Executive Summary
The following report details the Town of Gawler’s year to date (YTD) operating performance. All variances exceeding both $5,000 and 5% have been identified and explanatory notes have been provided. All variances are closely monitored by budget managers and finance staff.
(a) Income
Graph 1 below shows a summary of the YTD actual operating income performance against the YTD budget

Overall, the YTD actual operating income of $20.879M is $20K lower than the YTD budget of $20.900M. Details of significant YTD variances at income statement level are provided below:
1. Statutory Charges – Dog Registrations are currently reporting a $10K unfavourable YTDresult. The YTD budget has been based on the collection rate of registrations fromprevious financial years. Whilst dog registrations are not due until the end of August, theresults YTD are approximately 40% less than 2015-2016 YTD, which may be attributableto when the registration notices were posted. The trend normally is for people to leavepaying until the end of the month.
Planning Fees are currently $5K unfavourable. This result is 49% less than 2015-2016YTD Result. However, development application fees are calculated on the cost of thedevelopment which can result in variances during the year based on the timing and type ofapplication Council receives.Council staff & Department Managers recognise that Council is only one month into thefinancial year and both of these charges will be appropriately managed in 2016/2017.

MEMORANDUM OF UNDERSTANDING – GAWLER GRC FACILITY USAGE
This document formalises the commitment of both Greyhound Racing South Australia (GRSA) and theGawler Greyhound Racing Club (GGRC) to providing ongoing use of the greyhound racing clubfacilities at the Gawler Showgrounds to the Gawler Centrals Sporting Club (GCSC).
Whilst no financial component or discount has been identified in this agreement, it should be assumedthat the facilities would be available to the GCSC at a discounted rate to that which would otherwise beapplied to purely commercial arrangements. Negotiations relating to specific use will be undertaken byall parties in good faith, with regard for the spirit of historical dealings between GRSA, GGRC andGCSC.
The Venue Hire Agreement (attached) previously provided to the GCSC will serve as the template forall future usage agreements and identifies the default terms and conditions of all usage if no specificusage agreement has been formalised.
This commitment is to remain in place for the entire length of the current lease agreement betweenGRSA and the Town of Gawler Council, which is set to expire in 2035.

Introduction
This Community Land Management Plan (CLMP) has been developed in accordance with the requirements set out in the Local Government Act 1999 (LGA 1999). The LGA 1999 requires that all community land under the care, control, management or ownership of the Council must have a CLMP.
This CLMP has been developed to outline the current and future management of the Town of Gawler Administration Centre, in accordance with legislative requirements and Council’s By-Laws, Plans and Polices, including its Corporate Plan.
Identification Details
The identification details of the community land that is managed within the scope of the Town of Gawler Administration Centre Community Land Management Plan may be sited in Council’s Community Land Register at the Town of Gawler, 41 – 43 High Street Gawler or www.gawler.sa.gov.au
Ownership Details
The Town of Gawler, 41 – 43 High Street, Gawler SA 5118 is the registered proprietor of the land identified within the Town of Gawler Administration Centre Community Land Management Plan.
Purpose for which the land is held
The Town of Gawler Administration Centre is held for the purpose of:
- Continuing to support and provide the wider community a diverse range of core Counciladministrative services
- Providing the wider community with a community building, providing opportunities toparticipate in meetings, social gatherings, cultural events and educational opportunities
- Providing the community an environment for social and economic opportunities anddevelopment
Reason for this Community Land Management Plan
The reason for the Town of Gawler Administration Centre Community Land Management Plan is to:
- Provide direction in the management of the land ensuring continued support to the widercommunity in the provision of a diverse range of core Council administrative services
- Provide the wider community with a community facility that provides opportunities for theparticipation in meetings, social gatherings, cultural events and educational opportunities
- Provide the community an environment for social and economic opportunities anddevelopment
- Provision of a facility that is management and developed for the benefit and enjoyment ofthe community

Objective of this Community Land Management Plan
The objectives of this Community Land Management Plan are to:
- Achieve a diverse community facility that is well utilised and valued by the widercommunity, businesses and visitors to the Town of Gawler
- Provide physical and social infrastructure and development to match population growth- Support and encourage community involvement and teamwork- Deliver ongoing effective and efficient services, including support for regional collaboration- Support the refurbishment and redevelopment of civic buildings and areas within the public
realm, creating destinations that appeal to all ages and serve a changing population,subject to available financial and physical resources
- Promote people-orientated activities at key town precincts- Support the timely provision of community facilities and services to meet community
expectations- Ensure all council owned infrastructure is managed and maintained in a sustainable
manner and to a quality the community can afford- Design and develop pedestrian-friendly areas in key civic and Town Centre precincts- Provide the ability to offer leases, licences and permits to community and commercial
entities in accordance with the requirements of the Local Government Act 1999 andCouncil policies
- Manage the facility in an environmentally sensitive manner in accordance with soundfinancial management principles.

During the life of this Community Land Management Plan it is anticipated that there may be changes to By-Laws, Policies and Plans – where those changes do not change the intent of this Community Land Management Plan, this Plan will be updated accordingly and public consultation will not be undertaken.
Where the intent of this Plan is changed through changes to legislation, Council’s By-Laws, Policies or Plans Council will undertake public consultation in accordance with its Public Consultation Policy and the requirements of the Local Government Act 1999.

- Review the needs of the community and stakeholders, including lessees, determining andeffective strategy for the on-going future of the site
- Enhance the accessibility, aesthetics and functionality of the facility- Review the economic development to the community by reviewing opportunities for the
facility- Ensure a legislatively compliant annual building maintenance and inspection schedule is in
place, including Work Health and Safety requirements.
Community Land Management Plan Performance Measures
The performance measures associated with this Community Land Management Plan are:
- Community and economic opportunities associated with the site are optimised- Site is maintained in good and safe repair according to Council‘s building maintenance
schedules, risk and WHS requirements- Improved and well utilised facility- Site specific management plan developed, implemented and reviewed- Annual review and consultation with lessee’s.

Lease, Licence Permit Details
During the life of this Community Land Management Plan it is anticipated that there may be amendments or variations to current leases, licences and permits – where those amendments or variations do not change the intent of this CLMP, it will be updated accordingly and public consultation may not be undertaken.
Where the intent of this Plan is changed through changes to legislation, Council’s By-Laws, Policies or Plans Council will undertake public consultation in accordance with its Public Consultation Policy and the requirements set out in the Local Government Act 1999.
Council will continue to negotiate and enter into leases, licences and permits within the scope of this CLMP, the LGA 1999 and Council policies. Such negotiations will clearly define the responsibilities of Council and lessee’s, with those responsibilities monitored regularly ensuring the responsibilities of all parties are being met appropriately.

LICENCE AGREEMENT
BETWEEN: THE CORPORATION OF THE TOWN OF GAWLER of 89Murray Street, Gawler SA 5118 (together with its successors andassigns and which in this Licence is called "the Council")
AND: SHAUN LOUIS PIEROTTI and DIANNE PIEROTTI both of53 Panter Street Willaston SA 5118 (together with their heirsexecutors administrators and assigns and who in this Licence aretogether called "the Licensee")
BACKGROUND:
A. The Council has the care and control of the land marked in red in the plan contained
]in Annexure A.
B. The Licensee has requested a licence to use a portion of the above mentioned landfor the purpose of establishing and maintaining a car park for the adjoining golfcourse, of which the Licensee is the proprietor.
C. The Council has resolved to grant the licence over the area marked "A" on the plancontained in Annexure B which in this Licence is called "the Premises".
D. The Licensee and the Council wish to record the other terms of the licence in thisdocument.
AND THE PARTIES AGREE as follows:
1. ACKNOWLEDGMENT OF BACKGROUND
The preceding statements are accurate and form part of this Licence.
2. GRANT OF LICENCE
23 The Council grants the Licensee, and the Licensee accepts, a licence of the Premisesfor the term often (10) years, commencing on 1st day of July 1998 and upon all thefollowing terms and obligations.

3.2 Rates and Taxes
To pay, on time and in lull all rates, taxes (excluding state land tax),assessments and charges in relation to the Premises which are now, or mayat some time during the term, be charged, levied or payable by either theCouncil or any occupier of the Premises.
I 3.3 Utilities and OutgoingsI
3.3.1 To pay any and all charges for telephone, water and sewerage and.1
.for water, gas and electricity consumed on the Premises.
3.3.2 To pay all duties, fees, charges and taxes paid or payable by the3 Council as a consequence of the Council being the owner of the
Premises.I
3.4 Use of PremisesI3 Not to use the Premises for any purpose or activity other than that of a car
park for the use of the patrons of the Gawler Par 3 Golf Course.I
3.5 LegislationI.3 To comply (at its own cost and expense in all things) with the provisions of
all acts, regulations, by−laws and all directions and orders of any localI government or semi−government authority in relation to the Premises.
3 3.6 Maintenance and Repair
3 3.6.1 That the Licensee will keep the Premises in good repair.
3.6.2 That all plumbing and drainage on the Premises must be3 maintained by the Licensee in good working order and be kept
free from all blockages.I
3.6.3 That the Licensee will maintain in good condition the linemarkingas completed by the Licensee pursuant to Clause 3.17, provided
3 always that the Licensee must undertake re−linemarking no lessfrequently than every two years from the date of commencement
3 of this Licence.
3.6.4 That the Licensee will repair any potholes or other defects in thesurface of the carpark, constructed and sealed by the Licensee inaccordance with Clause 3.17.
3.6.5 That the obligations imposed upon the Licensee in this Clause 3.6are all to be carried out at the Licensee's cost.

3.7 Repairs by Council
3.7.1 Provided that the Licensee is given reasonable notice, the Licenseewill allow the Council to come onto the Premises for the purposeof inspecting its condition and state of repair.
3.7.2 If the Council finds that any part of the Premises needs repairingthen the Council may notify the Licensee.
3.7.3 I f the Licensee has not carried out the work required by the notice,to a standard reasonably acceptable to the Council within the time
] set out in the notice, which unless in the case of an emergency willnot be less than fourteen days, then the Council may come ontothe Premises at a reasonable hour to carry out the repairs. Thecost of the repairs and any other reasonable expenses incurred by
j the Council will be recoverable from the Licensee.
3.7.4 In the case of an emergency no notice need be given by theCouncil.
3.8 Non−exclusive Possession
3.8.1 The Licensee acknowledges that it is not granted exclusivepossession of the Premises.
3.8.2 The Licensee may not exclude or attempt to exclude any person orvehicle from the Premises, except in circumstances where theLicensee reasonably considers that the person or vehicle is causinga nuisance or disturbance or is engaging in an inappropriate use ofthe Premises.
3.9 Prohibition on Charging for Entry
The Licensee may not charge or levy any rate, payment or fee for the use ofor entry onto the Premises.
3.10 Erection of Buildings
Subject to Clause 3.19, unless with the Council's written consent, theLicensee will not make any structural changes to the Premises such aserecting any buildings. Any approved alterations to the premises must be
: 1 carried out in accordance with all planning and building approvals.
3.11 Signs
The Licensee must not put up, attach or erect any signs on the Premisesunless it has received the Council's written consent.

3.12 Offensive Activities
The Licensee must not create a nuisance or disturbance to the detriment ofeither the Council or the occupiers of adjoining lands, nor will it carry onany offensive or dangerous trade or business from the Premises.
3.13 Offences
The Licensee must not carry on any activity or do anything or fail to dosomething which is or may become an offence under any act or regulationor by−law.
3.14 Assignment
3.14. 1 The Licensee is not permitted to transfer, assign, sublet orotherwise give up possession of the Premises unless it hasreceived the Council's written consent.
3.14.2 The Licensee will be responsible to satisfy the Council that anyproposed new licensee will be a suitable body to use and occupythe Premises.
3.15 Surrender
3.15.1 Upon the expiration or earlier termination of the term, theLicensee will peacefully and quietly surrender and give uppossession of the Premises and all buildings located upon thePremises.
3.15.2 The Licensee is obliged to leave the Premises in good order,condition and cleanliness.
3.15.3 The Council may request the Licensee to remove all the Licensee'sfixtures and fittings and in doing so cause no damage to thePremises. The Licensee will be responsible for repairing at itsown cost any damage caused in removing its fixtures and fittings.For the purposes of this clause, "fixtures and fittings" does notinclude the improvements to the Premises described in clause3.19.
3.15.4 Any reasonable costs incurred by the Council in cleaning orrepairing any damage caused by the Licensee in surrendering thePremises may be recovered by the Council from the Licensee. 4

3.16 Indemnity
The Licensee will indemnify and hold the Council harmless from andagainst all actions, claims, demands, losses, damages, costs and expensesfor which the Council is or may be, or becomes liable in respect of thePremises. In this Clause 3.16 the term "the Licensee" includes theLicensee's servants, agents, customers, contractors or other personsclaiming through or under the Licensee.
3.17 Public Liability Insurance
3. 17. 1 The Licensee must take out and during the term continue tomaintain a public risk insurance policy.
3.17.2 The policy will be in respect of injury, loss or damage occurringon the Premises and it will note the Council's rights and interest asproprietor of the Premises and also the indemnities provided bythe Licensee in favour of the Council.
3.17.3 The policy must carry an endorsement from the insurer that theinsurer will inform the Council if the policy is allowed to lapse oris otherwise cancelled.
3.17.4 The cover will be for a minimum amount of TEN MILLIONDOLLARS ($10,000,000.00) per claim or any other amount
I which the Council advises the Licensee.
1 3.17.5 On the Commencement Date and on the anniversary of that dateduring the term the Licensee must provide Council with a copy ofthe Insurance Policy and a receipt acknowledging payment of the
I annual premium.
173 • 3.18 Release
3.18.1 The Licensee agrees to occupy, use and keep the Premises at theLicensee's risk.
3.18.2 The Licensee agrees to release the Council and its agents,servants, employees and contractors from all claims and demandsof every kind resulting from any accident, damage or injuryoccurring on the Premises except if such accident, damage orinjury is caused by the negligence of the Council or its agents,servants, employees and contractors.
3.18.3 The Licensee agrees that the Council will have no responsibility orliability for any loss or damage to the Licensee's fixtures orfittings or personal property.

3.19 Licensee's Works
3. 19. 1 The Licensee will construct a rubble surface carpark and drivewayto the satisfaction of the Council by no later than the 3 1st January1999 using bitumen treated rubble on the driveway, and inaccordance with the plan contained in Annexure C.
3.19.2 The Licensee will seal the driveway to the satisfaction of theCouncil by no later than the 31st day of July 1999 and inaccordance with the plan contained in Annexure C.
3.19.3 The Licensee will seal and linemark the balance of the carpark tothe satisfaction of the Council by no later than the 31st day ofJanuary 2000 and in accordance with plan contained in AnnexureC.
)3.19.4 Failure by the Licensee to complete the works described in this
Clause 3.19 will be a breach of this Lease for the purposes ofClause 5.2.
4. COUNCIL'S OBLIGATIONS − QUIET POSSESSION
The Council agrees with the Licensee that while the Licensee keeps its obligationswhich are contained in this Licence, then the Licensee may use the Premises for thepurposes set out in Clause 3.6.
:35. MUTUAL OBLIGATIONS
The Council and the Licensee mutually agree as follows:
7−3 5.1 Ownership of Improvements
3 5. 1. 1 That unless the Licensee obtains the Council's writtenacknowledgment, then, irrespective of whether the Council or theLicensee purchased them, all structures, improvements, fixturesand fittings located on the Premises at any time during the termwill become the property of, and belong to the Council.
5.1.2 The preceding subclause is not to be read as inconsistent with theCouncil's right in Clause 3.13 to require the Licensee to remove itsfixtures and fittings upon surrendering the Premises.

5.2 Default
If the Licensee commits any breach of this Leasee which, is either notcapable of being completely put right, or is not put right within fourteen(14) days from the date of the Council's notice to the Licence, identifyingthe breach and requiring it to be put right, then, the Council will be entitledto terminate this Licence and may enter into possession of the Premises.The right to terminate the Licence and enter into possession will not reducethe Council's rights to take any other action for any of the Licensee'sprevious breaches.
5.3 Default Interest
5.3.1 The Council will be entitled to charge the Licensee interest at thePrime Bank Rate defined in the Local Government Act plus 3 percentum per annum.
J.5.3.2 Interest will accrue on any moneys due but unpaid by the
Licensee, calculated from the due date for payment until themoney has been paid to the Council in full.
5.4 Resumption
I f after the Council receives notice of any proposed resumption oracquisition of the Premises by any Government (meaning Federal State orLocal) or any other authority, or if the control of the Premises is otherwisetaken away from the Council, the Council will be entitled to terminate thisLicence. Neither party will be permitted to bring any claim forcompensation against the other except for any previous breaches of thisLeasee.
5.5 Renewal
5.5.1 The Licensee will be entitled to an extension of this Licence forthe period often (10) years provided that:
ii5.5.1.1 the Licensee gives the Council a written notice of its
desire to, be granted the extension, not less than three (3)and not more than six (6) months before the expiration ofthe term of the Licence;
i5.5.1.2 the Licensee is not in breach of the Licence either at the
'1 time the notice is given or any time up to the expiry ofthe term of the Licence; and
15.5. 1.3 the Licensee has not committed any frequent and/or
I substantial breaches of the Licence during the term.I

5.5.2 The extended term will be on the same terms and conditions asthis Licence or such other terms as the parties may agree but willexclude this Clause 5.5 granting a right of extension, and Clause3.17 in relation to the Licensee's Works.
5.6 Holding Over
If the Licensee continues to occupy the Premises after the expiry of theterm, or after the Licence is terminated then the Licensee will occupy on amonthly basis on the terms and conditions contained in this Licence, andeither party may give the other one (1) month's notice to terminate theLicence.
5.7 Waiver
The failure or omission by the Council to take any action for breach of anyEl of the terms of this Licence will not stop the Council from taking action in
relation to any other breaches of the same or any other term or condition of−' the Licence.
5.8 Notice
Any notice which is required to be given by either party must be given bydelivering it or posting it to the other party at the address appearing in thisLicence. Notices to the Council must be addressed to the City Manager.
5.9 Severance
If any provision or obligation of this Licence is invalid, unlawful or notapplicable, then it will be deleted from the Licence without affecting anyother of the parties' obligations under this Licence.
5.10 Entire Agreement
The terms contained in this Licence comprise the whole of the agreementbetween the parties. It is expressly agreed and declared by the parties thatno further or other terms exist between them with respect to the Premises orthe Licence.
5.11 No Warranty
35 The Licensee specifically acknowledges that before signing this Licence itwas given no warranty as to the suitability of the Premises (whetherstructural or otherwise) for the use by the Licensee.
− 5.12 Conditional Licence
This Licence is subject to the Licensee obtaining at its own expense anynecessary approvals or consents, including but not limited to any consentrequired by the Development Act.

5.13 Costs
The Licensee will pay the stamp duty assessed on the Licence together withall costs incurred by the Council as a result of the Licensee's breach orthreatened breach of the Licence.
5.14 Interpretation
In this Licence, unless the context otherwise requires:
5.14.1 reference to any legislation includes subordinate legislation and allamending or substituting legislation;
5.14.2 words in the singular are capable of including the plural and viceversa and words importing one gender are to be read as includingthe other genders where appropriate;
5.14.3 any reference to a natural person will also apply to a bodycorporate and vice versa:
5.14.4 any reference to the term of this Licence includes any extension ofit
5.14.5 all moneys payable by the Licensee to the Council under thisLicence will be recoverable as a debt;
5.14.6 any consents must be obtained in writing and before any work,alteration or activity is undertaken;
5.14.7 the "Council" includes its servants, agents and workers.
The parties acknowledge the preceding clauses by their execution of this Licence.

ELDERLY CENTRE ADVISORY COMMITTEE TERMS OF REFERENCE

1 Background
1.1 Pursuant to Section 41 Part 3 of the Local Government Act 1999 ("the Act") the Council establishes the Elderly Centre Advisory Committee (referred to in these Terms of Reference as "the Committee").
1.2 The Committee is formed for a period 16 December 2014 24 November 2015 until the next general election or otherwise reviewed. until 24 November 2015 Council meeting.
1.3 The Committee may be wound up at any time by resolution of the Council.
2 Function of the Elderly Centre Advisory Committee
2.1 The Committee is established for the purpose of supporting the effective and efficient management of the Elderly Centre (“The Centre”).
2.2 The Committee will adopt a risk management focus in its considerations and recommendations to Council to enable Council to act as an informed and responsible decision maker representing the interests of the community.
3 Membership
3.1 Membership of the Committee will comprise of up to:-
3.1.1 Two (2) Council Members, for a period determined by Council
3.1.2 One (1) member nominated by Gawler and Districts Senior Citizens Club
3.1.3 One (1) member nominated by Gawler Care and Share Group Inc
3.1.4 One (1) member nominated by SA Pensioners Association Inc – Gawler Branch
3.1.5 One (1) member nominated by Gawler Low Vision Support Group
3.1.6 One (1) member nominated from each of the regular community groups (meeting greater than six (6) times per annum) with a maximum of four (4) representatives
3.1.7 One (1) community representative nominated by the Committee
3.1.8 One (1) independent Presiding Member appointed by Council. in accordance with the Council’s endorsed selection criteria.
3.1.9 All member community groups will have a nominated proxy.

3.2 The Council at its meeting held on 16 December 2014, appointed the following Council Members to the Committee.

3.23 The Council may alter the Committee membership by a decision of the Council.
3.34 All community representative and group nominated appointments and proxies are made for a period of two (2) years commencing from the date the appointment is adopted by Council.
3.45 The Committee may, by a vote supported by a majority of members of the Committee, make a recommendation to the Council to remove a member of the Committee from office where a member has failed (without the leave of the Committee) to attend three consecutive meetings of the Committee.
3.56 A member of the Committee who has an interest in a matter before the Committee must disclose the interest to the Committee (refer Code of Practice for Committee Meeting Procedures).
4 Chairperson (Presiding Member) and Deputy Chairperson
4.1 The Chairperson will be appointed by Council for a term of two (2) years.
4.21 The Committee will appoint a Deputy Chairperson from its members at the first meeting of the Committee for athe term of two (2) years.determined by Council in 1.2
4.23 If the Chairperson of the Committee is absent from a meeting then the Deputy Chairperson will preside at the meeting until the Chairperson is present. In the absence of the Chairperson and the Deputy Chairperson a member of the Committee chosen from those present will preside at the meeting until the Chairperson is present.
4.43 The Chairperson of the Committee will have a casting vote on a question arising for decision at the meeting, but not a deliberative vote.
5 Meeting Details
5.1 The Committee does not have any delegated powers from the Council so all decisions of the Committee constitute recommendations to the Council. The Council may delegate powers to the Committee on an ad hoc basis from time to time.
5.2 The Committee shall generally meet on a bi-monthly basis but no less than six (6) meetings per year or as otherwise determined by the Committee.
5.34 The Committee shall meet at a Council building or as otherwise agreed by a majority of the Committee members.

5.45 All Committee meetings will be conducted in accordance with the Local Government Act 1999, and relevant Regulations, Code of Practice for Committee Meeting Procedures and Code of Practice for Access to Council and Committee Meetings and Council Documents. Part 2 of Local Government (Procedures at Meetings) Regulations 2013 does not apply to this Committee.
5.56 Notice of the meetings and Committee Agenda will be given to all Council
Members. 5.6 A quorum for a meeting of the Gawler Elderly Centre Advisory Committee shall be
half plus one of the committee membership.
6 Reporting Requirements
6.1 This Committee reports directly to Council. 6.2 The Committee shall make whatever recommendations to the Council it deems
appropriate on any area within its Terms of Reference, where in its view action or improvement is needed.
6.3 Recommendations from the Committee will be referred to the next RegularOrdinary
Council meeting, through the presentation of minutes, for final resolution. 6.4 The Committee must produce an Annual Review report for consideration by the
Council at the end of AugustOctober each year.
