not contribute togreenhouse gas emissions from theplant. National Grid will finance thedesign, construction, operation andmaintenance of the biogas purificationsystem, and initially DEP will providethe biogas free of charge. Once projectcosts have been recouped, profits will besplit between DEP and National Grid’scustomers. Construction of the purifica-tion system will begin in 2014 and isexpected to be completed in 2015.

Over the summer of 2013, WasteManagement’s Varick I transfer facilityin Brooklyn began processing organicfood waste collected from local schoolsinto a liquefied feedstock using the com-pany’s Centralized Organic Recyclingequipment process. The feedstock isdelivered in sealed tankers to the New-town Creek Wastewater Treatment Plantwhere it is added to wastewater sludge toproduce additional biogas. Waste Man-agement is currently processing 2 tonsper day of organic waste at the Varick Ifacility and plans to increase its volumeto 5 to 10 tons per day during the initialpilot phase, with the potential to raisecapacity to 250 tons per day over thenext 3 years. If the pilot proves success-ful, there is the potential to process up to500 tons of organic food waste per dayat the Newtown Creek Plant.

Hagenbuch grants patentlicense for RFID-based refusecontainer collection

Inventor and entrepreneur LeRoy G.Hagenbuch has granted a non-exclusivelicense related to a portfolio of patentsdirected to radio frequency identification(RFID)-based refuse container interroga-tion and collection.

Toter LLC is a waste managementcompany in Charlotte, North Carolina.Toter is the second party in the U.S.authorized to sell systems, such as itsSmartWay III System, under Hagen-buch’s patents. Hagenbuch said heintends to continue enforcing his patentsin the waste industry, but is willing togrant licenses under his patents on rea-sonable financial terms.

The patents licensed to Toter gener-ally relate to the use of RFID tagsembedded in refuse containers such ashousehold carts or larger containers andbins. Collectively, those patents cover,among other things, processes for refusecollection whereby records are gener-ated for cart loading location, the iden-tity of the cart being loaded, the time ofcollection and/or the weight of materialin the carts being loaded. Some or all of

this information may be downloaded to acentral location and used for any numberof purposes, including fleet manage-ment, customer billing and confirmationof refuse container pickup.

In addition, a number of the patentclaims cover refuse collection processesdesigned to ensure that a collectionevent is recorded only when the contentsof a cart are actually loaded into ahaulage vehicle. This helps waste andrecycling collection companies avoidfalse positives, which can occur where avehicle interrogates a refuse cart butloading does not occur.

Hagenbuch has obtained more than60 patents in the U.S. alone. Included inthe portfolio of patents licensed to Toterare U.S. Patent Nos. 5,327,347,5,416,706, 5,631,835 and 5,644,489. Inaddition to Toter, licensees of his tech-nologies and patents have included OttoEnvironmental Systems North AmericaInc., Caterpillar and Komatsu, amongothers. Hagenbuch is the Co-Founder ofPhilippi-Hagenbuch, Inc., Peoria, Illi-nois and serves as its chief engineer.

Maui mayor signs integratedwaste conversion agreement

Maui Mayor Alan M. Arakawa exe-cuted an agreement with the MauiResource Recovery Facility, LLC, tofinance, design, construct, own and oper-ate a state-of-the-art resource recoveryfacility, which will divert approximately85 percent of the county’s municipal solidwaste from disposal in the Central MauiLandfill. The facility is anticipated to befully operational in 2017.

In addition to dramatically increasingdiversion, the facility will include a “recy-clable materials recovery facility” to sepa-rate recyclable materials. The waste thenwill be further separated into digestibleorganic fraction and residual matter.

The organic fraction will go to aclosed anaerobic digester, which will pro-duce renewable natural gas and other mar-

ketable commodities. The residual matterwill be processed into a clean solid fuelthat can be used to replace imported coal.The facility’s power needs will be largelymet by creating electricity using the land-fill gas and renewable gas as a fuel source.

Anaergia specializes in recoveringvalue from waste for the municipal, indus-trial and agriculture sectors worldwide,and has included a team of Hawaii-basedpartner firms for development, construc-tion and operation of Maui ResourceRecovery Facility. The project will providean estimated 150 construction jobs and upto 40 operations jobs, and has received sig-nificant support from the trades unions,members of the community and environ-mental organizations like NationalResources Defense Council.

Rehrig Pacific Company has addedroll-out cart production to its Orlando,Florida plant. Rehrig Pacific will haveroll-out cart production capacity in thefacility during the first half of 2014.

The company has been actively serv-ing the Florida market over the past 8years by producing both 14 and 18 gallonrecycling bins in Orlando. In 2010, theFlorida Legislature passed a bill requiringthe State of Florida to achieve a recyclingrate of 75 percent by 2020. At that time, itbecame apparent that single stream recy-cling would be one component in thateffort.

Rehrig Pacific expandsroll-out cart production

The Institute of Scrap RecyclingIndustries (ISRI) has hired Brady Millsto act as director of law enforcementoutreach. In this new role created byISRI, Mills will be responsible for work-ing with the recently formed LawEnforcement Advisory Council todevelop and implement a law enforce-ment training program as well as coordi-nate outreach with the law enforcementcommunity.

Mills recently retired from the U.S.Secret Service after more than 27 years.He began his career in the Secret Servicein 1986 in the Detroit Field Office fol-lowed by field assignments in the Wash-ington and Fresno offices, and asResident Agent in Charge of the Sacra-mento office.

From 1994 through 1998, he servedon the Presidential Protective Division,including a period as team leader on theCounter Assault Team. From 2006through 2012 he held headquartersassignments in the Inspection Divisionand the Office of Training at the RowleyTraining Center. Mills ended his careerwith the Service as the special agent incharge of the Secret Service Liaison Divi-sion. Prior to his career with the SecretService, Mills served as a trooper for fiveyears with the Pennsylvania State Police.

Mills named as director oflaw enforcement outreach

Vecoplan Integrated Controls hasadded Henry Gilliland to its electricalengineering team. Gilliland brings threeyears of practical experience to his newposition at VIC. Working first on a co-opbasis at Highland Industries while pursu-ing his undergraduate degree from NorthCarolina State, and then upon completion,as a full time engineer with the company.

Gilliland’s responsibilities willinclude working with senior engineers tocoordinate the design and development ofindividual machine control panels andturnkey integrated control systems forindustrial processing lines and manufac-turing plants. In order to ensure continuousquality control, he will also be a teammember overseeing the manufacture andimplementation of projects once the engi-neering phase has been completed.

Gilliland joins VIC ElectricalEngineering

U.S. Environmental ProtectionAgency administrator Gina McCarthydisclosed the selection of HeatherMcTeer Toney as regional administratorfor EPA’s regional office in Atlanta,Georgia. EPA Region 4 includes Ala-bama, Florida, Georgia, Kentucky, Mis-sissippi, North Carolina, South Carolina,Tennessee and six tribal nations.

McTeer Toney was the first African-American and first female to serve as themayor of Greenville, Mississippi, hold-ing that post from 2004 to 2012. Shejoins EPA from Mississippi Valley StateUniversity, where she is the executivedirector of the Center for Excellence inStudent Learning. She is also the princi-pal attorney at Heather McTeer, PLLC.

McTeer Toney’s private-sector suc-cess is complemented by considerableexperience in local and state politics. Shebegan her career working as a member ofMcTeer and Associates Law Firm andhandled a diverse group of cases rangingfrom racial discrimination to medicalmalpractice. Later she served as the pres-ident of the National Conference of BlackMayors and in 2009, was nominated byformer EPA administrator Lisa P. Jack-son, to serve as the chairwoman of theLocal Government Advisory Committee.

Metal theft is a serious problem andone of the fastest growing crimes in thecountry. Copper, aluminum, nickel, stain-less steel and scrap iron have become aneasy target for thieves looking to make aquick buck. The only proven way to com-bat metal theft is to have metal recyclerswork hand-in-hand with law enforcementto catch metal thieves. Most recyclers dofollow their state’s laws, obtain completeidentity information from sellers andreport suspicious transactions.

But what happens when good faithefforts by recyclers aren’t enough? Whathappens when law enforcement officialsdon’t understand the laws they’re sup-posed to enforce? Oscar Rodriguez, ownerof Atland Recycling, Inc. in Okeechobee,Florida, and his wife Liza, found out first-hand.

The Rodríguezes’ personal story iscompelling. Both were refugees fromCuba who escaped from a dictatorialregime for freedom in the U.S. and achance at the American Dream, wherehard work pays off and fairness under thelaw is a cornerstone of liberty.

Both were born, raised and educatedin Cuba. Liza was a chemical engineer andOscar a mechanical engineer. In 1993,Oscar tried to escape to the U.S., wascaught by Cuban officials, and spent ayear in jail as a political prisoner.

In 1995, both applied for the U.S.green-card lottery which awards perma-nent-residence visas to a small fraction ofthe millions of applicants who apply eachyear. Luckily, Liza won a lottery visa.They were married in Cuba before immi-grating to the U.S. in 1998.

Living in Miami, they immediatelywent to work. Liza attended night schooland in three months earned her pharmacycertification. Oscar worked in the truckingindustry and eventually became an owner-operator of a small fleet of trucks. Whileworking, Liza continued her education atBarry University where she earned a bach-

elor’s degree in healthcare administration,and then went to Nova Southeastern Uni-versity for a Master’s in business adminis-tration with a concentration in finance.

In 2006, after years of hard workand saving, they obtained a loan fromthe Small Business Administration andpurchased Atland Recycling. At the timeof purchase, Atland was junkyard and afailed business. From there, theRodríguezes built Atland into a highlysuccessful business that today employs15 people and is the leading metal recy-cler in their area. Oscar runs the busi-ness while Liza has been working onbecoming certified as a financial advisorand auditor.

But on September 25, 2012, bothOscar and Liza were arrested by Detec-

tive Mark Shireman of the OkeechobeeCounty Sheriff’s Office (OCSO) andcharged with dealing in stolen property– a felony offense under Florida law.

Gary S. Betensky, who is board certi-fied in business litigation by The FloridaBar and is a shareholder in the law firm ofRichman Greer, P.A. in West Palm Beach,Florida has been corporate and litigationcounsel to Atland for over 10 years. Beten-sky retained Kevin Gors, co-founder ofSeal-Mar, a licensed security, investigationand training company operating in Floridaand California, to investigate the eventssurrounding the criminal proceedingsagainst Atland’s owners.

“I was called upon by theRodríguezes’ corporate counsel to do aninvestigation. In my 37 years’ experience

in law enforcement, I’ve never experi-enced something like this – a genuinelegal nightmare,” said Gors.

Gors detailed the factual backgroundof the case. The property at issue in thecriminal case turned out to be a trailer andforklift that was sold to Atland as scrap for$700. Atland processed the transaction inaccordance with Florida law. In fact,Atland went above and beyond what wasrequired by law, and registered the trans-action with LeadsOnline, the nation’slargest online investigation system used bylaw enforcement to recover stolen proper-ty, reduce metal theft and solve crimes.

Atland had a long-time client whosaw the forklift and offered to buy it.Atland sold it for the same price they

The scrap industry has producedsignificant new tools to increasethroughput and productivity of themodern recycling yards. We now havethe ability to reduce entire vehicles toshredded materials that have been sort-ed and categorized for reuse. Many ofthese new tools require cooling tokeep them from failing prematurely.For example, a new shredder requiressignificant cooling to protect thesophisticated controls from overheat-ing, the hydraulics from overheatingby keeping the oil at an acceptabletemperature, the motor from overheat-ing, the windings and bearing fromfailing too soon and finally even thecompressors that can help sort thechaff from the end product. Manytimes the cooling systems are over-looked or minimalized in the purchaseprocess of these valuable new assets.

The manufacturer of each newshredder has specified the heat loadand the temperatures required to ade-quately cool the shredder, but how willyou make that happen? What type ofcooling system is right for your loca-tion? What is the least expensive sys-tem based on operating costs andmaintenance for your cooling system?The following can help you with thebasic types of cooling systems toenable a better understanding of howthey operate.

There are six basic types of liquidcooling systems:

•A liquid to liquid cooling system(PCX).

•A closed loop dry system (CD).•A closed loop dry system with

trim cooling (CDT).•A open loop system (OE).•A closed loop evaporative system

(CE).•A chilled water system (CW).The simplest of these systems is a

liquid to liquid cooling system (PCX).In this type of system your plant hasan abundance of some type of coolingliquid already available but you do notwant to provide this coolant to theshredder. It uses an intermediate heatexchanger and a coolant such as glycoland water on the other side of theintermediate heat exchanger in aclosed loop to cool the shredder. Theheat is exchanged through the interme-diate heat exchanger without foulingthe load heat exchangers. The strengthof the PCX system is that it is relative-ly inexpensive to purchase and install.The components can be installedinside or outside. The PCX system isinexpensive to operate with only theclosed loop pump using any additionalenergy. Maintenance is relatively sim-ple on a PCX system demanding onlya periodic inspection, lubrication, andcleaning of the heat exchanger as nec-essary.

A closed loop dry system (CD) isvery much like the radiator in your car.The CD system uses an air cooledfluid cooler to transfer the heat fromthe closed loop coolant fluid pumpedthrough rows of finned tubes that haveambient air blown/drawn across them.

The basic components to a CD systemare the fluid cooler, which contains theair to liquid heat exchanger with thefan/s, the pump and control skid, thecoolant, and the field installed systempiping.

A closed loop dry system with atrim cooler (CDT) is the same as theCD, but adds a supplemental fluidcooler. This system is typically used ina location that has too high of a drybulb in the summer to provide theproper coolant temperature to the load.With an added liquid-to-liquid trimcooler the customer can use a watersource to trim the temperature to thedesired set point. Many times CDTsystems are used to reduce the relianceon city water as a coolant.

The next system, an open loopevaporative cooling system (OE) iscompletely different than the firstthree listed above. This system has theability to use the design wet bulb asthe basis for the outlet temperature ofthe cooling water. For example if thedesign dry bulb for the location is95°F and the design wet bulb is 75°Fthe OE system can provide approxi-mately 82°F water to the load. The OEsystem cascades water through thehoneycomb PVC fill material in thetower along with ambient air blown ordrawn through the fill to evaporate thewater. During the evaporation theremaining water is cooled to as closeas 7°F or higher above the wet bulbtemperature. The evaporated water isreplaced with some type of make-upwater system like a float valve. The

Readers,This month’s Focus cover story

is one that I find particularly fasci-nating. It’s a story of a business thatdid everything right – and in fact,went above and beyond what wasrequired by law – and yet was stillforced to defend itself in our expen-sive, Byzantine legal system.

There is no denying that scraptheft is a very real problem. I’dwager that most of you know some-one or someplace that has beenaffected by scrap theft in some way.The vacant house two doors downfrom mine was hit by scrap thieveswho destroyed the interior walls tocut out the copper piping.

Not only did the bank thatowned the home suffer a loss as aresult, the eventual sale of that homeat a discounted price will adverselyaffect the value of my home, andevery other house in the neighbor-hood.

But here’s the thing: I don’tblame scrap yards for the theft. Theyard owners/operators didn’t donmasks and plunder that home. Theydon’t go out at night and pry upstorm covers or hijack air condition-ing coils.

Criminals do that. And if theyweren’t engaged in scrap theft,they’d find other illegal means toobtain money.

So why, then, are our legislatorspunishing yard owners instead of theactual criminals doing the thievingand damaging? There are alreadylaws in every state that criminalizetheft and property damage – therecords keeping and reportingrequirements, with criminal penal-ties for non-compliance, only penal-ize those individuals who are simplytrying to run a business and make anhonest profit.

And receiving stolen property isalready illegal in most jurisdictionsas well. If police can prove that ayard operator knows or should haveknown that material was stolen, thenthey can charge them without awhole slew of new reporting laws onthe books.

The bottom line is that lawsonly constrain the behaviors of thoseindividuals who are generally law-abiding. Criminals, by definition,tend to disregard the law. Imple-menting reasonable measure to catchthieves is fine and dandy – but itseems fundamentally unfair that theburdens of enforcement, both legaland monetary, fall to private busi-ness owners.

Be careful out there.

The Institute of Scrap RecyclingIndustries (ISRI) has assembled a LawEnforcement Advisory Council – a selectgroup of experienced law enforcementofficers, prosecutors and security person-nel from around the country with anunderstanding of the metals theft issue.The Council will advise ISRI in the devel-opment of a comprehensive program toaddress metals theft, including a multi-lay-ered training program to assist lawenforcement. The group held its first orga-nizational meeting in Washington, DC.

“The recycling industry has longbeen on the front lines as part of thesolution to metals theft, working closelywith local law enforcement and prosecu-tors to deter crime and creating a nation-

wide scrap theft reporting system to helpin the investigation and capture ofthieves,” said Robin Wiener, president ofISRI. “The establishment of the LawEnforcement Advisory Council is part ofan even more advanced, comprehensiveapproach by the industry to address theproblem of metals theft through trainingand greater outreach efforts. remaining water and the make-upwater are collected in a basin and thenpumped to the load and the cyclerepeats.

A closed loop evaporative system(CE) is somewhat of a hybrid betweena CD and an OE system. The closedloop evaporative system is an opentower with a closed loop heat exchang-er built into the tower. The tower waterstays outside in the tower and does notcirculate through the coolant piping.The coolant piping is a closed loop,with a glycol/water solution flowingfrom the CE tower to the load andback. The separate tower water ispumped from the basin to the top ofthe tower and sprays across the heatexchanger (normally an array of tubes)with air blown or drawn through thetower across the heat exchanger whereevaporation of the water transfers theheat from the closed coolant loop tothe ambient air. The remaining towerwater falls to the basin where it isagain pumped up to the top of thetower and repeats the process. The CEsystem tower water requires make-upwater, chemical treatment, a drain, acold weather basin heater and blow-down just like the OE system dis-cussed above.

The last type of cooling system isthe chilled water system (CW). Achiller normally has a mechanicalcompression device that converts ener-gy into compressed refrigerant byusing some type of compressor. Thecompressed refrigerant is piped to acondenser that rejects the heat fromthe refrigerant to the atmosphere orsome type of liquid coolant. The com-pressed refrigerant changes state froma gas to a liquid in the condenser andis piped to an evaporator where it ismetered or expanded in the evaporator.The expansion of the high pressure liq-uid refrigeration reduces the tempera-ture of the evaporator. The liquid to becooled is pumped through the evapora-tor heat exchanger and heat is trans-ferred to the refrigerant. The low pres-sure vapor is carried back to the com-pressor and the cycle begins again forthe refrigerant. The coolant flows fromthe evaporator heat exchanger to theload where the heat is transferred tothe coolant in the load heat exchangerand then returns back to the evaporatorto repeat the cycle.

There are many types of coolingsystems available to satisfy yourrequirements. It is best to involve yourcooling system specialist early in yourplanning to help you choose the bestsystem to fit your needs.

ISRI authors complianceguide to state scrap statutes

The Institute of Scrap RecyclingIndustries (ISRI) has released its firstState Metals Theft Statutes publication,an online compilation of all state lawsrelated to metals theft designed to helpscrap recyclers with their complianceobligations under state law. Forty-ninestates (Alaska being the exception) havepassed laws intended to combat metalsthefts, each with varying requirementsthat affect recyclers. The guide serves asa tool to help recyclers, law enforcementand other stakeholders better understandthe laws that apply in each individualstate, as well as an important resource towhat other states are doing.

“In recent years there has been awave of new legislation regarding metaltheft across the country, often with mul-tiple bills passed within any given state,making it extremely challenging forrecyclers to stay on top of currentrequirements,” said Robin Wiener, presi-

dent of ISRI. “ISRI’s State Metals TheftStatutes publication serves as a guide tohelp recyclers understand their most up-to-date compliance requirements as therecycling industry continues its efforts tobe part of the solution to the problem ofmetals theft.”

The information will be updatedthroughout the year as new state laws arepassed or amended. In 2013 alone, 28states passed amendments to existinglaws within their jurisdictions. In thecoming months ISRI plans on supple-menting this information with an inter-active, searchable database of statutoryrequirements related to metals theft,which will be available on its website atwww.isri.org and available to all stake-holders.

The release of this publication ispart of ISRI’s enhanced efforts to pre-vent metals theft.

Dave Conway has officially been in the furnace business since the mid-70s, andstarted his own business, Recycling Services International, in 1990, but he said thathe has “always been around the recycling business.” He grew up on a farm and oftenbrought farm scrap to a local scrap dealer. As a teenager, he made money by cuttingup old farm equipment for other farmers and taking that material to scrap dealers.

Later, Conway started working for a company that made furnaces for recy-clers. He said that the “big draw” to working there was traveling and meetingnew people. He didn’t purposely set out to build furnaces or be in the recyclingindustry, but, he said, “It was a job and then it became my life.”

When he started his own company, he said that he enjoyed designing thingsand seeing them work. “It’s a challenge and that’s what I like.” The companymakes different furnaces depending on the final use, as well as the customers’needs. Aluminum-melting furnaces are larger than those for melting preciousmetals, and can hold up to 12,000 lbs. of molten aluminum.

When automotive parts with both aluminum and steel go into the aluminumfurnaces, those furnaces produce high-quality ingot and also clean steel that canbe sent directly to steel mills with no further processing. The furnaces designedfor recovering precious metals don’t melt the metal at all – they burn off theresins and combustible materials so the metal can be recovered.

The furnaces designed for destroying PCBs from transformers have a 20-million BTU burner so the afterburner reaches 2300 degrees to eliminate anypollutants. The company also builds furnaces for melting lead off of copper wireand can also design and build furnaces for specific customer needs.

“When I started building furnaces,” Conway said, “I looked for maximumefficiency.” Now, his furnaces can produce more aluminum for half the money,but he doesn’t take all the credit for that. “It’s because of new technology – it’snot because I’m such a smart guy.”

The environmental issues are also one of his great interests, and he thinksthat it’s a “joint venture cleaning up the air,” with the EPA, product designersand businesses all playing roles. “Recycling is a good thing,” he said.

Conway said his customers are his best salespeople, and that it’s not unusu-al for current customers to invite potential customers to their facilities to see thefurnaces in action and to explain how they work. Some of his customers ownmore than one furnace.

He sells throughout the United States and he also ships overseas, but it’s notjust about selling. When a customer receives a new furnace, they also get com-prehensive training on how to use the furnace, how to maintain it and how toprepare reports for the EPA. That training usually takes about a week. “We havebuilt-in diagnostics,” Conway said, which makes troubleshooting much easierafter the training is done.

To help with EPA regulations and reporting, the furnaces are fitted with dat-aloggers that monitor the afterburners that burn off potential pollutants. Conwayalso provides the customers with a spreadsheet with formulas for reporting theinformation from the dataloggers.

Conway said, “It’s a lot of paperwork,” but it’s what needs to be done tostay compliant with the regulations, so his company does everything possible tomake it easier for his customers.

While other countries might not have the same sort of rules in place, Con-way said that he enjoys “helping other cultures that weren’t concerned about theenvironment” and seeing them become more aware of environmental issues.

The company has five employees who design and manufacture the burnersand controls, while a fabricator builds the shell which is shipped separately tothe customer, along with the lining material. The furnaces are built on the cus-tomers’ site, which takes about four weeks.

Conway said that since they started shipping the furnaces in pieces ratherthan fully assembled, they’ve had no warranty repairs. When the furnaces wereshipped fully assembled, there was always a chance for damage during shipping.

While many of his customers are established in the recycling industry,recently he helped a startup business, including helping them with networkingwith others who could give them a hand. “If I don’t know something,” he said, “Iknow someone who does.” He was quite pleased to see that new businessbecome a very successful startup.

Conway realizes that not every company treats its customers with that sortof care, but it’s part of his philosophy. “We build relationships,” he said, and helooks for vendors who take care of him the same way he takes care of his cus-tomers. Because of that, he has long-term relationships with many vendors –from sellers of simple nuts and bolts to those who make more complicatedrelays.

“We only use the best,” he said, “and only made in the USA.”

operate it. There are heat-treated pinsand bushings at all hinge points forextended wear life. Application of theattachment requires only standard pin onmounting and a mount plate which iswelded onto the machine. The product isideal for hydraulic excavators ranging insize from 18,000 to 55,000 lbs.

Adam Lindley, sales, said that SASForks offers the SAS™ Extreme™ grappleattachment, which is fast and easy toinstall. “Our grapple is engineered to pin toan existing dozer blade mount, utilizing theexisting undercarriage hydraulics. It con-nects directly to a factory stick mount.” Heexplained that the product can be used toextract items such as copper wiring, radia-tors, heater cores, alternators, starters, alu-minum condensers, a/c evaporators, intakemanifolds, engines and transmissions.

Lindley said the SAS grapple is engi-neered and built for optimum perform-ance. It features a rotating head withpatented jaws that provide aggressive teethfor engine pulling; a needle nose-type tipfor wire harness retrieval and the shape ofthe grapple allows it to maneuver in tightareas with speed and accuracy. There is ahard facing on the jaw teeth, hardenedpins, bushings and grease-able pivot pointsto extend service life and the hydrauliccylinder on a rotating head is protected tominimize potential damage.

The attachment is best suited forrotational industrial equipment with aboom arm and two auxiliary hydraulicfunctions plumbed to the end of the stickfor a rotating head with jaws. It offers anoperating weight of 16 to 24 tons.

paid. The client worked on the forkliftbut could not get it running properly, sohe sold it to a used equipment dealerlocated next to Atland for $1,000. Thedealer’s intent was to invest $1,000 to$1,500 more and maybe sell it for$3,500 to $4,500.

Meanwhile, however, the forkliftwas reported as stolen in another juris-diction. There, the investigating officerturned to LeadsOnline, where he wasable to find the transaction involving thestolen forklift that had been voluntarilyreported by Atland. The Detective andthe original owner of the forklift werethen able to track its whereabouts to theused equipment dealer – where they dis-covered that it had originally been soldto Atland.

At that point, Detective Shireman ofthe OCSO was called in to take over theinvestigation in Okeechobee. The forkliftwas voluntarily surrendered back to theoriginal owner, and Shireman began hisinvestigation.

Atland showed Shireman all theproper paperwork – photo, fingerprints,copy of driver’s license and signed affi-davit for the transaction. Under Floridalaw, Atland was not required to reportthe forklift and trailer transactionthrough LeadsOnline. It was only due toAtland’s going the extra mile and listingall its transactions that law enforcementeven learned where to look for the fork-lift and trailer – a perfect example of ascrap metal dealer cooperating with lawenforcement.

The actual thief was identified – aperson with a long criminal record. Heturned out to be a property manager for anout-of-state equipment company who hadbeen stealing from his employer and hadpawned or scrapped stolen equipment sev-eral times over many months.

Catching the actual thief, however,wasn’t enough. Shireman wrote in hisreport that the trailer had been manufac-tured and the VIN number was missing,and therefore, Atland should haveknown the trailer was stolen. But accord-ing to Gors’ investigation, this was con-trary to a report taken by police in thejurisdiction where the theft occurred,

who reported that the owner had indicat-ed that the trailer was homemade, andtherefore had no VIN number to beginwith.

But Shireman persisted, and proceed-ed under the theory that scrap dealers areonly allowed to take in something that hasnothing more than scrap value. In otherwords, if something has more potentialvalue than the scrap value, then the recy-cler should know it was stolen and theyshould go to jail. He believed that no onewould scrap a running forklift unless itwas stolen.

But in many cases old forklifts arehard to find parts for, difficult to repair andare often written-off and scrapped. WhenAtland went back through their recordshistory they were able to show Shiremannumerous transactions for old forkliftsthey had purchased for scrap.

For all of Atland’s cooperation andthe lack of evidence of any wrongdo-ing, Shireman chose to charge Oscarand Liza regardless. And despite theseemingly open and shut case, once thecharges had been filed, theRodríguezes were at the mercy of thelocal legal system.

According to Betensky, “TheRodriguezes and Atland followed thelaw to the tee, meaning they did all theproper paperwork, and then some. Theyattended all the appropriate seminars,including the seminar that preceded themost recent revision of the statute. Theyunderstand the statute and followed itbetter than anybody I know of and there-fore were immune from any prosecution.

“This whole thing was trumped-upto begin with,” Betensky explained.“One element was that Detective Shire-man just did not understand the law.When you combine Shireman’s lack ofknowledge of the law, and the fact thathis supervisors allowed him to pursuethis, it led to a complete travesty of jus-tice and an unwarranted and baselessprosecution.

“The assistant state attorney pushedthis case for 11 months, up until he hadto face the judge on a motion to dismisswhich had been filed by theRodriguezes’ defense counsel. On theday the motion was scheduled for hear-ing, the state attorney dropped thecharges because he finally decided to dohis own homework, rather than accept

everything Shireman had been feedinghim,” Betensky concluded.

“After working the case, we deter-mined as long as Atland did the properpaperwork according to statutes, there’snothing we can do,” said Assistant StateAttorney Rob Moeller. “Though there wasa presumption that it was stolen, and theyshould have known it was stolen, all of thepaperwork was in order which protectsthem under the law.”

It took 11 months, but eventually,the charges against Oscar and Liza weredismissed. However, the damage to theRodriguezes and their company is irre-versible. The story of their arrest andimprisonment appeared in the generalpress, in trade journals and on the inter-net. The news affected their children,family, friends, community and localbusiness associates. Even though thestate eventually dropped the charges,that fact received little publicity.

“Nobody would like to do businesswith a person with an arrest record,” saidLiza. “It’s really hard for us. What Ilearned since I left Cuba trying to be

away from a dictator, was that here inthe United States the only thing we havedone is to work hard and these guystreated us like they were dictators.”

“It cost the Rodríguezes terribly, notonly in legal defense and investigativecosts, but their reputation in the businesssense both domestically and with peoplethey do business with overseas. Reputationis a very fragile thing. The fact they werearrested and jailed for a felony and facedimprisonment is pretty scary. You can’t puta price tag on that,” Gors commented.

Subsequently, Oscar and LizaRodriguez filed a federal lawsuit againstDetective Mark Shireman and two of hissupervisors at the Okeechobee CountySheriff’s Office for violating their civilrights, wrongful arrest, false imprison-ment and malicious prosecution. Theyhope to right this wrong and are seekingsubstantial money damages.

Atland’s experience was a tragedyand an anomaly, but should be a warningto scrap metal dealers to be extra vigilantand thoroughly understand, and followmetal theft laws in their jurisdictions.
