“TN (Treaty NAFTA) status is a special non-immigrant status in the United States unique

to citizens of Canada and citizens of Mexico. Beginning in 1988, individuals practicing one

of the professions identified in the Canada – the United States Free Trade Agreement are

able to obtain TN status for legal work in the United States and Canada, creating freedom

of labor movement. TN status is recognized in the North American Free Trade Agreement

(NAFTA) which began in 1994. It allows U.S., Canadian and Mexican citizens the

opportunity to work in each other's countries in certain professional occupations.”

If you are a Canadian or Mexican citizen and are into a certain professional occupation

with a job offer from the United States employer, then the TN status will offer a simple

route to the temporary work visa. The TN status is valid only for one year and can be

renewed to further one year. There is no as such limit on the number of renewals. Also,

there is no annual cap on TN visas from Mexico or Canada, so no need to worry about

waiting lists developing.

The main disadvantage is that the TN visa holder cannot stay in the country after

the Work in the US is done. If you further want to work in the USA, then apply for

a standard H-1 visa.

There is no appeal available if the person has a difficult case and the entry in the

States is denied.

How to apply for TN

In order to apply for the TN, there are several steps. You can either apply directly in the
