EXTENSION OF IMPORT RESTRICTIONS IMPOSED ONARCHAEOLOGICAL AND ETHNOLOGICAL MATERIALS
FROM THE REPUBLIC OF MALI
AGENCY: U.S. Customs and Border Protection, Department ofHomeland Security; Department of the Treasury.
ACTION: Final rule.
SUMMARY: This final rule amends the U.S. Customs and BorderProtection (CBP) regulations to reflect an extension of import restric-tions on certain archaeological materials from Mali. These restric-tions, which were originally imposed by Treasury Decision (T.D.)93–74, and last extended by CBP Decision (Dec.) 12–14, are due toexpire on September 19, 2017. The Acting Under Secretary for PublicDiplomacy and Public Affairs, United States Department of State,has determined that conditions warrant the continued imposition ofimport restrictions on certain archaeological materials and the addi-tion of import restrictions on certain ethnological materials fromMali. The Designated List of cultural property described in CBP Dec.07–77 is revised in this document to reflect the addition of ethnologi-cal materials to include manuscripts dating between the twelfth andtwentieth centuries in paper. The import restrictions imposed on thearchaeological and ethnological materials from Mali will be in effectfor a five-year period, and the CBP regulations are being amendedaccordingly to reflect this extension through September 19, 2022.These restrictions are being imposed pursuant to determinations ofthe United States Department of State made under the terms of theConvention on Cultural Property Implementation Act, which imple-ments the 1970 United Nations Educational, Scientific and CulturalOrganization (UNESCO) Convention on the Means of Prohibitingand Preventing the Illicit Import, Export and Transfer of Ownershipof Cultural Property.

SUPPLEMENTARY INFORMATION:
Background
Pursuant to the provisions of the Convention on Cultural PropertyImplementation Act (hereafter, “the Cultural Property Implementa-tion Act” or “the Act” (Pub. L. 97–446, 19 U.S.C. 2601 et seq.)), whichimplements the 1970 United Nations Educational, Scientific and Cul-tural Organization (UNESCO) Convention on the Means of Prohib-iting and Preventing the Illicit Import, Export and Transfer of Own-ership of Cultural Property (hereinafter, the Convention) in U.S. law,the United States may enter into international agreements withanother State Party to the Convention to impose import restrictionson eligible archaeological and ethnological materials under proce-dures and requirements prescribed by the Act.
In certain limited circumstances, the Cultural Property Implemen-tation Act authorizes the imposition of restrictions on an emergencybasis (19 U.S.C. 2603(c)(1)). Under the Act and the applicable CBPregulations (19 CFR 12.104g(b)), emergency restrictions are effectivefor no more than five years from the date of the State Party’s requestand may be extended for three years where it is determined that theemergency condition continues to apply with respect to the coveredmaterials (19 U.S.C. 2603(c)(3)); such restrictions may also be con-tinued pursuant to an agreement concluded within the meaning ofthe Act (19 U.S.C. 2603(c)(4)).
On September 23, 1993, under the authority of the Cultural Prop-erty Implementation Act, the former U.S. Customs Service publishedTreasury Decision (T.D.) 93–74 in the Federal Register (58 FR49428) imposing emergency import restrictions on archaeological ob-jects from the region of the Niger River Valley of Mali and theBandiagara Escarpment (Cliff), Republic of Mali (Mali) and accord-ingly amended 19 CFR 12.104g(b).
On September 19, 1997, the United States entered into a bilateralagreement with Mali that continued without interruption the importrestrictions previously placed on the same archaeological material.On September 23, 1997, the former U.S. Customs Service published

T.D. 97–80 in the Federal Register (62 FR 49594), which amended19 CFR 12.104g(a) to reflect the imposition of these restrictions, andincluded a list designating the types of archaeological material cov-ered by the restrictions. (T.D. 97–80 also removed the emergencyrestrictions for Mali from 19 CFR 12.104g(b).)
Under the Act and applicable U.S. Customs and Border Protection(CBP) regulations (19 CFR 12.104g), the restrictions are effective forno more than five years beginning on the date on which the agree-ment enters into force with respect to the United States (19 U.S.C.2602(b)). This period may be extended for additional periods, eachsuch period not to exceed five years, where it is determined that thefactors justifying the initial agreement still pertain and no cause forsuspension of the agreement exists (19 U.S.C. 2602(e); 19 CFR12.104g(a)). On September 20, 2002, the former U.S. Customs Servicepublished T.D. 02–55 in the Federal Register (67 FR 59159), whichamended 19 CFR 12.104g(a) to reflect the extension of these importrestrictions for an additional period of five years until September 19,2007.
On September 19, 2007, CBP published CBP Decision (Dec.) 07–77in the Federal Register (72 FR 53414), which amended 19 CFR12.104g(a) to reflect the extension and amendment of the importrestrictions for Mali. The 2007 amendment added import restrictionson new subcategories of objects throughout Mali from the PaleolithicEra (Stone Age) to approximately the mid-eighteenth century in theamended Designated List for an additional period of five years untilSeptember 19, 2012.
On September 19, 2012, CBP published CBP Dec. 12–14 in theFederal Register (77 FR 58020), which amended 19 CFR 12.104g(a)to reflect the extension of the import restrictions for an additionalperiod of five years until September 19, 2017.
On March 14, 2017, by publication in the Federal Register (82 FR13706), the United States Department of State proposed to extend theAgreement between the United States and Mali concerning the im-position of import restrictions on archaeological material from Malifrom the Paleolithic Era (Stone Age) to approximately the mid-eighteenth century. Pursuant to the statutory and decision-makingprocess, the Designated List of materials covered by the restrictionsis being amended to include certain ethnological materials, specifi-cally manuscripts dating between the twelfth and twentieth centu-ries in paper. Thus, the Agreement now covers both the previouslycovered archaeological materials, as set forth in the Designated Listpublished in CBP Dec. 07–77, and the additional ethnological mate-rials (see 19 U.S.C. 2604, authorizing the Secretary of the Treasury,by regulation, to promulgate and, when appropriate, revise the list ofdesignated archaeological and/or ethnological materials covered byan agreement between State Parties to the Convention).

On August 7, 2017, the Acting Under Secretary for Public Diplo-macy and Public Affairs, United States Department of State, deter-mined that the cultural heritage of Mali continues to be in jeopardyfrom pillage of certain archaeological materials and is also in jeop-ardy from the pillage of certain ethnological materials. The ActingUnder Secretary made the necessary determination to extend theimport restrictions for an additional five-year period to September 19,2022, and to include in their coverage ethnological materials, specifi-cally manuscripts dating between the twelfth and twentieth centu-ries in paper. An international agreement has been concluded reflect-ing the extension of the Agreement and, pursuant to the Agreement,the import restrictions are being extended, as described in this docu-ment and as applicable to the revised Designated List set forth in thisdocument. Thus, CBP is amending 19 CFR 12.104g(a) accordingly.Importation of covered materials from Mali will be restricted throughSeptember 19, 2022. Importation of such materials from Mali contin-ues to be restricted through that date unless the conditions set forthin 19 U.S.C. 2606 and 19 CFR 12.104c are met.
In this document, the Designated List of articles that was publishedin CBP Dec. 07–77 is amended to include ethnological materialscomprised of manuscripts dating between the twelfth and twentiethcenturies in paper. The articles described in the Designated List setforth below are protected pursuant to the Agreement.
Amended Designated List
This Designated List, amended as set forth in this document, in-cludes archaeological material that originates in Mali, ranging indate from the Paleolithic Era (Stone Age) to approximately the mid-eighteenth century A.D. These materials include, but are not limitedto, objects of ceramic, leather, metal, stone, glass, textiles, and wood.The Designated List also includes a certain category of ethnologicalmaterial, namely manuscripts dating between the twelfth and twen-tieth centuries in paper. The Designated List and more informationon the import restrictions can be obtained from the Mali countrysection of the International Cultural Property Protection Web site athttp://exchanges.state.gov/heritage/culprop/mlfact.html.

Archaeological Material (Dating From the Paleolithic Era (Stone Age)to Approximately the Mid-Eighteenth Century)
I. Ceramics/Terra Cotta/Fired Clay
Types of ceramic forms (stylistically known as Djenné-Djeno orJenne, Bankoni, Guimbala, Banamba, Bougouni, Bura and otherstylistic labels) that are known to come from the region include, butare not limited to:
A. Figures/Statues.
1. Anthropomorphic figures, often incised, impressed and withadded motifs, such as scarification marks and serpentinepatterns on their bodies, often depicting horsemen or indi-viduals sitting, squatting, kneeling, embracing, or in a po-sition of repose, arms elongated the length of the body orcrossed over the chest, with the head tipped backwards. (H:2 to 20 in.)
2. Zoomorphic figures, often depicting a snake motif on statu-ettes or on the belly of globular vases. Sometimes the ser-pent is coiled in an independent form. A horse motif iscommon, but is usually mounted. Includes quadrupeds. (H:2 to 16 in.)
B. Common Vessels.
1. Funerary jars, ocher in color, often stamped with chevrons.(H: 20 to 32 in.)
2. Globular vases often stamped with chevrons and serpentineforms. (H: under 4 in.)
3. Bottles with a long neck and a belly that is either globular orstreamlined. Some have lids shaped like a bird’s head.
4. Ritual pottery of the Tellem culture, decorated with a char-acteristic plaited roulette.
a. Pot made on a convex mold built up by coiling.
b. Hemispherical pots made on three or four legs or feetresting on a stand.
5. Kitchen pottery of the Tellem culture with the paddle-and-anvil technique decorated with impressions from wovenmats.

a. Anthropomorphic figures, including equestrian figuresand kneeling figures. (Some are miniatures no taller than2 inches; others range from 6 to 30 in.)
b. Zoomorphic figures, such as the bull and the snake.
2. Bells (H: 4 to 5 in.) and finger bells (H: 2 to 3 in.).
3. Pendants, known to depict a bull’s head or a snake. (H: 2 to4 in.)

A variety of glass beads have been recovered at archaeological sitesin Mali.
VI. Textiles
Textile objects, or fragments thereof, have been recovered in theTellem funerary caves of the Bandiagara Escarpment and include,but are not limited to:
A. Cotton.
1. Tunics.
2. Coifs.
3. Blankets.
B. Vegetable Fiber.
Skirts, aprons and belts made of twisted and intricately plaitedvegetable fiber.

VIII. Manuscripts
Manuscripts and portions thereof from the Mali Empire, SonghaiEmpire, pre-Colonial, and French Colonial periods of Mali (twelfth toearly twentieth centuries), including but not limited to Qur’ans andother religious texts, letters, treatises, doctrines, essays or other suchpapers spanning the subjects of astronomy, law, Islam, philosophy,mathematics, governance, medicine, slavery, commerce, poetry, andliterature, either as single leaves or bound as a book (or “codex”), andwritten in Arabic using the Kufic, Hijazi, Maghribi, Saharan, Sudani,Suqi, Nashk, or Ajami scripts written on paper.
Inapplicability of Notice and Delayed Effective Date
This amendment involves a foreign affairs function of the UnitedStates and is, therefore, being made without notice or public proce-dure under 5 U.S.C. 553(a)(1). In addition, CBP has determined thatsuch notice or public procedure would be impracticable and contraryto the public interest because the action being taken is essential toavoid interruption of the application of the existing import restric-tions (5 U.S.C. 553(b)(B)). For the same reason, a delayed effectivedate is not required under 5 U.S.C. 553(d)(3).
Regulatory Flexibility Act
Because no notice of proposed rulemaking is required, the provi-sions of the Regulatory Flexibility Act (5 U.S.C. 601 et seq.) do notapply.

sole electronic data interchange (EDI) system authorized by the Com-missioner of CBP for processing electronic Foreign Trade Zone (FTZ)admission applications. This notice announcesthat the date for the transition to ACE as the sole CBP-authorizedEDI system for electronic FTZ admission applications is delayed untilDecember 9, 2017.
DATES: As of December 9, 2017, ACE will be the sole CBP-authorized EDI system for processing electronic FTZ admissionapplications, and the Automated Commercial System (ACS) will nolonger be a CBP-authorized EDI system for purposes of processingthese filings.

On August 16, 2017, U.S. Customs and Border Protection (CBP)published a notice in the Federal Register (82 FR 38923) announc-ing plans to make the Automated Commercial Environment (ACE)the sole electronic data interchange (EDI) system authorized by theCommissioner of U.S. Customs and Border Protection (CBP) for pro-cessing electronic Foreign Trade Zone (FTZ) admission applications,as of September 16, 2017. The document also announced that, onSeptember 16, 2017, the Automated Commercial System (ACS) wouldno longer be a CBP-authorized EDI system for purposes of processingthese electronic filings. Further, the document announced that thetest program would be extended until a decision is reached to imple-ment the program on a permanent basis and/or to conclude the test.Finally, the notice clarified that the list of data elements required forthe electronic FTZ admission application must include the “Zone ID,”and reminded test participants that they must provide the dataelements “Steel Import License Number” and “Kimberley ProcessCertificate Number” to CBP.
CBP has been assessing stakeholder readiness for the mandatorytransition of electronic FTZ admission applications from ACS to ACE.CBP has determined that industry partners need additional time toprepare for the transition to electronic capabilities in ACE.

ACTION: Notice of approval of Inspectorate America Corporation(Sulphur, LA), as a commercial gauger.
SUMMARY: Notice is hereby given, pursuant to CBP regulations,that Inspectorate America Corporation (Sulphur, LA), has been ap-proved to gauge petroleum and certain petroleum products for cus-toms purposes for the next three years as of March 29, 2017.
DATES: Inspectorate America Corporation (Sulphur, LA) wasapproved as a commercial gauger as of March 29, 2017. The nexttriennial inspection date will be scheduled for March 2020.

Notice is hereby given pursuant to 19 CFR 151.13, that Inspec-torate America Corporation, 384 North Post Oak Road, Sulphur, LA70663 has been approved to gauge petroleum and certain petroleumproducts for customs purposes, in accordance with the provisions of19 CFR 151.13. Inspectorate America Corporation is approved for thefollowing gauging procedures for petroleum and certain petroleumproducts from the American Petroleum Institute (API):
