While“Wethepeople”recognizethattheStateofOregonisaquasi-corporaGonandthattheCountyofWashingtonisan‘Agency’oftheStateofOregon,thepeoplearenotapartytothestateofStateConsGtuGon.(See;Padelford,Fay&Co.vs.TheMayorandAldermanoftheCityofSavannah,14Ga.438(1854)…“Butindeed,noprivatepersonhasarighttocomplain,bysuitinCourt,onthegroundofabreachoftheConsGtuGon.TheConsGtuGon,it istrue,isacompact(contract),butheisnotapartytoit.TheStatesareapartytoit…”(emphasisadded) Thereiscredibleevidencethatthepeoplearebeneficiaries.Iclaimthatbenefit.

Opera#ngIntroduc#on–Procedures:

Our/the Common LawGrand Jury shall have perpetual existence, and the Grand Jury, undernecessity, as sovereign people and AmericanNaGonals, is a jury of inquiry,whose duty is toreceivecomplaintsandaccusaGons,hearevidence, todetermineprobablecausethatacrimehasbeencommised,findbillsof indictmentwhereatrialoughttobehad,ortoreturna“nobill”.

The funcGonof theCommonLawGrand Jury isalso toprotect thepeoplewithinsaidcountyfromcorrupGoningovernmentortyrantsexceedingtheiroathofofficeorcommiungtreasonagainst their ‘compact’/ConsGtuGon (which invariably injures the people), to invesGgate anyneedfulmaser,includingbutnotlimitedtocomplaints,actsofcrimesincludingbutnotlimitedtoofficersandemployeesofso-calledgovernmentwithinsaidcountyandwithpowerto‘passdown’indictment(s)forapublicoffense,ortotryaquesGonoffact,and/ortogiveacorrecGve‘Order from theCommon LawGrand Jury/people’ to the officeholder for inappropriateness,violaGons,orotherwise,undernecessity.

Inanymannerthatthe/aCommonLawGrandJurysubsidesorisdisbanded,itshallalwaysremainwiththepeopletoacGvatesuchGrandJuryasthecasemaybe,intheinterestofjusGce,andifandwhenanycurrentCommonLawGrandJuryForeman,undernecessity,findsitnecessarytodisbandtheCommonLawGrandJury,heshallcauseaNoGceofthesametobepostedinandaroundthecommunity/city(s)andcounty,onbulleGnboardstherein,includingbutnotlimitedtocourthouses,communitybulleGnboardsandthelike,and/orcausethepublicaGonofthesameinnewspapersorotherwisewithinthecounty,togivesaidnoGceforatleastthreepublicaGonsaweekwithina30dayGmeperiod..



“TheCommonLawGrandJuryforTheCountyofWashington”shallconsistofTWELVE(12)peopletoTWENTYFIVE(25)people,asoriginallyreferencedbyKingJohnintheMagnaCarta,andmore,asneeded.

SaidpeoplefortheCommonLawGrandJury,shallbeselectedfromwithinthepeopleofthecounty,thosebeingready,willingandabletoasendtothebusinessoftheGrandJuryandthesametoserveasoneoftheGrandJuryforaGme,asneededorotherwise.

AnymemberoftheCommonLawGrandJurywhodiesorleavesthecounty,orinanyotherwayispreventedfromcarryingouttheduGesofCommonLawGrandJuror,orforwhateverreason,mayrelinquishhis/herposiGonasoneoftheCommonLawGrandJurybygivinga72hour/3daynoGceofintenttodeparttheCommonLawGrandJuryandtheCommonLawGrandJurysecretaryshallcommencethecontactandselecGonofanothertofillhisplaceandheshalllikewisebeswornintofilltheopeningasneeded.

EachmemberoftheGrandJury,beforebeingseated,mustbeswornin,andsuchoathshallbe:

“Idosolemnlyaffirmand/orswearthatI,__________________asoneofthepeoplewithinWashingtonCounty,inexerciseofmyrightandpower,willfaithfullyserveasoneoftheCommonLawGrandJury,andthatIwillfaithfullydischargetheduGesofbeingoneoftheCommonLawGrandJurors,accordingtothebestofmyability,forthepeaceandsafetywithintheCountyofWashington,andtofurthersecuretheLife,LibertyandHappinessofusall,undernecessity.”

WhentheGrandJuryiscalledtoorder,ifanyareabsentayerbeingsummoned,othersasmaybeneededwillbesummoned,withtheintenttosetfrom12to21GrandJurors,asthequorum,andintheeventthatfrom12to21cannotbeseatedforamaser,thenthosepresentwillconsGtutethequorumwithaminimumof12seated.

AlldecisionsoftheGrandJuryaredecidedbymajoritydecisionvoteofthosepresent.

AsestablishedinArGcle7oftheBillofRights,nodecisionofaCommonLawGrandJury,oraCommonLawCourtisreviewableinanycourtofthegovernment.

TheCommonLawGrandJuryshallhavethepower,andtheauthority,toinvesGgatethefollowing:



1.Anygovernmenttransgressionagainstanyoneinanyrespect,includingthefailureofourelectedrepresentaGvestohonortheirOathofOffice.2.AnygovernmentbreakingofarGclesofpeaceorsecurity.3.Anydisputeregardinganyonewhohasbeendisseized!(unconsGtuGonallydetained)orremoved,bythegovernmentwithoutalegalsentenceofhispeers,fromhislands,castles(Home),liberGesorlawfulright.

4.AnymisapplicaGonofstatute,knownas‘ConsGtuGonalimpermissibleapplicaGonoflaw,statute,rule,codeorotherwise.5.Anymaserofanyissue,violaGonorinjuryagainstthepeoplebyde-factogovernment.6Anymaser,violaGonofcrime,orharmdonetoanyone’sLife,LibertyorPropertybyanothermanorwoman.

Inastunning6to3decisionJusGceAntoninScalia,wriGngforthemajority,confirmedthattheAmerican grand jury is neither part of the judicial, execuGve nor legislaGve branches ofgovernment,but insteadbelongs to thepeople. It is ineffecta fourthbranchofgovernment"governed" and administered to directly by and on behalf of the American people, and itsauthority emanates from theBill of Rights. The following are extracts from theCourt’s 1992decision.

1.ItisaconsGtuGonalfixtureinitsownright.2.TheFiyhAmendmentdemandsatradiGonalfuncGonal"commonlaw"grandjury.3.TheGrandJuryisaninsGtuGonseparatefromthecourts.4.ThecourtsdonotpresideoverthefuncGoningofthe"commonlaw"grandjury.5.Thecourtshaveno"supervisory"judicialauthorityoverthe"commonlaw"grandjury.6.TheGrandJurybelongstonobranchoftheinsGtuGonalgovernment,servingasakindofbufferorrefereebetweentheGovernmentandthepeople”.7.TheGrandJury'sfuncGonalindependencefromthejudicialbranchisevidentbothinthescopeofitspowertoinvesGgatecriminalwrongdoing,andinthemannerinwhichthatpowerisexercised.8.TheGrandJurycaninvesGgatemerelyonsuspicionthatthelawisbeingviolated,orevenbecauseitwantsassurancethatitisnot.9.TheGrandJuryneednotidenGfytheoffenderitsuspects,oreventheprecisenatureoftheoffenseitisinvesGgaGng.10.TheGrandJuryrequiresnoauthorizaGonfromitsconsGtuGngcourttoiniGateaninvesGgaGon,ortoseekanindictment.11.TheGrandJuryoperateswithouttheinterferenceofapresidingjudge.12.TheGrandJuryswearsinitsownwitnessesanddeliberatesintotalsecrecy.13.TheGrandJuryremains"freetopursueitsinvesGgaGonsunhinderedbyexternalinfluenceorsupervisionsolongasitdoesnottrenchuponthelegiGmaterightsofanywitnesscalledbeforeit.”14.TheFiyhAmendment's"consGtuGonalguarantee”presupposesaninvesGgaGvebody'acGngindependentlyofeitherprosecuGngasorneyorjudge.



15.TheDoubleJeopardyClauseoftheFiyhAmendmentdoesnotbaragrandjuryfromreturninganindictmentwhenapriorgrandjuryhasrefusedtodoso.16.TheSixthAmendmentrighttocounseldoesnotasachwhenanindividualissummonedtoappearbeforeagrandjury,evenifheisthesubjectoftheinvesGgaGon.17.ItwouldruncountertothewholehistoryofthegrandjuryinsGtuGon"topermitanindictmenttobechallengedonthegroundthattherewasincompetentorinadequateevidencebeforethegrandjury.”

Pursuanttotheinstruc#onssetforthintheMagnaCarta,fourofthemembersmustbeshownthatbecauseofthegovernment:

1.Atransgressionhasoccurredagainstanyoneinanyrespect,or2.SomeoneofthearGclesofpeaceorsecurityhasbeenbroken3.Thefourmembersmustshowtothegovernmentthegovernment'serror.4.Thefourmembersmustaskthegovernmenttoamendthaterrorwithoutdelay.5.Ifthegovernmentdoesnotamendtheerrorwithin40daysayerbeingshowntheerror,thenthefourmembersshallreferthemasertotheremainderofthegrandjury.6.Thegrandjurymayissuedistraintandoppressthegovernmentineverywayintheirpower,namely,bytakingthehomes,lands,possessions,andanywayelsetheycanunGlamendsshallhavebeenmadeaccordingtothesolejudgmentofthegrandjury.

Thegrandjurymaynotimprisonorexecuteanygovernmentpersonnelortheirchildren.ThegrandjurymaydeliveritsfindingstotheSuperiorCommonLawCourtortheStateforfurtheracGoninanymaser.

Thegovernmentisprohibitedfromdoinganythingtodiminishtheeffectofthe‘CommonLawgrandjury.’

IfthegovernmentdoesprohibitordiminishtheeffecGvenessofthegrandjury,itshallbevainandinvalidandmaynotbeusedinanylaterproceedingbythegovernmentoranyoneelse.

SUMMARY:TheCommonLawGrandJuryisanunalienablerightofthepeople.Itisa/thefourthbranchofgovernmentcreatedandadministereddirectlybyandonbehalfofthepeopleintheirsovereigncapacity. It is separate from the courts funcGoning by its "ownwill" above the governmentservingasarefereebetweentheGovernmentandthepeople.”ItisaninvesGgaGvebodyacGngindependentlywithunhinderedpowertoinvesGgateandindictcriminalwrongdoingmerelyonsuspicion that the law is being violated,or evenbecause itwants assurance that it is not. Itneed not idenGfy the offender it suspects, or even the precise nature of the offense it isinvesGgaGng. It swears in its own witnesses, deliberates in total secrecy and its indictmentcannotbechallenged.InshortithasadutytoseekoutinjusGceandrecGfyit.
