BARBADOS

A Bill entitled

An Act to amend the Customs Act, Cap. 66 to provide for advance cargoinformation.

ENACTED by the Parliament of Barbados as follows:

Short title

This Act may be cited as the Customs (Amendment) (No. ) Act,2019.

Amendment of section 2 of Cap. 66

Section 2 of the Customs Act, Cap. 66 in this Act referred to as theprincipal Act, is amended by inserting the following definitions in theappropriate alphabetical order:

“ “advance cargo information” means a manifest, an airway bill, a billof lading, information or data as set out in the First Schedule inrespect of

cargo and stores including all imports, exports in transit andtrans shipment of goods; or

any package of which there is no bill of lading or airway billon board an aircraft or ship;

“break bulk” means cargo that must be loaded individually and is notin intermodal containers;

“bulk” means cargo that is transported unpackaged in large quantities;

“cargo” means goods, mail, stores, crew member’s effects andpassenger’s accompanied baggage carried on board an aircraft orship for consideration;

“cargo manifest” means a list of cargo being transported or warehoused;

“cargo reporter” includes a freight forwarder or a consolidator;

“carrier” means a person who transports goods or is in charge of orresponsible for the operation of the means of transport;

“consolidator” means a person or firm that combines cargo frommultiple shippers into a single shipment providing consolidationservices;

“freight forwarder” means a person who specialises in arrangingstorage and shipping or merchandise on behalf of shippers;

“long haul flight” means a flight with a duration of more than 8 hours;

“short haul flight” means a flight with a duration of less than 8hours.”.

Amendment of section 34 of Cap. 66

The principal Act is amended by deleting section 34 and substitutingthe following:

“Duty of master of ship or commander of aircraft

This section shall apply to a ship or aircraft that is expectedto arrive in Barbados.

The master of every ship, the commander of every aircraft, theagent of the master or commander respectively and every cargo reporterwhether the ship or aircraft is laden or unladen shall at the time statedin subsection (6) provide the proper officer at the intended port of arrivalin Barbados with the advance passenger information and advance cargoinformation set out in Part I and Part II of the First Schedule.

The advance passenger information and the advance cargoinformation referred to in subsection (2) shall be in electronic formator in a form that is approved by the Comptroller.

The advance passenger information and advance cargoinformation referred to in subsection (2) shall consist of data in respectof

the estimated time of arrival of the ship or aircraft;

a list of the names of all passengers and crew on board theship or aircraft in accordance with Part I of the FirstSchedule;

the port or airport at which the ship or aircraft will arrive;

a list of the ship and aircraft’s cargo for discharge inBarbados, whether commercial or non-commercial inaccordance with Part II of the First Schedule; and

a list of the ship or aircraft’s commercial cargo which is notintended for discharge in Barbados in accordance with PartIII of the First Schedule.

The master of a ship, commander of an aircraft, the agent of themaster or commander respectively and every cargo reporter shall atsuch time as is stated in subsection (6) provide the Chief OperationsOfficer of the JRCC with the data set out in the First Schedule in anelectronic format or in the form that is approved by the Chief OperationsOfficer.

Where a ship or aircraft is expected to arrive in Barbados, thedata referred to in subsections (4) and (5) shall be provided in the caseof

a commercial aircraft, no later than 40 minutes prior to thedeparture from the last port of call;

a private aircraft, no later than 40 minutes prior to thedeparture from the last port of call;

a ship or an aircraft arriving from outside the domestic space,no later than 24 hours prior to arrival; and

a ship or an aircraft arriving from a destination within thedomestic space, no later than one hour prior to arrival.

The advance passenger information and the advance cargoinformation referred to in subsection (2) shall show separately anygoods which are

in transit; or

to be transferred to another ship or aircraft for re-exportation,

and shall state whether there are any goods which are to remain on boardfor exportation on the same ship or aircraft and the information shallgive an account of all goods remaining on board for exportation.

On the arrival of a ship or aircraft in Barbados, the master,commander or agent of the master or commander shall proceed to theport or airport referred to in subsection 4(c).

The master of any ship, the commander of any aircraft to whichsubsection (2) applies or the agent of that master or commander may,where specially allowed by the Comptroller provide the advancepassenger information and advance cargo information as required bythis section after arrival in Barbados and after bulk is broken.

A master, commander, agent or cargo reporter who

fails to comply with subsection (2), (3), (4), (5) or (7) is guiltyof an offence and is liable on summary conviction to a fineof $50 000; or

transmits incomplete or false data is liable to pay to theComptroller a penalty of $10 000.”.

“JRCC to share advance passenger and advance cargoinformation with intelligence agencies

Where data is provided to the Chief Operations Officer ofJRCC pursuant to section 34, the Chief Operations Officer shall sharethat information with intelligence agencies.”.

34A.

Repeal and replacement of section 34A.1 of Cap. 66

The principal Act is amended by deleting section 34A.1 andsubstituting the following:

“Use and retention of advance passenger information andadvance cargo information by JRCC

Where the Chief Operations Officer of JRCC receives datapursuant to section 34(5), JRCC shall use the advance passengerinformation and advance cargo information to conduct screening ofpersons and cargo on board a ship or aircraft, which enters, departs fromor travels within the domestic space.

JRCC shall use the advance passenger and advance cargoinformation referred to in subsection (1) to conduct screening ofpersons against a watch list for the purposes of assisting participatingcountries or intelligence agencies in the furtherance of national,regional and international security.

Where JRCC conducts screening of persons pursuant tosubsection (2) and as a result of the screening suspects that

a criminal;

a criminal deportee;

involved in criminal activity; or

a person of interest to an intelligence agency; or

the cargo on board a ship or aircraft is liable to forfeiturepursuant to section 207,

JRCC shall share the information with law enforcement agencies ofparticipating countries and with intelligence agencies.

Advance cargo information and advance passenger informationcollected under this Act shall be retained by JRCC for a period of 7years from the date of collection.”.

Amendment of section 34A.2 of Cap. 66

Section 34A.2 of the principal Act is deleted and the followingsubstituted:

The Minister may by order

waive any requirements of subsection (2), (4) or (5) of section34;

modify any of the data referred to in the First Schedule; or

waive or modify any of the requirements of subsection (6) ofsection 34 with regard to the time required for the submissionof data.

An order made under subsection (1) is subject to negativeresolution.”.

The principal Act is amended by deleting section 34E andsubstituting the following:

“Denial of clearance

Where the ship or aircraft referred to in subsection (2) ofsection 34 is not a commercial ship or aircraft, the proper officer mayrefuse to grant clearance to the ship or aircraft to leave port until

the penalty imposed under section 34(10)(b) has been paid;and

the advance passenger information and the advance cargoinformation referred to in subsection (2) of section 34 hasbeen received.”.

The principal Act is amended by inserting immediately after section36 the following:

“Emergency stop

Where a ship or aircraft has to enter a port or land at an airportrespectively due to an emergency, accident or unfavourable weatherconditions, the master of the ship or the commander of the aircraft is

not required to provide advance passenger information or advancecargo information to the Comptroller.

The master or commander referred to in subsection (1) shall onarrival

immediately report to the Comptroller;

only permit cargo to be off loaded from the ship or aircraftwith the permission of the Comptroller; and

comply with any directions given by the Comptroller inrespect of any cargo on board the ship or aircraft.”.

Amendment of section 78 of Cap. 66

Section 78 of the principal Act is amended by

deleting subsection (2) and substituting the following:

The master of every ship and the commander of every aircraft orthe agent of the master or commander, or a cargo reporter whether theship or aircraft is laden or not, shall, at such time as is provided insubsection (4), deliver a content to the proper officer at the intendedport of departure in Barbados, in an electronic format approved by theComptroller or in the form approved by the Comptroller.”; and

“(2)

deleting subsection (4) and substituting the following:

Where a ship or aircraft has left or is expected to leave Barbados,the data referred to in subsection (3) shall be provided no later than 30minutes after departure from Barbados.”

Section 81 of the principal Act is amended by deleting subsection (1)and substituting the following:

Where a master of a ship or a commander of an aircraft, an agentof the master or commander or a cargo reporter fails to comply with theprovisions of subsection (2) of section 78, the Comptroller may seizeand detain the ship or aircraft to which the non-compliance relates.”.

Section 241 of the principal Act is amended by inserting immediatelyafter subsection (1) the following:

The Minister may make regulations that prescribe the proceduresfor the reporting and processing of advance cargo information.”.“(1A)

The principal Act is amended by inserting immediately after section241 the following new section:

“Power to make order

The Minister may by order amend Part I and Part II of theFirst Schedule.

The order referred to in subsection (1) is subject to negativeresolution.”.

The principal Act is amended by inserting immediately after section260 the following:

“Waiver in respect of advance passenger information andadvance cargo information

The Minister in consultation with the Minister responsiblefor Defence and National Security may waive the requirement for amaster of a ship or the commander of an aircraft or the agent of themaster or commander to provide advance passenger information oradvance cargo information in such circumstances and subject to suchconditions as the Minister may prescribe where the ship or aircraft is

a military or law enforcement ship or aircraft; or

a ship or aircraft of a sovereign State and is in Barbados onofficial State business.”.
