AN ORDINANCE OF THE TOWN OF McCANDLESS,

COUNTY OF ALLEGHENY, COMMONWEALTH OF

PENNSYLVANIA, AMENDING THE CODIFIED

ORDINANCES OF THE TOWN OF McCANDLESS, AT

PART THIRTEEN, TITLE THREE (“ZONING CODE”), TO

AMEND THE DEFINITION OF “DISTRIBUTED ANTENNA

SYSTEM (DAS)” AND “STEALTH TECHNOLOGY,” TO

ADD DEFINITIONS FOR “MINIMAL FUNCTIONAL

HEIGHT,” “SMALL WIRELESS COMMUNICATIONS

FACILITIES” AND “MICRO-WIRELESS

COMMUNICATIONS FACILITIES,” TO AMEND AND ADD

PROVISIONS REGARDING RETENTION OF EXPERTS

AND TO ESTABLISH CONDITIONS FOR “SMALL

WIRELESS COMMUNICATIONS FACILITIES,”

INCLUDING REGULATIONS RELATING TO APPLICATION

CONTENTS, TIMING OF REVIEW, FEES, DESIGN,

SITING AND ABANDONMENT.

WHEREAS, Part Thirteen, Title Three (“Zoning Code”) the Codified Ordinances

of the Town of McCandless defines and establishes conditions for the construction of

communications towers and antennae, both within and outside of public rights-of-

way; and

WHEREAS, on September 27, 2018, the Federal Communications Commission

issued a “Declaratory Ruling and Third Report and Order,” which took full effect on

April 15, 2019 (“FCC Order”) and places certain limits on municipal management of

wireless communications towers and antennas; and

WHEREAS, the FCC Order establishes specific requirements regarding so-called

“small wireless facilities,” which have been deployed at significantly more locations in

public rights-of-way across the United States to accommodate the rapidly increasing

demand for wireless services and to prepare national infrastructure for 5G technology;

and

WHEREAS, the FCC Order provides specific guidelines for municipal permit

fees, annual right-of-way management fees, and timelines for approvals of small

wireless facilities, such that the fees and approvals for small wireless facilities are

comparatively less than those for non-small wireless facilities; and

WHEREAS, the FCC Order also requires that specific aesthetic and design

requirements for small wireless facilities be “objective” and “published in advance”;

and

WHEREAS, the Town Council of the Town of McCandless now desires to amend

its Zoning Code to ensure compliance with the FCC Order, and to confirm that the

Town’s aesthetic and design requirements are applicable to applications for both small

and non-small wireless facilities.

NOW THEREFORE, BE IT ORDAINED AND ENACTED by the Town Council of

the Town of McCandless, Allegheny County, Pennsylvania, that:

Section 1. The definitions of “Distributed Antenna Systems” and “Stealth Technology” in Section 1311.04(a) (“Definitions”) of the Zoning Code, are hereby repealed and restated as follows: (40.1) “Distributed Antenna System (DAS)” means a network of Wireless

Communications Facilities that distributes RF signals from transceivers at a central hub to a specific service area with poor coverage or inadequate capacity. As typically configured, a DAS network consists of: (1) a number of remote communications nodes deployed throughout the desired coverage area, each including at least one antenna for transmission and reception; (2) a high capacity signal transport medium (typically fiber optic cable) connecting each node to a central communications hub site; and (3) radio transceivers located at the hub site (rather than at each individual node as is the case for small cells) to process or control the communications signals transmitted and received through the antennas. Only qualified “neutral-host” DAS networks that can support multiple providers simultaneously shall be considered public utilities if owned and/or operated by an entity granted public utility status (i.e., entities granted certificates of convenience as

competitive access providers). DAS networks that support only a single wireless service provider shall be governed by Section 1341.13 (“TOWERS AND ANTENNAS”), as amended.

(109.1) “Stealth Technology” means camouflaging methods applied to wireless communications towers, Antennas and other facilities which render them more visually appealing or blend the proposed facility into existing structure or visual backdrop in such a manner as to render it minimally visible to the casual observer. Such methods include, but are not limited to, architecturally screened roof-mounted Antennas, building-mounted Antennas painted to match the existing structure and facilities constructed to resemble trees, shrubs and light poles. The Town administration is authorized to publish objective standards for stealth technology to ensure that the established character of the Town is maintained.

Section 2. The following definitions are hereby added to Section 1311.04(a) (“Definitions”) of the Zoning Code:

(89.2) “Minimum Functional Height” means the minimum height necessary for Wireless Communications Facility to fill a gap in coverage.

(125.6) “Wireless Communications Facility, Micro-” means a Wireless Communication Facility, including those deployed aerially between utility poles or similar fixtures, and typically having dimensions no greater than 24 inches in length, 15 inches in width, and 12 inches in height, and an exterior antenna of no greater than 11 inches in length per FCC regulations, as amended. * * * *

(125.7) “Wireless Communications Facility, Small” means a Wireless Communications Facility, commonly used for the deployment of the next generation of wireless service, including 5G, and also including Micro-Wireless Communications Facilities, that meets the following conditions:

(1) The structure on which antenna facilities are mounted—

(i) is 50 feet or less in height, or

(ii) is no more than 10 percent taller than other adjacent structures, or

(iii) is not extended to a height of more than 50 feet or by more than 10 percent above its preexisting height as a result of the collocation of new antenna facilities; and

(2) Each antenna associated with the deployment (excluding the associated equipment) is no more than three cubic feet in volume; and

(3) All antenna equipment associated with the facility (excluding antennas) are cumulatively no more than 28 cubic feet in volume; and

(4) The facility does not require antenna structure registration under FCC regulations; and

(5) The facility is not located on Tribal lands, as defined under 36 CFR 800.16(x); and

(6) The facility does not result in human exposure to radiofrequency radiation in excess of the applicable safety standards specified by the FCC.

Section 3. Section 1341.13 of the Zoning Code is amended to add the following Section 1341.13(i):

(i) Special Requirements for Small Wireless Communications Facilities (1) In addition to the regulations set forth above, the following shall apply to Communications Facilities and/or Antenna that meet the definition of Small Wireless Communications Facilities, regardless of their location. In the event of a conflict, these regulations shall control.

A. The Town Administration is authorized to develop an application for the installation of any Small Wireless Communications Facility, which shall include, at a minimum, the following:

1. Property Owner Contact Information. 2. Applicant Contact Information. 3. Location(s) (General Description or Address). 4. Zoning Designation(s) of Location(s). 5. A written description and map showing the coverage

area of the provider’s existing facilities in the general and site-specific areas that are the subject of the Application.

6. A statement of the telecommunications objectives for the proposed location, whether the proposed facility is necessary to prevent or fill a gap or capacity shortfall in the Applicant or provider’s service area, whether it is the least obtrusive means of doing so, and whether there are any alternative sites that would have fewer aesthetic impacts while providing

comparable service. 7. A statement by an authorized representative that the

Applicant or provider holds all applicable licenses or other approvals required by the Federal Communications Commission, the Pennsylvania Public Utility Commission, and any other agency of state or federal government with authority to regulate telecommunications facilities that are

required in order for the Applicant to construct the proposed facility.

8. A statement by an authorized representative that the Applicant or provider is in compliance with all conditions required for such license and approvals.

9. A full description of the number and dimensions of all Small Cell Towers proposed to be installed.

10. A site development plan, signed and sealed by a professional engineer registered in Pennsylvania, showing the proposed location of the tower and existing structures within five hundred (500) feet of the proposed site. For Applications in which multiple towers are proposed, an overall site development plan showing all proposed locations within the Town

must be provided. 11. A vertical profile sketch or drawing of the towers,

signed and sealed by a professional engineer registered in Pennsylvania, indicating the height of the tower and the placement of all antennas and equipment enclosures.

12. Written approval from the property owner stating the Applicant or provider has permission to construct a facility on their property. In the case of public Right-of-Way or public property, written approval must be submitted from the duly-authorized representative of the governing body holding ownership.

13. Photographs of view shed from each proposed tower location, taken in at least four directions.

14. Description of whether other Overhead Utilities or Underground Utilities exist within five hundred (500) feet of the proposed location.

15. Identification of the location of sites attempted to collocate.

16. Explanation as to why colocation was unsuccessful.

B. Timing of Review. 1. Tolling. Within ten (10) calendar days of the date that an

application for a Small Wireless Communications Facility is filed with the Town, the Town shall notify the Applicant in writing of any information that may be required to complete such application. The shot clocks described below and established by FCC regulations then reset once the applicant submits the supplemental information requested by the Town. For subsequent determinations of incompleteness, the shot clock will be tolled if the Town provides written notice within 10 days that the supplemental submission did not provide the information

identified in the original notice delineating missing information.

2. Applications to Collocate Small Wireless Communications Facilities using on Existing Structure. Within sixty (60) calendar days of receipt of a complete application, the Town shall make its final decision on whether to approve the application and shall advise the Applicant in writing of such decision.

3. Applications to Deploy a Small Wireless Communications

Facilities on New Structures. Within ninety (90) calendar days of receipt of a complete application, the Town shall make its final decision on whether to approve the

application and shall advise the Applicant in writing of such decision.

4. Batched Applications. If an applicant files multiple siting

applications on the same day for the same type of facilities, each application is subject to the same number of review days. However, if an applicant files a single application for a batch that includes both collocated and new construction of Small Wireless Communications Facilities, the longer 90-day shot clock will apply.

C. Fees.

1. Application Fee. The Town may assess appropriate and

reasonable permit fees directly related to the Town's actual costs in reviewing and processing the application for approval of a Small Wireless Communications Facility, as well as inspection, monitoring and related costs.

2. Reimbursement for Right-of-Way (“ROW”) Use. In addition to permit fees, every Small Wireless Communications Facility in the ROW is subject to the Town's right to fix annually a fair and reasonable compensation to be paid for use and occupancy of the ROW. Such compensation for ROW use shall be directly related to the Town's actual ROW management costs including, but not limited to, the costs of the administration and performance of all reviewing, inspecting, permitting, supervising and other ROW management activities by the Town. The owner of each Small Wireless Communications Facility shall pay an annual fee to the Town to compensate the Town for the Town's costs incurred in connection with the activities described above. The annual ROW management fee for Small Wireless Communications Facility shall be determined by the Town and authorized by resolution of

Town Council and shall be based on the Town's actual ROW management costs as applied to such Small Wireless Communications Facility.

3. Retention of experts. The Town may hire any consultant

and/or expert necessary to assist the Town in reviewing and evaluating the application for approval of a Small Wireless Communications Facility and, once approved, in reviewing and evaluating any potential violations of the terms and conditions of these provisions. The applicant and/or owner of the Wireless Communications Facility shall reimburse the Town for all costs of the Town’s consultant(s) in providing expert evaluation and consultation in connection with these activities and provide an escrow

payment upon filing of the application to cover the estimated costs.

4. Fees shall be set forth in the Town’s Fee Schedule which may be amended by Resolution.

D. Design Guidelines for Small Wireless Communications Facilities.

1. Finishes. All exterior surfaces shall be painted, colored

and/or wrapped in flat, nonreflective hues that match the underlying support structure or blend with the surrounding environment. All surfaces shall be treated with graffiti-resistant sealant.

2. Noise. Small Wireless Communications Facilities, including all associated antennas, accessory equipment and other improvements must comply with all applicable noise control standards and regulations in the Town Code and shall not exceed, either on an individual or cumulative basis, the noise limit in the applicable zone.

3. Lighting. Small Wireless Communications Facilities must not be illuminated, except in accordance with state or federal regulations or if incorporated as part of a street light pole.

4. Signage. Signage is not permitted except to comply with FCC or Pennsylvania regulations to provide safety warnings.

a. Shrouding. All antennas and associated cables, jumpers, wires, mounts, masts, brackets and other connectors and hardware must be installed within a single shroud or radome. For pole-top antennas, the shroud shall not exceed 2.5 times the median pole diameter and must taper down to pole. For side-arm antennas, the shroud must cover the cross arm and any cables, jumpers, wires or other connectors between the vertical riser and the antenna.

b. Antenna Volume. Each individual antenna associated with a single small cell shall not exceed three cubic feet. The cumulative volume for all antennas on a single small cell shall not exceed: (A) three cubic feet in residential areas; or (B) six cubic feet in nonresidential

areas. c. Overall Height. No antenna may extend more than five

feet above the support structure, plus any minimum separation between the antenna and other pole attachments required by applicable health and safety regulations.

d. Horizontal Projection. Side-mounted antennas shall only be permitted when a pole-top antenna is not possible on the proposed support structure or any location within 500 feet of the proposed support structure. Where permitted, side-mounted antennas shall not project: (A) more than 24 inches from the support structure; (B) over any roadway for vehicular travel; or (C) over any abutting private property. If applicable laws require a side-mounted antenna to project more than 24 inches from the support structure, the projection shall be no greater than required for compliance with such laws.

6. Accessory Equipment Volume. The cumulative volume for

all accessory equipment for a single Small Wireless Communications Facility or other infrastructure deployment shall not exceed: (A) seven cubic feet to the extent feasible, but in no event greater than nine cubic feet in residential areas, or (B) 12 cubic feet in nonresidential areas. The volume limits in this subsection do not apply to any undergrounded accessory equipment.

7. Undergrounded Accessory Equipment. a. Where Required. Accessory equipment (other than any

electric meter (where permitted) and an emergency disconnect switch) shall be placed underground when proposed in any (A) location in the Town with underground utilities; (B) any location where it is feasible; or (C) any location where the Town finds substantial evidence that the additional above-ground

accessory equipment would incommode the public’s uses in the public rights-of-way.

b. Vaults. All undergrounded accessory equipment must be installed in an environmentally controlled vault that is load-rated to meet the Town’s standards and specifications. Underground vaults located beneath a sidewalk must be constructed with a slip-resistant cover and properly secured to prevent unauthorized access. Vents for airflow shall be flush-to-grade when placed within the sidewalk and may not exceed two feet above grade when placed off the sidewalk. Vault lids shall not exhibit logos or commercial advertisements.

c. Future Undergrounding Programs. If other utilities or communications providers in the public rights-of-way underground their facilities in the segment of the public rights-of-way where the Applicant’s Small Wireless Communications Facility or other infrastructure deployment is located, the Applicant must also underground its equipment, except the antennas and any approved electric meter, at approximately the same time. Accessory equipment such as radios and computers that require an environmentally controlled underground vault to function shall not be exempt from this condition. Small Wireless Communications Facilities and other infrastructure deployments installed on wood utility poles that will be removed pursuant to the undergrounding program may be reinstalled on a streetlight that complies with the City’s standards and specifications. Such undergrounding shall occur at the Applicant’s sole cost and expense except as may be reimbursed through tariffs approved by the state public utilities commission for undergrounding costs.

8. Pole-Mounted Accessory Equipment. The provisions in this

subsection are applicable to all pole-mounted accessory equipment in connection with Small Wireless Communications Facilities and other infrastructure deployments.

a. Concealment Techniques. Applicants shall place any pole-mounted accessory equipment in the least conspicuous position under the circumstances presented by the proposed pole and location. Pole-mounted accessory equipment may be installed behind street, traffic or other signs to the extent that the installation complies with applicable public health and safety regulations. Pole-mounted accessory equipment

shall be designed so that the largest dimension is vertical, and the width is such that equipment is minimally visible from the opposite side of the support structure on which they are placed.

b. Minimum Vertical Clearance. The lowest point on any pole-mounted accessory equipment shall be at least 10 feet above ground level adjacent to the pole. If applicable laws require any pole-mounted accessory equipment component to be placed less than 10 feet above ground level, the clearance from ground level shall be no less than required for compliance with such laws.

c. Horizontal Projection. Pole-mounted accessory equipment shall not project: (i) more than 18 inches from the pole surface; (ii) over any roadway for vehicular

travel; or (iii) over any abutting private property. All pole-mounted accessory equipment shall be mounted flush to the pole surface. If applicable laws preclude flush-mounted equipment, the separation gap between the pole and the accessory equipment shall be no greater than required for compliance with such laws and concealed by opaque material (such as cabinet “flaps” or “wings”).

d. Orientation. Unless placed behind a street sign or some other concealment that dictates the equipment orientation on the pole, all pole-mounted accessory equipment should be oriented away from prominent views. In general, the proper orientation will likely be toward the street to reduce the overall profile when viewed from the nearest abutting properties. If orientation toward the street is not feasible, then the proper orientation will most likely be away from oncoming traffic. If more than one orientation would be technically feasible, the Town may select the most appropriate orientation.

9. Ground-Mounted or Base-Mounted Accessory Equipment.

The provisions in this subsection are applicable to all ground-mounted and base-mounted accessory equipment in connection with Small Wireless Communications Facilities and other infrastructure deployments. a. Where permitted. Ground-Mounted or Base-Mounted

Accessory Equipment shall not be permitted unless Pole-Mounted Accessory Equipment is not possible as demonstrated and certified by Applicant through a qualified expert. In no event may ground-mounted or base-mounted accessory equipment interfere with pedestrian or vehicular traffic. Ground-mounted or Base-Mounted Accessory Equipment greater than three

cubic feet shall not be located within 25 feet of a lot in residential use or zoned residential.

b. Ground-Mounted Concealment. On collector roads and local roads, the ground-mounted accessory equipment shall be concealed as follows: (A) within a landscaped parkway, median or similar location, behind or among new/existing landscape features and painted or wrapped in flat natural colors to blend with the landscape features; and (B) if landscaping concealment is not technically feasible, disguised as other street furniture adjacent to the support structure, such as, for example, mailboxes, benches, trash cans and information kiosks. On arterial roads outside underground utility districts, proposed ground-mounted

accessory equipment should be completely shrouded or placed in a cabinet substantially similar in appearance to existing ground-mounted accessory equipment cabinets.

c. Public Safety Visibility. To promote and protect public health and safety and prevent potential hazards hidden behind large equipment cabinets, no individual ground-mounted accessory equipment cabinet may exceed four feet in height or four feet in width. Ground-mounted and base-mounted equipment cabinets shall not have any horizontal flat surfaces greater than 1.5 square inches to prevent litter or other objects left on such surfaces.

10. Utilities. The provisions in this subsection are applicable to

all utilities and other related improvements that serve Small Wireless Communications Facilities and other infrastructure deployments. a. Overhead Lines. No new overhead utility lines shall be

permitted in underground utility districts. In areas with existing overhead lines, new communication lines shall be “overlashed” with existing communication lines. No new overhead utility service drops shall be permitted to traverse any roadway used for vehicular transit.

b. Vertical Cable Risers. All cables, wires and other connectors must be routed through conduits within the pole or other support structure, and all conduit attachments, cables, wires and other connectors must be concealed from public view. To the extent that cables, wires and other connectors cannot be routed through the pole, such as with wood utility poles, applicants shall route them through a single external conduit or shroud that has been finished to match the underlying pole.

c. Spools and Coils. To reduce clutter and deter vandalism, excess fiber optic or coaxial cables shall not be spooled,

coiled or otherwise stored on the pole outside equipment cabinets or shrouds.

d. Electric Meters. Small cells and other infrastructure deployments shall use flatrate electric service or other method that obviates the need for a separate abovegrade electric meter. If flat-rate service is not available, applicants may install a shrouded smart meter that shall not exceed the width of the pole. If the proposed project involves a ground-mounted equipment cabinet, an electric meter may be integrated with and recessed into the cabinet, but the Town shall not approve a separate ground-mounted electric meter pedestal. i. Electric Meter Upgrades. If the commercial electric

utility provider adopts or changes its rules obviating

the need for a separate or ground-mounted electric meter and enclosure, the Applicant on its own initiative and at its sole cost and expense shall remove the separate or ground-mounted electric meter and enclosure. Prior to removing the electric meter, the Applicant shall apply for any encroachment and/or other ministerial permit(s) required to perform the removal. Upon removal, the Applicant shall restore the affected area to its original condition that existed prior to installation of the equipment.

e. Existing Conduit or Circuits. To reduce unnecessary wear and tear on the public rights-of-way, applicants are encouraged to use existing conduits and/or electric circuits whenever available and technically feasible. Access to any conduit and/or circuits owned by the Town shall be subject to the Town’s prior written approval, which the Town may withhold or condition as the Town deems necessary or appropriate to protect the Town’s infrastructure, prevent interference with the Town’s municipal functions and public health and safety.

11. New support structures for Small Wireless Communications

Facilities (i.e., poles) are only permitted if: (a) the applicant demonstrates and certifies through a qualified expert that aboveground support structures near the project site either do not exist or are not reasonably available to the applicant; or (b) the Town specifically finds that a new, non-replacement support structure would be more consistent with the established character of the Town and consistent with the objectives of these regulations than installations on existing structures near the project site.

12. Applicant shall provide all supporting documentation in support of its position. Unless Applicant demonstrates and Town finds that a new support structure designed to accommodate one Small Wireless Communications Facility is more consistent with the established character of the Town and consistent with the objectives of these regulations, new support structures for Small Wireless Communications Facilities shall be designed to accommodate collocation opportunities for a minimum of two Small Wireless Communications Facilities and shall be made available to more than one wireless license holders for future collocation.

13. New support structures shall be made of metal and have a

maximum diameter of 12 inches and shall be tapered toward the top wherever possible unless Applicant demonstrates and certifies through a qualified expert that a larger diameter is necessary to support additional Small Wireless Communications Facilities for collocation and the Town finds that a new support structure designed to accommodate collocation of Small Wireless Communications Facilities is more consistent with the established character of the Town and consistent with the objectives of these regulations.

14. New support structures shall not exceed the minimum

functional height, as demonstrated and certified by a qualified expert.

15. The Town administration is authorized to designate and publish one or more preapproved designs for Small Wireless Communications Facilities and other infrastructure deployments. In addition, the Town Administration is authorized to publish objective standards for stealth technology to ensure that the established character of the Towns is maintained.

16. Illustrative Small Wireless Communications Facilities are attached hereto as Appendix A. The Town Administration is authorized to publish additional illustrations.

E. Siting Guidelines for Small Wireless Communications Facilities.

Siting locations for all Communications Towers and Antennas, including Small Wireless Communications Facilities, is set forth in the above subsections of this Section 1341.13. If an Applicant demonstrates, pursuant to applicable law, that it is entitled to locate a Small Wireless Communications Facility outside of these permitted

siting locations, it must comply with the regulations set forth in this subsection.

1. Gap in Coverage. An Applicant for a Small Wireless

Communications Facility must demonstrate that a significant gap in wireless coverage, as defined by applicable law, exists within the applicable area and that the type of Communications Tower being proposed is the least intrusive means by which to fill that gap in wireless coverage.

2. Sight Triangle. The proposed siting of the Small Wireless Communications Facility shall comply with the applicable Town sight triangle regulations.

3. Siting Locations.

a. Siting locations shall be selected according to the

following preferences, ordered from most preferred to least preferred:

i. C-8 General Office and Limited Retail District. ii. C-7 Office Building District. iii. C-6 Industrial District. iv. C-5 Commercial Residential District. v. C-4 Regional Shopping Center District. vi. C-3 Highway Commercial District. vii. C-2 Neighborhood Shopping District. viii. R-C Residential-Commercial District. ix. C-1 Commercial Recreation District. x. D-Development District. xi. I Institutional District. xii. R-6 Elderly Housing District. xiii. R-5 Planned Residential Development District. xiv. R-4 Hi-Rise Apartment District. xv. R-3 Townhouse and Garden Apartment District. xvi. R-2 Single-Family and Two-Family Dwelling District. xvii. R-1 Single-Family Dwelling District.

Applicants shall demonstrate and certify through a qualified expert that any preferred locations not selected are not technically feasible and are not available. Applicants shall provide all documentation supporting their position.

b. The applicant shall not locate new support structures

within residential neighborhoods, designated open

space, conservation areas, or historic districts. If Applicant seeks to install such support structures in one or more of these areas, it shall demonstrate and certify through a qualified exert that the location of the proposed facility site is essential to meet the service demands of the carrier and no other alternative co-location, existing development or utility facility site, or type of support structure is feasible. This shall be documented by the applicant providing a list of the locations of preferred technically feasible sites, the good faith efforts and measures taken by the applicant to secure these preferred sites, and the specific reasons why these efforts and measures were unsuccessful.

c. Small Wireless Communications Facilities shall not be located on historically or architecturally significant structures unless visually and architecturally integrated with the structure and shall not interfere with prominent vistas or significant public view corridors.

4. Support Structures. In all cases, support structures shall

be selected according to the following preferences, ordered from most preferred to least preferred:

a. New Small Wireless Communications Facilities on

existing utility poles or support structures; b. New Small Wireless Communications Facilities on

existing or replacement streetlights or new or replacement traffic signal control poles;

c. New Small Wireless Communications Facilities on new standalone support structures.

Applicants shall demonstrate and certify through a qualified expert that any preferred structures not selected are not technically feasible and are not available. Applicants shall provide all documentation supporting their position.

5. Small Wireless Communications Facilities shall not be located in front of residential or business windows, primary walkways, primary entrances or exits, or in such a way that it would impede a delivery to a building or structure.

6. Small Wireless Communications Facilities shall be located at shared property lines between two adjacent lots.

7. Small Wireless Communications Facilities shall be located in mid-block locations instead of at more visible corners

and street intersections except if proposed on permitted traffic signal control poles.

8. New support structures shall all be located in the right-of-way and in alignment with existing trees, utility poles, and streetlights.

9. New support structures shall be an approximately equal distance between trees, with a minimum of 15 feet separation such that no proposed disturbance shall occur within the critical root zone of any tree.

10. A Small Wireless Communications Facility shall be no closer than 500 feet away, radially, from another Small

Wireless Communications Facility.

11. Rearrangement and Relocation. In addition to the requirements set forth in Section 1341.13(e)(7) and 1341.13(h)(10), above, an Applicant seeking to place a Small Wireless Communications Facility in the right-of-way acknowledges that the Town, in its sole discretion and at any time, may: (A) change any street grade, width or location; (B) add, remove or otherwise change any improvements in, on, under or along any street owned by the Town or any other public agency, which includes without limitation any sewers, storm drains, conduits, pipes, vaults, boxes, cabinets, poles and utility systems for gas, water, electric or telecommunications; and/or (C) perform any other work deemed necessary, useful or desirable by the Town (collectively, “Town work”). The Town reserves the rights to do any and all Town work without any admission on its part that the Town would not have such rights without the express reservation in this ROW administrative design review permit. If the Town determines that any Town work will require the Applicant’s Small Wireless Communications Facility located in the public rights-of-way to be rearranged and/or relocated, the Applicant shall, at its sole cost and expense, do or cause to be done all things necessary to accomplish such rearrangement and/or relocation. If the Applicant fails or

refuses to either permanently or temporarily rearrange and/or relocate the Applicant’s Small Wireless Communications Facility or other infrastructure deployment within a reasonable time after the Town’s notice, the Town may (but will not be obligated to) cause the rearrangement or relocation to be performed at the Applicant’s sole cost and expense. The Town may exercise its rights to rearrange or relocate the Applicant’s Small

Wireless Communications Facility or other infrastructure deployment without prior notice to Applicant when the Town determines that Town work is immediately necessary to protect public health or safety. The Applicant shall reimburse the Town for all costs and expenses in connection with such work within 10 days after a written demand for reimbursement and reasonable documentation to support such costs. Except as may be expressly permitted otherwise, nothing in this permit will be construed to require the Town or authorize the Applicant to change any street grade, width or location, or add, remove or otherwise change any improvements owned by the Town or any other public agency located in, on, under or along the site area or any portion of the public rights-of-way,

which includes without limitation any sewers, storm drains, conduits, pipes, vaults, boxes, cabinets, poles and utility systems for gas, water, electric or telecommunications, for the Applicant’s or any third party’s convenience or necessity.

F. Abandoned Facilities. In addition to the requirements set forth in

Section 1341.13(f)(18), in the event that use of a Small Wireless Communications Facility is no longer necessary to provide wireless service, the owner shall plan to discontinue use of the facility, provide written notice to the Town of its intent to discontinue use and the date when the use shall be discontinued. The Small Wireless Communications Facility or other infrastructure deployment shall be deemed abandoned if not operated for any continuous six-month period. Unused or abandoned Antennas or portions of Antennas shall be removed as follows: 1. All abandoned or unused Small Wireless Communications

Facilities and accessory facilities shall be removed within two months of the cessation of operations at the site unless a time extension is approved by the Town.

2. If the Small Wireless Communications Facility or accessory facility is not removed within two months of the cessation of operations at a site, or within any longer period approved by the Town, the Small Wireless Communications Facility and/or associated facilities and equipment may be removed by the Town and the cost of removal assessed against the owner of the Small Wireless Communications Facility.

Section 4. Severability.

If any of the provisions or terms of this Ordinance shall be held invalid for any

reason whatsoever, then, unless such provision or term is material to this Ordinance

as to render this Ordinance impracticable to perform, such provision or term shall be

deemed severable from the remaining provisions or terms of this Ordinance and shall

in no way affect the validity or enforceability of any other provisions hereof.

Section 5. Repealer.

All prior ordinances are hereby repealed in whole or in part to the extent

inconsistent herewith.

ORDAINED AND ENACTED into law, this ____ day of _____________, 2020, to

become effective ten (10) days after proper advertisement hereof.

TOWN OF MCCANDLESS TO REGULATE OBJECTS IN THE RIGHT-

OF-WAY, SIGNS IN THE RIGHT-OF-WAY, ADDING RELATED

DEFINITIONS AND AMENDING ENFORCEMENT AND PENALTY

PROVISIONS

WHEREAS, the Town Council of the Town of McCandless has determined that

unauthorized signs placed in the public rights-of-way and on public property are a danger

because they distract motor vehicle operators and because they can obstruct views creating

hazards to motor vehicle and pedestrian traffic; and

WHEREAS, the Town Council of the Town of McCandless has further determined that

unauthorized signs spoil the natural beauty of the Town that is an asset treasured by residents and

visitors alike; and

WHEREAS, the Town Council of the Town of McCandless has determined it to be in

the best interests of the health, safety, and welfare of the residents of the Town to amend Part

Nine, Title 1, Article 907 of the Codified Ordinances of the Town of McCandless to further

regulate signs and other objects in public rights-of-way and on public property, add related

definitions and amend the penalty and enforcement provisions of the Article.

NOW THEREFORE, it is hereby ORDAINED by the Town Council of the Town of

McCandless, Allegheny County, Commonwealth of Pennsylvania, as follows:

SECTION 1:

The above recitals are incorporated herein by reference.

SECTION 2:

Part Nine, Title 1, Article 907 of the Codified Ordinances of the Town of McCandless is

hereby repealed in its entirety and replaced with the following:

Objects and Signs in Right-of-Way

907.01 Definitions. 907.99 Penalty.

907.02 Objects in right-of-way.

907.03 Signs prohibited in rights-of-way and on public property.

907.01 DEFINITIONS.

For the purposes of this Article 907, the below terms shall be defined as follows:

(a) “Cartway” shall mean that portion of a street which is improved by surfacing

with permanent or semi-permanent material and is intended for vehicular

traffic and shall be measured from the termination points of the surfacing

material. Termination points are located at the base of a barrier curb, wedge

curb or other type of curb, or where the surfacing meets a grass or landscaped

area.

(b) "Sign," unless the context clearly indicates or requires a different meaning,

shall mean any surface, fabric or device bearing lettered, pictorial or

sculptured matter designed to convey information visually and exposed to

public view; or any structure including a billboard or poster panel designed to

carry such visual information.

907.02 OBJECTS IN RIGHT-OF-WAY.

(a) No trees, bushes, shrubs or hedges may be planted or allowed to grow so that

they infringe on the clear-sight triangle required by the Land Development

and Subdivision Regulations or otherwise create a hazard to vehicle or

pedestrian traffic.

(b) No object or structure may be built or placed or permitted to remain in a

location which infringes on the clear-sight triangle required by the Land

Development and Subdivision Regulations or otherwise creates a hazard to

vehicle or pedestrian traffic.

(c) Public Transit Shelters may be permitted at public transit stops if the location

and installation have been approved by the Town of McCandless.

907.03 SIGNS PROHIBITED IN RIGHTS-OF-WAY AND ON PUBLIC

PROPERTY

(a) Signs shall be permitted only on private property. Signs may not be placed

within the public right-of-way or on public property. In cases where a

resident does not have specific knowledge of the location of the right-of-way

line, signs which are placed at least five (5) feet from the cartway by or with

the permission of the property owner shall be presumed to be on private

property and shall be permitted.

(b) Public Nuisance. Any sign posted in violation of this Section is hereby

declared to be a nuisance. In addition to any other remedy provided by this

Article or available under law, the Town may apply to a court of competent

jurisdiction for an injunction to prohibit the continuation of any violation.

(c) Removal Procedure. Any sign found to violate this Section may be

removed forthwith by any Town employee duly authorized by the Town

Manager or his/her designee.

(d) Notice, storage, return. Upon removal of any sign in violation of this

Section, a designated employee of the Town shall keep a record of the

location from which the sign was removed. Further, a reasonable attempt shall

be made to contact the owner by telephone. If such attempt is successful, the

owner shall be notified of the removal and of the location where the sign may

be retrieved. If telephone contact is not achieved, written notice of the

violation and the retrieval location may, but is not required to, be provided. In

either case, the Town shall store any removed sign for at least ten (10) days.

After expiration of the ten-day period, the Town shall be permitted to destroy

or discard any sign.

(e) Persons deemed responsible. The person(s), organization(s), or

business(es) named or promoted on the sign posted in violation of this Section

shall be deemed to be the owner responsible for the violation, absent prior

notification to the Town of another responsible party. Nothing in this Section

shall be interpreted to make any person, organization, or business liable for

any signs posted by persons over whom he/she/it has no control.

907.99 PENALTY. The first violation of the provisions of this Article shall result

in a written warning issued by the Town. Any future violation of this Article shall

be considered a summary offense and the violator shall be fined not more than

three hundred dollars ($300.00) for each offense, plus costs of prosecution.

SECTION 3:

If any section, subsection, paragraph, sentence, clause or phrase of this Ordinance shall be

declared invalid for any reason whatsoever, such decision shall not affect the remaining portions of

this Ordinance, which shall remain in full force and effect; and to this end, the provisions of this

Ordinance are hereby declared to be severable.

SECTION 4:

All resolutions, ordinances, or parts thereof, of the Town of McCandless which are

inconsistent with the provisions of this Ordinance are hereby repealed to the extent of any such

inconsistency.

ORDAINED AND ENACTED into law this 24th day of August 2020, to become

effective ten (10) days after proper advertisement hereof.

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF McCANDLESS

ESTABLISHING A CODE OF ETHICS POLICY FORMALIZING A SET OF PRINCIPLES

AND PRACTICES OF THOSE ASSOCIATED INDIVIDUALS SERVING THE TOWN OF

McCANDLESS

WHEREAS, Town Council has determined in order to promote integrity,

objectivity, and professional behavior for Public Officials including members of Town

Council, Employees/Staff and elected or appointed members of Boards, Commissions,

Committees, and Authorities, the Town of McCandless is establishing this policy

formalizing principles that set parameters and provide guidance for conduct and

decision-making.

WHEREAS the Town of McCandless requires the highest ethical standards for

Public Officials in the performance of their responsibilities. These principles are to be

adhered to in all situations and circumstances including in-person, online, in print, and

other forms of media and during personal interactions, and at all times during service

and beyond regarding matters of a confidential nature.

WHEREAS Town Council desires to establish a Code of Ethics policy formalizing

a set of principles and practices of those associated individuals serving the Town of

McCandless.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Town Council of the

Town of McCandless as follows:

Section 1.

The Town Council of the Town of McCandless hereby authorizes the creation of a

“Code of Ethics Policy” attached hereto as Exhibit A and incorporated herein by

reference.

Section 2.

This Resolution shall become effective upon adoption.

Code of Ethics

In order to promote integrity, objectivity, and professional behavior for Public Officials

including members of Town Council, Employees/Staff and elected or appointed

members of Boards, Commissions, Committees, and Authorities, the Town of

McCandless establishes these principles that set parameters and provide guidance for

conduct and decision-making. The Town of McCandless requires the highest ethical

standards for Public Officials in the performance of their responsibilities. These

principles are to be adhered to in all situations and circumstances including in-person,

online, in print, and other forms of media and during personal interactions, and at all

times during service and beyond regarding matters of a confidential nature.

Town of McCandless Public Officials agree to:

1. Faithfully abide by the Pennsylvania Public Official and Employee Ethics Act (“Ethics

Act”), the Town of McCandless Code and any rules, and regulations of the Town of

McCandless, as well as the Town’s Statement of Equality, Diversity and Inclusivity:

“The Town of McCandless is a place of welcome and hospitality for all who

would seek lawful residence in or visit our community regardless of their

country of origin, race, native language, religion or sexual orientation and

embraces empathy for all, promoting equality, diversity and inclusivity.”

2. Undertake the responsibilities and duties of the position in such a manner to result

in the good of the entire the community rather than for one’s own personal benefit or

advancement.

3. Maintain a professional level of courtesy, respect, and objectivity in all Town-related

activities.

4. Demonstrate respect for the diversity of opinions as expressed or acted upon by

others and formally register dissent as appropriate.

5. Promote collaboration, cooperation, and partnership among all associated

individuals.

6. Exercise reasonable care, good faith, and due diligence in Town affairs.

7. Fully disclose, at the earliest opportunity, information that may result in a perceived

or actual conflict of interest. A “conflict of interest” is defined in the Ethics Act as “[u]se

by a public official or public employee of the authority of his office or employment or

any confidential information received through his holding public office or employment

for the private pecuniary benefit of himself, a member of his immediate family or a

business with which he or a member of his immediate family is associated. The term

does not include an action having a de minimis economic impact or which affects to the

same degree a class consisting of the general public or a subclass consisting of an

industry, occupation or other group which includes the public official or public

employee, a member of his immediate family or a business with which he or a member

of his immediate family is associated.”

No Public Officials of the Town of McCandless, including members of Town Council,

Employees/Staff and elected or appointed members of Boards, Commissions,

Committees, and Authorities shall engage in conduct which would constitute a conflict

of interest under the Ethics Act.

8. Remain accountable for prudent fiscal management.

9. No Public Official of the Town shall:

A. Participate in the influencing, negotiation of or decision to award contracts,

the settlement of any claims or charges in any contracts, the making of loans,

the granting of subsidies, the fixing of rates, or the issuance of permits,

licenses, grants, certificates, guarantees or other things of value to, with or

for any entity in which he or she has a financial or personal interest.

B. Represent or act as agent for any private interest, whether for compensation

or not, in any transaction in which the Town has a direct and substantial

interest.

10. Respect the confidentiality of sensitive information known due to service to the

Town.

Failure of any Public Official to comply with this Code of Ethics may, at the discretion

of Town Council, result in sanction, disciplinary action, and/or the removal of that

individual from his or her position. Reports of violations to this Code can be made by

calling__________________ or emailing to [email protected]. All

reports will be investigated by the Town’s Human Resources Department and the Town

Attorney who will issue a report to the Town Manager and Council President.
