1 Submission to Office of Legislative Audits & Board of Public Works Downtown Frederick Hotel & Conference Center by Peter Samuel March 18, 2019 SUMMARY: The Downtown Frederick Hotel and Conference Center project (DFH&CC or just ‘hotel project’) sponsored by the City of Frederick is the subject of extraordinary waste and fraud. Under Maryland law §12–102 it is the Board of Public Works’ duty to see that state funds flow only to projects that are efficiently and competitively procured. 1 Similarly at §2–1217 the Office of Legislative Audits exists to investigate and prevent fraud or waste by state agencies, and to advise the legislature where this occurs. 2 The City of Frederick’s (City) procurement of the hotel developer Plamondon Hospitality Partners (Plamondon) for the hotel project deserves investigation by the Office of Legislative Audits. Meanwhile the Board of Public Works should freeze all funds appropriated for this project. From 2010 on key aspects of the procurement of a hotel developer were outsourced by the City to a shady public-private body most commonly known as the Downtown Hotel Advisory Committee (DHAC 3 ). The DHAC specified the hotel to be sought in the RFP, decided sites to be considered, the form of the procurement, the selection of consultants. The Request for Proposals, RFP14J issued by the City in February 2014, was issued in the name of the DHAC. The DHAC formed the selection committee when proposals were received, and it scored the two proposals, presenting the Mayor and Board of Aldermen with what it claimed was a clear winner in Plamondon 4 . The DHAC has also been the source of promotional advocacy on behalf of the project. It has organized supporters to dominate meetings and paid for ‘independent’ experts to place favorable articles in newspapers and magazines. 5 1 http://mgaleg.maryland.gov/webmga/frmStatutesText.aspx?pid=&tab=subject5&stab=&ys= 2015RS&article=gsf&section=12-102&ext=html&session=2015RS/ 2 https://www.ola.state.md.us/top_pgs/Organizational%20Structure/organization_struc_main.htm l 3 Pronounced ‘dee-hack’ 4 Plamondon is used to mean Pete Plamondon Jr and his family business Plamondon Hospitality Partners which is the largest hotel operator in Frederick. 5 http://frederickhotelboondoggle.us/2016/09/griffin-key-points-for-recruited-speakers-says- no-taxpayer-s-to-be-used-calls-for-demolition-of-dilapidatedfire-damaged-tannery/

The latter are the interest groups who want a publicly funded DFH&CC. The selected developer Pete Plamondon Jr was apparently a member of the DHAC until not long before the procurement. He was publicly recognized as a member of DHAC, being introduced as such by DHAC chairman Robbins at the beginning of a DHAC presentation to the Mayor & Board of Aldermen meeting, February 6, 2013. 14There the City Attorney argued the DHAC was a local Chamber of Commerce, not a City, entity. This contradicted repeated public statements that the DHAC was appointed by the Mayor. And it was inconsistent with City Hall being the normal venue for DHAC meetings and the central role of the City’s Richard Griffin in calling meetings, setting the agenda, and the City’s financing of DHAC consultants to the tune of about $300,000. In calling DHAC a Chamber of Commerce entity the City was saying, in effect, it had outsourced procurement of a developer as City ‘partner’ to a business group, the very group which had been lobbying for taxpayer underwriting of the project. 15ExtensionofthedeadlineinRFP14JwasurgedbyGriffinonthesegroundswhenWormaldsaidhewasotherwiseunabletosubmitaproposal–inanemailtoCitypurchasingofficerKandiFullerton.
