A Fund to Combat Violent Crime Committee meeting was held on Tuesday, September 8, 2015, in the City of Dover Police Department conference room, 400 South Queen Street, Dover, Delaware. The meeting was called to order at 12:28 p.m.. by Chairman Lewis Schiliro. Those in attendance included:

The agenda follows:

I. Approval of September 9, 2014 Minutes of the Meeting Chairman Schiliro asked if there were any amendments to the September 9, 2014 minutes of the meeting and hearing none, made a motion for approval. The motion was seconded by Lt. Colonel Monroe Hudson. Hearing no discussion, the minutes were approved by the Committee members.

II. Violent Crime Trends

Chairman Schiliro asked Detective Scott Weaver from the DIA to give a brief presentation on violent crime trends.

Detective Weaver reported that for the period 2009-2014 overall violent crimes have decreased by 15.38% (violent crimes include homicide, rape, robbery aggravated assault). For this time period (separated from rape, robbery and aggravated assault) homicides increased by 8.87%. Property crimes have decreased 8.09%.

There were 2,260 gun involved complaints and 4,727 crimes against person for the same time period.

III. Consideration of FY 16 Fund to Combat Violent Crime Applications

V-01-16 Camden Police Dept. on behalf of Police Chiefs $134,000.00

Discussion: Chairman Lewis Schiliro asked DELJIS Director to give some background regarding DELJIS and the impact of the recent cut in funds.

Peggy Bell stated that this grant is to make up the $134,000 funding cut made by the General Assembly. The General Assembly gave DELJIS $202,000 in funding, cutting $134,000. DELJIS is used by all the police agencies for email, wanted files, DMV files in addition to creating their crime reports. The money to pay for these fees is placed within the DELJIS budget as pass thru money to DTI. Now that a $134,000 deficit exists it would mean that the money would have to come out of the DEJIS budget and if this were to happen Peggy would have to lay off developers which would mean longer delays and priorities would change. The other alternative is that DELJIS would have to bill each department $20.20 per officer per month. Without funding service may be lost.

Chief Bryson stated that he made the Police Chiefs’ aware of this and suggested taking the $134,000 off the top of the Fund to Combat Violent Crime. Twenty-four police chiefs responded in agreement.

Lt. Fred Calhoun stated that the FOP is opposed to this funding because the General Assembly did not give the police departments the opportunity to fund this program. The State of Delaware saves $1.4 by using DELJIS to enter and submit their reports and now want to charge the police $134,000 to access DELJIS and save the State $1.4. DTI has money to pay for this through Video Phone fund money and other State money. Lt. Calhoun does not think the money should come from the pockets of the police.

Attorney General Matt Denn asked what would happen if DELJIS was not funded?

Peggy Bell replied that these agencies would have to pay. The epilogue says the agencies would have to be billed, which amounts to $20.20 per officer per month.

Chairman Lewis Schiliro asked if DELJIS access would be cut off if an agency did not pay for DELJIS?

Peggy Bell replied that yes,,that would happen.

Chief Martin Willey stated that when this decision was made, his budget was already approved and they did not budget for DELJIS access.

Chief Ken McLaughlin stated that he was concerned that funding DELJIS was setting a precedent and police should not have to pay for general operating costs funded by the State. Police Chiefs’ should contact their local legislators and make them aware of this.

Lt. Colonel Monroe Hudson state that DELJIS is a policing data driver and needs to be approved.

Deputy Attorney General Lisa Morris stated that this is an allowable expenditure per guidelines that state local law enforcement agencies may combine their allocations, upon approval by the Committee, to support a pool arrangement to fund an area served by more than one local law enforcement agency.

Applicant requests approval to use funds to purchase 6 800MHz mobile radios.

V-03-16 Smyrna Police Department $27,124.82

Applicant requests approval to use funds to purchase 10 APX6000 700/800 model portable radios.

V-04-16 Camden Police Department $18,857.90

Applicant requests approval to use funds continue last year’s project of purchasing cameras in the high crime area of Camden.

Discussion: Chief Bryson noted that the cameras are placed in high crime areas and the camera purchased last year enable the Camden Police Department to solve a non-violent crime resulting in an arrest.

V-05-16 Harrington Police Department $21,062.41

Applicant requests approval to use funds to establish a canine program by purchasing a dual trained (narcotics and patrol) police dog to include related expenses for equipment , food, vet care and training; purchase 1 taser, surveillance camera, and overtime for community policing and call out crimes.

Applicant requests approval to use funds for overtime for supplemental patrols and violent crime investigations and to purchase emergency lighting and equipment for a new vehicle to be used as a covert and command vehicle.

V-07-16 Laurel Police Department $23,260.25

Applicant requests approval to use funds for overtime for saturation patrols to combat violent crime and to purchase 7 APX 6000 portable radios.

V-08-16 Elsmere Police Department $21,613.54

Applicant requests approval to use funds for overtime to combat violent crimes and to purchase equipment to enhance their surveillance system at the police station.

Discussion: Chairman Lewis Schiliro stated he was impressed with Chief Laura Giles grant application and the results she obtained using last year’s violent crime funds. He asked Chief Giles to brief the Committee on the impact of these funds to her municipality.

Chief Giles reported that in using the Violent Crime overtime money last year Elsmere Police Department was able to confiscate 9 weapons; seized marijuana, heroin ecstasy, morphine, mushrooms and soboxone; seized 2 vehicles and $61,376 USC.

V-09-16 Felton Police Department $9,704.51

Applicant requests approval to use funds for overtime to combat violent crimes and to purchase air cards to enable internet in the police vehicles.

Applicant requests approval to use funds to purchase 6 APX6500 700/800 MHz radios, a sniper rifle, and 13 taser cartridges.

V-12-16 Ellendale Police Department $8,051.13

Applicant requests approval to use funds for overtime to combat violent crimes, and to purchase 1 Taser Model X2 with accessories.

Discussion: Debby Golden asked that this grant be amended to include the purchase of 1 Motorola APX 6000 portable radio.

Motion for Approval: A motion was made by Lt. Fred Calhoun and seconded by Chief Paul Bernat to approve the grant application as amended. Hearing no further discussion, the motion was unanimously approved by the Committee members.

V-13-16 Rehoboth Beach Police Department $24,369.18

Applicant requests approval to use funds to purchase a surveillance camera and overtime to combat violent crimes.Discussion: Chairman Lewis Schiliro asked Chief Keith Banks to brief the Committee on how the ATV he purchased last year is helping his police department reduce crime.

Chief Banks replied that the ATV allows Rehoboth Beach Police Officers to reach areas that are difficult otherwise. Rehoboth Beach officers have made mostly drug arrests using the ATV.

Applicant requests approval to use funds for overtime for combating violent crime and to purchase 2 body cameras with accessories.

Discussion: Chairman Lewis Schiliro asked Chief Mark Anderson what the storage expenses would be for the body cameras. Chief Anderson replied that they are currently evaluating three different types of cameras and are waiting for the Delaware Police Chiefs’ Council policy before finding a plan that works for them.

V-15-16 Dover Police Department $64,050.39

Applicant requests approval to use funds to purchase tasers and cold weather gear and overtime to target violent crimes.

V-16-16 South Bethany Police Department $18,306.77

Applicant requests approval to use funds to purchase 2 Nighthawk Remote Tire Deflations Devices; 4 Motorola APX 6000 radios; 12 Impres Liion batteries; 1 Impres Multiple Charger; and miscellaneous radio accessories.

Motion for Approval: A motion was made by Attorney General Matt Denn and seconded by Chief Paul Bernat to approve the grant application as submitted. Hearing no discussion, the motion was unanimously approved by the Committee members.

V-17-16 Dagsboro Police Department $9,153.38

Applicant requests approval to use funds to purchase 1 Palmetto PA-15 M4 patrol rifle with initial qualifying ammo, 3 Mossberg 500 Magpul Stock and Breacher Barrell Shotguns with vehicle mounts and 2 Motorola XTL digital radio systems.

Applicant requests approval to use funds for overtime to conduct investigations and foot patrols and to purchase 3 APX 6000 800MHz portable radios with accessories.

Discussion: Chairman Lewis Schiliro asked Chief Randall L. Hughes what the overtime would be used for.

Chief Hughes stated that overtime would be used for the continuation of multiple neighborhood foot patrols, which have proven to be very successful in creating good community relations, in addition to investigations involving the heroin and weapons issues.

V-25-16 Newark Police Department $49,721.06

Applicant requests approval to use funds for undercover vehicle rental; purchase portable surveillance equipment and bicycle unit equipment; and buy/informant funds.

V-26-16 Wilmington Police Department $187,503.06

Applicant requests approval to use funds to acquire one canine with associated start up fees and overtime focused on reducing violent crime.

Discussion: Inspector Clayton Smith stated that the canine will replace a recently retired police dog and the foot patrols would be in sector plans, of the community, targeting high crime trends.

Applicant requests approval to use funds for buy/informant money; training; overtime to combat violent and quality of life crimes; and to purchase 5 Panasonic tablets and 1 Mac Book Pro laptop.

Applicant requests approval to use funds for overtime for drug enforcement; to purchase 1 Watch Guard Camera system, Tactical clothing, 14 Streamlight flashlights, IWC Weapon light mounts, and upgrade AR-15 rifles with sites and mounting lights.

Motion for Approval: A motion was made by Chairman Lewis Schiliro and seconded by Lt. Fred Calhoun to approve the grant application as submitted. Hearing no discussion, the motion was unanimously approved by the Committee members.

V-29-16 Ocean View Police Department $19,409.02

Applicant requests approval to use funds for overtime to conduct special investigations and patrols to combat violent crimes; to purchase supplies to support and enhance the Use-of-Force Simulator, 5 radio batteries for portable radios, and 9 Mossberg 500 shotguns with lights carriers and slings.

Discussion: Chairman Lewis Schiliro asked Chief Ken McLaughlin to explain the Use-of-Force Simulator.

Chief Ken McLaughlin stated that due to current issues regarding use of force, he purchased a Use of Force Simulator for training purposes.. The Simulator is available, at no charge, to all police departments that wish to use it. The supplies will enhance the Simulator to make it more realistic.

V-30-16 New Castle City Police Department $24,369.18

Applicant requests approval to use funds to purchase a cellular phone analyzing system for forensic examinations of cellular phones and a phone analyzing service to pay for analyzing homicide defendant’s cell phone forensic exam.

Discussion: Chief Dan Tjaden requested that his grant be amended to exclude the phone analyzing service in the amount of $4,500 and use the $4,500 for overtime.

Motion for Approval: A motion was made by Lt. Fred Calhoun and seconded by Chairman Lewis Schiliro to approve the grant application as amended. Hearing no further discussion, the motion was unanimously approved by the Committee members.

Applicant requests approval to use funds to purchase 1 APX 6000 portable radio; and establish a “Go Bag” for use in active shooters responses to include: 13 Protech Tactical Assault Carrier vests; 26 Protech Level III ballistic plates (front and back); 13 First Responders trauma kits; 14 ID Patches to attach to ballistic carrier; 13 Black hawk Active Shooter Dynamic Entry Hallagan tools; and 13 tactical backpacks.

Motion for Approval: A motion was made by Chief Paul Bernat and seconded by Lt. Colonel Monroe Hudson to approve the grant application as submitted. Hearing no discussion, the motion was unanimously approved by the Committee members.

V-32-16 Selbyville Police Department $18,306.77

Applicant requests approval to use funds to purchase 2 Motorola portable radios and saturation patrols in high crime areas, drug investigations and criminal investigation overtime. Motion for Approval: A motion was made by Chief Paul Bernat and seconded by Chairman Lewis Schiliro to approve the grant application as amended. Hearing no discussion, the motion was unanimously approved by the Committee members.

V-33-16 Bridgeville Police Department $19,409.02

Applicant requests approval to use funds for overtime in known hot spots; to continue “Coffee with a Cop” program and additional community outreach events; and to purchase an in-car camera and equip 5 patrol vehicles with patrol rifles.

Motion for Approval: A motion was made by Chief Paul Bernat and seconded by Chairman Lewis Schiliro to approve the grant application as amended. Hearing no discussion, the motion was unanimously approved by the Committee members..V-34-16 Frankford Police Department $8,051.13

Applicant requests approval to use funds to purchase and equip a Kawasaki Mule or similar utility vehicle for use in specialized patrols in the areas of the town in addition to local schools and community festival and events that are prone to violent crime activity.

Discussion: Chairman Lewis Schiliro asked Chief Michael Warchol to explain how the ATV purchase would impact violent crime.

Chief Warchol replied that the ATV would allow officers to get closer to the public in areas such as sporting events in addition for ease in rapid response to problems that may occur.

V-36-16 Milton Police Department $18,306.77

Applicant requests approval to use funds for overtime for patrols and investigation regarding violent crimes and to purchase 3 APX 6000 portable radios with accessories, 8 Streamlight Rail mounted tactical lights and 8 Level III duty holsters for Glock 21 with light.

V-37-16 Dewey Beach Police Department $19,409.02

Applicant requests approval to use funds to purchase and install wireless crime cameras to include antennas, mounting and related hardware.

Discussion: Chairman Lewis Schiliro asked how the cameras purchased last year have impacted crimes in Dewey.

Chief Sam Mackert responded that the cameras have detected assaults, 1 abduction, burglaries, in addition to having the ability to zoom in on traffic stops and capturing accidents.

Applicant requests approval to use fund to purchase 1 Windows NAS server, 2 Sig Sauer patrol rifles with weapon light, 3 Pocket Jet 6 in-car printers, 1 APX 6000 Motorola portable radio, 1 speaker microphone, 1 X26-C Taser and 2 Taser holsters.

Discussion: Debby Golden asked that the grant amount be reduced to $8,602.26.

IV. Other Business

Closing comments:

All FY 2015 Fund to Combat Violent Crime Grants must be closed by September 30, 2015;

Chairman Schiliro stated he was pleased with the presentation given by Detective Weaver which represented good trending in the reduction of violent crime;

Chairman Schiliro would like to see more concentration on gun trafficking and finding out where the guns are coming from.

Attorney General Matt Denn stated that he would like to see the statute (Fund to Combat Violent Crime) amended stating money cannot be used to supplant State money. The use of Violent Crime Funds to fund DELJIS fees, although permissible, decreases the funding for the police departments to concentrate on reducing violent crime, for which the fund was created.
