The Regular Meeting of the Board of Trustees of the Town of Elizabeth was called to order on

Tuesday, April 28, 2020, at 7:05 pm by Mayor Megan Vasquez.

Management Team May 12, 2020 Management Team - Monitoring Report Administration/Town Administrator – Matt Cohrs Town Trail – The pedestrian bridge over Running Creek just north of SH 86 is coming along with most of the concrete work completed. Grading of the trail south of SH 86 going to Running Creek Elementary School is ongoing. Concrete work on the trail starting at Evans Parks is scheduled to start this week as well. Community/ Economic Development – Grace Erickson Staff recently met with Emily Briggs from The Elizabeth Brewing Company regarding the 2020 Elizabeth

Farmers Market. The Elizabeth Brewing Company is seeking termination of the License for this year’s

farmers market. Staff and Ms. Briggs agree that terminating the license is necessary from a financial

standpoint due to the uncertainty in planning as well as a safety standpoint. Ms. Briggs would like to

potentially use the Town’s lot to host a local event this fall, pending the conditions at that time. The Town

could pursue a License or similar agreement with The Elizabeth Brewing Company at that time if conditions

allow. Staff is seeking the Board’s direction on termination of the License. Pending direction from the Board,

Staff would work with the Town attorney to formally terminate the License. Current License is attached.

Staff is recommending termination of the Agreement for Management and Delivery of the Elizabeth

Hops Fest, Wine in the Pines, and Mayor’s Tree Lighting Events between the Town and Lively Events, LLC.

Staff and Lively Events agree that cancellation of this year’s events is necessary due to the uncertain

conditions which could result in safety issues if events were held and financial loss if events were cancelled

after planning activities have taken place. Lively Events has spent $1,000 on the event so far but has paused

planning activities due to conditions. Staff is seeking direction from the Board on reimbursement for the

dollars spent along with termination of the agreement. The agreement is attached.

Per the last Board of Trustees meeting, Staff is working with our team to prepare a comprehensive list

of businesses accommodations propose to the Board. The accommodations would provide flexibility to

businesses in regard to temporary signage, food trucks, sidewalk sales, and parking lot sales. We anticipate

proposing a Resolution addressing a number of these items at the May 12th meeting.

Staff is working with the Main Street Board of Directors to continually provide outreach regarding

available resources. We anticipate a meeting in May to further discuss available resources and outreach.

SUMMARY On May 7th, a partially virtual court was held with steps for defendants to follow to ensure social distancing. Police Officers checked in defendants (step 1) and had them wait in their cars, or they could wait outside at a safe distance from one another. Four people were allowed in the courtroom at a time. There was an area to sit and wait (step 2) before the prosecutor called them in to meet with her (step 3). Once they finished with the prosecutor, they would go to a waiting area, or directly to a table with an iPad set up to meet with the judge (step 4). Judge White was in the conference room behind the boardroom with a computer. A zoom webinar was set up to facilitate the conversations between the Judge and the defendants. The clerk kept records and sent fine and fee amounts to the cashier at the front desk. Once the Judge ordered sentences, defendants went out and around to the front of Town Hall and to the front desk (step 5) to pay any fines and fees they may have been ordered to pay.

Little to no paperwork was exchanged. Classes were displayed on whiteboards for defendants to take pictures of. The clerk will mail any required paperwork to defendants after court. The Public Works Department built plexiglass dividers for the front desk and the prosecutors conference table. Directions were posted at check-in and signs were place for each step in the process, as well as arrows on the floor to direct traffic. Facemasks were provided and all, but one person wore a mask in court. No-one had a complaint on how the new court procedures went. The police department, judge, prosecutor and clerks had input into how to assure that the opening of the court was as safe as possible while continuing to provide defendants due process. The Elizabeth Municipal Court, to my understanding, was the third court to reopen since the COVID-19 closures.

SUBJECT: Public Works Monitoring Report

The Town of Elizabeth Public Works continues to be operating full time with full staff while practicing social distancing

from each other and the public to remain safe and healthy. Please see attached Wells, Tanks and Effluent reports for

January through April 2020.

1. Public Works has CLOSED Larmer and Bandt Park playgrounds during the COVID-19 pandemic. (Open

space is still usable).

2. Public Works completed the removal of the Larmer Park (W. Elm St. and S. Tabor St.) existing playground

equipment due to safety issues and being out-dated. The dirt work has been completed and will be receiving

a concrete border to surround the New playground equipment and the rubberized safety material that is

replacing the old existing wood mulch. Larmer Park will receive 4 new colorful picnic benches and trash bins

with lids. The color scheme includes bright blue, yellow, tan, green and red. Larmer Park is a park that is

considered infant through age 5 (toddlers). Public Works has removed 1 very large Elm/Cottonwood tree

that was damaged during a lightning storm years ago and deemed unsafe and unhealthy. The removal of

this tree will allow for a more uniform storm drainage flow whereas it created a fully shaded semi wet area.

The stump is scheduled to be ground below the surface and seeded for grass. Public Works anticipates the

Park completed the end of May 2020 depending on weather and other duties.

3. Public Works is working with JVA Engineering for upgrading Gold Creek Lift Station Pump sizing for

Ritoro/Gold Creek Filings 2 and 3 build out.

4. Public Works continues to work with JVA Engineering and HRS Water Engineering for the drilling of the

New Arapahoe and Denver acquifer wells within the Ritoro/Gold Creek filing 2 property.

5. Public Works continues to work with JVA Engineering to build and equip the New Well house for the water

treatment facility, tank distribution, and Supervisory Control and Data Acquisition (SCADA) communications

systems.

6. County Rd. 13 Realignment Project is on schedule and moving forward with all the Utilities (Century Link,

Black Hills Energy, IREA, ComCast, and Future Fiber Optic lines) relocations and the New Sanitary Sewer

line installation on the West side of the shell station. The New Sanitary Sewer service line has been installed

and passed pressure, lamp and deflection inspection per the Town of Elizabeth Water and Sewer

Standards. The New 12-inch Water Line tie-in is scheduled for Friday night May 1st that will allow the

addition of 3 New Water Main Valves, extend Main line out of Hwy 86 was completed within the new

intersection and went extremely well with no disruption of service during business hours. This will allow the

repaving and the reopening of Elizabeth St. on schedule May 30 (possibly sooner). Public Works and CORE

Engineering are completing daily inspections of installations.

7. Public Works has completed the Water Storage Tank cleaning, inspection and disinfection during the month

of April per CDPHE Tank Rules 100 Compliance schedule. Inspection reports will be relayed in the May 26

BOT Monitoring report.

8. Public Works has tentatively placed Town Clean Up Day on hold during the COVID-19 pandemic. PW has

tentatively scheduled for September 2020 and details will be updated as we get closer to that date.

9. Public Works has placed the Paint Round Up scheduled event on hold during the COVID-19 pandemic. The

tentative new date is for September or October 2020.

10. Public Works will NOT be conducting the High School Student Volunteer Clean-Up as students are out of

school during COVID-19.

11. Public Works has begun the grading and watering for dust suppression on County Rd. 13 South of County

Rd. 136 for the summer season. Public Works believes this will be required less over the next two months

due to no school and less commuter traffic.

12. Street Sweeping will be conducted once the COVID-19 pandemic subsides as to not create excess dust for

the public and staff. PW will be sweeping the PD parking lot in preparation for parking lot striping.

13. The CDOT Hwy 86 Cross Walk/Street light signage has been completed at Hwy 86/Main St. and Hwy 86

and Elbert St. Hwy 86 and Banner St. is 100% complete. The cross-walk areas have street lighting and

cross walk push button activated flashing lights that will help ensure the safety of pedestrians crossing Hwy

86.

14. Public Works added asphalt ramps at the Main St. Crosswalk to more easily enable wheelchair and walker’s

access to Gesin lot parking and access to businesses until CDOT’s ADA Crosswalks project that will be

taking place later this year.

15. Public Works has begun the yearly Lead/Copper Drinking Water Sampling that is required to remain

compliant by CDPHE.

16. Public Works has completed the Electrical Outlet Installation Project at the Gesin Event lot with Duplex

Ground fault outlets along the perimeter fencing. Gesin Lot now has live power and water that will allow

events without the need for extension cords and water hoses running within the lot but along the outside

perimeter for a safer environment.

17. Public Works has worked with CDOT and Scott Contracting to have the Northern portion on County Rd. 13

North of the realignment project to the Town Limits to be Street Striped at the same time the realignment

striping takes place at NO cost to the Town.

18. Public Works Gold Creek Waste Water Treatment Plant (GCWWTP) continues to have 99% removal of

Total Suspended Solids (TSS), 99% removal of Bio-chemical Oxygen Demand (BOD), 99% removal of

Nitrogen (Ammonia) and 99% removal of E-coli. CDPHE requires by Permit that GCWWTP remove the

minimum of 85% of these constituents for CDPHE Compliance. GCWWTP has just surpassed 11 straight

years of 99% removal of all constituents to continue to remain CDPHE Compliant.

19. GCWWTP as it exists is Designed for .5 MGD (million gallons day) (1/2 MGD or 500,000 gallons per day)

processing. GCWWTP currently operates treating an Average of .120MGD or 120,000 gallons per day,

which is 24% of the Design Capacity when construction completed and started treating sewage on April 7,

2009.

20. GCWWTP continues to operate 100% Chemical Free it operates Biologically (allowing bacteria and

organisms to eat, reproduce and die). GCWWTP is the only Waste Activated Sludge (WAS) Plant in the

SUMMARY

Ordinance 20-02 would amend Chapter 16 of the municipal code regarding horses and chickens. The proposed ordinance would allow up to twelve chickens on a property (currently up to six are allowed) and would allow required coops to be up to 240 square feet in size (currently 120 square feet is the maximum coop size allowed). Additionally, the proposed ordinance would allow property owners that have horses deemed a legal nonconforming use to keep the number of horses existing as of March 9, 2010, and replace a deceased horse to assure that two horses are kept during such time the use is a legal nonconforming use. Background The Board of Trustees originally passed an ordinance regulating horses, chickens, and livestock in 2010. The Board amended the regulations in 2019 to include miniature horses in the definition of horse and to add the definition of miniature horse to take into account Americans with Disabilities standards. An exemption was included for miniature horses that have been individually trained to do work or perform tasks for people with disabilities. The 2019 amendment also set a limit on chickens to allow no more than six chickens per parcel, allowing hens and prohibiting roosters. The amendment included the requirement of coops with placement and dimensions. The Board of Trustees held a work session on horses and chickens on February 25, 2020, where the revisions in Ordinance 20-02 were discussed. The Board sought to allow the replacement of a deceased horse to assure two horses are kept during such time the use of a property is a legal nonconforming use. Additionally, the Board sought to increase the allowed number of chickens from 6 to 12 based on feedback received from Elizabeth residents. Public Notice Notification procedures have been completed as required in Chapter 16, Article IV of the Elizabeth Municipal Code.

Notice was published in Ranchland News March 19, 2020.

PLANNING COMMISSION RECOMMENDATION The Planning Commission held a hearing on the proposed amendments on May 5, 2020. The Planning Commission voted to recommend approval of Ordinance 20-02 to the Board of Trustees with the following conditions:

Add requirements for registration of horses on all properties, conforming and nonconforming,

within the town.

Omit the proposed amendment to Section 16-1-210.

deceased horse to assure that two (2) horses are kept during such time the use

is a legal nonconforming use. All horses and livestock must be registered as

nonconforming with the Town. Miniature horses that have been individually

trained to do work or perform tasks for people with disabilities shall be

exempted from the provisions of this Section.

Section 2. Section 16-1-215, subsections (e) and (h) of the Elizabeth Municipal

Code are hereby amended to read as follows:

Section 16-1-215. Backyard Chickens

(e) Maximum Numbers. No more than twelve (12) chickens are

permitted per parcel.

remaining provisions of this Ordinance, the intent being that the same are severable.

Section 4. The Board of Trustees hereby finds, determines and declares that this

Ordinance is promulgated under the general police power of the Town, that it is promulgated

for the health, safety and welfare of the public, and that this Ordinance is necessary for the

preservation of health and safety and for the protection of public convenience and welfare.

The Board of Trustees further determines that the Ordinance bears a rational relation to the

proper legislative object sought to be attained.

Section 5. This Ordinance shall become effective thirty (30) days after

publication.

SUMMARY Currently, the Town of Elizabeth does not have any specific language in our code that would apply to the regulation of park land areas, which includes the new town trail. Given the current progression of work on the town trail, a new ordinance is needed to create the regulations necessary for the trail and its use upon completion. Ordinance 20-03 creates the regulations which are needed for the trail, as well as better defined regulations for our existing park areas. Staff coordinated with the Town Attorney in reviewing existing park land regulations in other municipalities, especially related to trails, to prepare the new ordinance. The ordinance addresses topics such as hours of operation, vehicles, parking, littering, glass containers, vandalism, trail use (etiquette), and animals. Ordinance 20-03, if approved, would go into effect 30 days after its publication. Section 1. Chapter 14 of the Elizabeth Municipal Code is hereby amended with

the addition of a new Article VI, entitled "Park Regulations" to read as follows:

ARTICLE VI

PARK REGULATIONS

Sec. 14-6-10. Definitions.

As used in this Article:

Law enforcement officers means all authorized officers of the Police

Department.

Motorized vehicle means automobiles, trucks, farm or agricultural

vehicles, motorcycles, motorbikes, go-carts, snowmobiles, motorized bicycles,

all-terrain or other recreational vehicles. The term shall not include personal

power mobility devices used by individuals with disabilities, including but not

limited to motorized wheelchairs.

Park lands means all public recreation lands and parks, including trails,

owned, leased, or operated by the Town.

Town mean the Town of Elizabeth, Colorado.

Sec. 14-6-20. Hours of Operation.

Park lands shall be open for daytime use only, between the hours of

sunrise and sunset.

Sec. 14-6-30. Vehicles.

It is unlawful for any person to operate any motorized vehicle on any

park lands, except on designated roadways which are specifically designated

as open for use by such vehicles.

Sec. 14-6-40. Parking.

Bicycles, vehicles, or trailers must be parked only in designated areas

and/or in compliance with all posted parking signs. It shall be unlawful to park

bicycles, vehicles, or trailers where prohibited or in such a manner as to create

a hazard or to obstruct vehicular, pedestrian, or bicycle traffic, or damage

natural resources. Vehicles may not be left parked and unattended at any time

from sunset to sunrise except with permission from the Town.

Sec. 14-6-50. Littering/Dumping.

It is unlawful to deposit or dispose of trash, garbage, rubbish, litter,

debris, or other objects within park lands. Trash and debris legally generated

within park lands must be removed or deposited in a designated trash

receptacle. Under no circumstances may hazardous materials be deposited

within park lands.

Sec. 14-6-60. Glass Containers.

No glass bottles or other glass containers shall be allowed on park

lands.

Sec. 14-6-70. Vandalism.

It is unlawful for any person to destroy any park land property. Any

person who pleads guilty or nolo contendere, or is found guilty at trial, of a

violation of this Section shall be financially liable for such damage to park land

property.

Sec. 14-6-80. Trail Use.

(a) It shall be unlawful for any trail user to fail to yield to any trail

user in the manner defined herein or as otherwise posted at trailheads: all users

yield to equestrians, bicyclists yield to pedestrians, and bicyclists traveling

downhill yield to bicyclists traveling uphill.

(b) All trail users shall travel on the right side of the path, except

to pass another trail user.

(c) Travel off designated trails is prohibited at all times.

Sec. 14-6-90. No camping.

It shall be unlawful to undertake or engage in camping or camping-

related activities within or upon park land property of the Town.

Sec. 14-6-100. Animals.

(a) It is unlawful on any park lands to hunt, trap, catch, molest,

harm, kill, or chase any wild animal or bird, or to molest their habitat.

(b) It is unlawful to molest, harm, or chase any livestock on park

lands, including cows in pastures on lands adjacent to trails.

(c) Animals including dogs and other domestic animals shall not

be allowed in park lands of the Town pursuant to Section 7-7-310 of the

Elizabeth Municipal Code, except that such animals may be allowed to use

recreational trails of the Town, provided that any owner or person having

control of any dog or other domestic animal shall not permit such animal to

defecate on park lands unless such defecation is removed immediately and

deposited in marked waste receptacles.

Sec. 14-6-110. Violation and Penalty.

Failure to comply with any of the terms of this Article shall constitute

a criminal violation. Any person who is found guilty of, or pleads nolo

contendere to the violation of, any provision of this Article shall be subject to

the criminal penalties set forth in Section 1-4-20 of this Code.

Dear Mayor and Trustees,

I have become aware that pursuant to the Colorado Revised Statutes, "if at any recall election the incumbent whose recall is sought is not recalled, the municipality may repay the incumbent for any money actually expended as expenses of such election when such expenses are authorized by C.R.S.A. 6 31-4-504.5" Section (2)(a) of this statute defines authorized expenses as including, but not being limited to, "moneys spent in challenging the sufficiency of the recall petition and in presenting to the voters the official position of the incumbent, to include campaign literature and advertising and the maintaining of a campaign headquarters."

According to the "Statements of Personal Expenditures by a Candidate" filed with the Town Clerk on March 16, 2020, April t, 2020 and April 24, 2020, together with supporting receipts, I personally expended a total of $1,163.74 to fund the cost of campaign literature and advertising to challenge the recall of my position on the Board of Trustees. I had no campaign committee soliciting contributions on my behalf nor did I receive a contribution or reimbursement of any kind. To that end, I believe that these expenditures are eligible for repayment according to the Colorado Revised Statutes as set forth above.

As you are aware and in light of the national and local states of emergency that we find ourselves a part of owing to the Coronavirus COVID 19 pandemic, members of our community are suffering tremendous difficulty in paying their bills and obtaining food to feed their families. Food banks to support urgent needs reach depletion within extremely short periods of time, and our rural location makes it nearly impossible to access more than a limited number of resources to keep our residents safe and fed.

Therefore, I respectfully request repayment of my authorized expenditures as outlined above so that I, in tum, can donate the entire sum, divided equally between Harvest Food Bank, Food Bank of Kiowa, and the E1izabeth Food Bank to support the urgent needs of citizens in our local Elbert County community. In light of dire circumstances brought about by this pandemic and the emergency declaration currently in place locally, I would very much appreciate your favorable consideration of this request. Food banks associated with Food Bank of the Rockies can purchase items for ten cents per pound to stock their shelves. This donation will make a significant difference for many of our neighbors in need.

SUMMARY

Resolution 20R16 would extend the declaration of Local Disaster Emergency until May 26th, 2020. The Town of Elizabeth previously issued an order declaring a Local Disaster Emergency in and for the Town of Elizabeth on March 17, 2020 in response to the COVID-19 pandemic. It has been extended at each Board of Trustee meeting since March 24th and needs to be extended again. This declaration follows the declarations released on a weekly basis by Elbert County since March 16th. The declaration allows the Town to be furnished aid and assistance through the state and federal governments. STAFF RECOMMENDATION Staff recommends approval of Resolution 20R16, a Resolution Consenting to and Extending the Order Declaring a Local Disaster Emergency in and for the Town of Elizabeth, Colorado until May 26th, 2020. RESOLUTION 20R-16

A RESOLUTION CONSENTING TO AND EXTENDING THE ORDER

DELCARNG A LOCAL DISASTER EMERGENCY IN AND FOR THE

TOWN OF ELIZABETH, COLORADO

WHEREAS, the Colorado Disaster Emergency Act, C.R.S. § 24-33.5-701, et seq. (the

"Act"), provides procedures for statewide and local prevention of, preparation for, response to, and

recovery from disasters and emergencies;

WHEREAS, pursuant to the Act, an "emergency" is an unexpected event that places life or

property in danger and requires an immediate response through the use of state and community

resources and procedures, and an "emergency epidemic" is cases of an illness or condition,

communicable or noncommunicable, caused by bioterrorism, pandemic influenza, or novel and

highly fatal infectious agents or biological toxins;

WHEREAS, pursuant to C.R.S. § 24-33.5-709, a local disaster emergency may be declared

"only by the principal executive officer of a political subdivision," here, the Mayor;

WHEREAS, on March 17, 2020, the Mayor did issue an order declaring a local disaster;

WHEREAS, pursuant to C.R.S. § 24-33.5-709(1), on April 28, 2020, the declaration of a

local emergency was continued or renewed for a period of 14 days until May 12, 2020 by the

Elizabeth Board of Trustees;

WHEREAS, pursuant to C.R.S. § 24-33.5-709(1), the declaration of a local emergency

shall not be continued or renewed for a period in excess of 7 days except by or with the consent of

Board of Trustees;

WHEREAS, pursuant to C.R.S. § 24-33.5-709(1), any order declaring, continuing, or

terminating a local disaster emergency shall be given prompt and general publicity and shall be

filed promptly with the Town Clerk, the County Clerk and with the state office of emergency

management; and

WHEREAS, immediately after it was issued, the attached order was given prompt and

general publicity, was filed with the Town Clerk and the Elbert County Clerk and Recorder, and

it was submitted to the Colorado Office of Emergency Management.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE

TOWN OF ELIZABETH, COLORADO AS FOLLOWS:

Section 1. The Board of Trustees hereby consents to and supports the Order Declaring

a Local Disaster Emergency in and for the Town of Elizabeth, Colorado.

Section 2. The Board of Trustees hereby extends the Order Declaring a Local Disaster

Emergency in and for the Town of Elizabeth, Colorado until May 26, 2020, unless sooner

terminated by action of the Board of Trustees, at which time the Order may be extended by action

of Board of Trustees.

Section 3. This Resolution shall be given prompt and general publicity, filed with the

Office of Emergency Management
