INTRODUCTION

Madhya Pradesh Tourism Development Corporation Limited also referred to as the “MPSTDC” or “Authority”, is a nodal agency under Department of Tourism, Government of Madhya Pradesh with a mandate to develop tourism infrastructure in the State of Madhya Pradesh. MPSTDC is operating various hotels and tourist complexes in the State of Madhya Pradesh for providing boarding & lodging facilities to the tourists. MPSTDC invites to submit bids UNDER SINGLE BID SYSTEM for supply of DTH SYSTEM with latest technology for its hotels located in different locations (the list of hotels is provided in Annexure D) of the State with following details:

Bid must be submitted within above stipulated date and time indicating rate as per the bid forms. The bid must be valid for 120 days from the final date of bid closing. Bid through Telex/Fax/Telegram will not be acceptable. MPSTDC assumes no responsibility for delay, loss or non-receipt of bid document sent by post.

GENERAL TERMS & CONDITIONS 1. “Bidder should be either a DTH service provider or an authorized representative of DTH service

providers. In case bidder is an authorized representative, valid authorization certificate issued by the original DTH service provider shall be submitted with bid”. Only one authorized represntative from each DTH operator shall be allowed to participate in the bid, incase more than one authorised representative participate in the bid, then the DTH operator shall not be eligible to participate in the process.

2. The DTH system should be with latest picture technology MPEG-4 and sound technology DVBS-2.

3. The DTH Operator should have registration for Service Tax.

4. The operator should have all the licences for DTH Operation.

5. Bidders are advised in their own interest to ensure that their bids reach this office well before the closing date and time of the bid as the bids received after the closing date and time of the bid will not be considered. Please confirm that you have received the bid document and will be quoting or the bid items/jobs. In case you are not quoting for the same, please return complete set of bid documents.

6. Any change in bid after opening of the bid will not be considered. Bids received by fax/e-mail/telex shall not be considered.

7. Quotation, duly sealed & super scribed with the bid number, bid opening date and the words ‘QUOTATION – DO NOT OPEN’, should reach this office on or before 1500 hrs on the due date of opening along with samples, if required, failing which your offer will not be considered. Quotations received late are liable to be rejected. Quotations will be opened on the due date at 1530 hrs in the presence of bidders/authorized representatives of bidders, who may intend/like to participate. Quotations received late by post or other means are liable to be rejected. MPSTDC will not be responsible for the loss of bid document or for delay in postal transit.

8. Validity of offer: Minimum 120 days from the date of opening of bid.

9. Warranty: 12 months from date of commissioning / 18 months from date of dispatch, whichever is earlier.

10. Rate should be quoted inclusive of all taxes according to unit mentioned in document and no alternative unit will be considered.

11. The validity of prices in financial bid should be for a minimum period of three years. If the bidder withdraws the bid during the validity period, the EMD will be forfieted.

12. The Technical specification sheet (ANNEXURE-C) enclosed with bid document must be filled-up in all respects duly signed (and sealed) and submitted with the UNPRICED bid. Bids with incomplete / blank specification sheet shall be treated as non-responsive bid and liable for rejection.

13. Discount/Rebate: No separate discount/rebate shall be indicated anywhere in the bid document. Any discount/rebate offered by the bidders shall be included in the quoted rates itself, in the Price Schedule Format, enclosed with bid document. Discount, if any, indicated in the offer, will

not be considered while evaluating the bid.

14. Bidders who are desirous of being present during the bid opening, may come in person or send their authorized representatives (with authorization letter signed by authorized signatory) on the due date and time of opening.

15. The list of MPSTDC units and tentative number of connections required in each unit is provided in Annexure D. The number of connections may vary as per requirement.

16. The new conncetions shall be provided at the same rate.

17. The DTH Operator shall bear all cost related to full repair/maintenance.

18. The comparison between the bids will be done on minimum channels basis.

19. Either party can leave contract after giving a notice of three (03) months.

20. The payment will be made in advance for six months period on per connection per month basis.

21. The Earnest Money Deposit (EMD) of the selected bidder will be converted into Security Deposit for a period of 3 years on which no interest will be paid.

22. MPSTDC reserves the right to accept/reject any or all bids without assigning any reasons whatsoever.

23. The DTH Operator/his distributor shall provide services all over Madhya Pradesh.

24. Any expenditure and/or demurrage incurred in respect of a wrong delivery shall be recovered from supplier.

25. Incase of discontinuation of a paid/un paid channel due to any circumstances, the same shall be substituted by the mutually agreed another paid/un paid channel accourdingly.

26. The DTH Operator shall take and provide all safety measures and will be responsible for all mishaps/mischief etc. resulting from such cable lying and shall indemnify MPSTDC/ individual against any risk arising out of the same.

27. The authorized DTH Operator or his employees will not, at any time cause or permit to cause any nuisance at the premises licensed or do anything which shall cause disturbance to the subscribers of MPSTDC.

28. The DTH Operator shall duly comply with all instructions issued by MPSTDC from time to time.

29. ARBITRATION

In case of any dispute, the provisions of Indian Arbitration & Conciliation Act, 1996 and the rules framed there under shall be applicable.

30. All issues between the MPSTDC and Bidder will be under the jurisdiction of session court of District Bhopal.

connection cables will be supplied by the DTH operator).

6. The DTH Operator shall bear all cost related to full repair/maintenance.
