The Minutes of the 210th Meeting of the NRC held from January 28th to 29th, 2013

The 210th Meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) was held from January 28th to 29th, 2013 at NRC, NCTE, Jaipur.

The following were present:

The Regional Director, NRC apprised the Northern Regional Committee about the provision of the NCTE Act, Rules, Regulations and instructions issued from time to time.

With the permission of Chairperson, Dr. Ram Kishor (Convener) presented the Agenda before the Committee. Item-wise decisions taken are as follows:-

CONFIRMATION OF MINUTES OF 209th

MEETING

NRC confirmed the minutes of 209th meeting with the following modifications:-

(i) In the decision against Agenda Item No. – 209.5.1 (S. No. – 3) in the line 4 date be read as 17.01.2011 (ii) In the decision against Agenda item No. – 209.15.4 (S. No. – 54) in the last para the following modification be made “recognition for the B.Ed. & B.Ed. (Siksha Shastri) course be withdrawn.” (iii) The decision against Agenda Item No. – 209.30.20 (S. No. – 164) in the line 5 date be read as 09.09.2010 (iv) In the decision against Agenda Item No. – 209.34.16 (S. No. – 191) in the line 6 course be read as B.Ed. B.Ed. The original file of the Institution along with other related documents, NCTE Act, 1993, Regulations and Guidelines of NCTE published from time to time has been carefully considered by NRC.

The Committee discussed and considered the case in detail and noted that the NRC, NCTE issued a show cause notice to the institution

HR-1740/207th meeting/2012/35594 dated 29th December, 2012. The institution gave reply dated 17.01.2013. So far the institution has not complied with the order issued by the NRC, NCTE dated 29.12.2012. The application is rejected.

Hence, NRC decided that the recognition of the above institution be refused under provision of clause 14 (3) (b) /15 (3) (b) of NCTE,, 1993on the above point.

FDRs if any, submitted by the institution be returned.

3. 210.3.3 HP-299 THAKUR COLLEGE OF EDUCATION, DHALIARA, TEHSIL-DEHRA, DISTT. KANGARA-177103, HIMACHAL PRADESH

D.El.Ed. The original file of the Institution along with other related documents, NCTE Act, 1993, Regulations and Guidelines of NCTE published from time to time has been carefully considered by NRC.

The Committee discussed and considered the case in detail and noted that in compliance of the Court order, the NRC wrote a clarification letter to the institution No. HP-299/177th/5010 dated 18th Feb. 2011. The institution did not give any clarification within stipulated period of 30 days of issue of the letter. Instead, the institution submitted two replies vide ref. no. 1320-TCED-2012 dated 12.12.2012 and no. 1327/TECD-2012 dated 22.12.2012 respectively. In the letter 12.12.2012.

The institution has cited about its office letters no. 888-TECD-2010-11 dated 17.02.2011 and reminder letter no. 955 TECD/2010-11 dated 21.06.2011. The institution was not enclosed any substantive proof of despatch of such letters to NRC, Jaipur. The institution has enclosed zeroxed copy of a letter dated 17.02.2011 bearing no signature and annexure.

The institution has misled the NRC, NCTE by not giving facts and evidences as per NCTE’s clarification letter. The application for D.El.Ed. course is rejected.

Hence, NRC decided that the application for the said course be rejected under provision of NCTE, Regulations, 2009 on the above point.

The Committee after going through all relevant records noticed that the institution was given recognition vide order No. NRC/NCTE/HR-1159/2008/61527-61533 dated 10th September 2008 with an intake capacity of 50 seats (two units). However as per the provisions of the NCTE Act, Rules & Regulations, the institution could be granted recognition initially with intake capacity of one unit only).

Therefore, the Committee decided to rectify the recognition order dated 10.9.2008 to the effect that intake capacity of the institution be for one unit only i.e. 35 students (one unit initially constituted 25 students. However vide notification dated 23.7.2010 one unit has been constituted to mean 35 students).

Accordingly, corrigendum to this effect be issued under intimation to all concerned subject to fulfillment of terms & conditions as laid down under provisions of the NCTE Act, Rules & Regulations.

Accordingly order to this effect enhancing the intake capacity by 10 students be issued under intimation to all concerned subject to fulfillment of terms & conditions as laid down under provisions of the NCTE Act, Rules & Regulations.

The NRC noted that the NRC in its 208th meeting already decided that “a decision on the issue can be taken only by the NCTE. The Govt. of Uttrakhand may approach it directly.”|”

In compliance of the direction of the NRC a letter dated 28.12.2012 to this effect has already been written to the Principal Secretary (Higher Education), Secretariat, Uttrakhand.

Therefore, the Registrar, Kumaun University, Nanital, Uttrakhand may take note of the above decisions of the NRC, NCTE.

2. The institution has not submitted building plan approved by the competent Government authority clearly showing the name of the institution khasra/plot no., total land area & built up area, multipurpose hall, different resource centre, class room, library etc.

3. The institution has not submitted notarized copy of change of land use certificate issued by the competent authority as per Regulation 2009. Hence the institution is required to submit notarized copy of change of land use certificate issued by the competent authority.

4. The building completion certificated has not submitted by the institution, complete details as required by the NCTE, the institution is required to submit a fresh building completion certificate as per the prescribed format.

5. The affidavit not submitted by the institution. The institution is required to submit an affidavit in the prescribed format on Rs.100/ stamp paper duly attested by oath commissioner or Notary Public as required under provision of section 7(1) of NCTE, Regulation, 2009.

The Committee after going through all relevant records, report of the NCTE Hq. under section 13 of the NCTE Act,1993, deficiencies pointed out by the NCTE Hq., reply submitted by the institution viz-a-viz provisions of the NCTE Act, Rules & Regulations deliberated and considered the case in detail.

The Committee noted that the NRC in its 207th meeting observed that the institution has make up the deficiencies

satisfactorily in respect of D.Ed. course, therefore, decided that the recognition of the institution shall stands for D.Ed. course as per the order of the Hon’ble Supreme Court. The Committee also observed that although the institution has submitted the reply in respect of its B.Ed. course, however in order to further examine the case in detail certain documents/clarifications are required to be submitted by the institution as per details given below:-

(i) A list of B.Ed. teachers approved by the affiliating University as per the prescribed format.

The institution submitted its reply and the same was considered by the NRC and after examination of the same the NRC observed that the institution has cured the deficiencies satisfactorily, therefore, it has been decided that the recognition of the institution shall stands as per the order of the Hon’ble Supreme Court. Accordingly, appropriate order withdrawing order of de-recognition for de-recognised courses for B.Ed. course be issued.

The Committee after going through the VTR and all relevant records relating to the institution viz-a-viz provisions of the NCTE Act, Rules & Regulations observed that a show cause notice dated 6.11.2012 had been issued to the institution requiring it to file its representation within a period of 21 days from the date of issue of the show cause notice, but despite of having been given the show cause notice, institution has not filed any reply/representation. Apparently it appears that the new management is not interested to submit any reply to the show cause notice.

Therefore, the NRC decided to withdraw recognition of the institution on the following grounds:-

a) Land documents duly certified by the Registrar/Sub Registrar not submitted by the institution.

b) Demarcated building map duly approved by the competent authorities not submitted by the institution.

c) List of faculty duly approved by the affiliating body not submitted by the institution.

d) Certificate of the Registrar, Society with the list of members of the Society not submitted.

Hence, NRC decided that the recognition of the institution be withdrawn under section 17 of the NCTE Act, 1993 on the above point.
