The Olympic Container Terminal and North and South intermodal rail yards exceeded the Depart- ment of Ecology's stormwater benchmarks for zinc, a common culprit in maritime industrial settings due to the high concentration of galvanized metals and container coatings. As a result, the Port must upgrade stormwater treatment at these sites by the end of 2014. Following the action agenda, commissioners will hear the results of a recent public opinion survey of 500 Pierce County citizens on their views about economic development, transportation and the role of the Port. According to bid documents, the project in- cludes the new construction of concrete path- ways, concrete stairs with railings, a flag pole and base, and underground electrical service and system elements. Optional items include new park benches, the planting of an ever- green tree, topsoil and ground cover plantings, and a decorative concrete border curb. Ray C. meeting agendaThe Port of Tacoma Commission is expected this

week to consider the construction of stormwater treatment facilities on three Port sites.

The Olympic Container Terminal and North and South intermodal rail yards exceeded the Depart-ment of Ecology's stormwater benchmarks for zinc, a common culprit in maritime industrial settings due to the high concentration of galvanized metals and container coatings. As a result, the Port must upgrade stormwater treatment at these sites by the end of 2014.

Following the action agenda, commissioners will hear the results of a recent public opinion survey of 500 Pierce County citizens on their views about economic development, transportation and the role of the Port.

The Port of Tacoma Commission meeting will be held on Weds., Feb. 12, at noon in Room 104 of the Fabulich Center, 3600 Port of Tacoma Road. Meet-ings are streamed live online at portoftacoma.com.

Former Commissioner Bottiger dies at age 81

Former Port of Tacoma Commissioner R. Ted Bot-tiger died Jan. 23 at the age of 81. He served on the commission from 1997 to 2009.

Before joining the Port, Bottiger served more than two decades in the Washington State Legislature, spending his last � ve years as the Senate majority leader. He went on to serve on the Northwest Power Planning Council.

The south Tacoma native graduated from the University of Puget Sound and University of Wash-ington School of Law. He served four years as Wash-ington state's assistant attorney general and spent 23 years in private legal practice.

ery, vehicles, equipment and all other property of any kind now or hereafter located on the Real Property, used or intended to be used on the Real Prop- erty wherever actually located, or pur- chased with the proceeds of the Note (as defined herein), and all rights of Borrower as lessee of any property described in this paragraph (f) or any of the above subsections. The default(s) for which this fore- closure is/are made are as follows: Defaults under the Loan Agreement

Under Section 6 of the Loan Agree- ment an event of default under the Note or Deed of Trust is a breach of the Loan Agreement. The Note has matured. Because the Borrower has failed to pay the Note, the Borrower is in default under the Loan Agreement.Defaults under the Note Section 2 of the Note required the Borrower to pay monthly interest on the principal bal- ance of the loan at a rate equal to the rate the Beneficiary paid for borrowed funds, plus an additional $15,000 per year payable in monthly installments of $1,250.00. The Borrower paid month- ly interest to the Beneficiary as it ac- crued through July 1, 2010, but the Borrower failed from the inception to make any of the required monthly pay- ments of $1,250.00. After July 1, 2010, the Borrower made no further interest payments. The failure of the Borrower to make such payments is a default under the Note.The Borrower obligated itself under Note to satisfy the Note in full when it matured on August 5, 2009. The Bor- rower is in default under the Note for failure to pay the indebtedness evi- denced by the Note upon the Note’s maturity. Defaults under the Deed Of Trust: The Deed of Trust by its terms secures all of the Borrower’s indebt- edness and obligations under the Loan Agreement, the Note and/or under the Deed of Trust itself. Article V of the Deed of Trust makes it an event of de- fault for the Borrower to fail to pay sums as and when due under the Loan Agreement and/or the Note. As indi- cated above, the Borrower failed to satisfy the Note when it matured, and thus the Borrower is in default under the Deed of Trust. Article III, Section 4(a) and Article III, Section 5 of the Deed of Trust required the Borrower to pay real property taxes and keep the property free of liens. The Borrow- er defaulted on this obligation as well, failing to pay any real property taxes assessed against the property after 2008. The Beneficiary paid the Pierce County Treasurer the amount payable for real property taxes (plus interest and penalties) that had accumulated since 2008 and in 2012 to prevent the property from being sold at a tax fore- closure sale. The Beneficiary made payment in the amount o f $79,799.62, on October 24, 2012. The Beneficiary also paid the 2013 real property tax in the amount of $14,528.93. Under Article III, Section 13 and Article III, Section 16 of the Deed of Trust, the tax payments made by the Beneficiary are treated as ad- vances bearing interest at the rate provided for by the Note, and under A r - ticle I, Section 5(b) of the Deed of Trust that additional indebtedness is part of the debt secured by the Deed of Trust. IV. The sum owing on the ob- ligation secured by the Deed of Trust as of August 1, 2013 is: Principal $3,120,000.00, plus $130,000.00 in unpaid monthly payments, plus ac- crued and unpaid interest in the amount of $268,363.32, plus interest- bearing amounts expended by the ben- eficiary to protect his interest in the amount of $94,328.55, plus $1,422.64 interest on interest-bearing amounts expended by the beneficiary to protect his interest and such other costs and fees as are due under the note or other instrument secured, and as are provided by statute. V. The above described real property will be sold to satisfy the expense of sale and the obligation secured by the Deed of Trust as provided by statute. The sale will be made without warranty, express or implied, regarding title, possession, or encumbrances on the 14th day of March, 2014. Because the entire re- maining principal balance of the obli- gation secured by the Deed of Trust, plus accrued interest was due in full on August 5, 2009, the Deed of Trust cannot be reinstated by making any unpaid monthly installments or pay- ments. Project Scope: This contract shall generally consist of installing approxi- mately 2500 ft. of sheet pile floodwall around the Southern and Northern por- tions of the Central Wastewater Treat- ment Plant. In addition, this project will consist of constructing 5 floodgates of which 3 will be automated, utility re- location, trench safety system, con- crete work, grading, restoration, new pump station system, valves, and all other work required to complete the Central Treatment Plant Floodwall as shown on the Contract Drawings and as specified in the Contract Docu- ments.

The lead agency for this proposal has made a preliminary determination that this project does not have a prob- able significant adverse impact on the environment. An environmental impact statement (EIS) is not required under RCW 43.21C.030(2)(9c).
