का.आ. 1565(अ).—भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मं ालय की अिधसूचना सं. 3105 (अ), तारीख 16 नवम्बर, 2015 ारा भारत के राजप , असाधारण म, उन सभी ि य से, िजनके उससे भािवत होने की संभावना थी, उस तारीख से, िजसको उस राजप की ितयां, िजसम यह अिधसूचना अंतिवर् ह,ै जनता को उपलब्ध करा दी गई थी, साठ िदन की अविध के भीतर आक्षेप और सुझाव आमंि त करते हुए एक ारुप अिधसूचना कािशत की गई थी;

और, उ ारुप अिधसूचना म अंतिवर् राजप की ितयां तारीख 16 नवम्बर, 2015 को, जनता को उपलब्ध कराई गई थी;

और, उ ारुप अिधसूचना के उ र म सभी ि य और पणधािरय से ा आक्षेप और सुझाव पर केन् ीय सरकार ारा सम्यक रुप से िवचार िकया गया;

और, सागरे र वन्यजीव अभयारण्य (हाल ही म नाम बदलकर यशवंतराव चव्हाण सागरे र वन्यजीव अभयारण्य रखा गया ह)ै जो महारा राज्य के सांगली िजला म 17º06’35’’´´ उ0 -17º09’40’’´´ उ0 अक्षांश और 74º20’20’’ और 74º24’20’’ ´पू0 दशेांतर के बीच अविस्थत ह ैऔर 10.87 वगर् िकलोमीटर क्षे तक फैला हुआ ह ै;

और, यशवंतराव चव्हाण सागरे र अभयारण्य संरक्षक के दलुर्भ योगो म स एक ह ै जहाँ संपूणर् अभयारण्य, वनीकरण कायर् म के तहत िबना िकसी बारहमासी जल ोत के िनिमर्त खेती वन ह;ै

और, अभयारण्य म पाए गए वन के कार जो दिक्षणी शुष्क िमि त पणर्पाती के रूप म ह ैऔर घास के मैदान से ढके हुए पहाड़ी ढलान के साथ दिक्षणी कांटेदार वन ह;

और, अभयारण्य िक ज्यादातर वन्यजीव जाित को 1980 म कृि म रुप से लाया गया ह ैऔर मुख्य वन्य पशु म काला िहरण (एंटेलोप किवर्कापरा), भेिडया (कैिनस लूपास पिल्लप्स), िसयार (कैिनस ऑिरयस), चीतल (एिक्सस एिक्सस), सांभर (सवुर्स यूनीक्लोर), जंगली सुअर (सस स् ोफ़ा), साही (हाइिरि क्स इंिडका) सिम्मलत ह;ै

और, टीक (टेक्टोना िडस), तद ु(डायिस्परोस मेलानॉिक्सयालोन), िससो (डाल्बिगर्या िससो), एगेवे (एगेवा अमेिरकाना), खैर (अगािकया कैटेचु), करंज (प गािमया िप ाटा), बीबा (सेमेकरपस एनकाडर्म), आमला (एमिब्लका ऑिफिसनािलस), ऐन (टिमर्निलया टेमटोसा) अप्टा (बहुिनया िरसेमोसा), िचंच (तामारइंडस इंिडका) आिद;

और, इस के्ष का पिररक्षण और संरक्षण करना आवश्यक ह ैतथा िजसकी सीमा के के्ष और चौह ी को इस अिधसूचना के पैरा 1 म यशवंतराव चव्हाण सागरे र वन्यजीव अभयारण्य के संरिक्षत क्षे के चार ओर पािरिस्थितक और पयार्वरण की दिृ से पािरिस्थितक संवेदी जोन के रूप म िविन दर् िकया गया ह ैऔर उ ोग या उ ोग के वग को तथा उनकी संि या और ि या को उ पािरिस्थितक संवेदी जोन म ितिष करना ह ै;

अतः अब, केन् ीय सरकार, पयार्वरण (संरक्षण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) के साथ पिठत उपधारा (1) ारा द शि य का योग करते हुए, महारा राज्य म यशवंतराव चव्हाण सागरे र वन्यजीव अभयारण्य की सीमा से 100 मीटर के िवस्तार के क्षे को यशवंतराव चव्हाण सागरे र वन्यजीव अभयारण्य पािरिस्थितक संवेदी जोन (िजसे इसम इसके प ात् पािरिस्थितक संवेदी जोन कहा गया ह)ै के रूप म अिधसूिचत करती ह,ै िजसका िववरण िन ानुसार ह,ै अथार्त् :-

1. पािरिस्थितक सवंदेी जोन का िवस्तार और उसकी सीमाएं--(1) पािरिस्थितक संवेदी जोन यशवंतराव चव्हाण सागरे र वन्यजीव अभयारण्य की सीमा से 100 मीटर तक फैला हुआ ह ै । िजसका िवस्तार 3.68 वगर् िकलोमीटर ह ै।

(2) पािरिस्थितक संवेदी जोन के साथ संरिक्षत क्षे का मानिच उपाबंध I क और उपाबधं ख के रूप म उपाब ह ै।

(3) पािरिस्थितक संवेदी जोन अक्षांश और दशेांतर के साथ उपाबधं II के रुप म संल ह।ै

(4) महारा राज्य के िजला सांगली के पािरिस्थितक सवेंदी जोन के अंतगर्त आने वाले ाम की सूची उपाबधं III के रुप म संल ह।ै

2. पािरिस्थितक सवंेदी जोन के िलए आंचिलक महायोजना – (1) राज्य सरकार, पािरिस्थितक संवेदी जोन के योजन के िलए राजप म इस अिधसूचना के काशन की तारीख से दो वषर् की अविध के भीतर, स्थानीय ि य

के परामशर् से और इस अिधसूचना म संलग् न अनुबंध के सामंजस् य से और राज्य सरकार म सक्षम ािधकारी के अनुमोदन से आंचिलक महायोजना तैयार करेगी ।

¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 (2) राज्य सरकार ारा पािरिस् थितक संवेदी जोन के िलए आचंिलक महायोजना इस रीित म, इस अिधसूचना म िविन दर्ष् ट रूप तथा सुसगंत क ीय और राज् य िविधय के सामंजस् य और क ीय सरकार ारा जारी मागर्िनदश , यिद कोई ह , ारा तैयार होगी ।

(3) आंचिलक महायोजना, पयार्वरणीय और पािरिस्थितक िवचार को समाकिलत करने के िलए राज् य सरकार के सभी संब िवभाग के परामशर् से तैयार होगी, अथार्त्:--

(i) पयार्वरण; (ii) वन और वन्यजीव; (iii) कृिष ; (iv) राजस् व; (v) नगर िवकास; (vi) पयर्टन; (vii) ामीण िवकास; (viii) िसंचाई और बाढ़ िनयं ण; (ix) नगरपािलका; (x) पंचायती राज; (xi) लोक िन मार्ण िव भाग।

(4) आंचिलक महायोजना अनुमोिदत िव मान भू-उपयोग, अवसंरचना और ि याकलाप पर कोई िनबधन अिधरोिपत नह करेगी जब तक िक इस अिधसूचना म िविन दर्ष् ट न हो और आचंिलक महायोजना सभी अवसंरचना और ि याकलाप म और अिधक दक्षता और पािरिस्थितक अनुकूलता का संवधर्न करेगी ।

(5) आंचिलक महायोजना म अनाच्छािदत क्षे के जीण ार, िव मान जल िनकाय के संरक्षण, आवाह के्ष के बंधन, जल-संभर के बंधन, भूतल जल के बंधन, मृदा और नमी संरक्षण, स्थानीय समुदाय की आवश्यकता तथा पािरिस्थितक और पयार्वरण स ेसबंंिधत ऐस ेअन्य पहलू , िजन पर ध्यान दनेा आवश्यक ह,ै के िलए उपबंध ह ग े।

(6) आंचिलक महायोजना सभी िव मान पूजा स् थल , ाम और नगरीय बंदोबस्त , वन के कार और िकस् म , कृिष के्ष , ऊपजाऊ भूिम, हिरत क्षे जैसे उ ान और उसी कार के स् थान, उ ान कृिष क्षे , फलोउ ान, झील और अन्य जल िनकाय का अभ्यकंन करेगी और इस योजना के मानिच ारा िव मान और स्तािवत भिूम के उपयोग का िववरण िकया जाएगा ।

(7) आंचिलक महायोजना स् थानीय समुदाय की जीवकोपाजर्न को सुिनिश् चत करने के िलए, पािरिस्थितक संवेदी जोन म िवकास को पािरिस्थितक अनुकूल िवकास के िलए िविनयिमत करेगी ।

(8) आंचिलक महायोजना इस अिधसूचना म िदए गए उपबंध के संबंध म अपने काय के बाहर ले जाने के िलए मानीटरी सिमित के िलए एक संदभर् दस्तावेज तैयार करेगी ।

3. राज्य सरकार ारा िकए जान ेवाले उपाय-- राज्य सरकार इस अिधसूचना के उपबंध को भावी करने के िलए िन िलिखत उपाय करेगी, अथार्त् :--

(1) भ-ूउपयोग - पािरिस् थितक संवेदी जोन म वन , उ ान-कृिष क्षे , कृिष के्ष , आमोद- मोद के योजन के िलए िचिन्हत िकए गए पाक और खुले स्थान का वािणिज्यक और औ ोिगक संब िवकास ि याकलाप के िलए


उपयोग या संपिरवतर्न नह होगा। :

परंतु पािरिस्थितक संवेदी जोन के भीतर कृिष भूिम का संपिरवतर्न मानीटरी सिमित की िसफािरश पर और राज्य सरकार के पूवर् अनुमोदन स,े राज्य सरकार के अन्य िनयम और िविनयम के रूप म लागू ह गे, जो स्थानीय िनवािसय की आवासीय जरूरत को पूरा करने के िलए ह,ै अथार्त् :-

(i) िव मान सड़क को चौड़ा करना और उन्ह सुदढ़ृ करना तथा नई सड़क का सिंनमार्ण;

(ii) बुिनयादी ढांच और नागिरक सुिवधा का संिनमार्ण और नवीकरण; (iii) दषूण उत्प न करन ेवाले लघ ुउ ोग; (iv) कुटीर उ ोग िजसके अंतगर्त ामीण कारीगर ह; सुिवधाजनक भण्डार और स्थानीय सुिवधा सहायक पािरिस्थितक पयर्टन म सिम्मिलत ह वास; और (v) संविधर्त ि याकलाप पैरा 4 के अधीन :

परंतु यह और भी िक राज्य सरकार के पूवर् अनुमोदन तथा संिवधान के अनुच्छेद 244 और तत्समय वृ िविध के उपबंध के अनुपालन के िबना, िजसके अंतगर्त अनुसूिचत जनजाित और अन्य परंपरागत वन िनवासी (वन अिधकार की मान्यता) अिधिनयम, 2006 (2007 का 2) भी ह,ै वािणिज्यक या उ ोग िवकास ि याकलाप के िलए जनजातीय भूिम का उपयोग अनुज्ञात नह होगा :

परंतु यह और भी िक पािरिस् थितक संवेदी जोन के भीतर भू-अिभलेख म उपसंजात कोई ुिट मानीटरी सिमित के िवचार ा करने के प ात् राज्य सरकार ारा त्येक मामले म सशंोिधत होगी और उ ुिट के संशोधन की केन् ीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मं ालय को सूचना दनेी होगी ।

परंतु यह और भी िक उपयुर् ुिट का सशंोधन म इस उप पैरा के अधीन यथा उपबंिधत के िसवाय िकसी भी दशा म भू-उपयोग का पिरवतर्न सिम्मिलत नह होगा :

परंतु यह और भी िक हिरत क्षे म जैसे वन के्ष , कृिष क्षे आिद म कोई पािरणािमक कटौती नह होगी और अन युक् त या अनुत् पादक कृिष के्ष म पुन: वनीकरण करने के यास िकए जाएंगे ।

(2) ाकृितक जल ोत -- आचंिलक महायोजना म सभी ाकृितक जल ोत की पहचान की जाएगी और उनके संरक्षण और पुनरुद्भूतकरण के िलए योजना सिम् मिलत होगी और राज् य सरकार ारा ऐसे क्षे पर या उनके िनकट िवकास ि याकलाप ितिष करने के िलए ऐसी रीित से मागर्िनदश तैयार िकए जाएंगे ।

(3) पयर्टन – (क) पािरिस्थितक संवेदी जोन के भीतर पयर्टन संबंधी ि याकलाप पयर्टन महायोजना के अनुसार ह गे जो िक आंचिलक महायोजना के भाग रूप म होगी ।

(ख) पयर्टन महायोजना पयर्टन िवभाग, ारा पयार्वरण और वन िवभाग के परामशर् से तैयार होगी ।

(ग) पयर्टन महायोजना आंचिलक महायोजना के एक घटक के रूप म जाना जायेगा ।

(घ) पयर्टन सबंंधी ि याकलाप िनम् निलिखत के अधीन िविनयिमत ह गे, अथार्त् :-

(i) यशवंतराव चव्हाण सागरे र वन्यजीव अभयारण्य की सीमा से एक िकलोमीटर तक या पािरिस्थितक संवेदी जोन के िवस्तार तक इनम जो भी िनकट है, नये वािणिज्यक होटल और िरसोटर् अनुज्ञात नह ह गे। परंतु, जहाँ पािरिस्थितक संवेदी जोन का िवस्तार एक िकलोमीटर से ज्यादा ह ैवहाँ, एक िकलोमीटर से परे और पािरिस्थितक संवेदी जोन के िवस्तार तक सभी नए पयर्टक ि याकलाप या िव मान ि याकलाप का िवस्तार पयर्टन महायोजना के अनुसार होगा;

(ii) पािरिस्थितक संवेदी जोन के भीतर सभी नए पयर्टन ि याकलाप या िव मान पयर्टन ि याकलाप का िवस्तार केिन् य सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मं ालय के मागर्दशर्क िस ांत के ारा तथा राष् ीय व् या संरक्षण ािधकरण, ारा जारी पािरिस्थितक पयर्टन (समय-समय पर यथा संशोिधत) मागर्दशर्क िस ांत के अनुसार, पािरिस्थितक पयर्टन, पािरिस्थितक िशक्षा और पािरिस्थितक िवकास को महत्व दतेे हुए पािरिस्थितक संवेदी जोन की वहन क्षमता के अध्ययन पर आधािरत होगा;

(iii) आंचिलक महायोजना का अनुमोदन िकए जाने तक, पयर्टन के िलए िवकास और िव मान पयर्टन ि याकलाप के िवस्तार को वास्तिवक स्थल िविन दर् संवीक्षा तथा मानीटरी सिमित की िसफािरश पर आधािरत संबंिधत िविनयामक ािधकरण ारा अनुज्ञात िकया होगा ।

(4) नसैिगर्क िवरासत -- पािरिस्थितक संवेदी जोन म महत्वपूणर् नैसिगर्क िवरासत के सभी स्थल जैसे सभी जीन कोश आरिक्षत क्षे , शैल िवरचनाएं, जल पात , झरन , घाटी माग , उपवन , गुफाएं, स्थल , मण, अ रोहण,

पात आिद की पहचान की जाएगी और िवरासत संरक्षण योजना आंचिलक महायोजना के भाग के रुप म उनके पिररक्षण तथा संरक्षण के िलए तैयार की जाएगी ।

(5) मानव िनिमर्त िवरासत स् थल - पािरिस् थितक संवेदी जोन म भवन , संरचना , िशल्प-तथ्य, ऐितहािसक, कलात्मक और सांस्कृितक महत्व के क्षे की पहचान भी होगी और उनके संरक्षण के िलए िवरासत संरक्षण योजना आंचिलक महायोजना के भाग के रुप म तैयार की जाएगी ।

(6) ध् विन दषूण -- पािरिस्थितक संवेदी जोन म ध् विन दषूण के िनयं ण के िलए राज् य सरकार का पयार्वरण िवभाग या राज् य दषूण िनयं ण बोडर् ध्विन दषूण (िविनयमन और िनयं ण) िनयम के अनुसार पयार्वरणीय (संरक्षण) अिधिनयम, 1986, 2000 अंतगर्त तैयार करेगा ।

(7) वाय ु दषूण -- पािरिस्थितक संवेदी जोन म, वायु दषूण के िनयं ण के िलए राज्य सरकार का पयार्वरण िवभाग या राज् य दषूण िनयं ण बोडर् वायु ( दषूण िनवारण और िनयं ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम के उपबंध के अनुसार म मागर्दशर्क िस ांत और िविनयम तैयार करेगा ।

(8) बिह ाव का िनस्सारण -- पािरिस्थितक संवेदी जोन म उपचािरत बिह ाव का िनस्सारण सामान्य मानक के िलए पयार्वरणीय दिूषत आच्छािदत के िनस्सारण के अंतगर्त पयार्वरणीय (संरक्षण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयम के उपबंध के अनुसार होगा।

(9) ठोस अपिश -- ठोस अपिश का िनपटान िन िलिखत रूप म होगा--

(i) पािरिस्थितक संवेदी जोन म उपचािरत बिह ाव का िनस्सारण, समय-समय पर संशोिधत ठोस अपिशष् ट बधंन िनयम, 2016, जो भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मं ालय की अिधसूचना सं. का.आ. 1357(अ), तारीख 8 अ ैल, 2016 ारा कािशत िकए गए थे, के उपबंध के अनुसार िकया जाएगा ;

(ii) स्थानीय ािधकरण जैव िन ीकरणीय और अजैव िन ीकरणीय संघटक म ठोस अपिश के संपृथ न के िलए योजनाएं तैयार करग े;

(iii) जैव िन ीकरणीय साम ी को अिधमानतः खाद बनाकर या कृिम खेती के माध्यम स ेपुनःचि त िकया जाएगा ;


(iv) अकाबर्िनक साम ी का िनपटान पािरिस्थितक संवेदी जोन के बाहर पहचान िकए गए स् थल पर िकसी पयार्वरणीय स्वीकृत रीित म होगा और पािरिस्थितक संवेदी जोन म ठोस अपिशष् ट को जलाना या भष् मीकरण अनुज्ञात नह होगा।

(10) जैव िचिकत् सीय अपिशष् ट- पािरिस्थितक संवेदी जोन म जैव िचिकत्सीय अपिश का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मं ालय की समय-समय पर यथासंशोिधत अिधसूचना जी.एस. आर 343 (अ) तारीख 28 माचर् 2016 ारा कािशत जैव िचिकत्सीय अपिश बंध िनयम, 2016 के उपबंध के अनुसार िकया जाएगा ।

(11) प्लािस्टक अपिश बंधन: - पािरिस्थितक संवेदी जोन म प्लािस्टक अपिश बंध का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मं ालय की अिधसूचना सं.का.िन 340(अ), तारीख 18 माचर्, 2016 ारा

कािशत प्लािस्टक अपिश बंध िनयम 2016 के उपबंध के अनुसार िकया जाएगा।

(12) िनमार्ण और िवध्वसं अपिश बंधन: - पािरिस्थितक संवेदी जोन म संिनमार्ण और िवध्वसं अपिश बंध का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मं ालय की अिधसूचना सं.का.िन 317(अ), तारीख 29 माचर्, 2016 ारा कािशत संिनमार्ण और िवध्वंस बंध िनयम, 2016 के उपबंध के अनुसार िकया जाएगा।

(13) यानीय यातायात- पिरवहन की यानीय गितिविधयां आवास के अनुकूल िविनयिमत ह गी और इस संबंध म आंचिलक महायोजना म िवशेष उपबंध अिधकिथत िकए जाएंगे और आंचिलक महायोजना के तैयार होने और राज् य सरकार के सक्षम ािधकारी के ारा अनुमोिदत होने तक, मानीटरी सिमित वृ िनयम और िविनयम के अनुसार यानीय गितिविधय के अनुपालन को मानीटर करेगी ।

(14) औ ोिगक इकाईयां - (i) राजप म इस अिधसूचना के काशन के प ात या काशन म, पािरिस्थितक संवेदी जोन के भीतर कोई नए दिूषत उ ोग की स्थापना की अनुज्ञा नह दी जाएगी।

(ii) पािरिस्थितक संवेदी जोन के क ीय दषूण बोडर् के वग करण के भीतर िसफर् गैर- दिूषत उ ोग की स्थापना की अनुज्ञा दी जाएगी।

(15) पहाड़ी ढलान को सरंक्षण: - पहाड़ी ढलान के संरक्षण के अंतगर्त:

(क) आंचिलक महायोजना पहाड़ी ढलान पर क्षे का संकेत होगा जहां िकसी भी संिनमार्ण की अनुज्ञा नह दी जाएगी ।

(ख)कटाव के एक उ िड ी के साथ िव मान खड़ी पहाड़ी ढलान या ढलान पर िकसी भी संिनमार्ण की अनुज्ञा नह दी जाएगी ।

(16) यिद यह आवश्यक समझता ह,ै इस अिधसूचना के उपाबंध को वृत करने म क ीय सरकार और राज्य सरकार, अन्य उपाय िन दर् करेगा।

4. पािरिस्थितक सवंदेी जोन म ितिष और िविनयिमत ि याकलाप की सचूी - पािरिस्थितक संवेदी जोन म सभी ि याकलाप पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) के उपबंध और इसके अध्यधीन बनाए गए िनयम ारा शािसत ह गे और नीचे दी गई तािलका म िविन दर् रीित म िविनयिमत ह गे, अथार्त् :--

ितिष ि याकलाप

1. वािणिज्यक खनन, पत्थर की खदान, उनको तोड़ने की इकाइयां ।

(क) सभी कार के खनन (लघु और वृहत खिनज), पत्थर की खान और उनको तोड़ने की इकाइयां वास्तिवक स्थानीय िनवािसय की घरेलू आवश्यकता िजसम िनजी उपयोग के िलए के िलए मकान के संिनमार्ण या मरम्मत के िलए धरती को खोदना और मकान बनाने के िलए दशेी टाइल्स या ईंट का िनमार्ण करना भी सिम्मिलत ह,ै के िसवाय नह ह गी ;

(ख) खनन संि याएं, माननीय उ तम न्यायालय की िरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमर्न िथरुमूलपाद बनाम भारत सरकार के मामले म आदशे तारीख 4 अगस्त, 2006 और िरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले म तारीख 21 अ ैल, 2014 के अंतिरम आदशे के अनुसरण म सवर्दा चालन होगा ।

6. ाकृितक जल िनकाय या सतही क्षे म अनुपचािरत बिह ार्व और ठोस अपिश का िनस्सारण ।

लागू िविधय के अनुसार ितिष (अन् यथा उपबंिधत के िसवाय) ह गे ।

7. नए काष् ठ आधािरत उ ोग। पािरिस् थितक संवेदी जोन की सीमा के भीतर नए काष् ठ आधािरत उ ोग की स् थापना को अनुज्ञात नह िकया जाएगा : परंतु िव मान का -आधािरत उ ोग िविध के अनुसार बने रहगे ।

8. फम , कॉप रेट, कंपिनय ारा बड़े पैमाने पर वािणिज्यक पशुधन संपदा और कुक्कुट फाम की स्थापना ।

स्थानीय जरूरत को पूरा करने के िलए लागू िविधय के अनुसार ितिष (अन् यथा उपबंिधत के िसवाय) ह गे ।


9. ईंट भ की स्थापना करना। लागू िविधय के अनुसार ितिष (अन् यथा उपबंिधत के िसवाय) ह गे ।

िविनयिमत ि याकलाप 10. होटल और िरसोट का स्थापना । पािरिस्थितक पयर्टन ि याकलाप संबंधी पयर्टक की

लघु संरचना के िलए संरिक्षत क्षे की सीमा से एक िकलोमीटर तक या पािरिस्थितक संवेदी जोन के िवस्तार तक, इनम जो भी िनकट ह,ै नए वािणिज्यक होटल और िरसोटर् अनुज्ञात ह गे, अन्यथा नह । परंतु, जहाँ पािरिस्थितक संवेदी जोन का िवस्तार एक िकलोमीटर से ज्यादा ह ैवहाँ, एक िकलोमीटर से परे और पािरिस्थितक संवेदी जोन के िवस्तार तक सभी नए पयर्टक ि याकलाप या िव मान ि याकलाप का िवस्तार पयर्टन महायोजना और यथा लागू मागर्दश िस ांत के अनुरुप होगा।

11. सिंनमार्ण ि याकलाप । (क) सरंिक्षत के्ष या पािरिस्थितक संवेदी जोन के िवस्तार, इनम से जो भी नजदीक हो, से 1 िकलोमीटर के भीतर नए वािणिज्यक संिनमार्ण को अनुज्ञात नह िकया जाएगा: परंतु स्थानीय ि य को उनके आवासीय उपयोग के िलए उनकी भूिम म संिनमार्ण िजसके अंतगर्त पैरा 3 के उपपैरा (1) म सूचीब ि याकलाप भी ह, को करने के िलए अनुज्ञात िकया जाएगा :

(ख) ऐसे लघु उ ोग जो दषूण उत् पन् न नह करते ह, से संबंिधत संिनमार्ण ि याकलाप िविनयिमत िकए जाएंगे और लागू िनयम और िविनयम , यिद कोई ह , के अनुसार सक्षम ािधकारी की पूवर् अनुमित से ही न् यूनतम पर रखा जाएगा ।

12. भू-जल का िनष् कषर्ण । लागू िविधय के अधीन स्थानीय लोग के पीने का पानीया कृिष की आवश्यकता को पूरा करने के िलए िविनयिमत ह गे।

13. वृक्ष की कटाई । (क) राज्य सरकार म सक्षम ािधकारी की पूवर् अनुमित के िबना वन, सरकारी या राजस्व या िनजी भूिम पर या वन म िकन्ही वृक्ष की कटाई नह होगी । (ख) वृक्ष की कटाई संबंिधत क ीय या राज्य अिधिनयम या उसके अधीन बनाए गए िनयम के उपबंध के अनुसार िविनयिमत होगी ।

14. िव ुत और दरूसंचार टावर और िबछाई गई केबल और अन्य बुिनयादी ढाँच का पिरिनमार्ण ।

लागू िविधय के अधीन िविनयिमत ह गे (भूिमगत केबल को ोत्सािहत िकया जा सकेगा) ।


15. नागिरक सुिवधा सिहत बुिनयादी ढांचे। लागू िविधय के अनुसार न्यूनीकरण की उपाय के साथ, िनयम और िविनयमन और उपलब्ध िदशािनदश िविनयिमत ह गे।

16. िव मान सड़क को चौड़ा करना और उन्ह सुदढृ करना ।

लागू िविधय के अनुसार न्यूनीकरण की उपाय के साथ, िनयम और िविनयमन और उपलब्ध िदशािनदश िविनयिमत ह गे।

17. राि म यािनक यातायात का संचलन । लागू िविधय के अधीन वािणिज्यक योजन के िलए िविनयिमत ह गे ।

18. िवदशेी जाितय को लाना । लागू िविधय के अधीन िविनयिमत ह गे ।

19. पोिलथीन थैल का उपयोग । लागू िविधय के अधीन िविनयिमत ह गे ।

20. पहाड़ी ढाल और नदी तट का संरक्षण । लागू िविधय के अधीन िविनयिमत ह गे ।

21. ाकृितक जल िनकाय या सतही क्षे मउपचािरत बिह ार्व का िनस्सारण ।

उपचािरत बिह ार्व के पुनचर् ण को ोत्सािहत करनाऔर अवमल या ठोस अपिश के िनपटान के िलए िव मान िविनयम का अनुपालन करना होगा ।

22. वािणिज् यक साइनबोडर् और होिडग । लागू िविधय के अधीन िविनयिमत ह गे ।

23. दषूण उत्प न करने वाले लघु उ ोग । पािरिस् थितक संवेदी जोन स े गैर दषूण, गैर पिरसंकटमय, लघु और सेवा उ ोग, कृिष उ ान, कृिष या कृिष आधािरत दशेीय माल स ेऔ ोिगक उत्पाद का उत्पादन उ ोग और जो पयार्वरण पर कोई िवपरीत

भाव नह डालते ह, अनुज्ञात िकए जाएंगे । 24. वन उत्पाद और गैर का वन उत्पाद का

सं हण (एन.टी.एफ.पी.) । लागू िविधय के अधीन िविनयिमत ह गे ।

25. वायु और यानीय दषूण। लागू िविधय के अधीन िविनयिमत ह गे ।

26. ध्विन दषूण। पयार्वरण (सरंक्षण) अिधिनयम 1986 के अधीन ध्विन दषूण (िविनयमन और िनयं ण) िनयम, 2000 म

िनयत उपबंध के अनुसार म पािरिस्थितक संवेदी जोन म ध्विन दषूण के िनयं ण के िलए िविनयम को कायार्िन्वत करेगा ।

27. खुले कुआ, बोर कुआ, आिद के िलए कृिष और अन्य उपयोग ।

लागू िविधय के अधीन िविनयिमत ह गे और िविनयिमतऔर उपयु ािधकारी ारा ि याकलाप की सख्ती से िनगरानी की जाएगी।

28. ठोस अपिश बंधन । ठोस अपिश बंधन िनयम, पयार्वरण (संरक्षण) अिधिनयम, 1986 के अधीन ठोस अपिश बंधन िनयम 2016 के उपाबंध के अनुसार होगा।

29. पािरिस्थितक-पयर्टन। लागू िविधय के अधीन िविनयिमत ह गे ।

30. पािरिस्थितक-पयर्टन से संबंिधत ि याकलाप जैसे गमर् वायु गुब्बार , ोन, आिद ारा वन्यजीव अभयारण्य क्षे के ऊपर से उड़ना जैसे ि याकलाप करना।

लागू िविधय के अधीन िविनयिमत ह गे ।

5. मानीटरी सिमित - क ीय सरकार के ारा, पयार्वरण (संरक्षण) अिधिनयम, 1986 की धारा 3 की उप-धारा (3) के अधीन इस अिधसूचना के उपबंध की भावी िनगरानी के िलए एक िनगरानी सिमित का गठन िकया गया, जो िन िलिखत स ेिमलकर बनेगी, अथार्त्:--

(क) िजला कलक्टर, यवतमाल – सांगली- अध्यक्ष;

(ख) गैर सरकारी संगठन का एक ितिनिध जो पयार्वरण (िवरासत संरक्षण सिहत) के के्ष म कायर् कर रहा है, िजसे महारा सरकार ारा त्येक मामले म तीन वषर् की अविध के िलए नाम िन दर् िकया जाएगा – सदस्य;

(ग) पािरिस्थितक और पयार्वरण के क्षे म एक िवशेषज्ञ िजसे महारा सरकार ारा त्येक मामले म तीन वषर् की अविध के िलए नाम िन दर् िकया जाएगा - सदस्य;

(घ) के्ष ीय अिधकारी, महारा राज्य दषूण िनयं ण बोडर् - सदस्य;

(ङ) क्षे का ज्ये नगर योजनाकार – सदस्य;

(च) महारा सरकार के पयार्वरण िवभाग का ितिनिध – सदस्य;

(छ) राज्य जैव िविवधता बोडर् के सदस्य – सदस्य;

(ज) भागीय वन अिधकारी, सांगली – सदस्य सिचव ।

6. िनदश िनबंधन

(1) मानीटरी सिमित इस अिधसूचना के उपबंध के अनुपालन को मानीटर करेगी ।

(2) सिमित का कायर्काल तीन वषर् की अविध के िलए िकया जाएगा।

(3) पािरिस्थितक संवेदी जोन म भारत सरकार के तत् कालीन पयार्वरण और वन मं ालय की अिधसूचना सं. का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 की अनुसूची म सिम्मिलत ि याकलाप और इस अिधसूचना के पैरा

(4) इस अिधसूचना के पैरा 4 के अधीन सारणी म यथा-िविन दर् ितिष ि याकलाप के िसवाय, भारत सरकार के पयार्वरण और वन मं ालय की अिधसूचना संख्यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 की अिधसूचना के अनुसूची के अधीन ऐसे ि याकलाप , िजन्ह सिम्मिलत नह िकया गया ह,ै परंतु पािरिस्थितक सवेंदी जोन म आते ह, ऐस े ि याकलाप की वास्तिवक िविन दर् स्थलीय दशा पर आधािरत मानीटरी सिमित ारा संवीक्षा की जाएगी और उस ेसंब िविनयामक ािधकरण को िन दर् िकया जाएगा ।

(5) मानीटरी सिमित का सदस्य-सिचव या संबंिधत कलक्टर या संबंिधत उ ान के उप-वन संरक्षक, कोई ि जो इस अिधसूचना के िकसी उपबंध का उल्लंघन करता ह,ै उसके िवरु पयार्वरण (सरंक्षण) अिधिनयम,

1986 की धारा 19 के अधीन पिरवाद फाइल करने के िलए सक्षम होगा ।

(6) मानीटरी सिमित मु के आधार पर अपेक्षा पर िनभर्र रहते हुए संब िवभाग के ितिनिधय या िवशेषज्ञ , औ ोिगक संगम या संब पणधािरय के ितिनिध ित मु े की अपेक्षा के अनुसार िवचार-िवमशर् म सहायता के िलए आमंि त कर सकेगी ।

(7) मानीटरी सिमित त्येक वषर् की 31 माचर् तक की राज्य के मुख्य वन्यजीव वाडर्न को अपनी वािषर्क कारर्वाई िरपोटर् उपाबधं IV पर उपाब ारूप पर 30 जून तक स्तुत करेगी ।

(8) केन् ीय सरकार का पयार्वरण, वन और जलवायु पिरवतर्न मं ालय मानीटरी सिमित को अपने कृत्य के भावी िनवर्हन के िलए समय-समय पर ऐस ेिनदशे द ेसकेगा, जो वह ठीक समझे ।

7. इस अिधसूचना के उपबंध को भाव देने के िलए क ीय सरकार और राज् य सरकार अितिरक् त उपाय, यिद कोई ह , िविन दर्ष् ट कर सकगे ।

8. इस अिधसूचना के उपबंध भारत के माननीय उ तम न्यायालय या उ न्यायालय या राष् ीय हिरत ािधकरण ारा पािरत कोई आदशे या पािरत होने वाले िकसी आदशे, यिद कोई ह , के अधीन ह गे ।

NOTIFICATION New Delhi, the 15th May, 2017

S.O. 1565(E).––WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 3105 (E), dated 16th November, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;

AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the dated the 16th November, 2015;

AND WHEREAS, objections and suggestions received from all persons and stakeholders in response to the draft notification have been duly considered by the Central Government;

AND WHEREAS, the Sagareshwar Wildlife Sanctuary (recently rename as Yashvantrao Chavan Sagareshwar Wildlife Sanctuary) is situated between 17º06’35’’ N - 17º09’40’’ N latitudes and 74º20’20’’ and 74º24’20’’ E longitudes in Sangli District of Maharashtra and extends over an area of 10.87 square kilometers;

AND WHEREAS, the Yashvantrao Chavan Sagareshwar Sanctuary is one of the rare experiments in conservation where the entire Sanctuary is a cultivated forest without any perennial source of water created under planned afforestation programme;


AND WHEREAS, the forest type found in the said Sanctuary are Southern dry mixed deciduous and Southern thorn forest with hill slopes covered with grasslands;

AND WHEREAS, most of the wildlife species of the aforesaid Sanctuary were artificially introduced in the year 1980 and the important wild animals include Black Buck (antelope cervicapra), Wolf (Canis lupas pallipes), Jackal (Canis aureus), Chital (Axix axis), Sambar (Servus unicolor), Wild pig (Sus scrofa), Porcupine (Hystrix indica) ;

AND WHEREAS, Teak (Tectona Grandis), Tendu (Diospyros Melanoxylon), Sisso (Dalbergia sisso), Agave (Ageva Americana), Khair (Agacia catechu), Karanj (Pongamia pinnata), Biba (Semecarpus anacardum), Amla (Emblica officinalis), Ain (Terminalia tamentosa) Apta (Bahunia recemosa), Chinch (Tamarindus indica), etc. are found in the said Sanctuary;

AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of Yashvantrao Chavan Sagareshwar Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;

NOW THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub- rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent up to 100 metres from the boundary of Yashvantrao Chavan Sagareshwar Sagareshwar Wildlife Sanctuary in the State of Maharashtra as the Yashvantrao Chavan Sagareshwar Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-

1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone is spread over an area of 3.68 square kilometres with an extent up to 100 metres from the boundary of Yashvantrao Chavan Sagareshwar Wildlife Sanctuary.

(2) The map of the protected area along with the Eco-sensitive Zone is appended as Annexures I–A and Annexure-B.

(3) The latitude and longitude of Eco-sensitive Zone is appended as Annexure II.

(4) The list of villages of Sangli District of Maharashtra falling within Eco-sensitive Zone is appended as Annexure III.

2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for consideration and approval of the Competent Authority in the State Government.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:-

(i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue; (v) Urban Development; (vi) Tourism;


(vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal; (x) Panchayati Raj; (xi) Public Works Department.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and Eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the Plan shall be supported by maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development for livelihood security of local communities.

(8) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions of monitoring under the provisions of this notification.

3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial activities:

Provided that the conversion of agricultural and other lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of the local residents and for the following activities, namely.

(i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities

supporting Eco-tourism including home stay; and (v) promoted activities given in paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:


Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism.- (a) All new Eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.

(b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests.

(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.

(d) The activities of Eco-tourism shall be regulated as under, namely:-

(i) no new construction of hotels and resorts shall be permitted within one kilometre from the boundary of the Yashvantrao Chavan Sagareshwar Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer:

Provided that beyond the distance of one kilometre from the boundary of the said Sanctuary till the extent of the Eco-sensitive Zone, whichever is nearer, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan;

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the Eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on Eco-tourism, Eco-education and Eco-development and based on carrying capacity study of the Eco-sensitive Zone;

(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up as part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared as part Zonal Master Plan.

(6) Noise pollution.- The Environment Department of the State Government or State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.

(7) Air pollution.- The Environment Department of the State Government or State Pollution Control Board shall implement standards and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rule made thereunder.

(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and rules made therein. -

¹Hkkx IIμ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21 (9) Solid wastes. - Disposal of solid wastes shall be as under:-

(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;

(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;

(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;

(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.

(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time.

(11) Plastic Waste Management:- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the 18th March, 2016, as amended from time to time.

(12) Construction and demolition waste management:- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 317 (E), dated the 29th March, 2016, as amended from time to time.

(13) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(14) Industrial units- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.

(ii) Only non-polluting industries may be permitted to be established within Eco-sensitive Zone as per the Central Pollution Control Board’s categorisation.

(15) Protection of hill slopes.- The protection of hill slopes shall be as under:-

(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.

(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.

16. The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification.

4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco- sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and be regulated in the manner specified in the Table below, namely:-

2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.

3. Setting up of industries causing water or air or soil or noise pollution.

No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted.

4. Establishment of new major hydroelectric projects and irrigation projects.

Prohibited (except as otherwise provided) as per applicable laws.

5. Use, production or processing of any hazardous substances.


6. Discharge of untreated effluents and solid waste in natural water bodies or land area.


7. New wood based industry. No establishment of new wood based industry shall be permitted within the limits of Eco-sensitive Zone: Provided the existing wood-based industry may continue as per law.

8. Establishment of large-scale commercial livestock and poultry farms by firms, companies, etc.

Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs.

9. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws.

Regulated Activities10. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within

one kilometer of the boundary of the Protected Area or up to the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities: Provided that, beyond one kilometer from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

11. Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone, whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per applicable building byelaws: (b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the Competent Authority as per


applicable rules and regulations, if any. 12. Extraction of ground water Regulated under applicable laws to meet the drinking water or

agricultural requirement of locals. 13. Felling of trees. (a) There shall be no felling of trees on the forest or

Government or revenue or private lands without prior permission of the Competent Authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder.

14. Erection of electrical and communication towers and laying of cables and other infrastructures

Regulated under applicable law (underground cabling may be promoted).

15. Infrastructure including civic amenities Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.

16. Widening and strengthening of existing roads and construction of new roads.

Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.

17. Movement of vehicular traffic at night. Regulated for commercial purpose, under applicable laws.

18. Introduction of exotic species. Regulated under applicable laws. 19. Uses of plastic carry bags. Regulated under applicable laws. 20. Protection of hill slopes and river banks. Regulated under applicable laws. 21. Discharge of treated effluents in natural water

agriculture, floriculture, horticulture or agro-based industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment may be permitted.

24. Collection of forest produce or Non-Timber Forest Produce (NTFP).

Regulated under applicable laws.

25. Air and vehicular pollution Regulated under applicable laws. 26. Noise pollution Control of noise pollution in the Eco-sensitive Zone shall be in

accordance with the provisions of the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.

27. Open well, bore well ,etc. for agriculture or other usage

Regulated under applicable laws and the activity shall be strictly monitored by the concerned authority.

28. Solid waste management. Management of solid waste shall be as per the provisions of the Solid Waste Management Rules, 2016 under the Environment (Protection) Act, 1986.

29. Eco-tourism Regulated under applicable laws. 30. Undertaking activities related to Eco-tourism

like over-flying the Wildlife Sanctuary Area by aircraft, hot-air balloons, drones, etc.

Regulated under applicable laws.

Promoted Activities31. Ongoing agriculture and horticulture practices

by local communities along with dairies, dairy farming, aquaculture and fisheries.

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions of this Notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 comprising of the following, namely:

(a) District Collector, Yavatmal – Sangli – Chairman;

(b) a representative of non-Governmental Organisations working in the field of environment (including heritage conservation) to be nominated by the Government of Maharashtra for a term of three year in each case – Member;

(c) one expert in the area of ecology and environment to be nominated by the Government of Maharashtra for a term of three year in each case - Member;

(d) Regional Officer, Maharashtra State Pollution Control Board, - Member;

(e) Senior Town Planner of the area - Member;

(f) representative of Department of Environment, Government of Maharashtra – Member;

(g) Member of State Biodiversity Board– Member;

(g) Divisional Forest Officer, Sangli –Member Secretary.
