When exercising freedom of speech you may be careful of Clear and Present danger.

Must be truthful or it is called slander.Bob was a very opinionated person.

Whenever people said that he should be less sharp with his words he said he had freedom of speech. On day Bob criticized a local shop owner of selling bad products even though everything there was fine. People heard Bob and stopped shopping there. The owner decided to sue Bob for slander. Bob said he had freedom of speech.

The freedom of assembly states that the people have the right to peacefully gather for protest. This also means abiding by local laws or you are not protected. This freedom lets the people protest in a way that allows them to be noticed.

Gary disliked that recess was no longer allowed so he gathered a group of people to assemble after school to protest. The assembly was peaceful, but the principal disliked the disturbance, so he called the police. The protesters were told by the cops to disperse and go home. Gary said that they had the right to assemble and that they would not leave. The police arrested the entire group and brought them to the station for disrupting the peace.

The right to bear arms has been interpreted in many ways. Some feel that only state troopers should be able to carry arms. Others believe that all citizens should be allowed to bear arms in self defense. Certain types of weapons are banned by the government.

Fred has weapons at home and says that no one would dare rob his home. He insists upon wearing arms on his person at all time. Fred even has a few banned weapons in his house in the name of self defense. His neighbors would call the police, but Fred threatens them saying he has the right to bear arms.

This amendment stems from colonial times when the British had their soldiers take up quarters with the colonists. Amendment Three was made to stop acts like the Quartering Act. The Continental Congress approved this amendment because they believed a man’s home should be his castle. This meant that people’s homes had to be safe from civil and military intrusion. During peacetime, there is no reason for a soldier to barge into your house and demand food.

General George decided that the military needed to save more money for their operations. After looking at what conveniences could be cut, the general decided that soldiers could go to the homes of people across the country to demand quarters. Whenever someone refused, they were arrested. The military saved lots of money and decided to keep up this money saving scheme.

Amendment four protects our right to be secure in our homes. Also, this right protects our expectation for privacy. Another thing this amendment protects us from is when the government seizes land and does not pay for it. To search your house or person you need a search warrant signed by a judge. There are only ten exceptions to a search warrant. Without this amendment anyone could barge in for anything.

Jerry loved her privacy, but she had jealous neighbors. One neighbor called the cops and said that Jerry had a stolen TV. A cop showed up at Jerry’s house and demanded entry. Jerry refused saying that the cop had no search warrant. The cop ignored Jerry and broke into her house. Jerry threatened to sue him, so he backed out. The next day the cop came back with a warrant saying he had permission to search for a stolen TV. The cop, instead of looking where you could fit a TV, started searching the saying he had a tip that there were drugs in the house. Jerry used her fourth amendment rights and stopped the unreasonable search.

Amendment five protects our rights in court. First, we have aright to a grand jury. A grand jury’s job is to decide if there is enough evidence for a trial. Also, we have are protected from double jeopardy which is when a person is tried twice for the same crime. Double jeopardy is illegal. Another useful thing is that you cannot self incriminate yourself. Self incrimination is when you are forced to testify against yourself. You also have Miranda rights. These rights say that you must be informed of your right to remain silent and your right to have an attorney present during the trial. Due process of law is your right to be heard. When the government takes private property for public use the owners must be paid a fair price. This is called Eminent Domain.

John was accused of stealing money from a bank. After being arrested, John was informed of his Miranda rights. Being poor, John asked for a free attorney and was given one. When the grand jury decided that there was enough evidence for a trial, John’s attorney started preparing a defense. When the trial started, John was asked to give testimony against himself. John, remembering his rights, said, “ I plead the fifth”. At the end of the trial, John was declared innocent and all charges were dropped. The following year, John was accused of robbing a bank again. John went to court and said that his trial could be considered double jeopardy which was illegal. The jury agreed and John returned home.

Our due process rights were given to us to ensure justice for all. First of all we have the right to a speedy trial which means that the trial must take place soon after the person is accused and arrested. Also, we have the right to a public trial which means that the public can watch to ensure fairness. Another good right is to an impartial jury which means that the jury are not slanted in favoring one side over the other. You should not have to be taken far away from home so you have a right for the trial to be located in the area where crime was committed. You must also be informed of the charges against you. Your next right is the right to be able to see, face to face, the witnesses who testify against you. You can call your own witnesses to the stand to testify as well. Last but definitely not least is your right to an attorney.

Joey was accused of stealing a car. He was told his rights and informed of his charges and so he demanded a speedy trial that was held in public. Joey also wanted to be sure of having an impartial jury. He was reassured that the jury would be impartial. Joey used his right to an attorney to get an attorney to help him out. Joey watched the witnesses that testified against him face to face. Then Joey called witnesses of his own to the stand. After all the testimony was over the jury made their decision. The charges against Joey were dropped and he drove home in his car.

We have rights to have a jury for not only crimes, but also civil cases.

Civil cases are not crimes. They usually occur between two individuals. Common Law is another 7th amendment right that means

you must obey a previous court decision.Also Civil cases are considered any case with an amount

above twenty dollars. Only when the amount is over twenty dollars do you have the right to a jury in a civil case. Sid’s neighbor was pretty clumsy and unorganized. One day he when he wasn’t paying attention, he drove over Sid’s mailbox. When Sid found out he was mad and wanted to sue his neighbor. Unfortunately for Sid, the cost of repairing the damage was only eighteen dollars so he couldn’t make a civil case out of the incident.

Bail is money paid to stay out of jail while waiting for the trial. It is returned after the trial.

Bail is basically a way of insuring that you show up in court. The 8th Amendment protects us from having to pay bails that don’t fit the

crime. Also, we are protected from cruel punishments that are too extreme for

the crime committed. If the crime is stealing candy, you shouldn’t get the death sentence.

Jack was accused of stealing a basketball. While waiting for the trial Jack asked what the bail price was. The judge decided to set it at fifty thousand dollars because he wanted to be sure Jack would show up for the trial. Jack said that that price was excessive bail. He then asked that the price be lowered to a more reasonable one. The judge agreed and lowered the price to one thousand dollars. Jack paid the price and got out of jail. On the day of the trial Jack showed up and recollected the bail money he had paid. The evidence was examined and Jack went through Due Process. In the end, Jack was declared innocent and he returned home.

The 9th Amendment is basically the etcetera amendment. It means that the people have all the rights that might not be in the

Constitution by default. This amendment was made to guarantee freedom in the quality of the

individual’s rights. For example, you can make your own choices about marriage, divorce,

having children, and education. These rights may not be listed, but Amendment Nine makes sure you get them.

Diego never wanted to have children because he felt they took too much maintenance. His wife, Dora, adored children and wanted some of her own. Dora asked Diego if they could have children, but he refused. The couple got into a huge argument. In the end, Dora took Diego to a civil court to decide if she could have kids or not. Diego using his 9th amendment rights refused to have kids. Dora, also using her rights, pushed to have children. Finally, the court ruled that the couple should think about getting a divorce. The couple agreed and divorced a little while later. After they divorced, each went their own separate ways.

First, this amendment states that any power not listed in the Constitution goes to the states and their people by default.

This amendment also states that Federal rights are superior to State rights.

States received powers to educate citizens because education was not in the Constitution.

Also, States only receive powers after individuals can no longer manage them.

The interpretation of this amendment will vary according to the time period.

The people of Kansas preferred home schooling to public schools. When the state tested the home schooled kids on what they should know, most of them failed. The state government then decided it needed to step in. First, it said that a child who failed after being home schooled had to attend public school to get the education they needed. Most of the people were resentful of this action, but they could see the state was exercising its 10th Amendment rights.
