Waqf : retaining a property in
trust forever, and giving its
benefits/ proceeds away in
charity.
It is an act of worship that is
recommended and essential
for the society to promote.

‘Umar said: “O Messenger of Allah, I
acquired wealth from Khaybar that I have
never acquired something more precious
than it. What do you command me to do
with it?” He said, “If you wish, you can
retain the original property as an
endowment, and donate the proceeds, but
the original should not be sold, given away
or inherited.” (Ag)

The Prophet said: “When the son of
Adam dies, all his good deeds cease
except three: perpetual charity,
knowledge from which others may
benefit after him, and a righteous
child who will pray for him.” (M)

1. Purpose must be pleasing to Allah.
2. Donor has authority to dispose of his/her
wealth.
3. Property is not perishable by use, and would
continue to exist while people benefit from
it.
4. Property precisely designated, so it doesn’t
work to say, I will put one of my houses in a
trust.

5. If it is for an individual, s/he must be one who can
own, so may not be given to the dead or
animals…etc.
6. Effective immediately and not conditional except if
contingent upon death, because ‘Umar made a will
that if anything were to happen to him, then
Samagh – land he owned – would be given in
charity,” narrated Abu Dawood. This should be no
more than one-third of the inheritance, because it
has to be within the will (wasiyyah.)

لواقف ا - The Donor’s Conditionsشرط
It is obligatory to honor the conditions of
the one who made the endowment, as
long as it does not go against Sharia,
because the Prophet said: “The Muslims
are bound by their conditions, except
those conditions which make haram as
halal or halal as haram.”
And because „Umarmade an endowment
and stipulated certain conditions in it.

waqf shoulders a huge
trust, so he must fear Allah
regarding it.

Waqfs is infinitely binding, and it is not
permissible to annul or sell
Unless its benefits cease altogether. In
this case it is sold and the money
should be spent on a similar thing.
If it is not possible to spend it on
something exactly similar, then on
something close in nature.

If it is a masjid, and can no longer be
used, then the money should be spent
on another mosque.
If a waqf is set up to benefit a mosque
and produces more than is needed, it
is spent on another masjid. It is
permissible to give the excess to the
poor as well.
