BARANGA Y Sinalhan, a local government unit of Santa Rosa City, Laguna, established and existing under ·the laws of the Republic of the Philippines, with office address at the Sinalhan Sta.Rosa Laguna, represented herein by HONORABLE FELIPE ALMARINEZ , B.arangay Chairman and hereinafter also referred to as the "LGU"

The UST MEDICINE '85 FOUNDATION, a non-profit non-stock organization, of the University of Santo Tomas, College of Medicine, Batch 1985, with principal office address at Espana, Sampaloc Manila, represented herein by DR. ANTHONY LEACHON, in his capqcity as PRESIDENT and herein referred to as "FOUNDATION". .

WITNESSETH THAT:

WHEREAS, the LGU, by virtue of Sangguniang Panlungsod Resolution No. ·_ , series of __ , and Sangguniang Pangbarangay Resolution No. _ , series of __ ,are given the authority to enter into a MOA with FOUDATION; · ·

WHEREAS, RA 7160 known as the 1991 Local Government Code mandated the devolution of the functions and services as one of the basic functions and responsibilities of all the local governr11ent units at all levels; ·

WHEREAS ·all parties respect and acknowledge the principle of partnership and cooperation inscribed in Art. X, Sec. ~ 3 of the Constitution, which states, "Local gbvernm~nts may group "' themselves, consol_idate or coordinate· their efforts, services and resources for purposes ~~ commonly beneficial to them in accordance wi\h the law"· and Art. 61 Sec 33 of the Local Government Code, which states, "Local government -units may through · appropriate . ordinances, group themselves; consolidate or coordinate their efforts, services and resources for purposes commonly beneficial to them"; ·

WHEREAS, FOUNDATION is committed to support community health and development through private-public ·partnership, as well as organizational, institutional · and human resources development at the local level;

WHEREAS, both parties agree in good faith, to have effective and efficient processes in keeping with the tenets- of democracy; ·

WHEREAS, both parties respect the autonomy of the LGU, in so far as their infernal affairs are concerned;

WHEREAS, · both parties accord priority to the development of a professionally-managed mechanism with the comm~ institution assuming increasing responsibility about matters concerning service delivery; ; ·.

WHEREAS, both parties commit themselves _to respect these principles in order to create a favora.ble environment for community development;

WHEREAS, the ·LGU shall share its learning experiences with other cities/municipalities in other parts of the country;

NOW, THEREFORE, for and in consideration of the foregoing premises ~nd by way of formalizing and confirming their commhment, the parties hereby mutually agree to· enter into. agreement in accordance with the t~rms and conditions hereunder set forth.

I. OBJECTIVES AND AREAS OF COOPERATION

1. Objective. The general objective of this cooperation is community development ·for better health, characterized by the following:

• Enhancement of the community's preference for optimum health • . Solidarity by organizing and planning together • Provision of opportunities to achieve social, economic and environment goals

2. Areas of Cooperation. The signing parties of this MOA shall cooperate to organize and implement initiatives supportive of the aforementioned objectives, to wit

Encourage partnership and networking between LGUs, national line agencies, NGOs/POs/cooperatives and the private sector within the LGU; Formulate and implement _policies and plans within the frc~mework of LGU policies and plans; · Utilize existing information and management system of the LGU that monitors and evaluates the outcome; . Set, implement and enforce· standards for the minimum package of activities in conformity with LGU policies; · i Upgrade t~c~nical and. institutional capaciti~~ through_, among at.hers, training . and re-training of local government service provider, development and improvement of organizational mechanisms, and policy development; . Pool or share manpower, logistics· and equipment resources, when necessary; and · · Undertake measures that will allow the initiatives to be sustainable. ·

11. INSTITUTIONAL ARRANGEMENTS

1. The Foundation shall be composed of the following committees; ·

4. Meetings and Quorum. ·

The partnership shall hold regular meetings at lea~t once every quarter, and shall convene during times of calamities:,and other health emergencies to prepare courses of action to address . these. Other meetings may be . J convened at the call of the chairperson. The presence of simple majority of all voting members present shall constitute a quorum. ·

111. ROLE:S ANO RESPONSIBILITIES OF INSTITUTIONAL PARTNERS

1. LGU. The LGU shall continue to u"ndertake their- -responsibilities with respect to the delivery of services in their respective territorial jurisdiction in accordance with the provisions of the 1991 Local Government Code . . It shall formulate and implement an integrated Development Plan within the framework of the National Strategic Plan. The LGU Development Plan shall be the referenc~ of the Foundation. The LGU shall · provide technical supervision, support and coordination.

2. FOUNDATION shall provide assistance in developing the community, including, but not lfmited to the folk>wing:

2. Criteria for continuation of the project in a baranggay shall be agreed upon by both parties

The partnership shall formulate and implement measures that will en~ure long-term sustainability of the· project and acceptance of the scheme by new and incoming political leaders, community leaders and service providers. Among others, it shall conduct an orientation on the partnership for new political officials after every local

Viii. · AMENDMENTS AND EFFECTIVITY

The parties hereto may, upon mutual agreement, amend, alter or modify this Memorandum of Agreement by· and through a document signed by the parties.

This Memorandum of Agreement shall take effect upon signing of all parties and· shali remain in full force and effect, unless sooner revoked or terminated by mutual agreement of parties.
