WTC-1302.AM Adoption of Previous Minutes by Council – 6 December 2012 The recommendations contained in Part 1 – Matters Proposing That Council Exercise Its Delegated Functions – of the Minutes of the Waverley Traffic Committee meeting held on 6 December 2012 were adopted by Council at its meeting on 11 December 2012. Council’s Proposal: That the Committee receive and note this information. WTC RECOMMENDATION (UNANIMOUS SUPPORT): That Council’s proposal be supported. Voting members present for this item: Representative of the Member for Vaucluse also representing the Member for Coogee, NSW Police representative, RMS representative and Waverley Council representative (Chair). WTC-1302.1 Tasman Street, Bondi – Temporary Road Closure (DA 301/2012/B) In accordance with the Waverley Traffic Committee Charter, a special meeting of the Committee was called by Council’s Divisional Manager, Technical Services to consider an application from the Nine Network Australia for the temporary road closure of Tasman Street, Bondi for filming of ‘The Block’. The meeting was called as the application required the Committee’s consideration prior to its scheduled meeting in order for the recommendation of the Committee to be considered at the February Council meeting. The Waverley Traffic Committee unanimously resolved to support Council’s Proposal contained within the report, and this recommendation was subsequently adopted by Council at its meeting on 19 February 2013, subject to the addition of the following condition: 1. Council’s Compliance Rangers be advised of the temporary road closure and be

requested to patrol the area during the road closure times. Council’s Proposal: That the Committee receive and note this information. WTC RECOMMENDATION (UNANIMOUS SUPPORT): That Council’s proposal be supported. Advisory Note: Council notes the Transport – State Transit (Sydney Buses) representative and the NSW Police representative expressed concerns in regard to the temporary road closure. WTC-1302.TEAC STATE ELECTORATE OF COOGEE WTC-1302.TEAC1 570-588 Oxford Street, Bondi Junction – Mixed Use Development (DA 501/2012) Report dated 18 February 2013 from the Divisional Manager, Technical Services about a development application received for 570-588 Oxford Street, Bondi Junction involving retail shops at street level and high density residential apartments in a tower above. Council’s Proposal: That no objections be raised, on traffic and parking grounds, to the mixed use development proposed on DA 501/2012 at 570-588 Oxford Street, Bondi Junction subject to the following: 1. The quantum of off street car parking spaces for residents, resident visitors and

commercial light vehicles being reduced to a maximum of 141. 2. A total of nineteen (19) car parking spaces be provided within the basement car park area

for the parking of resident visitor cars. Details of the location of the resident visitor parking be submitted to Council prior to the release of the Construction Certificate.

widening purposes be borne by the applicant. 12. The closure of Grafton Lane at the rear of the property be carried out in accordance with

the requirements of Council’s Divisional Manager, Technical Services. Full engineering details of adjustments to the kerb and gutter and roadway to affect the closure be submitted to Council for the approval of the Divisional Manager, Technical Services prior to works commencing.

13. A “Construction Vehicle and Pedestrian Plan of Management" (CVPPM) be approved by

Council prior to the issue of a Construction Certificate, and the undertaking of any demolition, excavation, remediation or construction on the site.

The CVPPM shall provide details of the following:

(a) The proposed route to be taken by demolition / construction vehicles in the Waverley

Council area when accessing and exiting the site.

(b) The type and size of demolition / construction vehicles. Trucks with dog trailers and semi trailers may not be approved for use if it is considered with the information submitted that such vehicles cannot adequately and safely gain access to and from the site, or where access into or out of the site may not be possible without the need to remove an unsatisfactory number of vehicles parked on the roadway adjacent to or opposite the site.

(c) The location of truck holding areas remote from the site should Council not give

approval for demolition / construction vehicles to stand on the roadway in the vicinity of the site.

(d) Traffic control measures be put in place when trucks, maneuvering in the vicinity of

the site, will interfere with the free flow of traffic.

(e) The location and materials of construction of temporary driveways providing access into and out of the site.

(f) The location and length of any proposed Works / Construction Zones. Note: such

zones require the approval of the Waverley Traffic Committee and Council prior to installation.

(g) The hours of operation of demolition / construction vehicles.

(h) The number of, and where it is proposed to park, light vehicles associated with staff /

employees / contractors working on the site.

(i) How it is proposed to cater for the safe passage of pedestrians past the site. The details shall include:

(i). The route required to be taken by pedestrians, including signage and any

other control measures that will need to be put in place to direct and keep pedestrians on the required route.

Figure 1 Existing parking zone for garbage trucks in Grafton Street Technical Analysis It was previously proposed to relocate the waste truck parking from east of Vernon Street to west, along the northern side of Grafton Street while retain the existing dedicated parking for Council vehicles. It was also recommended that the existing ‘No Stopping’ zone, west of Vernon Street, be extended to 15 m to ensure adequate sight line. The traffic committee raised issues against this proposal mainly concerning the sight line still being compromised. An on-site meeting was attended by representatives from Council’s Technical Services Division and Public Place Cleansing team. The meeting confirmed that the proposed parking relocation which was discussed at the previous traffic committee meeting is the most feasible option considering the current site constraints. It was agreed that the sight line can be further improved by installing a painted island and brining forward the Give-way line at the intersection of Vernon Street and Grafton Street. The purpose of the proposed painted islands and give way line is to divert the traffic along Grafton Street further away from the kerb and safely bring the vehicles from Vernon Street forward into the intersection with Grafton Street so that drivers can have improved sight lines while exiting Vernon Street.

Council’s Proposal: That Council install 20m of ‘No Parking 3.30pm-6.30pm Mon-Fri 8.30am-5pm Sun’ on the northern side of Birrell Street, Bondi Junction, west of the existing Bus Zone adjacent to Waverley Park. Purpose of Report Council’s Divisional Manager, Recreation, Community Planning & Partnerships has requested the installation of a drop-off / pick-up zone in Birrell Street. Introduction The sports grounds at Waverley Park are used for training and games most evenings on weekdays and all day on Sunday. Council’s Proposal: That Council: 1. Install a 1.2m ‘No Parking’ zone across the rear gate access to 5 Rawson Avenue,

Queens Park at the resident’s cost. 2. Reduce the existing 10m of ‘No Stopping’ on the eastern side of Birrell Lane, Queens

Park, south of Birrell Street, to 9m. Purpose of Report Council has received representation from residents requesting consideration be given to the removing on-street parking, adjacent to their driveway at 7 Rawson Street, Queens Park, in Birrell Lane. Council will need to exercise its delegated functions to implement the proposal. Introduction The matter was referred the Waverley Traffic Committee meeting held on 26 July 2012. Subsequently, Council resolved: That Council install a ‘No Parking’ zone in Birrell Lane which begins at the southern side of the driveway to 7 Rawson Avenue, Queens Park and extends 6.7m to the north. The installation of the zone be at the resident’s cost. The residents of 5 & 7 Rawson Avenue have since stated that they would prefer not to have ‘No Parking’ restrictions across the driveway and that vehicles parked outside 5 Rawson Avenue obstructs the rear pedestrian gate. There is now a preference for ‘No Parking restrictions to be installed to include the gate. Technical Analysis A plan of the existing and approved parking restrictions is illustrated in Figure 1, attached. Two vehicles can legally park between the driveway of 7 Rawson Avenue and the recently installed ‘No Stopping’ at the intersection of Birrell Street. Council would not normally approve the installation of an outward-hinging gate onto a public road. However, even with the gate modified, the resident of 5 Rawson Avenue would experience difficulty in taking out garbage bins. There are currently no posted parking restrictions at some approaches of these intersections. Technical Analysis There is currently ‘No Parking’ signposted on the eastern side of Lawson Lane, south of Lawson Lane II. A number of inspections have taken place during the day, revealing that vehicles are often parked on the corners of Lawson Lane. Vehicles parked at this location block driver’s sight distance as they exit the Lawson Lane, into Lawson Lane II. Therefore, since compliance is an issue at this location, it is recommended that the legislative requirements be signposted. This will not result in a net loss of on-street parking.

Legislative Requirements Under the [NSW] Road Rules 2008:

“A driver must not stop on a road within 10 metres from the nearest point of an intersecting road at an intersection without traffic lights, unless the driver stops … at a place on a length of road, or in an area, to which a parking control sign applies and the driver is permitted to stop at that place under these Rules …”.

Therefore, vehicles parked at these locations may be infringed without the installation of additional signage. However, the RMS’s Technical Direction TDT 2002/12 Stopping and Parking Restrictions at intersections and Crossings addresses the installation of ‘No Stopping’ and ‘No Parking’ signs at intersections and states:

“It is not intended that signs be installed at all locations. Where signs are not installed the legislative restrictions will apply. Generally signposting of restrictions covered by legislative requirements is only required where there is adjoining signposting or compliance is an issue. However, signposting adjacent to children’s crossings, pedestrian crossings and marked footcrossings should always occur. The relevant road authority is to determine where NO STOPPING and NO PARKING signs are to be erected.

Existing signs, with the exception of NO STANDING signs (see Technical Direction No 99/21), are not to be removed or replaced until required under maintenance. Where the post is required to be replaced, the sign should be relocated to the new location as specified in this Technical Direction.”

Purpose of Report Cr Kay has requested the installation of a Give-way line in Martins Avenue at the intersection of Penkivil Street, Bondi. Council will need to exercise its delegated functions to implement the proposal. Introduction The T-intersection of Martins Avenue and Penkivil Street is controlled by a ‘Stop’ sign. Kerb extensions have previously been installed in Penkivil Street, either side of Martins Avenue, to provide “shelter” for vehicles exiting Martins Avenue, whilst improving sight distance to approaching vehicles in Penkivil Street. An expanded storage area for bicycles has been installed in Martins Avenue recent years, with the Stop line for motor vehicles now located behind the expanded storage area. Drivers need to bring their motor vehicles to a complete stop for any bicycle riders waiting at the intersection. Once the expanded storage area is clear, motor vehicles can proceed up to the kerb extension alignment and give way to vehicles in Penkivil Street, as per any other T-intersection.

Technical Analysis There has only been one recorded crash at this location in the last five years. Notwithstanding, it would be beneficial to delineate the edge of the kerb extensions in Penkivil Street with a Give-way line. This helps delineate the edge of the travelling lane for drivers in both the major and minor roads. The kerb extension on the northern side of Martins Avenue protrudes further into Penkivil Street than the kerb extension on the southern side of Martins Avenue. This alignment can be adjusted by installing a painted island on the southern side of Martins Avenue. Purpose of Report Council has received representation from the Strata Manager of 5 Onslow Street, Rose Bay, requesting consideration be given to preventing vehicles from parking in the short section of kerb, in between the two driveways of the property. Council will be required to exercise its delegated functions to implement the proposal. Introduction The kerb in between the two driveways of 5 Onslow Street is only 3.5 m in length. This is insufficient to accommodate a frequently parked, B85 (4.9 m long) vehicle. Parking on the street is regularly at a premium and residents have problems gaining access into and out of their property when cars are parked close to the driveways. Council’s Parking Officers have issued infringements at times to vehicles blocking access however patrolling and issuing infringements does not move the vehicle and the problem continues.

Technical Analysis In order to address the issue, it is proposed to signpost the 3.5 m section of kerb, between the two driveways of 5 Onslow, as motorcycle parking. Purpose of Report Crs Kay and Mouroukas, on behalf of a resident of 64 Penkivil Street, Bondi, have requested consideration be given to installing ‘No Parking’ across their driveway in Penkivil Street. Council will need to exercise its delegated functions to implement the proposal. Introduction Waverley Council and the Traffic Committee have previously not been in favour of installing ‘No Parking’ restrictions across a driveway. Under the existing [NSW] Road Rules 2008, parking across a driveway is prohibited: 198 Obstructing access to and from a footpath, driveway etc (1) A driver must not stop on a road in a position that obstructs access by vehicles or pedestrians to or

from a footpath ramp or a similar way of access to a footpath, or a bicycle path or passageway unless:

(a) the driver is driving a public bus that is dropping off, or picking up, passengers, or (b) the driver stops in a parking bay and the driver is permitted to stop in the parking bay under

these Rules.

(2) A driver must not stop on or across a driveway or other way of access for vehicles travelling to or from adjacent land unless:

(a) the driver:

(i) is dropping off, or picking up, passengers, and (ii) does not leave the vehicle unattended, and (iii) completes the dropping off, or picking up, of the passengers, and drives on, as soon

as possible and, in any case, within 2 minutes after stopping, or

(b) the driver stops in a parking bay and the driver is permitted to stop in the parking bay under these Rules.

(3) For this rule, a driver leaves a vehicle unattended if the driver leaves the vehicle so that the driver is over 3 metres from the closest point of the vehicle.

However, Council enforcement of Rule 198 is relaxed, with infringements only being issued on complaint. Council does not have the resources to continuously patrol for vehicles parked across driveways.

Technical Analysis The proximity of 64 Penkivil Street to the high parking-demand area of Bondi Road means that vehicles often park across the driveway. A site inspection has revealed that there is a no parking zone across the driveway serving a neighbouring property at 56A-60 Penkivil Street. Council officers are proposing that the committee and Council consider the installation of a ‘No Parking’ zone across the driveway to 64 Penkivil Street, if the cost of installation being covered. It is noted that the ‘No Parking’ will override Council’s relaxation of the driveway parking rules, applying to all vehicles at all times, including residents and their visitors: 168 No parking signs

(1) The driver of a vehicle must not stop on a length of road or in an area to which a no parking sign

applies, unless the driver:

(a) is dropping off, or picking up, passengers or goods, and (b) does not leave the vehicle unattended, and (c) completes the dropping off, or picking up, of the passengers or goods, and drives on, as soon

as possible and, in any case, within the required time after stopping. (2) For this rule, a driver leaves a vehicle unattended if the driver leaves the vehicle so the driver is

over 3 metres from the closest point of the vehicle.

(3) In this rule:

required time means:

(a) if information on or with the sign indicates a time—the indicated time, or (b) if there is no indicated time—2 minutes, or (c) if there is no indicated time, or the indicated time is less than 5 minutes, and rule 206 applies

to the driver—5 minutes. A site inspection has also revealed that the ‘No Parking’ across the driveway that serves 56A-60 Penkivil Street is excessively long, extending beyond the driveway by 4 m. The swept path of a B85 vehicle, attached, suggests that only 2 m past the driveway is required. Purpose of Report This report assesses Council’s investigation into ten additional car share parking spaces in Bondi, Bondi Beach, Bondi Junction, North Bondi and Queens Park. Consultations on the proposed locations were carried out during March 2013. Photos and aerial maps detailing the locations of the car share parking zones are attached for Traffic Committee’s information in Attachments 1-5 to this report. Feedback received from residents who received Council’s notification is detailed in Attachment 6 to this report.

Introduction Council is a strong supporter of car share as a method of addressing high levels of car ownership, traffic and parking congestion in Waverley, as well as providing other environmental benefits. As of 12 March 2013, there were 61 approved on-street authorised car share parking spaces in Waverley. Technical Analysis Notifications of the proposed introduction of the car share spaces (including a map – see Attachments 2-5 to this report) were distributed to households within 50m of each of the proposed spaces during early March 2013. Residents were advised to contact Council with their feedback on the proposed locations. Council officers have thoroughly assessed the responses received. Based upon these submissions, the proposed space in Mackenzie Street will not proceed due to the high level of resident opposition to this space. For the remaining nine locations however officers do not believe that the issues raised are significant enough to warrant the relocation of the proposed spaces. In relation to the objections raised from residents on the introduction of new spaces, officers have noted: Introducing an allocated car share space will help address parking congestion as it leads

to sale of approximately eight cars by members in the surrounding area. Car share members are also residents and it is not unreasonable for one car share space

to be located close to their homes in areas of high demand. In certain areas of Waverley, car share membership and usage is so high that spaces are

required every 150-200m. For this report, no membership levels have been noted as the majority of the spaces are to be occupied by Hertz on Demand, which has only just started establishing their network in Waverley. Attachment 6 to this report details all feedback received by Council, including officers’ response to each individual comment / issue. Below is a brief summary of the type of responses received regarding the proposed locations (in favour or against) and recommendations for the proposed spaces. For safety reasons, it is also proposed to install No Stopping signage at locations where the car share spaces are immediately adjacent to an intersection, at the statutory 10m from the intersection. Only two of the proposed spaces are located at an intersection (without existing No Stopping signage): a. Birrell Street, south side just east of Alt Street b. Langlee Avenue, west side just south of Birrell Street

It should be noted that while the intersection of Birrell Street and Park Parade does not currently have No Stopping signage at 10m from the intersection, this signage has been approved and should be installed by RMS shortly. Financial Information for Council’s Consideration Car share operators are responsible for the cost and installation of signage required for their operations. These car share locations are not positioned in metered parking areas and therefore the installation of the spaces will not lead to any direct financial loss to Council. Partial cost recovery for the investigation of these spaces will be charged to the relevant operators - $200 per space investigated, totalling $1800. Note there will be no investigation fee charged for the proposed location in Mackenzie St (officers consider this to be a suitable location). If these spaces are approved, the following annual permit fees will apply: $50 – Permit for car share vehicle in non-RPPS area (Residential Preferential Parking Scheme) for the following spaces:

Elliott Street, North Bondi – Vehicle Manoeuvring at Dead End (A03/0650) Report dated 18 March, 2013 from the Divisional Manager, Technical Services about a petition received from residents of Elliott Street, North Bondi for consideration to be given to improving conditions at the dead end of Elliott Street for vehicle manoeuvring and accessing the garage at the rear of property 1/17 Roe Street. Council’s Proposal: That: 1. Council prepare a plan for the localised widening of the carriageway at the dead end of

Elliott Street to improve vehicle turning and access to and from the garage at 1 / 17 Roe Street, North Bondi.

2. At any widening of the carriageway in the vicinity of 13 Elliott Street, on-street parking be

maintained for one vehicle with the length of that space being not less than the existing. Purpose of Report A petition has been received signed by some 50% of the residents with a frontage to Elliott Street, North Bondi requesting consideration be given to improving conditions for vehicle manoeuvring at the northern, dead end of the street to firstly reduce the incidence of vehicles at times having to be reversed out of the street to Murriverie Road and secondly, to improve vehicular access to and from the garage located in the dead end at the rear of property 1/17 Roe Street. Council will NOT need to exercise its delegated functions to implement the proposal. Introduction The matter of vehicle manoeuvring difficulties at the northern, dead end part of Elliott Street was raised with Council in mid 2008 by the resident owner of property 1 / 17 Roe Street. Property 1 / 17 Roe Street has a single vehicle garage at the rear of the property fronting the dead end of Elliott Street. When vehicles were parked on the eastern side of the road up to the southern side of the driveway to the last, northernmost house in the street at No.13, access and manoeuvring into and out of the garage to 1 / 17 was reportedly very difficult.

The matter of vehicle manoeuvring into and out of the garage at 1 / 17 Roe Street was considered by the Waverley Traffic Committee firstly at its meeting on 28 August 2008, and later at a meeting on 23 October 2008. Council, at its meeting on 18 November 2008, when considering recommendations from the Committee to install “No Parking” restrictions at the dead end of the street outside No. 13, after receiving objections to the proposal from the resident owner of 13 Elliott Street and after considering legal advice from its barrister, resolved as follows: Recommendation 1 of the Waverley Traffic Committee made at its meeting on 23 October, 2008 at item WTC – 0810.L1 be adopted, which is that the following signs be installed at the northern end of Elliott Street, North Bondi (a) “No Parking” sign (left arrow) 1.5m south of the driveway to 13 Elliott Street. (b) “No Parking” sign (right arrow) immediately south of the driveway to 14 Elliott Street. The resident owner of 1/17 Roe Street now informs vehicles parking outside No. 13 frequently park with the rear often extending more than a metre past the northern end of the existing, “No Parking” zone. The protruding of vehicles beyond the end of the zone makes driving in/reversing out and reversing in/driving out of the garage very difficult. The manoeuvring becomes very difficult when the vehicle parked is a truck. Residents living along Elliott Street have raised concern also re the limited manoeuvring facilities at the dead end of the street and would like improved vehicle turning to be implemented to reduce the incidence of vehicles at times having to be reversed fully or part way along the narrow carriageway to access Murriverie Road. Damage has reportedly also occurred to fences at the dead end of the street by turning vehicles. Technical Analysis Elliott Street, North Bondi is a local road under Council control. It has a carriageway width of approximately 7.2m and terminates at a dead end some 107m north of Murriverie Road. Parking is permitted on both sides resulting in a travel lane width of approximately 3.2m. The street was constructed without a formal turning bowl/cul-de-sac at the dead end. To turn vehicles around at the dead end, use is made of the existing driveways to property 13 on the eastern side and 14 on the western side. Turning at driveways before the dead end is difficult due to the narrow carriageway, high on street parking demand and vehicles being parked close to the wings at almost every property.

Driveways at the dead of Elliott Street are used for manoeuvring and turning. Following complaints made to Council in 2008 by the resident / owner of 1 / 17 Roe Street who has a single vehicle garage at the dead end of Elliott Street, which is offset the east of the kerb line, in regard to access difficulties, Council approved the installation of a “No Parking” zone on the western side of the street across the driveway to No.14. On the eastern side outside No. 13, a “No Parking” zone was approved across the driveway, plus an additional 1.5m to the south.

Garage to property 1/17 Roe Street is the right side garage door of the two. Note the offset of the garage door to the right of the line of the kerb and gutter. Access to the garage requires using a portion of the driveway to No. 13 Elliott Street. The owner of 1 / 17 Roe Street informs drivers frequently park vehicles in the shorter than standard length parking space outside No. 13 with the rear of vehicles extending well beyond the northern end of the “No Parking” zone – see photographs attached to this report. The length of kerb outside No. 13 between the end of the existing “No Parking” zone and the driveway to No. 11 to the south is approximately 4.5m. This length is less than the 5.5m Australian Standard length for parking the B85 design vehicle. A space length of 4.5m would be suitable for parking vehicles up to the B35 size however vehicles larger than the B35 are frequently parked outside No. 13. When vehicles in excess of the B35 in size are parked, manoeuvring into and out of the garage at 1/17 Roe Street is very difficult. The eastern edge of the garage door is offset some 1.2m to the east (to the right) of the kerb line in the street. The owner of 1 / 17 Roe Street has a Chrysler Sebring sedan, which has dimensions smaller in length and width than the B85 vehicle.

Increasing the length of the existing “No Parking” zone outside No. 13 to include the full frontage is not an option having regard to past objections received from the owner of that property and to Council’s own legal advice. It is considered an option from 2008 to improve manoeuvring by carrying out localised widening of the road carriageway at the dead may improve conditions and is recommended it be further investigated. Any approval to widen the carriageway on the eastern side of Elliott Street would be reliant on a parking space outside No. 13 remaining and being no less in length than the existing. 2. “No Parking” sign (right arrow) immediately south of the driveway to 14 Elliott Street. __________________________________________________________________________ Purpose of Report This item was taken before the August Traffic Committee meeting detailing a request from a resident of 17 Roe Street who is experiencing difficulty accessing his driveway access difficulties at 17 Roe Street due to legally parked vehicles at a neighbouring property. The recommendation from the August Traffic Committee was:

1. In the short term, “No Parking” signs be installed in the 6m space between the driveways to 11 and 13 Elliott Street.

2. Council prepare a localised road widening to create a full or half parking bay outside 13 Elliott Street.

The item was saved and excepted at the October Council meeting and the following decision was adopted:

That:

1. The Recommendation of the Waverley Traffic Committee made at its meeting on 28 August 2008 not be adopted.

2. Council consider the options proposed by the consultant representing 13 Elliott

Street, and at a minimum, prepare a localised road widening plan to create a full or half parking bay outside 13 Elliott Street in accordance with the recommendation of the WTC.

3. If Council decides not to accept any proposed plans, that “No Parking” signage then

be considered in the 6m space between the driveways to 11 and 13 Elliott Street. Council will be required to exercise its delegated functions to implement the proposal. Introduction As detailed in the previous report, the driveway of concern is at 17 Roe Street, which has vehicle access off Elliott Street. The property shares a driveway with 13 Elliott Street on a 90° alignment, as shown in the attached photo. A site meeting was recently held to discuss access issues based on a proposal from the consultant to install a 1m “No Parking” zone south opf the driveway to 13 Elliott Street. Turning circles have been re-assessed using a Chrysler Sebring Sedan.

REPORT TO WAVERLEY TRAFFIC COMMITTEE ATTACHMENT Technical Analysis The attached turning circles show various movements of the Chrysler in accessing and egressing the garage at 17 Roe Street if a vehicle is parked 1m from the edge pf the driveway to 13 Elliott Street. The turning circles clearly show that a reverse movement into the garage anda forward movement out of the garage is easily achievable. The converse movement (forward in / reverse out) however cannot be completed as easily. It is therefore considered that a “No Parking” sign (left arrow) be installed 1m south of the driveway to 13 Elliott Street, with the zone finishing immediately south of the driveway to 14 Elliott Street. This will allow the resident of 17 Roe Street to reverse into his driveway, while still allowing 5m of parking outside 13 Elliott Street. Financial Information for Council’s Consideration The RTA will be requested to supply and install the signs at no cost to Council Council’s Proposal:

Urban Wheels Pty Ltd – Multi-pedal Powered Cycle (A02/0013) Report dated 18 March 2013 from the Divisional Manager, Technical Services about the operation of a multi-pedal powered cycle by Urban Wheels Pty Ltd in the Bondi Beach area. Council’s Proposal: That the information be received and noted. Purpose of Report Council has received an application from Urban Wheels Pty Ltd to operate a business in the Bondi Beach area. Council will NOT need to exercise its delegated functions to implement the proposal. Introduction Urban Wheels Pty Ltd intends to operate a multi-pedal cycle (referred to as “the vehicle” herein) in the Bondi Beach area. The vehicle is powered by up to eight of the fifteen seated riders, facing inwards (perpendicular to the direction of travel). Steering, brakes, warning devices, indicators and lights are to be controlled by a separate dedicated driver, employed by Urban Wheels Pty Ltd. The matter was referred to the Waverley Traffic Committee meeting held on 28 February 2013 for Traffic Engineering Advice. Subsequently, it was resolved: That Council’s proposal not be supported and the matter be deferred in order for technical advice to be sought from the RMS, NSW Police, the Federal Office of Road Safety, and Transport NSW. The following information has since been received by Council: The RMS’s Manager Traffic Policies, Guidelines & Legislation has indicated that:

1. The vehicle is deemed to be a bicycle. 2. Any person riding the bicycle and occupying a seat with pedals must wear a

helmet. 3. Any person riding the bicycle and occupying a seat without pedals is a

passenger, and thus is not required to wear a helmet if they have paid. 4. The operation of this “bus service” may require approval from Transport for NSW. 5. The RMS does not support the operation of the vehicle from a road safety point

of view. The Transport for NSW’s Project Officer, Bus Accreditation has indicated that:

1. No accreditation is required for vehicles not registered by the RMS. 2. Accreditation is only required for Public Passenger Services, defined as the

carriage of public passengers for a fare or other consideration by a motorised vehicle, which seats over eight passengers, along a road or road related area.

The Department of Infrastructure and Transport has indicated that: 1. The vehicle does not need to be certified under the Motor Vehicle Standards Act

1989. Technical Analysis Having regard to all of the information received, it is understood that: The vehicle is not able to be registered under the Road Transport (Vehicle

Registration) Regulation 2007.

The vehicle does not require any accreditation, certification or approval to operate on NSW roads or road related areas. This may not apply if the vehicle is being towed.

Council’s Parking Services Division is unable to issue penalty notices to the vehicle for

parking offences under the [NSW] Road Rules 2008. Council’s Compliance Division is able to issue penalty notices under Sections 104 &

107 of the Roads Act 1993 (enforced under Section 124 of the Local Government Act 1993).

Urban Wheels Pty Ltd has indicated that: The vehicle weighs approximately 1,000 kg.

The vehicle’s speed is approximately 6 km/h. No alcohol will be served on the vehicle. The vehicle will not be used for Bucks Parties and/or Hen’s Nights. The current proposed route is illustrated in Attachment 1. Council intends to enter into a Licence Agreement with Urban Wheels Pty Ltd to have the vehicle operate in local roads in the Bondi Beach area, including the use of Queen Elizabeth Drive.
