PartyoftheUnitedStates,theDelegateSelectionRulesforthe2012DemocraticNational

Convention(Rules),theCallforthe2012DemocraticNationalConvention(Call),theRegulationsoftheRulesandBylawsCommitteeforthe2012DemocraticNationalConvention

(Regs.),therulesoftheDemocraticPartyofMissouri,theMissourielectioncode,andthis

DelegateSelectionPlan.(Call,II.A.)

3. FollowingtheadoptionofthisDelegateSelectionPlanbytheStatePartyCommittee,itshalbesubmittedforreviewandapprovalbytheDNCRulesandBylawsCommittee(RBC).

TheStatePartyChairshallbeempoweredtomakeanytechnicalrevisionstothisdocumentasrequiredbytheRBCtocorrectanyomissionsand/ordeficienciesasfoundbytheRBCtoensureitsfullcompliancewithPartyRules.SuchcorrectionsshallbemadebytheState

PartyChairandthePlanresubmittedtotheRBCwithin30daysofreceiptofnoticeofthe

RBCsfindings.(Regs.2.5,2.6&2.7)

4. OncetheRBChasfoundthisPlaninCompliance,anyamendmenttothePlanbytheStatePartywillbesubmittedtoandapprovedbytheRBCbeforeitbecomeseffective.(Reg.2.9)

B. DescriptionofDelegateSelectionProcess

1. MissouriwilluseaproportionalrepresentationsystembasedontheresultsofthePrimaryforapportioningdelegatestothe2012DemocraticNationalConvention.

2. ThefirstdeterminingstepofMissourisdelegateselectionprocesswilloccuronFebruary7,2012,withaPrimaryelection.

3. VoterParticipationinProcess

a. ParticipationinMissourisdelegateselectionprocessisopentoallvoterswhowishtoparticipateasDemocratsandarecurrentmembersoftheMissouriDemocraticParty.

i. RegistrationQualifications:

4. Missouriisparticipatinginthestategovernment-runpresidentialpreferenceprimarythat

willutilizegovernment-runvotingsystems.TheStatePartyhastakenprovablepositivestepsto:

a. Promotetheacquisitionofaccessibleprecinctbasedopticalscansystems,whereverpossible.(Rule2.H.(1))

b. Seekenactmentoflegislation,rules,andpoliciesatthestateandlocalleveltoensurethatdirectrecordingelectronicsystemsincludeavoterverifiedpapertrail(Rule2.H.(2))

c. Seekenactmentoflegislationandrules/policiesatthestateandlocalleveltoensure

thatbothopticalscananddirectrecordingelectronicsystemsincluderecognized

securitymeasures.Thesemeasuresincludeautomaticroutinemanualauditscomparingpaperrecordstoelectronicrecordsfollowingeveryelectionandpriorto

certificationorresultswherepossible;paralleltestingonelectionday;physicalandelectronicsecurityforequipment;banninguseofwirelesscomponentsandconnections;publicdisclosureofsoftwaredesign;useoftransparentandrandom

chairshallberesponsibleforthelocationofthedistrictmassmeeting.All

massmeetingsandconventionsshallbeheldinpublicplaces,readilyaccessibleandlargeenoughtoaccommodatetheanticipatedassembly.Atall

massmeetingsandconventionseveryeffortshallbemadetoprovidepublic

meetingplacesaccessibletohandicappedpersons,ortoprovideassistancetothosehandicappedpersonswhowishtoparticipate.Thelocationofthe

massmeetingsorconventionsshallbeapublicplacewithinthepoliticalsubdivision.Privatehomesshallnotbeconsideredpublicplaces.

committeepersonreceivingthehighestnumberofvotesatthelastprecedingelectionshallbethechair.Ifneithercommitteepersonwaselected,seniorityasa

CommitteemeetingandtheStateDemocraticConvention.TheSecretaryoftheStateDemocraticCommitteeshallserveasSecretary.IntheeventtheChairisunableto

serve,thenextavailablehighestrankingofficeroftheStateDemocraticCommittee

shallserve.Ifnoofficerisabletoserve,thosedelegatesattendingandeligibletoparticipateshallelectatemporarychairandsecretary.

8. ParticipationCertification,OfficialRolls

a. MassMeetings

i. Allpersonspresentandeligibletoparticipateatamassmeetingshallconstitutethequorumofthemeeting.Everypersonattendingaward,township,legislativedistrict,orcountymassmeetingshallsigna

standardizeddeclarationfurnishedbytheStateDemocraticCommittee.They

shallthenreceiveastandardizedpledgeofsupportformthattheyshallcompleteandsubmittothetemporarycaucusleaderwhencaucusesare

formed.

ii. Itshallbetheresponsibilityifthechairofthemassmeetingtoinsurethatallpersonsinlinetosignthedeclarationby7:30p.mshallbepermittedtoparticipateinthemeeting.Thechairmayappointsuchpersonsasmaybe

necessarytocarryoutthisresponsibility.Itshouldusuallybesufficienttonotethelastpersontheninline.Innocaseshouldmeetingdoorsbesecured

insuchamannerthatthepublicisexcludedfromthemeetingafterall

eligibleparticipantshavesignedthedeclarationandreceivedtheirpledgeof

supportform.

iii. Itshallbetheresponsibilityofthesecretaryofthemassmeetingtoobtainthedeclarationfromeverypersonparticipatinginthemassmeetingandto

takeminutes.Thesecretarymayappointsuchpersonsasmaybenecessary

toassistincarryingoutthisresponsibility.Thesecretaryshallberesponsibleforthesafekeepingofthedeclarationandminutesofthemassmeeting,and

fordistributingthemtotheproperauthoritiesintheeventofachallengeor

anappeal.Thesecretaryshallwithin(10)dayssubmitcopiesofthedeclarationsatthemassmeetingtotheStateCommitteeheadquarters.After

allthedelegatesfromthemassmeetinghavebeenselected,themeetingchairshallcertifyimmediatelytotheappropriatecountyandcongressional

districtchairsandStateDemocraticChairthelistofdelegatesselected.The

certificationshallbesubmittedonastandardizedform,furnishedbytheStateDemocraticCommittee,andattestedtobythemeetingsecretary.


i. Thecertificationlistssubmittedbythechairoftheward,township,andlegislativedistrictmassmeetingsshallconstitutetheofficialrollofthe

countyconvention.Thesecretaryofthecountyconventionshallbe

responsiblefortakingandsafeguardingtheminutesofthecountyconvention,andfordistributingthemtotheproperauthoritiesintheevent

ofachallengeoranappeal.Thesecretaryshallwithinten(10)dayssubmitcopiesoftheminutesofthecountyconventiontotheStateDemocratic

Committeeheadquarters.Afteralldelegatesfromthecountyconvention

havebeenselected,theconventionchairshallimmediatelycertifytotheappropriatecongressionaldistrictchairandtheStateDemocraticChairthe

listofdelegatessoselected.Thecertificationshallbesubmittedona

standardizedformfurnishedbytheStateDemocraticCommittee,andattestedtobytheconventionsecretary.

c. CongressionalDistrictConventions

i. ThecertificationlistsfromcountymassmeetingsandconventionsandthemasswardandtownshipmeetingsintheCityofSt.Louis,St.LouisCounty,

andJacksonCountyshallconstitutetheofficialrollofthecongressional

districtconvention.Thesecretaryofthecongressionaldistrictconventionshallberesponsiblefortakingandsafeguardingtheminutesofthe

congressionaldistrictconvention,andfordistributingthemtotheproperauthoritiesintheeventofachallengeorappeal.Thesecretaryshallwithin

ten(10)dayssubmitcopiesoftheminutesofthecongressionaldistrict

conventiontotheStateDemocraticheadquarters.Afterallnationalconventiondelegateshavebeenselectedbythecongressionaldistrict

convention,theconventionchairshallimmediatelycertifytotheStateDemocraticChairthelistofnationalconventiondelegatessoselected.The

certificationshallbesubmittedonastandardizedformfurnishedbythe

i. ThedulyelectedmembersoftheMissouriStateDemocraticCommitteeshallconstitutetheofficialroleoftheStateDemocraticCommitteemeeting.TheSecretaryoftheStateDemocraticCommitteeshallberesponsiblefortaking

andsafeguardingtheminutesofthemeeting,andfordistributingthemtothe

i. ThecertificationlistsfromcountymassmeetingsandconventionsandthemasswardandtownshipmeetingsoftheCityofSt.Louis,St.LouisCounty,andJacksonCountyshallconstitutetheofficialroleoftheStateDemocratic

Convention.TheSecretaryoftheStateDemocraticCommitteeshallberesponsiblefortakingandsafeguardingtheminutesoftheStateDemocratic

conventionandfordistributingthemtotheproperauthoritiesintheeventof

achallengeorappeal.

9. MeetingProcedures

a. Asthefirstorderofbusinessateverymassmeetingorconvention,thechairshallexplaintheprocedureandrulesforselectionofdelegates.

b. Next,inthosewards,townships,legislativedistrictsandcountieshavingmorethanonecongressionaldistrict,thechairshalldividetheparticipantsbycongressionaldistrictofresidence.Theparticipantsineachcongressionaldistrictshallthenhold

separatesubmeetingsforthepurposeofformingcaucusesandelecting

congressionaldistrictleveldelegates.

c. Withineachmassmeetingorconvention,onlythosepresidentialpreferencesincludinguncommittedwhoonthebasisofthepresidentialpreferenceprimaryare

entitledtoatleastoneNationalConventiondelegatefromthecongressionaldistrict

inwhichthejurisdictionislocated(qualifiedpreference)canhavecaucusesformedontheirbehalf.Delegatepositionshallbeallocatedaccordingtothecongressional

districtprimaryvoteexceptthatpreferenceswhichhavenotattaineda15%

thresholdshallnotbeentitledtoanydelegate,andaccordinglyshallnotbedeemedaqualifiedpreference.Ifnopresidentialpreferencereachesa(15%)threshold,the

thresholdshallbethepercentageofthereceivedbythefront-runnerminus(10%).

10. ApportionmentofDistrict-LevelDelegatesandAlternates

a. Theapportionmentofdelegatestobeselectedbyeachcaucusshallbedeterminedasfollows:

delegatesshallbeselectedbylot.

b. Themeetingorconventionchairpersonshallthenaskeachparticipanttojoinan

eligiblecaucus.Eacheligiblecaucusshallelectapermanentchairpersonasthefirstorderofbusiness.Votingshallbeasigned,writtenballotwithadequatesafeguards.

Ifnocandidateforpermanentcaucuschairpersonreceivesasimplemajorityofthe

votescast,arunoffelectionshallbeheldbetweenthetwo(2)receivingthehighestnumberofvotes.

c. Thefollowingrulesapplytotheelectionofdelegatesandalternatesateverylevelof

thedelegateselectionprocess.

i. Nopersonshallbenominatedandelectedadelegateoralternatewhoisnot

aresidentandregisteredvoterinthepoliticalsubdivisionfromwhichheor

sheisbeingelected,andamemberoftheDemocraticParty.AmemberoftheDemocraticPartyisanyonewhoiseighteen(18)yearsofage,whoisa

registeredvoterunderthelawsofMissouri,whodeclaresthatheorsheisaDemocrat,whoisnotamemberofanyotherpoliticalpartyotherthanthe

DemocraticParty.

ii. AnyindividualorgroupofDemocratsmaysponsororendorseaslateofcandidates.Butnoslatemayreceivepreferentialtreatmentorbepublicly

identifiedastheofficialslate.Noslatemayappearontheofficialballotsusedforcastingvotesfordelegatesoralternates.

d. Eachcaucusleadershallopenthefloorforthenominationofdelegates.Nominating

speechesmaybelimitedbythecaucusleaderbutshallnotbelimitedtolessthana

totalofthree(3)minutesperdelegatecandidate.Nominationsshallbefromtheflooronly.IndividualsnominatedfromthefloorforNationalConventiondelegate

mustalsohavebeenonthelistofdelegatecandidatesapprovedbythepresidential

e. Afterallnominationshavebeenmadedelegatesshallbeelectedbywrittenballotwithadequatesafeguards.

f. Missourisdistrict-leveldelegatesareapportionedamongthedistrictsbasedonaformulagivingequalweighttothevotefortheDemocraticcandidatesinthe2008

presidentialandthemostrecentgubernatorialelections.

1. Inthecasewherethepresidentialcandidatehasonlyonealternate,

I. Anaccreditedparticipantinacaucus,conventionorcommitteemeeting,afterhavingappearedat

A. StatementofPurposeandOrganization

1. AllpublicmeetingsatalllevelsoftheDemocraticPartyinMissourishouldbeopentoallmembersoftheDemocraticPartyregardlessofrace,sex,age,color,creed,nationaloriginreligion,ethnicidentity,sexualorientation,economicstatus,orphysicaldisability(hereinaftercollectivelyreferredtoasstatus).

2. InorderthattheDemocraticPartyatalllevelsbeanopenPartywhichincludesrather

thanexcludespeoplefromparticipation,aprogramofeffectiveaffirmativeactionis

herebyadoptedbyMissouri.

Americans,Hispanics,NativeAmericans,Asian/PacificAmericans,personswithdisabilities,membersoftheLGBTcommunity,youthandwomen.

a. ThegoaloftheaffirmativeactionprogramsshallbetoencourageparticipationinthedelegateselectionprocessandinPartyorganizationsatalllevelsbythe

aforementionedgroupsasindicatedbytheirpresenceintheDemocraticelectorate.

b. ThisgoalshallnotbeaccomplishedeitherdirectlyorindirectlybythePartysimpositionofmandatoryquotasatanylevelofthedelegateselectionprocessorinanyotherPartyaffairs,exceptinthecaseofwomen.

6. PresidentialcandidatesshallassisttheMissouriDemocraticPartyinmeetingthedemographicrepresentationgoalsreflectedintheAffirmativeActionPlan.Presidential

candidatesmustsubmitplansforhelpingtheStateDemocraticPartytoreachitsdemographic,affirmativeaction,andequaldivisiongoalsbyDecember3,2011.

a. EachpresidentialcandidatemustsubmitawrittenstatementtotheStateDemocraticChairwhichindicatesthespecificstepsheorshewilltaketoencourage

fullparticipationinMissourisdelegateselectionprocessincluding,butnotlimitedto,proceduresbywhichpersonsmayfileascandidatesfordelegatesoralternate.

C. ImplementationofthePlan

1. Publicitya. Specialattentionshallbedirectedatpublicizingthedelegateselectionprocessinthestate.Suchpublicityshallincludeinformationoneligibilitytovoteandhowto

becomeacandidatefordelegate,thetimeandlocationofeachstageofthedelegateselectionprocessandwheretogetadditionalinformation.Theforegoing

informationwillalsobepublishedinthestatepartynewspaper.Theparty

organization,official,candidate,ormembercallingameetingorschedulinganevent,shalleffectivelypublicizetherolethatsuchmeetingoreventplaysinthe

selectionofdelegatesandalternatestotheDemocraticNationalConvention.

b. Newspapers,radio,andtelevisionwillbeutilizedtoinformthegeneralpublichow,when,andwheretoparticipateinthedelegateselectionprocess.Specifically,thisinformationshouldprovidedetailsastohowtoqualifytorunasadelegate

candidate.Specialeffortshallbedirectedtothemajordailynewspapers,radio,and

televisionstationsbytheStateDemocraticChair,AffirmativeActionCommitteemembersandstaff.Regularreleasesduringthedelegateselectionprocesstoall

othermediasources,weeklynewspapers,andwireservicesshouldcompletetimely

coverage.

c. Apriorityeffortshallbedirectedatpublicityinminoritynewspapersandradiostations,ethnicpress,NativeAmerican,Asian/PacificAmerican,Spanishspeaking

andothernon-Englishpress,radiostations,andpublications,womens

organizations,studentnewspapers,LGBTnewsoutletsandanyotherspecialmediainthestatethatislikelytoreachthestatusgroupssetforthintheIntroductionof

thisAffirmativeActionPlan.TheStateDemocraticPartyshallberesponsibleforthe

1. WellpublicizededucationalworkshopswillbeconductedineachofthedelegatedistrictsbeginninginSeptember2011.Theseworkshopswillbedesignedtoencourageparticipationinthedelegateselectionprocess,includingapprisingpotentialdelegate

candidatesoftheavailabilityoffinancialassistance.Theseworkshopswillbeheldinplaceswhichareeasilyaccessibletopersonswithphysicaldisabilities.Thetimes,dates,
