PROCEEDINGS:
The Government, in their Order fourth read above and in the subsequent
clarifications issued thereon, have revised the pension and pensionary benefits.
The Board is following the orders of the Government in respect of pensionary
benefits to its pensioners/family pensioners. The unions of the employees of the
Board as well as the various Pensioners Associations have represented for
adoption of the recent orders of the Government to the pensioners of the Board.
Considering their request, the Board, in the settlement dated 18.11.2009 entered
into with the unions of the Board under Section 12(3) of the Industrial Disputes
Act, 1947 before the Commissioner of Labour, has incorporated a term to the
effect that the recent orders on revision of pension issued by the Government to
their pensioners will be implemented for the pensioners of the Board in toto. In
pursuance of the terms of settlement referred to above of settlement, and in
deference to the request of the employees’ unions and Retired Employees’
Associations, the Board has decided to adopt the above orders of the Government
to the pensioners/family pensioners of the Board.

2. The Tamil Nadu Electricity Board after careful consideration, passes
the following orders: -
i) The basic pension as on 1.1.2006, 2.1.2006, 3.1.2006………….30.11.2007
of the existing pensioners who have not had the advantage of revision of pay with
effect from 1.12.2007 and who retired from posts on standard pay scales and
family pensioners will be allowed increase in pension at 40% of basic pension.
ii) The revised pension/family pension will be computed by adding the
following:
a) The existing Pension (before commutation)/Family Pension;
b) Dearness Pension, wherever applicable;
c) Dearness Allowance as on 1.1.2006 i.e. @ 24% on basic pension/basic
family pension plus dearness pension as admissible;
d) Fitment weightage @ 40% of the existing basic pension (before
commutation)/basic family pension. (If the amount of increase works out to
fraction of a rupee, it should be rounded off to the next higher rupee).
e) Where the existing pension in para 2(ii)(a) above includes the effect of
merger of 50% Dearness relief with effect from 1.8.2006, the existing
pension for the purpose of fitment weightage will be recalculated after
excluding the merger of dearness relief of 50% from the pension.
The amount so arrived at shall be the consolidated pension/ family pension with
effect from 1.1.2006. The consolidated pension/family pension shall be treated as
final basic pension with effect from 1.1.2006 and shall be entitled for grant of
Dearness Allowance sanctioned thereafter.
iii) The revised pension/family pension arrived at as above shall be
subject to a minimum pension/family pension of Rs.3050/- per month.
iv) The commuted portion, if any should be deducted from the revised
pension.
v) The upper ceiling on pension shall be 50% of the highest pay in the
Tamil Nadu Electricity Board (The maximum highest pay in Tamil Nadu
Electricity Board is Rs.67,000 + Grade pay of Rs.9,500/-).

vi) The provisional pension drawn by the pensioners shall be revised as
ordered in the Annexure-V to this order and the arrears shall also be regulated as
in the case of regular pensioners. However, the employees placed under
suspension beyond their superannuation date and drawing subsistence allowance
not exceeding provisional pension are not eligible to above said pension revision.
vii) The calculation of family pension at 30% of pay last drawn shall be
followed as hitherto subject to a minimum family pension of Rs.3050/- and the
maximum family pension at 30% of the maximum of the highest pay scale in
Tamil Nadu Electricity Board (i.e.) Rs.67,000 + Grade Pay of Rs.9,500/-. The
existing formula of granting enhanced family pension at fifty per cent of pay last
drawn in the event of death while in service shall be continued.
viii) In respect of the Contributory Pension Scheme, the contribution of
the employees in the revised pay scale shall be calculated at 10 per cent of Basic
Pay (Pay in the Pay Band + Grade Pay) and Dearness Allowance.
ix) Pensioners and family pensioners of the Board shall be allowed
dearness allowance on revised pension/family pension as allowed by the State
Government to their pensioners and family pensioners. The new rates of dearness
allowance admissible on the revised pension/family pension shall be:
a) With effect from 1st July 2006 : 2%
b) With effect from 1st January 2007 : 6%
c) With effect from 1st July 2007 : 9%
d) With effect from 1st January 2008 : 12%
e) With effect from 1st July 2008 : 16%
f) With effect from 1st January 2009 : 22%
g) With effect from 1st July 2009 : 27%
x) The maximum quantum of Gratuity/Death-cum-Retirement Gratuity
shall be enhanced from Rs.3.5 lakhs to Rs.10.00 lakhs. The difference amount of
Death-cum-Retirement Gratuity in respect of retirees from 1.1.2006 to 30.11.2009
shall also be disbursed in three equal installments.
3. The Board directs that the above pensionary benefits be granted with
notional effect from 1.1.2006 and with monetary benefit from 1.1.2007.

4. The Board has issued orders revising the scales of pay to its
employees and officers in (P) B.P. (Ch) No.223 (SB) dated 21.11.2009 and
(P) B.P. (Ch) No.224 (SB) dated 21.11.2009 respectively with effect from
1.12.2007. Therefore, the fixation of pension shall be subject to the provision that
the revised pension in no case shall be lower than fifty per cent of the minimum of
the pay in the pay band plus grade pay corresponding to the pre-revised pay scale
from which the pensioner had retired. The employees who have retired from
service prior to 1.12.2007 from the Selection Grade/Special Grade post, their
pension/family pension shall be calculated at 50% / 30% of the minimum of the
pay in the pay band + Grade pay applicable with effect from 1.12.2007,
corresponding to the pre-revised scale of pay of the post last held by the
employees at the time of their retirement i.e. Selection Grade/Special Grade posts
respectively. Ready Reckoner for calculation of Pension / Family Pension with
reference to the minimum of the revised pay scale + Grade Pay is given in
Annexure-III. Such of the pensioners/family pensioners shall apply to the Chief
Internal Audit Officer in the prescribed form in Annexure-IV to this order.
The Chief Internal Audit Officer/Board Office Audit Branch shall revise both the
pension and family pension on receipt of the completed application from the
pensioner/family pensioner.
5. The existing quantum of Medical Allowance to the pensioners/
family pensioners be doubled from Rs.50/- to Rs.100/- per month with effect from
1.9.2009.
6. Commutation of pension shall be permitted up to the rate of 33 1/3%
of basic pension to employees retiring from service on or after 01.06.2009. For
calculating commuted value of pension, the revised commutation table given in
Annexure-I shall be followed. As the commutation based on the revised pension
consequent on revision of scale of pay shall be calculated with reference to the
revised limit of 33 1/3% and new commutation Table, the employees retired
between 1.12.2007 and 31.05.2009 who are not willing to commute the difference
of revised pension with regard to Commutation Table, such employees shall
clearly indicate their unwillingness to the Pension Sanctioning Authorities.
However, if an employee, who retired in between the above said period, has
expressed his willingness for revision of commutation, it will be allowed up to the
limit of 33 1/3% only.
7. Existing pensioners on 1.12.2007 whose pension is enhanced based
on these orders are not entitled to commute one third of the increase in pension.
Only retirees who retired after 1.12.2007 whose pay is revised due to revision of
pay scale with effect from 1.12.2007 alone are entitled for commutation based on
the revised pension.

8. In Board’s Proceeding third read above, orders were issued granting
interim arrears to the pensioners/family pensioners at the rate of Rs.4000/-
(Rupees Four Thousand only) pending revision of pension due from 1.1.2006/
revision of pay from 1.12.2007. The Board directs that the arrears due to the
pensioners/family pensioners be calculated for the period from 1.1.2007 to
30.11.2009 after adjusting the interim arrears already paid and the net balance
arrear amount due shall be paid in cash in three equal installments i.e. first
installment along with the pension payable for the month of December 2009,
second installment in April 2010 and third and final installment in April 2011.
The arrears in respect of employees retired on or after 1.12.2007 who derive
fixation of pay and consequential revision of pay, pension and pensionary benefits
up to 30.11.2009 shall also be regulated as detailed above.
9. The pensioner/family pensioner who expired on or after 1.1.2006,
the arrears of pension/family pension if any due to them shall be paid in one
lumpsum to the spouse/legal heirs of the deceased pensioner/family pensioner
after adjusting the interim arrears already paid to them. In case of
pensioners/family pensioners, who expire after receiving the first installment of
arrears, in such cases also, the entire balance amount due to the deceased
pensioners/family pensioners shall be paid to the spouse/legal heirs of the
deceased pensioners/family pensioners in one lumpsum.
