The WNCT-TV & STEM East Teacher of the Month Contest (the “Contest”) is sponsored by Media General Operations, Inc. d/b/a WNCT—TV9 On Your Side (“WNCT”) and STEM East, a subsidiary of North Carolina’s Eastern Region (“STEM East”) (collectively “Contest Entities”). This Contest is offered only in the North Carolina counties of Beaufort, Bertie, Carteret, Craven, Duplin, Greene, Hyde, Jones, Lenoir, Martin, Onslow, Pamlico, Pitt, Tyrrell, Washington, Wayne and Wilson (the “Contest Area”). 2. Contest is subject to all federal, state and local laws. Contest Entities shall be entitled to interpret these Official Rules as needed — including but not limited to rules regarding nominations, deadlines, winner selection, prize restrictions, and eligibility — and all of their decisions are final. By participating in this Contest in any way, you agree to these Official Rules and to the decisions of Contest Entities.

3. This Contest is in no way sponsored, endorsed or administered by, or associated

with, Facebook. You are providing information to Contest Entities and not to Facebook. The information you provide will only be used for administration of the Contest and as otherwise set forth in these Official Rules. Any questions that you have about this Contest must be directed to Contest Entities and not to Facebook.

4. Contest begins on January 20, 2014. Final nomination deadline is October 31, 2014 at 11:59 p.m. Eastern Time ("ET"). Three (3) “STEM Teachers of the Month” (referred to as either “Winners” or “STEM Teachers of the Month”) will be selected for each Nomination Period, for a total of twelve (12) Winners in accordance with the “Contest Chart” below. Each Winner will be notified no later than the third week of the corresponding month, or within a reasonable time thereafter, i.e., the “February STEM Teacher of the Month” will be notified on or before February 21, 2014. STEM East’s computer is the official time-keeping device for this Contest.

5. Contest consists generally of the three (3) following phases, which are described

in more detail below:

a. Phase I – Nomination: Eligible nominators (each a “Nominator”) may nominate an eligible teacher (each a “Nominee”) for consideration as a STEM Teacher of the Month during any of four (4) nomination periods (each a “Nomination Period”), as set forth below in the Contest Chart below. Contest nomination applications may be downloaded at www.wnct.com (the “Contest Page”).

b. Phase II – Judging: Following each Nomination Period, all timely and properly submitted nominations will be judged to select three (3) Winners, one (1) for each of the relevant months.

c. Phase III –Notification: Following the selection of potential Winners each quarter, Contest Entities will make good faith efforts to appear at the schools of Winner on or before the corresponding “Notification” date in the Contest Chart below to congratulate the Winner and deliver his or her prize in person.

6. Please refer to the following Contest Chart for relevant dates and deadlines.

7. Limit one (1) Nomination (as defined below) per Nominee per Nomination Period. Non-winning Nominations carry forward to subsequent Nomination Periods.

ELIGIBILITY

8. All Nominators and Nominees must be legal residents of the Contest Area (defined above) and at least twenty-one (21) years old at the time they are nominated or submit nominations. Self-nomination is permitted. Employees of Contest Entities and the members of their immediate families (defined as spouse, parents, siblings or children) and households (whether or not related), are not eligible to participate as Nominators or Nominees or to win a prize. The term "household" includes all persons residing together in a single residence, whether or not related.

9. Nominees: Each Nominee, at all times during the Contest, also must:

a. be a STEM teacher (see below), b. possess a current Standard Professional 2 (SP2) license, and c. be employed full time with at least seventy percent (70%) of employment

time in direct instruction of an elementary or secondary school (public, charter, conventional private or NCVPS) in the Contest Area.

10. STEM education is an interdisciplinary approach to learning where rigorous

academic concepts are coupled with real-world lessons as students apply science, technology, engineering, and mathematics in contexts that make connections between school, community, work and the global enterprise enabling

the development of STEM literacy and with it the ability to compete in the new economy. (Tsupros, 2009).

11. Because detailed information and substantiation of each Nominee’s qualifications will be required, along with proof of performance such as video depicting actual teaching by the Nominee, it is strongly recommended that Nominations (defined below) be submitted by education professionals who have direct knowledge of the relevant Nominees’ qualifications or by the Nominees directly. Incomplete or untimely Nominations may be disqualified without further notification by Contest Entities.

PRIZES & PRIZE RESTRICTIONS

12. Prizes (12): $100 gift certificate or gift card redeemable at an area merchant for

goods or services for personal use and a $100 gift certificate or gift card redeemable at an area merchant for goods or services for classroom use, such as supplies or educational materials. Approximate Retail Value: $200.

13. All prize details shall be at WNCT’s sole discretion. Each Winner assumes sole

responsibility for all expenses and incidental costs associated with the prize not explicitly outlined above, including without limitation, all federal, state and local taxes (if any).

14. Gift card prizes are subject to terms and conditions thereon as well as any additional restrictions imposed by issuer. Non-cash prizes are not redeemable for cash and may not be sold, bartered or auctioned. Prizes are not transferrable and may not be substituted except that WNCT in its discretion may substitute a prize, or portion thereof, with a prize or portion of equal or greater value if it deems necessary. Any such changes will be announced.

15. Any portion of any prize not used by any Winner is forfeit and no cash substitute will be offered or permitted. Prizes offered are provided “as is” with no warranty or guarantee either express or implied by Contest Entities. Merchandise prizes (if any) carry no warranty other than that offered by manufacturer. Contest Entities have neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Other restrictions apply.

PHASE I: NOMINATION

16. Nominations will be accepted beginning January 20, 2014 at 12:01 a.m. ET and ending on October 31, 2014 at 11:59 p.m. ET.

17. To enter, visit www.wnct.com (the “Contest Page”) and download an application form. Follow the instructions to complete the application form (each a

“Nomination”) in its entirety and submit it to STEM East via e-mail at [email protected] accordance with the deadlines in the Contest Chart above. All Nominations must satisfy the “Submission Requirements” below. This is the only method of entering this Contest and Nominations will not be accepted via e-mail, regular or any other method.

18. Limit one (1) Nomination per Nominee per Nomination Period. Additional Nominations received from any Nominator or for any Nominee thereafter may be subject to disqualification. The use of robotic, repetitive, automatic, programmed, script, macro, or any other automated means or similar entry methods or agents (including, but not limited to, contest-entry services or multiple or different e-mail addresses, identities, registrations, accounts or logins) is prohibited and may result in the disqualification of all Nominations submitted by that Nominator. No group submissions will be accepted.

19. To be eligible for consideration for a particular month and/or Nomination Period,

Nominations must be received in accordance with the corresponding deadline in the Contest Chart above. All Nominations must be received by STEM East no later than October 31, 2014 at 11:59 p.m. ET. Proof of sending is not proof of receipt by STEM East. STEM East will not accept screen shots as proof of Nomination.

20. Contest Entities are not responsible for, and Nominators assume all risk of, Nominations that are lost, misdirected, mutilated, garbled, distorted, truncated, incomplete, illegible, or containing errors or that for any reason are not received by STEM East prior to the stated deadline, and all such Nominations are void. Nominations that fail to include any of the information required above may be disqualified without further notification by STEM East. STEM East reserves the right in its sole discretion to disqualify any Nomination at any time that in its opinion does not comply with these Official Rules. Nominations become the property of STEM East and will not be returned or acknowledged.

21. Each Nomination must include valid e-mail addresses for the Nominator and

Nominee. Contest Entities are not responsible for electronic communications that cannot be delivered due to incorrect or out-of-date information provided by Nominator or Nominee or that are undeliverable as a result of any form of passive or active filtering of any kind. In the event of a dispute as to the identity or eligibility of a Nominator based on an e-mail address, the Nomination will be declared submitted by the Authorized Registered User of the e-mail address used at time of nomination. “Authorized Registered User” is defined as the person who is assigned to the e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

22. The information that you provide in connection with the Contest may be used by STEM East in accordance with STEM East’s Privacy Policy, which is found at http://www.nceast.org/nc-east-privacy-policy and which may be updated from time to time.

Submission Requirements

23. All Nominations must satisfy the following Submission Requirements:

a. Nominations must be original to Nominator and/or Nominee (not copied, adapted, or reproduced from any other source and not collaboration with any other person).

b. Nominations must be completed on the front sides only, typed or legibly hand-printed, and may include no more than three (3) additional pages of pictures, work examples or other supporting documentation.

c. No watermarks, signatures, or copyright notices may be added to any Nomination and you must have all rights to submit in this Contest.

d. You must have permission to identify any person who is identifiable in your Nomination and you must be able to provide Contest Entities with written confirmation of permission if requested. Nomination may not contain any other personally identifiable information regarding any third parties.

e. Nominations must not describe or depict any content or statements that are inappropriate, lewd, pornographic, obscene, indecent, hateful, tortious, illegal, defamatory, slanderous, libelous, false, or disparaging, or that invade any person’s privacy or other rights, or that promote or advocate drug use, bigotry, racism, hatred, or harm against any group or individual, or that promote discrimination based on race, gender, religion, nationality, disability, sexual origin or age.

24. In the event that any claim of unauthorized use of any content contained within

the Nomination is made by any third party, Contest Entities reserve the right to disqualify the related Nomination. Contest Entities may reject and disqualify any Nomination that they determine has violated the Official Rules (including the Submission Requirements), or is otherwise unsuitable, offensive, or in poor taste at any time during the Contest, even if the Nomination has already been submitted to the Contest Judges (as defined below) for consideration. You agree that Contest Entities has the sole discretion to decide whether any Nomination satisfies these Official Rules and that their decisions are final.

25. By submitting a Nomination, you warrant that (a) the Nomination is original to and created solely by you and was not copied, in whole or in part, from any work belonging to anyone else, (b) the Nomination does not violate any copyright laws, and does not plagiarize, libel, slander, defame, disparage, or otherwise infringe on or violate the rights of any third parties, (c) any persons identified in the Nomination have agreed to be so identified in this Contest; (d) you are legally entitled to submit the Nomination in the Contest; (e) the distribution, reproduction, display and any other uses of the Nomination by Contest Entities as permitted herein will not infringe any third party rights, including those of any person who is identifiable in the Nomination; and (f) the Nomination complies with these Official Rules. Each Nominator agrees to indemnify and hold harmless Contest Entities, their parent companies and subsidiaries, and their respective officers, directors, employees and affiliated organizations, from and against any and all claims, demands, damages, costs, liabilities and causes of action of whatsoever nature that are based upon or arise out of any breach by the Nominator of these Official Rules or the warranties and/or representations made by Nominator pursuant to these Official Rules.

26. By submitting a Nomination, you expressly grant to Contest Entities (and to those

acting on their behalf) a non-exclusive, perpetual, world-wide royalty-free license (and waive all moral rights in and to the Nomination) to display or otherwise use the Nomination on the Contest Page and any related sites in connection with this Contest.

PHASE II: JUDGING

27. At the conclusion of each Nomination Period, all timely and properly submitted Nominations will be judged by an independent panel of qualified judges consisting of business and educational professionals assembled by STEM East (the “Contest Judges”), in accordance with rubric developed by review committee from NCDPI Stem Attributes (the “Judging Criteria”). Subject to verification of eligibility, the three (3) Nominees during each Nomination Period whose Nominations receive the highest overall score from the Contest Judges will be declared the Winners of the corresponding three (3) months in the Contest Chart above (for example, at the conclusion of Period 1, the STEM Teachers of the Months for February, March and April will be selected). Contest Entities reserve the right to select fewer than the stated number of Winners for any Nomination Period in which a sufficient number of eligible Nominations have been submitted.

PHASE III: NOTIFICATION

28. Contest Entities will make good faith efforts to notify each Winner in person at his/her school during the third week of the month for which he/she is named STEM Teacher of the Month and no later than the Notification date in the Contest Chart above. Each potential Winner may be required to present valid photo identification, sign an affidavit or declaration of eligibility, liability release, publicity

release (where legal), tax forms and/or other legal documents at the time of notification. Contest Entities in their sole discretion may allow transmission of verification documents via fax or e-mail.

29. In the event that any potential Winner (a) fails to satisfy any eligibility or

verification requirement herein, (b) declines to accept the prize, (c) or is otherwise determined to be ineligible, Contest Entities in their discretion may disqualify that individual and the Nominee who received the next highest score from the Contest Judges will be deemed an alternate Winner as soon as reasonably practicable after initial Winner is determined to be ineligible. Any alternate Winners are subject to all eligibility requirements and restrictions of these Official Rules. No more than one (1) attempt to verify an alternate Winner for any prize will be made. If an alternate Winner cannot be verified for a particular prize after one (1) attempt, no further attempts will be made for that prize and that prize will not be awarded.

30. Contest Entities may, in their sole discretion, post the names of the verified Winners on the Contest Page and/or any of their websites, including www.nceast.org and www.wnct.com.

PUBLICITY RELEASE

31. By accepting a prize, each Winner agrees to award Contest Entities the right to publicize his or her name, photograph (including the use and appearance of Winner's photograph on Contest Entities’ respective web pages), likeness, biographical information, e-mail address, voice and details of winning for purposes of this and future promotions without further compensation, except where prohibited.

LIMITATION OF LIABILITY/DISCLAIMER OF LIABILITY

32. By entering the Contest or accepting a prize, you hereby agree that Contest Entities, Facebook, and a range of subsidiaries, directors, agents, agencies, affiliates, distributors, retailers, franchisees, promoters, officers, directors, employees, and all of their respective advertising and promotional agencies, representatives, contractors and related persons (collectively, “Released Parties”):

a. are not responsible for technical failures of any kind, including but not

limited to lost, disconnected, interrupted, or unavailable network, server, or other connections, late, lost, undeliverable, damaged or stolen mail, or for any failed telephone or computer hardware or software, or for any failed, delayed, misdirected, corrupted, or garbled transmissions or errors of any kind, whether human, mechanical, or electronic, or for Nominations that for any reason are not received by STEM East by the deadlines stated above;

b. are not responsible for any incorrect or inaccurate information, whether

caused by Nominators, Nominees or other persons, or by printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Contest or in the printing of this offer, administration of this Contest, or in the announcement of the Winners;

c. are not responsible for any injury or damage to any computer, modem or other electrical device as a result of participation in any part of this Contest or of downloading of any software or materials;

d. are not responsible for unauthorized human intervention in any part of the Contest, including without limitation, the nomination or judging processes;

e. are not responsible for any printing, typographical, technical, computer, network or human error that may occur in the administration of the Contest, the receipt and/or processing of Nominations, the announcement of Winners, the prizes or otherwise in any Contest-related materials;

f. are not responsible for any unauthorized third party use of any Nomination;

g. are not responsible for the inability to select the Winners because of postal failure, equipment failure, or data storage failure; and

h. are released from any and all alleged, existing, or future actions, claims, and/or liabilities of whatever nature including, but not limited to, personal injury, bodily injury (including, without limitation, wrongful death and disability), property damage, and expense (including, without limitation, reasonable attorneys’ fees) and loss or damage of any other kind, arising in whole or in part directly or indirectly, from participating in the Contest (in whole or in part), the use (including modification, adaptation, and reproduction) of Nominations during or after the Contest, and the delivery, acceptance, possession, use, misuse, loss, or misdirection of any prize.

33. RELEASED PARTIES EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES

OF ANY KIND (WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE), INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. RELEASED PARTIES SHALL NOT BE LIABLE OR RESPONSIBLE FOR THOSE GUARANTEES OR WARRANTIES MADE OR OFFERED BY ADVERTISERS, PARTNERS, MANUFACTURERS OR SUPPLIERS, INCLUDING THOSE RELATED TO THE PRIZES. UNDER NO CIRCUMSTANCES SHALL RELEASED PARTIES BE HELD RESPONSIBLE OR LIABLE FOR YOUR USE OF THE INFORMATION AND/OR PRODUCTS PROVIDED AND/OR MADE AVAILABLE THROUGH THE CONTEST OR FOR

RELEASED PARTIES OFFER NO ASSURANCES, GUARANTEES OR WARRANTIES THAT THE CONTEST OR RELATED WEBSITES WILL BE UNINTERRUPTED OR ERROR-FREE AND DO NOT GUARANTEE THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE CONTEST. RELEASED PARTIES WILL NOT BE LIABLE, AND ARE NOT RESPONSIBLE, FOR DAMAGES OF ANY KIND RELATED TO YOUR PARTICIPATION IN OR INABILITY TO PARTICIPATE IN THE CONTEST, WHETHER THE DAMAGES ARE DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL.

34. BY ENTERING THE CONTEST AND/OR ACCEPTING A PRIZE, YOU AGREE

THAT THE RELEASED PARTIES SHALL NOT BE LIABLE FOR, AND WILL BE HELD HARMLESS BY YOU AGAINST, ANY LIABILITY FOR ANY DAMAGE, INJURY OR LOSS TO PERSON (INCLUDING DEATH) OR PROPERTY RELATED IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, TO ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE, PARTICIPATION IN ANY PRIZE-RELATED ACTIVITY, USE BY A RELEASED PARTY OF ANY NOMINATION, PARTICIPATION IN THE CONTEST IN ANY WAY, OR ANY OTHER CLAIM OR CAUSE OF ACTION YOU MAY HAVE AGAINST A RELEASED PARTY.

35. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF

LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU IN WHOLE OR IN PART.

MISCELLANEOUS

36. Contest Entities reserve the right to cancel, terminate or suspend this Contest or any part of this Contest in the event that they determine, in their joint discretion, that the security, administration, fairness and/or operation of the Contest has been corrupted or impaired by any non-authorized intervention, network failure, information storage failure, telecommunications failure, malfunction, or any other cause beyond their control. In such event, Contest Entities will post notice of same at the Contest Page and determine the Winners from among all non-suspect eligible Nominations received at the time of the Contest termination in accordance with previously described selection process if possible or in such other method as Contest Entities, in their discretion, deem fair and appropriate under the circumstances.

37. Contest Entities reserve the right to prohibit any person from further participation

in any part of the Contest if Contest Entities conclude, in their discretion, that such person has (a) attempted to tamper with the nomination or judging processes or the operation of the Contest in any other way, (b) has attempted to

unfairly affect the outcome of the Contest, (c) has repeatedly disregarded or has attempted to circumvent these Official Rules, or (d) has acted towards any Contest Entity or any other Nominator or Nominee in an unfair, inequitable, deliberately annoying, threatening, disrupting or harassing manner. Tampering includes attempting to submit more than the number of Nominations permitted herein, including through the use of any prohibited device or method. Any failure by Contest Entities to enforce any of these Official Rules shall not constitute a waiver of such Official Rules.

38. ANY ATTEMPT BY ANY INDIVIDUAL TO DEFRAUD, TAMPER WITH, OR DELIBERATELY UNDERMINE, THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND CONTEST ENTITIES RESERVE THE RIGHT TO PURSUE ANY AVAILABLE DAMAGES OR REMEDIES AGAINST SUCH INDIVIDUAL AND/OR REFER SUCH MATTERS TO LAW ENFORCEMENT

39. All activity arising out of and relating to the Contest, including any reference to a

Nominee's status as a "Winner," is subject to verification and/or auditing for compliance with the Official Rules and you agree to cooperate with Contest Entities concerning such verification and/or auditing. If Contest Entities determine, in their joint discretion, that verification or auditing activity evidences non-compliance of a Nomination, Nominator and/or Nominee with the Official Rules, Contest Entities reserve the right to disqualify the Nominee and/or remove the Nomination from the Contest at any time.

40. Contest Entities reserve the right to correct typographical, printing or clerical

errors in any Contest-related materials. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Contest Entities reserve the right to award only the stated number of prizes by selecting the Winners from all legitimate, un-awarded, eligible prize claims in accordance with the previously announced selection process.

TRADEMARKS

41. Facebook is not a sponsor of this Contest. Any third party trademarks mentioned herein are the property of their respective trademark owners. The use or mention of such third party trademarks in these Official Rules or in the Contest is solely for descriptive purposes and shall in no way imply an endorsement or sponsorship of the Contest.

DISPUTES

42. By participating in the Contest or accepting a prize, you agree that:

a. all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any person or Contest Entity in connection with the Contest, shall be governed by North Carolina law without giving effect to any choice of law rules that would cause the application of the laws of any jurisdiction other than North Carolina;

b. any legal proceedings arising out of this Contest or relating to these Official Rules shall be instituted only in the federal or state courts located in Pitt County, North Carolina, and you consent to the mandatory and exclusive jurisdiction therein with respect to any such legal proceedings or disputes;

c. any and all disputes, claims, and causes of action arising out of or

connected in any way with the Contest or any prize shall be resolved individually, without resort to any form of class action;

d. any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest but in no event attorneys' fees; and

e. you will not under any circumstances be permitted to obtain any award for,

and you voluntarily and freely waive all rights to claim any award for, punitive, incidental or consequential damages or any and all rights to have damages multiplied or otherwise increased, or any damages other than actual out-of-pocket expenses.

Some jurisdictions do not allow for limitations on the ability to pursue class action remedies, or certain kinds of damages, and so these limitations may not apply to you.

43. In the event of any discrepancy or inconsistency between any terms or conditions of these Official Rules and any disclosures or other statements contained in any other Contest-related materials, including but not limited to the Contest nomination forms, or point of sale, television, print, mobile or online advertising, the terms and conditions of these Official Rules shall prevail, govern and control.

44. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
