लाख -करोड़ लोग, जो कई साल से यातना का जीवन जी रहे ह, नकर् की यातना का

जीवन जी रहे ह, उन सबको एक नई आशा की िकरण िदखाने वाला यह िबल है।

मान्यवर, म थोड़ा पृ ठभिूम म जाना चाहंूगा। िवभाजन के बाद एक हम सबकी

क पना थी िक जो अ पसंख्यक नागिरक यहां पर रहते ह और पड़ोसी देश म भी जो

अ पसंख्यक रहते ह, वे सब अपने-अपने नागिरक अिधकार के साथ स मानपूणर् जीवन

जी पाएंगे।

साथ पालन कर पाएंगे। अपने पिरवार के वािभमान का और िवशेषकर पिरवार की

िस्तर्य के स मान की वे रक्षा भी कर पाएंगे और उन्ह रक्षण करने का अिधकार भी है।

परन्तु कई दशक के बाद, जब इस ओर मुड़कर देखते ह, तो कटु सच्चाई सामने यह

आई है िक चाहे अफगािन तान हो, चाहे पािक तान हो और चाहे समय-समय पर

बंगलादेश हो, जो अ पसंख्यक वहां रहते थे, उनके अिधकार की सुरक्षा नहीं हुई। उन्ह

समानता का अिधकार नहीं िमला। जब पूवीर् पािक तान से बंगलादेश बना, बंगबंधु

मुज़ीबुरर्हमान साहब ने इसे सुधारने का यास िकया, मगर दुभार्ग्य से उनकी हत्या हो

गई और एक ल बा काल खंड, अभी का शासन आने से पहले वहां ऐसा आया िक वहां

उन्ह घोर ताड़ना का सामना करना पड़ा।

मान्यवर, म इस बारे म आंकड़े बाद म, जवाब देते समय लेकर आऊंगा। मगर म

कहना चाहता हंू िक दोन पािक तान म- पूवीर् और पि चमी, मतलब िक आज के

बंगलादेश और पािक तान म, अ पसंख्यक की आबादी म लगभग 20-20 ितशत की

कटौती हुई है और कमी हुई है। कहां गए ये लोग? या तो उन्ह िकसी न िकसी रूप म

मार िदया गया, या उनका धमर् पिरवतर्न हो गया या, तो वे शरणाथीर् बनकर, अपने धमर्

और स मान को बचाने के िलए वे भारत म आए।

मान्यवर, भारत म आए, उन्ह यहां संरक्षण िमलना चािहए, लेिकन साल तक

नहीं िमला। उन्ह न नागिरकता िमली, न घर खरीदने का अिधकार िमला, न नौकरी, न


वा थ्य और िशक्षा की सुिवधाएं िमलीं और वे लोग आज अपने ही देश के अंदर दर-दर

की ठोकर खा रहे ह। यह िबल ऐसे सभी तािड़त लोग को जो धमर् के आधार पर

ताड़ना सह करके भारत म आए ह, उन सभी लोग को नागिरकता का अिधकार देने

हेतु यह िबल लाया गया है। इस िबल के अंदर कुछ िवशेष िरयायत भी इन िनि चत वगर्

के लोग के िलए हमने सोची ह। उन पर म बाद म आऊंगा।

मान्यवर, म आपके माध्यम से इस सदन का और सदन के माध्यम से पूरे देश की

जनता का ध्यान िदलाना चाहता हंू िक वषर् 2019 म, जब आम चुनाव हुए, तो आम चुनाव

के बाद, अभी जो पाटीर् स ा म है, वह भारतीय जनता पाटीर् और हमारे साथी दल,

सबने िमलकर भारतीय जनता पाटीर् का एक घोषणापतर् घोिषत िकया था और उसे

हमने देश की जनता के सामने रखा था।

सभापित महोदय, म टी पाटीर् डेमोकेर्िटक िस टम म, पािर्लयामटरी डेमोकेर्िटक

िस टम म इस घोषणापतर् म, जो सरकार बनने वाली है, उसकी नीितय की उद्घोषणा

होती है। इसके आधार पर चार होता है। देश की जनता इसके आधार पर अपना मत

यक्त करती है और िकसी एक दल को चुनकर, िजसका मेिनफे टो अच्छा लगे, उसे

शासन करने का अिधकार देती है। भारतीय जनता पाटीर् ने अपने घोषणापतर् के अंदर

असंिदग्ध तरीके से इस बात की घोषणा की थी। म यह बात इसिलए कहना चाहता हंू

िक जो लोग कह रहे ह िक आप वोट बक की राजनीित कर रहे ह या यह कर रहे ह या

वह कर रहे ह, म उन सभी सािथय से कहना चाहता हंू िक हमने चुनाव से पहले ही,


एक इरादा, देश की जनता के सामने रखा था, िजसे देश की जनता ने जनसमथर्न

िदया है और देश की जनता ने शासन करने का अिधकार िदया है।

मान्यवर, लोकतंतर् के अंदर जनादेश से बड़ी कोई बात नहीं हो सकती। हमने इस

घोषणापतर् के अंदर िलखा था िक हम पड़ोसी देश से तािड़त धािर्मक अ पसंख्यक के

संरक्षण के िलए िसिटज़निशप अमडमट िबल को लागू करने के िलए ितब ह और

उसे लागू करगे।

हमारे तीन पड़ोसी देश के धािर्मक अ पसखं्यक को संरक्षण देकर उनको नागिरक

बनाने की िकर्या का अमडमट लेकर आए ह और जो पूव र के राज्य ह, उनके

अिधकार को, उनकी भाषा को, उनकी सं कृित को और उनकी सामािजक पहचान को


ि ज़वर् करने के िलए, उनको संरिक्षत करने के िलए भी हम िंचता करते हुए इसके अंदर

ावधान लेकर आए ह। म िबल के िडटे ड ावधान पर बाद म जाऊंगा, लेिकन सरल

भाषा म कहंूगा - क्य िक देश की जनता भी इस सदन म हो रही बहस को बड़ी

curiocity देख रही है, सबके मन म प ट हो जाए, इसिलए म सरल भाषा म यह

बताना चाहता हंू िक यह िबल क्या है। पािक तान, बंगलादेश और अफ़गािन तान, इन

तीन देश की जो सीमाएं भारत को छूती ह, उन तीन देश म िंहदू, जैन, बौ , िसख,

ईसाई और पारसी, वहा ँकी लघुमती के लोग, जो भारत म आए ह, वे िकसी भी समय

आए ह , उनको नागिरकता दान करने का ावधान इस िबल म है। इसका मतलब

आज़ादी के बाद बंगलादेश, पािक तान और अफगािन तान से जो भी जैन, बौ ,

िसख, ईसाई, पारसी और िंहदू धमर् का अनुसरण करने वाले उन तीन देश की

माइनॉिरटी के लोग, जो यहा ँआए ह, हम उनको नागिरकता दगे।

दूसरा, हमने पूरे नॉथर्-ई ट के अंदर अलग-अलग कार से नॉथर्-ई ट के लोग

के िहत की िंचता भी की है, म इसको बाद म बताऊंगा।

मान्यवर, लोक सभा म चचार् चली। मने कुछ अखबार के आिर्टक स भी पढ़े ह, म

यह कहना चाहंूगा िक एक बहुत बड़ी ािंत फैलाई जा रही है िक यह िबल माइनॉिरटी

के िखलाफ है, यह िबल िवशेषकर मुि लम समुदाय के िखलाफ है। मान्यवर, म बताना

चाहता हंू िक जो इस देश के मुसलमान ह, उनके िलए इस देश के अंदर िकसी िंचता

की चचार् का सवाल ही नहीं है, क्य िक वे नागिरक ह, नागिरक रहगे, उन्ह कोई

तािड़त नहीं कर सकता। मगर आप िंचता िकसकी कर रहे ह? क्या पािक तान की


िंचता है? क्या आप चाहते ह िक पािक तान से भी जो मुसलमान यहा ँआएं, हम उनको

भी नागिरक बना द, बगंलादेश से जो मुसलमान यहा ँआएं, उनको भी नागिरक बना द,

अफगािन तान से भी जो मुसलमान यहा ँआएं, उनको भी नागिरक बना द? आप क्या

कहना चाहते ह? पूरी दुिनया से जो भी मुसलमान यहा ँआएगा, क्या हम उसको यहा ँ

की नागिरकता दे दगे? िकस तरह से दगे? देश कैसे चलेगा? ऐसे नहीं चल सकता है।

यह उन िनि चत वग के िलए है, िजनके धमर् के अनुसरण के िलए इन तीन राज्य म

अनुकूलता नहीं है, उनको तािड़त िकया जा रहा है। इसम उन तीन देश के

अ पसखं्यक को ही नागिरकता देने का ावधान है। आज जो लोग इस िबल का िवरोध

कर रहे ह, म उनसे यह पूछना चाहता हंू, कृपया आप मुझे यह बताइए - म जब जवाब

देने के िलए खड़ा होऊंगा तब पूरी चीज़ िडटेल म बताऊंगा, म आपकी जो एक-एक

शंका है, आपके जो सवाल ह, आप जो एक-एक प टीकरण मागंगे, वे सब

प टीकरण दंूगा, मगर म आपको िसफर् इतना बताना चाहता हंू िक िजन लाख ,

करोड़ लोग पर ताड़ना हुई है, वे लोग जाएं कहा?ँ वे कहा ँजाएँ? क्या उन्ह जीने का

अिधकार है या नहीं है? हम उन्ह अिधकार देना चाहते ह या नहीं देना चाहते ह?

मेरी उनको चुनौती है िक जब आपको बोलने का मौका िमले, तो मु े के साथ point

उपि थत किरएगा, म हरेक चीज का जवाब देने के िलए बाध्य भी हँू, तैयार भी हँू और

मान्यवर, म इस िबल के कुछ ावधान को बता कर अपना ारंिभक भाषण

समा त करूँगा। इस िबल के अन्दर नागिरकता अिधिनयम, 1955 की धारा 2 (1) (ख)

म जो ावधान ह िक पासपोटर्, वीजा और टर्ैवल द तावेज के बगैर जो वासी भारत म

आते ह, या िजनका पासपोटर् और वीजा expire कर जाता है, काल बा हो जाता है,

उनको अवैध वासी माना जाता है, अब हम इसके अन्दर सुधार लेकर आए ह। अब मने

ये जो 6 वगर् कहे - िहन्दू, िसख, जैन, पारसी, बौ और ईसाई, जो इन तीन देश से

आते ह, उनको अवैध वासी नहीं माना जाएगा। इससे उनको मुिक्त दे दी गई है।


मान्यवर, इसम नागिरकता अिधिनयम की नई धारा 6 (ख) भी लाने का ताव

है। इसम ताव है िक यिद धािर्मक उत्पीड़न के िशकार उपरोक्त वासी िनधार्िरत की

गईं शत और ितबंध के तौर-तरीक को अपना कर रिज टर्ेशन कराते ह, तो उनके

माध्यम से वे भारत की नागिरकता ले पाएँगे। यह ावधान भी िकया जा रहा है िक ऐसे

वासी अगर नागिरकता अिधिनयम, 1955 की धारा 5 या तीसरे शै ूल की शत पूरी

करने के उपरांत नागिरकता ा त कर लेते ह, तो िजस ितिथ से वे भारत म आए ह,

उसी ितिथ से उनको नागिरकता दे दी जाएगी। इसका मतलब होता है िक मेरे पि चमी

बंगाल के अन्दर ढेर सारे शरणाथीर् आए हुए ह, अगर वे 1955 म आए, 1960 म आए,

1970 म आए, 1980 म आए, 1990 म आए या 2014 की 31 िदसंबर के पूवर् आए, उन सभी

को उसी ितिथ से नागिरकता दी जाएगी, िजस ितिथ से वे आए ह। इससे उनको कोई

legal consequence face नहीं करना पड़ेगा। मान्यवर, अगर ऐसे अ पसंख्यक

वासी के िखलाफ अवैध वास या नागिरकता के बारे म, घुसपैठ या नागिरकता के

बारे म कोई भी केस चल रहा है, तो वह केस इस िबल के िवशेष ावधान से वहीं पर

समा त हो जाएगा। वह legal proceeding उसको face नहीं करना पड़ेगा। इस धारा

म यह भी ावधान िकया गया है िक अगर आवेदक िकसी भी कार का अिधकार या

privilege ले रहा है, तो इस ावधान के तहत वह अिधकार व privilege से वंिचत नहीं

कर िदया जाएगा। मान्यवर, कई जगह कुछ जो शरणाथीर् आए ह, उन्ह ने छोटी-मोटी

दुकान खरीद ली है, वे अपना काम कर रहे ह। कानून की दृि ट म हो सकता है िक वह

अवैध हो, गैर-कानूनी हो। मगर यह िबल उनको protect करता है िक उन्ह ने भारत म


अपने िनवास के समय म जो कुछ भी िकया है, उसको यह िबल regularize कर देगा।

उनकी उस status को कहीं पर भी वंिचत नहीं करेगा। जैसे िकसी की शादी हुई, बच्चे

हुए, इन सब चीज को यह िबल regularize करेगा।

ी अिमत शाह (कर्मागत): उ र-पूवर् के सभी राज्य म जो ोटेक्शन िदया गया है,

उसी को आगे बढ़ाते हुए, Sixth Schedule म असम, मेघालय, िमज़ोरम, ितर्पुरा और

अब पूरा मिणपुर भी नोिटफाई हो चुका है। जनजातीय इलाक पर यह िबल लागू नहीं

होगा। इसी तरह Bengal Eastern Frontier Regulation Act, 1973 के तहत Inner

Line Permit के इलाके, पूरा िमज़ोरम, अरुणाचल देश, अिधकांश नागालड और

मिणपुर, इन सारे एिरयाज़ म भी ये ावधान लागू नहीं ह गे।

मान्यवर, जहां तक असम का सवाल है, म आज इस सदन के सामने एक कटु

वा तिवकता रखना चाहता हंू। 1985 म असम के अन्दर तत्कालीन धान मंतर्ी, ी

राजीव गांधी जी ने Assam Accord िकया था। Assam Accord के अंदर असम के

लोग को उनकी सां कृितक, सामािजक और भाषाई पहचान िदए जाने एवं चुने हुए

फोर स म उनके representation के अिधकार को protect करने के िलए क्लॉज़-6

बनाया गया था। क्लॉज़-6 के अंदर एक ावधान था िक इसके माध्यम से भारत सरकार

एक किमटी गिठत करेगी, जो इन सारी चीज़ को देखेगी, इनकी िंचता करेगी, तािक

असम के जो मूल िनवासी ह, वे अपनी पहचान बना पाएं। ी राजीव गांधी जी ने बड़ी


उदा भावना के साथ इस Assam Accord को साइन िकया, असम के लोग बहुत खुश

हो गए, वहां पटाखे जलाए गए, खुिशयां मनाई गईं और िफर वह आन्दोलन वहीं पर

समा त हो गया। लेिकन 1985 से लेकर जब तक ी नरेन्दर् मोदी धान मंतर्ी बने, तब

तक क्लॉज़-6 की वह किमटी बनी ही नहीं।...( यवधान)... वह किमटी बनी ही नहीं।

मान्यवर, 35 साल तक िकसी को िंचता नहीं हुई िक असम के लोग की भाषा की रक्षा,

सािहत्य की रक्षा, सं कृित की रक्षा, पूरे सामािजक पिरवेश की रक्षा, उनके political

representation का protection, इन सारी चीज़ के िलए जो करना था, वह हुआ ही

नहीं।...( यवधान)... कभी नहीं हुआ।...( यवधान)... आप बोल रहे ह, तो यह भी

बताइए िक कब हुआ? ...( यवधान)... कभी नहीं हुआ। वह तब हुआ, जब इस देश ने

नरेन्दर् मोदी जी को धान मंतर्ी बनाया और भारतीय जनता पाटीर् की सरकार आई।

recommended to allot six hours for this important legislation. Though, in the

other House, it was discussed less than this time. But, Rajya Sabha, being

the Council of States, and after taking into consideration the suggestion, this

time has been fixed. It is a very important legislation. We are all Elders. If

there is concern in your heart and in your mind about your State, you have

got every right to express it through a system. So, please follow the timings

that have been allocated. Every party is given time as per the allocation of

their membership in the House. One minute, this way or that way, this is not

a big issue. We will be liberal. But, liberal does not mean that you go on

speaking. We will be flexible, to the extent, provided everybody cooperates

in that effort. Even, the smaller parties also will be given an opportunity. But,

they should also keep it in mind that the points which they want to make,

they should first make those points, and later, if you get time, then you can


add to it. Otherwise, what is happening is that they make other points, and

by the time the Chair asks them to conclude, then they say, ‘Sir, the original

point is still to be made’. So, keep that in mind. Now, I appeal to one and all,

the entire country is watching the House, like it was watched on earlier two

महोदय, गृह मंतर्ी जी ने अभी सदन म नागिरकता िवधेयक म संशोधन लाने का

एक ताव लाया है। िपछले कुछ साल से इसकी चचार् रही है। 2016 म भी यह िबल


लाया गया था। उस िबल म और इस िबल म काफी अन्तर है। मने सरकार के पक्ष को,

गृह मंतर्ी जी को सुना, दूसरे सदन म भी, यह कथन है िक सबसे बातचीत हो चुकी है।

कहा िक यह एक ऐितहािसक िबल है, पर इितहास इसको िकस दृि ट से देखेगा, वक्त

बताएगा। अगर आप बदलाव लाए थे, बेहतर होता, जातंतर् की यह िरवायत है, इसको

दोबारा िदखवाते। ज दीबाजी क्य ? इसको पािर्लयामट की कमेटी को भेजते और

अगले सतर् म इसको लेकर आते। हमने माँग की थी, पर सरकार अपनी िज़द पर कायम

है, चाहती है िक इसको कर, जैसे कोई बहुत बड़ी िवपि भारत के सामने है, ऐसा जो

िक िपछले 72 साल म नहीं देखा गया, इसिलए इसको तुरंत करना जरूरी है। हम

इसका िवरोध करते ह। िवरोध के कारण राजनीितक नहीं ह, बि क संवैधािनक ह,

नैितक ह। I am convinced that the Bill that you have brought is an assault on

the very foundational values of the Indian Constitution. It is an assault on the

Republic of India. It hurts the soul of India. It is against our Constitution; it is

against our democracy. It fails the morality test. It is divisive and

discriminatory. It is against the very Preamble of the Constitution of our

Republic, which talks of liberty, equality and secularism. This is the reason I


stand to oppose this Bill. नागिरकता; िहन्दु तान की आजादी के बाद देश का

बंटवारा हुआ था, नागिरकता की याख्या और कानून बनाने की आव यकता पर भारत

की संिवधान सभा ने यापक चचार् की थी, िजसकी अध्यक्षता थम रा टर्पित डा. राजेन्दर्

साद जी करते थे, डा. बी. आर. अ बेडकर डर्ािं टग कमेटी के चेयरमैन थे और

संिवधान की सिमित के अध्यक्ष पं. जवाहरलाल नेहरू थे, िजनका एक बहुत बड़ा

योगदान और कुबार्नी िहन्दु तान की आजादी म है।

पािर्टशन की पीड़ा पूरे देश को थी। उस समय जो लोग नेता थे, िजन पर

िज मेवािरयाँ थीं, िजन्ह ने िहन्दु तान की आजादी की लड़ाई लड़ी थी, महात्मा गाँधी के

नेतृत्व म रा टर्ीय आन्दोलन म िह सा िलया था, उनको मालूम था िक बंटवारे के बाद

नागिरकता का क्या महत्व है। उसको इन्ह ने समझा। पर, िसिटज़निशप का काँसे ट

क्या है? वह भौगोिलक है, territorial है, जन्म से है, वयं के जन्म से, माता-िपता के

जन्म से और हमारे संिवधान िनमार्ताओं ने तो आगे जाकर गर्ड पैरट्स के जन्म से भी

िकया, ओिरिजन से िकया, दादा-दादी, नाना-नानी, वे श द इस संिवधान के अंदर

शािमल िकए गए, धारा 5 से लेकर धारा 11 तक, यह संिवधान के अंदर है। उन्ह ने सब

कुछ उ लेख िकया है, जो माननीय गृह मंतर्ी जी ने अभी कहा िक जो िव थािपत थे,

बंटवारे के बाद जो पीिड़त थे, क्या संिवधान िनमार्ताओं का यह स मान करना है? अगर

हम आज 72 साल के बाद 2019 म यह कथन कह िक उनको कोई समझ नहीं थी,

उन्ह ने इस पर गौर नहीं िकया था, कुछ नहीं सोचा था, यह गलत बात है।


आपने जहाँ तक naturalisation process का िजकर् िकया िक लोग को

नागिरकता दी जाए। भारत के संिवधान म उसम कोई भेदभाव नहीं िकया गया, कोई

परहेज नहीं है। िहन्दु तान के बंटवारे से उजड़े और उत्पीिड़त लाख लोग, जो पि चम

और पूवीर् पािक तान से आए थे, क्या उनको स मान नहीं िमला? दो-दो धान मंतर्ी भी

बने, एक डा. मनमोहन िंसह जी यहाँ बैठे ह और एक आई. के. गुजराल भी थे। हम

मालूम है, पिरवार टूटे थे, रक्तपात और नरसंहार हुआ था, गृह मंतर्ी जी, उनको न्याय

िदलाना, बराबरी का अिधकार और समान अिधकार, यह ितब ता भारत देश की थी।

देश के संिवधान िनमार्ताओं ने यह सुिनि चत िकया था। मने बताया िक संिवधान म

इसका प ट ावधान है, जो आप लेकर आए ह, यह कोई नई बात नहीं है।

िसिटजनिशप एक्ट म नहीं, संिवधान म इसका ावधान िकया गया है। जहाँ तक

िसिटजनिशप एक्ट की बात है, यह 1955 म आया, उसके बाद इसम नौ बार बदलाव भी

हुआ, संशोधन हुआ, पर जो हमारा मूलभतू संिवधान है, उसम िकसी संशोधन से कोई

पिरवतर्न या कोई टकराव कभी नहीं हुआ। माननीय गृह मंतर्ी, इितहास बड़ा महत्व

रखता है। मेरा कतर् य बनता है िक म उसको सदन म रखँू। क्य िक आपने दूसरे सदन

म िहन्दु तान के बंटवारे का िज़कर् िकया और बंटवारे का दोष उन लोग पर लगाया,


भारतीय रा टर्ीय काँगेर्स पर और उन नेताओं पर लगाया, िजन्ह ने अंगेर्ज की जेल म

बरस गुजारे, कुबार्िनयाँ दीं और िहन्दु तान की आज़ादी के िलए संघषर् िकया। यह

न्यायोिचत नहीं है। म आपसे यह आगर्ह करता हँू िक अगर आप कहते ह िक राजनीित

नहीं होनी चािहए, तो यह राजनीित भी बंद होनी चािहए। वह महात्मा गाँधी के नेतृत्व म

था, उसम सरदार पटेल, सुभाष चंदर् बोस, मौलाना आज़ाद, सभी लोग शािमल थे। उन

वतंतर्ता सेनािनय के संघषर् को - आपको उनके मत से, िवचारधारा से कोई भी परहेज

हो, पर इितहास म वह अंिकत है, उससे इन्कार नहीं िकया जा सकता और अगर आज

की सरकार वैसा करती है, तो म कहँूगा िक उसको नकारना अन्याय होगा, इितहास

का अपमान होगा। इितहास को बदला नहीं जा सकता। दुिनया म यह कोिशश बहुत

हुई, कई सरकार, कई शासक ने नया इितहास िलखा है, पर वे िलख नहीं पाए,

क्य िक मनु य के जीवन म यही है, यही राजनीित और यही जातंतर् की सच्चाई है िक

कभी न कभी जब पिरवतर्न होता है, तब सच्चाई और इितहास अपने आप को पुन: चंड

रूप म कट करती है।

मान्यवर, एक नज़िरया उन लोग का भी था, जो गाँधी जी और काँगेर्स के मत के

िवरोधी थे। उसम मुि लम लीग थी, उनके नेता िज ा थे, िहन्दू महासभा थी, उनके नेता

िवनायक सावरकर थे। मान्यवर, जो बंटवारे की two-nation theory है, उसे काँगेर्स

नहीं लाई, बि क 1937 म अहमदाबाद म िहन्दू महासभा ने ताव पािरत िकया था।

उसकी अध्यक्षता सावरकर जी ने की थी। स 1938 म, उसके एक साल के बाद

मुि लम लीग का अिधवेशन हुआ, उसम Partition of India Resolution adopt िकया


गया। उसे फजलूल हक ने मूव िकया, जो बाद म इनके साथी भी बने, बंगाल के मुख्य

मंतर्ी बने और पािक तान के धान मंतर्ी बने। इसके बाद, आप अंगेर्ज़ की भिूमका की

चचार् क्य नहीं करते? लड़ाई तो अंगेर्ज़ी हुकूमत के िखलाफ थी। What was the role

of the British? They gave power of veto to the Muslim League and Jinnah

after 1938. 1948 और 1943 के घटनाकर्म को िहन्दु तान और इितहास भलू नहीं

सकता। ि तीय िव व यु शुरू हो गया था, काँगेर्स ने िवरोध िकया था, गाँधी ने भारत

छोड़ो का नारा िदया था, काँगेर्स का नेतृत्व कैद कर िलया गया था, कोई नेता बाहर

नहीं था, तीन साल तक सारी काँगेर्स, काँगेर्स को बैन कर िदया गया था, illegal

organization कह िदया था, जेल के अंदर हजार लोग बंद थे, सूब म काँगेर्स की

सरकार िडि मस कर दी गई थीं, इ तीफे हो गए थे, तब यही दो संगठन आगे आए और

Viceroy Linlithgow को एक के बाद एक िच ी दी। चाहे वह िहन्दू महासभा थी, चाहे

वह मुि लम लीग थी, िजन्ह ने कहा िक 'We will help in the formation of

Governments in the provinces loyal to Her Majesty's Government.'

ी आनन्द शमार् : माननीय, यह िजकर् क्य नहीं आया िक िहन्दु तान का बँटवारा,

Independence of India Act, िजसे House of Commons, British Parliament ने

पास िकया था, उसके कारण हुआ? कांगेर्स को भी दोष देना गलत है। अगर िकसी को

नया इितहास िलखने का ोजेक्ट िदया गया है, तो कृपा करके ऐसा अन्याय मत

कीिजए, आपसे यह मेरा आगर्ह रहेगा। पर, एक चीज़ जरूर है। स 1943 म

औपचािरक रूप से घोषणा कर दी गई -- सावरकर जी ने -- म जो ये सारी बात कह

रहा हँू, authenticate करके सभा पटल पर रखँूगा, तािक भिव य म इस सच्चाई की

याद रहे। उन्ह ने कहा, "I have no problems with Mr. Jinnah's proposal of a

two-nation theory." It is on record.

माननीय, अगर म आज के पिर े य म कहँू, तो Citizenship Act म जो नौ बार

संशोधन आए, उनम से कई महत्वपूणर् थे, म िकसी को नगण्य नहीं मानता। उसके बाद

लोग को नागिरकता दी गई। जब गोवा आज़ाद हुआ, दमण-दीव आज़ाद हुए,

पाँिडचेरी आज़ाद हुआ, तब वहाँ के
