WAS HELD ON 04-04-2014 AT 03.30PM IN DIRECTOR'S OFFICE
The 91h ERC meeting chaired by Director, AIIMS, and Bhubaneswar was held on 04-04-
2014 at 03.30pm in the Director's chamber, to discuss and finalize the deviation in the package-Ill
and package-IV. The following members of ERC attended the meeting:-

The outcome of the meeting after due deliberation are as follows
A. CIVIL WORKS
1. Regarding ACP cladding with structure in 03nos new entry gates in the Hospital, Medical
college and Auditorium {Package-IV)
Earl ier the Design of gates at above locations are of simple type without any canopy. But
keeping in view the aesthetics of the institute of national repute, the committee accepted
the proposal of entry gates at above locations redesigned by CES. Accordingly the
quantity of MS work will increase and ACP work will be extra item as there is no provision
of ACP work in the original BOQ. The quantity of ACP cladding as per drawing issued by
DPR consultant is as follows:
Hospital Gate:
IVORY ACP sheet= 700sqm.
Metallic Bunch ACP sheet= 270 sqm.
Medical College Gate:,
IVORY ACP sheet= 700sqm.
Metallic Bunch ACP sheet= 270 sqm.
Auditorium Gate
IVORY ACP sheet= 350sqm.
Metallic Bunch ACP sheet= 135 sqm.
Total area of IVORY ACP sheet is 1750 sqm @ Rs.3413.70 per sqm, total works out toRs.
59,73,975.00.
Total area of Metallic Bunch ACP sheet= 675 sqm. @ Rs.4399.95 per sqm, total works out
to Rs. 29,69,966.00

execution under Package-tV. Necessary extra item statement may be issued by
Superintending Engineer in prescribed format.
B. HORTICULTURE WORK
2. Providing and laying Carpet Grass around the main fountain in front of hospital building
(Package-IV).
It was decided in the presence of Joint Secretary during his visit before inauguration that
at least the sides of fountain made in front of Hospital and near Trauma centre should be
bedded with carpet grass to enhance the beauty and ambiance especially for inauguration
purpose. This proposal was got through by M/s Hospitech and accordingly the job was
assigned to M/s IVRCL (Responsible for external development and got executed on top
priority for inauguration of hospital) . As there is no item for carpet grassing, the same
became extra item. The rate analysis was made by M/s Hospitech, the Project Consultant
and checked by SPM, Project Cell and placed before the committee. The rate is Rs. 290.38
per Sqm., and total cost works out to be Rs. 4,64,608.00 for 1600sqm. of carpet grass area
and is approved by ERC as extra item and necessary extra item statement may be issued
by Superintending Engine.er in prescribed format.
C. ELECTRICAL WORKS
3. Providing cable tray (item no-8.2(a,b,c&d)) of Package-Ill
The matter was deliberated at length. During deliberation, Director and DDA expressed
their concern about the analysis of rates submitted by engineering department as per the
purchase invoice received from M/s JAKSON Ltd and suggested to receive the purchase
invoice of the said item for the previous quantity (BOQ quantity) in the recent years 2012
& 2013, so that a decision can be taken for the concurrence of the rates. But the analysis
tabled before ERC was made by M/S Hospitech based on present purchase in voice as per
the norms of contract condition. Not only that the engineering Dept. took part in the
discussion and explained to the committee that this hike of quantity submitted has been
concurred by CES who is responsible for design and change in BOQ. As per the rate
analysis the total cost implication are as follows:
(900mm width x 62.5 mm depth x 2.0 mm thickness)-Rs.2208.00x818mtr=Rs.1806144.00
(600 mm width x 62.5 mm depth x 2.0 mm thickness)-Rs.l762.00x234mtr=Rs.412308.00
(450 mm width x 50.0 mm depth x 2.0 mm thickness)-Rs.1078.00x311mtr=Rs.335258.00
(300 mm width x 50.0 mm depth x 2.0 mm thickness)-Rs.724x800mtr=Rs.579200.00
4. Providing down lights in main security guard room and LED lights in ACP canopy of main
gate. (Package-IV)
The matter was discussed in the meeting. As per the design of CES, the DPR consultant
the light fixtures are approved. The rate analysis received from M/s Hospitech as per the
norm was tabled before the committee. After due deliberation the committee approved
the rates of the items as follows.

a) 40WATI-RC380B PHILLIPS LED fittings and other accessories etc. as required @Rs.
14768.00 per piece. Total number of piece is 60 for three ga es. The cost comes out to be
Rs. 886080/=
b) BBS-170 LED down light fittings·and other accessories e c. as required for main gate
security guard room @Rs.3551.00 per piece. Total number of pieces required is 24 and
total amount comes out to be Rs. 85224.
c) Wiring for light with 2X4 sq. mm FR PVC insulated copper conductor single core cable in
surface/ recessed medium class PVC conduit along with 1 No 4 sq. mm FR PVC insulated
copper conductor single core cable for loop earthing as requ ired. @Rs.176.00 per meter.
Total length of wiring comes out to be 360m and the financial implication is Rs.63360.
The gth ERC meeting dated 04-04-2014 approved the above total works of Rs.13576123/=
as deviation and extra item and necessary sanction statement may be issued by
Superintending Engineer as per MoHFW guide line .

An Empowered Review Committee was constituted vide Ministry of Health & Family Welfare PMSSY division order No. Z-28016/11 /2012-SSH dated 20th May, 2013. The 10tn meeting of Empowered Review Committee was held on 18-07-2014 at AIIMS, Bhubaneswar under the chairmanship of Dr. A. K. Mahapatra, Director, AIIMS, Bhubaneswar.
The meeting was attended by following members:-
1. Shri Ravindra Pattar, Financial Advisor, AIIMS, Bhubaneswar. 2. Dr; B. B Mishra, Dy. Director (Admin) , AIIMS, Bhubaneswar. 3. Shri Chitaranjan Nanda, Superintending Engineer, AIIMS, Bhubaneswar. 4. Shri P. K. Mahallik, Executive Engineer (Electrical), AIIMS, Bhubaneswar. 5. Shri Biswajit Das Sr. Project Manager (Civil) , AIIMS, Bhubaneswar (Special Invitee).
In this ERC Meeting the issue of deviation/variation in HVAC work was discussed. It is re levant to mention that in order to review contract conditions and suggest different options in relation with HVAC facil ities at Six New AIIMS, MOH&FW had constituted a Committee vides Order No. Z-28016/12/2010-SSH dated 13.11 .2013.The Committee comprised of Director, AIIMS Bhopai-Convener; Director, AIIMS, Rishikesh -Co-Convener, Director, AI IMS, - Jodhpur - Member; SEs All Six AIIMS - Member, Legal Consultant (P SSY) - Member. The committee has submitter the recommendations contained in the Minutes of ~eetmg da ed 03.12.2013.
Meanwhile, in this connection MOH&FW vide it's letter No. 28016/12/2010-SSH dated 9th April. 2014 has issued that the respective AIIMS, sites to deal with the variation cases HVAC contracts in the ERC 1
constituted at AIIMS, as per the decision taken on the matter under Agenda No. 40.2.7.4 in 40th Meeting of PMC held on 26th March, 2014 and following decision was circulated through MOM vide No. Z-28016/130/2013-SSH dated 28th March, 2014 .
"It was decided that the HVAC matters were site speci fic in terms of their nature, execution , variation and exigencies of operational requirements, and as such, the cases were to be decided by the respective ERCs headed by Directors, on case basis, considering the recommendations of the Three Director's Committee dated 22nd December, 2013."
As per contract conditions the following issues are relevant which were also agreed by all the SEs of Six AIIMs as per Minutes of the Meeting regarding interpretation of contract clause for HVAC Works at Six New AIIMS under PMSSY held on 3rd Dec. 2013.
.. (a) As per NIT of Package - II it is a percentage rate tender under two bll!.d system (Technical &
Financial) . (b) The preamble of the contract specifies that the contract basis is percentage rate. It fu rther
mentioned that the rates should include cost of materials, labours, plants and equipment, taxes,

duties and all necessary apparent services required for complete execution and commissioning in accordance with relevant drawings and specifications. The Engineer-in-charge decision of interpretation of bill of quantities and its preamble /shall be final and binding on the Contractor.
(c) f:l.s per Preamble to bill of quantities, it is specified that these Preambles apply to all the sections of the bill of Quantities which include HVAC subhead also.
(d) Under contract Clause 16 specific to HVAC wok, term 'Turnkey' has been used specifically for the following : (i) · Detailed design to ensure maintenance of specified conditions. (ii) Preparation/approval of detailed designs. (iii) Fabrication/supply of required equipments/ fabricated items/ Materials after factory testing . (iv) Supply/ erection/ testing/ commissioning/ coordination with other execution agencies. (v) Subsequent comprehensive operation and maintenance for 5 years. (One year within
warrantee & 4year comprehensive). (e) Vide clause 32 of the contract indicates following:
"The BOO quantities are estimated quantities. The work will be executed as per approved drawings based on actual site requirements . The actual quantities may differ from estimated BOO quantities. The work will be executed as per actual quantities required with plus or minus deviation as permitted under conditions of the contract. For technical reasons certain items may not be required to be executed."
This clause clearly indicates that the actual work to be executed as per approved drawing and design and difference of quantities between BOO and actual will be considered as per provision of contract. This implies that the provision of Payment to be contractor as per relevant contract clause for deviation is to be followed.
(f) Vide Clause 34 of the contract following is mentioned: "This is a turnkey job. Even if certain items are not included within the BOO, but are required for comprehensive completion of the job, the AC contractor will do the same without any extra cost" The use of word 'turnkey' in this contract has created ambiguity. When the work is to be conducted based on actual site requirement than that rider in the limit of payment cannot be pre-defined. This clause indicates that the Contractor has to design the system and has to make it functional. In the process if any item is required, but not considered in the BOO, the same shall be provided by contractor without any extra cost i.e .. no extra item (i .e. items not covered in BOO, but required to complete that work) shall be payable to the Contractor.
It is also discussed that -The Notice Inviting Bid issued by the Government of India, Ministry of Health and Family Welfare (GOI) categorically states that the technical and financial bids were invited on "percentage rate basis" from the eligible contractors. The contractors have also placed their bids in the percentage rate method and after scrutinizing the bids, the candidate L 1 bid was awarded the contract. Therefore, it is apparent that both the parties have mutually agreed on percentage rate method before executing the said agreement.

Further, the preamble of bill of quantities specifically states that the contract basis is percentage rate method and the said rates shall include cost of materials, labours, plants and equipment taxes, duties, and all necessary apparent services required for complete execution, and commission in accordance with relevant drawings and specifications. It also states that preamble of bill of Quantities shall be final and binding on the contractor. The HVAC work as specified in clause 16 enumerates the scope of the work on "turnkey basis" i.e. inclusive of all the activities mentioned in the clause 16. The term "turnkey basis" is limited to the scope of the HVAC work· and it should not have any bearing on the final payment to the contractor, which shall strictly be in accordance to the percentage rate basis as agreed by the both the parties. Keeping 1n view the above facts, it is unanimously decided in the ERC meeting that HVAC work is percentage rate contract basis and deviation I variation in cost q_s per actual will be allowed to contractor as per Clause - 32 of preamble to BOO and as per clause - 12 of GCC. However, no extra item will be

The matter was deliberated at length. During discussion, the Director and FA expressed their
co ncern of not agreeing with t he amount which is Rs. 15,16,595/- and suggested to send the
case to MOH&FW to approve the amount which is due to gross negligence of DPR wh il e making
the BOQ.

Decision taken
At the outset SE placed before the Committee and intimated the committee about t he
essentia lity of t he execution of the said item. Also SE informed with papers about the DPR & PC
Comments.
SI.No-2, 3, 4, 5, 6, 8, 9, 10 & 11 of the agenda was discussed in the meeting. During discussion,
Director and Financial Advisor expressed t heir concern and gave opinion to send it to M oH&FW
for clearance/ approval of the raised quantity and rate due to gross negligence of DPR while
making design/ BOQ.
Regarding SI.No. 07, 12, 13, 14, 15 & 16 of the agenda was also discussed in t he meet ing, found
genuine and hence the committee unanimously approve the raised quantity I It em and t he

At the outset SE placed the case before Committee and intimated the committee about the
essen ti ality of the execution of the said item. Also SE informed with papers about the DPR & PC

SI.No. 17, 18, 19 & 20 of the agenda was discussed in the meeting. During discussion, Di rector
and Financial Advisor expressed their concern and gave opinion to se nd it to MoH & FW for
clearance/ approval of the raised quantity rate due to gross negligence of DPR while making
design/ BOQ.
Package- IV (Revised Extra Item/ ACP Cladding)
Decision taken
S.No. 21, It was discussed and decided in the ERC that as the quantity and rate has already
approved in the last ERC it is to be followed and the job will be executed as per the quantity
approved in ERC without any further change .

The outcome of the meeting after due deliberation are as follows-
PACKAGE· I (Extra Item ) Decision taken
Regarding Sl. No. 1 of the agenda for providing and fixing of fixtures for Aluminium Doors and Windows of package - I. SE placed the proposal in front of the committee and intimated the essentiality of the execution of the said item with comments of DPR and PC. As per BOQ it is mentioned that the aluminium fixture will be paid separately. Hence it is an essential item without which windows cannot be opened . Hence the committee approved it. However it should be paid on actual basis. The financial implications are Rs. 13, 85,852/-.
Regarding, Sl. No. 2, 3, 4, 5, 6, 7 of the agenda for Extra for shuttering for column, Fin wall shuttering, staircase shuttering for height more than above 4.2 mtr. and extra for lift for concrete for above V levels heights for head rooms, lift machine rooms parapet in Package-!. Hence the committee approved the raised quantity/ Item and financial implications are Rs 5, 56,360.00.
PACKAGE· II (Deviation Items) Decision taken
Regarding Item No. 8, 9 of the agenda for Supply and lying of 2CX1 .5 sqmm FRLS Unarmoured cable and 25mm MS rigid conduit to suit the ISMS cable of package -II. SE placed the proposal before the committee and intimated the committee about the essentiality of the execution of the said item, such as the temperature of AC of HVAC in patient room and other places cannot be controlled. But the FA expressed the concern that there is a huge variation quantity i.e more than 1000%. Based on the records available, it is not possible to ascertain as to why DPR experts did not anticipate the actual requirement even to suit the design and drawing of the plan. Hence, the committee observed that it may be due to faulty design and estimation clearly attributable to DPR experts. Hence, committee felt that the deviation in items may be due to the reasons which are beyond comprehensions the matter. Hence committee decided to refer the matter to the ministry.
Sl. No. 10 of the agenda was not discussed in the meeting since the quantity required is within the 30% of BOQ quantity.
SI.No. 11 , 12, 13 of the agenda was discussed and found genuine. Hence, the committee unanimously approved the raised quantity and the financial implication Rs 1, 19,75,790.00 came out of this .
Regarding SI.No.14 &15 of the agenda for CCTV system in Package- II .SE placed the proposal before committee and intimate the committee the essentiality of the execution of the said item with comments

of DPR and PC. But, The FA and DDA want to visit the site condition in order to ascertain the requirement and suggested to refer it to next ERC.
PACKAGE-Ill (Substituted item)
Decision taken
Regarding Sl No. 16, the substitute item was discussed at length and accepted by ERC as the above has been accepted/ directed earlier by Ministry. The financial implication was Rs 6,1 0,324.00.
Deviation Items
Decision taken
Regarding Sl No. 17, 18, 19, 20, 21, 22, 23 & 24, the matters related to the agenda no-16 was discussed and realised by ERC that the deviations came in the said sl no's are due to the change of item from 60KL to 2x15KL and hence accepted by ERC with financial implications Rs. 3,20,631.00 came out of this.
Regarding Sl No. 25 & 26, the quantity deviated at site as per drawing as less quantity was given in BOQ. This is due to the carelessness and theoretical attitude of DDPR during making BOQ. Hence, the ERC felt its necessity and approved the quantity with financial implications Rs. 58,132.00 came out of this.
Regarding Sl No. 31 , 32, 33 & 34 of the agenda of ERC for providing earth strips, the matter was again put up in ERC by SE, Where EE tried to convince the members of the ERC about the essentiality of the item. After due deliberation, eventually all members of the committee unanimously accepted the proposal and approved the quantity with financial implication Rs 16,36,233.00 came out of this .

Pipes and fittings with two coats of anti-corrosive bit mastic paint of approved quality : 65mm diameter pipe of external water supply i:1 Package- IV was also discussed and found genuine. SE placed·the proposal before the committee and intimated the essentiality of the execution of the said item with comments of DPR and PC. Director, FA and DDA took part in the discussion and the quantity of item and its financial implications Rs. 11,19,424.00 is approved in ERC after due deliberations.
