The purpose of this Weekly Circular is to inform Councillors of a development application which seeks consent for a retaining wall at 45 NARELLAN ROAD MOSS VALE. The owner of the property is an employee of Council. Site Description The site is known as Lot 134 DP 1232222, being 45 NARELLAN ROAD MOSS VALE (Attachment 1). The subject site is located within the Throsby Views Estate and a Dwelling House has been constructed on the lot. Proposed Development On 15 November 2019, DA 20/0594 was lodged with Council seeking consent for a retaining wall on the lot, required to stabilise excavation which was carried out for the purpose of constructing the existing Dwelling House on the site. A site plan of the proposal can be found at Attachment 2. Permissibility The site is zoned R2 under the Wingecarribee Local Environmental Plan 2010 and in this zone, a retaining wall is permissible with development consent. SUBJECT: INFORMATION AND EDUCATION FACILITY (REGIONAL ART GALLERY)

The purpose of this Weekly Circular is to inform Councillors of a development
application which seeks consent for an Information and Education Facility (Regional
Art Gallery) at Retford Park Old South Road Bowral.
Site Description.
The site is legally described as Lot 221 DP 1206897 and is more commonly referred
to and known as Retford Park, a historic Southern highlands homestead and garden,
originally built for the Hordern Family, but long held in the ownership of Mr James
Fairfax. The property is now owned by the National Trust. Lot 221 is approximately
33.79 hectares and is the residual land from a three lot subdivision of the original
Retford Park holding. It now accommodates the Retford Park home and gardens and
is accessed off Old South Road via the original driveway along the sites northern
boundary.
The land to both the east and to the west of Retford Park has been developed into
residential housing.
The land adjoins part of the open space network that extends along the northern
boundary of the East Bowral residential locality and includes the David Woods playing
fields.
Council has recently approved a Development Application (DA20/0272) for the
subdivision of Council owned public reserve in order to create a new road reservation
within which a new access road to the proposed gallery can be built. This road is
required to separate gallery traffic from other users of the Retford Park homestead. A
planning proposal has been resolved by Council to be submitted to the Department of
Planning, Industry & Environment to reclassify the allotment proposed for the roadway
as Operational Land.

Proposed Development.
The proposed development is for the establishment of a regional art gallery to be
known as the Southern Highlands Regional Gallery.
It will be established on the grounds of the Retford Park Estate through the renovation
and reuse of the original dairy building and vet clinic building. These buildings sit
approximately 150metres south east of the Retford Park home and generally outside
of the curtilage of the house and gardens which are orientated more north and east.
Whereas the main house and gardens have been immaculately maintained and in use,
these buildings have been neglected in recent years and currently have no meaningful
usage.
The Southern Highlands Regional Gallery at Retford Park is envisaged as a state-of-
the-art cultural facility with four key objectives:
1. Activation of the site through the provision of a unique cultural offering and
visitor experience;
2. Adaptive re-use and rejuvenation of an important piece of Bowral’s cultural
heritage providing intergenerational benefits for the people of the Southern
Highlands and NSW more broadly;
3. Provision of facilities that enable travelling art collections of world class quality
to tour the Southern Highlands;
4. To create a financially sustainable model for the continued success of a
Regional Gallery on the site.
The Regional Gallery will comprise three main components that are summarised as
follows:
Gallery and Entry Pavilion
The gallery will occupy space within what was the original dairy building. It will be
complemented by a new building that will provide gallery entry and amenities that will
allow for efficient and secure movement between the car park and the gallery. The
design of this building also provides for an upper level office area that can cater for
administrative functions.
The combination of the new building and the existing relationship between the dairy
building and the vet clinic building, will create a well-defined courtyard allowing for
easy flow of people into and out of the gallery.

The adaptive re-use of the dairy building will provide for four (4) exhibition/gallery
rooms for art display.
A fifth room is provided as a museum space, general storage that could also be used
in the future for an artist-in-residence and/ or multipurpose space for further exhibition
space, education space, office or storage.
An Operational Plan for the gallery has been prepared. This plan covers issues such
as purpose, governance and finance, staffing numbers, exhibition programs,
education and public programs, likely visitation numbers, operating hours and food
and beverage (café).
Café.
The café will occupy the remodelled vet clinic building. It will have a small kitchen
area, servery and cool store with an internal floor space area for approximately 30
seats, with additional outdoor seating capacity.
It is intended that the café will operate as an ancillary feature of the gallery, open only
during the gallery opening times or in support of occasional special functions hosted
by the gallery. These could include gallery fund raising events or exhibition openings.
The café is an important component of the financial viability model for the Gallery as
a whole.
Access and On-site Parking.
Vehicular access to the Gallery will be via a proposed new public road, to be
constructed across Council public recreation reserve that adjoins the site along its
southern boundary.
The new road will link to the existing public road system at the intersection of Rowland
Road and Jonathon Street. The new road will form the fourth leg at what is currently
a T intersection. The issues of traffic generation, traffic safety and on-site car parking
are all covered by the report prepared by Varga traffic.
A total number of thirty three (33) car parking spaces are provided, two of which are
accessible spaces in close proximity to the gallery entrance. There is a proposed bus
turning facility and bus parking.
Other Works
To support the proposed development site infrastructure will be carried out and
includes:
• Site landscaping including both street removal of nominated specimens and
replacement plantings of a type sympathetic to and in keeping with the heritage

nature of the site and existing gardens. Works will create a landscape approach
to the Gallery, a northern courtyard and a southern sculpture garden;
• A 30kW Solar array to the north east, but out of site of the gallery;
• 70,000 litre rainwater tank to the south west of the Gallery;
• Mechanical chiller plant that assists with regulation of temperature within the
gallery building;
• Relocation of an existing timber shed to be retained and used for storage of
landscape supplies, tools and machinery;
• New and repaired timber fencing where appropriate.

Approval
Should the application be approved it would be subject to a deferred commencement
approval such that the approval would not become operational until such time as a
legal access road is approved to provide access to the proposed Gallery across
Council public recreation reserve that adjoins the site along its southern boundary.
Permissibility.
The site is zoned E3 Environmental Management Zone under Wingecarribee Local
Environmental Plan 2010. The proposed use is permissible under the zoning
Assessment Timeline.
The application has been notified to the public from 20/11/2019 to 20/12/2019 and
referred to appropriate Government agencies and internal Council Departments for
comments.
The application shall be determined under delegated authority, unless it is requested
by a Councillor that the application be determined by Council.

SUBJECT: BRIARS INN & LODGE – 563-645 MOSS VALE ROAD BURRADOO NSW 2576

The purpose of this Weekly Circular is to inform Councillors of a development application
which seeks consent for Tourist and Visitor Accommodation – Alterations and additions
Site Description.
The site is known as Lot 2 DP 1176315, Briars Inn & Lodge 563-645 Moss Vale Road
Burradoo. The site is on the western side of Moss Vale Road with the Bong Bong Common
on the southern boundary.
The site is rectangular in shape with a frontage to Moss Vale Road of approximately 164
metres. The total site area is 3.79 Hectares..
A heritage Impact report has been provided to Council that gives a detailed history of the site.
The site has had numerous uses over the years. The original two storey Briars Inn building
was originally built as the Royal Oak Inn in 1855 by Charles Throsby to replace an earlier
establishment on the site of the Bong Bong Common. The Royal Oak Inn was later converted
to a private residence in 1874 by Charles Throsby’s 6th son Patrick Throsby and renamed “The
Briars”. Patrick Throsby moved from The Briars to Throsby Park. The building was known to
operate as an unsuccessful preparatory school for boys, used as a private residence and then
left in a dilapidated state till the 1940’s. It was converted into three flats and some significant
changes occurred to the building, including relocating the kitchen to the rear of the building
and a portico added. By 1958 The Briars was purchased by the Sydney Church of England
Grammar School (SCEGGS), and the building was altered by the school and used for the
teaching of home science, with around 15 boarders living upstairs.
By 1976 the building was purchased by the Myerson family, who by 1979 had opened a bistro
in the building and opened it as an Inn by December that year. The Lodge component of the
site was opened in 1988, and in 1995 eight (8) country houses were built on the land west of
the lodge and sold individually. From then till this day, the “Briars Inn” has continually
operated.

Background
On 1 September 2018 a fire broke out in the kitchen area of “The Briars Inn” which resulted in
internal damage to building elements and the kitchen facilities. The fire also caused damage

to other areas of the building including parts of the toilets and dining area. The premises have
been closed since this time.
On 29 March 2019 DA 19/1421 was submitted to Council by the owner to replace the kitchen
building elements.
The application to Council did not include information in regard to the fit-out of the kitchen
area. Additional information was sought from the applicant in relation to the total refit of the
premises to comply with the Building Code of Australia, Standard 3.2.3 of the Australian and
New Zealand Food Standards Code under the Food Act 2003 and AS 4674-2004 for the
design, Construction and Fit out of Food Premises.
Council also requested that a BCA Audit of the existing building be undertaken for the purpose
of preparing a report to provide an assessment of the existing building for general compliance
with the fire safety and egress requirements of Sections C, D and E of the Building Code of
Australia.
A further report was requested that a DDA Access audit be undertaken and provide a copy of
the report to Council.
The applicant would not provide the required additional information and the application was
subsequently refused.
Proposed Development.
Development Application 20/0534 seeks consent for internal works to the dining and lounge
areas including removal of internal walls and a chimney to open up the dining areas for a
higher capacity of guests and demolition and works to one wall in the lounge area for a more
open feel to the room. There is a proposed addition to the rear of the building including new
toilets (to comply with table F2.3 of the NCC), a back of house entry and re arrangement of
external storage to improve the visual aspect of the rear of the building from Moss Vale Road.
The proposed works both internal and external have been inspected on-site with Council
officers and Council’s Heritage Advisor during the design stage and the preparation of plans.
The application that is now under assessment has addressed all of the previous issues raised
by Council in relation to a fire upgrade of the premises in relation to compliance with the
Building Code of Australia, Standard 3.2.3 of the Australian and New Zealand Food Standards
Code under the Food Act 2003 and AS 4674-2004 for the design, Construction and Fit out of
Food Premises and the provision of access for disabled persons.
The new application has also addressed the accumulation of outbuildings on the southern side
of the inn and will remove some of the visual intrusions from this aspect of the building from
Moss Vale Road.

development consent.

appropriate Government agencies and internal Council Departments for comments.

Councillor that the application be determined by Council.

The purpose of this Weekly Circular is to inform Councillors of a development application which seeks consent to retain and continue use of an unauthorised advertising structure and advertisement at 6/310-318 BONG BONG STREET BOWRAL. Site Description The site is known as Lot 6 SP 41585, being 6/310-318 BONG BONG STREET BOWRAL (Attachment 1). It is a developed commercial lot on the eastern side of Bong Bong Street in Bowral’s town centre. Surrounding properties are generally used for commercial premises purposes, along with Council’s Car Park occupying multiple lots immediately to the land’s east. Proposed Development On 7 November 2019, 20/0587 was lodged with Council seeking consent to retain and continue use of an unlawfully erected advertising structure and advertisement. The application is accompanied by visual representations of the proposed development, which are reproduced at Attachment 2. Permissibility The site is zoned B2 Local Centre under the Wingecarribee Local Environmental Plan 2010. Development for the purposes of advertising structures and advertisements is permitted with development consent in Zone B2. However, Council’s applicable Bowral Town Plan Development Control Plan (BDCP) specifies signage may only be erected and displayed on the land occupied by the development or activity to which the signage relates. The application is accompanied by a statement of environmental effects that indicates, “The proposed development involves the retention of an existing advertising structure that displays advertising for various local businesses, provides information in relation to the activities of various community groups, including Wingecarribee Shire Council and act generally as a community notice board”. The proposed development is also subject to various other requirements, restrictions and guidelines specified by applicable environmental planning instruments and BDCP. Assessment Timeline The application has been notified to adjoining and adjacent landowners with the notification period concluding on 6 December 2019. At the time of drafting, no submissions from the public had been received. The application shall be determined under delegated authority, unless it is requested by a Councillor that the application be determined by full Council.
