I am counng down the days to June 27 th , when as the song goes, I’ll be “leaving on a jet plane,” headed for the excitement of Las Vegas, Nevada. Why? Not for the gambling and sun, but for the SHRM Annual Conference and Exposion. 2014 Employment Law Update for Maryland, Virginia and the District of Columbia. The presentation will take a tour of the

key cases from state and federal cases that most impact the day-to-day lives of Human Resource Professionals. It will also

include an update on important legislation.

About the Speakers:

James R. Hammerschmidt is a principal of the Paley Rothman Law firm and Co-Chair of the firm’s Employ-

ment Law practice group, as well as a member of its Litigation and Appellate practice groups, whose prac-

tice includes a wide range of commercial, corporate and employment counseling and litigation.

His general civil litigation and appellate practice experience includes matters involving real estate, land

development, breach of contract, trusts and estates, construction, shareholder disputes, business dis-

putes, consumer protection law, RICO, conspiracy and defamation among many others.

Mr. Hammerschmidt has equally extensive experience representing and counseling clients on employment law issues. He

represents clients in federal and state court, as well as before agencies such as the EEOC, Department of Labor and local

and state human rights commissions and labor departments, involving claims arising under Title VII, ERISA, FLSA, FMLA,

ADA, ADEA, Wage Payment and Collection Law and Wage and Hour Law statutes. He counsels clients on and litigates a

wide range of employment issues such as breach of contract, wrongful termination, trade secret claims and non-

competition and non-solicitation agreements. In addition to litigation, he provides daily advice to clients dealing with diffi-

cult employees and employee discipline, and routinely assists clients in developing and implementing employment policies

and practices, drafting employee manuals and preparing employment agreements. Mr. Hammerschmidt has been recog-

nized for his outstanding work in employment law with his inclusion on the 2014 Maryland Super Lawyers list.

IRS Issues Cadillac Tax Guidance by: Alan Schulman On February 23, 2015, the Internal Revenue Service (IRS) issued Notice 2015-16 to initiate and inform the process of develop-ing regulations on the excise tax on high –cost employer-sponsored health coverage under Code §49801, also known as the “Cadillac Tax.” Beginning in 2018, if the aggregate cost of applicable employer-sponsored coverage provided to an employee exceeds a statutory dollar limit, the excess is subject to a 40% excise tax. Below are the highlights.

Defining applicable coverage – The Notice lists the types of plans specified as applicable coverage, which include health FSAs, HSAs, governmental plan, retiree coverage, and some on-site medical clinics. Excluded from applicable coverage are long-term care, standalone dental or vision, and fixed indemnity coverage. The Notice indicates that employer HSA and Archer MSA con-tributions (including salary deduction HSA contributions) would be considered applicable coverage, while employee after-tax contributions would be excluded. Coverage through on-site clinics providing only the minimis (limited value) medical care, EAPs, and limited-scope dental or vision benefits are also excluded from qualifying as excepted benefits under final regula-tions.

Determining cost of applicable coverage – The Notice clarifies that the Cadillac Tax is determined based on the cost of applica-ble coverage in which the employee is actually enrolled. The cost of applicable coverage is determined under rules similar to those for determining the COBRA applicable premium, with additional elements. For example, costs are calculated separately for “self-only” coverage and “other-than-self-only” coverage, and special rules apply for retiree coverage, health FSAs, HSAs, and Archer MSAs. The Notice acknowledges existing COBRA-related challenges in computing premiums, such as determining who is “similarly situated” and calculating applicable premiums for self-insured plans and HRAs.

Applying the annual dollar limit – Different statutory dollar limits apply depending on whether the employee has self-only ($10,200 limit) or other-than-self-only coverage ($27,500 limit). The IRS is considering several approaches to clarify the appli-cation of the dollar limit when an employee simultaneously has one type of coverage (e.g., major medical coverage) that is self-only coverage and another type of coverage (e.g., and HRA) that covers the employee and the employee’s family. The dollar limits are subject to various adjustments, including a “health cost adjustment percentage” for 2018 and cost-of-living adjust-ments for subsequent years and adjustments for certain retirees and employers whose workforce age and gender characteris-tics vary from the national norm. Adjustments are also applicable for participants in plans primarily covering employees in specified high-risk professions (such as law enforcement and first responders). The Notice seeks input on how to determine whether a plan meets the applicable criteria and on whether further guidance on high-risk profession is desirable.

The Notice sets forth potential approaches and invites comments from the public. The IRS plan to issue another notice inviting comments on additional topics related to the Cadillac Tax before releasing proposed rules.
