PRE-QUALIFICATION CONDITIONS FOR TECHNICAL BID:

01 Tenderers are required to submit their offers in two separate parts i.e. Technical bid & price bid. The technical bid should cover all the technical requirements / supporting documents as mentioned in schedule - A.

02 The tenderers must quote their rates per unit specified in figures as well as in words. Any revision in the offered rates, specifications, terms & conditions etc shall not be allowed on any ground such as mistake, misunderstanding, typographical mistake etc. after submission of tender offer

03 AddressingTender: Tenders must be submitted in envelopes which must be properly sealed by the tenders with their office seals and must be super scribed with the Tender No WT-________, its description as per Schedule - B, whether Technical Bid or Price bid, and the date of opening of the tender. Tenders will be submitted by RPAD / Speed post only. Tenders submitted by other means will not be accepted / considered Time of Tender Submissions: It is the responsibility of the tenderers to see that the tenders are received by the corporation’s office within the stipulated date and time. Validity of Tender: All tender offers against this contract shall be valid for acceptance for a period of 120 days from the date of opening of the offers.

04 Contractor has to produce following documents along with Technical Bid. a. Copy of past work order executed by party in reputed organization. b. Copy of separate P. F. Code Number & PAN Number. c. Service tax Registration certificate. d. Schedule-A, Schedule-B (without quoting rates), Terms & conditions duly signed on

each page, deviation if any clearly are brought out. e. Required vehicle model (first registration) should be April 2016 & onwards, the proof

of the same should be submitted along with Technical-Bid. If contractor will provide new vehicle in this condition it should be mention clearly in tender document.

05 The offer without any of the above documents or non acceptance of any clause shall be

liable for rejection in this regard the decision of The Chief Engineer (Gen), Ukai, TPS shall be final & binding to bidder.

06 Tenderer should also certify that the tender submit ted is unconditional tender and specifically remarks “Unconditional Tender” on cover itself.

INSTRUCTION TO BIDDER:

01 Earnest Money Deposit @ 01% of estimated cost which will be accepted by crossed demand draft on Bank of Baroda / SBI, Ukai Branch in favour of GSECL.

02 EMD and Tender Fees Paid MR No / D.D No and Amount Paid should be clearly indicated on technical bid without which technical bid will not be opened.

03 Each bid duly offered in sealed super scribed with tender number and due date of opening shall be received by RPAD/ Speed post. The GSECL will not take any responsibility of the bids not received on or before due date of submission by RPAD/Speed post.

04 The undersigned reserves the right to accept/ reject any or all bids without assigning any reason thereof.

05 Any alteration/ addition/ deletion will not be considered after opening of bids, unless called for by the GSECL for negotiations.

06 Price Bids of only those offers who qualify in Technical Bid shall be opened and no dispute shall be entertained in this regards.

07 Subletting of bids is not permitted, however sub-contracting is permitted with the consent of The Chief Engineer (Gen.), GSECL Ukai.

08 The tender is to be submitted in sealed envelope with tender number, name of work, due date of opening, DD of EMD and tender fee. same shall be received by RPAD/Speed post only.

09 The bids will be opened in the presence of bidders who wish to remain present at the time of date of opening of the bids.

10 Service or Any Other Taxes-Applicable - must be mentioned in PRICE BID ONLY and if mentioned in Technical Bid or elsewhere is liable to be IGNORED.

SCHEDULE- A

Name of work :- Providing of 11 Nos. ( 09 non-AC Mahindra Bolero or Tata or any equivalent make + 02 AC TATA make sumo) closed body Jeep having seating capacity of 8+1 seats on hire basis for for 730 Days (24 Months) to GSECL TPS Ukai.

General Specification and scope of work for contrac t. (1) The rates are invited for diesel driven vehicles only. The rates are inclusive cost of

Diesel, Oil, Salary of Drivers & other expenditures like repair maint, Tyre / Tubes, Road tax, Insurance, PUC, Passenger tax, as per Motor Vehicle Act 1988, Rules 66, Vehicle contract Carriage permits as & when Competent Authority desires to see all type of document.

(2) Contractor shall have to provide total 11 nos of jeeps (09 non AC + 02 AC ) having seating Capacity of 8+1 seats. Model of provided vehicles must be of year April 2016 or afterwards. Vehicle” means the above named vehicles in neat and absolute working condition and of the year of First Registration not earlier than Year April 2016 . The vehicle so referred should be registered for MAXI operation, duly insured and taxes paid up to dates and to be provided with the services of “DRIVER”(s).The vehicles must be MAXI passing with total comprehensive insurance of drivers plus passengers. It is sole responsibility to renewal of insurance policy of the contractor.

(3) The contractor should have to offer for Eleven jeeps, otherwise offer shall not be considered. Out of 11 nos of jeep, contractor shall have to provide 09 Mahindra ‘Bolero’ or Tata or any equivalent makes closed body jeep & 02 nos AC TATA Sumo Jeep.The contractor should provide Eleven Jeeps on his own name However if there are any partner in that case Contractor have to submit power of attorney of that vehicle before commencement of work. No sub contract is allowed. As per GSECL rules, employee of GSECL, employee of associated organization or their close relatives shall not participate for this contract either direct, indirect or giving the Power of Attorney.

(4) The Tenderer must have the P.F.code number & he has to submit copy of P.F. challan along with his bill a statement regarding deduction against employee’s provident fund and Family Pension Scheme in respect of each concerned employees. The contractor’s contribution and his workers contribution towards provident fund and family pension scheme shall be deposited by the contractor to P.F. authority.

(5) Contractor has to produce Xerox copy of comprehensive insurance, Passenger Tax / Service Tax paid receipt , ECR copy shall have to be submitted with every running bill.

(6) Vehicles shall be in tip top condition furnished with all the basic necessities with good quality cushioned seats, lockable doors and with flap windows, suitable for all weather travel. The vehicles are to be used by officers of the GSECL & therefore the same shall be fitted to their status.

(7) The rates are inclusive of Driver. Drivers of all vehicles shall be employees of Contractor.The contractor shall fulfill the requirement of current labour act. Minimum

wage act, Labour compensation Act, PF Act, Bonus Act Overtime etc & its latest amendments. The Drivers provided on vehicle must be well dressed as per RTO rules. The Drivers must be well mannered, well behaved. The Drivers shall be experienced and shall have valid driving license.

(8) The “DRIVER” shall mean paid driver of the contractor provided on the hired vehicle and possession of valid professional driving license.

(9) MODEL OF THE VEHICLE (s) under this tender means the year of its first registration. Required vehicle model (first registration) should be April 2016 & onwards ,the proof of the same should be submitted along with Technical-Bid. If contractor will provide new vehicle in this condition it should be mention clearly in tender document.

(10) Vehicle offered by the contractor shall be neat and absolute working condition fully road worthy, duly registered with R.T.O., all taxes paid, comprehensively insured covering the risk of all Officers/ staff and families of GSECL, traveling in the vehicle. The vehicle should have valid MAXI permit to run on the roads / in the states covered under GSECL’s operations under this contract and should be equipped with sufficient tools and spares for repairs to be carried out through route.

(11) All the 11 hired vehicle shall be required for 24 hrs daily duty for O&M purpose of various departments of TPS/HPS. e.g OT calling /Tiffin Collection/ line Patrolling duty /Shipment of men & light material/CISF Use etc. Vehicle will be used & operated on motorable Kaccha/ Pakka Road. If required vehicle will be used to shift/carry GSECL’s light weight material /Goods up to 500 Kgs. along with personnel.

(12) For smooth operation of the vehicle round the clock, the contractor has to depute adequate number of drivers and to regulate their duty hours as per Labour Laws including contract Labour Act (Regulation & Abolition), payment of Wages Act, Minimum Wages Act, Factories Act, Employer’s PF Act and Misc. Provision Act etc. to provide smooth and uninterrupted services.

(13) The contractor shall make his own arrangement for the stay of his staff including halt at any location at his own risk and cost and also for repairs, fueling etc, of the hired vehicle as per requirement.

(14) The hired vehicle shall be provided by the contractor with well behaved drivers, in possession of valid driving license. The drivers should be skilled, who can read & understand Gujarati or Hindi. In case the driver is not well behaved or is not skilled in driving, the contractor will have to change the driver immediately, failing which GSECL reserves the right to refuse the vehicle for duty and penalty will be imposed as per SCH-A, clause no-29(II). Decision of Chief Engineer (Gen), GSECL, Ukai in this respect shall be final and binding to the contractor.

(15) For the purpose of day-to-day and time-to-time operations, instructions shall be given by the authorized representative of GSECL which shall be followed by the contractor.

(16) For advance planning and proper coordination of operations, the contractor shall nominate his representative / supervisor who should be available on call at GSECL’s, Ukai office. A Contact telephone number (Mobile Number) should be made available

for this purpose while signing the contract. The successful bidder must have their liaison office at Ukai for day to day coordination and smooth operation of the hired vehicles. With Vehicle there should be a unique mobile phone in on and in service condition.

(17) Driver (s) deployed by the contractor on the hired vehicle for the duty of GSECL shall be required to go to various places and as such they should be well conversant with the routes and roads of the area. The contractor should keep continuity in deployment of drivers on the vehicle and frequent change of driver(s) shall not be allowed normally.

(18) Vehicle must be equipped with small fire extinguisher, first aid box, Spark arrestor as per ISO norms, tool kit & spare wheel. All vehicles must be equipped with good stereo system. Seats of jeep must be covered by suitable/comfortable seat covers.

(19) The vehicle shall be kept in good running condition at all times. Procurement of fuel, lubricants, spares etc. will be arranged by the contractor at his own cost. Routine maintenance, repair, frequent checks up servicing, overhauling, payments of wages to drivers will be Contractor’s liability.

(20) As per recommendation of authorized servicing station time to time servicing/ maintenance of contractual vehicle shall be carried out. If vehicle will send to repair, alternative vehicle will be arranged by contractor if not so penalty will be deducted as per clause 29.

(21) In case of major break down or withdrawal of Vehicle from services by the contractor on account of maintenance or for any reason whatsoever, the contractor shall immediately replace the same by another serviceable vehicle duly app roved by the EIC. Withdrawal of vehicle shall be done with prior intimation and consent. Penalty as per Schedule-A clause No-29(II)-d will be imposed if the substitute vehicle is of lower model or lower capacity. Substitute vehicle of model earlier than 2013 will not be acceptable.

(22) No penalty will be imposed by GSECL in case the substitute vehicle provided by the contractor is of higher capacity & better and above year model.

(23) DOCUMENTS AND STATUTORY RESPONSIBILITY:

a) The vehicles asked for under this tender should be fit in all respect for use in accordance with Motor Vehicle Act and rules and existing laws as amend from time to time. The vehicles(s) must be equipped with valid documents, i.e., Registration Book, PUC certificate, Insurance Certificate, Fitness Certificate, route Permit and with all taxes, fees, levies paid up to date, during the contract. The responsibility of any lapse in this regard shall be that of the contractor exclusively and GSECL stands completely indemnified by the contractor against such defaults.

b) The driver provided with vehicle(s) must be physically/medically fit, professionally

sound and legally competent in all respects, holding valid driving license as prescribed under prevailing Motor Vehicle Act and rules on the subject.

c) The contractor will be solely and fully responsible for any consequences and claims (s) arising out of any accident caused by the hired vehicle to the equipment /property /personnel of GSECL. He will also be responsible for any claim and compensation that arises due to damages /injuries sustained by any parties including his own life /injury/property caused by hired vehicle.

d) The contractor’s staff shall abide by the existing security and safety rules

/regulation/precautions as per instructions given from time to time. The contractor and his employees may also be required to pledge secrecy and non-divulgence of the nature of the work of GSECL that may prejudice the interests of GSECL. Contractor shall also ensure to engage only those persons whose character antecedents have been got verified by him .

e) The driver (s) engaged /deputed with the hired vehicle (s) by the contractor for carrying GSECL’s officers /staff shall maintain punctuality and discipline. If any person (s) engaged by the contractor is found to be undisciplined and /or is misbehaving with the GSECL’s officers /staff / representative or is under the influence of any intoxicant. GSECL may ask the contractor to replace driver forthwith otherwise the hired vehicle may not be accepted for duty to GSECL and penalty will be imposed as per clause no-29((II)-E.

f) The following documents complete in all respect shall be submitted to Engineer in charge for verifications before commencement of work.

(I) Insurance certificate covering period and other details up to date. (II) RC book with tax paid. (III) Proof of registration of the vehicle as maxi passing. (IV) Copy of license of all drivers engaged under contract.

g) The contractor shall exclusively be liable for compliance of the provisions of statutory

acts, laws, rules and regulation having bearing over engagement of workers, directly or indirectly of execution of the work. The contractor hereby undertakes to indemnify GSECL against all action, Suites, proceedings, claims, losses, damages, etc., which may arise under Industrial Laws and particular Minimum Wages Act, personnel injuries (Company Insurance Act , E.S.I. Act, Contract Labour Regulation & Abolition Act, Fatal Accident Act, Workmen Compensation Act, Shops & Establishment Act, Employees Provident Found Act, Family Pension & Deposit Linked Insurance and Pensionery Scheme or any other Act) or status not herein specifically mentioned but having any direct or indirect application for the persons engaged under this contract by him.

h) GSECL shall not be responsible for any claim / compensation that may arise due to damages /injuries pilferage to the contractor’s vehicle /property /drivers /and other staff etc., under any circumstances while a hired vehicle is engaged on GSECL’s duty.

i) The contractor shall ensure that his drivers refrain from smoking or carrying any inflammable substance etc., at the installations, camp stations, stores, yards, etc., while on duty with GSECL. The contractor’s employees shall ensure that they abide by

usual and special rules regarding the safety and security measures while on duty with GSECL as per directions of the representative of GSECL, at the work site.

j) lunch, diner Fueling, changing of driver(s) etc., shall be carried out at the cost of contractor with the permission of the user, within a reasonable minimum time period so that there is no effect to timely change of shift etc.

k) There must be an adequate arrangement /provision with driver (s) for fuel / lubricant / emergency/ contingent expenses.

l) The speedometer, kilometer recorder and other instrument /meter /must be maintained at high standard of accuracy. Any defect found by GSECL shall be rectified forthwith by the contractor. Until such rectification, the kilometer run for such distance/ places as verified and certified by the officers/staff traveling in the vehicle shall be final and binding to the contractor for the purposes of billing etc. In case of any apparent tempering of meter found in the surprise checks. 50% Kilometer run shall be reduced from monthly run kilometer from the contractor’s monthly bill, in an addition to refuse of the services of that driver / vehicle and for that an alternative vehicle / driver is to be deployed by the contractor.

m) The contractor or his employees shall ensure entries in the Logbook, which shall be supplied by contractor at their cost, are properly maintained and recorded date wise as per columns given in the logbook and are properly got signed by the driver from the user. Driver shall have to weekly submit the complete logbook to EIC for verification. No cutting is allowed in the logbooks. The responsibility of updating the logbooks will be of the driver concerned /contractor.

n) The contractor or his driver(s) shall ensure the proper recording of time and kilometer in/ out are also made by the user. In case it noticed that there is a variation and differences in the kilometers recorded in the Logbook verified by the user and the actual run, the deduction on this account shall be made by GSECL from the bill of the contractor without any reference to him. The contractor shall submit the Logbook to GSECL along with the bills.

o) The contractor (which shall include the Contracting Firm/ Company) shall be solely liable to obtain and to abide by all necessary licenses / permissions from the concerned authorities as provided under the various Labour Law Legislations including Labour License from the competent authority under the Contract Labour (Regulation & Abolition) Act-1970, ESI Act, E.P.F & Misc. Provision Act, Factory Act etc.

p) The contractor shall discharge obligations as provided under various applicable statutory enactment including the Employees provident fund & miscellaneous Provisions Act, 1952, the Employees state Insurance (ESI) Act-1948, the Contract Labour ( Regulation & abolition ) Act-1970, the Inter-State Migrant workmen ( Regulation of employment & Conditions of Service) Act-1979, the Minimum Wages Act-1948, the Payment of Wages Act-1936, the Workmen’s Compensation act-1923 and other relevant Acts, rules and Regulations enforced from time to time.

q) The contractor shall be responsible for required contribution towards P.F. pension,

ESI or any other statuary payment to be made in respect of the contract and the personnel employed for rendering service to GSECL and shall deposit these amounts on or before the prescribed dates. Every contractor shall submit the proof of depositing the employee’s and employer’s contributions. The contractor shall also be responsible to pay any administrative /inspection charges thereof, wherever applicable, in respect of the personnel employed by him for the work of GSECL as per current low of Government, contractor has to pay service tax for providing ‘Service’. Contractor has to get “Rent a Cab Operator Service” from Government & has to submit the copy of related document.

r) The contractor shall indemnify the Company against all losses or damages, if any, caused to it on account of acts of the personnel deployed by him.

24. TERMINATION: GSECL may, without prejudice to its right against the contractor in respect of any delay

or otherwise or any claims for damage, in respect of any breach of the terms of the contract and without prejudice to any rights or remedies under any of the provisions of this contract or otherwise, by notice in writing absolutely terminate the contract with immediate effect in any of the following case:

a. In the event of the contractor going into liquidation or winding up his business or

making arrangement with his creditors, GSECL shall have the right to terminate contract without prejudice to any other rights /remedies.

b. In the event, if it is found that contract has been procured by submitting incorrect or incomplete statements by the contractor or by marking any misrepresentation.

c. If in the opinion of GSECL, the contractor has delayed or suspended the execution of work, the facilities and vehicles etc., offered by the contractor to be inadequate for effective completion of the job.

d. In the event of any breach of the terms and conditions of the contract by the contractor or if the contractor is found to be indulging in activity subversive to GSECL’s interest or activity prejudicial to the interests of GSECL and for any other good or sufficient reasons.

e. Up to such termination of the contract the security Deposit/Bank Guarantee are liable to be forfeited/ invoked to satisfy the outstanding claims of GSECL. Notwithstanding anything contained above, GSECL may, as its sole discretion, terminate this Contract by giving the contractor 15 days written notice to the effect, without assigning any reasons whatsoever. Security deposit will be forfeited in case of termination of contract due to poor performance by the contractor. The contract shall be deemed to have expired on expiry of the original period of two years unless extended.

25. During the currency of the contract, GSECL can order increase/ decrease in the number of vehicles on the same rates, terms and conditions as stipulated in the contract and same shall be obligatory and binding on the contractor to execute any

such order.

26. INSURANCE: Hired vehicles should be fully / comprehensively insured by the contractor at his own

cost for all risks including strike and riots. All liabilities whatsoever arising out of the accidents of the hired vehicle shall rest upon the contractor only and GSECL shall stand indemnified. The rates quoted shall be “COMPOSITE & FIRM” and shall remain unchanged during currency of the contract including the extended period except Fuel hike. Fuel hike calculation will be done as detailed below.

27. FUEL HIKE: • Any increase / decrease in monthly rates shall be considered for fuel consumption

under fixed monthly run. For Fuel rates Hike, rates of CPM/ Songadh patrol pump shall be the base for any difference of hike. The prevailing diesel rate at the date of opening of tender technical bid shall be considered as base price for Diesel price escalation.

• Formula for considering price variation – No price variation will be payable on cost of

Oil, Tyres, Tubes etc. Only charges in price of Diesel will be adjustable. You must quote prices on the basis of prevailing 15 days before the due date of tender. This basic rate shall be indicated in this offer. For every Ten Paise increase/decrease in price of fuel per KM payable/deductable price shall go up/down by One Paisa. This will be applicable to the actual KM traveled during the month.

• Any increase / decrease in fuel prices shall come into force from the next day and

shall be based on CPM / Songadh rates.

28. FINANCIAL CAPACITY OF BIDDER Contractor must have financial capacity to continue their services at least for two Months in case their payments from GSECL have been held up on any account / unforeseen reasons and no claim / interest will be entertained on this account.

29. PENALTY :

I. Proof of having paid all taxes, insurance etc. shall be furnished by the Contractor along with the monthly bill for each vehicle. In the absence of the copy of proof of payment of taxes as required for operating the vehicle as MAXI, a sum of Rs.5000.00 per month per vehicle shall be deducted from the contractors’ bills. Drivers driving the vehicles should have valid driving license, shall be well dressed and good mannered having full knowledge/idea about road, place & traffic rules etc. No driver shall be deployed below the age of 21 Years and not more than 55 Years.

II. (A) In case of any breakdown maintenance, accident, etc. contractor will have to arrange alternate vehicle at the required point. In case, the alternate vehicle fails to turn up on the day of the duty immediately, a penalty of Rs.200 /- per hour will be deducted till alternate vehicle is put into service on that day from next day penalty will be as per clause (B).

(B) After accidental, breakdown day and any reason if contractor fail to arrange alternate/same vehicle, from next day penalty of Rs.3000/- per day will be deducted. (A Fix day charge of absent day should not be given and penalty Rs. 3000/- is additional). Party must have submitted relevant document of alternate vehicle if alternative arrangement done. (C) In case of late reporting 200.00/- Rs per hour. (D) in case of below model 500.00/- Rs per day will be deducted.

(E) In case due to misbehavior of driver or contractor, vehicle not put in service penalty of Rs.500/- per hour will be deducted.

(F) In case if driver/contractor refuse to perform any outside or local trip, penalty of Rs.1000/- will be imposed & that day will be treated as absent day.

30. The Thermal Power Station is prohibited area. The movement of men, material and

vehicles are restricted. At any stage if the Chief Engineer feels necessity to restrict movement of any particular person or vehicle or to back permission granted by him, it is the sole responsibility of the contractor & / or his driver to adhere to instructions & / or to comply with the instruction.

31. The vehicle is required for Electricity Generation related day to day activity of operation & Maintenance work related activity of various departments of TPS/HPS CISF use & Patrolling purpose of TPS/HPS/ASH DYKE/GSECL Colony/CISF Colony & For Emergency call of GSECL O&M staff from colony in odd hours at the time of emergency in any of units, coal plant, HPS other miscellaneous trips of associated department. Out station journeys either to Surat, Baroda, Ahmedabad, Gandhinagar, Sikka, KLTPS or any where in Gujarat. If required vehicle may also send to near by state with short notice intimation in Maharashtra, MP, Rajasthan, Chattisgarh etc. When vehicle is allotted out state duty; bidder shall have to complete all required RTO formalities like other state entry tax, out state visit RTO permit. The Other state Entry tax & RTO taxes, Toll Tax will be reimbursed to contractor by GSECL on the submission of receipt. It is compulsory to keep all original documents along with vehicle as per RTO Rules & regulation like, Maxi Permit, Insurance papers, Vehicle fitness certificate, RC Book, Original Driving license of driver as statutory requirement. In absence of document if any asked to produce before RTO authority penalty imposed & levied paid if any will not be reimbursed. The contractor shall have to make such outside trips as & when required.

32. Normally out side journey will be One day trip but in some case night halt is required to be made. For 24 Hours duty vehicle Night halt charges are not applicable. It is the responsibility of the contractor or driver to make his own arrangements for lodging and boarding at the place of night halt. GSECL, Officer performing the journey does not have any responsibility in this regard including safe custody of the vehicle.

33. Total K.M of 09 non-AC Jeep will be considered 35,000 kilometers per month ( Item Sr No-1 & 2 of Schedule-B ) & 02 AC Jeep will be considered 6000 kilometers per month ( Item Sr No-3 & 4 of Schedule-B) This being dependent on so many factors; it is usually not possible to strictly adhere to this kilometer. Therefore, if during the month, running of 09 non-AC Jeeps are more than 35,000 kms & running of 02 AC Jeeps are more than 6,000 kms, the contractor shall be paid as per the Schedule-B Item Sr No-5 & 6 resp. of Schedule-B for extra kilometer travelled.

34. No vehicle once inspected and approved by the Engineer in charge for hire shall be changed or substituted by the contractor except prior permission and approval of the alternative arrangements made stated above.

35. The L1 (lowest) party should be paid security deposit at 5% of the order value against LOI within 10 days from the date of issue of Letter of intent (LOI), failing to which the amount of EMD paid by party will be forfeited. More over party will not be allowed to participate in the tenders invited by this office for the period of one year. Only after receipt of SD the order will be dispatched to the party.

36. For attending any breakdown/repairing prior permission from Engineer in charge shall be obtained and KM reading should be recorded in vehicle section.

37. Normal duration of the contract is 730 Days (24 Months) from the date of commencement of work. If GSECL desires, the contract is extendable by further THREE months on the same rates, terms & condition without the concern of contractor & this is binding to contractor. If both parties agree, the contract will extendable by further period of 12 months, However. This is binding upon contractor. Such extension shall form the part of original contract and all the terms conditions rates applicable to original contract shall be applicable to this extension also.

38. Terms of Payment:

(a) Payment will be made by running accounts bills monthly after taking joint measurements and following the GSECL’s procedure within 30 days from date of measurement.

(b) The final joint measurement will also be completed as early as possible after handing over the completed work in all respects and final bill will be prepared and paid for as soon as possible thereafter.

(c) GSECL shall reimburse parking charges, toll charges and entry tax on submission of the duly certified receipt by the user.

39. It is whole & sole responsibility of the contractor for fatal &/or non fatal accident & to pay compensation and damages to the persons involved as per law of act. The contractor shall indemnify GSECL on stamp paper of Rs. 100/- (cost of which shall be borne by the contractor) against any damages either contractor’s staff /vehicle / equipment or any other persons & / or property /vehicle arising out of any accident or damages before commencement of work.

40. If the service of the contractor is found unsatisfactory GSECL shall exercise its discretionary power to cancel the order in accordance to stipulation as above and SD shall be forfeited.

41. In any circumstances, no unauthorized persons should permit to use the contract vehicle during the trip of concern user officers of GSECL. It is sole responsibility of contractor.

42. Rates mentioned in Schedule ‘B’ & all the terms & condition of Schedule ‘A’ is an undivided part Tender & bounded to the contractor. In case of any dispute arises, Decision of Chief Engineer is final & bound to contractor.

43. If the contractor has fails to execute order successfully, Order will be got completed through other agency and if required by paying higher rates. In such case difference of rate with 15 % supervision charges will be recovered from contractor.

44. As per GSECL’s rules the contractor has to enter in to agreement with company on stamp paper of Rs. 100/- (cost of stamp paper is to be borne by the contractor) in the prescribed Performa that will be supplied by the GSECL before execution of work.

45. All the security rules & regulations as framed from time to time shall have to observed and complied by the contractor & / or his persons. Necessary authorized photographed entry pass shall have to be obtained for drivers for entry in TPS. Necessary photograph are to be arranged by the contractor. It is contractors responsibility to obtain entry pass of vehicle and their driver in advance.

46. The GSECL reserves the right to terminate the contract at any time, without assigning any reason what so ever by giving notice period of month from the date of termination of the contract. Contractor will not be entitled for any compensation/damages/losses what so ever, on account of such termination of the contract.

47. Monthly bill should be submitted by the contractor in Triplicate along with vehicles certified logbook pages with advance stamp receipt to the controlling officer. After verifying produced bill & documents lawful admissible payment will be done as per prevailing rules of GSECL.

48. The contractor shall have to deploy new hire jeeps within 60 days from the date of order, failing which Penalty as per clause no. 29(ii) will be levied. If contractor will deploy below model jeeps ( model of vehicle not earlier than 2013) after 60 days (from date of order) penalty of Rs.250/- per day per lower model jeeps will be imposed up to first 15 days, there after Rs.500/- penalty will be imposed per day per lower model jeep. However vehicle of model earlier than 2013 will not be acceptable.

49. The contractor shall pay minimum rates fixed under the minimum wages act. The wages of every contract labour employed by him under this contract shall be paid on or before Dtd 7th of every month through Bank and same shall be certified by LWO / IRO every month salary, failing which monthly payment of bill shall not be made.

GENERAL TERMS & CONDITION OF CONTRACT: LABOUR LAW:

1. Persons below the age of 18 years & above the age of 60 years shall not be employed for the work.

2. No female workers shall be employed in the night shift between 07.00 PM to 06.00 AM 3. Contractor shall maintain valid labour license under the Contractor (Regulation &

Abolition) Act 1972 for employing necessary manpower to be required by him. In the absence of such license the contract shall be liable to be terminated without assigning any reasons thereof.

4. The contractor shall at his own expense comply with all the labour laws and keep the corporation indemnified in respect thereof. Some of the major liabilities under various labour and industrial laws which the contractor shall have to comply with are as under.

5. Payment of contribution of employees (contractor labour) as well as employer’s (contractor ) contribution towards Provident Fund, Family pension scheme, Employees Deposit Linked Insurance Scheme, Administrative charges, inspection charges etc. at the rates made applicable from time to time by Government of Gujarat/Government of India or other Statutory authorities.

6. Labours engaged by you shall be entitled for Earn leave as per the provision laid down in Factories Act 1948. Contractor shall extend the facility of E.L. as per the provision laid down in Factories Act and shall also have to maintain leave records in prescribed form under Factories Act.N

7. o labours are allowed to enter in power station premises who do not have Identity card prescribed under Factories Act.

8. Contractor shall have to comply with the Maternity benefit if he happens to engage female labours as per Maternity benefit Act.

9. Contractor shall have to obtain Insurance of the labours engaged by him to carry out contractual work before commencement of work under Workmen’s compensation Act.

10. P.F. CODE NUMBER: The contractor shall have to submit the details of his own P.F. code number along with

offer from appropriate authorities, without P.F. Code no. the tender is likely to be disqualified.

11. PROVIDENT FUNDS AND FAMILY PENSION SCHEME: The contractor shall submit along with his bill (Month wise) a statement regarding deductions at the rate of 12% of the wages against employees provident Fund & Family Pension Scheme in respect of each concerned employee,(or at the rates made applicable by the Government from time to time ) of the wages. The contractor’s contribution and his workers contribution towards Provident fund and Family Pension Scheme shall be deposited by the contractor with Regional provident Fund commissioner Ahmadabad or to the authority prescribed under the Act. Along with the other charges applicable. Copy of paid PF challan required to be attached alongwith every RA Bill.

12. If any workman engaged by contractor meets with fatal or non-fatal accident while on duty then contractor shall be liable to pay compensation to the legal heir or to the workman as the case may be as per Workman’s Compensation Act.

13. EMPLOYEES DEPOSIT LINKED INSURANCE SCHEME: The contractor shall have to deposit ½ % of the rate applicable from time to time of the wages in respect of employee who are a member of the provident Fund against the

14. The contractor should pay prevailing minimum wages to the labours engaged by him as per the minimum wages Act in presence of the corporation’s officer or representative.

15. The Contractor shall deposit fifteen days salary for every completed year of service in case of each worker towards the liability of gratuity.

16. ADMINISTRATIVE CHARGES: Administrative charges for maintaining Provident Fund Account shall be deposited by the contractor with Regional provident Fund commissioner, Ahmadabad. at the rates applicable.

17. LABOUR LICENSES FOR LABOUR CONTRACT: The contractor shall have to obtain the copy of labour contract license under contract labour (Regulation & Abolition) Act from the appropriate authorities before commencement of work.

18. Contractor shall have to issue the contractual appointment letter for a specific period to their labour engaged during the contract period each and every instance & should narrated clear cut terms & conditions for the liabilities of the concerned employees.

19. After completion of the contract work, the work completion certificate is required to be produced be fore the D.G.M./I.R.O. for the purpose of No due certificate and cancellation of the gate passes issued to the contractor’s workman at the time of execution of the contract work.

20. The Contractor shall have to maintain all the relevant records under labour laws as mentioned here in above and keep ready for verification by the corporations authority as well as the authority of the Government Officials as and when asked for the checking.

21. The Contractor shall have to produce / submit the original copy of wage register/muster roll and relevant records under labour laws for the contract work as and when demanded by the corporation for statutory compliance if arise in future.

22. Additional New Conditions. The contractor shall produce certified copies of documents, in respect of workers deployed by him at GSECL, Ukai as below mentioned before Dy.G.M.(HR//IRO/LWO/In-Charge of HR Dept.

All the contractors working at Ukai Thermal Power Station shall have to strictly observe the following Safety Rules. The Contractors shall be responsible for informing & observing these rules by their supervisors/ employees/ labours as well as the supervisors/ employees/ labours of their sub-agencies/ sub-Contractors engaged, if any. Prior to commencement of the work, Contractor shall have to submit a written assurance on their letterhead to the concerned Sectional Head/ Engineer-in-charge that they have thoroughly gone through these Rules, have educated their employees/ employees of their sub contractor and will strictly observe the said Rules while execution of work under work contract awarded to them. They will have to indemnify the Corporation for any loss or damage/ accident/ injury to the Corporation‘s property/ employee or employee of their own in default of non-observing these rules.

01 Persons to be employed for carrying out the work shall possess required qualification, be fully trained and conversant for works to be done. All persons should have gate pass. Register consisting the full details (i.e. address, phone no, details of nearest relative, etc.) of all persons is to be maintained. During the work execution, one trained & competent supervisor should always remain present at site.

02 The contractor shall take all the required safety measures prior to commencement of work on dangerous substances, machineries or area at which cautionary notice is displayed and obtain- “Line Clear or Work Permit” through the concerned Department/ Section.

03 Prior to carrying out welding, gas cutting, furnace heating or any other hot work job, the contractor shall remove all the inflammable material lying at or nearby worksite or cover it properly by suitable protective covering. Also, special care shall be taken before carrying out such job & see that all possible contributing factors to set fire shall be removed/ vanished prior to commencement of the work. Advance intimation shall be given to concerned section/ fire section to commence the work in fire prone areas. They should also keep ready all the First Aid Fire Extinguishers/ equipments & fire extinguishing media/ material like sand/ water buckets or other appropriate equipment at such place.

04 While carrying out work in confined space or inside vessel, the contractor shall obtain necessary-Confined Space/ Vessel Entry Permit “from concerned department prior to commencement of the work. For lighting in such areas, only 24-volt (ISI certified & with proper guard) hand lamp shall be used. For taking care of the persons working inside the confined space/ vessel, a supervisor/person capable to keep continuous watch on person(s) working inside, assist them in case of emergency or arrange to get immediate outside help, shall remain present at entry point and shall use full body safety belt without fail. While working inside sewage, trench or in-depth, a person to warn outsiders/ entrants/ passers etc. shall remain available near entry point or the entry point shall be cordoned by a barricaded tape with a cautionary notice. After completion of the works, all the lids/ covers/ grills/ grits opened, shall be re-fixed/ re-placed in the original position as it were prior to commencement of the work and leave the work place in safe condition in all respect, so as to prevent accident to fellow workers.

05 The contractor shall see that he/ his persons do not block (by stacking material, spare parts, tools-tackles, equipments etc), any passages/ walkways / gangways/ aisles/

staircases/ ladders/ lifts or any other approaches/ roads leading to plants or its auxiliaries, on which there is a traffic movement or possible traffic movements in case of emergency. Such passages are meant for safe escape in the event of emergency. If it is utmost necessary to carry out work in such area with blocking of passage, prior permission of Competent Authority or the Engineer-In-Charge shall be obtained. To demarcate/ declare the area as UNSAFE, cordon it using barricading tape & display suitable caution notice or keep a person to restrict/ divert the traffic on this route through other safe passage.

06 Prior to use power/ electrically operated hand tools/ equipments/ machines/ gadgets like welding machine, hand grinder, hand drill etc, ensure for its safe operation & use it only if it is found safe to use. Do not use defective, unsafe or improperly maintained equipments. The electrical power supply required to run such equipments shall not be taken directly at their own but shall be obtained through concerned Electrical Maintenance Departments or their authorized persons or under their observations/ guidance only. The Electrical Section shall provide temporary electrical connection up to contractor‘s Mains Board on which it is compulsory to install mains switch, ELCB & fuses of adequate capacity. All such equipments shall invariably be earthed adequately to prevent electrical shock, sparking, short circuit etc. Power cord to be used shall be of adequate capacity, without any joint & shall consist of earth wire also. Hence, it is necessary to use adequate capacity 3-wire power cord for single & 5-wire power cord for three phase power connections. The plugs, receptacles, pins, holders etc shall be of adequate capacity & safe to use. All electrical & mechanical equipments/ tools-tackles viz. welding machine, cutting machine, Grinder, Drill, Chain Pulley Blocks, Hook chooks etc required to be used during work execution shall be of standard make & bear ISI certification mark on it. The consumables like welding electrodes, grinding wheels/ discs etc which has specific prescribed life span shall not be used in any case if its expiry date is over.

07 It is compulsory to use standard make Personal Protective Equipments (P.P.Es.) as per the job requirement. Do not work without use of required P.P.Es. Contractor is responsible to provide standard make (ISI approved) Personal Protective Equipments/ Safety Gadgets suitable to give sufficient protection against hazards involved in their work/ job to their staff, as per the job requirement and insist/ enforce their staff to put on the same while at works. The ongoing work is liable to be stopped at any time if the contractor’s staff is found working without P.P.Es. Following is the list of various P.P.Es to be used for various works/ worksites.

08 Before using lifting machines/ tackles (like C.P.Bs., Hook chooks, winch, forklift, mobile crane, EOT crane etc) & its attachments (like D-shackles, slings, U-clamps, Eye bolts or any fixtures), it shall be checked and used only if found safe to use. Also, ensure that these are tested, examined & certified in form no 9/ 10 by Competent Person as per the Factory act-1948 and its validity is not expired. Further, it shall be fixed properly and firmly prior to lifting the weight.

09 Scaffoldings to be used for working at height shall be of adequate size & capacity. Obtain the work permit when working at height. While climbing on such scaffolding or working on any structure at height, use of full body safety belt & Helmet is compulsory. It is also necessary to fasten chinstraps of the helmet.

10 Contractor or their employee shall not interfere in day-today routine plant activities/ works except the work assigned to them, shall not loiter in the areas other than their work jurisdiction, as well as shall not temper/ operate/ touch the machineries / equipments / auxiliaries with which they are not concerned. Also, the contractor shall strictly instruct their staff not to sit or take rest at/ near/ below running plants, auxiliaries, systems or any place which is risky, hazardous & prone to accident.

11 The cylinders containing poisonous/ toxic or inflammable/ explosive gas like Oxygen, Acetylene, LPG, Hydrogen, Ammonia, Chlorine, CO2 etc shall be handled safely taking due care. To handle/ shift such cylinders a special trolley/ cage meant for it must be used but in no case it should be rolled. Domestic LPG cylinder shall not be used/ permitted.

12 On completion of the work, cotton waste, spilled oil/ grease, pieces of welding rod & other waste material shall be removed from work site and the area shall be left safe, neat & clean.

13 In case of any injury/ accident while working, it shall immediately be reported to Safety Department through concerned Sectional Head/ Engineer. The prescribed Form No. 21 may be obtained from concerned section or Safety Officer. [For any incident occurred but have no injury to any persons should also be informed to Safety Officer as- “Near Miss Incident”.]

14 In all risky jobs, before starting the work, contractor should obtain General Safety Work Permit from concerned section well in advance.

15 In case of noticing smoke or fire during their work execution, they shall make immediate efforts to extinguish/ control it and simultaneously inform the Fire Brigade on phone No. 4444 or 4344 or 5555 or 02624-290049, shall shift the casualty to nearby hospital after rendering first aid in case of accident.

16 Over & above these, contractor shall have to follow all the safety requirements/ rules & regulations/ norms and legal provisions laid down in various statutes, particularly the

provisions of The Factories Act-1948 & the Gujarat State Factories Rules-1963 (Amended up to date) shall be followed strictly. The contractor shall also obey the rules/ regulations/ instructions of the local Competent Authority for safety requirements.

17 No women or young person shall be allowed to clean, lubricate or adjust any part of a prime mover or of any transmission machinery while the prime mover or transmission machinery is in motion. Examination or operation of motion machinery shall be made or carried out only by a specially trained adult male worker wearing tight fitting clothing as per section 22 of factories act 1948.

18 No women or young person shall be employed or permitted to work in Lead-compound area like battery room etc. as per schedule VI of GFR 1963.

19 All the relevant labour and industrial laws shall also be followed compulsorily.

20 It is felt necessary to deploy safety officers/ Safety supervisors by contractors/ Agencies involved in carrying out hazardous activities/ operations inside TPS to have better and constant supervision in terms of Health Safety and Environment activities.

21 In case, it comes to the notice of GSECL UTPS management that the safety guidelines/ safety rules/ safety norms are not being followed then a minimum sum of Rupees One Thousand shall be penalized on the contractor/ Agency and for subsequent such violation, a severe penalty/ action as deemed fit shall be imposed, which may please be noted.

22 The above rules shall be scrupulously followed and where required, they may contact the Safety Officer for any ambiguity/ further guidance in this regard.

23 For performance evaluation of contractor, safety factors of work accident, fire incident & near miss accident will be considered. Steps can be taken to review the job assignment up to cancellation for negligence.
