9 A. Introduction 10 11 1. Hawai`i has a total of 31 delegates and 2 alternates. (Call I & Appendix B) 12 13 2. The delegate selection process is governed by the Charter and Bylaws of the 14

Democratic Party of the United States, the Delegate Selection Rules for the 15 2016 Democratic National Convention (“Rules”), the Call for the 2016 16 Democratic National Convention (“Call”), the Regulations of the Rules and 17 Bylaws Committee for the 2016 Democratic National Convention (“Regs.”), 18 the rules of the Democratic Party of Hawai`i, the Hawai`i election code, and 19 this Delegate Selection Plan. (Call II. A) 20

21 3. Following the adoption of this Delegate Selection Plan by the State Party 22

Committee, it shall be submitted for review and approval by the DNC Rules 23 and Bylaws Committee (“RBC”). The State Party Chair shall be empowered to 24 make any technical revisions to this document as required by the RBC to 25 correct any omissions and/or deficiencies as found by the RBC to ensure its 26 full compliance with Party Rules. Such corrections shall be made by the State 27 Party Chair and the Plan resubmitted to the RBC within 30 days of receipt of 28 notice of the RBC‟s findings. (Reg. 2.5, Reg. 2.6 & Reg. 2.7) 29

30 4. Once this Plan has been found in Compliance by the RBC, any amendment 31

to the Plan by the State Party will be submitted to and approved by the RBC 32 before it becomes effective. (Reg. 2.9) 33

34 B. Description of Delegate Selection Process 35 36 1. Hawai`i will use a proportional representation system based on the results of 37

the Caucus for apportioning delegates to the 2016 Democratic National 38 Convention. 39

40 2. The “first determining step” of Hawai`i‟s delegate selection process will occur 41

on 03/26/2016 with a caucus. The first determining step will be held in 42 conjunction with precinct club meetings. 43

44 3. Voter Participation in Process 45 46 a. Participation in Hawai`i‟s delegate selection process is open to all voters 47

who wish to participate as Democrats. 48 49

1 b. Every person who qualifies and reaches the age of 16 may pre-register 2

and will automatically be registered upon reaching 18 years of age. 3 (HRS §11-12) Every person who qualifies and has reached the age of 4 17 may register to vote and may participate if they will be 18 years of 5 age on or before November 8, 2016. Their names shall be placed on the 6 appropriate county general register and precinct list. 7

8 C. Voters in Hawai„i may choose to register in person at two locations on 9

the main Island of O`ahu and one location on the Island of Hawai`i, 10 Kaua`i and Maui. Alternatively they may complete a “Wikiwiki Voter 11 Registration & Permanent Absentee” form to register by mail. A first time 12 voter choosing to register to vote by mail must include a current valid ID. 13

14 d. Registration deadline for the Primary election is July 14, 2016. The 15

deadline for the General Election is October 10, 2016. 16 17 e. The State of Hawai`i does not require a declaration of party prior to the 18

Primary election. A person selects only one Party ballot and votes that 19 Party preference in the privacy of the voting booth. (See „A Guide to 20 Voting,‟ pg. 5.) Only a registered member of the Democratic Party of 21 Hawai`i who registered on or before March 26, 2016, may participate in 22 the precinct meeting. (Rule 2.A, Rule 2.C, & Reg. 4.3) 23

24 f. At no stage of Hawai`i‟s delegate selection process shall any person be 25

required, directly or indirectly, to pay a cost or fee as a condition for 26 participating. Voluntary contributions to the Party may be made, but 27 under no circumstances shall a contribution be mandatory for 28 participation. (Rule 2.D & Reg. 4.4) 29

30 g. No person shall participate or vote in the nominating process for the 31

Democratic presidential candidate who also participates in the 32 nominating process of any other party for the corresponding elections. 33 (Rule 2.E) 34

35 h. No person shall vote in more than one (1) meeting, which is the first 36

meeting in the delegate selection process. (Rule 3.E & Reg. 4.6) 37 38 i. Voters must be registered as members of the Democratic Party of 39

Hawai`i on or before March 26, 2016. 40 41 4. Scheduling of Delegate Selection Meetings 42

The dates, times and places for all official Party meetings and events related 43 to the state‟s delegate selection process have been scheduled to encourage 44 the participation of all Democrats. Such meetings will begin and end at 45 reasonable hours. (Rule 3.A & Reg. 4.5) 46

Section II 1 Presidential Candidates 2

3 A. Ballot Access 4 5

A presidential candidate gains access to the Hawai`i presidential preference 6 primary ballot, or is eligible to participate in the Hawai`i‟s first-tier caucuses, by the 7 following process: 8 9 (1) Each Presidential candidate shall submit in writing on campaign letterhead the 10 name(s) of his or her authorized representative(s) to the Chair of the Democratic 11 Party of Hawai`i, 404 Ward Ave. Suite 200, Honolulu, HI, 96814. The written 12 authorization letter must be received either by mail or in person by January 8, 13 2016, at 5:00 P.M. HST. (Rule 1.A.7) 14 15 (2) A filing fee of $2,500.00 must accompany the written authorization letter. The 16 filing fee shall be waived in the case of a person who declares himself/herself, by 17 affidavit, to be indigent and who has filed a petition signed by at least 100 18 members of the State Party, registered as of the filing date of the statement. (Rule 19 1.A.8) 20

21 B. Other Requirements 22 23 1. Each presidential candidate shall certify in writing to the State Democratic 24

Chair, the name(s) of his or her authorized representative(s) by January 8, 25 2016. (Rule 12.D.1) 26

27 2. Each presidential candidate (including uncommitted status) shall use his or 28

her best efforts to ensure that his or her respective delegation within the state 29 delegation achieves the affirmative action goals established by this Plan and 30 is equally divided between men and women. (Rule 6.I) 31

Selection of Delegates and Alternates 34 35 A. District-Level Delegates and Alternates 36 37 1. Hawai`iis allocated 14 district-level delegates and 2 district-level alternates. 38

(Rule 8.C, Call I.B & I.I, Appendix B, & Reg. 4.31) 39 40 2. The first determining step in electing District-level delegates and alternates 41

occurs on March 26, 2016, at 1:00 P.M. HST in the Precinct Caucus through 42 the election of precinct level delegates and alternates to State Convention. 43 (Rule 10 A. & 12.A.) 44

45 a. The number of delegates to the Hawai„i State Convention from each 46

precinct shall be allotted according to a formula in direct proportion to 47

the most recent total vote in the precinct for the Democratic nominee for 1 Governor of the State of Hawai„i, according to proportioning factors 2 which provide for the maximum opportunity for participation consistent 3 with the Constitution, provided, however, each precinct shall be entitled 4 to at least two (2) delegates to the State Convention. 5

6 (1) The total number of elected delegates to the Hawai„i State 7

Convention shall be 1,000. The number of delegates allotted to 8 each precinct shall be determined by the total votes cast in each 9 Precinct plus the apportioned absentee ballots, divided by the total 10 number of votes cast for the gubernatorial candidate, and the 11 results multiplied by the total number of elected delegates to the 12 State Convention. (Bylaws of the Democratic Party of Hawai`i, 13 Article VI, Section 2D, Subsection 1) 14

15 (2) Convention delegates who are not elected as stated above and have 16

all rights and privileges of elected precinct delegates, including 17 voting for District level delegates and alternates, are as follows: 18 Incumbent Party Chairperson, National Committeeman and 19 National Committeewoman, State Central Committee Members, 20 Incumbent County at-Large Representatives to the State Central 21 Committee, District Chairpersons, Incumbent and Immediate Past 22 County Chairpersons, including ex-officio members of the State 23 Central Committee, former Democratic Governors, former 24 Democratic Lieutenant Governors, former Democratic Party 25 Chairpersons, Elected Federal, State and County Officials, or 26 officials who may have been appointed to fill a vacant position of 27 an elected official, who do not seek election as delegates or 28 alternates from the Precinct. (Article VI, Section 2A, 2B, 2C, 29 Democratic Party of Hawai`i Constitution) 30

31 (3) Each precinct will poll its members present at the caucus to 32

determine their presidential preference or uncommitted status. 33 After the formal registration process, balloting for presidential 34 preference or uncommitted status will be by secret ballot. Ballots 35 will be counted, sealed and submitted to the Democratic Party 36 Headquarters within forty-eight (48) hours. The State Central 37 Committee will tabulate and announce the results within twenty 38 (20) days after the balloting. 39

40 b. Only Delegates and Alternates to the State Convention who submit a 41

Statement of Support form indicating their Presidential Preference or 42 uncommitted status by 5:00 P.M. HST, ten (10) calendar days prior to 43 the start of State Convention, will be permitted to participate in the 44 election of their District Level Delegates to the National Convention. 45

c. Any member of the Democratic Party of Hawai„i who would like to be 1 elected as a Delegate or Alternate to the National Convention must 2 submit a Statement of Candidacy Form by May 13, 2016, at 5:00 P.M. 3 HST to the Secretary of the Democratic Party of Hawai„i by e-mail: 4 [email protected], by mail or in person at: 404 Ward Ave. 5 Suite 200, Honolulu, HI, 96814. 6

7 d. A Pledge of Support Form, which indicates the “presidential preference” or 8

“uncommitted status” of the prospective delegate or alternate, must be 9 submitted with the Statement of Candidacy Form. 10

11 e. On May 17, 2016, the list of prospective Delegates and Alternates will be 12

distributed to each presidential candidate or their authorized 13 representative and the Affirmative Action Committee for review. The 14 presidential candidate or their designated representative must respond 15 with their list of approved candidates to the Party Chair by May 20, 2016, 16 at 5:00 P.M. HST. 17

18 f. The District-level delegates and alternates shall be elected by the State 19

Convention delegates at the State Convention on May 28, 2016. 20 21 g. “Uncommitted status” will be considered the same as a specified 22

“presidential preference.” 23 24 3. Apportionment of District-Level Delegates and Alternates 25 26

a. Hawai`i‟s district-level delegates and alternates to the Democratic National 27 Convention are apportioned to two (2) Congressional Districts as 28 indicated in the following chart. (Rule 8.A, Reg. 4.10, Reg. 4.11, & 29 Appendix A) 30

31 (1) Equal weight to the vote for the Democratic candidates in the 2008 32

presidential and the most recent gubernatorial elections. 33 34

b. Hawai`i‟s total number of district-level delegates will be equally divided 35 between men and women (Rule 6.C.1 & Reg. 4.8) 36

37 c. The district-level delegates and alternates are apportioned to districts as 38

indicated in the following table: 39 40

2 4. District-Level Delegate and Alternate Filing Requirements 3

4 a. A district-level delegate and alternate candidate may run for election 5

only within the district in which he or she is registered to vote. (Rule 6 12.H) 7

8 b. An individual can qualify as a candidate for district-level delegate or 9

alternate to the 2016 Democratic National Convention by filing a 10 statement of candidacy designating his or her singular presidential (or 11 uncommitted) preference and a signed pledge of support for the 12 presidential candidate (including uncommitted status) with the State 13 Party by May 13, 2016, at 5:00 P.M. HST. A delegate or alternate 14 candidate may modify his or her singular presidential preference by 15 submitting an updated pledge of support no later than the filing deadline. 16 (Rule 12.B, Rule 14.F & Reg. 4.21) 17

18 (1) The Statement of Candidacy Form shall be signed by not less than 19

ten (10) certified members of the Democratic Party of Hawai`i from 20 the Congressional District in which the candidate is a member of 21 the Precinct Club. The ten required signatures do not exceed those 22 in effect in Hawai`i as of January 1, 1994. (Rule 14.D.) 23

(2) Candidates for delegate or alternate positions shall file a statement 24 designating their presidential (or uncommitted) preference and a 25 signed Pledge of Support form for the presidential candidate with 26 the Secretary of the Democratic Party of Hawai„i no later than May 27 13, 2016, at 5:00 P.M. HST. 28

(3) All candidates considered for District-level alternate positions must 29 meet the same requirements as candidates for District-level 30 delegate positions. (Rule 12.C.) 31

5. Presidential Candidate Right of Review for District-Level Delegates and 1 Alternates 2

3 a. The State Democratic Chair shall convey to the presidential candidate, 4

or that candidate‟s authorized representative(s), not later May 17, 2016, 5 than a list of all persons who have filed for delegate or alternate pledged 6 to that presidential candidate. (Rule 12.D & Rule 12.F) 7

8 b. Each presidential candidate, or that candidate‟s authorized 9

representative(s), must then file with the State Democratic Chair by May 10 20, 2016, at 5:00 P.M. a list of all such candidates he or she has 11 approved, provided that approval be given to at least three (3) times the 12 number of candidates for delegate men and three (3) times the number 13 of candidates for delegate women, and three (3) times the number of 14 candidates for alternate men and three (3) times the number of alternate 15 women to be selected. (Rule 12.E.1 & Reg. 4.24) 16

17 c. Failure to respond will be deemed approval of all delegate and alternate 18

candidates submitted to the presidential candidate unless the 19 presidential candidate, or the authorized representative(s), signifies 20 otherwise in writing to the State Democratic Chair not later than May 20, 21 2016, at 5:00 P.M. 22

23 d. National convention delegate and alternate candidates removed from 24

the list of bona fide supporters by a presidential candidate, or that 25 candidate‟s authorized representative(s), may not be elected as a 26 delegate or alternate at that level pledged to that presidential candidate 27 (including uncommitted status). (Rule 12.E & Reg. 4.24) 28

29 e. The State Democratic Chair shall certify in writing to the Co-Chairs of the 30

DNC Rules and Bylaws Committee whether each presidential candidate 31 (including uncommitted status) has used their best efforts to ensure that 32 their respective district-level delegate candidates and district-level 33 alternate candidates meet the affirmative action and inclusion 34 considerations and goals detailed in the Affirmative Action section of this 35 Plan within three (3) business days of returning the list of approved 36 district-level delegate candidates and district-level alternate candidates 37 as indicated in Section III.A.5.b of this Plan. 38

39 6. Fair Reflection of Presidential Preference 40 41 a. Hawai`i is a caucus/convention state. Accordingly, delegate and 42

alternate positions shall be allocated so as to fairly reflect the expressed 43 presidential preference or uncommitted status of the caucus participants 44 in each district. Therefore, the national convention delegates elected at 45 the district level shall be allocated in proportion to the percentage of the 46 caucus vote won in that district by each preference, except that 47

preferences falling below a 15% threshold shall not be awarded any 1 delegates or alternates. Percentages shall be determined by the results 2 of the precinct caucuses on March 26th, 2016. (Rule 13.B.) 3

4 b. Within a district, if no presidential preference reaches a 15% threshold, 5

the threshold shall be the percentage of the vote received in that district 6 by the front-runner minus 10%. (Rule 13.F) 7

8 c. Candidates/nominees pledged to a presidential candidate shall be 9

elected to the Democratic National Convention by delegates to the State 10 Convention who have signed Statements of Support for the same 11 presidential candidate that the nominees are pledged. Elections shall be 12 conducted by signed ballot, and by corresponding Congressional 13 District. (Rule 12.G.) 14 15 (1) Delegates and alternates to the State Convention who wish to vote 16

for District-level delegate candidates pledged to a particular 17 presidential candidate shall file a signed Statement of Support form 18 for the same presidential candidate or uncommitted with the 19 Secretary of the Democratic Party of Hawai„i no later than May 13, 20 2016, at 5:00 P.M. HST. (Rule 13.C.) 21

22 (2) A signed Statement of Support is a documented pledge of loyalty to 23

a presidential candidate or uncommitted upon which is affixed the 24 signature of the person, with his or her residential street address 25 and his or her district and precinct. 26

27 (3) District level Delegates and Alternates will be elected by State 28

Conventioneers by signed ballot and by corresponding 29 Congressional District. The election of District Level Delegates and 30 Alternates will take place on May 29, 2016, at the State 31 Convention. 32

33 (a) State Conventioneers who have submitted their Statement of 34

Support form designating their presidential preference or 35 uncommitted status will enter the voting area and receive a 36 ballot corresponding to their Congressional District and 37 presidential preference/uncommitted status. The ballot will 38 consist of the names of District Level Delegate and 39 Alternates. The Conventioneer will select the appropriate 40 number of male(s) and female(s) based on percentage 41 allocation in conjunction with the outcome of the Presidential 42 Preference poll and allocation to their Congressional District. 43 The ballot will be signed and the corresponding 44 Congressional District. (Rule 12.G) 45

7. Equal Division of District-Level Delegates and Alternates 1 2 a. In order to ensure the district-level delegates are equally divided 3

between men and women, delegate positions within each district will be 4 designated by presidential preference beginning with the highest vote-5 getting presidential preference. This assignment of delegate positions, 6 alternating by sex as mathematically practicable, will continue with the 7 next highest vote-getting preferences in descending order until the 8 gender of each position has been assigned. (Rule 6.C.1 & Reg. 4.8) 9

10 b. After the delegates are selected, the alternates will be awarded, using 11

the same process described above. 12 13 8. The State Democratic Chair shall certify in writing to the Secretary of the 14

Democratic National Committee (DNC) the election of the state‟s district-level 15 delegates and alternates to the Democratic National Convention within 10 16 days after their election. (Rule 8.C & Call IV.A) 17

18 B. Unpledged Delegates 19 20 1. Unpledged Party Leaders and Elected Officials 21 22 a. The following categories shall constitute the Unpledged Party Leaders 23

and Elected Official delegate positions: 24 25 (1) Members of the Democratic National Committee who legally reside 26

in the state; (Rule 9.A.1, Call I.F & I.J & Reg. 4.13) 27 28

(2) Democratic President and Democratic Vice President (if 29 applicable); (Rule 9.A.2 & Call I.G) 30

31 (3) All of Hawai`i‟s Democratic Members of the U.S. House of 32

Representatives and the U.S. Senate; (Rule 9.A.3 & Call I.H & I.J) 33 34 (4) The Democratic Governor; (Rule 9.A.4 & Call I.H & I.J) 35 36 (5) “Distinguished Party Leader” delegates who legally reside in the 37

state. (Rule 9.A.5, Call I.G & Reg. 4.13) 38 39 b. The certification process for the Unpledged Party Leader and Elected 40

Official delegates is as follows: 41 42 (1) Not later than March 1, 2016, the Secretary of the Democratic 43

National Committee shall officially confirm to the State Democratic 44 Chair the names of the unpledged delegates who legally reside in 45 Hawai`i. (Rule 9.A) 46

(2) Official confirmation by the Secretary shall constitute verification of 1 the unpledged delegates from the categories indicated above. (Call 2 IV.B.1) 3

4 (3) The State Democratic Chair shall certify in writing to the Secretary 5

9 2. For purposes of achieving equal division between delegate men and delegate 10

women within the state‟s entire convention delegation, the entire delegation 11 includes all pledged and unpledged delegates. (Rule 6.C) 12

13 C. Pledged Party Leader and Elected Official (PLEO) Delegates 14 15 1. Hawai`i is allotted 3 pledged Party Leader and Elected Official (PLEO) 16

delegates. (Call I.D & 1.E & Appendix B) 17 18 2. Pledged PLEO Delegate Filing Requirements 19 20 a. Individuals shall be eligible for the pledged Party Leader and Elected 21

Official delegate positions according to the following priority: city mayors 22 and state-wide elected officials (to be given equal consideration); state 23 legislative leaders, state legislators, and other state, county and local 24 elected officials and party leaders. (Rule 9.B.1 & Reg. 4.15) 25

26 b. An individual can qualify as a candidate for a position as a pledged 27

PLEO delegate by filing a Statement of Candidacy and Pledge of 28 Support forms with the Secretary of the Democratic Party of Hawai„i by 29 mail or in person at 404 Ward Ave. Suite 200, Honolulu, HI, 96814, e-30 mail [email protected] by May 29, 2016, after the 31 selection of District-level delegates and within 30 minutes after the 32 adjournment of the 2016 Hawai„i State Convention. (Rule 9.B.3 & 14.G & 33 Reg. 4.16 & 4.21) 34

35 c. If persons eligible for pledged PLEO delegate positions have not already 36

made known their presidential preference (or uncommitted status) as 37 candidates for district-level or at-large delegate positions, their 38 preference shall be ascertained through the following alternative 39 procedure: candidates for PLEO nominations must file a statement of 40 candidacy and indicate their support for a presidential candidate, or for 41 uncommitted status by filing a signed Pledge of Support form by May 29, 42 2016, after the selection of District-level delegates and within 30 minutes 43 after the adjournment of the 2016 Hawai„i State Convention. 44 Presidential candidates or their authorized representatives will be given 45 a 30 minute opportunity to review and approve the list of candidates. 46 (Rule 9.B.3 & Reg. 4.16) 47

1 3. Presidential Candidate Right of Review 2 3 a. The State Democratic Chair shall convey to the presidential candidate, 4

or that candidate‟s authorized representative(s), not later than May 17, 5 2016, at 5:00P.M. HST a list of all persons who have filed for a party 6 and elected official delegate pledged to that presidential candidate. 7 (Rule 9.B.3 & 12.D) 8

9 b. Each presidential candidate, or that candidate‟s authorized 10

representative(s), must file with the State Democratic Chair, by May 20, 11 2016, at 5:00 P.M. HST a list of all such candidates he or she has 12 approved, as long as approval is given to at least two (2) names for 13 every position to which the presidential candidate is entitled. (Rule 14 12.E.2 & Reg. 4.24) 15

16 c. Failure to respond will be deemed approval of all delegate candidates 17

submitted to the presidential candidate unless the presidential candidate 18 or the authorized representative(s) signifies otherwise in writing to the 19 State Democratic Chair not later than May 20, 2016, at 5:00 P.M. HST. 20

21 d. The State Democratic Chair shall certify in writing to the Co-Chairs of the 22

DNC Rules and Bylaws Committee whether each presidential candidate 23 (including uncommitted status) has used their best efforts to ensure that 24 their respective pledged PLEO delegate candidates meet the affirmative 25 action and inclusion considerations and goals detailed in the Affirmative 26 Action section of this Plan within three (3) business days of returning the 27 list of approved pledged PLEO candidates as indicated in Section 28 III.C.3.b of this Plan. 29

30 4. Selection of Pledged Party Leader and Elected Official Delegates 31 32 a. The pledged PLEO slots shall be allocated among presidential 33

preferences on the same basis as the at-large delegates. (Rule 9.B.2, 34 10.C, 13.E & 13.F) 35

36 b. Selection of the pledged PLEO delegates will occur on or before May 37

29, 2016, by a majority vote of the Hawai‟i State Central Committee 38 members at a meeting immediately following the adjournment of the 39 Hawai‟i State Convention, which is after the election of district-level 40 delegates and alternates and prior to the selection of at-large delegates 41 and alternates. (Rule 9.B) 42

43 (1) The PLEO delegates are selected based on a rank order of 44

their elected position after a review by the Presidential 45 candidate or their authorized representative(s). 46

c. These delegates will be selected by the State Central Committee, 1 provided that: 2

3 (1) Membership on the Hawai„i State Central Committee is 4

elected at State and County Conventions and is apportioned 5 based on the following: Senatorial Districts which in turn are 6 apportioned on the basis of population, one male and one 7 female; issue caucuses, such as Hawaiian Affairs, Women‟s, -8 Kupuna, Labor, Environmental, Education, GLBT, one male 9 and one female for each; County at-large seats (4 counties), 10 one male and one female for each; Young Democrats, one 11 male and one female; National Committee Members, one 12 male and one female; County Chairs; one State Senator and 13 one State House member alternating male and female, 14 immediate past state chairperson, and State Party Chair. 15 (Article V. Sec. 1, Subsection (1) (A) Rule 9.C.1 & Reg. 16 4.17.A) 17

18 (2) Members of the State Central Committee will be selected 19

through open processes in conformity with the basic 20 procedural guarantees utilized for delegate selection. Any 21 member of the Democratic Party of Hawai„i can become a 22 candidate, except if a member has resigned from the Party in 23 the two (2) years prior to re-enrollment in the Democratic Party 24 of Hawai„i, the re-enrolled member must be a member in good 25 standing for one (1) year before the next election prior to being 26 elected Party Chairperson or for election to the State Central 27 Committee. The State Chair must be a member for at least 28 one year. The election of members to the State Central 29 Committee is conducted at the State Convention to which the 30 delegates have been elected by members in equally 31 apportioned Senatorial Districts, except for those county 32 representatives whose delegates have been elected at their 33 precinct meetings and represent equally apportioned state 34 house districts, and county representatives who were elected 35 at their respective county conventions. (Rule 9.C.2& Reg. 36 4.17.B) 37

38 (3) Members of the State Central Committee shall have been 39

elected at the Democratic Party of Hawai`i State Convention 40 pursuant to the State Party Constitution and Bylaws on or 41 before May 29, 2016; subsequent to the election of district-42 level delegates. (Rule 9.C. (3)) 43 44

(4) Members of the State Central Committee shall have been 45 elected on or before May 29, 2016, which is not earlier than 46 the date of the previous presidential election. (Rule 9.C.4) 47

1 (5) Membership of the State Central Committee shall comply with 2

the equal division requirements of Article 9, Section 16 of the 3 Charter of the Democratic Party of the United States. One 4 male and one female shall be elected from each Senatorial 5 District, issue caucuses, county at-large seats, Young 6 Democrats and National Committee members. Also on the 7 Committee are the County Chairpersons, the State Party 8 Chair, the immediate past state chairperson, and 9 representatives of both houses of the Hawai„i State 10 Legislature. (Rule 9.C.5 & Reg. 4.17.C) 11

12 d. Alternates are not selected at the pledged Party Leader and Elected 13

Official level. These alternates are combined with the at-large alternates 14 and selected as one unit. (Reg. 4.31) 15

16 5. The State Democratic Chair shall certify in writing to the Secretary of the 17

Democratic National Committee the election of the state‟s pledged Party 18 Leader and Elected Official delegates to the Democratic National Convention 19 within 10 days after their election. (Rule 8.D & Call IV.A) 20

21 D. At-Large Delegates and Alternates 22 23 1. The state of Hawai`i is allotted 5 at-large delegates and 2 at-large alternates. 24

(Rule 8.C, Call I.B, II, Appendix B & Reg. 4.31) 25 26 2. At-Large Delegate and Alternate Filing Requirements 27 28

a. Persons desiring to seek at-large delegate or alternate positions may file 29 a statement of candidacy designating their singular presidential or 30 uncommitted preference and a signed pledge of support for the 31 presidential candidates (including uncommitted status) with the State 32 Party by Secretary of the Democratic Party of Hawai„i at 404 Ward Ave 33 Suite 200, Honolulu, HI 96814, or e-mail: 34 [email protected], by May 13, 2016, 5:00 P.M. HST. A 35 delegate or alternate candidate may modify his or her singular 36 presidential preference by submitting an updated pledge of support no 37 later than the filing deadline. (Rule 12.B &14.G, Reg. 4.22, 4.28, & 4.31) 38

39 b. The statement of candidacy for at-large delegates and for at-large 40

alternates will be the same. After the at-large delegates are elected by 41 Hawai„i State Central Committee those persons not chosen will then be 42 considered candidates for at-large alternate positions unless they 43 specify otherwise when filing. (Rule 18.A) 44

45 (1) If persons desiring to seek at-large delegate or alternate positions 46

Presidential candidates or their authorized 10 representatives will be given a 30-minute opportunity to review and 11 approve the list of candidates. 12

13 3. Presidential Candidate Right of Review 14 15 a. The Hawai`i State Democratic Chair shall convey to the presidential 16

candidate, or that candidate‟s authorized representative(s), not later than 17 May 15, 2016, 5:00 P.M. HST., a list of all persons who have filed for 18 delegate or alternate pledged to that presidential candidate. (Rule 12.D) 19 20

b. Each presidential candidate, or that candidate‟s authorized 21 representative(s), must then file with the Hawai`i State Democratic 22 Chair, May 20, 2016, 5:00 P.M. HST a list of all such candidates he or 23 she has approved, provided that, at a minimum, two (2) names remain 24 for every national convention delegate or alternate position to which the 25 presidential candidate is entitled. (Rule 12.D.4 & 12.E.2 & Reg. 4.24) 26

27 c. Failure to respond will be deemed approval of all delegate candidates 28

submitted to the presidential candidate unless the presidential candidate 29 or the authorized representative(s) signifies otherwise in writing to the 30 State Democratic Chair not later than May 20, 2016, 5:00 P.M. HST. 31

32 d. The Hawai`i State Democratic Chair shall certify in writing to the Co-33

Chairs of the DNC Rules and Bylaws Committee whether each 34 presidential candidate (including uncommitted status) has used their 35 best efforts to ensure that their respective at-large delegate candidates 36 and at-large alternate candidates meet the affirmative action and 37 inclusion considerations and goals detailed in the Affirmative Action 38 section of this Plan within three (3) business days of returning the list of 39 approved at-large delegate candidates and at-large alternate candidates 40 as indicated in Section III.D.3.b of this Plan. 41

4. Fair Reflection of Presidential Preference 1 2 a. At-large delegate and alternate positions shall be allocated among 3

presidential preferences according to the division of preferences among 4 convention participants, provided that no person participating shall 5 automatically serve by virtue of holding a public or Party office. (Rule 9.D 6 & Reg. 4.18) 7

8 b. Preferences which have not attained a 15% threshold on a state-wide 9

basis shall not be entitled to any at-large delegates. (Rule 13.E) 10 11 c. If no presidential preference reaches a 15% threshold, the threshold 12

shall be the percentage of the statewide vote received by the front-13 runner, minus 10%. (Rule 13.F) 14

15 d. If a presidential candidate is no longer a candidate at the time of 16

selection of the at-large delegates, then those at-large slots that would 17 have been allocated to the candidate will be proportionally divided 18 among the remaining preferences entitled to an allocation. (Rule 10.C) 19

20 e. If a given presidential preference is entitled to one (1) or more delegate 21

positions but would not otherwise be entitled to an alternate position, 22 that preference shall be allotted one (1) at-large alternate position. (Rule 23 18.B, Call I.I & Reg. 4.31, 4.34) 24

25 5. Selection of At-Large Delegates and Alternates 26 27 a. The selection of the at-large delegates and alternates will occur on May 28

29, 2016, by a majority vote of the State Central Committee immediately 29 following the adjournment of the State Convention, which is after all 30 pledged Party Leader and Elected Official delegates have been selected. 31 (Rule 8.D & Call III) 32

33 b. These delegates and alternates will be selected by the Hawai`i State 34

Central Committee provided that: (Rule 8.E, 10.B) 35 36

(1) Membership on the Hawai„i State Central Committee is apportioned on 37 the basis of population and/or some measure of Democratic 38 strength. (Rule 9.C.(1)) 39

(2) Members of the Hawai„i State Central Committee have been elected 40 through open processes in conformity with the basic procedural 41 guarantees utilized for delegate selection. (Rule 9.C.(2)) 42

(3) Such delegates are elected at a public meeting subsequent to the 43 election of district level delegates. (Rule 9.C.(3)) 44

(4) Members of the State Central Committee shall have been elected no 45 later than May 28, 2016, which is after the previous presidential 46 election. (Rule 9.C.(4)) 47

(5) Membership of the State Central Committee complies with the equal 1 division requirements of Article 9, Section 16 of the Charter of the 2 Democratic Party of the United States. (Rule 9.C.(5)) 3

4 c. Priority of Consideration 5 6 (1) In the selection of the at-large delegation priority of consideration 7

shall be given to African Americans, Hispanics, Native Americans, 8 Asian Americans and Pacific Islanders and women. (Rule 6.A.) 9

10 (2) In order to continue the Democratic Party‟s ongoing efforts to 11

include groups historically under-represented in the Democratic 12 Party‟s affairs and to assist in the achievement of full participation 13 by these groups, priority of consideration shall be given other 14 groups by virtue of race/ethnicity, age, sexual orientation, gender 15 identity or disability. (Rule 5.C & 6.A.3, Reg. 4.7) 16

17 (3) The election of at-large delegates and alternates shall be used, if 18

necessary, to achieve the equal division of positions between men 19 and women, and may be used to achieve the representation goals 20 established in the Affirmative Action section of this Plan. (Rule 6.A, 21 6.C) 22

23 (4) Delegates and alternates are to be considered separate groups for 24

this purpose. (Rule 6.A.3, 10.A, & Reg. 4.8, 4.19) 25 26 6. The State Democratic Chair shall certify in writing to the Secretary of the 27

Democratic National Committee the election of the state‟s at-large delegates 28 and alternates to the Democratic National Convention within 10 days after 29 their election. (Rule 8.C & Call IV.A) 30 31

E. Replacement of Delegates and Alternates 32 33 1. A pledged delegate or alternate may be replaced according to the following 34

guidelines: 35 36 a. Permanent Replacement of a Delegate: (Rule 18.D.3) 37 38 (1) A permanent replacement occurs when a delegate resigns or dies 39

prior to or during the national convention and the alternate replaces 40 the delegate for the remainder of the National Convention. 41

42 (2) Any alternate permanently replacing a delegate shall be of the 43

same presidential preference (including uncommitted status) and 44 sex of the delegate he/she replaces, and to the extent possible 45 shall be from the same political subdivision within the state as the 46 delegate. 47

1 (a) In the case where the presidential candidate has only one (1) 2

alternate, that alternate shall become the certified delegate. 3 4 (b) If a presidential candidate has only one (1) alternate, and that 5

alternate permanently replaces a delegate of the opposite sex, 6 thereby causing the delegation to no longer be equally 7 divided, the delegation shall not be considered in violation of 8 Rule 6.C. In such a case, notwithstanding Rule 18.D.2, the 9 State Party Committee shall, at the time of a subsequent 10 permanent replacement, replace a delegate with a person of 11 the opposite sex, in order to return the delegation to equal 12 division of men and women. (Reg. 4.33) 13

14 (3) If a delegate or alternate candidate who has been elected but not 15

certified to the DNC Secretary resigns, dies or is no longer eligible 16 to serve, he or she shall be replaced, after consultation with the 17 State Party, by the authorized representative of the presidential 18 candidate to whom he or she is pledged. (Rule 18.D.2) 19

20 b. Temporary Replacement of a Delegate: (Rule 18.D.3) 21 22 (1) A temporary replacement occurs when a delegate is to be absent 23

for a limited period of time during the convention and an alternate 24 temporarily acts in the delegate‟s place. 25

26 (2) Any alternate who temporarily replaces a delegate must be of the 27

same presidential preference (including uncommitted status) as the 28 delegate he/she replaces, and to the extent possible shall be of the 29 same sex and from the same political subdivision within the state 30 as the delegate. 31

32 c. The following system will be used to select permanent and temporary 33

replacements of delegates: 34 35

(1) The delegate chooses the alternate. (Rule 18.D.(1)) 36 37 (2) If for any reason, e.g., death, the delegate cannot or does not 38

select his/her replacement, the Hawai„i State Chair shall do so in 39 consultation with the presidential candidate or with his/her 40 authorized representative. 41

d. Certification of Replacements 1 2 (1) Any alternate who permanently replaces a delegate shall be 3

certified in writing to the Secretary of the DNC by the State 4 Democratic Chair. (Rule 18.D.3) 5 6

(2) Permanent replacement of a delegate (as specified above) by an 7 alternate and replacement of a vacant alternate position shall be 8 certified in writing by the Hawai`i‟s Democratic Chair to the 9 Secretary of the Democratic National Committee within three (3) 10 days after the replacement is selected. (Call IV.D.1) 11

12 (3) Certification of permanent replacements will be accepted by the 13

Secretary up to 72 hours before the first official session of the 14 Convention is scheduled to convene. (Call IV.D.1 & Reg. 4.32) 15

16 (4) In the case where a pledged delegate is permanently replaced after 17

72 hours before the time the first session is scheduled to convene 18 or, in the case where a pledged delegate is not on the floor of the 19 Convention Hall at the time a roll call vote is taken, an alternate 20 may be designated (as specified above) to cast the delegate‟s vote. 21 In such case, the Delegation Chair shall indicate the name of the 22 alternate casting the respective delegate‟s vote on the delegation 23 tally sheet. (Call VIII.F.3.d, VIII.F.3.b, & Reg. 5.6) 24

25 e. A vacant alternate position shall be filled by the delegation. The 26

replacement shall be of the same presidential preference (or 27 uncommitted status), of the same sex and, to the extent possible, from 28 the same political subdivision as the alternate being replaced. (Rule 29 18.E) 30

31 2. Unpledged delegates shall not be entitled to a replacement, nor shall the 32

state be entitled to a replacement, except under the following circumstances: 33 (Rule 18.E & Reg. 4.33) 34

35 a. Members of Congress and the Democratic Governor shall not be entitled 36

to name a replacement. In the event of changes or vacancies in the 37 state‟s Congressional Delegation, following the official confirmation and 38 prior to the commencement of the National Convention, the DNC 39 Secretary shall recognize only such changes as have been officially 40 recognized by the Democratic Caucus of the U.S. House of 41 Representatives or the Democratic Conference of the U.S. Senate. In 42 the event of a change or vacancy in the state‟s office of Governor, the 43 DNC shall recognize only such changes as have been officially 44 recognized by the Democratic Governors‟ Association. (Call IV.D.2.a) 45 46

b. Members of the Democratic National Committee shall not be entitled to a 1 replacement, nor shall the state be entitled to a replacement, except in 2 the case of death of such delegates. In the case where the state‟s DNC 3 membership changes following the DNC Secretary‟s official 4 confirmation, but prior to the commencement of the 2016 Democratic 5 National Convention, acknowledgment by the Secretary of the new DNC 6 member certification shall constitute verification of the corresponding 7 change of unpledged delegates. (Call IV.D.2.b) 8

9 c. In no case may an alternate cast a vote for an unpledged delegate. (Call 10

VIII.F.3.d) 11 12

Section IV 13 Convention Standing Committee Members 14

15 A. Introduction 16 17 1. Hawai`i has been allocated 3 member(s) on each of the three (3) standing 18

committees for the 2016 Democratic National Convention (Credentials, 19 Platform and Rules), for a total of 3 members. (Call VII.A & Appendix D) 20

21 2. Members of the Convention Standing Committees need not be delegates or 22

alternates to the 2016 Democratic National Convention. (Call VII.A.3) 23 24 3. These members will be selected in accordance with the procedures indicated 25

below. (Rule 1.G) 26 27 B. Standing Committee Members 28 29 1. Selection Meeting 30 31 a. The members of the standing committees shall be elected by a quorum 32

of Hawai`i‟s National Convention delegates, at a meeting to be held on 33 May 29, 2016. (Call VII.B.1) 34

35 b. All members of the delegation shall receive adequate notice of the time, 36

date and place of the meeting to select the standing committee 37 members. (Call VII.B.1) 38

39 2. Allocation of Members 40 41 a. The members of the standing committees allocated to Hawai`i shall 42

proportionately represent the presidential preference of all candidates 43 (including uncommitted status) receiving the threshold percentage used 44 in the state‟s delegation to calculate the at-large apportionment pursuant 45 to Rule 13.E. of the Delegate Selection Rules. (Call VII.C.1 & Reg. 5.8) 46

b. The presidential preference of each candidate receiving the applicable 1 percentage or more within the delegation shall be multiplied by the total 2 number of standing committee positions allocated to Hawai`i. If the result 3 of such multiplication does not equal 0.455 or above, the presidential 4 preference in question is not entitled to representation on the standing 5 committee. If the result of such multiplication is 0.455 but less than 6 1.455, the presidential preference is entitled to one (1) position. Those 7 preferences securing more than 1.455 but less than 2.455 are entitled to 8 two (2) positions, etc. (Call VII.C.2) 9

10 c. Where the application of this formula results in the total allocation 11

exceeding the total number of committee positions, the presidential 12 candidate whose original figure of representation is farthest from its 13 eventual rounded-off total shall be denied that one (1) additional 14 position. Where the application of this formula results in the total 15 allocation falling short of the total number of committee positions, the 16 presidential candidate whose original figure of representation is closest 17 to the next rounding level shall be allotted an additional committee 18 position. (Call VII.C.3) 19

20 d. Standing committee positions allocated to a presidential candidate shall 21

be proportionately allocated, to the extent practicable, to each of the 22 three (3) standing committees. When such allocation results in an 23 unequal distribution of standing committee positions by candidate 24 preference, a drawing shall be conducted to distribute the additional 25 positions. (Call VII.C.4) 26

27 3. Presidential Candidate Right of Review 28 29 a. Each presidential candidate, or that candidate‟s authorized 30

representative(s), shall be given adequate notice of the date, time and 31 location of the meeting of the state‟s delegation authorized to elect 32 standing committee members. (Call VII.D.1) 33

34 b. Each presidential candidate, or that candidate‟s authorized 35

representative(s), must submit to the State Democratic Chair, May 20, 36 2016, 5:00 P.M. HST, a minimum of (1) name for each slot awarded to 37 that candidate for members of each committee. The delegation shall 38 select the standing committee members from among names submitted 39 by the presidential candidates (including uncommitted status). 40 Presidential candidates shall not be required to submit the name of more 41 than one (1) person for each slot awarded to such candidate for 42 members of standing committees. (Call VII.D.2) 43

44 4. Selection Procedure to Achieve Equal Division 45 46

a. Presidential candidates (including uncommitted status) shall use their 1 best efforts to ensure that their respective delegation of standing 2 committee members shall achieve Hawai`i‟s affirmative action goals and 3 that their respective members are equally divided between men and 4 women. (Rule 6.I & Reg. 4.9) 5

6 b. The presidential candidates or candidates who receives the highest 7

number of votes in Hawai„i‟s caucuses will be given the opportunity to 8 select the standing committee and gender preference for the first 9 committee. The candidate‟s representative will make the first selection. 10 The gender preference of the remaining two committees will alternate, 11 with the Presidential Candidates who receive the second and third 12 highest number of votes in Hawai„i‟s caucuses given the opportunity to 13 select the second and third highest standing committee, provided that 14 the Presidential candidates is entitled to representation on the standing 15 committee according to the mathematical formula specified in Sec.2.b, 16 consistent with Section 4.a. immediately above. 17

18 (1) A separate election shall be conducted for membership on 19

each standing committee. 20 21

(2) The membership of the standing committees shall be as 22 equally divided as possible under the state allocation; if the 23 number is even, the membership shall be equally divided 24 between men and women; if the number is odd, the variance 25 between men and women may not exceed one (1), and the 26 advantaged gender must not remain constant for the three 27 standing committees. (Call, VII.E.1.) 28

29 (3) The positions allocated to each presidential candidate on each 30

committee shall be voted on separately, and the winners shall 31 be the highest vote-getter(s) of the appropriate sex. 32

33 5. Certification and Substitution 34 35 a. The State Democratic Chair shall certify the standing committee 36

members in writing to the Secretary of the Democratic National 37 Committee within three (3) days after their selection. (Call VII.B.3) 38

39 b. No substitutions will be permitted in the case of standing committee 40

members, except in the case of resignation or death. Substitutions must 41 be made in accordance with the rules and the election procedures 42 specified in this section, and must be certified in writing to the Secretary 43 of the Democratic National Committee within three (3) days after the 44 substitute member is selected but not later than 48 hours before the 45 respective standing committee meets. (Call VII.B.4) 46

3 A. Hawai`i will select one (1) person to serve as Delegation Chair and 2 to serve as 4

National Convention Delegates, at a meeting to be held on May 29, 12 2016. (Call IV.E) 13

14 b. All members of the delegation shall receive timely notice of the time, 15

date and place of the meeting to select the Delegation Chair. (Rule 3.C) 16 17 2. The State Democratic Chair shall certify the Delegation Chair in writing to the 18

Secretary of the Democratic National Committee within three (3) days after 19 his or her selection. (Call IV.E) 20

21 C. Convention Pages 22 23 1. 2 individuals will be selected to serve as Hawai`i‟s Convention Pages by the 24

State Democratic Chair in consultation with the members of the Democratic 25 National Committee from the state. This selection will take place May 29, 26 2016. (Call IV.F.3, Appendix C & Reg. 5.7) 27

28 2. The Convention Pages shall be as evenly divided between men and women 29

as possible under the state allocation and shall reflect as much as possible, 30 the Affirmative Action guidelines in the Affirmative Action Plan. (Reg. 5.7.A) 31

32 3. The State Democratic Chair shall certify the individuals to serve as Hawai`i‟s 33

Convention Pages in writing to the Secretary of the Democratic National 34 Committee within three (3) days after the selection. (Call IV.F.3 & Reg. 5.7.B) 35 36

Section VI 37 General Provisions and Procedural Guarantees 38

39 A. The Democratic Party of Hawai`i reaffirms its commitment to an open party by 40

incorporating the “six basic elements” as listed below. These provisions 41 demonstrate the intention of the Democratic Party to ensure a full opportunity for 42 all minority group members to participate in the delegate selection process. (Rule 43 4.A. & Rule C) 44

45 1. All public meetings at all levels of the Democratic Party in Hawai`i should be 46

open to all members of the Democratic Party regardless of race, sex, age, 47

color, creed, national origin, religion, ethnic identity, sexual orientation, 1 gender identity, economic status or physical disability (hereinafter collectively 2 referred to as “status”). (Rule 4.B.1) 3

4 2. No test for membership in, nor any oaths of loyalty to, the Democratic Party in 5

Hawai`i should be required or used which has the effect of requiring 6 prospective or current members of the Democratic Party to acquiesce in, 7 condone or support discrimination based on “status.”(Rule 4.B.2) 8

9 3. The time and place for all public meetings of the Democratic Party in Hawai`i 10

on all levels should be publicized fully and in such manner as to assure timely 11 notice to all interested persons. Such meetings must be held in places 12 accessible to all Party members and large enough to accommodate all 13 interested persons. (Rule 4.B.3) 14

15 4. The Democratic Party in Hawai`i, on all levels, should support the broadest 16

possible registration without discrimination based on “status.”(Rule 4.B.4) 17 18 5. The Democratic Party in Hawai`i should publicize fully and in such a manner 19

as to assure notice to all interested parties a full description of the legal and 20 practical procedures for selection of Democratic Party officers and 21 representatives on all levels. Publication of these procedures should be done 22 in such fashion that all prospective and current members of each State 23 Democratic Party will be fully and adequately informed of the pertinent 24 procedures in time to participate in each selection procedure at all levels of 25 the Democratic Party organization.(Rule 4.B.5) 26

27 5. The Democratic Party in Hawai`i should publicize fully and in such a manner 28

as to assure notice to all interested parties, a complete description of the legal 29 and practical qualifications of all positions as officers and representatives of 30 the State Democratic Party. Such publication should be done in timely fashion 31 so that all prospective candidates or applicants for any elected or appointed 32 position within each State Democratic Party will have full and adequate 33 opportunity to compete for office. (Rule 4.B.6) 34

35 B. Discrimination on the basis of “status” in the conduct of Democratic Party affairs is 36

prohibited. (Rule 5.B) 37 38 C. Hawai`i‟s delegation shall be equally divided between delegate men and delegate 39

women, and alternate men and alternate women. Such goal applies to the entire 40 delegation, which includes all pledged delegates and alternates and all unpledged 41 delegates. Delegates and alternates shall be considered separate groups for 42 purposes of achieving equal division. (Rule 6.C) 43

44 D. All delegate and alternate candidates must be identified as to presidential 45

preference or uncommitted status at all levels which determine presidential 46 preference. (Rule 12.A) 47

1 E. No delegate at any level of the delegate selection process shall be mandated by 2

law or Party rules to vote contrary to that person‟s presidential choice as 3 expressed at the time the delegate is elected. (Rule 12.I) 4

5 F. Delegates elected to the national convention pledged to a presidential candidate 6

shall in all good conscience reflect the sentiments of those who elected them. 7 (Rule 12.J) 8

9 G. All delegates, alternates and standing committee members must be bona fide 10

Democrats who have the interests, welfare and success of the Democratic Party of 11 the United States at heart, who subscribe to the substance, intent and principles of 12 the Charter and Bylaws of the Democratic Party of the United States, and who will 13 participate in the Convention in good faith. (Rule 12.H & Reg. 4.25) 14

15 H. 40% of the members of any Party body above the first level of the delegate 16

selection process shall constitute a quorum for any business pertaining to the 17 selection of National Convention delegates, alternates, standing committee 18 members, and other official Convention participants. (Rule 15) 19

20 I. An accredited participant in a caucus, convention or committee meeting, after 21

having appeared at such meeting and having established credentials, may register 22 a non-transferable proxy with another duly accredited participant at that meeting 23 (except where an accredited alternate is present and eligible to serve as a 24 replacement), provided that no individual may hold more than three (3) proxies at 25 one (1) time. (Rule 16 & Reg. 4.29) 26

27 J. The unit rule, or any rule or practice whereby all members of a Party unit or 28

delegation may be required to cast their votes in accordance with the will of a 29 majority of the body, shall not be used at any stage of the delegate selection 30 process. (Rule 17.A) 31

32 K. Any individual or group of Democrats may sponsor or endorse a slate of 33

candidates for convention delegates. But no slate may, by virtue of such 34 endorsement, receive a preferential place on a delegate selection ballot or be 35 publicly identified on the ballot as the official Democratic Party organization slate, 36 and all slates must meet identical qualifying requirements for appearing on a ballot 37 at all levels of the delegate selection process. (Rule 17.B) 38

39 L. All steps in the delegate selection process, including the filing of presidential 40

candidates, must take place within the calendar year of the Democratic National 41 Convention, except with respect to the implementation of the Affirmative Action 42 Plan. (Rule 1.F, 11.B) 43

44 M. In electing and certifying delegates and alternates to the 2016 Democratic National 45

Convention, Hawai`i thereby undertakes to assure all Democratic voters in the 46 state a full, timely and equal opportunity to participate in the delegate selection 47

process and in all Party affairs and to implement affirmative action programs 1 toward that end: that the delegates and alternates to the Convention shall be 2 selected in accordance with the Delegate Selection Rules for the 2016 Democratic 3 National Convention: and that the delegates certified will not publicly support or 4 campaign for any candidate for President or Vice President other than the 5 nominees of the Democratic National Convention. Furthermore, voters in the state 6 will have the opportunity to cast their election ballots for the Presidential and Vice 7 Presidential nominees selected by said Convention, and for electors pledged 8 formally and in good conscience to the election of these Presidential and Vice 9 Presidential nominees, under the label and designation of the Democratic Party of 10 the United States. (Call II.B) 11

Affirmative Action, Outreach and Inclusion Plan 14 15 A. Statement of Purpose and Organization 16 17

1. Purpose and Objectives 18 19

a. In order that the Democratic Party at all levels be an open Party 20 which includes rather than excludes people from participation, a 21 program of effective affirmative action is hereby adopted by 22 Hawai`i. (Rule 5.A.) 23

24 b. Discrimination on the basis of “status” in the conduct of Democratic 25

Party affairs is prohibited. (Rule 5.B.) 26 27

c. All public meetings at all levels of the Democratic Party in Hawai`i 28 should be open to all members of the Democratic Party regardless 29 of race, sex, age, color, creed, national origin, religion, ethnic 30 identity, sexual orientation, economic status or physical disability 31 (hereinafter collectively referred to as “status”). (Rule 4.B.(1)) 32

33 d. Consistent with the Democratic Party‟s commitment to including 34

groups historically under-represented in the Democratic Party‟s 35 affairs, by virtue of race/ethnicity, age, sexual orientation, or 36 disability, Hawai`i has developed Party outreach programs. Such 37 programs include recruitment, education and training, in order to 38 achieve full participation by such groups and diversity in the 39 delegate selection process and at all levels of Party affairs for 2016. 40 (Rule 5.C & Reg. 4.7.) 41

42 e. In order to encourage full participation by all Democrats in the 43

delegate selection process and in all Party affairs, the Democratic 44 Party of Hawai`i has adopted and will implement programs with 45 specific goals and timetables for African Americans, Hispanics, 46 Native Americans, Asian/Pacific Americans and women. (Rule 6.A.) 47

1 1. The goal of the programs shall be to encourage participation in 2

the delegate selection process and in Party organizations at 3 all levels by the aforementioned groups as indicated by their 4 presence in the Democratic electorate. (Rule 6.A.(1)) 5

6 2.For the delegate selection process, “Youth” is defined as any 7

participant 36 years old and younger. 8 9 3. For the delegate selection process, individuals identifying as 10

Native Americans should provide tribal affiliation and indicate 11 if they are in enrolled in a tribe. 12

13 4. These goals shall not be accomplished either directly or indirectly 14

by the Party‟s imposition of mandatory quotas at any level of 15 the delegate selection process or in any other Party affairs. 16 (Rule 6.A.2) 17

18 2. Organizational Structure 19

20 a. The Hawai‟i State Democratic Chair shall appoint an Affirmative 21

Action Committee no later than March 18, 2015. (Rule 6.F.) 22 23

b. The Hawai„i State Democratic Chair shall certify in writing to the 24 Rules and Bylaws Committee of the Democratic National 25 Committee the compliance of the State‟s Affirmative Action 26 Committee with Rules 5.C, 6.A and 7, and submit the names, 27 demographic data and contact information no later than 15 days 28 after their appointment. (Reg. 2.2.K) 29

30 c. The Committee shall consist of members from each delegate 31

district representing the Democratic constituency groups set forth in 32 the Introduction to the Affirmative Action Plan. 33

34 d. The Affirmative Action Committee shall be responsible for: 35

36 (1) Reviewing the proposed Delegate Selection and Affirmative 37

Action Plans and making recommendations to the Hawai„i 38 State Democratic Chair. 39

40 (2) Reviewing the proposed Inclusion Programs and making 41

recommendations to the Hawai„i State Democratic Chair. 42 43

(3) Directing the implementation of all requirements of the 44 Affirmative Action section of this Plan. 45

(4) Implementing a financial assistance program for delegates 1 and alternates. (Rule 6.G.) 2

3 (5) Ensuring, on behalf of the Hawai„i State Central Committee, 4

that district lines used in the delegate selection process are 5 not gerrymandered to discriminate against African Americans, 6 Hispanics, Native Americans, Asian/Pacific Americans and 7 women. (Rule 6.E.) 8

9 e. Financial and staff support for the Affirmative Action Committee 10

shall be provided by the Hawai„i State Central Committee to the 11 greatest extent feasible, including, but not limited to, making 12 available on a priority basis, the Hawai„i State Party staff and 13 volunteers and covering all reasonable costs incurred in carrying 14 out this Plan. 15

16 3. Implementation of the Affirmative Action Plan shall begin no later than 17

September 16, 2015, with the distribution of the press kits, and will 18 continue through the end of the delegate selection process. (Rule 1.F.) 19

20 B. Efforts to Educate on the Delegate Selection Process 21 22

1. Well-publicized educational workshops will be conducted in each of the 23 delegate districts beginning in September 2015. These workshops will be 24 designed to encourage participation in the delegate selection process, 25 including apprising potential delegate candidates of the availability of 26 financial assistance. These workshops will be held in places which are 27 easily accessible to persons with physical disabilities. The times, dates, 28 places and rules for the conduct of all education workshops, meetings and 29 other events involved in the delegate selection process shall be effectively 30 publicized by the party organization and include mailings to various 31 organizations representative of the Democratic voting populace. (Rules 32 3.A., 3.C. & 3.D.) 33

34 2. A speaker‟s bureau of volunteers from the Affirmative Action Committee 35

comprised of individuals, who are fully familiar with the process, will be 36 organized to appear before groups, as needed, to provide information 37 concerning the process. 38

39 3. The Hawai„i State Party‟s education efforts will include outreach to community 40

leaders within the Democratic Party‟s constituencies and making sure that 41 information about the delegate selection process is available to 42 Democratic Precinct clubs and Party caucuses representing specific 43 constituencies. 44

45 4. The Hawai„i State Party will publish and make available at no cost: a clear and 46

concise explanation of how Democratic voters can participate in the 47

delegate selection process; an explanation of how, where and when 1 persons can register to vote; and delegate district maps. The Party shall 2 also make available copies of the State Party Rules, the Delegate 3 Selection Plan (and its attachments), the Affirmative Action Plan, and 4 relevant state statutes at no cost. Copies of multilingual documents related 5 to the state‟s delegate selection process will be prepared and the 6 Affirmative Action Committee will distribute them in the various delegate 7 districts not later than November 16, 2015. Request for copies via e-mail 8 will also be available upon request at: [email protected]. 9 (Rule 1.H.) 10

11 5. The State Party shall take all feasible steps to encourage persons to register 12

and to vote as Democrats and will seek to ensure simple and easy 13 registration procedures. (Rule 2.C.) 14

15 16 C. Efforts to Publicize the Delegate Selection Process 17 18

1. Special attention shall be directed at publicizing the delegate selection process 19 in the state. Such publicity shall include information on eligibility to vote 20 and how to become a candidate for delegate, the time and location of 21 each stage of the delegate selection process and where to get additional 22 information. The Party organization, official, candidate, or member calling 23 a meeting or scheduling an event, shall effectively publicize the role that 24 such meeting or event plays in the selection of delegates and alternates to 25 the Democratic National Convention. (Rules 3.C. and 3.D.) 26

27 2. Newspapers, radio and television will be utilized to inform the general public 28

how, when and where to participate in the delegate selection process. 29 Specifically, this information should provide details as to how to qualify to 30 run as a delegate candidate. The State Democratic Chair, Affirmative 31 Action Committee members and staff shall direct special effort to the 32 major daily newspapers, radio and television stations. Regular releases 33 during the delegate selection process to all other media sources, weekly 34 newspapers, and wire services should complete timely coverage. (Rules 35 4.B. (3) & 6.D.) 36

37 3. A priority effort shall be directed at publicity among the Democratic Party‟s 38

constituencies. 39 40

(a) Information about the delegate selection process will be provided to 41 minority newspapers and radio stations, ethnic press, Native 42 American, Asian/Pacific Americans, Spanish-speaking and other 43 non-English press, radio stations and publications, and women‟s 44 organizations, student newspapers, gay and lesbian press, 45 disability press, and any other specialty media in the state that is 46

likely to reach the Democratic constituency groups set forth in the 1 Introduction of this Affirmative Action Plan. 2

3 (b) The Hawai„i State Democratic Party shall be responsible for the 4

implementation of this publicity effort. For purposes of providing 5 adequate notice of the delegate selection process, the times, dates, 6 places and rules for the conduct of events shall be effectively 7 publicized, multilingual where necessary, to encourage the 8 participation of minority groups. (Rule 6.D.) 9

10 4. Not later than November 16, 2015, a press kit shall be made and provided to 11

each daily and weekly newspaper as well as to the electronic media. The 12 press kit will include: 13

14 (a) A summary of all pertinent rules related to the state‟s delegate 15

selection process; 16 17 (b) A map of delegate districts and how many delegates will be elected 18

within each district; 19 20 (c) A summary explaining the operation and importance of the 2016 21

Convention; and 22 23 (d) Materials designed to encourage participation by prospective delegate 24

candidates. 25 26 D. Representation Goals 27 28

1. The Hawai„i State Democratic Party has determined the demographic 29 composition of African Americans, Hispanics, Native Americans, and 30 Asian/Pacific Americans in the state‟s Democratic electorate. These 31 constituency percentages shall be established as goals for 32 representation in the state‟s convention delegation. (Rule 6.A.) 33

34 2. The Hawai„i State Party has determined the demographic composition of 35

members of the GLBT community, people with disabilities, and youth in 36 the state‟s Democratic electorate and furthermore, the State Party has 37 chosen to establish these percentages as goals for representation in the 38 state‟s convention delegation. 39

2 3. When selecting the at-large portion of the delegation, the demographic 3

composition of the other delegates (district-level, pledged PLEO, and 4 unpledged) shall be compared with the State Party‟s goals in order to achieve 5 an at-large selection process that helps to bring about a representative 6 balance. 7

8 4. Use of the at-large delegation to achieve the affirmative action goals 9

established by this Plan does not obviate the need for the State Party to 10 conduct outreach activities such as recruitment, education and training. (Rule 11 6.A.3) 12

13 E. Obligations of Presidential Candidates to Maximize Participation 14 15 1. Presidential candidates shall assist the Hawai`i Democratic Party in meeting 16

the demographic representation goals reflected in the Affirmative Action Plan. 17 (Rule 6.H) 18

19 2. Each presidential candidate must submit a written statement to the State 20

Democratic Chair by February 26, 2016, 5:00 P.M. HST which indicates the 21 specific steps he or she will take to encourage full participation in Hawai`i‟s 22 delegate selection process, including, but not limited to, procedures by which 23 persons may file as candidates for delegate or alternate. (Rule 6.H.1) 24

3. Each presidential candidate must submit demographic information with 1 respect to all candidates for delegate and alternate pledged to them. Such 2 information shall be submitted in conjunction with the list of names approved 3 for consideration as delegate and alternate candidates pledged to the 4 presidential candidate. (Rule 6.H.2) 5

6 4. Presidential candidates (including uncommitted status) shall use their best 7

effort to ensure that their respective delegations within the state‟s delegate, 8 alternate and standing committee delegations shall achieve the affirmative 9 action goals reflected in the Affirmative Action Plan and that the respective 10 delegations of each presidential candidate shall be equally divided between 11 men and women. Furthermore, presidential candidates shall use their best 12 efforts at the district level to approve delegate and alternate candidates who 13 meet applicable equal division and affirmative action considerations in order 14 to achieve the affirmative action goals and equal division for their respective 15 delegations. (Rule 6.I & Reg. 4.9) 16

Section VIII 1 Challenges 2

3 A. Jurisdiction & Standing 4 5 1. Challenges related to the delegate selection process are governed by the 6

Regulations of the DNC Rules and Bylaws Committee for the 2016 7 Democratic National Convention (Reg. Sec. 3), and the “Rules of Procedure 8 of the Credentials Committee of the 2016Democratic National 9 Convention.”(Call Appendix A) 10

11 2. Under Rule 20.B. of the 2016 Delegate Selection Rules, the DNC Rules and 12

Bylaws Committee has jurisdiction over challenges pertaining to the 13 submission, non-implementation and violation of state Delegate Selection and 14 Affirmative Action Plans. (Rule 20.B & Call Appendix A) 15

16 3. The Rules and Bylaws Committee has jurisdiction to hear and decide any 17

challenge provided it is initiated before the 56th day preceding the date of the 18 commencement of the 2016 Democratic National Convention. (Call Appendix 19 A & Reg. 3.1) 20

21 4. Challenges to the credentials of delegates and alternates to the 2016 22

Democratic National Convention initiated on or after the 56th day preceding 23 the date of commencement of the Democratic National Convention shall be 24 processed in accordance with the “Rules of Procedure of the Credentials 25 Committee of the 2016 Democratic National Convention.”(Call Appendix A) 26

27 5. Any challenge to the credentials of a standing committee member shall be 28

considered and resolved by the affected standing committee in accordance 29 with Appendix A of the Call for the 2016 Democratic National Convention. The 30 Rules and Bylaws Committee shall have jurisdiction over challenges brought 31 before the 56th day preceding the date of the commencement of the 32 Democratic National Convention. (Call VII.B.5) 33

34 6. Copies of the Regulations of the Rules and Bylaws Committee and/or the Call 35

for the 2016 Democratic National Convention, including the Rules of 36 Procedure of the Credentials Committee (Appendix A), shall be made 37 available by the State Party upon reasonable request. 38

39 7. Any group of 15 Democrats with standing to challenge as defined in Reg. 3.2 40

43 B. Challenges to the Status of the State Party and Challenges to the Plan 44 45 1. A challenge to the status of the State Party Committee as the body entitled to 46

sponsor a delegation from that state shall be filed with the Rules and Bylaws 47

Committee not later than 30 calendar days prior to the initiation of the state‟s 1 delegate selection process. (Rule 20.A & Reg. 3.4.A) 2

3 2. A challenge to the state‟s Delegate Selection Plan shall be filed with the Chair 4

of the Hawai`i Democratic Party and the Co-Chairs of the Rules and Bylaws 5 Committee within15 calendar days after the adoption of the Plan by the State 6 Party. (Reg. 3.4.B) 7

8 3. A challenge to a Plan must be brought in conformity with the Rules and the 9

Regs., which should be consulted for a detailed explanation of challenge 10 procedures. 11

12 C. Challenges to Implementation 13 14 1. A challenge may be brought alleging that a specific requirement of an 15

approved Plan has not been properly implemented. Jurisdiction over all 16 challenges initiated in a timely fashion shall reside with either the Rules and 17 Bylaws Committee or the Credentials Committee of the National Convention 18 (See Section VII.A. above). However, the Rules and Bylaws Committee may 19 provide advice, assistance or interpretations of the Delegate Selection Rules 20 at any stage of the delegate selection process. (Reg. 3.1.C) 21

22 2. An implementation challenge brought before the Rules and Bylaws 23

Committee is initiated by filing a written challenge with the State Party 24 Committee and with the Rules and Bylaws Committee not later than 15 days 25 after the alleged violation occurred. The State Party has 21 days to render a 26 decision. Within 10 days of the decision, any party to the challenge may 27 appeal it to the Rules and Bylaws Committee. If in fact, the State Party 28 renders no decision, any party to the challenge may request the Rules and 29 Bylaws Committee to process it. The request must be made within 10 days 30 after expiration of the above 21-day period. (Reg. 3.4.C, E, & H) 31

32 3. Performance under an approved Affirmative Action Plan and composition of 33

the convention delegation shall be considered relevant evidence in the 34 challenge to any state delegation. If a State Party has adopted and 35 implemented an approved affirmative action program, the State Party shall 36 not be subject to challenge based solely on delegation composition or primary 37 results. (Rule 6.B) The procedures are the same for challenges alleging 38 failure to properly implement the Affirmative Action section of a Plan, except 39 that such challenges must be filed not later than 30 days prior to the initiation 40 of the state‟s delegate selection process. (Reg. 3.4.C) 41

42 4. Depending on the appropriate jurisdiction (see Section VIII.A. above), 43

implementation challenges must be brought in conformity with the 44 Regulations of the Rules and Bylaws Committee or the Rules of Procedure of 45 the Credentials Committee, which should be consulted for a detailed 46 explanation of challenge procedures. 47
