The Committee visited the site of the following application: Application No. Site and Proposal 3/11/0089/FUL Erect 2 storey dwelling and detached double garage.

RESOLVED that the applications contained in this schedule be determined or otherwise dealt with in accordance with the Development Manager's recommendation.

1. 3/10/1124/FUL

Construction of dwelling as amended by plans received 16 February 2011. R/O 2 Lewens Lane, Wimborne.

Public speaking:

Neil Bishard, the applicant’s architect, explained that the proposed house was designed to compliment the adjoining conservation area and that the entrance driveway was the only available option. The property had been designed to fit the plot and was to a size in keeping with neighbouring houses. The site had existing permission for a 3 bedroom house and a conservation survey had revealed that there would be a negligible impact on wildlife.

GRANTED.

1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

2. The development hereby permitted shall be carried out in accordance with the following approved plans: 1159.01A, 1159.02A, 1159.03A, 1159.04B and 1159.05A.

3. Details and samples of all external facing and roofing materials shall be submitted to and approved in writing by the Local Planning Authority before any on-site work commences. All works shall be undertaken strictly in accordance with the details as approved.

4. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 or any subsequent re-enactment thereof no extension to the dwelling, porch, garage or car port shall be erected nor any hardstanding area extended without express planning permission first being obtained.

5. Details of the proposed fenestration, to include full joinery details, subsills, label moulds, and parapet cappings at a scale of not less than 1:10 shall be submitted to and agreed in writing by the Local Planning Authority prior to any development commencing on site. All works shall then be undertaken strictly in accordance with the details as approved.

6. There shall be no external plumbing on the front elevation other than that indicated on the submitted drawing No. 1159.05A, and all rainwater goods should be of cast iron or cast aluminium.

7. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 or any subsequent

re-enactment no further windows shall be constructed in the southwest elevation (such expression to include the roof and wall) of the building hereby permitted, unless otherwise agreed in writing by the Local Planning Authority.

8. Before the development is commenced, proposals for the landscaping of the site, to include provision for the retention and protection of existing trees and shrubs, if any, thereon, together with any means of enclosure proposed or existing within or along the curtilage of the site shall be submitted to and approved by the District Planning Authority by means of a large scale plan and a written brief. All proposed and existing trees and shrubs shall be correctly described and their positions accurately shown. Upon approval such new planting shall be carried out during the planting season October/March inclusive, in accordance with the appropriate British Standards for ground preparation, staking, etc., in BS4428:1989 (1979), immediately following commencement of the development. The landscaping shall thereafter be maintained for five years during which time any specimens which are damaged, dead or dying shall be replaced and hence the whole scheme shall thereafter be retained.

9. Notwithstanding details already submitted with the application, no development, including ground works, shall start on site until an Arboricultural Method Statement (AMS) and Tree Protection Plan (TPP), has been submitted to and approved in writing by the Local Planning Authority. The Arboricultural Officer shall then be invited to a pre-commencement meeting with the site manager following the installation of the tree protective fencing and the development shall then be carried out strictly in accordance with the approved AMS throughout the duration of construction.

10. The development hereby permitted shall not be brought into use until the access, turning space, garaging and parking shown on the approved plan has been constructed and these shall be maintained and be kept available for that purpose at all times.

11. No development shall take place on the site, until a Construction Method Statement has been submitted to, and approved in writing by, the local planning authority. The approved Statement shall be adhered to throughout the construction period. The Statement shall provide for:

• the parking of vehicles of site operatives and visitors; • loading and unloading of plant and materials; • storage of plant and materials used in constructing the

development; • measures to control the emission of dust and dirt during

construction

Notes: 1. In considering the application the Council were mindful of PPS5. 2. The applicant/s has/have provided a unilateral undertaking dated ^IN; to pay the appropriate contribution in relation to Heathland mitigation as required by the Dorset Heathlands Interim Planning Framework 2006-2009 (as amended).

3. 3/11/0022/FUL

Change of use of ground floor from shop (A1) to doctors surgery (D1) and addition of porch/lobby. 2 Station Road, Alderholt. Public speaking:

Dr Hywel Morris, the applicant, explained that the new surgery would provide a better building in a better location with improved disability access. There would be no loss of community as there was a village hall, community centre and small supermarket nearby and the site of the proposed development had not been able to support a shop in the past. His proposals had received a good level of support at a recent well attended open meeting.

Mr Simon Rutter, the architect for the proposal, explained that the development would maintain the presence of a practice that had a long history of commitment to the village and would offer improved facilities. Mr Rutter pointed out that objections received had focused on the loss of the site as a retail unit, which had failed in the past, rather than its conversion to a GP surgery.

Mr Norman Jones objected to the proposals. The village had a pub, a post office and a small supermarket to serve 3,500 people. A proposed new housing estate with planning permission could increase the population to nearer 4,000. The site of the proposed surgery was in a prime location for a retail outlet would help to attract people to village shopping. Mr Jones noted that the proposal included a document storage facility which he regarded as unsuitable for a village centre retail site.

Rev. Phillip Martin objected to the proposal as he believed that the village centre deserved better than a part time surgery that would also be used for document storage. A patients’ consultation group had been formed by the practice so if the application was refused it would allow better consultation within the village. Rev. Martin was of the view that a shared facility at the site could be developed.

There were no more public speakers on this item.

Members of the Committee did not agree with the recommendation of the Development Control Manager. Members were of the opinion that approval would be contrary to planning policy SHEDEV8 as it was not shown that the existing retail unit was unviable.

REFUSED.

1. The proposal is unacceptable as it would result in the loss of a shop within the village of Alderholt where such facilities are limited. The applicants have also failed to demonstrate that the existing use is unviable as a retail outlet. The proposal would therefore conflict with

GRANTED.

1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

2. The development hereby permitted shall be carried out in accordance with the following approved plans: 054/1C and 054/2C.

3. Details and samples of all external facing and roofing materials shall be submitted to and approved in writing by the Local Planning Authority before any on-site work commences. All works shall be undertaken strictly in accordance with the details as approved.

4. The development hereby permitted shall not be brought into use until the access, garaging and parking shown on the approved plan has been constructed and these shall be maintained and be kept available for that purpose at all times.

7. The protection of the Lime trees on site shall be carried out in accordance with the Tree Protection Plan 03/10/2 Revision JA which has been submitted as an amended plan. The tree protection shall be erected in accordance with the written specification on the Tree Protection Plan drawing and positioned as shown on the red line before any equipment, materials or machinery are brought onto the site for the purposes of development. The tree protection shall be retained until the development is completed and nothing shall be placed within the fencing, nor shall any ground levels be altered, nor shall any excavation be made without the written consent of the planning authority.

8. The Bat Mitigation Report dated 6.1.2011 and signed by the Applicants shall be carried out in its entirety in accordance with the timescale detailed in the Bat Survey by Lindsay Carrington Ecological Services Ltd dated December 2010. The Agent is reminded that a Bat Licence is required from Natural England for these works.

9. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 or any subsequent re-enactment, no alteration or extension shall be carried out at first floor level, or above first floor level, which materially affects the appearance of the dwelling(s), without express planning permission first being obtained.

10. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 or any subsequent re-enactment thereof no extension to the dwelling shall be constructed without express planning permission first being obtained.

11. No development shall take place, including any works of demolition, until a Construction Method Statement has been submitted to, and approved in writing by, the local planning authority. Two storey rear and side extension and detached garage. 21 Sandy Lane, St Ives, Ringwood.

Public speaking:

Mr Matthew Ironside, the applicant, explained that he bought the house with his wife to provide a long-term family home. The downstairs layout was not good and although architects had proposed demolition, he wanted to retain the character of the original cottage. Mr Ironside did not believe the development was too large and he had good support from his neighbours.

Councillor Howard Tilly of St Leonards and St Ives Parish Council explained that the Parish Council objected to the proposal. The parish Council wanted to safeguard the character of properties that were integral to the character of the village. The proposed development was of a house that was one of the oldest within the village and was an important feature. Whilst the use of sympathetic building materials was supported the Parish Council objected to the proposed size and scale of the development.

GRANTED.

1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

2. The materials and finishes to be employed on the external faces of the development, hereby permitted, shall be identical in every respect to those of the existing building unless otherwise first agreed in writing by the Local Planning Authority.

3. The development hereby permitted shall be carried out in accordance with the following approved plans: drawings nos. 10-09-001: 002: 003 and 004.

4. Before the development is commenced, proposals for the landscaping of the site, to include provision for the retention and protection of existing trees and shrubs, if any, thereon, together with any new planting proposed along the rear boundary of the site, shall be submitted to and approved by the District Planning Authority in the form of a large scale plan and a written brief. Erect 2 storey dwelling and detached double garage. Land opposite Cutlers Farmhouse, Gaunts Common, Wimborne.

Public speaking:

Mrs Easton, the applicant’s agent, explained that whilst the site was in a special character area it was also within the village envelope. The new proposal took into account previous objections with the design more in keeping, reduced in size, and no first floor windows on the west and east elevations. The Parish Council had raised no objections and a community could not afford to stand still and routinely block all applications.

Mrs Jeneson, the applicant, explained that her and herfamily would move into the proposed development from the farmhouse as they wanted to downsize. The neighbouring farm was not overly busy and there was less traffic now that dairy farming had ceased. The issue of drainage had been dealt with as had the issues of overlooking with neighbouring properties.

Mrs Claire Small, a neighbour, lived in a neighbouring listed building property and the proposed development would badly affect her. Her bedroom window would look directly at the ground floor windows of the proposed house and she would suffer a noticeable loss of sunlight. The development would also cause a detrimental loss of open space.

Mr James Ireland, a neighbouring farmer, objected to the proposal. Mr Ireland acknowledged the amendments that had been made but issues of overlooking and dominance remained. He still operated a busy farmyard that generated noise and dust and he was of the view that this could cause problems for any neighbouring residential site.

GRANTED AS PER THE OFFICER RECOMMENDATION.
