I. PAYMENT OF MEMBERSHIP FEE

stMembers may kindly note that for the year 2013-14 payment of fee become due on 1 April, 2013 and must be paid on or before

th30 September 2013. Members are requested to go through the following advice for payment of their membership fee.

Fee can be remitted directly to the concerned Decentralized Office of the Institute. Members may send their fee as per above

fee schedule through demand draft/local cheque favouring The Secretary, The Institute of Chartered Accountants of India,

Payable at the concerned Regional Office of ICAI as per address given overleaf alongwith Annexure 'A' or Annexure 'A-1' as

applicable and other documents.

You may please note that payment of membership fees through Central Bank of India has already been discontinued. You are

therefore requested not to pay fees through Central Bank of India.

Payment through Electronic Clearing System is also provided for which member may use mandate form placed at Annexure

'B' and as per instructions printed overleaf. Currently this facility is available to the members having Bank Account with MICR

cheque facility in the cities mentioned in the mandate form.thMembers are requested to use this facility by submitting the mandate form by 30 April 2013.

Payment gateway solution was introduced facilitating members to remit the membership/COP fees online. Members are

encouraged to use this facility for their convenience and comfort. For use of payment gateway, members are requested to pay

annual membership fee online. Members are required to fill in the credit card details alongwith name of the cardholder on the

payment gateway page for successful transaction online.

Member may remit any amount at their discretion in advance alongwith the fee for the year 2013-2014. However the same

would be kept in the credit of the member concerned as advance and would be adjusted against membership and/ or COP fee

as and when the same becomes due and other dues, if any. In the event of any short fall in advance, due to

revision/increase in fee(s), it is the responsibility of the member to remit the balance. The salient features of the

scheme are also given overleaf.

As you are aware, the Institute maintains a record of members' signatures. You are requested to affix your specimen

signatures in the Signature Card enclosed as Annexure 'C' and return the same.

stThe Institute compiles data of members as on 1 April every year based on the particulars as provided by the members duly stconfirmed/updated/modified in the member card. The exercise for compilation of the data of the members as on 1 April 2013

is being undertaken. For the purpose, we are enclosing herewith member data card of your membership containing current

particulars in the Institute's record.

Even if the particulars given in the member data card do not require any modification/changes, the same is still required to be thconfirmed by sending back the data card duly signed. If we do not hear anything from you in this regard on or before 30 April,

2013 it would be presumed that the entries pertaining to your membership as indicated in the enclosed member data card are

correct and no change therein is required, and particulars as shown in the membership data card would alone be taken as final stfor compilation of the data of members as on 1 April, 2013.

You would appreciate that discrepancy, if any, found later on because of non-confirmation/updation of the member data card,

would not only tantamount to non-compliance with the regulatory provisions but also have adverse implications arising out of

furnishing incorrect particulars to outside authorities.

stIn the member data card enclosed with Fee Circular total CPE Credit earned by a member during a period of 1 January 2012 stto 31 December 2012 as uploaded in the CPE Portal is given for information. The members may verify the CPE Credit hours

st stduring the period from 1 January 2012 to 31 December 2012 with the records available with them and in case of discrepancy

in CPE hours, members should contact the concerned Programme Organizing Unit (POU), which has organized the

Programme during said period, and get it uploaded on the CPE Portal. The CPE requirement for the calendar year 2013 is also

available on CPE portal . Self-declaration Form to avail CPE credit hours for Unstructured Learning Activities

is placed at Annexure 'D'.

The Committee for Members in Industry of the Institute of Chartered Accountants of India has set up a CFO Guild (Corporate

Accountants Guild). This Guild is for our members who are occupying high positions (CEO/CFO/Treasure Head/Head of

Analyst, GM or above) in Industry. The Primary objective of setting up such a guild is to develop a platform where highly

intellectual & talented pool of people from various organizations can discuss various issues concerning the profession in

general and for Members in Industry in particular. They can plan, formulate and strategize policies for improving the image of

the Chartered Accountants in the eyes of the Industry. Industry specific seminars / Conferences/round Table meetings can

also be organized to discuss the matters pertaining to the Industry and make them the Brand Ambassadors of the profession.

Committee for Members in Industry organizes Campus Placement Programme for newly Qualified Chartered Accountants,

periodical job fair(s) for experienced Chartered Accountants and Semi Qualified Chartered Accountants / Accounting

Technicians.

The Institute has set up an Industry-wise Data bank for the benefit of members and others concerned. The database, inter

alia, is meant for informing the members regarding industry specific training/ development programmes, industry focused

publications etc.Members working in industry are requested to kindly intimate about the industry in which they are employed

1. Contribution towards Chartered Accountants' Benevolent FundMember must be aware that the Chartered Accountants Benevolent Fund has been set up with the object, inter alia, of providing financial assistance to Institute's members and/or their families in distress. Chartered Accountants can become member of the Chartered Accountants Benevolent Fund either by paying ordinary membership fee of Rs. 500/- annually or become life members thereof by paying one time amount of Rs. 2500/-. The Chartered Accountants Benevolent fund has been providing financial assistance to the members and/or the families of the deceased member depending on the number of request received and the fund position. In order to provide assistance to more and more needy members and the distressed families of members and in a substantial manner, augmentation of the Chartered Accountants' Benevolent Fund is necessary. Towards this direction members are earnestly requested to contribute their mite while remitting their membership/certificate of practice fee for the year 2013-14. It is hoped that the members of the Institute would respond positively to this noble cause as the present corpus is not adequate and does not offer much scope for the actually required and desired assistance to the families of needy members. We need to make serious efforts to increase the corpus of the benevolent fund to fulfill its true objectives. All the members are requested to become members of the fund and contribute generously. The members residing abroad can also contribute if they are Indian citizen. They are requested to confirm holding of Indian citizenship while sending contribution. The prescribed form for life membership is placed as Annexure-'F'.

Members of the fund may kindly note that the Annual General Meeting of the Fund is likely to be held in September, 2013 and the exact date, time, venue, agenda and audited accounts will be hosted on the Institute's website/ published in the Journal. Members are requested to attend the Annual General Meeting.

Established under the Societies Registration Act 1860 in 1962 “by the members of the Institute for the members of the Institute” to provide financial assistance for maintenance, education or medical treatment to its members and their families in distress. The 'fund' is an independent body managed by its Managing Committee comprising of President – ICAI as “Ex-officio Chairman”, Vice President – ICAI as “Ex-officio Vice-Chairman” and Member Secretary with other members elected in Annual General Meeting of the Committee.

CABF provides various types of financial assistance to its members and their families in distress: -lEx-Gratia financial assistance to the legal heir of deceased member in case of accidental death/unnatural death at the

age below 55 years against claim.lThe financial assistance is granted per month to be considered on the merit of the case.lAssistance considered may be granted for a period of one year.lRequest for grant of monthly assistance is accepted in prescribed application format recommended by a designated

member.

Till date CABF could get 112793 only life members on roll of around 211051 members of the Institute. In order to strengthen the financial position of the Fund the Committee desires that all the members of the Institute should join CABF extending their helping hands to support their professional colleagues and dependants.

It is an earnest appeal of the Fund that all the members must become life member of the Fund, if not, and to contribute voluntarily any amount for the noble and pious cause of CABF. It is also an appeal to all the members to pay annual voluntary fee for CABF every year. The voluntary contribution can be made by way of cheque/demand draft payable in favour of 'The Chartered Accountant Benevolent Fund, New Delhi' can be sent to CABF, The Institute of Chartered Accountants of India, I P Marg, New Delhi – 110002 during the year. Life members are allotted a separate life membership number of the fund. The CABF issues receipts of the contributions made by the members which is eligible for tax exemption under section 80-G of Income Tax Act.

You may be aware that S. Vaidyanath Aiyar Memorial Fund has been set up with the object, inter alia, of providing scholarship to the needy and deserving students. Members may become life members of the fund by contributing a one-time payment of Rs. 500/-. You are requested to become life members of the S. Vaidyanath Aiyar Memorial Fund. The prescribed form for life membership is placed as Annexure-'G'

ICAI under aegis of CABF has made an arrangement with Life Insurance Corporation of India facilitating a Special Group Term Insurance Scheme for the members and their spouses. The Insurance Scheme covers accidental death benefits in addition to the life cover. The Scheme provides life coverage for sum of Rs. 10,00,000/- for Member & Rs. 5,00,000/- for spouse as well with additional accident death cover of Rs. 10,00,000/- for member and Rs. 5,00,000/- for spouse respectively. This insurance scheme is uniquely designed only for the members of the Institute to avail insurance benefits on payment of one time competitive premium and coverage for three years. Members may further renew the insurance scheme after three years. The details of Group Term Insurance Scheme and application form are available on Institute's website www.icai.org and placed as Annexure-'H'. The Scheme is open throughout the year. A large number of members have already joined this scheme. CABF makes an appeal to the members who have not joined to apply immediately and insure self & spouse. In the Motor Insurance scheme, all members will avail 55% discount on Own Damage premium irrespective of the previous claims in respect of private four wheelers and two wheelers when member approaches office of the Oriental Insurance Company directly.

The Anti virus software protects your laptops and desktops and provides protection against all kinds of Internet or

network-based threats. Upon installation, it acts as a shield against viruses, worms, trojans, spywares and other

malicious threats. It also provides security against new and unknown threats with the anti virus software's renowned ®DNAScan Technology. The price of the aforesaid antivirus software is Rs 750/-+ applicable taxes (for 3 years from the

date of activation).

The Portfolio management software enables the maintenance of shares & mutual funds portfolio & Accounting. This software also enables the user to directly import Brokers' bills of scripts sale/purchase in case of brokers and entry module in other cases and market rate of stocks. The software also records - bonus received on the shares as well as Insurance policy details. The aforesaid software is free of cost for 2 financial years to the Practitioners & CA Firms.

The 'Tax Cloud: Cloud based ITR & TDS Return Preparation for CAs' enables Income Tax Return and TDS Return preparation, provides all types of assessee support including Individuals, HUFs, Firms and Companies, calculates Income Tax under all heads such as Salary, House Property, Capital Gain, Business and Profession, Other and Exempt Income Heads, generates detailed computation of Income Tax Returns, PDF for paper filing and XML for e-Filing, automatic data backup every night for CAs for cloud servers. The aforesaid software is free of cost for 2 financial years to the Practitioners & CA Firms.

The 'Excise & EXIM Compliance software' is a complete automation solution for use by Practitioners & CA Firms. The software is designed to facilitate Practitioners & CA Firms on various professional areas, namely Excise Manufacturing, Excise Trading, and Export Import Documentation. The aforesaid software is free of cost for 2 financial years to the Practitioners & CA Firms.

The Committee has published a publication on the Quick Insight 2012 to the Chartered Accountant profession to be circulated among the CA Firms. The Quick Insight contains the various provisions pertaining to Direct Tax & Indirect Tax, Accounting & Auditing Standards, LLP, MCS & other services, list of Mandatory Statements and Standards on Audit as well as relevant information pertaining to the CA profession.

The ICAI has developed a Website namely www.icai.org.in, where the CA Firms may create their portals as per the norms laid down by the Council of the Institute of Chartered Accountants of India. The website provides a platform for the CA Firms to upload their firms' details and gives them an opportunity to reach out to the members and CA firms practicing

thworldwide. As on 5 March, 2013, more than 5043 CA firms have created their websites in the aforesaid website. The website also acts as a forum for consolidation of the members and CA Firms by providing for consolidation measures like Networking, Merger and Corporate Form of Practice. The members may visit portals of other members and firms and like-minded persons may join hands to grow big to compete in the international front.

The Committee in order to enable members to have access to qualitative database for doing comparative study for transfer pricing, has tied up with C-MOTS Internet Technologies Pvt. Ltd. for providing access to Capitaline TP Corporate Database (online version) at a special discounted price of Rs. 10,000/- plus taxes only. Revised Guidelines of Network of Firms The Committee has considered practical difficulties in consolidation of CA Firms through medium of Networking. The Committee has appropriately finalized the revised Guidelines of Networking facilitating members and firms for its easy a d o p t i o n . The Committee has taken a major initiative for prescribing the Minimum Recommended Scale of Fees for the professional assignments done by the members of ICAI. The recommendation is about the fee to be charged as per the work performed for various professional assignments and the amount quoted under respective heads of professional work. The Committee has taken a major initiative for arranging Health Insurance Scheme through New India Assurance Co. Limited. No Health check-up. No age limit & entry barrier.

A portal has also been developed for online solution for the Members of ICAI. The link for the aforesaid portal for the Health insurance Scheme is available at http://icai.newindia.co.in.

ICAI has arranged insurance protection for members in practice/firms in the form of specially designed professional indemnity insurance at a reasonable premium. The scheme is already in effect for the Members in practice/ Firms of the ICAI through New India Assurance Co. Ltd.

As a major initiative of this Committee to provide financial assistance in the form of liberalized loan scheme for the members and firms, ICAI has corroborated with Corporation Bank. The specially designed scheme (Corp CA) caters to various financial needs of the Chartered Accountants. Through the scheme, eligible Chartered Accountants can avail finance for construction of office premises including cost of furniture/fixture/office equipments-computers and other accessories. The scheme would also enable the Chartered Accountants to finance a part of the working capital for building their profession and will take care of the needs of fresher (CAs with experience below three years).

The Committee has arranged to provide the Tax Compliance software namely 'ICAI-Tax Suite' for the Practitioners & CA Firms, which combines facility for Income Tax, TDS, Audit Reports, Project Report/ CMA, Form Manager, AIR (Annual Information Return), Service Tax and Document Management.

The Committee has arranged to provide the MCA-21 Compliance software namely 'ICAI- ROC' for the Practitioners & Firms, pertaining to management of secretarial requirements & generation of forms as per MCA21 Requirements. This software also provides the members the facility to prepare Auto filling of eForms, Shares Records/Certificates, Meetings & Minutes, Resolutions/Drafting, Annual Return forms and maintains Registers and Reports etc.

The Committee has launched the software on Accounting and Billing on Cash Basis for Professionals named as 'Billing & Accounting Software'. The software is a complete package to manage the accounting and billing requirements of a CA Firm on Cash System of Accounting. This package provides the facility to generate bills, receipts, vouchers etc. This software will be free of cost for 2 financial years.

The Committee has launched the software on XBRL named as ICAI-XBRL software to provide the CA Firms for MCA mandate XBRL Filing. The XBRL software is a solution for converting financial information of a Company in XBRL format as per MCA mandate. The software will be available to all CA firms free of cost for 2 financial years.

The Committee has launched the software on Payroll Management for Professionals named 'Payroll' Software. The software is a complete package to manage all small business firms' PF, ESI, PT and TDS aspects of the same. Salient features of the Scheme for advance amount remittance by members

st(a) Since rate of fee have been revised from 01 April 2011, Members are requested to remit as per new scale of fee. Members may however remit any amount at their discretion in advance. However the same would be kept as advance in the credit of the member concerned and would be adjusted against membership and/ or COP fee as and when the same becomes due and other dues, if any.

(b) In case the amount lying to credit of the members' account falls short of subsequent year's fee requirement due to revision of fee, it would be the responsibility of the member to ensure that sufficient credit is maintained in his/her account and in case of shortfall the balance is remitted within the due date. It will be our endeavour to intimate regarding any shortfall in the credit of the member concerned.

Advance amount remittance (which would be kept in the credit of the member concerned) is only a facility to members and would be adjusted against membership and/ or COP fee as and when the same becomes due and other dues, if any. It would in no manner mean that because of the amount remitted their membership is secured. In spite of the amount remitted continuance or otherwise of their membership would be subject to the provisions of the Chartered Accountants Act and the Regulations framed thereunder.

(d) Refund of amount received would not be allowed under any circumstances except in case of removal of the name of a member from the Register of Members under the provisions of the Chartered Accountants Act, 1949 as amended by the Chartered Accountants (Amendment) Act, 2006 and the Chartered Accountants Regulations, 1988.

In the case of death, the fee for the year in which removal takes place would be deducted and the balance of the advance amount remitted, if any would be refunded to nominee(s)/legal heir(s) of the member concerned. In all other cases, the balance of advance amount, after such a deduction as aforesaid, if any would be kept to the credit of the member concerned for adjustment towards annual membership fee payable at the time of restoration.

(e) Interest on the amount remitted would not be payable at all.

(f) In case of members residing abroad: -

Presently the airmail and seamail charges for CA Journal are respectively Rs. 2100/- and Rs. 1100/- p.a. in case of members residing abroad. Payment of fee/air mail/sea mail charges for Journal should be made in Indian currency i.e. the draft/cheque drawn on the designated Indian branch for credit to the account of the Institute would have to be made out in rupees irrespective of the country/currency applicable to the member. However, where the fee has been sent in foreign currency, conversion of foreign currency would be at the rate applicable on the date when the Institutes bankers give credit. It may be noted that the fee would be payable only by way of demand draft or cheques on bank branches at designated places in India (as local cheques).

They should clearly indicate and remit separately air mail/sea mail charges for dispatch of Journal, if they so require, for 3 years. The Institute would communicate to members abroad the approximate air mail/sea mail charges payable for 3 years based on the average increase taken place in air mail/sea mail charges during last 5 years. The idea is to enable such members to send sufficient amount in advance and the Institute to adjust the likely increase over the next 3 years.

In order to avail of this service you need to fill-up a simple mandate form and send it to your Regional Office, which will

be a one-time activity. You need to provide your membership details and your bank account details from which

you want to pay your charges and sign the mandate form. The Bank Account can be with any bank in the cities

listed above. One time registration charges are Rs. 20/-.

You need to attach a blank cancelled unsigned cheque as a proof of your Bank Account with the mandate form.

ICAI will raise annual fees due against your membership and send you the demand notice. Simultaneously, ICAI will

send the fee details to M/s. Tech Process Solution Limited after receipt of the mandate form from your end.

Once you have filled the mandate form you need not come to ICAI at any time to deposit the annual fees. The

service provider will send your e-mail and an SMS informing the date on which your account will be debited for the

exact amount towards payment of fees. Please keep your account funded during that period.

The fees amount will be debited from your Bank account through the Reserve Bank of India National Clearing

CHECK-LIST FOR IMPORTANT REGULATORY COMPLIANCE*

Earning CPE Hours :* All members holding COP may plan well in time to complete 90 CPE credit hours for the rolling period of three years starting from the year 2012 and minimum 20 CPE credit hours of structured learning in each year.* All members who are not holding COP or are residing abroad may plan to complete at least 45 CPE credit hours of structured / unstructured learning for the rolling period of 3 years starting from the year 2012 and minimum 10 CPE credit hours of structured/unstructured learning in each year* All the members attaining the age of 60 years during a particular calendar year within 2012-14 or are at present of the age of 60 years and above and holding COP are required to complete at least 70 CPE hours either through structured or unstructured learning activities and minimum 10 CPE credit hours in the year 2012 and minimum 20 CPE credit hours in 2013 & 2014 * All members attaining the age of 60 years during a particular calendar year within 2012-2014 or are at present of the age of 60 years and above and not holding COP or are residing abroad are required to complete at least 35 CPE credit hours either through structured or unstructured learning activities and minimum 5 CPE credit hours in the year 2012 and minimum 10 CPE credit hours in 2013 & 2014

Grant of Certificate of Practice :* No member can practise unless he holds Certificate of Practice

Apply in Form '6' along with Fee (Revised w.e.f. 1.4.2011) of Rs. 1,500/- for members of age 60 years and above and Rs. 2,000/- for members below 60 years.

Certificate of practice will be granted fromthe date of receipt of Form '6' complete in all respects.

Admission as Fellow :* An associate member who has completed 5 years of continuous practice and/or employment would be eligible for admission as a Fellow Member

He may submit Form '3' with prescribed fee.A member in employment is required to submit self declaration form along with Form 3.He can also submit Form '6' with COP fee if he intends to hold COP

A member can submit Form '3' and '6' also relevant documents required for admission as fellow even 30 days prior to the date of his eligibility for admission as a fellow member.

Restoration of Name :* A member whose name has been removed from the Register of Members is eligible for Restoration of his name

If removal is on account of non payment of fee thby 30 September, apply in Form '9' with

membership fee for the current year and Restoration fee (revised w.e.f. 1.4.2011) of

stRs. 1,200/- before 31 March for restoration of name retrospectively.

If the membership fee and Form '9' is streceived on or after 1 April the name will

be restored only prospectively with effect from the date of receipt of Form '9' with requisite fees

Restoration of Certificate of Practice :* A member whose certificate of practice has been cancelled is eligible for restoration of certificate of practice

If cancellation of COP is on account of non thpayment of fee by 30 September, apply in

Form '101' with COP fee for the current year stbefore 31 March for restoration of COP

retrospectively

If the COP fee is not received on or before st31 March the member concerned has to

apply for grant of fresh COP by submitting Form '6' with the prescribed Membership and COP fee

Change in Address :* Every member shall have a postal address of the professional address at the time of enrolment and shall intimate any change in the said address.

A written intimation duly signed giving the old as well as new address shall be submitted within 30 days from the date of change in theaddress.

Change in address shall be intimated then and there. Non intimation or delayed intimation will put the member to certain inconvenience like non receipt of Journal, Newsletter and other communications from the Institute.

Permission for other engagement :* A member in practice is required to seek prior permission for engagement in any business or occupation other than profession of accountancy

Within 30 days from the date of joining employment or occupation an intimation containing details thereof shall be submitted seeking permission. In the case of family business, Managing Director or whole time Director, the member is required to file information in the prescribed form while seeking permission

General permission is granted to the members to become Director Simplicitor in the companies i.e. to attend Board Meeting for which they will be entitled to only sitting fee and no remuneration. Specific permission is granted on case to case basis to be lecturer in a college subject to fulfilling certain conditions teaching hours not exceeding 25 hours per week.

Joining/Leaving employment in Industry:* A member employed in industry is also required to give details of his employment irrespective of whether he holds certificate of practice or not.

Joining/leaving as Paid Assistant:* A member whether holding certificate of practice or not can join as a Paid Assistant in a CA Firm or with a Chartered Accountant in practice

A written intimation and confirmation by the firmindicating the date of joining/leaving is required to be submitted within 30 days

Members in practice working as a paid assistant cannot perform attest function and will be treated as a member in part-time practice

Firm/LLP Name Approval :lMember holding certificate of practice can practise in a trade/firm name with prior approval

lPrior approval of name of LLP from Secretary, ICAI is required in case the proposed name of LLP includes the words `Chartered Accountant' or 'Chartered Accountants'

Name will be approved only from the date on which form no.117 has been received.

Registration of Firm/LLP :lof firm name

lLLP can be registered after incorporation with the Registrar of LLP

A firm can be registered after getting approval

Any subsequent change in the particulars of LLP shall be intimated by submitting Form 18 within 30 days from the date of noting of the change in constitution of LLP by the Registrar of LLP along with the copy of letter issued by Registrar of LLP regarding change in constitution.

MCS /Network of firms name Approval:lthe office of Managing Director, Whole time Director or Manager of a body corporate with the prior approval within the meaning of the Companies Act, 1956 provided that the body corporate is engaged exclusively in rendering MCS permitted by the Council in pursuant to Section 2(2)(iv) of the CA Act,1949 and complies with the conditions as specif ied by Council from time to t ime.
