SUMMARY OF THE MAIN PROVISIONS AS AT 1 DECEMBER 1985

UNEMPLOYMENT INSURANCE ACT, 1966

While it is not possible to set out fully in this summary all the provi­sions of the Unemployment Insurance Act, 1966, it is essential that the main purposes and requirements of the Act should be known to contributors, in order that they may derive the benefits to which they are entitled thereunder and by complying with the provisions which affect them, obviate delays in payment of amounts due.

1 UNDERLYING PRINCIPLES OF ACT

The Act provides for the insurance of employees, who are contri­butors to the Unemployment Insurance Fund, against the risk of loss of earnings arising out of unemployment due to the termination of their employment, illness or maternity, and for payments to the de­pendants of deceased contributors. A contributor, or in the event of the contributor's death, his or her dependants are entitled to the be­nefits and allowances prescribed, subject to the conditions set out hereunder. A married woman who loses her employment may qualify for benefits notwithstanding the fact that her husband is in employ­ment.

Unemployed contributors, other than those applying for illness or maternity benefits, are required to register for work (see paragraph 15). They should make every effort to find work of their own accord and should comply with any direction given them with the object of placing them in employment.

Where contributors are capable of and available for work, unem­ployment benefits are intended to assist therrr while they seek em­ployment.

It should also be noted that the main function of the Fund is to in­sure contributors against temporary loss of employment and it is not meant to provide for persons who have left the labour market. Fur­thermore, the Fund is not a savings, provident or pension fund from which moneys are merely drawn after retirement or termination of employment, but that in respect of every type of benefit, i.e. unem­ployment, maternity, illness or payments to dependants, certain re­quirements are stipulated as explained in more detail in the ensuing pages.

2 UNEMPLOYMENT INSURANCE FUND

In order to provide for the payment of benefits and allowances to contributors* and for payments to dependants of deceased contri­butors and to meet other expenditure connected with administration, the Unemployment Insurance Fund has been established.

The revenue of the Fund is obtained mainly from contributions by employees who are contributors in terms of the Act, contributions from employers of such contributors, an annual contribution by the State based on the total amount of contributions received from em­ployers and contributors, and interest from investments.

The Act requires employers* of contributors to pay the pre­scribed contributions monthly to the Fund. Every employer must pay contributions to the Fund at the rate of 0,3 per cent (3/1000) of the earnings* of each contributor in his employ and each contributor

must contribute at the rate of 0,5 per cent (5/1000) of his earnings. Contributions paid in respect of contributors who are required to con­tribute to the Fund are not refundable. Any payments made to contri­butors from the Fund are made solely by way of benefits or allow­ances to which they may become entitled.•See definitions on pages 12 and 13.

Employers are empowered by the Act to deduct each employee's contributions from his weekly or monthly earnings as the case may be and are required to remit the amounts so collected together with the sum payable by the employers themselves, to the Unemployment In­surance Fund, not laterthan the 10th of the following month.

Should an employee become aware that his employer Is not registered with the Fund and that contributions are conse­quently not being paid, it Is in his interest to report the matter to the nearest office of the Department of Manpower.

3 UNEMPLOYMENT INSURANCE BOARD

In terms of the Act the Minister of Manpower appoints representa­tives of both employers and employees to serve on the Unemploy­ment Insurance Board, the main functions of which are to advise the Minister on matters concerning the Act and to hear and determine ap­peals against decisions of Unemployment Benefit Committees.

4 UNEMPLOYMENT BENEFIT COMMITTEES

Unemployment Benefit Committees established by the Minister of Manpower, after consultation with the Unemployment Insurance Board, have jurisdiction in specified areas. The interests of both em­ployers and employees are represented, and these committees are, inter alia, required to hear and determine appeals against decisions of claims officers.

5. CLAIMS OFFICERS

Claims Officers are appointed by the Director-General: Manpower for specified areas of jurisdiction, and they deal with all applications for unemployment, illness and maternity benefits.

It is of the utmost importance that every contributor should be sup­plied with a contributor's record card (form U.F. 74). It is in the inte­rest of a contributor that such card should reflect full particulars of his employment as a contributor from the date he first commenced con­tributing to the Fund.

Every employer is required to notify the Unemployment Insur­ance Commissioner, P.O. Box 1851, Pretoria, 0001, without fail on form U.F. 85 as soon as he employs a contributor who had not pre­viously been employed as a contributor or who is not in posses­sion of a contributor’s record card, whether such card was previ­ously provided to the contributor or not. The card (U.F. 74) will be issued and sent to the employer concerned. U.F. 85 forms are ob­tainable from any office of the Department of Manpower.

A contributor must hand his contributor's record card to his new employer immediately he enters his service.

The employer is required to complete the contributor’s record card as soon as a contributor leaves his service, by entering on it the period during which he was in his employ as a contributor or non-contributor, his rate of earnings during the last 13 weeks' em­ployment as a contributor and the reason for termination of ser­vice. The duly completed card must be handed to the contributor.

Benefits may not be paid from the Fund until the contributor's re­cord card is produced and, consequently, it is in the interest of the contributor to ensure that he receives the card from the employer as soon as his services are terminated.N.B. The need to ensure that a contributor’s record card is is­sued and properly completed is of the utmost importance.

7. IDENTITY NUMBERS

When applying for a contributor's record card, the employer must furnish the contributor's identity number.

A person's identity number and personal particulars are reflected on page 1 of his/her identity document. Such document will be sup­plied by the Director-General: Internal Affairs, Private Bag X114, Pre­toria 0001, only on receipt of a duly completed application form. An immigrant/alien who has not had an identity number allocated to him must furnish the number of his permanent residence permit or the number of his temporary work permit and the date it expires.

The Identity Numbers furnished 'in respect of Black contributors should be verified from their Reference Books. In the case of foreign Black contributors the Passport or Travel Document Number should be furnished.

8 BENEFITS PAYABLE TO CONTRIBUTORS

The benefits payable to a contributor are calculated at the rate of 45 per cent of his weekly rate of earnings during the last 13 weeks of employment as a contributor. However, if he was employed at diffe­rent rates of earnings during the last 13 weeks of employment, the claims officer will decide what should be regarded as his normal rate of earnings.

APPLICATION

When a contributor becomes unemployed he must register immedia­tely for employment whether or not he is in possession of his contri­butor’s record card (See paragraph 15).

If the contributor cannot be placed in employment, he will be asked to complete an application form for benefits at the office where appli­cation must be made and to present his contributor’s record card. If the card is not available he must obtain and present it as soon as pos­sible. Although a contributor may apply for benefits without a contributor's record card payment may not be made to him until he presents the completeid card. The date of application is an im­portant factor and application must not be delayed because the con­tributor is awaiting receipt of his card (U.F. 74).

The claims officer is empowered to require a contributor to produce evidence that he is unable to obtain suitable work and that he is or has been actively seeking work. He may also require him to report at his office, or at any other place and time that he may determine, to sign the unemployment register and receive benefits.

The contributor's record card is either handed direct to the contri­butor or posted to him once it is no longer required by the claims of­ficer.

CONDITIONS

UNEMPLOYMENT BENEFITS may be paid to unemployed contri­butors provided they are capable of and available for work, resident in the Republic of South Africa and were employed as contributors or otherwise in employment for at least 13 weeks during the 52 weeks immediately preceding the date upon which a period of unemploy­ment is deemed to have commenced (date of application).

The date upon which application is made is regarded as the date upon which a period of unemployment begins and under normal cir­cumstances benefits may not be paid in respect of any period prior to that date. Not more than one week’s benefits are payable for each completed four weeks' employment as a contributor between 1 Janu­ary 1950 and 29 July 1962 inclusive and one week's benefits for each completed six weeks' employment as a contributor on or after 30 July1962. Except in cases where the Unemployment Insurance Board otherwise decides, benefits may not be paid for more than 26 weeks during any period of 52 consecutive weeks. Application for an exten­sion of the period must be made on form U.F. 139.

If a contributor who has applied for benefits moves to the area of ju­risdiction of another claims officer and submits a further application within 14 days from the date on which he last reported for the pur­pose of signing the unemployment register, the period of unemploy­ment is deemed to have commenced on the date determined in re­spect of the first application.

Benefits are not payable in respect of the first week of unemploy­ment unless unemployment commenced within nine weeks of a pre­vious period of unemployment. However, if unemployment continues

into the second week, benefits are paid for the same number of days in the first week as the contributor was unemployed in the second week.

If, in the opinion of the claims officer, a contributor left his employ­ment voluntarily without just cause or lost his employment as a result of his own misconduct, he wiil not be entitled to benefits for a period of six weeks from the date of application. However, if, in a particular case, the claims officer considers that withholding benefits for six weeks would be inequitable because of the special circumstances of the case, he may reduce the period. If a contributor refuses to accept or apply for suitable work notified to him or of which he may become aware, or to comply with any specific reasonable direction given by or on behalf of the claims officer with a view to helping him to obtain work, he forfeits his rights to benefits for a period of 13 weeks or such shorter period as the claims officer may determine.

10 ILLNESS BENEFITS

ILLNESS BENEFITS may be paid to contributors who are unem­ployed or who, although their services have not been terminated re­ceive from their employers, whether in cash or in kind, less than one third of their normal earnings, due to illness, but conditions such as alcoholism, anxiety, debility, depression, drug dependence, insomnia or neurasthenia are not regarded as illnesses except—(a) in the case of vague diagnoses such as anxiety, depression or

insomnia, which shall be regarded as recognisable only for the duration of the period for which a person is admitted to a recog­nised hospital for treatment, or receives outpatient treatment in respect of which a medical clinical report is furnished by a medi­cal practitioner from which it appears clearly that the person duly suffers or suffered from a disease;

(b) in the case of alcoholism or drug dependence, which shall be regarded as recognisable only for the duration of the period for which a person is admitted to and undergoes treatment for alco­holism or drug deperdence at a recognised registered rehabili­tation centre or Slate psychiatric hospital.

Illness benefits are not payable to a contributor—(i) whose illness arises from his own misconduct, or(ii) who unreasonably refuses to or neglects to undergo medical

treatment.It should be noted that illness benefits are intended to grant relief to

contributors who are regular workers but who are prevented tempo­rarily from working through illness. It is not intended to provide a source of income to persons who have left the labour market on ac­count of chronic illness.

Illness benefits are paid, as in the case of unemployment benefits, at the rate of 45 per cent of the weekly rate of earnings at which the contributor was employed during the last 13 weeks of employment as a contributor.

APPLICATION FOR ILLNESS BENEFITS

APPLICATION FOR ILLNESS BENEFITS must be made on form U.F. 86, which is obtainable from the nearest office of the Department of Manpower, Magistrate or Labour Bureau (See paragraph 15).

The form includes a medical certificate which must be completed by the medical practitioner who attended the contributor to show the actual period during which he was unable to work because of illness. If the illness continues for longer than the period shown on the first application form, U.F. 86, application for further payment must be made on form U.F. 87. Application must be made afresh on form U.F. 87 in respect of each further period for which payment is desired. Contributors who are unemployed should submit their contributors record cards with their applications for benefits as soon as possible. In the case of those contributors whose contracts of service have not been terminated but receive from their employers, whether in cash or in kind, less than one third of their normal earnings, the claims officer will require the employers to forward the contributors’ record cards to him and also complete forms U.F. 125. Although a contributor may apply for illness benefits without a contributor’s record card, payment may not be made until the completed card is produced. The date of application is an important factor and application must not be delayed because the applicant is awaiting receipt of his card.

CONDITIONS ATTACHING TO PAYMENT OF ILLNESS BENEFITS

In order to qualify for payment of illness benefits a contributor must, on account of illness, be unable to perform work.

Only persons who had been in employment as contributors or were otherwise in employment for at least 13 weeks during the 52 weeks immediately preceding the date upon which unemployment is deemed to have commenced may be paid benefits.

A contributor is not entitled to receive benefits during the first two weeks he is unemployed, or deemed to be unemployed, provided that if the unemployment continues after the second week, he may be paid benefits in respect of the same number of days during the first two weeks, as the number of days he was unemployed thereafter. For example, if he is unemployed for three weeks altogether, benefits will be paid in respect of two weeks.

As in the case of unemployment benefits, illness benefits may only be paid for a maximum of 26 weeks in any period of 52 consecutive weeks, unless the Unemployment Insurance Board decides to ex­tend the period. Application for the extension of a period should be made on form U.F. 140.

in no case can the total amounts paid exceed the benefits accrued, on the basis of one week's benefits for every four weeks' employ­ment as a contributor between 1 January 1950 and 29 July 1962 in­clusive, and one week's benefits for each completed six weeks' em­ployment as a contributor on or after 30 July 1962.

11 MILITARY SERVICE

A contributor performing any continuous service or undergoing continuous training in any portion of the South African Defence Force (except the Permanent Force) or the Reserve, within the meaning of the Defence Act, 1957, is deemed to be in employment as a contribu­tor for the purpose of the thirteen weeks' qualifying period in a period of fifty two weeks referred in paragraphs 9 and 10 above.

MATERNITY BENEFITS, as in the case of unemployment bene­fits, are calculated at the rate of 45 per cent of the weekly rate of earn­ings at which the applicant was last employed as a contributor. Such benefits may be paid to a female contributor who is unemployed —

(a) in respect of her pregnancy for a period not exceeding 18 weeks and commencing not earlier than 18 weeks prior to the expected date of her confinement or, where application is made on or after the date of birth, the date of birth, as the case may be; and

(b) for a period not exceeding eight weeks after the birth of a live child or four weeks after the birth of a stillborn child.

Contributors whose services have not been terminated but who have stopped working and receive from their employers, whether in cash or in kind, less than one third of their normal earnings, may also qualify for these benefits. In the case of such a contributor the claims officer will require her employer to send her contributor’s record card to him and to complete form U.F. 125 to reflect details of her earnings and periods of employment.

APPLICATION FOR MATERNITY BENEFITS must be made on form U.F. 92 which is obtainable from the nearest office of the Depart­ment of Manpower, Magistrate or Labour Bureau (See paragraph 15).

The applicant must complete form U.F. 92 and the medical certifi­cate on the form must be completed by a medical practitioner if she is still pregnant when application is made. The application should be submitted, together with the applicant's contributor's record card, to the office from which the form was obtained. She will subsequently receive forms U.F. 93, U.F. 94 or U.F. 95, as the case may be, for completion and return to the claims officer who has jurisdiction in the area in which she resides.

If, on the date of application, her child has already been born, she must complete form U.F. 92 except for the medical certificate thereon, and lodge the application together with a completed form U.F. 94. She will thereafter be requested by the claims officer to com­plete one or more forms U.F. 95 as he may require.

Payment will be made to her by cheque.

CONDITIONS ATTACHING TO PAYMENT OF MATERNITY BENEFITS

To qualify for maternity benefits a contributor must have been in employment as a contributor or otherwise in employment for at least 18 weeks during the 52 weeks immediately preceding the expected date of her confinement or where application is made on or after the date of birth, the date of birth, as the case may be.

A contributor performing any continuous service or undergoing continuous training in any portion of the South African Defence Force (except the Permanent Force) or the Reserve, within the meaning of the Defence Act, 1957, is deemed to be in employment as a contribu­tor for the purpose of the eighteen weeks qualifying period in a period of fifty-two weeks referred to in the above paragraph.

Special provisions, however, apply in the case of contributors who have been employed on work connected with ionizing radiation.

A contributor shall not be deemed to have become unemployed more than 26 weeks prior to the date on which application is made.

Application for maternity benefits may be made after the contributor ceases working due to pregnancy and before the birth of a child, but should be made within eight weeks (56 days) after the date of birth as delays beyond this period may result in the loss of benefits. If the applicant is not in possession of her contributor's record card the application should nevertheless be lodged and the card submitted as soon as possible thereafter.

As in the case of the payment of unemployment benefits, not more than one week's benefits are payable for each completed four weeks' employment between 1 January 1950 and 29 July 1962 inclusive, and one week's benefits for each completed six weeks' employment as a contributor on or after 30 July 1962. Benefits are not payable for more than 26 weeks in aggregate, in any period of 52 consecutive weeks. For the purpose of determining what benefits are payable, the total number of weeks of benefits of every description received, is taken into account.

13. PAYMENTS TO DEPENDANTS OF DECEASED CONTRIBUTORS

An amount equal to not more than 26 weeks' benefits at the rate of 45 per cent of the weekly rate of earnings at which the deceased con­tributor was last employed as a contributor may be paid to a depen­dant of that contributor. The number of weeks in respect of which payment may be made depends on the period the deceased was em­ployed as a contributor and the benefits paid to him.

If the deceased contributor leaves a widow the amount due will be paid to her or, if the deceased leaves an invalid widower, payment will be made to him. If there is no widow or invalid widower payment may be made to a child (including an adopted child) or children under se­venteen years of age who were wholly or mainly dependent on the deceased for the necessities of life. If there are no such children, pay­ment may be made to any other person who was wholly or mainly de­pendent on the deceased for the necessities of life.

APPLICATION FOR PAYMENTS TO DEPENDANTS OF DE­CEASED CONTRIBUTORS should be made on form U.F. 126 where the applicant is a widow or an invalid widower, and on form U.F. 127 where the applicant is a person other than a widow or an in­valid widower, and should be lodged at the nearest office of the De­partment of Manpower or at the office of the nearest Magistrate, Com­missioner or Labour Bureau (See paragraph 15). Where the applicant is an invalid widower the application should be accompanied by a cer­tificate signed by the medical practitioner by whom the applicant has been treated stating the period during which the applicant has been under his medical treatment, the nature of the disability and indicating the period that the applicant was not capable of performing work.

Application by or on behalf of a child or children or other person who was wholly or mainly dependent on the deceased contributor for

the necessities of life should be made on form U.F. 127 and should be accompanied by a sworn declaration as required therein.

The following documents should be forwarded with form U.F. 126 orU.F. 127:—

(1) Contributor’s record card (U.F. 74) of deceased contributor. (Where there is more than one card, all cards should be sent).

(2) The death certificate, or if the death certificate is not available, post-mortem certificate or burial order relating to the death of the contributor.

(3) Where the applicant is the widow or invalid widower of the de­ceased contributor, the marriage certificate.

(4) When application is made on behalf of a child or children, the birth certificate(s) of such child or children.

(5) Form U.F. 128 completed by the last employer of the deceased contributor.

CONDITIONS ATTACHING TO PAYMENTS TO DEPENDANTS OF DECEASED CONTRIBUTORS

Payments are restricted to dependants of contributors who had been in employment as contributors or otherwise in employment for at least thirteen weeks during the five years immediately precedina their death.

A deceased contributor who was performing any continuous ser­vice or undergoing any continuous training in any portion of the South African Defence Force (except the Permanent Force) or the Reserve, within the meaning of the Defence Act, 1957, is deemed to have been in employment as a contributor for the purpose of the thirteen weeks' qualifying period during the period of five years referred to in the above paragraph.

Application must be lodged within three years of the date of death of the contributor, and may be made by a person who is resid­ing outside the Republic.

The amount payable to any dependant does not form part of the es­tate of the deceased.

14 APPEALS

Any person who is aggrieved by a decision of a claims officer in re­gard to any application for benefits, or an allowance, or any other mat­ter arising under the Act, may appeal to the Unemployment Benefit Committee against such decision.

The appeal should be in writing and be lodged with the Secretary of the committee concerned, within 30 days of the date of notification of the claims officer's decision.

Any person who is aggrieved by a decision of a committee may ap­peal to the Unemployment Insurance Board. The appeal should be in writing and should be lodged with the Secretary, Unemployment In­surance Board, P.O. Box 1851, Pretoria, 0001, within 30 days of noti­fication of the committee's decision.

15. OFFICES FOR REGISTRATION FOR EMPLOYMENT AND LODGING OF APPLICATIONS FOR BENEFITS AND PAYMENTS

TO DEPENDANTSUnemployed persons must register for employment and applica­

tions for benefits and payments to dependants must be lodged as in­dicated hereunder:A. Whites, Coloureds and Asians (males and females).

(a) Unemployment Benefits — the contributor must report personally to register for employment and to apply for bene­fits at the nearest office of the Department of Manpower (list hereunder) or Magistrate's officeT

(b) illness and Maternity Benefits — applications must be lodged as indicated in (a). Applicants are not required to re­

port personally.

(c) Payments to dependants — applications must be lodged personally (if possible) at an office as indicated in (a).

B. Black persons(i)(a) Unemployment Benefits (males) — the contributor

must report personally to register for employment and to apply for benefits at the nearest Labour Bureau or, where there is no such bureau, at the nearest office of a Commissioner or Magistrate (in the national states).

(b) Unemployment Benefits (females) — the contributor must report personally to register for employment and to apply for benefits at the nearest Labour Bureau or, where there is no such bureau, at the nearest office of a Com­missioner, Magistrate (in the national states).

(ii) Illness (males and females) and Maternity Benefits —applications must be lodged at an office as indicated in (i)(b). Applicants are not required to report personally.

(iii) Payments to dependants (males and females) — applica­tions must be lodged personally (if possible) at an office as indicated in (i)(b)OFFICES OF THE DEPARTMENT OF MANPOWER

16 GLOSSARY

“CONTRIBUTOR”A contributor includes any person, irrespective of race, who works

under a contract of service or of apprenticeship or learnership with an employer, in an industry, undertaking, trade, occupation or activity, but excludes:—

(1) Persons whose earnings exceed R26 000 per annum.(2) Persons employed by an employer for less than one full working

day or less than eight hours, whichever is the less, in any ca­lendar week;

(3) The husband or wife of an employer when working for such em­ployer.

(4) Domestic servants employed as such in private households;*(5) Persons who enter the Republic for the purpose of carrying out

a contract of service if upon termination thereof the employer is required by law or by the contract or by any other agreement to repatriate the person or that person is so required to leave the Republic;

(6) Persons employed in agriculture, save persons employed ex­clusively or mainly in forestry;

(7,) Persons employed casually and not for the purpose of the em­ployer’s business;

(8) Seasonal workers, viz: persons employed in an industry which the Minister of Manpower has declared by notice in the Gazette to be a seasonal business and who are not members of the ad­ministrative, clerical, technical, office, sales or maintenance staff. Any person, however, who has been a seasonal worker for a continuous period of eight months in the employment of the

same employer, ceases to be a seasonal worker if he remains thereafter in the employment of such employer.

(9) Persons to whom articles or materials are given out by an em­ployer to be made up, finished, adapted for sale or otherwise worked with at a place-not under control of the employer.

(10) Persons whose earnings consist solely of a share in takings or are calculated purely on a commission basis;

(11) Persons employed on the fixed establishment of the Public Ser­vice;

(12) Persons in the permanent employment of the S.A. Transport Services, or on the Services' regular non-White staff estab­lishment:

(13) Persons employed by a provincial administration who contribute to the Government Service Pension Fund.

(14) Persons who in terms of section 23 of the Educational Services Act, 1967, section 12 of the Coloured Persons Education Act,1963, and section 12 of the Indians Education Act, 1965, are for all purposes in respect of pension and retirement benefits dealt with as if they occupied posts included in a division of the public service referred to in section 3(1 )(a) of the Public Service Act 1957.

(15) Officers on the fixed establishment of Parliament; and

(16) Certain classes of persons who are excluded under section 2(5) of the Act.

“EMPLOYER”An employer is any person (or firm) who/which employs a contri­

butor.

NOTE — If a person is employed by two or more employers, that per­son shall be regarded as a contributor only in respect of that employ­ment which in the opinion of the Director-General: Manpower consti­tutes his normal employment. In deciding this, regard is had, in addition to other circumstances, to the amount of earnings received from each employer respectively.

EARNINGS

“ Earnings" means any payment in money or in kind or both in money and in kind made or owing to any person, which arises in any manner whatsoever out of employment, but does not include com­mission or a share in takings, overtime, any additional payment based on the quantity or output of work done (except any amount guaran­teed by law or otherwise to be a minimum remuneration) or any spe­cial payment, bonus or allowance.

The value of food and/or quarters the employer provides to a con­tributor, which must be included for the purpose of calculating "earn­ings" , is determined at the rate of 17 per cent in respect of food and 8 per cent in respect of quarters, of the weekly or monthly amount of the cash earnings of the contributor.

WERKLOOSHEIDVERSEKERINGSWET, 1966Terwyl dit onmoontlik is om in hierdie opsomming ’n volledige uit-

eensetting van al die bepalings van die W erkloosheidver- sekeringswet, 1966, te gee, is dit nogtans noodsaaklik dat bydraers vertroud moet wees met die vernaamste doelstellings en vereistes van die Wet sodat hulle, deur aan die betrokke voorwaardes te vol- doen, die voordele waartoe hulle ingevolge die Wet geregtig mag wees sonder vertraging kan bekom.

1 HOOFDOEL VAN DIE WET

Die Wet maak voorsiening vir die versekering van werknemers wat bydraers tot die Fonds is, teen die risiko van verlies van verdienste voortspruitende uit werkloosheid as gevolg van diensbeeindiging, siekte of swangerskap en vir betalings aan afhanklikes van oorlede bydraers. Onderworpe aan die voorwaardes hieronder uiteengesit is 'n bydraer, of in die geval van 'n bydraer se dood, sy of haar afhank- like, op die voorgeskrewe voordele geregtig. 'n Getroude vrou wat werkloos raak kan op voordele geregtig wees nieteenstaande die feit dat haar eggenoot in werk is.

Dit word van werklose bydraers, behalwe die wat aansoek doen om siekte- of kraamvoordele, vereis om vir werk te registreer (kyk para- graaf 15). Hulle moet alle pogings aanwend om vir hulle self werk te vind en moet alle voorskrifte wat aan hulle gegee word met die oog om hulle in werk te plaas, nakom.

Waar bydraers geskik en beskikbaar vir werk is, is werkloosheid- voordele bedoel om hulle te help terwyl hulle werk soek. Dit dien ook daarop gelet te word dat die hoofdoel van die Fonds is om bydraers te verseker teen tydelike verlies van werk en dit is nie die bedoeling om voorsiening te maak vir persone wat die arbeidsmark verlaat het nie. Die Fonds is nie 'n spaar-, voorsienings- of pensioenfonds waaruit daar sonder meer gelde na uitdienstreding of diensbeeindiging ge- trek kan word nie, maar ten opsigte van elke tipe voordeel, d.i. werk­loosheid, kraam, siekte of betalings aan afhanklikes, word sekere ver­eistes gestel soos verderaan in meer besonderhede verduidelik word.

2. WERKLOOSHEIDVERSEKERINGSFONDS

Ten einde voorsiening te maak vir die betaling van voordele en toe- lae aan bydraers* en vir betalings aan afhanklikes van oorlede by­draers, en om die nodige administratiewe koste te dek, is die Werk- loosheidversekeringsfonds gestig. Die inkomste van die Fonds is hoofsaaklik afkomstig van die bydraes van werknemers wat bydraers ingevolge die Wet is, bydraes van werkgewers van sodanige by­draers, ’n bydrae deur die Staat gebaseer op die totale bedrag van bydraes van werkgewers en werknemers ontvang, en rente op be- leggings.

Die Wet vereis dat die voorgeskrewe bydraes maandeliks deur werkgewers* van bydraers in die Fonds inbetaal moet word. Elke werkgewer moet ten opsigte van elke bydraer in sy diens, en elke by­draer moet tot die Fonds bydra. In die geval van sodanige werkgewer teen die koers van 0,3 persent (3/1000) en, in die geval van sodanige bydraer teen die koers van 0,5 persent (5/1000) van die ver­dienste* van sodanige bydraer. Bydraers wat verplig is om tot die Fonds by te dra se bydraes is nie terugbetaalbaar nie, en enige beta-

lings aan bydraers uit die Fonds geskied slegs by wyse van die beta- ling van voordele of toelaes waarop bydraers volgens Wet geregtig mag wees.* Kyk woordomskrywing op bladsye 12 en 13.

Werkgewers word deur die Wet gemagtig om die bydraes deur elke bydraer betaalbaar van sy weeklikse of maandelikse verdienste, na gelang die geval mag wees, af te trek, en moet hierdie bedrae te- same met die bedrae wat deur werkgewers betaalbaar is, nie later nie as d ie 10de van d ie vo lge nde maand aan die W erk loos- heidversekeringsfonds stuur.

Indien ’n werknemer daarvan bewus is dat sy werkgewer nie by die Fonds geregistreer is nie en bydraes gevoiglik nie betaal word nie is dit in sy belang om dit by die naaste kantoor van die Departement van Mannekrag aan te meid.

3 WERKLOOSHEIDVERSEKERINGSRAADDie Werkloosheidversekeringsraad is saamgestel uit verteenwoor-

digers van beide werkgewers en werknemers wat deur die Minister van Mannekrag kragtens die Wet aangestel word. Die Raad bedien die Minister van advies oor aangeleenthede aangaande die Wet en onder andere verhoor en beslis hy appelle teen die beslissings van Werkloosheidbystandskomitees.

4. WERKLOOSHEIDBYSTANDSKOMITEES

Werkloosheidbystandskomitees word deur die Minister ingestel in oorleg met die Werkloosheidversekeringsraad en hou regsbevoegd- ■heid in sekere vasgestelde gebiede. Die belange van beide werk­gewers en werknemers word op die komitees verteenwoordig.

Die komitees moet onder andere appelle teen die beslissings van eisebeamptes aanhoor en daaroor beslis.

5 EISEBEAMPTES

Eisebeamptes word deur die Direkteur-generaal: Mannekrag aan­gestel met regsbevoegdheid in vasgestelde gebiede. Alle aansoeke deur bydraers om werkloosheid-, siekte- of kraamvoordele word deur die eisebeamptes behandel.

Dit is van die uiterste belang dat elke bydraer van 'n bydraersver- siagkaart (vorm U.F. 74) voorsien moet word. Dit is in belang van 'n bydraer dat sodanige kaart volledige besonderhede van sy diens as 'n bydraer vanaf die datum waarop hy tot die Fonds begin bydra het, sal aantoon.

D it w o r d v a n e l k e w e r k g e w e r v e r e i s om d i e Werkloosheidversekeringskommissaris, Posbus 1851, Pretoria, 0001, sonder verwyl op die voorgeskrewe vorni U.F. 85 in kennis te stel sodra hy 'n bydraer in diens neem wat nog nie voorheen 'n by­draer was nie of wat nie in besit van ’n bydraersverslagkaart is nie, hetsy sodanige kaart voorheen aan die bydraer verskaf is, al dan nie. Die kaart (U.F. 74) sal uitgereik en aan die betrokke werkgewer ge- stuur word. Vorm U.F. 85 kan deur werkgewers van enige kantoor van die Departement van Mannekrag verkry word.

Sodra ’n bydraer by ’n nuwe werkgewer in diens tree moet hy sy verslagkaart aan die werkgewer oorhandig.

Die werkgewer is verplig om, sodra ’n bydraer uit sy diens tree, die bydraer se verslagkaart te voltooi deur daarop aan te dui die tydperk wat die bydraer as bydraer of as nie-bydraer in sy diens was, skaal van verdienste gedurende die laaste 13 weke diens as 'n bydraer en die rede vir die diensbeeindiging. Die verslagkaart, aldus voltooi, moet dan aan die bydraer oorhandig word. Sonder hierdie kaart kan voordele nie uit die Fonds betaal word nie en dit is dus in die bydraer se eie belang dat hy seker moet maak dat hy sy verslagkaart van sy werkgewer ontvang sodra hy ophou om vir die werkgewer te werk.LW DIE NOODSAAKLIKHEID OM SORG TE DRA DAT ’N BY­DRAERSVERSLAGKAART UITGEREIK EN BEHOORLIK VOLTOOI WORD, IS UITERS BELANGRIK.

7. PERSOONS-/IDENTITEITSNOMMERS

Wanneer om 'n bydraersverslagkaart aansoek gedoen word, moet die werkgewer die bydraer se persoons/identiteitsnommer verstrek.

'n Persoon se identiteitsnommer en persoonlike besonderhede verskyn op bladsy 1 van sy/haar identiteitsdokument. Sodanige do- kument sal uitgereik word deur die Direkteur-generaal: Binnelandse Aangeleenthede, Privaatsak X114, Pretoria 0001, slegs na ontvangs van 'n behoorlikvoltooideaansoekvorm.

In die geval van 'n immigrant/vreemdeling aan wie ’n identiteits­nommer nog nie toegeken is nie, moet die nommer van sy permit vir permanente verblyf of die nommer van sy tydelike werkpermit en die datum waarop dit verval, verstrek word.

Die identiteitsnommers wat verstrek word ten opsigte van Swart bydraers moet met hulle bewysboeke gekontroleer word. In die geval van vreemde Swart bydraers moet die paspoort- of werkersreisdoku- mentnommer verstrek word.

8 . VOORDELE AAN BYDRAERS BETAALBAAR

Die voordele wat aan ’n bydraer betaalbaar is, word bereken teen die koers van 45 persent van die weeklikse skaal van sy verdienste gedurende die laaste 13 weke van diens as 'n bydraer, of indien hy teen verskillende skale van verdienste gedurende die laaste 13 weke van diens werksaam was, sal die eisebeampte beslis watter skaal van

verdienste as die normale verdienste van 'n bydraer beskou moet word.

9 WERKLOOSHEIDVOORDELE AANSOEKE

Wanneer ’n bydraer werkloos word, moet hy onmiddellik vir werk registreer of hy 'n bydraersverslagkaart in sy besit het al dan nie (kyk paragraaf 15). Indien 'n bydraer nie in werk geplaas kan word nie, sal hy gevra word om ’n aansoekvorm by die betrokke kantoor waar aan- soek gedoen kan word te voltooi en om sy bydraersverslagkaart in te handig of om dit so spoedig doenlik te verkry. Alhoewel ’n bydraer sonder 'n bydraersverslagkaart aansoek om voordele kan doen, is geen voordele betaalbaar tot tyd en wyl die behoorlik vol- tooide kaart voorgele word nie. Die datum van aansoek is 'n be- langrike faktor en 'n aansoek moet nie vertraag word omdat die aan- soeker nog wag op ontvangs van sy kaart nie.

Die eisebeampte kan vereis dat die bydraer bewys moet lewer dat hy nie geskikte werk kan kry nie en dat hy daadwerklik werk soek of gesoek het en hom aanse om hom by sy kantoor of op sodanige ander plek en tye as wat hy mag bepaal, aan te meld, ten einde die werkloosheidregister te teken en betaling van voordele te ontvang.

Die bydraersverslagkaart word 61 direk aan die bydraer oorhandig 6t aan hom gepos sodra die eisebeampte dit nie meer nodig het nie.

VOORWAARDES WERKLOOSHEIDVOORDELE kan betaal word aan bydraers wat werkloos is. mits hulle beide geskik en beskikbaar vir werk is, in die Republiek van Suid-Afrika woonagtig is en wat as bydraers of an- dersins in diens werksaam was vir ten minste 13 weke gedurende die 52 weke wat die datum waarop 'n tydperk van werkloosheid geag word te begin het (datum van aansoek) onmiddellik voorafgaan.

Die datum waarop om voordele aansoek gedoen word, word be­skou as die datum waarop die tydperk van werkloosheid begin en onder gewone omstandighede kan geen voordele ten opsigte van enige tydperk voor hierdie datum betaal word nie.

Hoogstens een week se voordele is betaalbaar vir elke voltooide vier weke diens as bydraer tussen 1 Januarie 1950 tot en insluitende 29 Julie 1962 en een week se voordele vir elke voltooide ses weke diens as 'n bydraer op of na 30 Julie 1962. Behalwe in gevalle waar die Werkloosheidversekeringsraad andersins besluit, is voordele vir hoogstens 26 weke gedurende enige tydperk van 52 agtereenvol- gende weke betaalbaar. Aansoek om 'n verlenging van die tydperk moet op vorm U.F. 139 gedoen word.

Indien 'n bydraer wat om voordele aansoek gedoen het, verhuis na die gebied waar 'n ander eisebeampte seggenskap het en 'n verdere aansoek indien binne 14 dae vanaf die datum waarop hy hom die laaste keer aangemeld het ten einde die werkloosheidregister te teken, word die tydperk van werkloosheid geag ’n aanvang te ge- neem het op die datum wat ten opsigte van die eerste aansoek vas- gestel is.

Tensy 'n tydperk van werkloosheid binne nege weke vanaf 'n vo- rige tydperk van werkloosheid 'n aanvang neem, is geen voordele vir die eerste week betaalbaar nie, maar as die werkloosheid tot in die tweede week voortduur, kan voordele ten opsigte van die eerste week betaal word vir dieselfde aantal dae as waarop die bydraer ge- dut ende die tweede week werkloos was.

Indien die eisebeampte van oordeel is dat 'n bydraer sy werk vry- willig sonder gegronde redes verlaat het, of sy werk as gevolg van sy wangedrag verloor het, sal so 'n bydraer vir 'n tydperk van ses weke vanaf datum van aansoek om voordele, nie op voordele ge- regtig wees nie. Indien die eisebeampte egter in ’n bescndere geval van oordeel is dat uitsluiting van voordele vir so ’n tydperk van ses weke weens spesiale omstandighede onbillik sou wees, kan hy die tydperk verkort. Indien 'n bydraer weier om geskikte werk waar- van hom kennis gegee is of waarvan hy te wete gekom het, te aan- vaar of om daarom aansoek te doen, of, indien hy versuim om 'n spesifieke redelike voorskrif deur of namens die eisebeampte aan hom gegee ten einde hom te help om werk te kry, na te kom, ver- beur hy sy reg op betaling van voordele vir 'n tydperk van 13 weke of vir sodanige korter tydperk as wat die eisebeampte mag bepaal.

SIEKTEVOORDELE kan betaal word aan bydraers wat werkloos is of wat, alhoewel hul dienskontrakte nie beeindig is nie, minder as 'n derde van hulle verdienste, hetsy in kontant of in natura, van hulle werkgewers ontvang, weens enige siekte, maar toestande soos alko- holisme, angs, debiliteit (swakheid), depressie, dweimafhanklikheid, senusiekte of slaaploosheid word nie as siektes beskou me, behalwe

(a) in die geval van vae diagnose soos angs, depressie of slaaploosheid, wat as herkenbaar beskou word slegs vir die duur van die tydperk waarvoor 'n persoon vir behandeling in 'n erkende hospitaal opgeneem word of buitepasientebehandeling ontvang ten opsigte waarvan ’n mediese kliniese verslag van 'n mediese praktisyn verstrek word waaruit dit duidelik blyk dat die persoon wel aan 'n siekte ly of gely het;

(b) in die geval van alkoholisme of dweimafhanklikheid, wat as her­kenbaar beskou word slegs vir die duur van die tydperk waar­voor 'n persoon vir alkoholisme of dweimafhanklikheid opge­neem word en behandeling ondergaan by 'n erkende geregistreerde rehabilitasie-sentrum of Staats-psigiatriese hos­pitaal.

Siektevoordele is nie betaalbaar aan 'n bydraer—(i) wie se siekte uit sy eie wangedrag voortspruit of(ii) wat onredelik weier of versuim om mediese behandeling te on­

dergaan.Dit dien daarop gelet te word dat siektevoordele bedoel is om ver-

ligting te verleen aan bydraers wat gereelde werkers is, maar wat ty- delik deur siekte verhinder word om te werk.

Dit is nie bedoel om 'n bron van inkomste te verskaf aan persone wat die arbeidsmark as gevolg van kroniese siekte verlaat het nie. Betaling van siektevoordele word bereken net soos gewone werkloosheidvoordele teen die koers van 45 persent van die week- likse skaal van verdienste waarteen die bydraer gedurende die laaste13 weke van sy diens as 'n bydraer werksaam was.

AANSOEKE OM SIEKTEVOORDELE

AANSOEK OM SIEKTEVOORDELE moet gedoen word op vorm U.F. 86 wat by die naaste kantoor van die Departement van Manne-

krag, of by die kantoor van die naaste Landdros, Arbeidsburo, of Ma- gistraat verkrygbaar is (kyk paragraaf 15). Hierdie vorm maak voorsie- ning vir 'n doktersertifikaat wat deur die mediese praktisyn wat die bydraer behandel voltooi moet word en die werklike tydperk waarty- dens die bydraer weens siekte ongeskik vir werk was, moet aandui. Indien die siekte voortduur na die tydperk wat aangedui is op die eerste aansoekvorm U.F. 86 moet aansoek om verdere betaling op vorm U.F. 87 gedoen word. Aansoek op vorm U.F. 87 moet opnuut gedoen word vir elke tydperk ten opsigte waarvan verdere betaling van voordele verlang word. Bydraers wat werkloos is, moet hulle ver- slagkaarte tesame met hulle aansoeke om voordele so spoedig moontlik indien, terwyl in die geval van bydraers wie se dienskon- trakte nie beeindig is nie, maar minder as ’n derde van hulle normale verdienste, hetsy in kontant of in natura, van hulle werkgewers ont- vang, die eisebeampte die betrokke verslagkaart van die bydraers se werkgewers sal aanvra, asmede die werkgewers versoek om vorm U.F. 125 te voltooi. Alhoewel 'n bydraer sorider 'n bydraersverslag- kaart vir die voordele aansoek kan doen. kan geen betaling gemaak word alvorens die behoorlik voltooide kaart voorgele word nie. Die datum van aansoek is 'n belangrike faktor en 'n aansoek moet nie vertraag word omdat die aansoeker nog wag op die ontvangs van sy kaart nie.

VOORWAARDES BETREFFENDE BETALING VAN SIEKTEVOORDELE

Ten einde vir siektevoordele te kwalifiseer moet ’n bydraer as ge- volg van siekte nie in staat wees om werk te verrig nie.

Slegs persone wat in diens was as bydraers of andersins in diens werksaam was vir ten minste 13 weke gedurende die 52 weke wat die datum waarop 'n tydperk van werkloosheid geag word te begin het. is op die voordele geregtig.

Gedurende die eerste twee weke wat hy werKloos is of as werkloos beskou word, is 'n bydraer nie op voordele geregtig nie. Dog, as hy na die tweede week nog werkloos is, kan aan hom voordele betaal word ten opsigte van dieselfde aantal dae gedurende die eerste twee weke as wat hy daarna werkloos was. Byvoorbeeld, as 'n bydraer vir drie weke werkloos was. kan die voordele vir twee weke betaal word.

Net soos in die geval van werkloosheidvoordele is die voordele vir hoogstens 26 weke gedurende enige tydperk van 52 agtereenvol- gende weke betaalbaar tensy die Werkloosheidversekeringsraad besluit om die tydperk te verleng. Aansoek vir 'n verlenging van die tydperk moet op vorm U.F. 140 gedoen word.

Onder geen omstandighede, egter, mag die totale bedrag betaal die opgeloopte voordele, bereken teen die koers van een week se voordele vir elke vier voltooide weke diens as bydraer tussen 1 Janu- arie 1950 tot en insluitende 29 Julie 1962 en een week se voordele vir elke voltooide ses weke diens as 'n bydraer op of na 30 Julie 1962, oorskry nie.

11. MILITERE DIENS

'n Bydraer wat by enige deel van die Suid-Afrikaanse Weermag (uitgesonderd die Staande Mag) of die Reserwe, ooreenkomstig die bedoeling van die Verdedigingswet, 1957, ononderbroke diens verrig

of ononderbroke opleiding ondergaan het, word geag as 'n bydraer werksaam te gewees het vir die doel van die kwalifiserende dertien weke gedurende die tydperk van twee-en-vyftig weke waarna in pa- ragrawe 9 en 10 hierbo verwys word.

12 KRAAMVOORDELE

KRAAMVOORDELE word (net soos werkloosheidvoordele) bere- ken teen die koers van 45 persent van die weeklikse skaal van ver- dienste waarteen die applikant laas as bydraer werksaam was. Soda­nige voordele kan betaal word aan 'n vroulike bydraer wat werkloos is gedurende haar swangerskap—(a) vir 'n tydperk van hoogstens 18 weke en wat begin nie vroeer

nie as 18 weke voor die verwagte datum van haar bevalling of, waar aansoek om voordele op of na die datum van geboorte ge- doen is, die geboortedatum, na gelang van die geval, en

(b) vir 'n tydperk van hoogstens agt weke na die geboorte van 'n le- wende kind, of vier weke na die geboorte van 'n doodgebore kind.

Bydraers wat, alhoewel hul dienskontrak nie beeindig is nie, maar opgehou het met werk en minder as ’n derde van hul normale ver- dienste, hetsy in kontant of natura, van hulle werkgewers ontvang, kan ook vir hierdie voordele kwalifiseer. In so ’n geval sal die eise- beampte die applikant se werkgewer versoek om haar bydraersver- slagkaart aan hom te besorg en om ’n vorm U.F. 125 in te vul waarop besonderhede aangaande haar dienstydperk en haar verdienste ver- strek moet word.AANSOEK OM KRAAMVOORDELE moet gedoen word op vorm U.F. 92 wat by die naaste kantoor van die Departement van Manne- krag, Landdros, Magistraat of Arbeidsburo verkrygbaar is.

Die applikant moet vorm U.F. 92 invul en die mediese sertifikaat op die vorm moet deur ’n mediese praktisyn ingevul word indien sy nog swanger is wanneer aansoek gedoen word. Die aansoekvorm, te- same met die applikant se bydraersverslagkaart, moet terugbesorg word aan die kantoor waar die aansoekvorm verkry is.

Sy sal daarna vorms U.F. 93, U.F. 94 of U.F. 95, na gelang van die geval, ontvang wat ingevul moet word en daarna aan die eisebeampte wat seggenskap het in die gebied waar sy woonagtig is, teruggestuur moet word.

Indien haar kind reeds gebore is op die datum waarop sy aansoek doen, moet 'n ingevulde vorm U.F. 92, behalwe vir die mediese serti­fikaat daarop, tesame met 'n ingevulde vorm U.F. 94 ingedien word. Sy sal daarna deur die eisebeampte versoek word om een of meer vorms U.F. 95 in te vul, soos deur die eisebeampte verlang. Betaling aan haar sal per tjek geskied.

VOORWAARDES BETREFFENDE BETALING VAN KRAAMVOORDELE

Applikante vir kraamvoordele kwalifiseer slegs as hulle vir min- stens 18 weke gedurende die 52 weke onmiddellik voor die verwagte datum van bevalling, of waar aansoek gedoen word op of na die datum van geboorte, die datum van geboorte, na gelang van die geval, as bydraer of andersins in diens werksaam was.

'n Bydraer wat by enige deel van die Suid-Afrikaanse Weermag (uitgesonderd die Staande Mag) of die Reserwe, ooreenkomstig die bedoeling van die Verdedigingswet, 1957, ononderbroke diens verrig of ononderbroke opleiding ondergaan het, word geag as 'n bydraer werksaam te gewees het vir die doel van die kwalifiserende agtien weke gedurende die tydperk van twee-en-vyftig weke waarna in die paragraaf hierbo verwys word.

Spesiale voorsiening word egter gemaak in gevalle waar bydraers werk verrig wat met ioniserende bestraling in verband staan.

'n Applikant sal nie geag word werkloos te geraak het nie meer as 26 weke voor die datum waarop aansoekgedoen word.

'n Aansoek om kraamvoordele kan ingedien word nadat die by­draer as gevolg van swangerskap opgehou het om te werk en voor die geboorte van haar kind, maar aansoek moet gedoen word binne agt weke (56 dae) na die geboortedatum aangesien vertra- gings met die indiening van 'n aansoek na verstryking van die tydperk verlies van voordele mag inhou. Indien die applikant nie in besit van haar bydraersverslagkaart is nie, moet die aansoek nogtans gedoen word en die kaart so spoedig moontlikdaarna ingedien word.

Net soos in die geval van werkloosheidvoordele is kraamvoordele beperk tot een week se voordele ten opsigte van elke voltooide vier weke diens as bydraer tussen 1 Januarie 1950 tot en insluitende 29 Julie 1962 en een week se voordele vir elke voltooide ses weke diens as 'n bydraer op of na 30 Julie 1962. Voordele is betaalbaar vir hoogstens 26 weke gedurende enige tydperk van 52 agtereen- volgende weke. Ten einde vas te stel hoeveel voordele betaalbaar is, sal die totale aantal weke waarvoor voordele van watter aard ook al betaal is, in aanmerking geneem word.

13. BETALING AAN AFHANKLIKES VAN OORLEDE BYDRAERS

'n Bedrag gelykstaande aan hoogstens 26 weke se voordele kan aan die afhanklike van 'n oorlede bydraer betaal word bereken teen die koers van 45 persent van die weeklikse skaal van verdienste waarteen die oorledene laas as bydraer werksaam was. Die aantal weke betaalbaar hang af van die oorledene se tydperk van diens as ’n bydraer en voordele reeds aan hom betaal. Indien die oorlede by­draer 'n weduwee laat, sal die verskuldigde bedrag aan haar betaal word of indien die oorlede bydraer 'n sieklike wewenaar laat, sal die bedrag aan hom betaal word. Indien daar geen weduwee of sieklike wewenaar is nie, kan betaling geskied aan 'n kind (ingeslote 'n aan- genome kind) of kinders onder die ouderdom van 17 jaar wat geheel en al of hoofsaaklik van die oorlede bydraer vir lewensnoodsaaklik- hedeafhanklikwas.

Indien daar geen sodanige kinders is nie, kan betaling geskied aan enige ander persoon wat geheel en al of hoofsaaklik van die oorlede bydraer vir lewensnoodsaaklikhede afhanklik was.

AANSOEK OM BETALING AAN DIE AFHANKLIKE VAN N OOR­LEDE BYDRAER moet gedoen word op vorm U.F. 126 waar die ap­plikant 'n weduwee of 'n sieklike wewenaar is, en op vorm U.F. 127 waar die applikant 'n persoon is anders as 'n weduwee of sieklike we­wenaar, en moet by die naaste kantoor van die Departement van

Mannekrag of by die kantoor van die naaste Landdros, Magistraat, Kommissaris of Arbeidsburo ingedien word (kyk paragraaf 15).

Waar die applikant 'n sieklike wewenaar is, moet die aansoek ver- gesel word van ’n sertifikaat wat geteken is deur die mediese prakti- syn deur wie die applikant behandel is, en wat die tydperk gedurende weike die applikant onder sy behandeling was, die aard van die ongeskiktheid en die tydperk gedurende welke die applikant nie geskik was om werk te verrig nie, vermeld.

Aansoek deur of ten behoewe van 'n kind of kinders of enige ander persoon wat geheel en al of hoofsaaklik van die oorlede bydraer vir lewensnoodsaaklikhede afhanklik was, moet op vorm U.F. 127 ge­doen word en moet vergesel word van 'n beedigde verklaring soos daarin vereis.

Die volgende dokumente moet aangestuur word tesame met vorms U.F. 126 ofU.F. 127:—(1) Die bydraersverslagkaart (U.F. 74) van die oorlede bydraer. (In­

dien daar meer as een kaart is, moet al die kaarte gestuur word).(2) Die doodsertifikaat, of as die doodsertifikaat nie beskikbaar is

nie, die lykskouingsertifikaat of begrafnisbevel wat in verband staan met die dood van die bydraer.

(3) Waar die applikant die weduwee of die sieklike wewenaar van die oorlede bydraer is, die huweliksertifikaat.

(4) Die geboortesertifikaat/kate van die kind of kinders indien aie aansoek ten behoewe van sodanige kind of kinders is.

(5) Vorm U.F. 128 voltooi deur die laaste werkgewer van die oor­lede bydraer.

VOORWAARDES BETREFFENDE BETALINGS AAN AFHANKLIKES VAN OORLEDE BYDRAERS

Betalings is beperk tot afhanklikes van bydraers wat vir minstens dertien weke gedurende die vyt jaar onmiddellik voor hulle afsterwe, as bydraers of andersins in diens werksaam was.

'n Oorlede bydraer wat by enige deel van die Suid-Afrikaanse Weermag (uitgesonderd die Staande Mag) of die Reserwe, ooreen- komstig die bedoeling van die Verdedigingswet, 1957, ononderbroke diens verrig of ononderbroke opleiding ondergaan het, word geag as ’n bydraer werksaam te gewees het vir die doel van die kwalifise- rende dertien weke gedurende die tydperk van vyf jaar waarna in die paragraaf hierbo verwys word.Aansoek moet binne drie jaar na die dood van die bydraer ge­doen word, en mag deur 'n persoon ingedien word wat buite die Re- publiekwoonagtigis.

Die bedrag wat aan 'n weduwee of ander afhanklike betaal word, maak nie deel uit van die boedel van ’n oorlede bydraer nie.

14 APPELLE

Enigeen wat veronreg voel deur 'n beslissing van ’n eisebeampte in verband met enige aansoek om voordele of toelaes of enige ander saak wat ingevolge hierdie Wet ontstaan, kan na die Werkloosheidby- standskomitee teen so n beslissing appelleer.

So 'n appel moet skriftelik en binne 30 dae na die datum waarop hy van die beslissing van die eisebeampte kennis gegee is, by die sek- retaris van die komitee ingedien word.

Enigeen wat veronreg voel deur die beslissing van die komitee kan na die Werkloosheidversekeringsraad appelleer. Sodanige appel
