Dear Mr. Brooks:

This refers to the telephone conversation between you, Colleen Carol Casey, and me on October 25, 201 0, regarding your letter dated July 29, 201 0, transmitted to us via facsimile on July 29, 2010, requesting an amendment to your NRC Material License No. 21-24685-01. Specifically, a request to increase your possession limits to support receiving portable density gauges from Detroit Water and Sewage Department (DWSD).

You letter July 29, 201 0, states that you want to receive four Campbell Pacific Nuclear Gauges from DWSD. You further explain that it is your understanding that DWSD will be without a Radiation Safety Officer (RSO) and a “valid materials license;” the basis for you submitting the amendment request. In addition, you stated that you plan not to use the gauges that would be transferred to you from DWSD,

Again, referring to our October 25, 2010 telephone conversation, we informed you that we have voided your amendment request in the letter dated July 29, 2010. We are unable to approve your request to receive radioactive materials that will not be used. We also requested that you please have DWSD contact Mike Herr at (630) 829-9752 or Colleen Carol Casey at (630) 829-9841 to allow us to provide guidance in their license activities.

In accordance with 10 CFR 2.390 of the NRC’s “Rules of Practice,” a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the NRC’s Agencywide Documents Access and Management System (ADAMS), accessible from the NRC Web site at httD://www. nrc.aov/readinn-rm/adams. html.
