Dr. McRoberts is currently a visiting Associate Professor of Orthopaedics at the University of New Mexico. He is a member in the Greater Albuquerque Medical Association, New Mexico Medical Society, American Academy of Othopaedic Surgeons, & New Mexico Orthopaedic Association. On August 16, 2007, the Board accepted the resignation of Dr. Prakash Ranka after approximately four years of service. The Board bid farewell to Dr. Alfredo Vigil upon his appointment by the Governor to the position of Health Secretary effective June 11, 2007. Add provi- sion: “If New Mexico is the first state of licensure, initial licenses are valid for a period of not less than twenty-four months or more than thirty-five months and shall be renewed on July 1.” Subsection D of Section 12, License Expiration Revise to read: “Postgraduate training licenses are valid for no longer than three years but may be renewed for a period not to ex- ceed six years, as long as the license holder is enrolled in a board approved training program. Part 16.10.3 NMAC—Examinations Revise to add definitions in Section 7. Subsections A,B, & C of Section 8 are revised to clarify and sim- plify eligible exam combinations. This section applies to applicants who were examined PRIOR to January 1, 2000. Part 16.10.4 NMAC—Continuing Medical Education Subsection B of Section 10 NM Specific CME, correct language to delete “whether taken in an on site format or taken using the inter- net” , as these credits are for committee participation and not avail- able on the internet. Part 16.10.9 NMAC—Fees Proposed fee increase for license application, triennial renewal, late fee, and reinstatement. Delete fees for duplicate licenses. Effective August 16, 2007, the Governor appointed Dr. Robert L. McRoberts to replace Dr. Alfredo Vigil. Dr. McRoberts has been licensed in New Mexico since 1972 having come to the University of New Mexico as an instructor in Orthopaedic Surgery in 1972. He was certified by the American Board of Orthopaedic Surgery in 1974. Dr. McRoberts is a graduate of Amherst College and Yale University. He completed a four year Orthopaedic residence program at the Mayo Clinic in Rochester, NM in 1972. He was in the private practice of Orthopaedic Surgery in Albuquerque from 1978 until 2003. Dr. McRoberts is currently a visiting Associate Professor of Orthopaedics at the University of New Mexico. He is a member in the Greater Albuquerque Medical Association, New Mexico Medical Society, American Academy of Othopaedic Surgeons, & New Mexico Orthopaedic Association.

On August 16, 2007, the Board accepted the resignation of Dr. Prakash Ranka after approximately four years of service. The Board bid farewell to Dr. Alfredo Vigil upon his appointment by the Governor to the position of Health Secretary effective June 11, 2007. Dr. Vigil served on the Board for approximately two years. The Board appreciates the dedicated service Dr. Ranka and Dr. Vigil provided during their tenure.

The Board is considering rule revisions to the following Parts as summarized below. Please submit written comments by November 1, 2007, if you are unable to attend. Criminal Background Checks

STATE AND NATIONWIDE CRIMINAL HISTORY SCREENING REQUIRED

The New Mexico Medical Board was created by the State Legislature in the interest of the public health, safety and welfare. Its statutory mandate is to protect the public from the improper, unprofessional, incompetent and unlawful practice of medi-cine. In the fulfillment of that mission, the NMMB has joined the majority of states in the country by requiring all license applicants and current license holders to submit to a state and nationwide criminal background check. LICENSE RENEWALS: Beginning with the 2008 renewal cycle, every licensee seeking to renew their license will be required to submit fingerprints for a state and national criminal background check in accordance with the provisions of 61-6-11(G) of the Medical Practice Act and Title 16, Chapter 10, Part 2, Part 7 and Part 15 of the rules and regulations. The Board is committed to processing background checks as quickly and efficiently as possible. If you have any questions or comments, please do not hesitate to contact Board staff directly so they may assist you. What is a criminal history record?

The nationwide criminal history record includes information concerning a person’s arrests, indictments or other formal criminal charges and any dispositions arising there from, including convictions, dismissals, acquittals, sentencing and correc-tional supervision, collected by criminal justice agencies and stored in the computerized data bases of the Federal Bureau of Investigations (FBI), the national law enforcement telecommunications systems, the Department of Public Safety (DPS) or the repositories of criminal history information of other states. Will the criminal background check slow down my license or renewal application?

No. There will be absolutely no delay in the Board’s timeline for processing completed license applications or renewals. In order for your application , renewal or reinstatement to be considered complete, the Board office will need to receive the completed fingerprint cards and authorization forms. The office will proceed to approve your application or renewal while the background screening is pending and you should receive your license in a timely manner. Neglecting to complete and send the fingerprint cards would delay license issuance because your application will be considered incomplete. If the back-ground screening reveals a felony or a violation of the Medical Practice Act, the applicant or licensee will be notified ,and the Board will determine what action may be taken. How frequently am I going to have to submit to a background check?

ONE-TIME-ONLY. Recent advancements in technology mean that each applicant will only have to submit to a single combined state and national background check, rather than a background check at each renewal; a new background check will only be required if new information about the licensee becomes available. Where would I go to have my fingerprints taken? Most public law enforcement agencies offer fingerprinting services; such as, Department of Public Safety, county sheriff, city police, campus, military and tribal police. Check your local “yellow pages” for other qualified fingerprinting sources. Remember, you need to obtain the cards and forms from the NM Medical Board office before having your fingerprints taken.

What will a criminal history screening cost me? The cost is currently $34.00, payable to the NM Medical Board, in addition to the fee charged by the fingerprinting agency. Do I have to wait until I receive a renewal application to submit fingerprints? No. You may submit fingerprints at any time or wait until you receive a renewal application in 2008, 2009, or 2010. Remember, this is a one-time-only requirement so you will not be required to submit fingerprints when renewing after 2010. Fingerprint cards will be mailed to all licensees with their renewal application; however, if you want to submit fingerprints sooner, contact the Board office for the required cards and forms to be mailed to you. What if my criminal history screening reveals an arrest? The Board will consider each instance where a background check reveals relevant information very carefully. It will take into consideration all aspects of the situation, including the type of offense, when the offense occurred, and any evidence – or lack thereof – of continued problems. The Board predicts (based on statistical information from other states that conduct background checks) that there will be very few disciplinary actions resulting from the screenings. The Board’s intention is not to uncover each and every past indiscretion; however minor ,which resulted in an arrest and charges with the goal to punish and invoke disciplinary action. The Board is committed to its statutory mis-sion—to protect the public—and; therefore, will use every tool available to uncover and investigate the most egre-gious actions. What if I suspect my criminal history screening may reveal an arrest and I can’t remember if—or I forgot to—report it to the Board? The Board only intends to consider the actual infraction and as stated before, will consider all relevant aspects of the arrest. Of course the Board expects full and honest disclosure. The initial application for a NM license and every license renewal application thereafter requires NM physicians to disclose any arrest or conviction they may have had. However, the Board is not conducting these background checks for the purpose of identifying or prosecuting any historical instances of failure to disclose. Nevertheless, you are well advised to voluntarily report a previously undisclosed violation to the Board prior to the criminal background check. And again, the Board does not contem-plate any allegations based on prior failure to disclose. Why can’t you use the criminal history screening I had taken for my employer or university? The FBI does not allow criminal background check documentation to be shared from agency to agency. What if I refuse to submit to a criminal history screening when I renew my license? Because the law requires a criminal history screening, refusing to submit fingerprints with your renewal application will result in an incomplete application and your license will not be renewed. You may voluntarily choose not to renew and let your license lapse with no disciplinary action. Reference Part 7, Subsection C of Section 13 NMAC. A physician may inform the Board that he does not wish to renew an active license to practice in New Mexico and will voluntarily allow the license to lapse. A voluntarily lapsed license is not valid for practice in New Mexico.

MESSAGE FROM THE EXECUTIVE DIRECTOR

The Board office is collaborating with the NM Medical Society, the Greater Albuquerque Medical Association, the NM Hos-pital Association, the UNM Medical Students Society and state hospitals to assist all state physicians with access to fingerprint-ing resources. You have probably already had fingerprints taken for employment or university enrollment; however, the FBI does not allow this information to be shared agency-to-agency. We definitely do not want this license requirement to be burdensome. The actual process takes only about five minutes. As you know, students, teachers, nurses, and all or nearly all, healthcare provid-ers are required to submit fingerprints for enrollment, employment, or licensure, either currently or they will be in the very near future. The fingerprint requirement has been in the Medical Practice Act for years and implemented off and on. In to-day’s world, this requirement is becoming the norm. We will be compiling a list of certified fingerprinting agencies, in addition to the law enforcement or university offices for your reference. As soon as the list is available, we will post it on the Board’s web site.

Summaries of the rule revisions adopted at a Rule Hearing held on August 16, 2007 are as follows: Part 16.10.2 NMAC—Physician Licensure Requirements Removed Subsection D of Section 17 regarding accepting criminal background checks from another state because the FBI does not allow criminal background check documentation to be shared from agency-to-agency. Part 16.10.3 NMAC—Examinations Subsection E of Section 9 was revised to expand and clarify the Board’s authority to grant exceptions to the seven-year requirement for qualified applicants. Part 16.10.4 NMAC—Continuing Medical Education Subsections A, B & C of Section 8 were revised for clarification. Subsections A & B of Section 11, added language “whether taken in an on-site format or taken using the internet”. Section 12, removed language limiting the number of hours that are obtained using the internet. Subsections A, B &C of Section 13, Verification of CME, were revised for clarification; added that settlements and fines may be offered for physicians unable to provide the required documenta-tion in lieu of initiating disciplinary action. Part 16.10.7 NMAC—License Expiration, Renewal and Reinstatement Section 7, added definitions of “nationwide criminal history record” and “nationwide criminal history screening”. Sections 9 & 18, added that the criminal background screening includes nationwide. Part 16.10.8 NMAC—Medical Ethics Section 7, added the definition of an established physician-patient relationship. Subsection L of Section 8 was revised to define prescribing, dis-pensing or administering drugs to a patient when there is no estab-lished physician-patient relationship. Part 16.10.9 NMAC—Fees Subsection H of Section 7 was revised to state the fee for a nation-wide criminal history screening is equal to the current FBI and Department of Public Safety fee. Section 12, Miscellaneous Fees, increased copying fee and license verification fee. Part 16.10.15 NMAC—Physician Assistants: Licensure & Practice Requirements Section 7, Definitions, clarified “alternate supervising physician’, added “effective supervision, removed “oral communication”, and added “direct communication. Subsection H of Section 9, removed rule accepting criminal back-ground checks from another state because the FBI does not allow criminal background check documentation to be shared from

Medical Marijuana Medical Use of Cannabis Act

Dr. Steve Jenison, Medical Director, Department of Health, provided the Board an update on Senate Bill 523 at their August 17, 2007 meeting. The Department of Health (DOH) has created a registry for people that have a prescription and medical diagnosis for use of medical cannabis. As part of the application review, each referring physician is contacted by Dr. Jenison. Since the reg-istry began on July 1, 2007, thirty people have been enrolled. The people enrolled suffer from diagnoses such as cancer, glaucoma, spinal cord damage with intractable spasticity, multiple sclerosis, HIV or AIDS, and hospice care. Those people approved get a card in the mail indicating what being enrolled in the program means. The production and distribution portion of the Bill are cur-rently on hold. Applications are on the DOH web site. Currently the DOH is not providing the cannabis and is not inquiring where the registrants acquire it. New Mexico’s law is similar to laws in Colorado. No other states have a provision for providing cannabis. A public hearing was held on October 1, 2007, to adopt two proposed rules 7.34.2 NMAC, Advisory Board Responsi-bilities and Duties, and 7.34.3 NMAC, Registration Identification Cards. The Board invited Dr. Jenison to attend their November 2007 meeting for an update. The following physicians are serving on the Advisory Committee: Erin Bouquin, MD; Elaine Edmonds, MD; Eve Elting, MD; Eve Espey, MD; William Johnson, MD, Timothy Lopez, MD; Mitchell Simson, MD; and Karla Thornton, MD. The committee will meet at least twice a year to hold public hearings and evaluate patients’ petitions to add conditions to the list of qualifying medical conditions. There is a list of “Frequently Asked Questions” on the Department of Health web site. ⇒ Representative of the NMMB will be

participating with various other health care professions regarding Senate Memorial 48. Senate Memorial 48 resolves that the Regulation and Li-censing Department, the Office of Attorney General, representatives from each of the State boards that license health care providers includ-ing the New Mexico Medical Board, the Board of Nursing, the Board of Pharmacy and representatives from the health care-related boards within Regulation and Licensing, collaborate on a study that will assess whether current law adequately protects the public’s right to access safe and effec-tive traditional, cultural, complemen-tary and alternate health care remedies freely and whether any changes to State law are necessary to protect this right.

⇒ Resolution B-201: New Mex-ico Medical Board Should As-sert Control Over Determining the Scope of Practice of Non-Physician Medical Practitioners in New Mexico. This resolu-tion was adopted unanimously by the Greater Albuquerque Medical Association (GAMA) at their May 11-12, 2007, House of Delegates. The reso-lution directs the New Mexico Medical Society (NMMS) to collaborate with the New Mex-ico Medical Board (NMMB) to prepare a report evaluating the extent to which the NMMB has the statutory authority to define the practice of medicine and surgery and those aspects of that practice that may be dele-gated to practitioners of other allied professional health fields. The Board will be dis-cussing this resolution in the near future.

from patients when their medi-cal records are not released in a timely manner. Remember - Part 17 of the NMMB regula-tions require physicians to pro-vide complete copies of medi-cal records to a patient or to another physician in a timely manner when legally requested to do so by the patient or by a legally designated representa-tive of the patient.
