1. APS02586D.EdSt. Thomas College of Education, Nizamabad.

K.P. Education Society has submitted an application for seeking recognition for D.Ed course in the name and style of St. Thomas College of Education,Bodhan Revenue Division, H.No.1-4-846, Azam Gunj Achanpally village, Nizamabad, Andhra Pradesh – 503 185 on 03.02.2004.In the meanwhile the Govt of Andhara Pradesh of Hyderabad filed a Writ Petition No.22866/2005 in Hon’ble High court of Andhra Pradesh at Hyderabad challenging the notification of NCTE with regard to the dispensing with the requirement of NOC from the State Govt. The writ petition was allowed by the learned single judge with the directions that the rule excluding the State Govt. is bad.

Against the said Judgment a writ appeal No. 692/2006 was filed in the Division Bench of Hon’ble High Court of Hyderabad. Many discussions took place between the State Govt. of Andhra Pradesh and SRC-NCTE. However, neither the State Govt. withdrew the case filed by them, nor the stay was vacated.Thereafter, some institutions went to the court and filed petitions individually seeking directions for processing of their applications, in one of such writ petition No.8278/2008. The Hon’ble High court of Andhra Pradesh decided that the applications of the institutions shall be processed as per the NCTE rules and regulation, norms and standards existing as on date.

As per direction of Hon’ble High court the matter was placed in 164th

meeting of SRC and the Committee considered the pending matters of D.Ed institutions in the State of Andhra Pradesh and it was decided to process these applications according to the new norms and standards of NCTE as per direction of Hon’ble High court of Andhra Pradesh.

As per the directions of Regional Committee a deficiency letter was issued to the applicant institution on 30.09.2009, with a request to submit reply to the deficiency letter within 90 days as per section 7(1) of the NCTE Regulation 2007.

Earlier, SRC in its 135th meeting held on 7th –8th June, 2007 had decided

to treat the application which have not submitted compliance as closed after the expiry of 90 days of time as per the Regulation of NCTE, 2005. A letter dated 31.10.2008 was received from NCTE Hqrs. clarifying that all such cases where letter of deficiency was issued but no reply was received from the concerned institution within 90 days may also be closed in terms of section 7(1) of the NCTE Regulations.

The applicant institution had failed to submit the reply within 90 days and hence it was decided to close the application and letter closing the application was issued to the institution on 02.03.2009.

After that the applicant institution approached Hon’ble High Court of Andhra Pradesh in writ petition No. 22786/2009. In this regard, a suitable reply was forwarded to our legal counsel on 26.11.2009. The Hon’ble High passed an order dated 16.12.2009. However, the operative part of order as under:-“the writ petition is allowed and the impugned order is set aside. The respondent is directed to pass appropriate orders taking into account the compliance report by the petitioner to the deficiencies pointed out, in his letter 30.09.2008. This exercise shall be completed within la period of four (4) weeks from the date of receipt of a copy of this order. There shall be no order as to costs”.

The court order is received in SRC office on 12.01.2010. The institution has also submitted compliance report on 27.01.2010

The matter was placed before 188th meeting of SRC held on 28-29th

January, 2010 the Regional committee decided to cause Re-Inspection. The inspection report dt. 30.04.2010 was considered by SRC.

The Southern Regional Committee in its 192nd Meeting held on 10th and 11th May 2010 considered the Inspection Report and all the relevant records and decided to refuse recognition to the D.Ed. course for the following reasons:-

The built –up space is inadequate for offering both B.Ed. and D.Ed. courses, as per NCTE norms. Building is incomplete. The Building Completion Certificate submitted is not from the Government Engineer/Competent authority.

As per direction of Regional Committee refusal order issued on 25.06.2010.

The institution has now sent letter dated 16.07.2010 enclosing a copy of order dated 09.07.2010 in W.P.M.P. no. 17495/2010 in writ petition no.

13905/2010 wherein the Hon’ble High court has passed the following order.

The operative part of order is reproduced as under:-

“If the Committee feels that the report submitted by the Visiting Team has not reflecting the true picture, the Committee can record the reasons and reject the same. The order impugned in the Writ Petition does not reflect that they ignored the report submitted by the Visiting Team Members or the report submitted by the visiting team member is contrary to any of the information available with them.

“In view of the matter, there shall be interim direction to the respondent to reconsider the application filed by the petitioner seeking permission for commencement of the D.Ed course in its institution keeping in view the report submitted by the Visiting Team Members, as expeditiously as possible. I may also make it clear that if the committee feels that the report of the visiting team members is contrary to any other material placed before them, it is left open to the committee to disagree with the report submitted by the visiting team members by recording the reasons”.

It is not clear from this what the impugned order is. A copy of the WPMP No.17495/2010 as well as certified copy of the order dated 09.07.2010 called from the counsel in Andhra Pradesh. The institution has also submitted BCC certificate along with Building plan issued by Dy. Executive Engineer (R&B) Sub. Divn. Bodhan, approved building plan and photos of the building alongwith letter dated 16.07.2010.

The Southern Regional Committee in its 194th Meeting held on 21st and 22nd July 2010 considered the court orders, VT report, VCD covering the visiting team visit and all the relevant documents and decided as follows:-

1. As per the norms of NCTE, an institution should possess the land and building complete in all respects, at the time of making application itself.

2. The institution in question applied on 3.2.2004 for grant of recognition to D.Ed. course, claiming the possession of land and building. But when the Visiting team inspected the institution on 30.4.2010, i.e., over four years after the application, on Court orders, it was evident from the VCD that the second and third floor of the building meant for the proposed D.Ed. programme was still under construction(with only pillars and roof, with no walls/partition; a substantial work was yet to be done) as per the VCD evidence.

3. The institution had obviously given an evidence, apparently contrary to truth, in the form of a Building Completion Certificate(BCC), from a Government Engineer issued on 26th June, 2010. This BCC given by the Government Engineer states that the building including the second and

third floors was constructed as early as in the year 2003, whereas the VCD evidence of the visit recorded on 30.4.2010(i.e., seven years later) showed that the building was in no way complete. The top two floors had nothing but pillars and roofs.

4. The visiting team, which inspected, was also caught very much in the VCD inspecting the empty shell of the top two floors under construction. But, unfortunately, the visiting team failed to bring out the factual position regarding building under construction in the Report. For such a serious omission, the visiting team members are being blacklisted and debarred from any NCTE assignment.

Based on careful scrutiny of the visiting team report and related evidence, and on the irrefutable VCD evidence on hand, the SRC took a considered decision to reconfirm the earlier decision of refusing the recognition for D.Ed. programme to the said institution.

NCTE-Hqrs vide appeal order dt.02.01.2011 after perusal of documents , memorandum of appeal , affidavit VT report and after considering oral arguments advanced during hearing , the Council reached the conclusion that there was no ground to accept the appeal and hence it should be rejected. Accordingly , the appeal was rejected and RC’s order dt.01.09.2011 was confirmed.

The Institution has filed a Writ Petition No. 12708 of 2011 in the Hon’ble High Court of Andhra Pradesh for rejecting grant of recognition by NCTE. Wherein the Hon’ble High court has passed an order dt. 28.07.2011

The operative part of order is reproduced as under:-

“The Petitioner is aggrieved by the action of the respondent in not granting recognition to the petitioner for setting up B.Ed College of Bodhan in Nizamabad district

Learned counsel for the petitioner submits that the institution had applied for grant of permission of B.Ed College on 03.02.2004, his building was inspected by the respondents. However , the same was not found to be complete.

Learned counsel for the petitioner submits that now, the building is complete in all respects. He has referred to the photographs, which he has annexed along with the writ petition, and prays that the respondents be directed to conduct fresh inspection.

Learned counsel for the respondents 1 and 2 submits that the petitioners may, however, apply to the respondents again and on receipt of the application afresh, inspection would ne carried on.

After hearing the learned counsel for the parties, the Writ petition is disposed of with a direction that the petitioner may apply to the respondents afresh and on receipt of such application, the inspection may

be carried on within a period of eight weeks (8) from the date of such receipt and take appropriate decision accordingly. No costs”

Note: As per Supreme Court Judgment dt.31.01.11 in the matter of Civil Appeal No. 1125-1128/2011 in SLP No. 17165-68/2009 filed by NCTE in the matter of Bhanwar Kanwar Sing Shiksha Mahavidhyalaya and other case it is mandatory that NCTE Act & Regulations be adhered to strictly.

The Institution has submitted the above Court order along with hard copy of application which is not submitted online and other documents for consideration.

The Committee considered the application of the institution, Court direction directing the institution to apply afresh and decided that the old application is rejected and the case related to thereto is closed. The Court-order specifically requires the petitioner to apply “afresh”. The Committee will consider the case again if the petitioner chooses to apply again observing all the NCTE guidelines.

2. SRCAPP276B.EdPavlov College of Teacher Education, Karimnagar.

Pavlov College of Teacher Education, No.90, 91, 316, Vedira, Ramdugu, Karimnagar-505451, Andhra Pradesh. Velankani Matha Educational Society, P.No2-10-1716, Street No.7, Chaitanya puri Village, Karimnagar- 505 002, Andhra Pradesh had submitted an application for grant of Recognition to Pavlov College of Teacher Education, No.90, 91, 316, Vedira, Ramdugu, Karimnagar-505451, Andhra Pradesh for B.Ed Course.

The Application was scrutinized and a copy of application was sent to State Government for recommendation on 09.11.2010/02.02.2011. A deficiency letter was issued to the institution on 09.12.2010. The institution has replied to the deficiency letter in 07.02.2011.

Southern Regional Committee in its 202nd Meeting held on 14th and 15th

March 2011 considered the reply of the Institution and decided cause inspection under section 14 of NCTE Act. The inspection was carried out on 30.03.2011. The Inspection report has been received along with VCD to SRC – NCTE on 06.04.2011

The Southern Regional Committee in its 204th Meeting held on 27th and 28th April 2011 considered the VT Report, VCD and all the relevant documentary evidences and it was decided to serve the Show cause Notice for the following:

As per VCD, the building is incomplete and 2nd floor of the building is not shown in the VCD. As per VCD observation the building is still under construction and

incomplete at the time of application/inspection. The earmarked area for each course i.e., B.Ed & D.Ed is to be given. The purpose/utilization of the 2nd floor should be given with details.

As per direction of SRC, Show Cause Notice was issued to the applicant institution on 26.05.2011. In response to notice dated 26.05.2011 the institution has submitted reply vide letter dated 31.05.2011.

The Southern Regional Committee in its 208th Meeting held on 13th and 14th July 2011 after going through the reply of institution dt. 31.05.2011, come to the conclusion that the reply is not satisfactory and not convincing and hence, the recognition is refused for the following reasons:-

As per the VCD the building is incomplete and the 2nd floor of the building is not shown in VCD . As per the NCTE Regulation the building should have been completed on the date of application.

Refusal order dt.25.08.2011 was issued to the institution as per the decision of SRC. The institution preferred for an appeal at NCTE- Hqrs. Original file was sent to NCTE- Hqrs on 15.09.2011.

Meantime the institution has filed a Writ Petition in the Hon’ble High Court of Andhra Pradesh at Hyderabad. The Hon’ble High Court has passed an order dt. 22.09.2011 in WPMP No. 30100 of 2011 in WP No.24508 of 2011 as follows:

“ It is the case of petitioner that even though it has rectified all deficiencies, the committee failed to consider the same by taking into consideration the material placed and thereby has come to an incorrect conclusion. According to the petitioner, a certificate issued by Assistant Engineer, Municipal Corporation, Karimnagar would clearly show that it has completed construction of the building as per the requirements of the Regulations. Therefore, the grounds stated in the order of rejection are not tenable: and had the respondent taken the material into consideration, it would not have resulted in the rejection

On a consideration of the aforesaid facts and material placed on record , prima facie, the contention appears to be tenable

In this circumstances, there shall be interim direction to the respondent to reconsider the application of the petitioner in the light of the material already submitted and pass an appropriate order in accordance with law as expeditiously as possible preferably within a period of four weeks from the date of receipt of a copy of the order.”

Before approaching the Court with the writ petition, the petitioner had also appealed to the NCTE (HQ). The Appellate Authority had

requisitioned all the relevant records in connection with the appeal and the original file was sent to NCTE Hqrs on 15.09.2011.

The committee considered the Court direction and decided that for verifying the records on the case file, as directed by the Court, therefore, it will be necessary for the Southern Regional Committee to first recall the records from the Appellate Authority. After receipt of the records, the office shall examine the Asst. Engineer’s report with reference to the Visiting Team Inspection Report and place the case for consideration by the Committee.

3. SRCAPP290B.EdSiddipet College of Education, Medak.

Siddipet College of Education, Prasanth Nagar, Siddipet, Medak-502103, Andhra Pradesh. Golkonda Educational Society Plot No.12-5-92/1 Ganesh Nagar, Siddipet village and Psot Office, Medak- 502 103 Andhra Pradesh has submitted an application for grant of recognition to Siddipet College of Education, Plot No. 1381, Prasanth Nagar, Siddipet, Medak-502103, Andhra Pradesh for B.Ed Course.

The Application was scrutinized and a copy of application was sent to State Government for recommendation on 09.11.2010/02.02.2011. A deficiency letter was issued to the institution on 09.12.2010.The inspection of the institution was conducted on 01.04.2011.

The Southern Regional Committee in tis 204th Meeting held on 27th and 28th April 2011 considered the VT Report, VCD and all the relevant documentary evidences and it was decided to serve Show cause Notice. for the following:

Building Completion Certificate from Competent Government Engineer is to be submitted. From VCD observation, it is observed that the building is incomplete and still under construction at the time of application/inspection/visit. Language learning lab is not available.

As per direction of SRC SCN was issued to the applicant institution on 27.05.2011. In response to this office letter dated 27.05.2011 the institution has submitted reply vide letter dated 24.06.2011.

The Southern Regional Committee in its 208th Meeting held 13th and 14th

Refusal order dt.29.08.2011 was issued to the institution as per the decision of SRC. The institution preferred for an appeal at NCTE- Hqrs. Original file was sent to NCTE- Hqrs for appeal on 15.09.2011.

Meantime the institution has filed a Writ Petition in the Hon’ble High Court of Andhra Pradesh at Hyderabad. The Hon’ble High Court has passed an order dt. 22.09.2011 in WPMP No. 31899 of 2011 in WP No.25874 of 2011 as follows:

“ It is the case of petitioner that even though it has rectified all deficiencies, the committee failed to consider the same by taking into consideration the material placed, including fresh VCD and thereby has come to an incorrect conclusion. Accordingly to the petitioner, as certificate issued by Deputy Engineer, Panchayat Raj Department would clearly show that construction of the building is completed in all respects as per the requirements of Regulations. Therefore, the grounds stated in the order of rejection are not tenable: and had the respondent taken material consideration, it would not have resulted in the rejection

On a consideration of the aforesaid facts and material placed on record , prima facie, the contention appears to be tenable

In this circumstances, there shall be interim direction to the respondent to reconsider the application of the petitioner in the light of the material already submitted and pass an appropriate order in accordance with law as expeditiously as possible preferably within a period of four weeks from the date of receipt of a copy of the order.”

Before approaching the Court with the writ petition, the petitioner had also appealed to the NCTE (HQ). The Appellate Authority had requisitioned all the relevant records in connection with the appeal & the original file was sent to NCTE Hqrs on 15.09.2011.

4. APS03719B.EdB.T.L. College of Education, Bommasandra, Bangalore.

B.T.L. College of Education, 259/B, Bommasandra Industrial Area, Hosur Main Road, Bangalore-560099, KarnatakaB.T.L. College of Education, No.259/B, Bommasandra Industrial Area, Hosur Main Road, Bangalore-560099, Karnataka had submitted an application for grant of recognition on 20.12.2004. The institution was granted recognition for offering B.Ed course with an intake of 100 students vide order dated 30.01.2006. The inspection of the institution was conducted on 22.04.2010 U/s 13 of

KA NCTE Act and NCTE, Hqrs vide its letter dated 22.09.2010 has forwarded a copy of the inspection report dated 22.04.2010 conducted Under Section 13 of NCTE Act. As there are deficiencies pointed out in the inspection report, NCTE, Hqrs has requested SRC to initiate action against the institution Under Section 17 of the NCTE Act immediately.The SRC in its 197th meeting held on 13-14 October, 2010 considered the matter and decided to issue Show cause Notice. Accordingly, show cause notice was issued on 06.12.2010 for the following:

The management is running Pre-University Course (PUC) in the same building where B.Ed, Programme is also conducted, which is not permissible as per NCTE norms.

The Built up area as per VT report is only 1094 sq,mts which is inadequate as per NCTE norms of 1500 sq.mts.

The institution has submitted written representation on 19.01.2011.

The committee in its 200th Meeting 20th-21st January, 2011 after scrutinizing the reply of the institution for the deficiencies pointed out in its show cause notice dt. 06.12.2010, the management admitted in writing that they are running pre-university course (PUC) in the same building where B.Ed, programmes is also conducted. The Committee decided to withdraw recognition on the following grounds:-

1. The built up area allotted to B.Ed in one floor is only 1190 sq.mts, which has been admitted in writing by the management. The built up area is inadequate for B.Ed course as per NCTE norms.

Based on the above points the SRC withdrew the recognition of the B.Ed course run by B.T.L. College of Education, No. 259/B, Bommasandra Industrial Area, Hosur Main Road, Bangalore, Karnataka, from the academic year 2011-12, in order to enable the ongoing batch of students in B.Ed, course, if any, to complete their course.

It was made clear that the institution is debarred from making any further admission subsequent to the date of issue of this order.

The Affiliating body / Examining board / body were informed accordingly, it was further decided by SRC to return Endowment funds and Reserve fund deposited with SRC NCTE, Bangalore if any.Accordingly, withdrawal order was issued to the institution vide its order no. F.SRO/NCTE/2010-2011/27586 dated 11.03.2011.

Aggrieved by the withdrawal order of SRC the institution preferred appeal to NCTE-Hqrs and the appellate authority in its order no. F.No.89-110/2011 Appeal/3rd Mtg-2011 A36887 dated 26.05.2011 confirmed SRC’s decision and rejected the appeal.

The institution approached Hon’ble High Court of Karnataka at Bangalore. The Hon’ble HC of Karnataka vide its direction in W.P.No. 23299 of 2011 dated 23. 08.2011 has quashed the appellate authority order and directed SRC to conduct inspection of the land and building made available to the B.Ed. College and submit its report to the institution within a period of four weeks from the date of deposit of the prescribed fee for re-inspection. The Hon’ble Court has directed the SRC to reconsider the matter afresh in accordance with law after taking into consideration the materials placed by the petitioners along with the Memorandum of appeal as also the report of the visiting team as above and pass appropriate orders thereon in accordance with law within a period of six weeks from the date of receipt of the report.

Letter to the institution regarding inspection is sent on 3.10.2011. Accordingly, re-inspection of the institution was conducted on 14.10.2011.

The case abounds in infirmities. The building plan is not in the prescribed format, the Building completion certificate is not approved and signed by the Govt. Engineer; the Psychology and Science labs are not maintained separately; other courses are also conducted in the same building; land has only on temporary partition, there is no separate registration for land partition.

Taking all these into account, the recognition given to this college is withdrawn with effect from 2011-12.

As directed by the Court, in case of any adverse decision by the Southern Regional Committee, the Management of the College will be responsible for their (Students) transfer to other (recognized) institutions. And, there will be no more fresh admissions.

The Committee considered the direction of Hon’ble High court of Karnataka and conducted re-inspection of the said institution on 14.10.2011 and as per VT report, the following deficiencies are still persists and it was decided to withdraw recognition for the following reasons:-

The building plan is not in the prescribed format duly approved by the competent Govt. authorized Engineer / Authority.

Building completion certificate is not approved by the competent Govt. Engineer/Authority.

The built up area mentioned in the Building completion certificate is not matching with that of the actual area recorded by the VT members.

As per NCTE 2009 Regulations Rule 8 (10)“At the time of inspection, the building of the institution shall be complete in the form of a permanent structure on the land possessed by the institution in terms of sub-regulation (7) of Regulation 8, equipped with all necessary amenities and fulfilling all such requirements as prescribed in the norms and standards. The applicant institution shall produce the original completion certificate issued by the competent Government Authority or localbody authority, approved building plan in proof of the completion of buildingand built up area and other documents to the visiting team for verification. No temporary structure or asbestos roofing shall be allowed in the institution,even if it is in addition to the prescribed built up area.”

“Further, at the time of inspection for new course or enhancement of intake, visiting team shall also verify the facilities for existing teacher education courses already accorded recognition by National Council forTeacher Education and would ascertain the fulfillment and maintenance of Regulations and Norms and standards for the existing courses as well.”

As per VT Report, the Karnataka Industries Development Board has allotted 10 acres of Land on 30 years lease to run Industrial Training cum Production Centre in Bommasandra Industrial Area. In the same Land, Management is running Engineering College, ITI, Polytechnic, Degree College, Nursing School, PUC, Secondary & Primary School. There is no earmarked land for B.Ed course. This is against NCTE norms. As per NCTE norms 1500 sq,mts of built up area and 2500 sq.mtrs of Land area is required exclusively for B.Ed course.

As per Norms, Rule 8 sub (7) (iv)The society sponsoring the institution shall be required to transfer and vest the title of the land and building in the name of the

institution within a period of six months from the date of issue of formal recognition order under sub-regulation (11) of Regulation 7. However, in case, the society fails to do so due to local laws or rules or bye-laws, it shall intimate in writing with documentary evidence, of its inability to do so. The Regional Office shall keep this information on record and place it before the Regional Committee for its approval.

The management is running other courses along with the existing course B.Ed, like Degree College (B.A & B.Com),Polytyechnic, Nursing School, Secondary and Primary School, PUC in the same building. This is against the NCTE norms.

As per NCTE norms, Rule 7 (i) & (ii)

No institution shall be granted recognition under these Regulations unless the institution or society sponsoring the institution is in possession of required land on the date of application. The land free from all encumbrances could be either on ownership basis or on lease from Government or Government institutions for a period of not less than 30 years. In cases where under relevant State or Union Territory laws the maximum permissible lease period is less than 30 years, the State Government or Union Territory Administration law shall prevail. However, no building shall be taken on lease for running any teacher training course.

The society sponsoring the institution shall have to ensure that proposed teacher education institution has a well demarcated land area as specified by the norms. The teacher education institution shall not be allowed to have any other institution within its demarcated area or building and shall not have any other course(s) in its building.

Land is only on temporary partition as declared in the Affidavit, there is no separate earmarked land and Building in the name of the institution as per NCTE norms.

Based on the above grounds. the committee decides to withdraw the recognition of the B.Ed course run by the B.T.L. College of Education, 259/B, Bommasandra Industrial Area, Hosur Main Road, Bangalore-560 009, Karnataka from the academic year 2011-12, in order to enable the ongoing batch of students in B.Ed, course, if any, to complete their course.

But it is made clear that the institution is debarred from making any

Application was processed and recognition to the institution was granted on 20.01.2006 at No.113/53, Angappa Naicken Street, Chennai-600001, Tamilnadu.

Meanwhile the institution vide letter dated 16.09.2009 intimated the office about shifting of Measi College of Education to the newly constructed building at No.2, Demellows Road, Chennai-112. The institution vide letter dated 24.02.2010 submitted application for shifting of B.Ed and D.T.Ed course to new building along with Rs. 40000/- for each course.

The inspection of the institution for shifting of premises was conducted on 16.09.2010. The Committee in its 197th meeting held on 13th-14th October 2010 considered the VT Report and all the relevant documentary evidences and it was decided to serve Showcause Notice Under Section 17 of NCTE Act for the following -

The earmarked area as provided in Essential data and countersigned by the management for B.Ed course is 13004 Sq.ft. which is inadequate as per NCTE Norms. The total Built up area available for both D.Ed. and B.Ed is 18554 Sq.Ft. which is far less than the requirement of 27,000 Sq. Ft. as per NCTE Norms.To produce the latest Building Completion Certificate from the competent Government Engineer,

Accordingly, show cause notice was issued to the institution on 10.12.2010 to submit reply within 30 days.

The reply from the institution has not been received even after a lapse of time period of more than 30 days.

The SRC in its 200th meeting held on 20-21 January 2011 considered the VT Report and other relevant documents, and non-reply of the institution to

the Show Cause Notice and decided to withdraw the recognition for the following reasons:-

The institution has not cared to reply to the show cause notice issued vide letter dt. 10.12.2010 under section 17 of NCTE Act, for the deficiencies pointed in the notice. The earmarked area as provided in Essential data and countersigned by the management for B.Ed course is 13004 Sq.ft. which is inadequate as per NCTE Norms. The institution has submitted Building Plan which is not approved for the location and Sy.No not mentioned.The management has not submitted the building plan approved by the Competent Government Authority.The management has not produced the latest Building Completion Certificate from the competent Authorised Government Engineer.The total Built up area available for both D.Ed. and B.Ed is 18554 Sq.Ft. which is far less than the requirement of 27,000 Sq. Ft. as per NCTE Norms.

Accordingly, order withdrawing recognition has been issued to the institution on 03.03.2011.

The institution preferred appeal and the appellate authority vide order dated 06.07.2011 has confirmed the withdrawal orders of SRC.Aggrieved by the order of the appellate authority, the institution filed W.P.17997 and 17998 of 2011 and the court has passed judgment dt.12.08.2011 which reads as under:

…. The matter remitted back to the second respondent (SRC,NCTE) to consider the request of the petitioner in all relevant facts and pass fresh orders within a period of three weeks from the date of receipt of copy of this order.

Accordingly, the matter was placed before 210th meeting held on 22-23 August 2011 and the matter was deferred.

As per the directions of the Hon’ble High Court the institution has submitted its written representation on 05.09.2011 and has stated that copies of the Building plan of the new premises is duly approved by the corporation of Chennai. The Building plan clearly shows the total constructed area, which is more than sufficient for running both B.Ed and D.T.Ed courses.

The institution has submitted vide letter dt. 05.09.2011 the Building plan approved by The Commissioner, Corporation of Chennai for the proposed Measi College of Education at Door no.2, Demellows Road, Choolai,

The SRC in its 211th meeting held on 21-23 September 2011 considered the matter and decided to comply with the court order on receipt of any fresh submission from the institution and the reply of the institution be processed.

Since the court has ordered to dispose the case by considering the request of the petitioner in all relevant facts and pass fresh orders within a period of 3 weeks and in obedience with the court the institution has already submitted the reply and the same was also placed before 211 th

meeting.

The Committee considered the request of the institution, Court order and decided as the case abounds in infirmities. There is no proof of the building plan being approved by the corporation. There is also no proof that the building has been constructed as per the plan. The building has not been approved for the location in reference. In the (so-called) approval, Survey nos have not been mentioned. The building completion certificate issued by a Chartered Engineer and not a Govt. Engineer as required in the Guidelines.

Taking all these pointes into account the recognition given is withdrawn with immediate effect.

The Committee considered the reply of the institution dt. 2.09.2011, direction of Hon’ble High court of Tamilnadu and processed the reply of the institutin and the following deficiencies are still persists and it was decided to withdraw recognition for the following reasons:

May, 2009 the office of SRC has reviewed the files of the institution who have been granted recognition either in a rented premises pending construction of own building or in lease premises pertaining to the B.Ed course in the State of Karnataka.A list of such institution has been prepared and placed before SRC in its 176th meeting held on 27th and 28th May, 2009, it was decided that the institution which have not shifted to the permanent premises even after expiry of three years time limit be issued notice.As per the decision of SRC notice was issued to the institution on 8.9.2009 to submit the 10 essential documents.As the institution did not care to respond to the notice issued on the institution, for their failure to shift to permanent premises, even after the lapse of three years stipulated period permitted in their conditional orders of recognition and the matter was placed before SRC.The SRC in its 196th meeting held on 15-16 September, 2010 considered the matter and decided to issue showcause notice. Accordingly, showcause notice was issued to the institution on 25.10.2010. Again the institution did not care to respond to the showcause notice issued on the institution even after lapse of 4 months.

The SRC in its 201st meeting held on 22nd and 23rd February, 2011 considered the non-response by the institution to the showcause notice dated 25.10.2010 and decided to withdraw ongoing batch of students in D.Ed course. If an y, complete their course.But it is made clear that the institution is debarred from making any further admission subsequent to the date of issue of this order. The affiliating body/examining board body be informed accordingly.Accordingly, order of withdrawing recognition was issued to the institution on 23.3.2011.Aggrieved by the withdrawal order of SRC, the institution preferred an appeal to NCTE-Hqrs. and the appellate authority in its order dated 6.7.2011 confirms the order appealed against.As requested by the SRC-Counsel, this office has forwarded duly signed counter affidavit in W.P. No. 28449 of 2011 filed by Vatsalya College of Education, Mysore on 13.9.2011.Now, the institution in its letter dated 23.9.2011 enclosing a copy of judgement dated 16.9.2011 filed by the institution in the Hon’ble High court of Karnataka at Bangalore stated as follows; “…..the impugned order of the appellate at Annexure-E, dated 6.7.2011, stands set aside. Since the de-recommendation is for the year 2012-13, there is no hurdle for the petitioner to run the college for this academic year. Thus, it is open for the petitioner to deposit the required inspection fees .in favour of the Member Secretary, NCTE, payable at Bangalore, for visiting the petitioner-institution and for taking action in accordance with law. The petitioner shall also comply with all the defects found by the respondents. The inspection fees shall be deposited by the petitioner within four weeks from today. If the inspection fees are deposited, the respondents shall visit the college of the petitioner and proceed in accordance with law”.The institution has submitted the following documents;

In this a legal opinion has been solicited from advocate as to whether it is a fit case to challenge the inspection ordered by the Hon’ble High court a letter has been address to the advocate on 13.10.2011.

The Committee considered the request of the management & Court order and decided that the facts of the case do not warrant an appeal against the Court order. That being so, the office should cause an inspection as per normal procedure.

An application was submitted by IRFF Institute of Elementary Teacher Education, Gospel Fields, Repalle, Guntur District, Andhra Pradesh for grant of recognition to D.Ed course in the office of SRC-NCTE, Bangalore vide dated 03.02.2004.

The file was under process and in the meanwhile, in view of the recommendations of the State Government of Andhra Pradesh vide letter dated 07.01.2009 not to further recognise/permit the institutions for conducting B.Ed, D.Ed, Physical Education, Language Pandit course(s).

The SRC in its 169th Meeting held on 12th – 13th January, 2009 having considered the letter dated 07.01.2009 of State Government of Andhra Pradesh and decided to give effect to the above decision of State Government of Andhra Pradesh as such, with immediate effect.

A letter dated 07.02.2009 forwarded by Principal Secretary of Education requesting not to accord further recognition/permission to the new colleges/private B.Ed, D.Ed, Physical Education, Language Pandit in the State of Andhra Pradesh as the above colleges are exceeding in numbers than required.

A letter dated 17.03.2009 has been received from NCTE, Hqrs informing that the “The recommendations of the Govt. of Andhra Pradesh not to grant recognition/permission in respect of other courses like B.Ed, D.Ed and Physical Education courses have further been decided that no further Recognition/ Permission to any institution in the State of Andhra Pradesh be considered by SRC for the academic session 2009-2010 for B.Ed, D.Ed, and Physical Education courses also”.

The State Government vide its letter dated 20.03.2009 informed that it has been decided not to recommend the name of this institution. The letters dated 07.01.2009, 07.02.2009, 17.03.2009 and 20.03.2009 was considered by SRC in its 172nd Meeting held on 25-26 March, 2009 and SRC decided to accept the recommendation of the State Government of Andhra Pradesh, not to grant recognition to any of the Teacher Training Institutions in the State of Andhra Pradesh for the year 2009-2010 and decided to close the applications.

As per the decision of SRC the application was closed on 29.04.2009

The Institute has approached to Hon’ble High Court in W.P.No.12729 of 2011 without approaching the appellate authority.

Now, the Hon’ble High Court has passed an order on 28.04.2011 vide W.P.No. 12729 of 2011 reads as hereunder:

“ The petitioner is aggrieved of the impugned proceedings of respondent No.1 dated 29.04.2009 wherein they have refused to consider the petitioners proposal for recognition of B.Ed course in view of the directive of the State of Andhra Pradesh in its policy dated 07.01.2009.

The learned counsel for the petitioner has brought to my notice order of this court in W.P.No.6712 of 2009 dated 06.12.2009 which has also been followed by another learned single Judge of this Court in W.P.No.9360 of 2010 and passed order directing respondent No.3 herein i.e. the National Council for Teacher Education to consider the application of the petitioner therein without reference to the policy of the State Government dated 07.01.2009.Since the present case falls squarely covered, there shall be a similar direction until further orders.

Therefore, it is directed that respondents shall consider the application of the petitioner without reference to the State Government’s policy dated 07.01.2009”. The SRC considered in 206th Meeting held on 09th – 10th June, 2011 wherein SRC mentioned in decision to cause inspection whereas in the minutes it is mentioned that to process on resubmission of the original application along with all relevant documents as originally submitted along with this application.

The Committee considered the reply of the institution dt. 29.07.2011, VT Report and all the relevant documentary evidences and it was decided that the facts of the case warrant issue of a show cause notice for deficiencies as per normal procedure for the following:

Fresh building plan with earmarked area for all courses is to be submitted.

The application was returned back to the society on 29.10.2010 as the application was not submitted electronically through on-line mode as per the new Regulation;

“As para 5 (3) of the NCTE Regulation, 2009 the application may be essentially submitted electronically through on-line mode available on the website of National Council for Teacher Education along with the processing fee. However, while submitting the application through on-line mode, the application and requisite documents in triplicate shall have to be submitted or sent by registered post separately to the office of the Regional Committee concerned, immediately after on-line submission of the application. You have not submitted your application in on-line mode”.

Further it is also informed that as per the Public Notice dated 28 th July, 2009, the NCTE had taken a policy decision not to recognize/permit institutions for conduct of B.Ed course in the State of Tamilnadu for the academic session 2010-2011. However, the above restriction will not apply in case of minority institutions established under Article 20 of the Constitution”.

the same was returned since the application was not submitted through on-line mode and that too after the last date of submission of application. Previously, the institution filed court case in W.P. No. 12809 of 2009 in the Hon’ble Madurai Bench of Madras High Court, Madurai District quashing SRC’s letter no. F.SRC/NCTE/2009/16764 dated 20.11.2009.

Accordingly, the fact of the case was communicated to Shri. A. Sivaji, Advocate, Madurain vide this office letter No. F.CC/SRO/NCTE/2009-2010/17728 dated 10.2.2010.

The Hon’ble High Court of Madras, Madurai Bench of Madurai in their order dated 27.4.2010 in the W.P(M.D) No. 12809 and M.P. No. 1 of 2009 filed by the above institution has dismissed the writ petition. The court has ordered as follows:

“The Learned Counsel appearing for the petitioner seeks permission of this court to withdraw the writ petition and he has also made an endorsement to that effect.

In view of the same, the writ petition is dismissed as withdrawn. No costs. Consequently, connected miscellaneous petition is closed”.

This year also the same institution applied for B.Ed course through on-line on 30.9.2010 but the hard copy received by this office on 13.10.2010 i.e after the last date of submission of application (as per regulation 2009, the institution should apply through on-line followed submission of hard copy within 7 days).

Hence, the application submitted by the institution is rejected and returned in terms of clause 7(1-A) (i)(b) of new Regulation, 2009 read with Gazette Notification dated 25.11.2010 under the following circumstances:-

“Hard copy in triplicate of the on-line application is not dispatched within 7 days of the submission of the on-line application”

Accordingly, a rejection letter was issued to the institution vide no. F.SRO/NCTE/2010-2011/25896 dated 03.01.2011 along with original application. The institution has submitted the written representation on 26.09.2011 alongwith supporting documents. The institution has stated that “consideration to our application for starting a new B.Ed course for academic year 2011-12. I herewith attached the Hon’ble High Court, Madras order M.P.No. 1 of 2011 against the Writ Petition No. 18247/2011 filed by the institute which also sent to you by wire through Assistant Registrar (C.S-Vth) High Court of Madras-104, on 23.09.2011”. The institution has requested to arrange for commission to grant an order to start a new B.Ed course in the year 2011-12.

W.P. No. 18247/2011 vide Judgement dt. 23.09.2011 reads as under The learned counsel for the petitioner submits that so far the order is in operation and no stay is granted and only difference in this case is there is delay of 5 days instead of 4 days in submitting the hard copy of the on line application. Andhra Pradesh had filed a court case vide Writ petition No. 11719 of 2011 in the Hon’ble High Court of Judicature, Andhra Pradesh at Hyderabad verses – NCTE- SRC, The Government of AP, Rep, by its Secretary School Education deportment and The Director of School Education, Hyderabad as first, second and third respondents respectively against the above SRC order dt.07.07.2007.

Hon’ble High Court has passed an order dt. 25.04.2011 in WP No. 9903 of 2011 as under

The complaint of the petitioner is with regard to the policy of the State of Andhra Pradesh in not permitting recognition of private B.Ed/D.Ed/ private physical education / private language pandit training colleges as communicated under the letter dt07.01.2009 addressed to the National Council for Teacher Education. Acting thereupon, vide proceeding dt 16.04.2009 the National Council l for Teacher Education rejected the name of the petitioner- Institution for grant of recognition to D.Ed course. The petitioner seeks a consequential direction to National Council for Teacher Education rejected the names of the petitioners- Institutions for grant of recognition to B.Ed course. The petitioners seek a consequential direction to National Council for Teacher Education to grant recognition for the said course forthwith

The matter is squarely covered by the judgment, dt. 16.12.2009 in W.P No. 6712 of 2009, thereby, a learned judge of this court held that the power of the state Government to review policy as to the necessity or otherwise of according permission to establish new colleges could not be extended to existing institutions. The learned judge observed that the right that accrues to such colleges could not be taken away on account of subsequent

In terms of the aforestated decision, the writ petition is disposed of directing the National Council for Teacher Education to consider the petitioner’s case for granting permission for commencing B.Ed Course independently and pass appropriate orders, in accordance with law, as expeditiously as expeditiously as possible No Order as to the Costs.

The committee in its 206th meeting held on 9th & 10th June 2011 considered the matter and decided to process the application on submission of original of original application dt. 10.12.2007 and related supporting original documents as per the regulations, within four weeks from the date of confirmation of the Minutes.

As per the decision of SRC a letter was issued to the institution on 05.07.2011.The institution has submitted reply on 08.07.11 and 03.10.2011.

Syed Jamal Educational Society, Plot No. 3-202/3/1, Nayanagar Street, Kodad Village, Kodad Post Office and Taluka, Nalgonda District – 508 206, Andhra Pradesh had submitted an application for grant of recognition to Syed Jamal Memorial College of Education, Block No. 3, Sy No. 206, 201, 202, Plot No. 26, Kodad Village, Kodad Post Office and Taluka, Nalgonda District – 508 206, Andhra Pradesh for B.Ed course on 07/10/2010.

The application was scrutinized and a copy of application was sent to State Government for recommendation on 09.11.10 / 04.02.11. A deficiency letter was issued to the institution on 09.12.2010.

The committee considered the reply of institution dt. 08/02/2011 for the deficiencies and decided to cause inspection of the institution under Section 14 of NCTE Act to verify the infrastructural and instructional facilities.

The inspection of the institution was conducted on 02.04.2011. The Committee considered the VT Report, VCD and all the relevant documentary evidences and it was decided to serve the Show cause Notice for the following:

1. As per VCD observation the building is still under construction and incomplete at the time of application/inspection, as admitted by the management itself.

2. Survey number 203, which is reflected in all land documents, is not matching with the application form.

As per direction of SRC SCN was issued to the applicant institution on 26.05.2011. In response to this office notice dated 26.05.2011 the institution submitted reply vide letter dated 23.06.2011.

AND WHEREAS, the Committee in its 208th Meeting of SRC held on 13th – 14th July, 2011 after going through the reply of institution dt. 23.6.2011, come to the conclusion that the reply is not satisfactory and not convincing and hence, the recognition is refused for the following reason:

1. As per VCD observation the building is still under construction and incomplete at the time of application/inspection, as admitted by the

Accordingly a refusal order was issued to the institution on 26.08.2011.

Aggrieved by the Refusal order of SRC, the institution has approached to Hon’ble High Court in W.P.No.31029 of 2011 in W.P No. 25228 of 2011 without making appeal to appellate authority under section 18 of NCTE Act.

Now, the institution has submitted a letter dt. 28.09.2011 along with the Hon’ble High Court order on 28.09.2011 vide W.P.No.31029 of 2011 in W.P No. 25228 of 2011. reads as hereunder:

“it is the case of the petitioner that even thought it has rectified all the deficiencies, the committee failed to consider the same by taking into consideration the material placed and thereby has come to an incorrect conclusion. According to the petitioner, a certificate issued by the Asst. Executive Engineer, Panchayat Raj Department, would clearly show that it has completed construction of the building in all respects as per the requirements of the Regulations. Therefore, the grounds stated in the order of rejection are not tenable; and had the 1st respondent taken the material into consideration, it would not have resulted in the rejection.

On a consideration of the aforesaid facts and material placed on record, prima facie, the contention appears tenable.

In the circumstances, there shall be interim direction to the 1st

Respondent to re-consider the application of the petitioner in the light of the material already submitted and pass an appropriate order in accordance with law as expeditiously as possible, preferably within a period of four weeks from the date of receipt of a copy of the order”. Note: Building Completion Certificate dated 08.02.2011 issued by Assistant Executive Engineer (PR), Mandal Parishad, Kodad for 29,769.9 Sq Fts at Sy No. 201, 202, 206 Block No. 3 Nayanagar Kodad is available in the records.

The Committee considered the request of the institution, Court direction and noted that there are differences between the contents of the VCD and the Engineer’s report. Also, there are discrepancies in Sy.nos. between land records and the application. In the event, a fresh inspection is called for. The applicant should deposit “fee” afresh for the VT; the applicant should also furnish a fresh VCD.

The Application was scrutinized and a copy of application was sent to State Government for recommendation on 09.11.2010/02.02.2011. A deficiency letter was issued to the institution on 09.12.2010. The institution has replied to the deficiency letter on 07.02.2011. The inspection of the institution was conducted on 29.03.2011.

The Committee in its 204th Meeting of SRC held on 27th – 28th April, 2011 considered the VT Report, VCD and all the relevant documentary evidences and it was decided to serve the Show cause Notice for the following grounds:

1. As per VCD observation the building (2nd floor and top floor) is still under construction and is incomplete at the time of application/inspection.

2. Sale deed certified copy of registered document by competent authority is to be submitted.

3. The institution has not submitted valid Minority Status Certificate from the Competent Authority.

4. Multipurpose Hall size is less than the requirement as per Regulation-2009.

5. Science lab & Psychology lab needs to be strengthened. As per direction of SRC, Show Cause Notice was issued to the applicant institution on 27.05.2011. In response to this office letter dated 27.05.2011 the institution submitted reply on 27.06.2011.

The committee after going through the reply of institution, came to the conclusion that the reply is not satisfactory and not convincing and hence, the recognition is refused for the following reasons:

1. As per VCD observation the building (2nd floor and top floor) is still under construction and is incomplete at the time of application/visit.

Therefore, the grounds stated in the order of rejection are not tenable; and had the 1st respondent taken the material into consideration, it would not have resulted in the rejection.

On a consideration of the aforesaid facts and material placed on record, prima facie, the contention appears tenable.

In the circumstances, there shall be interim direction to the 1st

Note: As per records on file Gift deed dt. 16.02.2009 land to the extent of A 3.13 Guntas in Sy No. 40/A, 40/B, 41/A & 578/B at Moqdumpur Village, Karimnagar Mandal & District, is gifted to Alexander College ‘Iqbalunnissa Memorial Trust” however BCC available in records is not issued by the Executive Engineer Panchayat Raj as mentioned in the Court Order.

The Committee considered the request of the institution, Court direction and noted that the land is in the name of the individual and not of the institution. The gift of the land by the individual to the institution was subsequent to the Visiting Team Inspection. The Building Completion Certificate has not been by the Executive Engineer of the Panchayat Raj Department. Bearing in mind these facts, recognition is refused in this case.

The application has been scrutinized and deficiency letter dt.18.08.08 was sent to the Institution giving 90 days time to remove the deficiencies and other letter dt. 18.08.2008 along with the copy of the application was sent to the Secretary, School Education Department, Andhra Pradesh for recommendations. Whereas the above Society submitted its reply on 29.08.08 for the clarification of deficiencies pointed out. On consideration of the reply one more letter dtd.22.09.2008 was sent seeking further clarification with the supporting documents. The Society submitted its reply on 29.09.2008 and 13.10.2008 both were considered and letter of consent was sent on 24.10.08 to give their consent for Inspection. Inspection shall be conducted within 30days of receipt of consent. The file was under process and in the meantime, in view of the recommendations of the State Government of Andhra Pradesh not to further recognize / permit the Institutions for conducting the B.Ed, D.Ed Physical Education, Language Pandit courses a Public notice was issued on 02.10.2009 to this effect that the application for the above courses from the states of Andhra Pradesh will not be considered for the academic session 2009-10 and such application shall be returned along with the processing fees and documents.SRC in its 169th Meeting held on 12th and 13th January 2009 considered the letter dt. 07.01.2009 of the State Government of Andhra Pradesh and decided to give effect. A letter dt .20.03.2009 was forwarded by the Principal Secretary of Education not accord further recognition/ permission to new colleges/private B.Ed, D.Ed, Physical Education , Language Pandit in the State of Andhra Pradesh as the above colleges are exceeding in numbers than required. The same was considered by the SRC in its 172nd

meeting held on 25th and 26th March 2009 and decided to accept recommendation of the State Government of Andhra Pradesh , not to grant recognition to any Teacher training Institutions in the State Andhra Pradesh for the year 2009 -2010 and decided to close applications. Muniswamy Technical & Rural Development Education society, Door No, 25-72, Kondapeta, Dhone Village, Kurnool District, Andhra Pradesh filed a Court case vide Writ Petition No. 12887 of 2009 in the Hon’ble High Court of Judicature of Andhra Pradesh Verses NCTE-SRC and Government of Andhra Pradesh School Education department as 1st and 2nd respondent respectively against the closure order.

Hon’ble High Court of Andhra Pradesh at Hyderabad has passed an order on 13.04.2011 in WP No. 12887 of 2009 as under:-

“To issue a writ order or direction more particularly on in nature of writ mamdus declaring the action of the 1st respondent herein in closing the application of the petitioner society in the proceeding No. SRC/NCTE/2009/11908 dt. 22.04.2009, by relying on the letter of the 2nd

On scrutiny of the application and the essential documents that the institution has submitted as required under NCTE Act and its regulations there under, a visiting team was constituted by SRC-NCTE which visited the institution on 29.03.2005 to verify the human resources, infrastructural and instructional facilities provided by the institution for D.Ed course.

The report of the inspection team was placed before the Southern Regional Committee in its 95th Meeting and considered the inspection team report submitted by the visiting team and other documents furnished by the institution along with the application, the Committee is of the opinion that the institution prima facie, does not fulfill the requirements, the norms and standards laid down by the NCTE in accordance with the provisions of the NCTE Act, 1993, as detailed below:

There are only three class rooms for B.Ed and D.Ed programs and it is highly inadequate for running two courses.

Accordingly a notice was issued to the institution on 29.07.2005. The institution had submitted a letter on 22.08.2005

As per MIS record the file has already been closed on 02.03.2009 vide letter No. 9806. The Closure letter not available in the file.

Recently Court order in Writ Petition No. 23428/2011 in the matter of Chaitanya College of Educational Society. The Honorable High Court has directed as under:

“Heard Smt. G. Jhansi, learned counsel for the petitioner and Sri P. Vinayaka Swamy, learned counsel appearing for the 1st respondent. Both the learned counsels agree that the issue raised in this writ petition is squarely covered by orders of this Court in W.P No. 4704 of 2011, date 09-03-2011.

The brief facts are that the petitioner-Society is running a college imparting B.Ed., and M.Ed programmes in the name of Chaitanya College of Education, Markapur, Prakasam District. I submitted an application on 31.1.2004 seeking recognition to impart education in D.Ed. course for the academic year 2004-05. Inspection of the premises is said to have been conducted on 29.03.2005 and on noticing a deficiency, the 1st respondent served a notice dated 29.7.2005 on the petitioner-Society. Thereafter the Petitioner-Society offered its explanation on 10.08.2005. It is stated that even though considerable time has elapsed, the said application dated 31-01-2004 was kept pending. However, subsequently, a further show cause notice dated 01-10-2008 appears to have been issued calling upon the petitioner-Society to submit explanation to certain deficiencies pointed out therein. Thereupon, a decision appears to have been taken in pursuance of the said notice dated 01.10.2008. It is the specific case of the petitioner-Society that the notice dated 01.10.2008 was not served on it not the decision communicated. This Court having regard to the said submission called for the record and a perusal of the same shows that the said proceedings were not communicated on the petitioner-society.

3. In similar circumstances, this Court in W.P. No 4707 of 2011 dated 09.03.2011 set aside the orders impugned therein and within a time frame with a further direction to consider the matter afresh.

4. In the aforesaid circumstances, it is directed that decision said to have been taken shall be treated as non existent and the petitioner-Society shall be permitted to comply with the objections/deficiencies pointed out in the letter dated 01.10.2008 within a period of one week from the date of receipt of a copy of this order. On such compliance, the 1st respondent shall consider the matter afresh and pass appropriate order as expeditiously as possible, preferably within a period of four weeks thereafter.

5. The writ petition is accordingly disposed of. No. costs”.

The Court’s order required the petitioner to submit compliance of the show cause notice within a week and the Southern Regional Committee to pass order within 4 weeks thereafter. But, no compliance report has been received from the petitioner. That being so, the application of the institution is duly considered and the Committee decided to refuse and its application is rejected for recognition and the case is closed.

There is a report in this case that the petitioners is running M.Ed and B.Ed courses in the same 3-room building. Office may open a new file, register a new case and, issue a show cause notice.

The Committee considered all the relevant documentary evidences and it was decided to serve Show Cause Notice to B.Ed & M.Ed course for the following:

The built up area is inadequate for the courses being run by the institution. There are only three class rooms for B.Ed and M.Ed courses and it is highly inadequate as per NCTE norms.

In view of the above, the Committee decided to issue a Show cause Notice to the institution as to why the recognition be not withdrawn and thereby providing an opportunity to the institution to make a written representation within 21 days from the date of issue of the Notice along with necessary certificates/documents in order to take a final decision in the matter; failing which action will be taken including the withdrawal, based on the records available, with no further notice.

days as per regulation 2009. SRC in its 202nd meeting held on 14-15 March 2011 considered the matter and decided to refuse recognition. Accordingly, refusal order was issued to the institution on 18.04.2011.

The institution preferred appeal to NCTE, Hqrs and the Appellate Authority vide order dt.03.08.2011 has reversed the refusal order of SRC with a direction to consider the reply submitted by the institution and taking decision thereafter.

The SRC in its 210th meeting held on 22-23 August, 2011 considered the Council directions Dt. 03.08.2011 and decided to reconsider the entire case and to issue speaking order in the matter. Mean while the institution has submitted the its representation on 17.08.2011.

The Committee considered the request of the institution, Appellate authority direction and noted that the facts of this case warrant conduct of a Visiting Team Inspection and further processing of the application with reference thereto.

The application was processed and deficiency letter was issued to the Institution on 07.12.2010 and the Institution submitted its reply on 31.01.2011. SRC in its 202nd Meeting held on 14th and 15th March 2011 on careful perusal of the original file and other related documents, NCTE Act 1993, Regulations and guidelines from time to time laid on the table, written representation from the institution the Southern Regional Committee decided to reject the application for the reason:-

The SRC considered, the matter in its 201st Meeting held on 22nd - 23rd

February, 2011 and on careful perusal of the original file of the institution and other related documents, NCTE Act 1993, Regulations and guidelines from time to time laid on the table, written representation from the institution, the Regional committee decided to reject the application on the following grounds: -

The institution has not replied to the deficiency letters even after a lapse of stipulated time of 60 day as per clause 7(1), Regulation 2009.

Accordingly the application of Hezekiah College of Education Ziroithi, Rajapulova, Bhogapuram Mandal, Vizianagaram-531162, Andhra Pradesh vide order 23.03.2011 was rejected. The Institution preferred to go in for an appeal at NCTE, Hqrs. Building completion certificate:- The institution has not submitted the building completion certificate issued by local civil authority in prescribed format. Hence the institution is required to submit Building completion certificate issued by local civil authority/Govt. Engineer in prescribed format. (copy enclosed)

If the institution has running other teacher education courses/ other technical courses in the same premises then, the institution shall submit earmarked area for proposed course with total area and built up area.

Minority Certificate:- the institution is minority institution as per application form, however the institution has not submitted minority certificate in this regard. Hence the institution is required to submit minority certificate issued by competent authority

Certified copy of the registered land documents issued by the competent authority :- The institution has submitted Photocopy of registered land documents in Telugu version, and it is not certified by the competent authority. Hence, the institution is required to submit certified copy of the land documents issued by the office of the Sub-Registrar or Competent issuing authority in English version.

The plot No.2177 Village-Rly Koduru, Taluka-Rly Koduru, Distt- Kadapa, Andhra Pradesh mentioned in the application form whereas building plan/affidavit/BCC/LUC the Khasara No. 1712, Surapurajapalli Village, Rly Kodur, Kadapa. Hence, the plot No does not match with other documents i.e Affidavit, Building plan, BCC, LUC, and Sale deed. The committee its 203rd meeting held on 31st March and 1st April 2011,considered the reply of institution dt. 18.03.2011 for the deficiencies and decided to cause inspection of the institution under Section 14 of NCTE Act to verify the infrastructural and instructional facilities.

The inspection of the institution was done on 21.04.2011.The Committee considered the VT Report, VCD and all the relevant documentary evidences and it was decided to serve the Show cause Notice for the following:

The management has submitted the application vide address as Plot no. 2177 village Rly Koduru, Taluk-rly Koduru, district Kadapa, AP, where as in the building plan/affidavit/BCC/LUC the Khasara no. mentioned is 1712, Surapurajapalli Village, Rly Kodur, Kadapa. Further, The Inspection was conducted at No. 1712, Rly Koduru, Kadapa. AP. This is not matching with the application form submitted and it amounts to misleading/trying to suppress the facts from NCTE and a serious violation of norms and regulations.

As per direction of SRC a letter was issued to the institution on 22.06.2011. In response to this office letter dated 22.06.2011 the institution has submitted reply vide letter dated 06.07.2011and 08.07.11, explaining and clarifying the points raised in the show cause notice.

The Committee considered the reply of the institution dt.06.07.2011and 08.07.2011,other related documents, Act of NCTE, 1993, Regulations and guidelines of NCTE published from time to time laid on the table, and the reply to the show cause notice, the Regional Committee decided to issue Letter of Intent for grant of recognition to B.Ed. course of one year duration with an annual intake of 100(One hundred only)(one unit) for the academic year 2011-12 subject to the appointment of qualified staff through duly constituted selection committee as per the Norms of NCTE/State Government/Affiliating University and be given effect before the commencement of the academic session.As per direction of SRC letter of intend was issued on 20.07.2011.In response to SRC letter dated 20.07.2011 the institution has submitted reply of LOI vide letter dated 18.08.2011. As per Regulation 2009 one principal and Seven lecturer is required. The institution has submitted teaching profile of one principal and seven lecturer. The status of teaching faculty as per approval list by Registrar, Yogi Yemana University, Kadapa-516003, Andhra Pradesh which are as

The letters dated 07.01.2009, 07.02.2009, 17.03.2009 and 20.03.2009 were considered by SRC in its 172nd meeting held on 25th-26th March 2009 and SRC decided to accept the recommendation of the State Government of Andhra Pradesh, not to grant recognition to any of the Teacher Training Institutions in the state of Andhra Pradesh for the year 2009-10 and decided to close the applications. No. 24142/2010 as under:- “In the light of the orders passed by this court in the similar writ petitions W.P.No. 6712/2009, W.P.no. 9360/2010 and W.P. no. 11078/2010 there shall be a direction to the first respondent to consider the petitioner’s application for starting D.Ed course in accordance with law without reference to the state Govt’s Policy dated 07.01.2009.”The SRC considered the Hon’ble court orders and all the relevant documents and decided to take further action in the matter, subject to the fulfillment of all the requirements by the institution as per the norms and regulations.As per the decision of SRC a deficiency letter was issued to the institution on 16.11.2010.In reply to the letter dated 16.11.2010 institution submitted its written representation on 30.11.2010. The SRC in its 199th meeting held on 22-23 December 2010 considered the matter and all relevant documents and decided to cause inspection to examine whether the institution fulfils all the requirements as per the norms, for the proposed programme, subject to the condition that the deficiencies, if any, were duly rectified by the institution, as per the norms. The inspection was conducted on 07.02.2011. The VT Report was considered in the 201st Meeting of SRC held on 22nd – 23rd February, 2011 and as per SRC direction, Show Cause Notice Under Section 17 of NCTE Act for the following on 18.03.2011

As per VT report, the earmarked Built up area for B.Ed is 16250 sq.ft. forD.Ed is 16250 sq.ft and no earmarked built up areas for for HPT, TPT are given. The total built up area for all the four courses is inadequate as per NCTE norms.

The institution has to submit VCD with full view of the Front side of the Building and all the portions of the Bulding.

The letters dated 07.01.2009, 07.02.2009, 17.03.2009 and 20.03.2009 were considered by SRC in its 172nd meeting held on 25th-26th March 2009 and SRC decided to accept the recommendation of the State Government of Andhra Pradesh, not to grant recognition to any of the Teacher Training Institutions in the state of Andhra Pradesh for the year 2009-10 and decided to close the applications.As per the decision of SRC the application was closed on 29.04.2009.

The Hon’ble High Court has passed an order on 23.04.2010 vide W.P.No.9360 of 2010 to consider the application of the petitioner without making reference to the recommendation of State Government policy dated 07.01.2009. Further, a letter has been received from NCTE, Hqrs vide letter No.64-138/2010/NCTE/legal dated 02.06.2010 with the direction to file Counter Affidavit in the matter incorporating the provision of filing appeal under section 18 of NCTE Act and to defend the case including on behalf of NCTE (HQ) under intimation to this office.The Committee considered the matter and decided to process the application.As per decision of Regional Committee the file has been processed and deficiency letter was issued on 17.08.2010. The institution is having land and building on a lease of 30 years as per regulation 2006. As per questionnaire submitted by institution on 28.09.2010 it is having land on ownership in Sr. NO. 522/2- total 1 Acres and the building is constructed over it.

The institution is already running B.Ed course with 100 intake.

As per affidavit dated 03.04.07 it is showing that it has permanent land in Sr. No. 48,60,61 of Kesanupalli, Village, Narasaraopet Mandal, Guntur District to extent of 2.23 hectares. The sale Deed dated 24.12.2005 states that the institution is having land of one acre in Southern Regional Committee. A complaint was received against Chirstian Mission Educational Trust, Salem, Tamilnadu for offering Annai Theresa Teacher Training Institute, Thammampatty, Salem District, Tamilnadu for conducting D.T.Ed, D.T.Ed-AI & B.Ed courses stating that the institution is lacking with regard to infrastructure and instructional facilities

The complaint was considered by SRC in its 182nd meeting held on 31st

August 2009 and decided to issue show cause notice Under Section 17 of NCTE Act for all the courses in order to call for remarks on the complaint along with questionnaire. Accordingly, show cause notice were issued for all the three courses on 1.10.2009.

The institution has submitted its reply on 22.10.2009, which was placed in 187th meeting of SRC held on 29th and 30th December 2009. SRC considered the written representation of the institution and decided to cause Inspection Under Section 17 of NCTE Act. Again the matter was placed in SRC in its 192nd meeting held on 10th-11th May 2010 and decided that “copy of the complaint “excerpts” pertaining to the concerned institutions had already been given to the concerned institutions and the remarks of the institutions were also obtained and considered by the SRC; and hence the visit to the institution be proceeded, without any further delay, in anticipation of the inspection fee of Rs.40,000/- payable on this account as upheld by the Hon’ble High Court of Madras.

As per the decision of SRC, inspection of the institution was conducted on 8th June 2010. The VT report alongwith original file was considered by SRC in its 193rd meeting held on 21st-22nd June 2010. The Committee decided to issue notice to the institution for all the courses on 29.07.2010. The institution submitted its reply on 18.08.2010.

The SRC considered the reply in its 196th meeting held on 15th-16th

September 2010 and the committee decided to cause re-inspection for all the courses on receipt of the filed in Questionnaire, including all the relevant documents. The committee decided that the Arul Teacher Training Institute bearing APS0 No. 8066 in the same campus be also be inspected to verify whether it has exclusive and separate infrastructure facilities.

A letter calling for documents alongwith Questionnaire was issued on 26.10.2010. The institution did not submit its reply. Inspection of the institution was fixed between 18th-25th November 2010 and the same was intimated to the institution on 08.11.2010. But inspection could not be conducted by VT members because institution has not allowed VT members to inspect.

The institution submitted a letter dated 23.11.2010 to the VT members “stating NCTE inspecting authority members visited our institution to inspect the institution on 23.11.2010. Already we filed a pending case to the high court, Chennai W.P.No. 25842/2010. We are expecting the stay order from the court. In this movement we are not able to face the inspection after getting the court order, if the court may be order to face the inspection., we will ready to cooperate the inspection.”

The Court order dated 19.11.2010 has been received from the Hon’ble High Court of Madras stating as follows:

“The learned counsel for the respondent has brought to the notice of this court that by proceedings dated 26.10.2010, the petitioner was served with a notice calling upon to produce certain documents, besides giving 15 days time for submission of the reply also. However, on receipt of the reply, the respondent can inspect and verify the stand taken in the reply given by the petitioner institution. Besides, the power of inspection of the respondent with the petitioner institution cannot be curtailed basing on the last inspection done. According to the learned counsel, as far as the impugned notice dated 8.11.2010 is concerned, it is by mistake, the same has been issued and no further steps will be taken basing on the notice dated 8.11.2010, which is under challenge in this writ petition. However, depending on the reply to be furnished by the petitioner institution for the notice dated 26.10.2010, further steps, including inspection, will be done by the respondent institution.

Recording the above submission made by the learned counsel appearing for the respondent, this writ petition is closed, setting aside the impugned notice dated 8.11.2010. No costs. M.P. Nos.1 and 2 of 2010 are closed”.

The reply was not received from the institution to the notice dt. 26.10.2010. The committee in its 200th meeting held on 20th-21st January 2011 considered the matter and decided to issue Notice under Sec 17 of NCTE Act to the institution giving 30 days time for reply to the earlier notice issued to the institution dt. 26.10.2010 calling for documents along with Questionnaire and then process the reply for inspection after submission of Rs. 40000/- towards inspection fee for each of the courses being run by the institution.

A Notice was again issued to the institution on 03.03.2011 to submit the relevant documents following as called for in letter dated 26.10.2010. The institution vide its letter dated 01.04.2011 instead of submitting enclosed above documents alongwith filled in questionnaire and D.D of Rs.40,000/- requested to visit the college directly and consider the application and do the need full action as early as your favour.

Azizia College of Education, Kurnool District, Andhra Pradesh has made an application for B.Ed course to Southern Regional Committee, NCTE, Bangalore on 31.12.2001. The application was processed and after considering the report of the Visiting Team as well as other relevant materials granted recognition to the institution for offering B.Ed course with an intake of 120 students vide order No.6652 dated 08.04.2003. The institution in its letter dated 25.06.2009 has submitted proposal for shifting the B.Ed course to the new location. Inspection for shifting was conducted on 09.02.2011.The Committee considered the VT Report, VCD and all the relevant documentary evidences and it was decided to serve the Show cause Notice under section 17 of NCTE Act for the following:

1) The building plan submitted is not approved by competent Govt. authority. Plot no. and Khasara no. are not mentioned in the Building Plan. Approved building plan from Govt. authority is to be submitted.

2) FDRs for Rs. 5 lakhs & 3 lakhs towards endowment and reserve fund respectively from Nationalised Bank in the Joint account is to be submitted.

3) Non-encumbrance certificate from competent Govt. authority in English Version is to be submitted.

4) Furniture in the library needs to be strengthened.5) Science lab & other labs/Physical Education lab need to be

strengthened.

In view of the above, the Southern Regional Committee in its 204th Meeting held on 27th and 28th April 2011 decided to issue a Show cause Notice. The application was processed inadvertently B.Ed course instead of D.E.C.Ed course and the deficiency letter was issued to the institution on 22.12.2009. The institution did not submitted reply to deficiency letter.

The SRC considered the matter in its 190th meeting held on 29th-30th March 2010 and on careful perusal of the original file of the institution and other related documents, NCTE Act 1993, Regulations and guidelines from time to time laid on the table, written representation from the institution, the Regional Committee decided to reject the application on the following grounds:-

The institution has not replied to the deficiency letter even after a lapse of three months and hence it is decided that no further action is necessary and that the application is to be rejected.

Accordingly, rejection order was issued to the applicant institution on 03.05.2010.

Appeal authority remands back the case to the SRC with direction to issue fresh deficiency letter to the institution at the correct address. As per the decision of Appellate authority a fresh deficiency letter to the correct address was issued on 25.10.2010. Institution submitted its reply on 21.12.2010.

The SRC in its 200th meeting held on 20-21 January, 2011 considered the matter and all relevant documents and decided to cause inspection to examine whether the institution fulfils all the requirements as per the norms, for the proposed programme.

As per the decision of SRC inspection of the institution was scheduled between 22nd –25th March, 2011. Institution was unwilling for facing the inspection as per statement of VT members and has requested for postponement.

informing that the recommendations of the Government of Andhra Pradesh not to grant recognition/permission in respect of other courses like B.Ed, D.Ed and Physical Education courses have been considered in NCTE and it has been decided that no further recognition/permission to any institution in the State of Andhra Pradesh be considered by SRC for the academic session 2009-2010 for B.Ed, D.Ed and Physical Education courses also.The letters dated 07.01.2009, 07.02.2009 and 17.03.2009 were considered by SRC in its 172nd Meeting held on 25th and 26th March, 2009 and the Committee decided to accept the recommendation of the State Government of Andhra Pradesh, not to grant recognition to any of the teacher training institutions in the State of Andhra Pradesh for the year 2009-10 and decided to return the applications.As per the decision of SRC the application for B.Ed course in the respect of K.B.R College was returned along with documents and processing fee of Rs.40000/- on 28.04.2009.Further the institution has approached Hon’ble High Court of Andhra Pradesh in W.P.No.10067 of 2009. The court has passed order dated 13.07.2010 which reads as under:“With a direction to the first respondent to take necessary steps for granting recognition to the petitioners College of Education at Narsireddy Kandriga, Naidupeta, Nellore District in accordance with the relevant rules. This recognition shall ensure to the benefit of the present academic year has already commenced with the schedule of counseling which is to begin from 02.08.2010. in the circumstances of the case, there shall be no order as to costs”. SRC in its 195th Meeting held on 17th – 18th August, 2010 considered the matter and decided to direct the Management/institution to resubmit the old application returned by SRC along with the documents as originally submitted relating to land, building, FDR, Application fee, BCC from competent Government Engineer and other relevant aspects for processing and for necessary action. As per the decision of SRC a letter was issued on 23.09.2010 and a letter to revalidate the DD was issued on 07.10.2010. Till date institution did not submit its written representation alongwith revalidated D.D. SRC in its 201st meeting held on 22nd –23rd February, 2011 considered the non-reply of the institution to the SRC’s letters dated 23.09.2010 and 07.10.2010 and decided to send a Show cause Notice Accordingly a final show cause notice was issued to the institution on 18.03.2011. The institution has submitted its written representation on 10.06.2011.The Committee in its 207th Meeting held on 23rd June, 2011 considered the VT Report, reply of the institution and all the relevant documentary evidences and it was decided to serve Final Show cause Notice under Section 17 of NCTE Act. Accordingly, final show cause notice was issued to the institution on 21.07.2011. The institution has submitted written representation on 26.08.2011.

The Committee considered the reply of the institution dt. 26.08.2011 and decided that, It will be advisable to give some more time for the construction to be completed. Accordingly, Southern Regional Committee may wait for one more month for receipt of the Building Completion Certificate. This case may be resubmitted for consideration in Nov.11.

The institution in its letter dated 25.09.2007 has submitted a proposal for shifting of premises along with Rs.40, 000/- towards shifting fee.

The inspection was carried out on 30th December 2010. The inspection report has been received along with VCD.

The SRC in its 204th meeting held on 27th-28th April 2011 considered the all relevant documentary evidences and it was decided to issue Final Show cause notice. Accordingly, Final Show cause notice was issued to the institution on 30.05.2011. The institution has submitted its written representation on 29.06.2011.The Committee in its 208th meeting held on 13th-14th July, 2011 considered the VT Report, VCD and all the relevant documentary evidences and it was decided to serve another Show cause Notice under Section 17 of NCTE Act. Accordingly, show cause notice was issued to the institution on 05.09.2011. The institution has submitted written representation on 10.10.2011.

unsatisfactory and unconvincing and decided to withdraw recognition for D.Ed (APS02125) course with effect from 2012-13, in order to enable the ongoing batch of students in D.Ed course, if any, to complete their course.Accordingly, order of withdrawing recognition was issued to the institution vide its order no F.SRO/NCTE/2010-2011/27851 dated 25.03.2011.Aggrieved by the withdrawal order of SRC the institution preferred appeal to NCTE-Hqrs and the appellate authority in its order no. F.No.89-236/2011 Appeal/5th Meeting-2011 A40608 dated 03.08.2011 the Council reached the conclusion that there was adequate ground to accept the appeal and set aside SRC’s order dated 25.03.2011 with a direction to the SRC for re- consideration of the case and issuing speaking order of withdrawing recognition. Accordingly, the appeal is accepted and the order of the SRC dated 25.03.2011 is reversed.

The SRC in its 210th Meeting held on 22nd-23rd August, 2011 considered the Council directions Dt. 03.08.2011 and decided to process and reconsider the reply to the show cause notice.

The Committee considered the earlier reply of the institution to process the reply of the institution as per the direction of the Council and decided that the circumstances governing the case warrant re-inspection of the premises. Accordingly, re-inspection of the premises may be organised after receipt of Rs. 40,000/- as fee therefor.

National College for Teacher Education, Ernakulam District – 683554, KeralaNational College for Teacher Education, Allama Iqbal Memorial National Trust, Iqbal Square Meprathupady, Perumbavoor, Ernakulam District – 683554, Kerala was recognized by SRC, NCTE for M.Ed. course on 01.10.2007. A complaint has been received from Prof. P.C. Krishnan, Secretary, Educational Reforms Forum, Thiruvananthapuram, Kerala on 5.5.2009. The complainant made complaints against 21 institutions, which are functioning in the State of Kerala. All the institutions were granted recognitions during 2002-2006. The complainant has stated that the B.Ed. and M.Ed. un-aided institutions in Kerala noticed serious defects like infrastructural and instructional facilities available in these institutions. The complainant is requesting SRC-NCTE to conduct a surprise inspection to confirm the authenticity of the complaints made.

The matter was placed before SRC in its 175th meeting held on 13th and 14th May, 2009. The Committee decided to issue show cause notice under section 17 of NCTE Act. Accordingly notice was issued to the above institutions on 4.6.2009 for the following reasons:-

The institution does not possess qualified Professor, Reader and Lecturer for conducting the M.Ed. course.

The infrastructural facilities have not been provided for PG course in education.

The institution has replied to the Notice on 16.9.2009. The matter was considered by SRC and it was decided to cause inspection under Section 17 and ask the institution to submit the reply to the Questionnaire (for all courses including TTC). As per the direction of the Regional Committee, a letter was issued to the institution on 03.12.2009. In response to this letter the institution has submitted Questionnaire for M.Ed course. Inspection under Section 17 was conducted to the institution on 22.3.2010.

On careful perusal of the original file of the institution and other related documents, Act of NCTE, 1993, Regulations and guidelines from time to time laid on the table, visiting team report under section 17 of NCTE Act, the Regional Committee decided to withdraw recognition of B.Ed.(APS0628), M.Ed. course (APS05798) and B.Ed.-Addl. unit(APS06290) on the following grounds:-

The institution is functioning in multi floor building complex which also houses part of a school run by the same Management. As evident from the VCD, all the teacher education programmes of B.Ed., B.Ed. Addl. M.Ed. and TTC are run in the same building along with school which is against the NCTE norms.

The VT Report, giving the infrastructural data(built-up area etc.) and also duly countersigned by the Management of the institution, stated the following:-The built-up area available and earmarked for Teacher education programmes were as follows:

Actual requirement as per norms.B.Ed. & B.Ed. Addl. Batch : 1,390 sq.ft. 16,000 + 6,000 sq.ft.M.Ed. : 4,596 sq.ft. 6,000 sq.ft.TTC : 4,900 sq.ft. 11,000 sq.ft. -------------------- ------------------Total : 20, 886 sq.ft. 43,000 sq.ft. -------------------- --------------

Thus as per the above break-up, against the required built-up area of 43,000 sq.ft. as per the NCTE norms, for all the teacher education programmes, the available earmarked built-up area is only 20,886 sq.ft. the shortage being as high as 22,114 sq.ft.

In view of the fact that the available space will be adequate for the earliest approved TTC course (and the remaining space will not be adequate for the remaining programmes), it is decided that approval for the programmes of B.Ed.(APS0628) and B.Ed. Addl. Intake(APS06290) and M.Ed.(APS05798) be withdrawn w.e.f. 2010-2011. No further admission in these programme. The TTC programme alone be continued.

While, the visiting team has given the actual data on built-up area, it has made a wrong observation about its adequacy, for which separate action is contemplated.

The top floor housing Multi-purpose Seminar Hall is a temporary shed with tin sheet roof which is not acceptable as per NCTE norms.

As the management itself has concurred with the VT report on built-up area data,(through their counter signature), it was decided that there was no need for any further notice to be sent. Already an opportunity was given by the issue of Notice under Section 17 and the institution’s reply was duly considered. Now, the deficiencies had been admitted by the Management itself.

Now the institution has approached Appellate Authority. Accordingly, the Council hereby reverses the order appealed against with the direction to the SRC for restoring the recognition of the B.Ed. programme with an intake of 100 only and for addition unit of B.Ed programme & M.Ed programme the recognition stands withdrawn.

SRC in its 197th meeting held on 13th –14th October, 2010 considered the Appellate Authority Order Dt. 22.9.2010 of the institution, VCD and other related documents along with the original file of the institution and decided to restore recognition to one unit of B.Ed only with an intake of 100 candidates only. Whereas the recognition to M.Ed courses be withdrawn and further, it is made clear that the institution is debarred from making any further admission subsequent to the date of issue of this order. The Affiliating body / Examining board / body may be informed accordingly for necessary enforcement.

The institution has approached to Hon’ble High Court in W.P.No. 29284/2010. The Hon’ble High Court has an order on 28.02.2011 vide W.P. No 4387 of 2011 reads as hereunder:“Yet another grievance of the petitioner is that in respect of one batch of B.Ed course for which recognition has been restored by the 1st respondent as per Ext.P10, students are not allotted by the 3rd respondent. Now that recognition has been restored as per Ext.P10, petitioner is entitled to allotted students. Therefore, I direct the 3rd respondent to allot students to the B.Ed course offered by the petitioner on the strength of a copy of this judgment. Subject to the above, Ext.P10 will stand in all other respects. Writ petition is disposed of as above”.

SRC in its 203rd meeting held on 31st March-1st April, 2011 decided to call for clarification on whether the undertaking given by the management to the Hon’ble High Court of Kerala that the Asbestos, roofed covering an area of 3000 sq.ft. would be replaced by RCC roof has been fulfilled. If so, the management be directed to produce documentary proof from a Govt.

The institution has submitted documents on 06.05.2011 as per website as under: - The committee in its 206th Meeting of SRC held on 09th – 10th

June, 2011 considered the reply of the institution dt. 06.05.2011, and decided to cause Composite inspection of the institution on submission of Rs. 40000/- towards inspection fee for each of the courses being run under Section 17 of NCTE Act. Accordingly a letter dt 29.06.2011 was issued to the institution for submission of inspection fee. Inspection of the institution was conducted on 07.07.2011 & VT Report was received to the SRC-NCTE on 14.07.2011. The Institution not submitted Inspection fee of Rs. 40000. However the inspection has been conducted on 07.07.2011.

As per the VT Report total built up area is 32,536 sq.ft. for D.Ed, B.Ed and M.Ed courses.

The inspection of the institution was done on 07/07/2011.The Committee in its 209th Meeting held on 31st July, 2011 considered the VT Report, VCD & and all the relevant documentary evidences and it was decided to serve Show cause Notice under Section 17 of NCTE Act. Accordingly, a show cause notice was issued to the institution on. 27.09.2011. The institution submitted written representation on 10.10.2011.

The Committee considered the written reply of the institution dt. 10.10.2011 and decided that, since all the requirements have been satisfactorily fulfilled, continuation of the M.Ed course is approved.
