INTRODUCTION

Themanualfortakingthebarexam inKosovowasestablishedwithintheproject"Strengtheningtheruleoflaw innorthernKosovo",whichwasimplementedbyAdvocacyCenterforDemocraticCulture(ACDC),withthesupportofUSEmbassyinKosovo.

Thisguideaimstoprovidetostudentsoflaw andyounglawyersfrom northernKosovo,themostimportantinformationoftheBarExaminationinKosovo.Manualcontainsbasicinformationaboutthebarexamination,conditionsthatapplicantsmustmeet,theprocedurefortakingthebarexam,aswellasthestructureoftheexam.

Ofcourse,consideringthatthisisnotacomprehensivemanualforthebarexam,werefertopotentialcandidatesthemanualdrawnupbytheAssociationofSerbianlawyersofKosovo.AcopyofthemanualcanbefoundedattheofficeoftheNGOACDC.

Onthisoccasion,weexpressourspecialgratitudetotheUSEmbassyinKosovoforsupportingtheproject,andthereforeforthedevelopmentofthisguide.Alsoweexpressgratitudetotheattorneysfrom northernKosovowhoparticipatedintheimplementationofprojectactivitieswhichenabledthepreparationofthismanual.

ABOUTTHEBAREXAM

TheBarexamistheexamthatanylawyermustpassinordertoengageinjudicial,prosecutorialorlawprofession.Thebarexaminationconsistsofawrittenandoralexam.ExamisorganizedbyMinistryofJusticeofKosovoanditistakingpartinfrontofaCommissionwhichisproposedbytheMinister,appointedbytheAssemblyofKosovo.

1.Commissionconsistlegalexperts,whohaveatleast12yearsofexperienceinthejudicialsystem.

2.Theexamisorganizedeverythree(3)months,four(4)timesperyear.

3.FeeforthebarexamisanamountwhichisdeterminedbytheMinistryofJustice.Currently,feefortakingtheexamis100euros.Thefeeforre-takingitis75euros.

Conditionstoapplyforthebarexam

LawonBarExaminationprescribestheconditionsthatarenecessaryfortakingofthebarexam.Thecandidateshouldmeetfollowingconditions:

1.TobeacitizenofKosovo;

2.Completedfour-yearstudiesatthelawfacultyormasterstudiesinlawschool;

3.Atleastone(1)yearworkingexperienceonlegalmattersincourt,publicprosecutor'sofficeorlawoffice;oratleasttwo(2)yearsoflegalexperienceinotherinstitutionsorotherorganizations.Alsothebarexamcanbetakenbyacandidatewhohasnoprofessionalworkexperience,buthe/shehasdoneprofessionalpracticeincourt,publicprosecutororlawyer'soffice;

4.AcandidatewhofinishedlawstudiesonabroadmustdothecertificationofdiplomaintheDepartmentofEducation,ScienceandTechnology.

5.Graduatedlawyerswhohavepassedtheprofessionalexam forworkinpublicadministrationandthosewhohavepassedtheprofessionalexamforthemagistrate,cantakethebarexam asanadditionalexam atthereducedprogram,withtherecognitionofpriorexamspassed.

Applicationfortakingthebarexam

ApplicationsfortakingofthebarexamshallbesubmittedtotheMinistryofJusticeofKosovo.Intheapplicationtheapplicantmustindicateonwhichoftheofficiallanguageswantstotaketheexamandwhetherifheorshetookexambefore.Also,inadditiontotherequirementsforthebarexam,thecandidateshouldattachevidenceonfulfillmentofconditionsreferredtoinArticle6oftheLawontheBarExam.Accordingly,acandidateforthebarexamshouldsubmitthefollowingdocuments:

1.Theapplicationfortakingthebarexam,whichisavailableonthewebsiteoftheMinistryofJusticeofKosovo;2.NotarizedcopyoftheDiploma;3.Confirmationofworkexperienceaftergraduation;4.NotarizedcopyofthedecisionoftheMinistryofEducation,ScienceandTechnologyofassessmentandrecognitionofdiplomasacquiredabroad.

TheentiredocumentationshallbesubmittedtotheMinistryofJustice,Officeoffreelancers(8thfloor).Applicationsforthebarexammustbesubmittednolaterthan3weeksbeforethedateoftheexam.Takingofthebarexam.Thebarexaminationconsistsofwrittenandoralexam.Thewrittenexam,thefirstpartistakeninsolvingpracticalcasesfromthecriminalandcivillegalauthorities.Foreachofthesetwotasks,acandidatecanwinamaximum offifteen(15)points.Inordertopassthewrittenpartoftheexam,thecandidateshouldbemarkedwithatleastnine(9)pointsfrombothassignments.

Thewrittenpartoftheexamlastsfive(5)hours.Duringthetimeofthewrittenexam,thecandidatemayuseonlythetextsoflaws,whichdoesnotincludethecommentsonlaw.Ifthecandidatesuccessfullypassesthewrittenpartoftheexam,isentitledtotaketheoralexam.Theoralpartoftheexamconsistthefollowingsubjects;

2.1.CivilLaw(substantiveandprocedural),family,hereditaryandobligatory;2.2.Commerciallaw;2.3.Criminallaw(materialandprocedural);2.4.Laborlawandadministrativelaw;2.5.Constitutionallaw,theorganizationofthejudicialsysteminKosovo,basedonasystemoftheEuropeanUnionandhumanrights.

Inordertopasstheoralexam,thecandidatemustachieveatleastsix(6)pointsineachsubject.

Candidatescanachieveamaximumofeighty(80)points,whiletheminimumscoretopasstheexamisforty-eight(48)points.

Ifacandidateisnotsatisfiedwithhisevaluationonwrittenortheoralpartoftheexamination,he/shehavetherighttoappealwithinthree(3)daysofthepublicationoftheexamresults.Commissionwilldecideontheappealwithinfive(5)days.

Examre-entry

Thecandidatewhodidnotachieveasatisfactoryresultfrom one(1)ortwo(2)

subjectsmustundergotheexamre-entry.Thecandidatehasanobligationtore-take

theexamiffromtwo(2)subjectsintheoralparthasnotachievedthesatisfactory

results.Thecandidateshouldsignfortakinganexam re-entrywithintwo(2)tosix

(months),otherwiseitshallbeconsideredthatthecandidatedidnotpasstheexam.

TheLawontheBarExamstipulatesthatacandidatewhoneedstotakearemedialoral

examincriminallawandcriminalproceedingsorcivillawandhavepreviouslypassed

thewrittenpartoftheexam,whentakingaremedialexamdoesnothavetore-takethe

writtenpartoftheexam.

Finally,acandidatewhodoesnotpasstheremedialexam,cannottoretakethebar

exambeforetheexpirationofaperiodoftwelve(12)months.
