Le PRÉSIDENT déclare ouverte la première' audience de la dix-septième Session de la Cour.

Cette session, qui est une session ordinaire, convoquée conformément aux termes de l'article 2I du Statut, s'est ouverte le I7 juin dernier. Pour des motifs tenant au fait que la seizième Session (extraordinaire), ouverte le I3 mai dernier, n'a pas encore pu être close, les audiences publiques de la dix-septième Session ne commencent, toutefois, qu'aujour-d'hui.

Le Président prie le Greffier de mentionner les affaires dont· la Cour est effectivement saisie.

The PRESIDENT declared the first public meeting of the Court's .Seventeenth Session open.

This session, which was an ordinary session, summoned in accordance with the terms of Article 21 of the Statute, had begun on June 17th last. For reasons connected with the fact that the Sixteenth (extraordinary) Session, begun on May 13th, had not yet been concluded, the public hearings. however. of the Seventeenth Session were only being begun that day.

The President asked the Registrar to indicate the cases actually before the Court.

Le GREFFIER indique qu'il s'agit:

r) du différend entre les Gouvernements de la République française et de la Confédération suiss·e au sujet des zones franches de la Haute-Savoie et du Pays de Gex;

2) du différend entre les Gouvernements de l'Allemagne, du Danemark, de la France, de Sa Majesté britannique en Grande-Bretagne, de la Suède et de la Tchécoslovaquie, d'une part, et le Gouvernement de la Pologne, d'autre part, au sujet des limites territoriales de la compétence de la Commis-sion internationale de l'Oder.

Le PRÉSIDENT observe que la première de ces affaires, à savoir celle qui a trait aux zones franches de la Haute-Savoie et du Pays de Gex, se trSlUve en état depuis le I2 juin dernier; l'autre, relative à l'étendue de la juridiction de la Commission de l'Oder, est en état depuis le ro juin dernier.

La Cour s'occupera en premier lieu de l'affaire des zones franches.

Avant de donner la parole aux plaideurs, le Président rappelle que, l'une des Parties en cause - la France - ne comptant· pas en ce moment sur le siège un juge de sa natio-nalité et faisant usage du droit qui lui revient aux termes de l'article 31 du Statut, a désigné, à titre de juge ad hoc, M. Eugène Dreyfus, premier président de la Cour d'appel de Paris. Il prie M. Dreyfus de prendre l'engagement solennel, prévu à l'article 20 du Statut, d'exercer ses fonctions en pleine impartialité et en toute conscience.

M. DREYFUS prend cet engagement. \

Le PRÉSIDENT prend acte, au nom de la Cour, de la décla-ration de M. Dreyfus et le déclare installé dans ses fonctions de juge ad hoc en l'affaire entre la France et la Suisse au sujet des zones franches de la Haute-Savoie et du Pays de Gex.

Il rappelle que les Gouvernements en cause ont désigné comme agents: le Gouvernement français, M. Basdevant, conseiller juridique adjoint du ministère des Affaires étrangères de France, et le Gouvernement suisse, M. A. de Pnry, ministre

The REGISTRAR said that these were:

(I) a dispute between the Governments of the French Republic and of the Swiss Confederation concerning the free zones of Upper Savoy and the Pays de Gex;

(2) a dispute between the Governments of Czechoslovakia, Denmark, France, Gennany, His Britannic Majesty in Great Britain, and Sweden, of the one part, and the Government of Poland, of the other part, concerning the territorial limits of the jurisdiction of the International Commission of the Oder.

The PRESIDENT said that the first of these cases, namely, that relating to the free zones of Upper Savoy and the District of Gex, had been ready for hearing sinee June uth 1ast; the other, concerning the extent of the jurisdiction of the Oder, had been ready sinee June Ioth last.

The Court would first take the case of the free zones.

Before calling on Counsel to address the, Court, the President observed that one of the Parties ta this case-name1y, France -, having no judge of its nationality at the present time upon the bench and exercising the right conferred upon it by Article 31 of the Statute, had appointed as judge ad hoc M. Eugène Dreyfus, First President of the Court of AppeaI of Paris. He requested M. Dreyfus ta make the solemn declaration provided for by Article 20 of the Statute ta exer-cise his duties impartially and conscientiously.

M. DREYFUS made this declaration.

Thp PRESIDENT, in the name of the Court, placed this declar-ation on record, and declared M. Dreyfus duly installed in his duties as judge ad hoc for the case between France and Switzerland concerning the free' zones of Upper Savoy and the Pays de Gex. '

He recalled the fact that the Governments concerned in this case had appointed as Agents: the French Government, M. Basdevant, Assistant Legal Adviser ta the French Ministry of Foreign Affairs, and the Swiss Government, M. A. de Pury,

de Suisse aux Pays-Bas, et M. Paul Logoz, membre, du Conseil national suisse, professeur à l'Université de Genève.

L'agent du Gouvernement français sera assisté par Me Paul-Boncour, député, ancien ministre, avocat à la Cour d'appel de Paris, ainsi que par M. Labouret, conseiller d'ambassade, M. Noël Henry, consul de France, et par Me Louis Lucien-Hubert, avocat à la Cour d'appel de Paris, et les agents du Gouvernement suisse par M. Walter Burckhardt, professeur à l'Université de Berne, M. Paul-Edmond Martin, professeur à l'Université de Genève, directeur des Archives d'État de Genève, en qualité de conseils, ainsi que par M. Pierre Bonna, conseiller de légation.

Le Président déclare que, la présente affaire ayant été soumise à la Cour par notification d'un compromis, et aucun accord entre les Parties au sujet de l'ordre entre les plaidoiries ne lui ayant été communiqué aux termes de l'article 46 du Règlement, . il donnera, suivant la pratique de la Cour, la parole aux conseils, dans l'ordre alphabétique des noms des États dont ils exposent le point de vue.

En conséquence, il invite les représentants du Gouvernement français à prendre la parole.

Me PAUL-BoNCOUR prononce la plaidoirie reproduite en annexe l, dont la suite est interrompue par la suspension de l'audience.

L'audience, suspendue à 12 h. 45, est reprise à I5 h. 30.

Le PRÉSIDENT donne la parole à Me Paul-Boncour.

The President stated that as the present case had been submitted to the Court by a Special Agreement and as no agreement between the Parties as to the order in which they were to address the Court had been notified to the Court under Article 46 of the Rules, he would, in accordance with· the Court's practice, calI upon Counsel in the alphabetical order of the names of the States which they represented.

Accordingly, he called ?n the representatives of the French Govemment.

Me PAUL-BoNCOUR made the speech reproduced in the annex 1, which he had not concluded when the hearing was adjourned.

The hearing was adjourned from 12-45 to 3.30 p.m.

The PRESIDENT called on MO Paul-Boncour to continue.

The REGISTRAR said that the Court had met for the pro-nouncement of an order fixing a time-limit in the case between France and Switzerland concerning the free zones of Upper Savoy and the Pays de Gex.

The PRESIDENT observed that, according to the Special Agreement of October 30th, I924, the High Contracting Parties agreed that the COUTt-as saon as it had concluded its de1iberation on the question whether, as between France and Switzerland, Article 435, paragraph 2, of the Treaty of Versailles, with its annexes, had abrogated or had for its object the abrogation of the provisions of the Protocol of the

de Paris du 20 novembre 1815, du Traité de Turin du 16 mars 1816, et du Manifeste de la Cour des Comptes de Sardaigne du 9 septembre 1829, relatives à la structure douanière et économique des zones franches -, impartisse aux deux Parties un délai convenable pour régler entre elles le nouveau régime desdits territoires dans les conditions qu'elles jugeraient oppor-tunes. La Cour va rendre l'ordonnance fixant le délai ainsi prévu.
