From the President

The pastThis is the time of year when wereflect on the year just gone and try tolook positively to the future, but whatcan we say about 2009 that has notalready been said? It will surely godown in history as a turning point forthe global economy. I suspecthistorians will say this was really thetime when the economic powerstarted to shift eastwards towardsChina. The catalyst of this changewas, of course, the financial crisis,which went on to be a generaleconomic crisis. In our industry theimpact has been devastating in allexcept some very niche sectors. It isgenerally recognised that our sectorhas suffered a decline of anywherebetween 30 and 80 per cent.

The futureSo is 2010 going to be any better?This is an impossible question at anytime, but particularly now as we aresurrounded by so much uncertaintyas to Government finances and thefact that a General Election will beheld soon. The consensus view onthe economy seems to be that wehave bottomed out, but there is norecovery imminent - I think this iswhat is described as a "U" shapedrecovery. It means that sales to finalusers will not increase so much, buthopefully manufacturers can increaseproduction due to the fact that suchlarge inventory reductions took placein 2009.

The CEAUnder these circumstances the CEAhas remained active in lobbyingGovernment to support our sector asmuch as possible. We have joinedwith calls from the EEF to promotemanufacturing, via the ManufacturingAlliance, as a route to a morebalanced economy. We also lend ourvoice to the wider constructioninterest in underlining how investmentin infrastructure pays immediatedividends in jobs and longer-termbenefits to social welfare andbusiness efficiency. We will focus onsome of these issues and ourindustry specific agenda at our AGMconference to be held on 17 March -at the now usual venue of One GreatGeorge Street, Westminster. A dateto note in your new 2010 diary.

Our latest survey showed that oneof the major things valued bymembers is the ability to network atCEA events. With this in mind, andalso to ensure we keep as many ofyou up to speed with all the work weare doing, we are planning to hold amid-year working conference anddinner (probably sometime inSeptember). At this conference weplan a more detailed update on CEAactivities - presented by yourAssociation's directors and officers.

The 2009 surveyThank you to all those members that

contributed to our end of year survey.

Your sales figures confirmed how tough

2009 was. From the CEA's standpoint,

we gained a lot of useful information and,

although we need to keep working, it was

good to note that 95 per cent plus of

respondents felt that CEA membership

was positive value for money.

Services and activitiesWe asked about the services and

activities that you most value for your

membership investment. The top 5 were:

New opportunitiesThese results have helped us set the

programme for 2010 - which will include

new opportunities to meet together to

discuss business and key issues for our

sector. We also aim to make sure that we

have a clear voice on legislative and

economic issues in the run up to the

General Election.

CEA working for youIn an open question on what action you

would like to see from Government that

would benefit our sector, there were some

very direct answers. These added up to

the wish for the CEA to push even harder

to ensure politicians and decision makers

realise the true value of manufacturing

and construction to the UK economy.

MarketTrends

UK construction outputthird quarter 2009The total volume of construction output in

the third quarter of 2009 rose by two per

cent compared with the second quarter of

2009. The rise in repair and maintenance

of ten per cent was offset by a fall in new

work of four per cent. The total volume of

construction output in the 12 months to

the third quarter of 2009 fell by eleven per

cent compared with the previous 12

month period. The total volume of new

work in the 12 months to the third quarter

of 2009 was twelve per cent lower

compared with the previous 12 months

and was four per cent lower in the third

quarter when compared with the previous

quarter. The total volume of repair and

maintenance work fell by eight per cent in

the 12 months to the third quarter of 2009

compared with the previous 12 months,

but was ten per cent higher in the third

quarter of 2009 compared with the

previous quarter.

Membership subscriptions freeze confirmedThe CEA’s Management Council has

confirmed a further freeze in membership

subscription scales for 2010. This means

that there has been no increase in

subscriptions in real terms for three years.

In fact, many members will pay less in

2010, as for most membership categories

subscriptions decrease in relation to falls

in sales. CEA members that have

reported their latest turnover figures will

have this reflected in their membership

subscription assessments. Good news

too for smaller companies, as the new

maximum subscription for those with an

average turnover below £2 million per

annum, dips to just £595 (ex VAT) a year.

Lisbon Treatymeans new challenges for CECEAfter eight years of negotiation and stop-start the Lisbon Treaty came into force on1 December 2009. The headline changeswere the appointment of a permanentCouncil President (Herman Van Rompuy)and a High Representative of the EU forForeign Affairs and Security (step forwardCatherine Ashton). Whilst the EuropeanCommission retains the right to proposenew legislation, the Treaty extends theinvolvement of both national parliamentsand the European Parliament (EP) itself.National bodies have the right tocomment on Commission proposalswithin an eight week timeframe - and ifone-third of national parliaments reject aproposal it can be referred back toBrussels. Under the ordinary legislativeprocedure the EP has increased rights ofco-decision making. Meanwhile theCouncil of Ministers can look forward toqualified majority voting - but not until2014. Whilst the changes are fairlyarcane, CECE has identified threechallenges arising from the Treaty and theappointment of the new EuropeanCommission. The new Commissioner forIndustry and Entrepreneurship is AntonioTajani. CECE must forge strong relationswith the Commissioner and his cabinet to

ensure that the CONEQT (ConstructionEquipment for Tomorrow) project andother key policies are progressed.Second, the growing role of MEPs needsto be reflected in CECE's priorities todevelop contacts with key representativeson parliamentary committees and withinthe major power blocs. This is a difficultchallenge - there are 498parliamentarians under the new Lisbonrules, from 27 countries. However, theCEA can contribute to this by fosteringrelations with UK MEPs - somethingwhich will be a priority for us in 2010. TheLisbon Treaty also, for the first time,explicitly commits the EU to addressclimate change. In the constructionequipment industry we are used todealing with Commission concerns onmachine noise and pollutants - but it isnow likely that CO2 emission restrictionswill rise to the top of the agenda. This isthe third area where CECE must beprepared to lead new policy discussions.Whatever the decision making regime, wehave learnt from experience that the drivefor more regulation is a continuousprocess with which we must engage - atboth European and UK level.

New CECE Presidenttakes officeThe new President of CECE took office

on 1 January. He is Jose Luis del Prim of

ENARCO - the Spanish concrete

machinery manufacturer. As a

representative of the Spanish trade

association, ANMOPyC, he steps up from

the office of 1st Vice-President of CECE

and succeeds Dr Tim Leverton. Mr Del

Prim is particularly interested in ensuring

the voice of SMEs is heard within Europe

and he will host the 2010 CECE

Congress in Barcelona (20-22 October).

When overall markets have been so badin the last year or so, we have to welcomeany sign of optimism. The latest CECEBusiness Barometer reports that most ofthe major European markets now seem tohave bottomed out. In their latest monthlysurvey of construction equipmentbusinesses across Europe, 37 per cent ofrespondents expected a salesimprovement over the next half year(compared with 25 per cent a monthearlier) - with "no change" predicted by 42

CECE reports increase in business optimismper cent (up from 34 per cent). 83 percent felt that France had reached thebottom of the cycle, compared with 76 percent for the UK and 73 per cent forGermany. Government investment in construction is the most beneficial use of stimulative public expenditure inboth the short and longer term, and any reduction in construction expenditure would have significant,immediate and enduring negative consequences for the UK.

Impact on economic activityConstruction is one of the best ways of stimulating economic activity - not just in the constructionsector, but across the economy as a whole, including troubled manufacturing sectors. It also hasone of the lowest levels of imports, so the stimulus spending stays within the national economy.

Contribution to employmentConstruction is the best sector for stimulating employment. The employment that constructionprovides benefits lower skilled and young workers who have relatively few alternative opportunities.Many regions are heavily dependent on construction jobs.

Benefits of investmentConstruction is not only immediate economic production, it is also investment rather thanconsumption, which provides significant long-term economic and social benefits.

Technical BriefingExhaust Emissions:potential increase in OEM flexibility

The construction equipment industry,together with engine manufacturers andagriculture, has identified an increase inthe flexibility allowance from 20 to 50 percent (at least) as a priority for Stage IIIBrequirements which start in 2011. TheCommission has agreed to anaccelerated procedure to present aproposal to the European Parliament andCECE has urged national associations tolobby governments to press for thechange. Flexibility was one of the four

requests discussed with Commission VicePresident Verheugen in March 2009,following the CECE letter aboutimmediate actions that could be taken toassist the construction equipment industryin the current economic climate.Commission Services are known to bepreparing the proposal for an amendingDirective to increase OEM flexibility.CECE has engaged with Commission andprovided considerable input. Theproposal has met some resistance within

Exhaust Emissions:in-service conformity (PEMS or OBD - on-board diagnostics)

Following the requirements of the 2007technology review to assess the need forin-use compliance tests, the Commissionhas initiated a test programme. This willassess the use of PEMS (portableemissions measurement systems)equipment to measure emissions of theengines installed in non-road mobilemachinery (construction and agricultural)during the real working day. The USA iscurrently ahead of the EU in developing anon-road in-use test programme and it isanticipated that proposed rules will bepublished this year, requiring all enginemanufacturers to take part in a pilotprogramme. PEMS are complex, costlyand sizeable devices and have alreadybeen developed for the on-highway trucksector, but the operating requirements arevery different for the off-road sector. Inorder to perform a measurement thePEMS system would be temporarilyconnected to the exhaust system of the

machine being tested. Although PEMSare aimed more at engine performancethan the equipment to which they areattached, equipment manufacturers haveexpressed concerns about safety aspectsof mounting PEMS on in-use equipment.PEMS can affect visibility and place veryhot exhaust systems near operators.There are also doubts about the durabilityof PEMS in construction site situations.No proposals of how a future EU non-road in-use conformity programme usingPEMS could be managed have yet beenmade, but the Commission is obliged toreport to Parliament and Council on thisissue when they next make amendmentsto the Directive. The CEA will work withthe CECE Emissions PT to develop aposition paper to explain why PEMS is notthe right method to address the intent ofthe Directive on in-service compliance,using feedback from an industry pilotexercise conducted during 2009.

Machinery Directive:new regulations for 2010

Machines placed on the market from 29December 2009 must comply with theprovisions of Directive 2006/42/EC, whichreplaces 98/37/EC. There are a numberof requirements of concern to CEAmembers, but the most critical ones havebeen favourably treated in theCommission guidance followingprolonged input from CECE and otherindustries. These include a newrequirement for fixed fastenings onguards and a new requirement for everyitem of equipment used for lifting toundergo a static and dynamic test. Alarge part of the Commission guidancehas been completed and was launched ata Machinery Conference held in Brusselson 9 December. A 2nd Edition will becompleted by March 2010 and the wholeguidance will be subject to review andamendment as considered necessary.However, there are still two importantsubjects for the CEA and CECE toresolve. One is the classification ofattachments used for earthmovingmachines within one of three categories -basic attachments or tools,interchangeable equipment and partlycompleted machinery (pcm). Thedefinition and status of pcm remains acomplicated issue and the CEA has inputsome text to CECE to help clarification,particularly with regard to quick couplers.The second issue is regarding therequirement for information on vibrationemissions to be included in salesliterature for machinery. However, asthere is no agreed testing procedure,every manufacturer designs and conductsits own tests according to what it feels isappropriate for the machine and likelyduty cycles. This means that there is nodirect comparison possible, althoughcustomers are likely to favour machinesfor which a lower value has beendeclared.

Exhaust Emissions:retrofit DPFs and London Best Practice Guide (BPG)

The Greater London Authority (GLA) isresponsible for the Best Practice Guide(BPG) on reducing dust and engineemissions on construction sites. Itrequires diesel particulate filter systems(DPFs) to be fitted to new or existing non-road machinery above 37 kW, eventhough the reduction in particulatesprovided by DPFs will, in any case, berequired by Stage IIIB from 2011. TheCEA has played an important part in thelong-running discussions that have voicedindustry concerns about safety, fuelresources, costs to companies,warranties, etc. The CEA has alsoexplained that the PUWER regulationswould be put at risk when DPFs are fitted.The CEA raised the profile of the industrycase in a press release following theEnergy Industries Commission (EIC) letterto the DfT minister to seek nationwideacceptance of the BPG scheme. Thisexplained the CEA’s support for improving

air quality, but pointed out that there is alack of evidence to show that constructionsite equipment is a significant contributorto diesel particulates, as EIC contends.Ongoing safety after retrofitting has notbeen guaranteed and the CEA continuesto support the increasingly tough EUstages of engine emissions reduction thatare leading to orderly technologydevelopments and which will providelower emissions with proven technology.The Olympic Delivery Authority (ODA) hasrecently decided to conduct its own studyinto the costs and benefits of fitting DPFs.This will comprise an exercise to calculatethe theoretical costs and emissionsreduction followed by a practical test inthe Olympic Park to see whether fittingDPFs was beneficial. The trial isexpected to start this year and could lastup to 12 months. There does not seem tobe much implementation of this aspect ofthe BPG on other major sites.

Commission and the CommissionServices did not complete the necessaryinternal review and sign-off the proposalbefore the term of office of the previousCollege of Commissioners ended on 31October 2009. The proposal cannot nowbe adopted by the Commission andreleased to Council and Parliament untilafter the new College of Commissionersis confirmed, the earliest being the end ofJanuary 2010. As such, the outcome ofthe co-decision is not likely to be known

before the third quarter of 2010 - and anychange in law would be unlikely before2011. So the increase, if agreed, will stillbe on time for Stage IIIB. However, evenif the proposal is sent to Parliament andCouncil, a positive outcome is notassured. At a suitable point in time it maybe necessary for the CEA to advocate toMEP's the importance of this amendment,in order to maximise the probability of apositive vote in the European Parliament.

BICES : Beijing, China03-06 November 2009Despite an unexpectedly early blizzard,which stretched into a week-long freeze ina new exhibition centre with no heating -BICES was an excellent show. Held atthe Jiu Hua International ExhibitionCentre just outside Beijing, a purpose-built, if not entirely completed, exhibitioncomplex featuring a 4,000 room hotel andoffering "hot springs with billiards", BICES2009 saw over 900 exhibitors taking150,000 sqm of exhibition space. A greatachievement in these times of economicdownturn. It was disappointing that theUK Pavilion was very small - only fourexhibitors, plus two companies takingExport Pods. However, we were stillgiven a prime location right by the mainentrance and made the most of ourpresence by flying the flag for UKmanufacturing. Four companies alsobenefited from a £1,400 grant at BICES.The CEA, generously supported by UKTrade & Investment, hosted a networkingdinner during the show. BICES featuredan exhibition celebrating 60 years of

Chinese construction equipment. As wellas a fascinating insight into the genesisand development of the Chinese sector, itwas great to see Off-Highway Researchand the KHL Group featured in theexhibition. On a personal note, I washumbled to find myself included in fourphotos in the exhibition at variousopening and signing ceremonies over theyears that the CEA has been helping UKcompanies to do business in China. Meet the buyer seminar and factory visitsXiamen, ChinaSupported by UK Trade & Investment andorganised by the CEA and Off-HighwayResearch, six UK manufacturersparticipated in the 2009 China Meet theBuyer Seminar. At the invitation of theFujian Special Machinery Association, wevisited Xiamen in Fujian Province in thesouth-east of China, opposite Taiwan andone of China's premier seaside resorts.After a weekend spent warming up afterBICES, the UK group visited the verylarge XGMA plant, Xiamen WheeledLoaders, who entertained us to anexcellent lunch and showed us roundtheir factory and the impressive Linde LiftTrucks factory. We are grateful to allthese companies for giving up their timeand for listening to the UK manufacturers.We hope some good business will arisefrom these meetings. The seminar washeld on 10 November and well attendedby almost 50 delegates. UK companies,including Perkins Engines, GKD Technik,Trelleborg and Off-Highway Research, as

well as Alan Woods from BIS (UKDepartment of Trade) and JamesMcGuire from UKTI in Guangzhou, madepresentations in the morning session.This was followed by a networking lunchand one to one meetings in the afternoon.Speakers reported the seminar as beingvery valuable in meeting new contactsand in raising their own company profileby being associated with an official UKGovernment event.

Excon : Bangalore, India25-29 November15 UK manufacturers exhibited on theCEA organised UK Pavilion at Excon - arecord UK presence in India and well upon the four UK companies that exhibitedat Excon 2007. 14 UK companiesreceived UKTI grants of £1,400 each.The exhibition saw around 30,000 visitorsover the five days and 400 exhibitors,making it the largest event for our sectorcurrently held in India. It is always achallenge for the CEA as grouporganisers to run a Pavilion in India, andthis year's Excon was no exception - butthat is why we offer the service as part ofthe CEA benefits - and judging by thecomments received from exhibitors, wedid our job and made it easy for Pavilionparticipants.

Meet the buyer seminarBangalore, IndiaWith support from UK Trade &Investment, the CEA were able to run aMeet the Buyer Seminar on 24 Novemberat the Golden Palms Conference Centrein Bangalore. Nine UK companies madepresentations to an audience of over 50Indian manufacturers, distributors andcontractors. Speakers were the CEA,GKD Technik, JCB, Miller UK, MIRA, Off-Highway Research, Spiroll, Telestack,Trelleborg and Webtec. The Seminar washeld in a rather curious venue after thehotel double booked the conference suite.It was supposed to be an Italianrestaurant - but immediately renamed theHarry Potter Enchanted Forest thanks tothe twelve ceiling height plastic trees thatlined the walls and a waterfall in thecorner. Everyone expected to see Hagridemerge with a baby dragon tucked underhis arm at any moment! The seminar wasorganised with the help of Indianconsultants, Continex, who also assistmanufacturers looking for Indian partnersor to source components. Thanks toContinex, a large backdrop was installedand the room became slightly less"Potteresque". The seminar proceededwithout a hitch and was well received byboth delegates and speakers alike.

The CESAR review committee works todevelop and improve the CESARscheme. The statistics are now beginningto show clear advantages to joining thescheme. Committee members includethe police, insurers, CEA manufacturersand staff, the scheme providers, Datatag,and the AEA (Agricultural EngineersAssociation). The last meeting, held atPerkins in Peterborough in earlyDecember 2009, discussed clearerprocedures and expansion of the schemein the UK and Europe.

Farmers and contractors buying a newMcCormick tractor in 2010 can enjoylower insurance premiums and theirmachines are less likely to be stolenthanks to joining the industry-leadinginitiative. From January 2010, all newMcCormick tractors will be registered withCESAR, the construction and agriculturalequipment theft deterrence and vehicleidentification scheme, free of charge.

Kubota, of the UK mini-excavator market,has announced that it is to fit the CESARregistration and security system to two ofits popular excavator models. Themachines are the U17-3, a 1,650kg mini-excavator, and the KX080-3, a 8,300kg
