Dear Fellow Conservative,

The American Conservative Union Foundation is proud to present our ratings for the first session of the 115th Congress. Now in its 47th year, our Congressional Ratings reflect how elected officials view the role of government in an individual’s life. We begin with our philosophy (conservatism is the political philosophy that sovereignty resides in the person) and then apply our understanding of government (its essential role is to defend life, liberty and property).

Because our ratings are designed to educate the public about how consistently their elected officials adhere to conservatism, we do not announce in advance which bills we will score. Rather, we carefully examine the entire docket of legislation to select the most meaningful votes and then publish the results after the dust has settled.

The 2016 election dramatically impacted the political landscape of Washington, giving Republicans control of all three branches of government for the first time in over a decade. With these victories comes the ability to implement policies that restore individual liberty and return us to a limited form of government run by and for “We the People.”

This year’s Congressional ratings included monumental votes on issues such as tax reform, Obamacare, and the confirma-tion of Neil Gorsuch to the Supreme Court. Members of Congress who held firm during these historic votes have received double credit for upholding conservative principles.

It is our hope that these ratings will serve as a guide showing who you can rely on to fight for conservative principles and restore the role of government to what our nation’s founding fathers envisioned.

SELECTING THE VOTES

ACU researched and selected a range of bills before Congress that determine a member’s adherence to conservative principles. We selected bills that focus on Ronald Reagan’s philosophy of the “three-legged stool”: 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) National Security: preserving our nation’s security by maintaining a strong national defense.

The wide range of issues covered are designed to give citizens an accurate assessment of how Members of Congress best defend the principles of a free society: Life, Liberty, and Property.

The votes selected by the ACU are not always considered the “most important” votes; instead, the selected votes we score help reflect the ideological distinctions among our elected officials.onservatives and the public – in an unbiased, transparent manner – on where individual members of Congress fall on the ideological spectrum.

1. S Con Res 3 Conservative Budget Proposal (Roll Call 3). The Senator Rand Paul (R-KY, 96% ACU LIFE) amendment to the Fiscal Year 2017 budget resolution presents a conservative budget alternative that balances the budget in five years, freezing federal spending while allowing congressional appropriations committees to decide where the spending would be cut. ACU supports proposals to tackle the massive annual deficit and a national debt that has grown to over 20 trillion dollars and supported this amendment. The Senate defeated the amendment on January 9, 2017 by a vote of 14-83.

2. PN 37 Confirmation of Elisabeth “Betsy” DeVos (Roll Call 54). This vote is to confirm the nomination of Betsy DeVos as Secretary of Education. ACU supported the confirmation of Devos, who has been a champion of school choice and less federal regulation of local schools. The Senate voted to confirm the DeVos nomination on February 7, 2017 by a vote of 50-50 with Vice President Mike Pence (99.6% ACU LIFE) voting “Yes” to break the tie.

3. PN 54 Confirmation of Mick Mulvaney (Roll Call 68). This vote is to confirm the nomination of Mick Mulvaney (97.8% ACU LIFE) as Director of the Office of Management and Budget. ACU supported the confirmation of Mulvaney, who, as a member of Congress, compiled a spectacular lifetime ACU rating and has been a leader in efforts to reduce government regulation and government spending. The Senate voted to confirm the Mulvaney nomination on February 16, 2017 by a vote of 51-49.

4. PN 44 Confirmation of Scott Pruitt (Roll Call 70). A key vote on the confirmation of Scott Pruitt as Director of the Environmental Protection Agency came on a motion to extend debate indefinitely on the nomination. ACU supported the confirmation of Pruitt, who, as Attorney General of Oklahoma, was a nationwide leader in fighting the Obama Administration’s attempt to bypass Congress and initiate a federal takeover of the nation’s electric power system and control privately owned land through the Waters of the United States rule and so opposed this motion. The Senate defeated the motion on February 17, 2017 by a vote of 47-51.

5. HJ Res 44 Federal Land Management Regulations (Roll Call 82). This resolution invokes the Congressional Review Act to overturn an Obama Administration rule that weakens state and local citizen participation as well as the legislative branch of government in federal land management decisions. ACU supports strengthening local input over land management regulation, reducing the power of unelected bureaucrats in the executive branch, and supported this resolution. The Senate passed the resolution on March 7, 2017 by a vote of 51-48.

6. HJ Res 57 Federal Control of Local Schools (Roll Call 84). This resolution invokes the Congressional Review Act to overturn an Obama Administration rule that micromanages how states and local school districts meet the accountability standards set in the omnibus education bill of 2015. ACU opposes federal control over local education and supported this resolution. The Senate passed the resolution on March 9, 2017 by a vote of 50-49.

7. SJ Res 34 FCC Privacy Rule (Roll Call 94). This resolution invokes the Congressional Review Act to overturn an Obama Administration rule that mandates how internet service providers can store and use information from customers. ACU opposes executive agency mandates that ought to be handled through congressional legislation and, as with other Obama Administration rules, exempt companies such as Google and Facebook from similar regulation, and supported this resolution. The Senate passed the resolution on March 23, 2017 by a vote of 50-48.

8. HJ Res 43 Planned Parenthood Funding (Roll Call 101). This resolution invokes the Congressional Review Act to overturn an Obama Administration rule that forces states to send taxpayer funds for “family planning,” known as Title X funds, to Planned Parenthood. ACU believes abortion is a human tragedy and opposes sending taxpayer funds to organizations that perform abortions, such as Planned Parenthood, and supported this resolution. The Senate passed the resolution on March 30, 2017 by a vote of 50-50 with Vice President Mike Pence (99.6% ACU LIFE) voting “Yes” to break the tie.

9. PN 55 Lowering the Threshold for the Confirmation of Neil Gorsuch to the U.S. Supreme Court (Roll Call 109). The pivotal vote on the confirmation of Neil Gorsuch came on this motion to change the rules of the Senate that required a supermajority of 60 votes to end debate and allow a simple majority of Senators to end debate. ACU supported the nomination of Gorsuch, who compiled an outstanding record on the federal bench in following the conservative principles of the late Antonin Scalia, who he was named to replace, and so supported this motion. The Senate voted against approving the decision of the liberal Senate parliamentarian that 60 votes were required on April 6, 2017 by a vote of 48-52. (A “No” vote supported the ACU position). This vote was double-weighted due to the monumental role it played in shaping the U.S. Supreme Court.

10. HJ Res 36 Federal Control Over Methane Emissions (Roll Call 125). This resolution invokes the Congressional Review Act to overturn an Obama Administration rule that puts controls on methane emissions from oil and gas drilling on federal lands. ACU opposes these regulations without congressional authorization that drive up the cost of oil and gas to promote a global warming agenda and supported this resolution. The Senate defeated the resolution on May 10, 2017 by a vote of 49-51.

11. HR 1628 Obamacare Repeal Bill of 2015 (Roll Call 169). This amendment to the House-passed bill to repeal and replace Obamacare contains the bill passed by Congress but vetoed by President Obama in 2015. It repeals major portions of Obamacare, including penalties for not buying government-approved health insurance, Medicaid expansion to able-bodied childless adults, and subsidies to buy insurance through government controlled exchanges. The bill also prevents Planned Parenthood from receiving much of its federal funding for one year. ACU supports the repeal of Obamacare, which has caused millions of Americans to lose their insurance plan and their doctor while dramatically increasing premiums and deductibles and supported this amendment as the most that can be accomplished under Senate rules. The Senate defeated the amendment on July 26, 2017 by a vote of 45-55. This amendment is double-weighted due to the fact six Senators changed their vote from “yes” to “no” because, unlike the vote in 2015, this vote would have been signed into law.

12. PN 89 Confirmation of Ajit Pai (Roll Call 208). This vote is to confirm the nomination of Ajit Pai as Chairman of the Federal Communications Commission. ACU supported the nomination of Pai, who compiled an outstanding record as a member of the FCC, supporting free market principles and keeping the internet free of federal control. The Senate confirmed the nomination on September 28, 2017 by a vote of 55-41.

13. H Con Res 71 Spending Cuts (Roll Call 236). The Senator Rand Paul (R-KY, 96% ACU LIFE) amendment to the Fiscal Year 2018 Budget Resolution reduces discretionary spending by $43 billion. ACU supports reasonable spending reductions at a time of annual deficits heading back to $1 trillion and a national debt of over $20 trillion and supported this amendment. The Senate defeated the amendment on October 19, 2017 by a vote of 5-95.

14. H Con Res 71 Payment in Lieu of Taxes Funding (Roll Call 239). The Senator Tom Udall (D-NM, 3.8% ACU LIFE) amendment to the Fiscal Year 2018 Budget Resolution calls for the permanent funding of the Payment in Lieu of Taxes program that “reimburses” states for “lost” revenue due to the federal government ownership of land. The program is currently subject to the annual appropriation process. ACU opposes tactics that force taxpayers in other states to pay for “lost” revenue and opposed this amendment. The Senate passed the amendment on October 19, 2017 by a vote of 58-41.

15. H Con Res 71 Allowing for a Larger Tax Cut (Roll Call 241). The Senator Rand Paul (R-KY, 96% ACU LIFE) amendment to the Fiscal Year 2018 Budget Resolution increases the total tax cut to $2.5 trillion over ten years from $1.5 trillion over ten years. ACU supports this increase when combined with mandatory and discretionary spending reductions and supported this amendment. The Senate defeated the amendment on October 19, 2017 by a vote of 7-93. This amendment was double-weighted due to the impact it would have had in reducing all American’s taxes.

16. H Con Res 71 Drilling in ANWR (Roll Call 243). The Senator Maria Cantwell (D-WA, 8.8% ACU LIFE) amendment to the Fiscal Year 2018 Budget Resolution eliminates the provision that will allow drilling for oil and natural gas in a small portion of the Alaska National Wildlife Refuge. ACU supports increasing domestic energy production to provide affordable energy for all and opposed this amendment. The Senate defeated the amendment on October 19, 2017 by a vote of 48-52.

17. HJ Res 111 Federal Control Over Private Contracts (Roll Call 249). This resolution invokes the Congressional Review Act to overturn an Obama Administration rule that prohibits private contracts that require arbitration to settle disputes. ACU supports the right of private citizens to decide what contracts they sign and to use arbitration to avoid costly litigation without the interference of the federal government and supported this resolution. The Senate passed the resolution on October 24, 2017 by a vote of 50-50 with Vice President Mike Pence (99.6% ACU LIFE) voting “Yes” to break the tie.

18. HR 1 Education Savings Accounts (Roll Call 298). The Senator Ted Cruz (R-TX, 99% ACU LIFE) amendment empowers parents to choose the best schools for their children by expanding 529 savings accounts to elementary and secondary school education as well as homeschool students. Currently, they can only be used for higher education. ACU supports the expansion of school choice and supported this amendment. The Senate passed the amendment on December 1, 2017 by a vote of 50-50 with Vice President Mike Pence (99.6% ACU LIFE) voting “Yes” to break the tie.

19. HR 1 Taxing College Endowments (Roll Call 302). The Senator Jeff Merkley (D-OR, 3.2% ACU LIFE) amendment to the comprehensive tax reform bill reinstated a tax on college endowments for institutions that refuse to accept federal funds. ACU believes colleges should be encouraged to refuse federal funds, rather than be penalized for it and opposed this amendment. The Senate passed the amendment on December 2, 2017 by a vote of 52-48.

20. HR 1 Comprehensive Tax Reform (Roll Call 323). This bill substantially reduces taxes on corporations and small business, reduces individual income tax rates from top to bottom, increases the standard deduction for individuals and the exemption for the Death Tax and repeals Obamacare’s individual mandate beginning in 2019. Although the bill does not include provisions advocated by ACU, including simplifying the tax code, abolishing the Death Tax and abolishing the Alternative Minimum Tax, ACU supported the bill as a good first step in passing more comprehensive tax reform. The Senate passed the bill on December 20, 2017 by a vote of 51-48. This vote was double-weighted due to its impact in expanding the overall American economy.

21. HR 1370 Automatic Spending Reductions (Roll Call 324). This procedural motion allows the Senate to ignore the automatic spending reductions that go into effect because the Continuing Resolution to fund the federal government through January 19 busts the budget caps. ACU opposes busting the budget caps that have served as the only break on spending increases that have added to our national debt of over $20 billion and opposed this resolution. The Senate passed the resolution on December 21, 2017 by a vote of 91-8.

1. HR 7 Taxpayer-Funded Abortions (Roll Call 65). This bill prohibits federal funds, including funds in the District of Columbia budget, from being used for abortions and prohibits health insurance plans that include federal subsidies from coverage of abortions. Exceptions are made for rape, incest and the life of the mother. ACU believes abortion is a human tragedy, supports restrictions on the process and educating patients, and supported this bill. The House passed the bill on January 24, 2017 by a vote of 238-183.

2. HJ Res 36 Federal Control Over Methane Emissions (Roll Call 78). This resolution invokes the Congressional Review Act to overturn an Obama Administration rule that puts controls on methane emissions from oil and gas drilling on federal lands. ACU opposes these regulations without congressional authorization that drive up the cost of oil and gas to promote a global warming agenda and supported this resolution. The House passed the resolution on February 3, 2017 by a vote of 221-191.

3. HJ Res 57 Federal Control of Education (Roll Call 84). This resolution invokes the Congressional Review Act to overturn an Obama Administration rule that reinstates federal control over state accountability plans under the new education act. ACU opposes this attempt to use federal funds to pressure states into agreeing to federal mandates and supported this resolution. The House passed the resolution on February 7, 2017 by a vote of 234-190.

4. HJ Res 43 Planned Parenthood Funding (Roll Call 99). This resolution invokes the Congressional Review Act to overturn an Obama Administration rule that forces states to send taxpayer funds for “family planning,” known as Title X funds, to Planned Parenthood. ACU believes abortion is a human tragedy and opposes sending taxpayer funds to organizations that perform abortions, such as Planned Parenthood, and supported this resolution. The House passed the resolution on February 16, 2017 by a vote of 230-188.

5. HR 985 Tort Reform (Roll Call 148). This bill reforms the laws that govern class action lawsuits to make sure that these lawsuits truly represent a “class” of people who have suffered the same injury. Among other provisions, it requires certification that no relatives or former employees or clients of counsel are involved, limits attorney fees and requires proof that those represented have actually agreed to participate. ACU supports reform of class action lawsuits that are often more for the benefit of attorneys than clients and supported this bill. The House passed the bill on March 9, 2017 by a vote of 220-201.

6. SJ Res 34 FCC Privacy Rule (Roll Call 202). This resolution invokes the Congressional Review Act to overturn an Obama Administration rule that mandates how internet service providers can store and use information from customers. ACU opposes executive agency mandates that are properly handled through congressional legislation and, as with other Obama Administration rules, exempts companies such as Google and Facebook from similar regulation, and supported this resolution. The House passed the resolution on March 28, 2017 by a vote of 215-205.

7. HR 1628 Obamacare Repeal (Roll Call 256). This bill repeals major parts of Obamacare over a period of time, including capping Medicaid expansion, to primarily able-bodied childless adults and ending the expansion in 2020 while defunding Planned Parenthood for one year. The bill still keeps some insurance mandates while allowing more requests for waivers from mandates that force less risky customers to pay higher premiums to subsidize more risky customers. ACU supports the complete repeal of a program that has caused millions of people to lose their insurance plans and their doctors while dramatically increasing insurance premiums and deductibles and supported this bill as a step in the right direction. The House passed the bill on May 4, 2017 by a vote of 217-213. This vote was double-weighted due to its role in attempting to dismantle Obamacare.

8. HR 10 Dodd-Frank Banking Regulation Repeal (Roll Call 299). This bill repeals much of the Dodd-Frank banking regulation act, removing draconian regulations on community banks, eliminating “too big to fail” provisions on large banks, ending government guarantees to bail out banks’ bad debt and simplifying regulations for small businesses. The bill also replaces the Consumer Financial Protection Bureau (CFPB) with the Consumer Law Enforcement Agency with a director who serves at the pleasure of the president and is subject to the congressional appropriation process. ACU supports the reform of these laws and the rogue CFPB that have combined to stifle small business loans and impose regulations at the whim of the CFPB Director and supported this bill. The House passed the bill on June 8, 2017 by a vote of 233-186.

9. HR 3003 Sanctuary Cities (Roll Call 342). This bill prohibits state and local governments from interfering with federal and other state or local officials who are trying to carry out the nation’s immigration laws. Under the bill, authorities cannot be prevented from asking about a person’s immigration status and certain Justice Department grants can be withheld from those who do not comply with requests for cooperation. ACU supports the enforcement of federal immigration laws and supported this bill. The House passed the bill on June 29, 2017 by a vote of 228-195.

10. HR 2810 Nadler Amendment Closing Guantanamo (Roll Call 359). The Congressman Jerrold Nadler (D-NY, 2.7% ACU LIFE) amendment to the National Defense Authorization Act would allow the transfer of terrorist detainees at Guantanamo to the United States. ACU opposes closing Guantanamo and bringing terrorist detainees to the U.S. and opposed this amendment. The House defeated the amendment on July 13, 2017 by a vote of 167-257.

11. HR 2810 Military Base Closings (Roll Call 365). The Congressman Tom McClintock (R-CA, 98.7% ACU LIFE) amendment to the National Defense Authorization Act removes provisions of the bill that prevent the military from conducting a round of base realignments and base closings. ACU supports efforts to realign our military bases with changing requirements and supported this amendment. The House defeated the amendment on July 13, 2017 by a vote of 175-248.

12. HR 2810 Wasteful Military Spending (Roll Call 367). The Congressman Ken Buck (R-CO, 98.7% ACU LIFE) amendment to the National Defense Authorization Act requires the Department of Defense to complete a cost effectiveness analysis ensuring that the Department of Defense does not purchase alternative fuels unless they are as cost effective as traditional fuels. ACU opposes wasting millions of taxpayer dollars on expensive fuel to carry out a politicized global warming agenda and supported this amendment. The House defeated the amendment on July 13, 2017 by a vote of 203-218.

13. HR 2810 Taxpayer Funded Sex Change Operations (Roll Call 369). The Congressman Vicki Hartzler (R-MO, 79.5% ACU LIFE) amendment to the National Defense Authorization Act prevents taxpayer funds from being used for sex change operations in the military. ACU opposes taxpayer funds being used for elective or cosmetic procedures and supported this amendment. The House defeated the amendment on July 13, 2017 by a vote of 209-214.

14. HR 3219 Private Competition for Government Contracts (Roll Call 433). The Congressman Matt Cartright (D-PA, 7% ACU LIFE) amendment to the Defense Department Appropriations bill bars the government from allowing a public-private competition for government contracts. ACU supports more public-private competition and opposed this amendment. The House passed the amendment on July 27, 2017 by a vote of 253-172.

15. HR 3354 Rural Air Service Subsidies (Roll Call 447). The Congressman Tom McClintock (R-CA, 98.7% ACU LIFE) amendment to the Transportation and Housing and Urban Development Appropriations bill eliminates $150 million in funding for a program that subsidizes air service to rural airports with little passenger traffic and applies the funds to deficit reduction. ACU opposes this wasteful spending on mostly short distance air service to destinations easily accessible by car or bus and supported this amendment. The House defeated the amendment on September 6, 2017 by a vote of 140-280.

16. HR 3354 Defunding Amtrak (Roll Call 449). The Congressman Mo Brooks (R-AL, 90.3% ACU LIFE) amendment to the Transportation and Housing and Urban Development Appropriations bill eliminates subsidies to Amtrak, which receives over $400 million in subsidies and loses over $200 million in taxpayer funds each year. ACU opposes funding for a program that was supposed to be self-sufficient by 2009 and supported this amendment. The House defeated the amendment on September 6, 2017 by a vote of 128-293.

17. HR 3354 Repeal of Davis Bacon Act (Roll Call 453). The Congressman Steve King (R-IA, 92% ACU LIFE) amendment to the Department of Transportation and Housing and Urban Development appropriations bill prohibits using funds to enforce the prevailing wage provisions of the Davis-Bacon Act, a Depression-era price control measure. ACU opposes artificial wage requirements that drive up the cost of projects and supported this amendment. The House defeated the amendment on September 6, 2017 by a vote of 180-241.

18. HR 3354 Reduced Federal Spending (Roll Call 481). The Congressman Marsha Blackburn (R-TN, 95.7% ACU LIFE) amendment to an omnibus appropriations bill provides for an across-the-board one percent spending reduction. ACU supports this modest effort at reducing spending to help shrink the deficit and supported this amendment. The House defeated the amendment on September 8, 2017 by a vote of 156-248.

19. HR 3354 Funding for the EPA Criminal Enforcement Division (Roll Call 482). The Congressman Gary Palmer (R-AL, 100% ACU LIFE) amendment to the Department of the Interior Appropriations bill prohibits funding for the Environmental Protection Agency’s Criminal Enforcement Division. The ACU Foundation’s Center for Criminal Justice Reform engages heavily on issues such as this leading to over-criminalization. ACU opposes the EPA’s misuse of this division which has conducted armed raids of the Gibson Guitar Company with no charges forthcoming, and supported this amendment. The House defeated the amendment on September 8, 2017 by a vote of 178-227.

20. HR 3354 Spending Increase for the Manufacturing Extension Partnership (Roll Call 493). The Torres (D-CA, 1.2% ACU LIFE) amendment to the Omnibus Appropriations bill increases spending for the Manufacturing Extension Partnership, a program that uses taxpayer funds and fees to act as a business consultant to American manufacturing companies. ACU opposes this wasteful program that has seen American manufacturing shrink by one-third since the program’s inception in 1988 and opposed this amendment. The House passed the amendment on September 13, 2017 by a vote of 279-137.

21. HR 36 Late Term Abortion Restrictions (Roll Call 549). This bill prohibits abortions when the probable age of the fetus is 20 weeks (five months) or longer with exceptions for rape, incest or the life of the mother. ACU believes abortion is a human tragedy, supports educating patients and restricting the practice and supported this bill. The House passed the bill on October 3, 2017 by a vote of 237-189.

22. H Con Res 71 Conservative Budget Proposal (Roll Call 555). The Congressman Tom McClintock (R-CA, 98.7% ACU LIFE) amendment to the Budget Bill for Fiscal Year 2018 implements the House Republican Study Committee budget proposal, also known as the conservative budget. Among other provisions, the proposal balances the budget in five years, caps discretionary spending, reforms entitlements, including combining Medicaid and the Children’s Health Insurance Program (CHIP) into a single block grant, reforms Medicare to keep it solvent and helps preserve Social Security by increasing the retirement age beginning in 2022. ACU supports these proposals that tackle our long-term debt and bankrupt entitlement programs others have refused to deal with and supported this amendment. The House defeated the amendment on October 5, 2017 by a vote of 139-281.

23. HR 38 Concealed Carry Reciprocity (Roll Call 663). This bill requires states to recognize concealed carry permits held by qualified people from other states while at the same time strengthening reporting requirements by federal agencies of those barred from purchasing firearms. ACU supports the founder’s belief in the Second Amendment and supported this bill. The House passed the bill on December 6, 2017 by a vote of 231-198.

24. HR 1 Comprehensive Tax Reform (Roll Call 692). This bill substantially reduces taxes on corporations and small business, reduces individual income tax rates from top to bottom, increases the standard deduction for individuals and the exemption for the Death Tax and repeals Obamacare’s individual mandate beginning in 2019. Although the bill does not include provisions advocated by ACU, including simplifying the tax code, abolishing the Death Tax and abolishing the Alternative Minimum Tax, ACU supported the bill as a good first step in passing more comprehensive tax reform. The House passed the bill on December 19, 2017 by a vote of 227-203. This vote was double-weighted due to its impact in expanding the overall American economy.

25. HR 4667 Disaster Assistance Supplemental Appropriations (Roll Call 709). This bill appropriates $81 billion in “emergency” funding with no offsets to deal with disaster assistance for hurricanes and fires. ACU opposes this irresponsible approach to disaster funding that is double the Trump Administration request, includes billions of dollars that will not be spent for years to come and includes money for cotton producers that were not affected by natural disasters and opposed this bill. The House passed the bill on December 21, 2017 by a vote of 251-169.
