Michelle Surkan has been appointed the East King County Chapter Director and Rebecca Horst has been appointed the Snohomish County Chapter Director. The East King County Chapter has a mee8ng scheduled for May 26th. The details are included in this newsleMer. The Snohomish County Chapter has a mee8ng scheduled for May 25th. It is that 8me of year again for Officer and Director Elec8ons and Nomina8ons for WSPA Paralegal Awards. Look for a survey to vote on the Officer and Director posi8ons in the next week. Also all the informa8on on what awards we will be giving out as well as how to nominate someone is included in this newsleMer. WSPA Vision Statement for 2020 The Washington State Paralegal Association is the regulatory and licensing body of paralegals in Washington State. The Washington State Paralegal Association will define standards of skill and competence for paralegals and legal assistants in Washington State. It has a reputation for being a welcoming, supportive professional organization. It offers opportunities to increase personal and professional growth through educational opportunities and social events. The Washington State Paralegal Association is highly regarded by the public, the media, and public policy makers as the voice of the profession. The Association is influential and politically effective.

Definition of a Paralegal – as defined by NFPA and WSPA

A Paralegal is a person, qualified through education, training or work experience to perform substantive legal work that requires knowledge of legal concepts and is customarily, but not exclusively, performed by a lawyer. This person may be retained or employed by a lawyer, law office, governmental agency or other entity or may be authorized by administrative, statutory or court authority to perform this work. Substantive shall mean work requiring recognition, evaluation, organization, analysis, and communication of relevant facts and legal concepts

WSPA is seeking motivated and energetic paralegals or paralegal students to fill WSPA management positions.

• Secretary

The Secretary is responsible for preparing meeting minutes from all Board meetings. The Secretary is also responsible for keeping all records for the association.

• Spokane Chapter Director

• South King County Chapter Director

Chapter director positions are responsible for coordinating meetings in their designated areas, which includes arranging speakers and topics, selecting meeting location and marketing WSPA events. In addition, Chapter Directors are required to aDend quarterly Board meetings and write bi-monthly articles for the newsleDer. Chapter Directors should live or work in the area they represent.

• CLE Certification Coordinator

• Job Bank Coordinator

• Pro-Bono Coordinator

Being a coordinator is a great way to get involved with WSPA management. The coordinator positions are not mandatory Board positions so there is no requirement to aDend Board meetings. Though, it is highly recommended to aDend the meetings.

In addition, WSPA is seeking volunteers for marketing, event planning, speaker coordination, mentoring, pro bono, etc. If you are interested in any of the above positions, please email a le@er of interest to [email protected]

In Washington state, there are 29 federallyrecognized Indian tribes. Most of thesetribes have func8oning and thriving tribalcourts. Thesecourtsareestablishedbythetribes’respec8veCons8tu8ons.TribalcourtsinWashingtonstateareanimportantpartofIndian country and provide the necessarysecurity andwell-being for tribes, and theirmembers, to func8on as independentgovernments.

As the paralegal to a busy Na8ve Americanprac8ce group, I navigate various legalindustries, including li8ga8on. DraJingandrevising pleadings is one of my many dailytasks, in addi8on to obtaining third-partyrecords. Acri8calcomponenttoreques8ngt h i r d - p a r t y r e co rd s i s h av i n g a nunderstandingofCivilRule45–theprocessand procedure for issuing subpoenas in acivilcase.

An advantage to working for Na8veAmerican cl ients is that I have anunderstanding of tribal jurisdic8on.Par8cularly, if a case requires obtaininginforma8on from a tribe. The approachwhen reques8ng t r i ba l reco rds i saccomplisheddifferentlythanyouwouldfindinWashingtonstatecourt. SimplydraJingastate court subpoena and serving it on atribalen8tyisinsufficient.

In an aMempt to obtain records from tribalen88es, law firms will oJen issue a statecourt subpoena directly to a tribal en8ty.However, most tribes in Washington statehave adopted their own processes andproceduresforobtainingtribalrecords.

As an example, the Snoqualmie Indian Tribeprovides an avenue for a state courtsubpoena to be recognized by theSnoqualmieTribalCourt.

This process is outlined in the Tribe’stribal codes – the laws and proceduresthat govern the Tribe’s opera8on. TheJudiciary Act code establishes the TribalCourt, in addi8on to recognizing andenforcingasubpoenaissuedbyaForeigncourtpursuanttotheTribe’sRecogni8onandEnforcementofForeignCourtOrderscode. Thiscodeoutlinestheprocessforobtaining an Order to receive recordssubpoenaed on the Tribe, includingsubpoenas issued to a Tribal en8ty, aTribalmember or any person under thejurisdic8onoftheTribe,oracustodianofTribalrecords.

Whenseekingrecordsfromatribeoranytribal en8ty, first find the court contactinforma8onforthetribefromwhichyouareseekingrecords.MostofthetribesinWashington state have a dedicatedwebsitefortheirtribalcourtandprovidecontact informa8on for the clerk of thetribal court. Some tribal courts offerforms to help you navigate theirprocedures. When in doubt, find thetribe’sadministra8veofficesandrequestinforma8on on their tribal courtprocedures.

Taking the 8me to understand tribalcourt jurisdic8on can be paramount toyour successas aparalegal. Bemindfulthattribalcourtsoperatejustasanystateor federal court; therefore, they cannotprovidelegaladvice.

MEETING OF THE BOARD OF DIRECTORS of the Washington State Paralegal Association February 13, 2016

The Board of Directors of the Washington State Paralegal Association (“WSPA”) met on February 13, 2016 in Tukwila, Washington. Proper

notice was sent via e-mail to all Board and Association members.

In attendance were the following:

Officers Present: Sarah Eisenhauer ,Theda Yandell, RP, Debra Smith

Chapter Directors: Pamela Hokansen

Guests Present: Diane Bevins Brenda Cothary

WELCOME

Introductions of Officers present. Sarah Eisenhauer, President, welcomed and thanked all present and called the meeting to order at 10:37

a.m.

QUORUM REQUIREMENT:

When the meeting notice was sent out, there were 3 Directors and 3 Officers serving in office, with 51% or at least 4 such positions needed to

be present for a quorum and to conduct business under our Bylaws. We began the meeting with 4 voting persons present so there was a

quorum.

PAST MINUTES APPROVAL:

The Board Meeting Minutes for September 13, 2015 were presented and reviewed. It was motioned that we approve the minutes. It was

seconded and passed unanimously. There was no further discussion.

OFFICER AND CHAPTER REPORTS:

Pam – Seattle Chapter held a brown bag meeting. The meetings are now scheduled for the 4th Thursday of every month.

Julie/Brenda – South Puget Sound Chapter had a wine social in December. Julie is currently planning on a meeting on the last Friday of the

month.

Sarah – working on website.

MEMBERSHIP:

Membership is down this year. We currently have 91 members. Theda will be sending out another email regarding membership renewal.

CAREER DINNER:

We have not had the turn out that we have had in the past. We discussed different ways to get a flyer out to the Law firms in the area.

Action Item: Theda will contact Ballister, ABC Services and T-Scan to see if they will include our flyers with their materials. Action

Item: Sarah will set up a conference call for Friday at noon.

NEWSLETTER:

We would like to send out a Newsletter for March/April.

Action Item: Sarah will send out a call for articles to management and members.

NFPA UPDATE:

Theda is not getting the updates from NFPA that she should be getting. She will check with them and make sure that she is set up to

receive them.

NFPA will be losing their management company. They are going through RFPs right now. Prometric is the new testing company. Ethics Week is in May.

2018 NFPA ANNUAL CONFERENCE:

The new proposed Tag Line is “Paralegals Shine in the Emerald City”. Planning meetings will be held 1st Wednesday of odd months using Go To Meeting. This month’s meeting will be on the Tag Line and Social Event.

WSPA BUDGET:

The 2016 budget was discussed. We decided that we can send two people to the Region meeting, and one person to NFPA Joint

Conference and the National Meeting. It was decided that Brenda and Theda would go to the Region meeting, Pam would go to the

Joint Conference and Theda would be going to the National Meeting.

It was motioned that we approve the budget as discussed. It was seconded and unanimously approved.

BANK ACCCOUNT:

It was discussed and approved that we need to get Sarah and Debra on the US Bank Account as signors. Brenda will no longer need to

be on the account as she is now Past President.

MARKETING:

Deb has been sending out the Sponsor letters. We have received several sponsorships for the coming year.

NEXT MEETINGS:

The next meeting date will be discussed in the conference call on Tuesday.

Privacy Policy WSPA’s general policy regarding member information is that we do not share this information indiscriminately. We must share name and mailing address with NFPA in order for you to receive your full membership benefits. We may share name and mailing address with certain legal-related vendors, including seminar sponsors, for a fee. This provides WSPA with non-dues income and allows us to keep our membership fees low. Definitions & Requirements Paralegal (NFPA Definition): A paralegal is a person qualified through education, training, or work experience to perform substantive legal work that requires knowledge of legal concepts and is customarily, but not exclusively, performed by a lawyer. This person may be retained or employed by a lawyer, law office, governmental agency, or other entity or may be authorized by administrative, statutory, or court authority to perform this work. Substantive shall mean work requiring recognition, evaluation, organization, analysis, and communication of relevant facts and legal concepts.

Membership Types – Regular Membership - $110: Any paralegal (see definition above) living or working in Washington with an associate or

bachelors degree and 24 semester hours in paralegal studies OR having a minimum of three year’s experience as a paralegal as defined by NFPA. Regular members are eligible to vote and hold office.

Student Membership - $60: Any student currently enrolled in a paralegal program and not eligible for regular or associate membership status. Student membership is limited to 3 years. Student members are eligible to vote and hold office.

Associate Membership - $110: Any paralegal living or working outside Washington, not currently practicing, or retired. Associate members are eligible to vote and hold office. CLE Credits: WSPA recognizes CLE credits are an important part of developing and maintaining one’s skills and abilities.

As such, all WSPA members are strongly encouraged to obtain 10 CLE credits annually. Individuals who earn 10 CLE credits in a membership year will be recognized in the WSPA newsletter Findings and Conclusions, and will be eligible for a 10% discount off the registration fee for one WSPA CLE of his/her choice during the following calendar year. CLE credits may be reported on the attached form
