My dear fellow exporters,
The efforts of the Council over the last two months to convince the Government about the lossesfaced by our members as a consequence of 12% Rupee appreciation in the last couple of monthshas finally resulted in positive action. On July 12, 2007, the Government announced a set of measuresthat included the increase in DEPB Rates by 3% for engineering products, enhancement of DutyDrawback rates, lowering of interest cost on packing credit by 2%, reduction by 10% on ECGCpremium as well as reimbursement of terminal excise duty at the earliest.
In its reaction, the Council has stated that the above measures are, indeed, welcome and will partiallyoffset the tough conditions that are faced by the exporting community. We have also stated that theelement of uncertainty still remains since the steps announced are only upto end of December 2007and it is quite possible that from October 2007 onwards, exporters will, once again, desist from bookingnew contracts if the exchange rate continues to hover around the Rs. 40 to a dollar mark. Thus, theGovernment should extend the benefits for the full fiscal year so that the export target set by theCommerce & Industry Minister can be met in the current year. Moreover, the DEPB Rates could haveincreased by about 5% across the board.
The Council has also expressed its disappointment that the Government is yet to notify the ServiceTax Notification on services for post-production of goods as this was promised by the Commerce &Industry Minister Shri Kamal Nath nearly three months ago. In an interactive session with the CommerceSecretary on CNBC TV, the Commerce Secretary, Shri G. K. Pillai accepted that the above concessionswere partial in nature and the Government will shortly come out with the Service Tax ExemptionNotification. Further, while the cost of export credit is an important issue for the SME engineeringexporters, access to credit is an equally important factor. The commercial banks lend aroundRs. 97,000 crore in a year to the commercial sector and the Council has stressed that the RBI mustmandate the banks that 8% of this amount should be directed to meet the export credit needs of theSME exporters.
The Council has also opined that under current conditions a 15% growth in engineering exports isfeasible provided the exchange rate is around Rs. 42 to a dollar. This implies that the engineeringexports would touch around USD 30 billion this year. We would, however, like to stress that thesituation is still fluid and I shall be happy if could continue to keep the Council informed of the challengesand problems faced by you in the process of exporting your products abroad. The Council is alsotaking up various banking and financial sector related problems in the RBI’s External Group on ExportCredit for SME sector where we have suggested a detailed appraisal of the export credit needs of theSME sector. This apart, the Council has also been invited by the Department of Science and Technology,Government of India to do a study on the potential of Consultancy Services exports from India tosome African and Latin American countries. We will get in touch with the concerned member companiesover the next couple of days to the relevant member companies to elicit their responses to theQuestionnaire that the Department has requested to circulate.

Preamble
It has always been EEPC’s endeavour to foster exports of India’s state-of-the-art Engineering Industry into world market.
In line with above EEPC is pleased to announce one of its major events – INDEE, Johannesburg – to be held in South
Africa at Expo Centre, Nasrec, Johannesburg during 23-26 October, 2007. This is a major step forward to enter into the
South African market.
About South Africa
South Africa is the economic powerhouse of Africa with a Gross Domestic Product (GDP) four times that of its Southern
African neighbours and comprising around 25% of the entire continent's GDP. The country leads the continent in industrial
output (40% of the total output) and mineral production (45%) and generates most of Africa's electricity (over 50%). Its major
strengths include its physical and economic infrastructure, natural mineral and metal resources, a growing manufacturing
sector, strong growth potential in the tourism, high value-added manufacturing and service industries. The financial and
industrial sectors are concentrated in Gauteng Province which on its on accounts for over 30% of the country (GDP).
South African economy has been showing an upward trend since September-1999 and the annual economic growth rate
from September-1999 through June-2005 has averaged at 3.5%. Gross Domestic Product (GDP) was running at an
annualized 4.8% at the second half of 2005 (compared to 3.7% in 2004 and 2.8% in 2003).
India-South Africa Trade Relations
Since 1994 India South Africa relation has shown smooth development with signing of a number of bilateral agreementsin diverse areas ranging from Defence, Culture, Science and economic cooperation.
Total trade between the two countries has grown significantly since 2001 with surge in both export and import, but Indiahas remained a net Importer. But in the engineering sector, India’s export to South Africa has maintained a steady growth89.5% in 2005-06 and 94% in 2004-05 on year on year basis.

Potential growth areas for Indian exports to South Africa are – Vehicle and vehicle components, Transport equipments,
Castings, Forgings, Hand Tools, Agricultural equipments, Two wheelers etc. There are also good potential for exports in the
service industry like Software expertise, technical man-power training.
Indian investments in South Africa have grown significantly both in quantity as well as diversity. Major investors includes
UB Group of India, Tatas, Mahindras, Ranbaxy, Cipla, Godrej, Ashok Leyland etc.

Payment & Cancellation
Full payment should be made along with Application Form, duly filled in latest by 31st July, 2007. The payment should
be made by way of Demand Draft drawn in favour of “Engineering Export Promotion Council” payable at New Delhi.
Reservation requests will be considered only on receiving 100% payment. 50% cancellation charge applicable if reservation
is cancelled before 31st July, 2007.
Shipment of Exhibits
In order to facilitate shipment of exhibits, Council will appoint a Shipping Agent.
Selection Criteria
Final selection of the participants will be done by a Committee based on the criteria such as Accreditation to the Inter-
national Standards (like ISO, QS, etc.) foreign collaboration, annual export, and exports to South Africa.
Travel and Hotel Accommodation
Council will assist participants in locating suitable air lines and hotels at Johannesburg at negotiated rates through
accredited Travel Agents. However, participants are free to stay and travel through their own agencies.
MDA Grant
All eligible participants will be entitled to MDA grant under Focus Africa Programme of Ministry of Commerce, Government
of India as per the MDA Guidelines effective from April 01, 2006.
Assistance would be permissible on travel expenses by Air in Economy Excursion Class fare and/or charges of built up
furnished stall subject to an upper ceiling of Rs. 1,50,000/- (Rupees One Lakh Fifty Thousand only).
Further, eligibility for MDA grant is subject to exporting companies having FOB value of exports up to Rs. 15 crores in the
preceding year, having complete 12 months membership with EEPC with regular filing of returns and fulfilling other
conditions, details of which can be obtained from respective Regional Offices of EEPC.

EEPC Invites Participation for MIDEST-2007, Paris, France(November 13 - 16, 2007)
MIDEST is the world’s largest Industrial Subcontracting Show. It provides a service for manufacturers, component suppliers
and assemblers who want face-to-face meetings with solution providers in the fields of metals, plastics, electronics and
industry services. MIDEST-2007 is scheduled to be held from 13 to 16 November, 2007 at Paris, France.
MIDEST attracts an average of 2,000 exhibitors every year out of which 38% exhibitors are from countries other than
France. Last year the fair was visited by 47,915 visitors, 14% of which come from 61 outside countries.
The export of engineering goods from India to European countries has reached a level of US$ 4.40 billion in 2005-06
against a value of US$ 3.95 million during 2004-05 thereby registering a growth of 11.14%. The last three years trend
indicates an average growth of 36.78%. This shows that the Indian engineering goods are regularly finding a favourable
place in European market.

MSV 2007 (49th International Engineering Fair) is the largest Technology Trade Fair in Central Europe. It is a holistic
platform for the engineering industry co-locating manufacturers of machine tools and forming machinery along with material
and component manufacturers with applications in automation, building and construction, engineering and electronics, and
measuring instruments. There is great scope for Industrial machinery, given the upsurge in users from the automotive and
electrical engineering industries. MSV 2007, Brno is scheduled to be held from 1 to 5 October, 2007 at Brno, Czech
Republic.

The Council is pleased to inform that a Multi-Product Trade Delegation will be visiting Thailand, Philippines and Malaysia
during 16th to 22nd September, 2007.
India’s trade with the ASEAN dates back to time immemorial. The Indo-ASEAN trade accounts for about 18% of India’s
total trade in the last three years. The bilateral trade between India and ASEAN countries has grown by 9 times in 2006
since 1993-’94. ASEAN is the fifth most important market in the world in terms of Indian exports. Among the ASEAN
countries, the share of Indian exports to Malaysia was 11.16%, Thailand accounted for about 10.32% and Philippines with
4.76% in 2005-’06, projected a promising future scenario.
The engineering exports to ASEAN countries have touched the US$2477.99 million in 2005-’06. The total export to ASEAN
from April 2005–January 2006 accounted to about US$1687.12 million and that from April 2006–January 2007 to about
US$2212.34 million.
Malaysia
Malaysia has emerged as a multi-sector economy and is the 10th largest investor in India with an investment of US$76 million.
India’s exports in the engineering sector were US$330.69 million (2005-’06), which has almost doubled since 2003-’04.
Thus, projecting a growth of about 96.16%. The exports for the period April–January (2006-2007) was US$290.43 million.
Philippines
The bilateral trade between India and Philippines has also almost doubled since early 2000 and has reached US$577.08
million (2004-’05). Indian exports recorded a rise of 67.76% in 2005-’06. The figures for the period April–January (2006-’07)
show an accumulated export of US$157.19 million.
Thailand
Indo-Thailand relations have improved appreciably over the past few years. Trade between India and Thailand has grown
significantly since 2003-’04 from US$251.60 million to US$318.99 million in 2005-’06, which suggests a growth of 26.78%
in just 3 years time. A glimpse at the April–January (2006-’07) with total engineering exports of US$318.04 million clearly
express the potential in store.

Hotel Accommodation/Travel Costs

Registration and Participation Charges
Rs. 40,000/- per participant will be charged to partially cover the expenses on providing following facilities to the participants :

Participants will be eligible to & fro air passage in economy excursion class up to Rs. 70000/- only as per revised MDA
guidelines. Only one person per company will be entitled.

Bilateral business discussion between India & Mexico
Prime Minister Dr. Manmohan Singh and President Calderón met in Germany on the sidelines of the G-8 and G-5 Meet.
During the meeting, President Calderón underlined the fact that India is one of his Government’s priorities in the Asian-
Pacific Rim. Both leaders hailed the advances achieved in recent years regarding the expansion of the legal framework,
particularly the signing of the Agreement for the Promotion and Reciprocal Protection of Investments. President Calderón
expressed his desire to see the signing of other agreements concerning double taxation, mutual legal assistance, Customs
cooperation and air transport.
President Calderón pointed out that the recent signing of the memorandum of understanding for the establishment of
a top-level economic cooperation group will permit the analysis and proposal of strategies to reinforce trade and investment
strategies to enable them to achieve their full potential. To this end, he stressed the importance of increasingly involving
the private sectors of both countries in the task of economic promotion. Prime Minister Dr. Manmohan Singh invited
President Calderón to make an official visit to India. President Calderón expressed his gratitude for this invitation, adding
that he hoped that his visit would take place this year, pending authorization from the Mexican Congress.

New acquisition for Swedish truck maker
Volvo said that it has reached an agreement to pay US$1.3 billion for the road-building division of American group Ingersoll
Rand. Volvo says it is to boost its construction equipment business and it expects the acquisition will save it about
US$85 million over five years. In beginning of March, Japanese truck maker Nissan Diesel accepted a billion dollar buyout
from Volvo, which was its largest shareholder.

Risk Management System (RMS) - Charter of Functions for Risk Management Division andConstitution of National/Local Risk Management Committee - regarding
The undersigned is directed to invite attention to Board’s Circular No.43/05-Customs dated 24.11.2005 introducing RiskManagement System as a significant step in the ongoing Business Process Re-engineering initiative of the department.In continuation of this initiative, a Risk Management Division (RMD) has been created in the Directorate of Systemsand Data Management, CBEC with its headquarters in Mumbai.
2. The objective of the Risk Management System (RMS) is to achieve an optimal balance between providing appropriatelevels of facilitation to the international trading community and ensuring compliance with regulatory provisions. Witha view to streamlining the operations of the RMS, the Risk Management Division with the following charter of functionshas been created.
3. Charter of functions for the RMD
3.1 The RMD will have the overall responsibility for the management of the RMS which has been designed to addressrisks facing Customs, i.e., the potential for non-compliance with Customs and allied laws and security regulations,including risks associated with the potential failure to facilitate international trade.
3.2 The RMD will be the nodal agency with the overall responsibility for designing and implementation of RiskManagement System using various risk parameters and risk management tools. RMD will suggest assessmentand examination in respect of consignments perceived to be risky and facilitate the remaining ones.
3.3 The RMD will also be responsible for collecting and collating information and developing an intelligence databasewith a view to effectively implement the RMS and also carry out effective risk assessment, risk evaluation andrisk mitigation techniques. It will update and maintain risk parameters in relation to the trade, commodities andall stakeholders associated or involved with the supply chain logistics.
3.4 The RMD will be the nodal agency for Accredited Client’s Programme (ACP). It will maintain a list of accreditedclients in the RMS and closely monitor the compliance standards of these accredited clients.
3.5 The RMD will closely interact with all Custom Houses, Directorate of Revenue Intelligence (DRI) and Directorateof Valuation (DOV) to enable it to effectively address national risks. The local risks will be largely addressed byRMD in co-operation with the Custom Houses where import/export clearances are actually effected. Further, theRMD will also closely interact with Directorate of Valuation (DOV) on all matters pertaining to the Valuation RiskAssessment Module (VRAM) of RMS. DOV will guide and advise RMD on all matters pertaining to valuation inRMS. DOV will also supply the list of Most Sensitive Commodities with value bands, the list of valid valuationalerts and the list of Unusual Quantity Code(UQC) at agreed intervals.
3.6 The RMD will also review the performance of the RMS in terms of reviewing the various targets/interventions
inserted by the Local Risk Management (LRM) Committee, make an objective assessment of the effectiveness
of such insertions, and ensure that the performance is consistent with the objective laid down. For this purpose,
the RMD shall provide necessary advice and guidance to Custom Houses as and when required, which shall be

followed. The RMD will also review the extent of facilitation being provided to the trade and offer necessary guidance
to the officers in the Custom Houses with a view to providing appropriate facilitation and also ensuring compliance.
3.7 The RMD will also coordinate and liaise with other Government Departments (OGDs), in order to deal with risks
relating to the compliance requirements under allied Acts which the Customs department is required to administer,
under the overall direction of the D.G. (Systems).
3.8 The RMD will work in close coordination with NACEN in developing training manuals and other documentation
necessary for the implementation of RMS. In addition to this, it will also work out regular training schedules for
training of officers responsible for implementing the RMS in major customs locations.
3.9 The RMD shall work in close coordination with Directorate General of Audit (DG Audit), which has the responsibility
for formulating audit policies and procedures, developing criteria and parameters for selection of cases or documents
for audit.
3.10DG(Systems) will submit periodic reports on the functioning of the RMS to the Board.
National Risk Management (NRM) Committee
4.1 There shall be established a National Risk Management (NRM) Committee with the DG(Systems) as the head.
The RMD will be the nodal agency responsible for convening the National Risk Management (NRM) Committee
to review the functioning of the RMS, supervise the implementation of RMS and provide feedback for improving
the effectiveness of RMS. The NRM Committee will be a standing committee and shall include representatives
of Directorate General of Revenue Intelligence (DGRI), Directorate General of Valuation (DGOV), Directorate General
of Audit (DG Audit), Directorate General of Trade Facilitation (DGSTF) and Tax Research Unit (TRU).
4.2 The NRM Committee shall be convened at least once every quarter and will have the following functions :
(i) Review of the performance of the RMS including progress on implementation of the ACP and reviewing theimplementation of PCA (Post Clearance Audit) functions;
(ii) Review of Risk parameters and behaviour of important risk indicators;
(iii) Review of economic trends, changes in policies, duty rates, exemptions, market data etc., that adversely impacton customs functions and processes and suggesting remedial action thereof;
(iv) Any other matter of import/export which the RMD considers important enough to engage the NRM Committee’s
attention.
Local Risk Management (LRM) Committee
5.1 A Local Risk Management (LRM) committee shall be constituted in each Custom House/Air Cargo Complex/ICDand shall be headed by an officer not below the rank of Commissioner of Customs.
5.2 The LRM Committee will comprise the Additional/Joint Commissioner in charge of Special Investigation andIntelligence Branch (SIIB), who will be designated as the Local Risk Manager, and will also function as the Secretaryof the Committee. The LRM Committee shall also include the Additional/Joint Commissioner in charge of Auditand a nominee, not below the rank of a Deputy Director from the regional/zonal unit of the DRI, and a nominee,not below the rank of Deputy Director from the Directorate of Valuation, if any.
5.3 The LRM Committee will meet once every month and will have the following functions :
(i) Review of trends in imports of major commodities and valuation with a view to identifying risk indicators
(ii) Decide on the interventions to be put in place at the local level, both for assessment and examination of goodsprior to clearance and for post clearance audit.

(iii) Review the results of interventions already in place and decide on their continuation/modification or discontinuance
etc.
(iv) Review the performance of the RMS and evaluate the results of the action taken on the basis of the RMS output.
(v) Any other matter which the LRM Committee considers important to be brought before the NRM Committee
5.4 Periodic reports, as may be prescribed by the RMD, will be sent to the RMD with the approval of the Commissioner
of Customs.
6. All field formations are requested to take note of the charter of functions of RMD and the creation of NRM/LRM
Committees for effective implementation of the Risk Management System. The above instructions may be brought to
the notice of all concerned.

Delay in Payment of Customs Duty Refunds - reg.
I am directed to state that various representations from importers, exporters, trade and industry associations have been
received in the Board regarding delay in payment of Customs Duty refunds and the hardships faced in obtaining refunds
from Customs field formations. Further, in a number of cases it has also come to the notice that the Courts and higher
judicial authorities have taken adverse note of the delay caused in refund of duty.
2. Refund of Customs Duty involves acknowledgement and processing of refund application for sanction or rejection of
refund in terms of Section 27 of the Customs Act, 1962 and the Customs Refund Application (Form) Regulations, 1985.
Further, Board have also issued instructions from time to time clarifying the doubts raised by field formations in dealing
with the refund claims. (Board’s circular No. 59/95-Cus dated 5.6.1995). Needless to say that if these procedures are
followed properly, normally refund applications should be disposed off within the interest free time limit of three months.
3. However, it is noticed that the aspect of timely refund of Customs Duty has not been given due importance by the
field formations. Therefore, Board desires that in order to ensure expeditious disposal of Customs Duty refund
applications and to enhance transparency in refund disbursement as well as bring alertness among the officers, the
following procedure should be followed :
4.1. System for receipt and acknowledgement of all Customs Duty refund applications : All refund applications
made by any person under Section 27 of the Customs Act, whether by post or courier or personal delivery, shall
be received by the department and a simple receipt, for having received the application that is said to have been
filed as ‘refund application’ shall be issued immediately. At this stage the receipt should make it clear that the
application has not been scrutinized for its completeness. These applications are required to be scrutinized for
their completeness within ten working days of their receipt, for giving acknowledgement by the proper officer as
per the Customs Refund Application (Form) Regulations, 1995. Hence, if any deficiency is found in the application
or any document is required by the department, the same shall be informed at this stage of initial scrutiny itself
within ten working days of the initial receipt. This will avoid any chance for raising repeated queries to the applicant,
in a piece-meal manner and bring certainty in dealing with refund applications.
4.2. Processing of refund applications and their disposal : Application of refund found to be complete in all respects
by Customs, after scrutiny as above, shall be processed on ‘first-come-first served’ basis so as to decide whether
the whole or any part of the duty and interest paid by the applicant is refundable. If refund is due in such case,
an order for refund is required to be passed in terms of Sub-Section (2) to Section 27 or where the claim for
refund is found liable to be rejected, as the case may be, a speaking order shall be passed giving complete
reasons for the order. Further, in respect of the provisions of unjust enrichment, the order should indicate that
this aspect has been examined based on the guidelines, if any, applicable; the order should also contain the findings
of adjudicating authority on the documents produced in support of the claim and the basis for determining the
amount as either refundable to the claimant or payable to the Consumer Welfare Fund or the claim not being
admissible.

4.3. Issue of Cheque : Where the refund application has been admitted, whether in part or in full, and claimant is
eligible for refund, the Deputy/Assistant Commissioner of Customs may ensure that payment is made to the party
within 3 days of the order passed after due audit, if any. In all such cases refund of amount shall be paid to
the applicant by a cheque on the authorised bank with which the sanctioning authority maintains account. After
the cheque has been signed, it shall either be delivered to the claimant or his authorised representative personally
when he next calls for it or sent to him by Registered Post ‘Acknowledgement Due’ at Government cost, on the
basis of pre-receipt already obtained from the claimant.
4.4. Audit system : Existing instructions on audit scrutiny of refunds shall continue. Accordingly, all applications
involving a refund of duty and/or interest of Rs. 5 lakhs or more shall be subjected to pre-audit as per the existing
practice. The applications of refund of amount below Rs. 50,000/- may be post-audited on the basis of the random
selection by Deputy/Assistant Commissioner (Audit). The selection can be made in such a way that 25 per cent
of the refund applications are post-audited. The applications of refund for amount between Rs. 50,000/- and Rs.
5 lakhs should be compulsorily post audited. This audit system has been prescribed with a view to check improper
sanction and payment of refunds. However, this does not dispense with the verification of the refund vouchers
and the re-conciliation of refunds, which shall continue to be done by the Chief Account Officers. However, it
may be ensured that where pre-audit is involved the action is completed at the earliest so that the disposal of
refund applications is not unduly delayed.
5. CVC’s instructions : Your attention is also invited to the instructions issued by the Central Vigilance Commission
(CVC) under Section 8(1)(h) of the CVC Act, 2003 to bring about greater transparency and accountability in the
discharge of regulatory, enforcement and other public dealings of the Government organisations vide their Circular
No.40/11/06 dated 22.11.2006. (Refer CVC website http://www.cvc.nic.in under ‘Improving Vigilance administration
by leveraging technology). These instructions, interalia, require that status of individual applications/matters should
be made available on the organisation’s website and should be updated from time to time so that the applicants
remain duly informed about the status of their applications. It is further stated that the manual records maintained
presently for various purposes may continue.
6.1. System of maintaining online database on Customs Duty refunds : In pursuance of the instructions of CVC,
all Commissioners of Customs shall establish a mechanism for maintenance of a comprehensive database in
their respective website, indicating the receipt, acknowledgement, action taken for disposal (either payment or
rejection) of refund applications and those pending at the end of the month. This shall be implemented with in
a period of three months time and a report of the same may be sent to the Board and DG (Inspection).
The details of refund application such as name of the claimant, file number, date of application, amount of refund
claimed, date of its acknowledgement shall be indicated in chronological order by the date of its receipt. The
applications may be serially numbered for each year and shall be shown in a single list indicating their respective
status distinctly. The illustrative status that could be mentioned for easy understanding of any applicant may include
the following : (i) refund application received but pending for scrutiny and acknowledgement (ii)(a) refund application
acknowledged for its completeness (ii)(b) refund application found incomplete and returned for rectification of
deficiency (iii)(a) refund application rejected by passing a speaking order (iii)(b) refund application sanctioned,
pending verification by audit (iv) cheques issued for refunds sanctioned and paid to applicant/credited to consumer
welfare fund. This is not exhaustive and if any other stage of processing of refund application is involved the
same may be indicated. An abstract at the end of the month about the total number of refund applications received,
acknowledged, disposed and pending may also be indicated.

This online data base would enable any person who had applied for refund with Customs, to check the status
of his refund application by reference to the date of his refund application having been received by Customs.
This data will be accessible to the trade and public as well as by all Customs officers to enhance transparency.
Further, the status of individual applications for refund of Customs Duty shall be updated from time to time, at
least daily, so that the applicants remain duly informed about the status of their applications. The data may be
allowed for display in the website for three months period from the date of its final disposal and there after it
can be moved to the history data base.
7.1. Monitoring Mechanism : Chief Commissioners/Directorate General of Inspection (DGI) is requested to review
the position of refunds in their respective zones/select zones, to check on the timely sanction of refund applications.
If any refund application is pending for long period, the reasons for the same may be identified by the concerned
Chief Commissioner and action initiated for their disposal by reference to the concerned Commissionerate. DGI
may also access the data base of such refund applications and maintain the data in respect of those refund
applications pending for long period and action taken thereon, for reporting to the Board.
8. The above instructions are being issued so that an administrative arrangement is made on a permanent basis
to deal with refund of Customs Duty, an important aspect of tax administration which needs to be given due
importance in view of the prompt disposal as per legal provisions and their revenue implications. Accordingly, the
Commissioners of Customs and Chief Commissioners of Customs concerned may ensure for proper implementation
of these instructions of the Board.
9. A suitable Public Notice and Standing Order may be issued for the guidance of the trade and staff. Difficulties
faced, if any, in implementation of the Circular may be brought to the notice of the Board at an early date.

G.S.R. (E).- In exercise of the powers conferred by Sub-Section (1) of Section 5A of the Central Excise Act, 1944
(1 of 1944), the Central Government, on being satisfied that it is necessary in the public interest so to do, hereby makes
the following further amendments in the Notification of the Government of India in the Ministry of Finance (Department
of Revenue), No. 64/95-Central Excise, dated the 16th March, 1995 which was published in the Gazette of India,
Extraordinary, vide number G.S.R. 256(E), dated the 16th March, 1995, namely :-
In the said Notification, in the Table, after S. No. 24 and the entries relating thereto, the following S. No. and entries
shall be inserted, namely :-

“25. Machinery, equipment, instruments, components, If,-
spares, jigs, fixtures, dies, tools, accessories, (i) supplied to the Programme LR-SAM under the
computer software, raw materials and consumables Ministry of Defence; and
required for the Long Range Surface to Air Missile
(LR-SAM) Programme of Ministry of Defence (ii) before clearance of the said goods, a certificate
from the Programme Director, Programme LR-SAM
to the effect that such goods are intended for the
said Programme LR-SAM, is produced to the
proper officer.
Explanation. – Nothing contained in this exemption shall
have effect on or after the 31st day of May, 2011.”
