INFORMATION Limited Tender is invited for the work of Dismantling, erection, testing and commissioning of scrap shear machine in plate mill at Bhilai Steel Plant

INTRODUCTION: 1.0 INTRODUCTION: The scrap shear machine is used for shearing of plate and it is placed at plate mill plate plant. The existing old scrap shear machine is placed there and it is required to change the old machine by the new scrap shear machine. Manufacturing and assembly of new machine is under final stage in HEC workshop. The approx weight of the whole machine is 112 MT Detail description of scrap shear machine in chapter -02 in technical specification of the Scrap shear machine.

1.1 BROAD SCOPE OF WORK: 2. Dismantling of existing shear machine as per HMB drg no. 2405.23.300 3. Removal of old housing assembly and cutting mechanism. 4. Removal of coupling from existing eccentric shaft and removal of output shaft from

the existing drive reducer. 5. Assembly of shear machine with new housing assembly as per HMB Drg no.

2405.23.310 AO and new cutting mechanism as per HMB drawing no. 2405.22.80 with all other existing parts/components to be restored and assembled as per HMB Drg No. 2405.23.300

6. Assembly of dismantled old coupling on new eccentric shaft and thereafter drive reducer output shaft positioning and reducer box up.

7. Coupling to be coupled with existing reducer side coupling after alignment. 8. All the grease line, grease feeders, pneumatic lines and hydraulic pipe lines

connected to the shear machine shall also be removed and restored back to normal functioning of the shear machine.

9. Replacement of housing assembly and restoration of all other parts, commissioning and their after trial run for 72 hours.

10. All materials handling equipments as well as consumables are to be arranged by the party.

11. Any related civil jobs as well as facilities/tools/tackles required during assembly/ dismantling shall be arranged by party (contactor).

12. Party shall have to complete total job within the time schedule. 13. EOT cranes available with BSP may be provided to the party as per availability.

However the same shall not be binding on BSP or HEC. 14. All the replace/parts/assemblies shall be shifted to the desired locations as per

BSP’s directive and the same shall be in the scope of the work of the party only. 15. The dismantling and removal of old shear machine and installation, erection, testing

and commissioning of new shear machine shall be completed by the party within 27 days of the site availability.

16. All items against this Purchase order shall be delivered directly at plate mill site, to avoid any handling problems at store as well as to avoid multiple transportation. The item shall be with plate mill custody till the time of actual execution of activities as per schedule.

17. To facilitate accounting at stores, after receipt of material at plate mill site, indentor/user (plate mill) shall arrange to certify receipt of material on the party’s invoice and send the same to stores for generation of RN/GRN.

18. Inspection at BSP stores against GC/WC, MTC given by party. Material shall be unloaded at plate mill site directly and receipt of material certified by plate mill.

19. Successful commissioning means 72 hours trial run after commissioning of the shear machine.

20. The items shall have guarantee/ warrantee against defective materials, bad workmen ship for a period of 12 months from the date of commissioning or 18 months from the date of dispatch, whichever is earlier.

21. Erection & Commissioning of electrics of scrap shear machine (if any) will also come under party scope of work.

22. The scope also includes unloading & storage of paints, lubricants and some materials which may be sent later for completion of subject work.

23. Any item not specifically mentioned but essentially required for completion of erection of equipment shall also be included in the scope of work of erection; commercial settlement will be done after acceptance of the work.

24. Mobile crane/hydra etc required for erection will be in the scope of contractor. All the statutory requirements i.e. insurance/ESIC & PF etc of the labors shall be in the scope of the contractor.

The contractor shall ensure erection and commissioning of the shear cutting machine complete in all respect and any work not covered in this specification but essential for completion of work shall be included in the scope of the contractor.

The detailed scope of work under this work order will generally include the following apart from specifically indicated as above for the specific equipment’s as per the drawing, document and manuals to be supplied by the manufacturer/HEC.

a) Erection, painting, testing and commissioning of the equipment’s complete with all structural, Mechanical and electrical equipments as per the drawing, document and manuals to be supplied by the manufacturer.

b) Mobilization of labour, suitable mobile crane, tools and tackles, lifting and handling equipment, testing equipment and consumables etc.

c) It necessary making suitable level ground at erection site for receipt and unloading of material/equipment at site with their own men, tools and tackles and making store for storing all the supply items properly at site to be allocated by BSP, Bhilai.

d) Contractors are advised to visit site before quoting so that they are acquainted with site conditions and requirements.

e) The heavy structural components to be unloaded at erection site at respective sites where the item is to be erected, whereas the packed boxes, electrical components and other smaller components to be unloaded and stored in contractor’s store.

f) The contractor shall store all the items properly and protect them from damage by weather, any other natural causes or stealing/theft, misuse till the equipment’s are handed over to the end user after satisfactory performance & acceptance test. For this purpose contractor shall construct a suitable store at erection site to protect valuable equipment’s from rain, heat and theft. Place shall be provided by BSP, Bhilai. If any theft occurred after receiving/custody items the same amount will be deducted from the contractor’s bill.

g) In case apparent damages/ shortages in consignments, packing are noticed by the Contractor, such cases shall be brought to the notice of HEC site representative immediately and cleared only with their knowledge/ approval.

h) The contractor shall arrange for handling and transportation of items / components from own store to the erection site as per the requirement of erection & commissioning.

i) The Contractor shall be responsible for arrangement of adequate material handling equipment like mobile cranes, trucks, trailers, fork lifters, tools and tackles as may be required for his work.

j) The necessary lifting tackles, tools, wire rope, slings of suitable capacities and other equipment to carry out this work shall be arranged by the Contractor. All such lifting tackles shall have valid test certificates. These certificates may be inspected by the Purchaser or any statutory agency from time to time.

k) The Contractor shall be responsible for all damages to his trucks/ trailers/ cranes which may take place during the course of execution of work.

l) The Contractor shall make provision for adequate storage sheds which are to be wind and water-tight for the storage of necessary equipment, such as motors, brakes, cables, etc. to protect them from damp and moisture. All auxiliary and loose parts shall be systematically classified for ready identification and location when ever needed. As far as possible, materials shall be stored in the order in which they will be erected.

m) Closed stores shall be of tubular truss structure with asbestos sheet as roof. Adequate illumination and fire fighting facilities for the stores shall be provided by Contractor. Necessary partition / racks, furniture, etc. shall be provided.

n) Watch and Ward: The Contractor shall provide and be responsible for watch and ward of the goods in his custody on round the clock basis. The Contractor shall be solely responsible for the safety and security of the stores. The Contractor shall be responsible for any loss, fire, theft or burglary of any of the items from the stores and at erection site. The storage responsibility of the Contractor shall be over only when the plant and equipment are formally taken over by end customer.

o) Furnishing details of Unloading/loading of all consignments to be received at BSP, Bhilai site from HEC/BSP and handing over commissioning spares and other spares.

p) Supervision of erection, testing and commissioning of equipments.

q) Earthing of various electrical equipment to equipment structures as specified.

r) The scope of work shall also include acceptance of the erection front/building structure to be handed over by BSP, Bhilai for erection of equipments.

s) Supply of all consumables for erection purpose like welding electrodes, PVC Tapes, grease

and lubricants cotton waste etc. required during erection.

t) Supply and provision of packing plates shims up to thickness 3-8 mm etc. required during erection and alignment of motors, brakes etc.

u) Contractor has also responsibility for getting Preliminary Acceptance Certificate (PAC),Commissioning Certificate(CC) & Final Acceptance Certificate( FAC) from BSP, Bhilai for the project.

v) Conduct all Tests as required by Project/customer to obtain FAC.

1.2 GENERAL INSTRUCTION TO TENDERER

i) Tenderer should visit to have better understanding of the requirements.

ii) Tenderer should submit documents of similar experience of work related to the scope of work or similar work with respective completion certificate of the work.

iii) Tenderer should submit balance sheet of last 3 years

iv) System shall be erected, tested & commissioned to meet the technical requirements covered under relevant specifications & drawings.

v) Tenderer shall quote their price in price format enclosed in Annex-A.

vi) The credential of technical suitable venders will be forwarded to BSP, Bhilai for acceptance and approval of the vender by BSP, Bhilai for carryout the scope of work under the tender. The price bid of venders approved by BSP, Bhilai will be opened for its evolution for placement of order.

vii) Inspection & testing shall be carried out in presence of Successful Tenderer/HEC/ BSP, Bhilai on the basis of drawings, specification.

viii) Successful tenderer shall not let-off the contractor part thereof to any sub-contractor without written permission of BSP Bhilai /HEC. In case, subletting of any part of the work is permitted by BSP, Bhilai, the fact that such permission has been accorded, neither shall establish any contractual relationship between Sub-Contractor & BSP, Bhilai nor shall release the contractor from any of his obligations and liabilities under the specific and applicable contract.

ix) Successful tenderer shall clearly indicate deviations if any from the tender document so that same can be considered during tender evaluation.

x) Successful tenderer shall clearly indicate the assumption made in respect of specification, date or any other details that have not been mentioned in the tender document but considered necessary for meeting the specified functional requirements.

xi) Once the work order is placed on the successful Tenderer within the validity period of his offer the awarded price shall remain valid throughout the entire period of the contract in terms of conditions stipulated in G.C.C. of HEC.

xii) Approval of various procedures submitted by the successful tenderer shall not relieve him of his responsibilities towards completion of the work as defined in the contract.

xiii) Tenderer shall furnish the following to BSP, Bhilai /HEC before starting of erection:

Erection plan schedule including list of personnel and erection equipment to be deployed.

A time bar chart showing starting and completion of various activities of erection of the scrap shear machine.

xiv) The Tenderer must have a valid electrical Tenderer's license issued by the concerned state government. Tenderer should have in his employment sufficient number of electricians and supervisors holding valid license.

xv) The Tenderer shall indicate his requirement of electrical power for erection purpose. Subject to the availability, the power shall be supplied at one point of erection site on cost/free basis as per BSP, Bhilai rules. The Erection Tenderer shall carry out further distribution to different points. The power normally shall be supplied at 415V, 50Hz. AC.

xvi) All the equipments structures mechanical and electrical equipment shall be stored and handled in such a manner that they are not subjected to damage or excessive stress due to mishandling and environmental condition.

xvii) The positioning, leveling and plumbing of the equipments shall be carried out in accordance with the approved drawings. If the units are not supplied in assembled condition due to transportation reasons etc, all the items/parts shall be positioned, leveled and plumbed at ground in accordance with the approved drawings. The work shall be carried out to the satisfaction of the HEC/ BSP, Bhilai.

xviii) The successful tenderer shall be solely responsible for obtaining necessary clearance from various statutory bodies during execution of the work.

xix) The Tenderer shall carry out the work in accordance with relevant IS standards, and drawings, data, information, instructions furnished by the HEC/ BSP, Bhilai. The testing and commissioning of the equipments shall be done in presence of the representative manufacturer and BSP, Bhilai.

xx) The Tenderer has to carry out the work in such a manner that it does not effect the operation of the plant/shop. If other Tenderer is also engaged on the same work site for other jobs, the Tenderer shall work in close co-operation with them. The Tenderer shall get himself acquainted with the prevailing working conditions, practices and arrangement at the plant site, failure to do so shall not relieve him of his responsibility of correct interpretation and execution of the work involved.

xxi) The suitability and capacity of all plant and equipment used for erection, testing and commissioning shall be to the satisfaction of the HEC/BSP, Bhilai.

xxii) While conducting test on the equipments, the Tenderer shall not be held responsible for any manufacturing defect but shall be held responsible for defective workmanship carried out during the erection work. The Tenderer shall arrange for slings, wire ropes, pallet to support test load wherever necessary, stop watches and other necessary equipment/instrument to carryout the work. (The Tenderer shall be responsible for transporting, loading/unloading of test loads to test site from other places within plant boundary). The Tenderer shall arrange necessary equipment and light fittings with lamps and other accessories to adequately illuminate his work site. Maintenance of light fittings and replacement of fused lamps shall be Tenderer's responsibility.

xxiii) After completion of the work, the Tenderer shall promptly remove from the premises everything brought in by him and shall leave the premises in an acceptable clean condition.

xxiv) The Tenderer shall furnish fort-nightly progress report in an agreed format to HEC site office to monitor the progress of erection work.

xxv) During course of erection work the Tenderer shall strictly follow all the safety norms/rules and regulations and shall abide by all the statutory rules and regulations.

xxvi) The Tenderer shall make his own arrangement for alternative power in case BSP, Bhilai is not able to supply construction power.

xxvii) Necessary drawings and documents required for erection made available to the BSP, Bhilai by the manufacturer shall be provided to the erection Tenderer which shall be return after completion of the scope of work.

xxviii) Tenderer should follow the safety rules and regulation as per BSP/SAIL requirements. Deputation of Safety Officer, use of safety equipments during erection of scrap shear machine, training of workers in safety etc. are in the scope of tenderer as it is basic requirement for execution of the erection & commissioning work.

xxix) HEC Management has right to change/add/ remove any clause, terms & condition in any further stage if required.

1.3 SERVICES TO BE PROVIDED BY HEC

The following will be in the scope of HEC apart from that specifically mentioned

against each equipment: 1. Supply of complete equipment sequentially to be erected at Site. 2. Supply of all drawings/documents required for erection, testing & commissioning of

the equipment. 3. Supply of Paint for carrying out intermediate & final painting, if required. 4. Supply of First fill of lubricant, if required.

1.4 ERECTION

1. Erection work involves assembly of equipments parts components as per approved drawings.

2. During erection, the steel work/equipment shall be securely bolted or properly fastened and when necessary shall be temporarily braced to take care of all loads transferred to the structure during erection including those due to erection equipment and its operation.

3. No permanent bolting or welding should be done until proper alignment has been

made. 4. Erection and dismantling of equipment parts shall be carried out in a manner so as to

ensure stability of the scrap shear machine at all stages of erection. 5. The contractor shall be held responsible for the assembly of the equipment parts

within the required accuracy. The dimension, of the scrap shear machine after

assembly shall be within the tolerances as specified. All materials shall be straight unless required to be of curvilinear form and shall be free from twists. All cold straightening shall be done by pressure only.

6. As far as possible sub-assembly of the scrap shear machine parts shall carried out on

the ground.

7. Instrumental checking for correctness of alignment of the scrap shear machine shall be carried out by the Contractor. The necessary instrument shall be arranged by the Contractor.

8. Bolting at site shall be carried out with the same accuracy and care as those adopted in

the shop. When parts are to be joined by bolts, these shall be tightened to the maximum limit. The threaded portion of each bolt shall project through the nut by at least one thread. Bolts shall be fitted with spring washer. Where fitted bolts are required, new bolts shall be used with holes re-reamed to the required tolerances.

9. WELDING- All field assembly and welding shall be executed in accordance with the

requirements for shop fabrication. Electrodes used for welding scrap shear machine structures shall be low hydrogen type. Only qualified welders shall be employed to carry out welding process. The welding shall be uniform and free from defects like slag inclusion, blow holes porosity, cracks, under cuts etc. There shall not be over lapping or undercutting of the parent metal.

10. Necessary adjustment to the structure, wheels, equipment etc. for satisfactory operation and acceptance of the equipment shall be made by Contractor. Any modification, rectification or repairs to members or equipment which have been damaged during transit have to be made good by the Contractor to ensure proper assembly of the components. Any modification or repair to members or equipment which have been damaged during storage and handling or otherwise, shall be made good by the contractor free of cost, to ensure proper assembly of the component.

11. Erection of the electrical and mechanical equipment shall be carried out as per

approved erection instructions/documents. Proper care shall be taken so that no chance of damaged due to faulty or careless dismantling and erection procedure. The Purchaser decision shall be final regarding any damage due to wrong dismantling or faulty erection procedure and the entire cost of replacement of the damaged part shall be borne by the Contractor.

12. Contractor has to rectify small defects observed during erection, testing &

commissioning of scrap shear machine without claiming it as extra work.

13. All type of small rectification work may be considered in scope of work and no extra charges for the same should be claimed by the contractor.

1.5 PAINTINGS After erection the equipment shall be painted as follows:

a) Damaged and defective shop coats shall be touched up with the same type of paint as used for shop coat.

b) Requisite coats of intermediate and finish paint shall be applied. Requisite quantity of the paints shall be supplied by the manufacturer of the equipment.

c) Before commencing painting of the steel which is delivered unpainted, all surfaces to be painted shall be dry and thoroughly cleaned from all loose mill scales, rust and foreign matters.

d) Surfaces which will be inaccessible after site assembly shall receive the full specified protective treatment before assembly.

1.6 ACCEPTANCE CERTIFICATE

a. The Contractor shall inform sufficiently in advance regarding readiness of acceptance tests and commissioning.

b) The test shall be carried out in presence of the HEC & BSP authorized representative.

c) After equipment erection is completed, visual inspection will be jointly made by the Contractor, scrap shear machine manufacturer and the Purchaser. The defects and short-comings found during visual inspection shall be rectified by the Contractor.

d) After the supply has been completed and before the complete scrap shear machine installation is put to load test, tests shall be carried out for satisfactory operation of each of the equipment.

e) The compliance of the equipment with the specified performance requirements. All the relations of the equipment shall be tested with rated load on all notches and the speeds at full notch with rated load shall be attained.

1.7 TIME SCHEDULE

Planned deliveries of the equipments will start in the month of Jan’ 2015. It is desired that scrap shear machine will erected & commissioned in not more than one month. However Erection, testing and commissioning of scrap shear machine shall be completed within fifteen days after receipt of the last major consignment at site as per scope of work indicated above and handing over of erection front. The tenderer to draw an erection schedule and submit a plan for resource mobilization. The schedule should show activities, sequence of activities and time (in number of days) required for the activities for each equipment. Resources like man, tools & tackles and facilities (mobile cranes, welding sets etc.) planned to deploy to meet this schedule to be tabulated. Common resources like supervisors, supporting manpower to be used for more than one equipment also to be indicated.

CHAPTER – 2: TECHNICAL SPECIFICATION

2.0 TECHNICAL PAPRAMETER OF SHEAR SCRAP MACHINE 01. The control assembly of the shear machine will be done in the shop as per the

drawing. 02. At assembly all the mating and other machine surface faces are to be covered with

anti corrosive grease. 03. The clearance between the knives should be kept 0.4 to 0.8 mm. throughout the

whole length of the knives. In this condition of the knives, the wages must be in their initial position.

04. The stroke of the crosshead is to be checked by rotating two times the eccentric shaft in the clock wise direction at site. At site seen from the drive side.

05. While rotating eccentric shaft the balancing cylinder should be subjected to pressure and pressure is to be maintained maximum up to 100 ATM at site.

06. It is to be seen that shear moving mechanisms work smoothly without jamming. 07. The hydraulic cylinder of the balancing mechanism should be tested under

pressure 125 ATM for a period of 5 minutes. 08. The work of the holding down mechanism to be checked out for smooth work and

hydraulic cylinder to be tested. 09. The minimum thickness of the knives should be 1 mm to 8 mm. 10. The hand railing are to be welded at site. 11. The hole for fixing: limit switch are to be done at site. 12. The unmatched surface are to be painted with anti corrosive paint.

2.1 ERECTION, TESTING & COMMISSIOINING:

Erection work involves assembly & alignment of equipments parts including motors and brakes of electrical components and installation of the equipment as per approved drawings. The actual weight will be given package wise along with dispatch of goods to BSP site and will be considered for payment calculation. a) The contractor is to transport all the components from stores / unloading site to the

proper location of the erection with their own arrangement. Un-packing of packages and listing of damaged / short supply items to be recorded and immediately reported to HEC site in charge.

b) To maintain the inventory of items at site. The Contractor shall maintain detailed records of all the equipment received and issued from the stores under their control. Unloading and loading of equipment at stores and at erection site shall be the total responsibility of the Contractor.

c) The erection to be done in proper sequence to ease subsequent mounting, alignment, assemblies & subassemblies and safety of man & equipment.

d) Proper safety measures to be taken as to avoid accidents that may cause damage to

material and injury to persons working.

e) The scrap shear machine will be dispatched painted with primary paints. The intermediate and final painting to be done by the contractor at site as per required thickness in micron.

f) Earthling of various electrical equipment to scrap shear machine structure as specified to be completed.

g) The contractor shall supply all consumable and auxiliary materials like soldering flux, electrodes, insulation materials, PVC tapes and other sundry materials needed for the completion of erection as per specification given by HEC.

h) All scrap shear machine structures, mechanical and electrical equipment shall be stored and handled in such a manner that they are not subjected to damage or excessively stressed due to mishandling and / or environmental conditions.

i) Erection and alignment of electrical items including motors, brakes, electrics items

bases.

j) Initial requirement of lubricant including replacement during erection and commissioning work will be done by the contractor.

k) The contractor shall carry out the work in accordance with relevant IS, IPSS standards, Indian electricity rules and the drawing data information, instructions furnished by the manufacturer. Painting of the scrap shear machine shall be as per General Specification. The testing and commissioning of the scrap shear machine shall be done in presence of the representatives of the manufacturer, consultant and the end user.

l) While conducting tests on the scrap shear machine, the contractor shall not be held responsible for any manufacturing short comings of shops but shall be held responsible for defective workmanship carried out during the erection work. The contractor shall arrange slings, wire ropes, cradles to support test load wherever necessary, stop watches and other necessary equipment/ instrument to carry out the work. The contractor shall be responsible for transporting. Loading/ unloading of test loads from other shops of BSP, Bhilai to the test site and return them back to the respective shops after the load test is over. The contractor shall also be responsible to stack the test loads suitably for load test.

m) Acceptance Test parameters to be achieved by the contractor during PG and

acceptance test. The erection, alignment & assembly should be such that all the technical parameters as given in the drawing are properly met. Manufacturers including electrics supplier shall actively help in achieving the test parameters.

2.2 ERECTION SEQUENCE:

Tenderer may visit the site to see the site condition & to have an idea of similar existing

system for better understanding. Keeping in view the overall time schedule, the tenderer has to submit the sequence of erection along with realization schedule by the tenderer.

2.3 INSPECTION, TESTING & COMMISSIOINING

The tenderer shall conduct all tests required to ensure that the equipment furnished shall confirm to requirement of the specification and in compliance with the requirements of the applicable codes. Necessary test certificate shall be submitted.

2.4 TESTS AT SITE BY ERECTION CONTRACTOR

The scrap shear machine after erection shall be tested as given below:

a) No Load test:

After completion of erection, scrap shear machine shall be tested with no load to check the performance of the scrap shear machine and speeds, clearance, limit switch operation, no load current of motors, contacts, relays, interlock etc.

b) Performance Test: The scrap shear machine shall be tested with rated load for performance of machine with loaded condition.

c) Insulation tests and other tests mentioned shall be carried out as per the latest IS: 3177 & IS: 4137 (as applicable).

d) Any other tests which will be recommended/ Desired by HEC/BSP, Bhilai

The scrap shear machine shall be offered for inspection and testing during different stages of its erection.

2.5 ACCEPTANCE TEST:

a) The contractor shall inform sufficiently in advance regarding readiness of acceptance tests and commissioning.

b) The tests shall be carries out in presence of the HEC representatives. HEC further may invite Customer’s representative and consultant’s representative.

c) After scrap shear machine erection has completed, visual inspection will be jointly made by the contractor, manufacturer and the purchaser (HEC). The defects and shortcomings found during visual inspection shall be rectified by the contractor.

d) After the power supply has been connected and before the complete scrap shear machine installation is put to load test, tests shall be carried out to

i. The satisfactory operation of all protective devices.

ii. The satisfactory operation of scrap shear machine.

iii. The compliance of the scrap shear machine with the specified performance requirements

e) When conducting acceptance tests, erector shall provide his own operator. However, the end customer shall be entitled to employ his own operator, if he so desires.

f) A certified copy of the test figures shall be submitted to the end customer / consultant for his approval and record before acceptance of the scrap shear machine. After acceptance of scrap shear machine, 15 copies of performance reports in bound volumes shall be furnished to the end customer within four weeks.

2.6 PAINTING

All parts/ equipments of the scrap shear machine shall be thoroughly cleaned of all loose scales, rust of foreign matter before painting. If required after erection at the site, the contractor shall carry out cleaning and repainting. a) After erection the damaged portion occurred due to transport or erection or

welding works shall be retouched and then one final coast shall be applied with primer.

b) Color scheme shall be as approved by the end customer.

2.7 LIST OF DRAWINGS & DOCUMENTS

The referential G.A drawing of equipment will be available at the Head office after giving request letter for it.

CHAPTER-3

COMMERCIAL TERMS & CONDITIONS

3.0 GENERAL INFORMATION TO TENDERER

a) All correspondences/ documents made by the tenderer shall be in English Language and the data/measurement related results in Metric Units only, unless otherwise specified.

b) Tenderer shall quote as per performa. If any part / portion of scope are excluded from his offer, the same shall be brought out clearly in the offer and the quotation of the tenderer may be liable to get rejected.

c) Tenderer shall submit credentials of past works done.

d) During the course of execution of the contract, the department has the right to award additional work or deletion of work or advise removal/ repair /re-fabricate the work already executed.

e) Technical specifications, drawings and bill of materials to be the basis of content of work, assignment and defining responsibility. Tenderer may suggest any improvement for the betterment of the operation of the system, which shall be reviewed by HEC and appropriate action should be taken.

f) The offer shall clearly indicate any assumption made in respect of specification, data or any other details that have not been mentioned in this tender but considered necessary for meeting the specified functional and duty requirements. Any such assumptions not indicated during tendering stage, will not be binding on HEC.

g) Approval of various procedures submitted by the successful tenderer shall not relieve the tenderer of his responsibilities towards completion of work as defined in the contract. During the course of execution, if any additions/ alterations are found necessary and intimated to the tenderer before fabrication/installation of the equipment, the same shall be implemented by the tenderer without any extra cost.

h) All necessary facilities including tools, tackles, safety appliances, measuring & testing equipment/ instruments, accessories & material handling equipment, etc. shall be provided by the successful tenderer to enable stage wise inspection of the system during erection, testing & commissioning at site.

i) The Successful tenderer shall be solely responsible for obtaining necessary clearance from various statutory bodies including those of Central & State Government, as applicable, during the course of manufacture / fabrication, testing, transportation, erection and commissioning of the equipment at site.

3.1 CONTRACT PRICE

In accordance with Scope of Work & Services indicated in technical specifications of the tender paper the tenderers are to furnish their offer in the format given at Annexure – A.

3.2 PRICE BASIS

a) The basic price to be indicated for total equipments. All taxes & duties, levies, royalty, cess, including works Contract tax and surcharge there on if any, as applicable in the state and insurance charges for storage cum Erection etc. to be shown separately in the given Performa.

b) Contract Price shall remain firm and binding and shall not be subject to any escalation on any account whatsoever except for statutory variations of taxes & duties within contractual completion. Reimbursement will be made against submission of documentary evidences.

c) The Contract Price stated in above shall includes special tools & tackles, instruments, appliances for erection, operation and maintenance, etc. till erection, testing, successful Commissioning and handing over of the plant & equipment to end user.

d) The contract Price includes cost of storage-cum-erection insurance, handling of materials, storing, conservation and re-conservation fees and all expenses of the Contract.

3.3 TERMS OF PAYMENT

a) 10% of total work order value on prorata basis on unloading, safe storage and receipt of

materials at site. b) 40% of total work order value on prorata basis on placement of receipted materials on

foundation, erection, alignment and production of inspection certificate from the HEC/BSP, Bhilai.

c) 30% of total work order value on prorata basis on completion of testing of equipment on production of inspection certificate from the HEC/ BSP, Bhilai.

d) 5% of total work order value on issue of PAC by BSP, Bhilai. e) 5% of total work order value on issue of CC by BSP, Bhilai. f) 5% of total work order value on issue of Performance Guarantee Test certificate by BSP, Bhilai. g) 5% of work order total value on issue of FAC by BSP, Bhilai.

(Payments will be made on Running bill basis on certification of the works by HEC site engineer and as per GCC of HEC). Statutory payment shall be made subject to submission of challans/documents.

3.4 PAYING AUTHORITY:

Finance Department Heavy Machine Building Plant, Heavy Engineering Corporation Limited, Ranchi- 834004

The R. A. bill to be submitted (in Quadruplicate) with proper documentation.

3.5 GENERAL CONDITION OF CONTRACT

Tenderer shall abide by the General condition of contract of Heavy Engineering Corporation Ltd. Ranchi, a copy of GCC of Works Contract can be downloaded from the site www.hecltd.com for ready reference.

3.6 STORAGE

All materials, equipment supplied by manufacturer shall have to be properly unloaded and stored by the contractor at proper erection site / HEC site store. Contractor will be responsible for making suitable permanent storage facilities to store components / materials. The bidders will make their own security arrangement for men, material etc.

Any loss or damage to the equipment during handling, transportation storage, erection and all other activities to be performed till such time the equipment is taken over by end customer shall be in the account of contractor and he shall be liable to make good of them.

3.7 MAN POWER

Necessary manpower has to be deployed by the contractor at different locations as per the program agreed / approved by HEC. To achieve the target, contractor may have to mobilize additional man-hours and / or deploy work force for additional hours without any extra cost to HEC. Any statutory requirement for additional working hours or any manpower related issue shall be total responsibility of contractor.

3.8 INSPECTION Erection testing & commissioning will be inspected by HEC along with or without the representative of end customer / customer’s consultant. Contractor shall provide necessary assistance in carrying out inspection and if any defects are pointed out, they will carry out the necessary rectification / modification without any extra cost to HEC. Bidders will deploy sufficient manpower during pre and final inspection and handing over the entire jobs and a protocol will be drawn based on which the job will be accepted.

3.9 RECONCILATION OF FREE ISSUE ITEMS

Bidders will submit reconciliation statement of free issue items if any, on monthly basis, failing which no progressive payment shall be released. However any supply to contractor by the purchaser, which was originally in the scope of contractor will attract recovery with 22.5% overhead charge.

3.10 STATUTORY RECOVERIES

Statutory recoveries if any shall be made as per rule/rates prevailing at working site.

3.11 GUARANTEE PERIOD The contractor shall stand full guarantee for workmanship / service for a period of one year from the date of commissioning and acceptance of the system at site.

3.12 SUBMISSION OF TENDER: The tender is to be submitted in Three Bid.

EMD (Earnest Money Deposit) the tender shall comprise Demand Draft of EMD (Earnest Money Deposit. Offer without EMD will not be considered and will be rejected. Tender comprising Techno Commercial offer which shall cover all technical part as well as commercial terms.

a. Tenderer shall furnish copy of all statutory obligations of Government of India, State Government applicable at site such as labour rules, minimum wages act, & payment of wages, etc. and the purchaser shall not be liable for any action on statutes applicable to non-fulfillment of statutory obligations by the bidders.

b. Tenderer shall must attach/furnish copy of followings:-

1. PAN No., 2. Labour License 3. EPF registration No. 4. Income tax clearance duly counter signed by income tax officer of the circle

concerned under the seal of the office. 5. Sales tax clearance certificate. 6. Service Tax Registration no. 7. Registration of firms with HEC/ any other Govt./ Semi Govt. Organization. Copy

of same to be enclosed. c. Experience of similar type of work executed during the last three years. Details

with value, name of the client etc. are to be mentioned enclosing documentary evidences. Completion certificate is MANDATORY.

d. Constitution and legal status of the tenderer (individual, partnership, co-operative, registered firm etc.), existence of joint ventures or other tie up for technology, equipment, financial backing and / or project management etc. to clearly mention with copy of supporting documents along with the offer.

e. Details of necessary equipment /facility for the job under this tender to be deployed for the project and proof of its availability, equipment proposed to be purchased or hired are to be attached with this offer.

f. Availability of key personnel for supervision and management of the work indicated. g. Information regarding project in hand, current litigation, orders regarding

execution/expulsion or back listing if any to be furnished. h. Capacity of the tenderer to take up a new work/ project under consideration in

addition to his present commitment.

PRICE BID - The Tender shall comprise Price Bid only as per the format enclosed with tender as annexure- A.

Offer without EMD will not be considered and will be rejected. The price bid shall be opened only after the Techno Commercial terms are settled and accepted. If the tender is bulky & voluminous the tenders are to be handed over to the following persons against receipt date & time:

3.13 ACCEPTANCE OF TENDER:

Tender may be accepted for full. Any incomplete tender in any respect is liable to be rejected without any notice. The company is having rights to reject any tender without assigning any reason for which no question can be asked anywhere.

There is no obligation on our part to accept delayed/ late tender received after the due date of opening of tender and these are liable to be summarily rejected.

Tenderer shall return the tender documents along with the tender duly signed & stamped on each page as a token of acceptance.

3.14 EARNEST MONEY DEPOSITION (EMD)

EMD shall be Rs. 70,000/- (Rupees seventy thousand only) and to be submitted in the form of DD in favour of:

Earnest Money of unsuccessful bidders will be refundable immediately after finalization of contract on receiving a written request from the bidders. For the successful tenderer, the Earnest Money will be converted to Security Deposit. No interest will be payable on Earnest Money and Security Deposit. Exemption from deposition of Earnest Money and Security Deposit for Small Scale Industries (SSI) or any other category will be guided as per prevailing Government directives on production of documentary evidence in its support.

3.15 SECURITY DEPOSIT

Security Deposit shall be 10% of the basic value of erection, commissioning and testing. Earnest Money of the successful bidder will be converted to Security Deposit. The remaining Security Deposit should be deducted at the rate of 10% from the running bills. In the event of non-execution of the contract or withdrawal before expiry of validity period, the EM/SD will be forfeited. The total security deposit will be converted into retention money for one year from the date of completion of the project.

3.16 LIQUIDATED DAMAGES

If the tenderers fails to complete the work within the stipulated time fixed in the order, the tenderers shall be liable to pay to the purchaser as agreed liquidated damages and not by way of penalty a sum of 0.5% of the total contract price per weeks of delay or part thereof by which the completion of work has been delayed, subject to a maximum limit of 10% of the total contract price as per GCC.

3.17 FORCE MAJEURE

Time being the essence of the contract, if either party is prevented from the Performance of its obligations in whole or in part for reasons of Force Majeure, viz acts of God, acts of Government, acts of Public enemy, war, hostility, civil commotion, sabotage, fire, flood, explosion, strike, and lawful lockout, then provided notice of happening of any such eventuality is given by the effected party to the other party immediately & maximum within 15 days from the date of occurrence and cessation of the force majeure, the period of Force Majeure shall be excluded accordingly. If the Force Majeure event(s) continue beyond the period of 3 months, the parties shall hold consultation to chalk out the further course of action. Neither party can claim any compensation from other party on account of Force Majeure.

3.18 ARBITRATION

a) All Disputes or differences, whatsoever, arising between the parties out of or in relation to the construction, meaning and operation or effect of this Contract or breach there of shall be settled amicably. If, however, the parties are not able to resolve them amicably, the same shall be settled by arbitration in accordance with the Rules of Arbitration of the Indian Council of Arbitration as per the provision of Arbitration Conciliation Act 1996 and the award made in pursuance there of shall be binding on the parties. The Arbitrator /Arbitrators will give reasoned award.

b) Work under the contract shall continued by the Bidders during arbitration proceeding unless otherwise directed in writing by HEC/ BSP or unless the matter is such that work cannot be continued until decision of the arbitrators or of the umpire , as the case may be, is obtained and save as those which are otherwise expressly provided in the contract, no payment due or payable by the purchaser shall be withheld on arbitration proceeding unless it is the subject matter or on the subject matter thereof.

c) The Venue of arbitration shall be Ranchi, Jharkhand

3.19 RISK AND COST

If the bidders fail to complete the work and comply with notice given in this regard within the period as considered reasonable for such compliance from the date of serving the notice, then in such case without prejudice to purchasers right under this clause the purchaser shall have at his option to take the affected work wholly or in part out of the bidder’s hand and may complete the work at the risk & cost of the bidder.

3.20 NO CLAIM OR COMPENSATION FOR SUBMISSION OF TENDER

The Tenderer whose offer is not accepted shall not be entitled to claim any costs, charges, expenses or and incidental to or incurred by him through or in connection with his submission of Tenderer, even though HEC Ltd may decide to withdraw the invitation of Tender. No price ESCALATION will be considered for successful tenderer till completion of the project.

3.21 NOTICES ON BEHALF OF HEC LTD

Notice and certificate on behalf of HEC LTD in connection with the Work order may be given by duly authorized officers of HEC LTD. Any modification which may become necessary in the interim period will be intimated to you as soon as possible.

3.22 CONTRACTOR’S RISK The contractor is responsible for the expected risks, which are: A) War, hostilities, invasion, act of foreign enemies, rebellion, revolution, insurrection

of military or usurped power, or civil war; B) Riot, commotion, disorder, unless solely restricted to employees of the contractor. 3.23 JURIDICTION OF COURT The issue shall be under the jurisdiction of Ranchi High Court. 3.24 PRICE ESCALATION:

No price escalation is admissible for execution of the scope of work after issue of LOI/work order. No extra payments shall be admissible to the contractor, consequent on any alleged misunderstanding or miscalculation or arising of any other mistake or factor not specifically provided in the offer.

3.25 AN AGREEMENT

An agreement will have to be signed with HEC Ltd. on a non-judicial stamp paper of value Rs 50/- (Rupees Fifty only) purchased by you from the state of Jharkhand in a standard performa within fifteen days. Failure to execute an agreement within specified period may entail forfeiture of security deposit.
