MEDICAL VISA Requirements for SURROGACY in India

For taking surrogacy treatment in India

for the couple who are from some other

country the couple needs to take a

Medical visa.

The foreign couple who are

married officially and are

living together at least for

two years.

The couple need to get a letter from the

foreign ministry of their corresponding

country or the embassy of the country

in India clearly mentioning that

• Surrogacy is recognized in that country

• The baby born through a surrogate mother to

the intended parents will be allowed as a

biological child to the couple.

guaranteed agreement that they

would take care of the baby born

through surrogacy.

An ICMR Recognized ART clinic is only

allowed for the treatment of Surrogacy. The

couple needs to take care of the clinic

whether it is recognized by ICMR or not.

A duly notarized agreement between the

surrogate mother and the intended couple

should be produced.

The visa application will be rejected if

any of the mentioned conditions are

not fulfilled.

The couple needs to take an exit visa from FRRO. Before granting

an exit visa the couple needs to carry a certificate from the ART

stating that the couple had taken the custody of the child and the

surrogate mother rights discharged from the child as per the

agreement. A copy of Birth certificate of the child also to be

produced in addition to the photocopies of the passport and visa of

the foreign couple.
