The Ukrainian Revolution of Dignity began with the demand of activists to sign the Association Agreement between Ukraine and the European Union. Many people supported the protest precisely because of rejection of high level corruption.

According to research, corruption itself was one of the most important reasons that led to mass protests in early 2014.

According to the results of the research "the barometer of global corruption" which conducted by the international organization Transparency International in 2013, 36 percent of Ukrainians were ready to go out to the streets protesting against corruption.

At the end of February 2014, Viktor Yanukovych with his closest associates fled the country, but the main issue of struggeling against corruption has become one of the main tasks for the society.

The Dignity Revolution has also substantially changed the political vector of the country. Ukraine has become much closer to co-operating with Western countries, and in particular with the European Union. Europeans, in turn, have begun to demand clear and decisive steps from Ukraine to build anti-corruption institutions. In exchange, Ukraine received macroeconomic assistance and liberalization of the visa regime.

We have worked very closely with other international organizations and colleagues here. With American colleagues, with international institutions, with the IMF it was clear that these old institutions themselves were the subject of corruption.


There is a lot of corruption there, in the judicial system, in the prosecutor's office, and in the police.


To build effective institutions, it was necessary to create them from the beginning, because it is like a house. When the house is old, it's difficult to repair it, it's better to destroy, demolish it and start building with a new foundation.


Here is the same situation. With new people, with new rules, with new templates, it is much better to fight corruption more effectively than with those who have already infected with corruption.

During the Revolution, we advocated sanctions against Yanukovych and his associates quite successfully, and after the Revolution


We tried to use the «window of opportunity» to advance legislative changes so that we had the infrastructure for punishing corruptive crimes of high officials.


On January 16, 2014, the 7th convocation of the Verkhovna Rada could establish a dictatorship for a long time after voting for the dictatorial package of Yanukovych's laws; instead, within a few months, under the pressure of public activists

and after the victory of the Revolution of Dignity, the same Verkhovna Rada was forced to vote for the Anti-Corruption Law Package, which gave the beginning of the creation of new anti-corruption institutions.

The passed package of laws provided for the creation of three new authorities - NABU, SAP and NACP.

They were supposed to provide a prerequisite for a more effective fight against corruption.


The first of these authorities was NABU. The objectives of this authority were to identify, stop, and disclose corrupt crimes. However, NABU should take care only of high-ranking officials and only by separate articles of the criminal code, which are mainly related to corruption

If talk in general, NABU deals with detection, termination, investigation of criminal offenses, but not any, namely, the highest officials. Namely, they are civil servants of Category A, ministers, secretaries of state, judges, and the leadership of law enforcement authorities.


Our trials are very narrow. Unfortunately, people do not understand this, and we receive statements from everyone from communal services to the president of Ukraine.


That is why, it would be desirable to have a broader circle of subjects on which we can work, on the other hand, we understand that we have 700 people


including 200 detectives, and that not all are recruited even to this day, therefore, to embrace all the highest state employees, on 200 people all over Ukraine is very hard.

At the beginning of NABA's work, it was record number of top-level officials during all history of Ukraine who was under investigation.

Among those who were under investigation were such high officials as the head of the Central Election Commission, the chairman of the SFS, the son of the Minister of the Interior, people's deputies and many others.


Talking with colleagues from the past place of work, none of them could not imagine that the case not only would be brought to court, but in general will be disrupted criminal proceedings against the acting head of the SFS, the acting people's deputies of Ukraine.

Another 4-5 years ago, none of my former colleagues from the law enforcement system, could not have imagined that the actual officials had a real investigation, it was never before. I believe that this is a real achievement of our own authority.

When I was working at the military prosecutor's office and I had more or less resonant interest in the cases, and someone was interested in ending them in a certain way, or closing them off, or direct them to court

I never understood this and did not consider it necessary to follow such instructions, therefore, such employees like me, they had either disciplinary problems, or they took away the case. If it were, I would not have stayed in the civil service. Here I feel that I am an autonomous procedural person.

That is, the prosecutor is the filter between the investigator and the court, which should first of all ensure the legality of the pre-trial investigation in all proceedings concerning top-level corruption, and secondly


If he admits that the evidence is sufficient and they can be referred to the court, the prosecutor brings them to the verdict those proceedings that were investigated by the detectives of NABU.

Amendments were made to the Law of Ukraine on the Prosecutor's Office, where the SAP was created as a separate department of the GPU with a clear narrow specialization. And actually, as far as I remember, it was February 2015, when the relevant changes were adopted, and in September 15, by the order of the Attorney General, an SAP.


The feature of the SAP is that all the prosecutors who work here are all recruited through an open competition, which was held with the participation of specialists and with participation including international partners.


I was chosen in the competition, my deputies, the heads of the deputies, the prosecutors went through that “throat of selection” and through the tests that were before us put. This is also a test of knowledge of legislation, both general skills tests and interviews.

But shortly there were serious problems between the heads of NABU and SAP. This aquarium has become a symbol of the scandal between Artem Sitnik and Nazar Holodnitsky. It was there that the device was hidden through which the head of the SAP was listening.

Conflicts of organs continued, it even came to the fight. Despite this, the authorities continue to work further, albeit with less effectiveness than they could.


We have never been supporters of bringing all these conflicts to the public sphere. Even when something was wrong, the SAP always kept silent and said that everything was fine, it was definitely a bug in part and it must be recognized.


But this does not threaten the institutions, because the institutions are working. The SAP will work regardless of whether Kholodnitsky will be there or there will be another surname on the post of head. NABA will work regardless of whether Sitnik is there, who is not an investigator at all in the proceeding, or is there not.

There is no need to differentiate between institutions and individuals who manage them. The Verkhovna Rada will not go anywhere when the elections are over and for example Parubiy will not become the head of the convocation. There were heads to him and after him would be.


The same thing here, after another, will be another manager, whether I will go myself, or I will go after the end of the term for which I was assigned. Therefore, it is impossible to speak about a conflict


The only thing is that all these events make us more closely and more qualitative to assess our evidence in these proceedings. And this, in turn, I do not exclude that it can be accused of someone blocking something to someone.

We work with them for almost 24 hours a day, 7 days a week. In general, cooperation is satisfactory, there are some discussion points in a number of proceedings, when just does not coincide legal position.


We, as detectives, usually want our case to be brought to court, on any evidence basis, prosecutors after we send the indictment to court, they will defend this case in court then, so they are more demanding on the evidence base and sometimes would like the evidence to be iron-concrete there.


But sometimes there are discussions about this, because in such a category of cases, on such subjects the evidence of reinforced concrete is almost never happen. But these work moments are generally satisfied with the cooperation.

Despite the conflicts of the two agencies, activists believe that the creation of NABU and SAP is a positive example in building new institutions.

Since 2014, a number of anti-corruption institutions have been established. Some of them are a really successful example of the fact that independent institutions can be launched in Ukraine.


Others are the opposite of the situation. Successful are NABU, as well as SAP, at least in the part of the activities of middle level prosecutors, which execute directly the procedural guidance of the NABU investigations.

Such obscene luxurious apartments often have Ukrainian officials who have not been working in business for a day. To hide the corrupt origin of such assets, they often record them on relatives, but in order to detect such cases in Ukraine, the National Agency for the Prevention of Corruption was created.

The NACP was created as a central executive authority with a special status. This authority should ensure the formation and implementation of state anti-corruption policy. For this he received an extremely wide range of powers.

The main weapon of the NACP was to become the system of electronic declaration of officials.

With adopted changes to the law, all officials must declare their wealth and accordingly have to be prepared for explanations as to their origin. By declaring false information, now you can get 2 years of imprisonment under the article of illegal enrichment.


The system of electronic declaration is on the agenda in each developed country where there is the IT industry that is in paper form to process declarations, where a small amount of date, which can be compared with the actual state of affairs.


Of course it was necessary to introduce. And this was foreseen in the anti-corruption strategy and directly in the new wording of the "Law of Ukraine on the Corruption Prevention".


Indeed, the introduction of an electronic declaration system was the first indicator of the lack of desire of the authorities to make changes. Why? Because such a consolidation of absolutely diverse political forces we have never seen before, I say never in the time after the Revolution of Dignity.

However, the NACP did not work as effectively as expected. Of the millions of declarations, only a few hundred have been tested.

Now, in NACP there is situation that the leadership is loyal to the Presidential Administration. It is advantageous to the majority in the Parliament, because they are not interested in making an automatic system of checking declarations


They execute political orders, it means that they search corruption where they say due to certain political opponents, even when there is no corruption and no problems, not see in electronic declarations top officials who are close to power.

In addition to the fact that the authority is often associated with the influence of politicians, the NACP is also remembered by the scandal with the issuing of significant awards to itself.

I believe that we have a corresponding step in advance, because the intolerance of corrupt practices has already taken place in society - this is the main thing. It is clear that citizens will measure the number of criminal cases and so on. Unfortunately, most ordinary citizens today do not understand the functions of the NACP, do not understand that this function is primarily preventive.


We are not a law enforcement agency, and we must first of all clarify and enforce the relevant restrictions related to compliance with anti-corruption legislation. But this is not the function of the NACP, we have to provide a prevention


And if a person has committed such violations, we must objectively and fully investigate this, for referral and for investigation to our respective anti-corruption authorities. And in this sense, we are doomed to effective cooperation.


As for the NACP, in my personal opinion, cooperation with them gradually deteriorated from the start. For the first time, we were blocked from access to the basis of declarations, although under the law on NABU we have direct access to it.


Now we are forced for each separate declaration to go to the NACP and get permission. Secondly, the NACP publishes, from the legal point of view, unreasonable

explanations, which, in criminal proceedings, are related to the non-declaring of property for unlawful enrichment


They only insert us stick in the wheels. These clarifications do not allow gathering the necessary evidence base, which was in principle from the very beginning.


Caught and released. These are realities of the Ukrainian combating corruption.

No matter how much NABU would catch corrupt officials


The Ukrainian courts will simply let them out, so that is why in Ukraine decided to create a new independent Anti-Corruption Court.

The Highest Anti-Corruption Court will deal exclusively with cases, which related to the investigation of the NABU.

All judges will be recruited according to the results of the open competition, and the international partners of Ukraine will oversee the selection process.


The majority of NABU cases are sabotage the courts. What does sabotage mean? Simply postpone the decision. Consider these cases for an extremely long time, years. Almost a year is only being read out of the indictment against the ex-head of the SFS.


The situation will change the Anti-corruption Court, which, by analogy with NABU, has guarantees of independence.

For example, recently in the underground there were hundreds of posters with the head of NABU, about which this authority had not even guessed.

This was obviously done in order to cause skepticism in society.

Also recently, at that time when activists demanded the resignation of the head of the SAP, protesters stormed into NABU, demanding the resignation of the head of NABU. Later, journalists found the link between these people and influential government officials.

The experience of foreign countries shows that attacks of the system in response to the activities of anti-corruption institutions are everywhere.


This also applies to developed countries and countries that only implement such institutions, that is, it is a normal reaction of the system when it fights in response to those who are struggling with it. Expecting attacks on the activities of anti-corruption institutions is still ahead. They were they and they will be.


How can this be countered?

First, there should be a clear firm position of the leadership of these institutions, they must defend their positions and not lose sight their positions, not to deviate from the critical priority issues in the activities of their institutions.

Secondly, it is a projective support of citizens and non-governmental organizations. At the moment, citizens take a rather passive position.


And it seems to me that currently one of the biggest allies in supporting the activities of these institutions is international organizations and the international community in general, and the level of embassies and governments of other countries

Officially, the international communities see in many respects problems in Ukraine's declared reforms in the fight against corruption. However, partners are still ready to support the direction of anti-corruption reforms in Ukraine.


There is progress ahead, although it is slow, but there is. We understand that there are no alternatives to make a step back, this way we have to pass together, we are ready to go along with you, to be with you, to consult, to provide expert assistance, financial assistance, so that you can finish this process yourself.


And there are other countries that also had corruption problems, it's also the EU member states that joined the EU, which already with the support of the EU successfully overcame corruption, we have precedents and we believe that Ukraine will also be an example of a successful fight against corruption.

In many ways, it depends on society, because at the crucial moment, those who want to protect anti-corruption institutions must be no less than those who want to destroy them.

Ще 5 років тому потрапити сюди було абсолютно неможливо. Колишня державна резиденція перетворилась на оселю для одного з найбільших корупціонерів країни. Але за іронією долі саме корупція стала однією з причин завдяки якій він був змушений тікати з країни. А сьогодні його оселя перетворилась на музей корупції. Мабуть найбільший у світі.

Українська Революція гідності почалась з вимоги активістів підписати Угоду про асоціацію України з Європейським Союзом. Чимало людей підтримувало протест саме через несприйняття високого рівня корупції.

За даними досліджень, саме корупція була однією з найголовніших причин, що призвела до масових протестів на початку 2014 року.

Революція гідності також суттєво змінила політичний вектор країни. Україна стала набагато тісніше співпрацювати з західними країнами, та зокрема з Європейським Союзом. Європейці в свою чергу почали вимагати від України чітких і рішучих кроків у побудові антикорупційних інституцій. В обмін Україна отримувала макроекономічну допомогу і лібералізацію візового режиму.


Ми тут дуже тісно співпрацювали з іншими міжнародними організаціями і колегами. З американськими колегами, з міжнародними інституціями, з МВФ. було зрозуміло що ці старі інституції вони самі стали предметом корупції.


В них є багато корупції, в судовій системи, в прокуратурі, міліції.


Щоб побудувати ефективні інституції то треба було їх створювати з самого початку, бо це як будинок. Коли він у вас хитається, то важко його ремонтувати, краще його знищити, знести і почати будувати його з новим фундаментом.

Тут така сама ситуація. З новими людьми, з новими правилами, з новими зразками, набагато краще, ефективніше бороти корупцію ніж з тими які самі вже заражені корупцією.

Вагому роль у цих процесах відігравали громадські активісти, які створювали додатковий тиск на владу у питанні боротьби з корупцією.


Під час Революції ми адвокатували санкції проти Януковича та його соратників досить успішно


і після Революції ми намагались використати вікно можливостей щоби просунути законодавчі зміни для того щоб у нас була інфраструктура для покарань за корупційні злочини високопосадовців.


16 січня 2014 року 7 скликання Верховної Ради могло надовго встановити диктатуру проголосувавши за диктаторський пакет законів Януковича, натомість вже за декілька місяців, під тиском громадських активістів


та після перемоги Революції Гідності цей самий склад Верховної Ради був змушений голосувати за Пакет антикорупційних законів, який і дав початок створенню нових антикорупційних інституцій.


Проголосований пакет законів передбачав створення трьох нових органів – НАБУ, САП та НАЗК. Вони мали забезпечити передумови для більш ефективної боротьби з корупцією.


Першим з цих органів було створене НАБУ. Задачами цього органу били виявлення, припинення та розкриття корупційних злочинів. Втім НАБУ мало опікуватись лише високопосадовцями і лише окремими статтями кримінального кодексу, що переважно пов’язані з корупцією


Якщо брати в загальному, НАБУ займається виявленням, припиненням, розслідуванням кримінальних правопорушень, але не будь-яких, а саме найвищих посадових осіб. Тобто це державні службовці категорії А, міністри, державні секретарі, судді, керівництво правоохоронних органів.


Наша підслідність вона дуже вузька. Люди нажаль цього не розуміють і нам надходять заяви на всіх, починаючи від комунальників і завершуючи президентом України.

Тому дуже хотілося б мати ширше коло суб’єктів по яким ми можемо працювати, з іншої сторони ми розумієм що в нас 700 людей


з них 200 детективів і то не всі набрані навіть на сьогоднішній день, тому охопити всю найвищу державну ланку службовців, на всю Україну 200 людей дуже важко.

З початком роботи НАБУ, під слідством опинилась рекордна кількість топ-чиновників за всю історію України.

Серед тих, хто потрапив під слідство були такі високопосадовці як голова ЦВК, голова ДФС, Син Міністра МВС, народні депутати та багато інших.


Спілкуючись з колегами з колишнього місця роботи, ніхто з них не уявляв, що не те, що справа до суду буде направлена, а взагалі будуть порушені кримінальні провадження проти діючого голови ДФС, діючих народних депутатів України.


Ще 4-5 років тому назад ніхто з моїх колишніх колег з правоохоронної системи не міг такого уявити, щоб по діючим посадовцям були реальні розслідування, такого раніше не було. Я вважаю що це реальний здобуток саме нашого органу.

Коли я працював у військовій прокуратурі і в мене були більш менш резонансні цікаві справи і хтось був зацікавлений в тому, щоб вони закінчились певним чином, або закрити їх, або направити їх в суд


то починались виходи на моє керівництво і з головної військової прокуратури були дзвінки на кшталт - “ось цю справу треба закрити до п’ятниці”.


Я ніколи цього не розумів і не вважав за необхідне таких вказівок дотримуватись, тому такі співробітники як я, у них були або дисціплінарні проблеми, або справу забирали. Якби тут таке було я б на державній службі не залишився. Тут я відчуваю що я автономна процесуальна особа.

Контроль за діяльністю детективів НАБУ у новій архітектурі антикорупційних органів мала забезпечувати спеціальна антикорупційна прокуратура. Вона мала б доводити справи підслідності НАБУ вже у судах.

По простому якщо НАБУ – це орган слідства, це слідчі, то САП це є прокурори, які наглядають за законністю дій і потім в суді підтримують публічне обвинувачення у провадженнях які розслідували НАБУ.


Тобто прокурор це той фільтр між слідчим і судом, який в першу чергу повинен забезпечити законність проведення досудового розслідування у всіх провадженнях щодо топ-корупції, і по-друге


якщо він визнає, що ці докази є достатніми і вони можуть бути направлені до суду, прокурор доводить їх власне до вироку ті провадження які розслідували детективи НАБУ.

Це дань дитячому захопленню зоряних війн, на яких виросло не одне покоління і американських і українських вже дітей.


Були прийняті зміни до закону України про Прокуратуру, де було створено САП як окремий департамент ГПУ з чіткою вузькою спеціалізацією. І власне наскільки я пам’ятаю це був лютий 2015 року коли були прийняті відповідні зміни і у вересні 15-го року наказом Генерального прокурора було створено САП


Особливість САП в тому що всі прокурори які тут працюють, усі набрані за допомогою відкритого конкурсу, який проводився і за участю спеціалістів і за участю у тому числі міжнародних партнерів.


Я був обраний на конкурсі, мої заступники, начальники віділів, прокурори пройшли через те горло відбору і через ті випробування які були перед нами поставленні. Це і тестування на знання законодавства це і тести general skills та відповідно співбесіда.

Та невдовзі між керівниками НАБУ і САП з’явились серйозні проблеми. Цей акваріум став символом скандалу між Артемом Ситником і Назаром Холодницьким. Саме у ньому був схований пристрій через який відбувалось прослуховування голови САП.

Після цього керівники органів почали спілкуватись між собою через ЗМІ. У інтерв’ю виданню дзеркало тижня голова НАБУ розповів, що голова САП допомагає деяким підозрюваним уникати відповідальності.

Назар Холодницький в свою чергу відповів Ситнику своїм інтерв’ю в Українській правді, де звинуватив Ситника у надмірному піарі і непрофесіоналізмі.

Конфлікти органів продовжились, дійшло навіть навіть до бійки. Не зважаючи на це, органи продовжують працювати далі, хоча мабуть з меншою ефективністю ніж могли б.


Ми ніколи не були сторонниками щоб всі ці конфлікти виносились в публічну сферу. Навіть коли щось було не так, САП завжди мовчали і казали що все добре, це напевно була помилка частково і її треба визнати.


Але інституціям це нічого не загрожує, бо інституції працюють. САП буде працювати незалежно від того чи буде там Холодницькій чи буде там інше прізвище на посаді керівника. НАБУ буде працювати незалежно від того, чи є там Ситник, який взагалі не є слідчим у жодному провадженні, чи його там немає.


Тут не треба розмежовувати інституції і осіб які ними керують. Верховна рада ніде не дінеться коли закінчаться вибори і наприклад Парубій не стане головою скликання. До нього були голови і після нього будуть.


Теж саме і тут, після мене буде інший керівник, чи піду я сам, чи піду по закінченню строку на який мене було призначено. Тому тут про конфлікт говорити не можна


єдине що, ці всі події змушують нас більш ретельніше і якісніше підходити до оцінки своєї доказової бази у цих провадженнях. А це в свою чергу я не виключаю, що може вилитись у звинувачення, що хтось комусь щось гальмує.


З ними ми працюємо майже 24 години на добу, 7 днів на тиждень. В цілому співпрацею задоволені, є певні дискусійні моменти по ряду проваджень, коли просто не співпадає правова позиція.


Ми як детективи звичайно хочемо щоб при будь-якій доказовій базі наша справа була направлена до суду, прокурори ж після того як ми направляємо обвинувальний акт до суду, то їм цю справу в суді потім відстоювати, тому вони до доказової бази більш вимогливіші і іноді хотіли б щоб докази були там залізо-бетонні.

Але іноді виникають дискусії з цього приводу, оскільки в такій категорії справ, по таким суб’єктам докази залізобетонними майже не бувають ніколи. Але це робочі моменти загалом співпрацею задоволені.

Попри конфлікти двох відомств, активісти вважають, що створення НАБУ та САП є позитивним прикладом у побудові нових інституцій.


З 2014 року було створено цілий ряд антикорупційних інституцій. Одні з них дійсно успішний приклад того, що в Україні можна запускати незалежні інституції.


Інші – абсолютно протилежна ситуація. Успішні це НАБУ, а також САП, як мінімум в частині діяльності прокурорів середньої ланки, що виконують безпосередньо процесуальне керівництво розслідуваннями НАБУ.


Такі непристойно розкішні апартаменти часто мають українські чиновники, які ні дня не працювали ні дня у бізнесі. Щоб приховати корупційне походження таких активів вони часто записують їх на родичів, але щоб виявляти такі випадки в Україні було створено Національне агентство з питань запобігання коррупції.

НАЗК було створено як центральний орган виконавчої влади зі спеціальним статусом. Цей орган має забезпечувати формування та реалізацію державної антикорупційної політики. Для цього він отримав вкрай широкий спектр повноважень.


Я б назвав би 5 основних функцій, відмінність у нас в тому, що у нас цей орган колегіальний, кожен член НАЗК відповідальний за окремий напрямок.


Це такий напрямок як антикорупційна політика, напрямок організації роботи із запобігання корупції, напрямок конфлікту інтересів, запобігання політичній корупції і фінансовий контроль та моніторинг способу життя.

Головною зброєю НАЗК мала стати система електронного декларування чиновників.

З прийнятими змінами до законодавства, всі чиновники мають декларувати свої статки і відповідно мають бути готовими до пояснень щодо їх походження. За декларування недостовірної інформації відтепер можна отримати 2 роки ув’язнення за статтею незаконне збагачення.

Система електронного декларування то на порядку денному в кожній розвиненій країні де є ІТ індустрія то му що в паперовій формі обробляти декларації, де невеличкий обсяг дати, якої можна порівняти з реальним станом справ.


Звісно треба було запроваджувати. І то було передбачено в антикорупційній стратегії і безпосередньо в новій редакції “Закону України про запобігання корупції”.


І насправді запровадження системи електронного декларування то було першим індикатором відсутності бажання у представників влади проводити зміни. Чому? Тому що такої консолідації абсолютно різнобарвних політичних сил ми не бачили до того ніколи, я говорю ніколи в рамках часу після революції Гідності.

Втім НАЗК запрацювало не так ефективно як очікувалось. З мільйонів декларацій було перевірено лише декілька сотень.


Зараз у нас в НАЗК така ситуація, що керівництво лояльне до Адміністрації Президента. Воно вигідне більшості в Парламенті, тому що вони не зацікавлені в тому щоб робити автоматичну систему перевірки декларацій


вони виконують політичні замовлення, тобто знаходять корупцію там де їм кажуть фас стосовно певних політичних опонентів, навіть коли там немає корупції і не знаходять жодних проблем, не бачать в електронних деклараціях топ чиновників, які близькі до влади.

Окрім того, що орган часто пов’язують з впливом політиків, НАЗК також запам’яталось скандалом з виписуванням чималих премій самим собі.

Скажіть будь-ласка і роз’ясніть суспільству і депутатському корпусу з якого дива в минулому році ви наприкінці року ви собі виділяли премії по 200 тис грн для кожного члена НАЗК.

Стосовно премій. Ніяких незаконних дій з мого боку не було. 200 тисяч гривень була премія, но це премію отримували всі. За роботу.


Я вважаю що в нас є відповідний поступ вперед, тому що вже в суспільстві склалась нетерпимість до корупційних проявів – це головне. Зрозуміло, що

громадяни будуть вимірювати кількістю кримінальних справ і таке інше. Нажаль більшість пересічних громадян сьогодні не розуміють функції НАЗК, не розуміють, що ця функція є передусім превентивна.


Ми не правоохоронний орган, і ми маємо передусім роз’яснити і забезпечити виконання відповідних обмежень, які пов’язані з дотриманням антикорупційного законодавства. Але це не є на сьогодні функція НАЗК, ми маємо забезпечити превенцію


а якщо вже людина допустила відповідні порушення, ми маємо об’єктивно і максимально повно це дослідити, для направлення і для розслідування до відповідних наших антикорупційних органів. І в цьому сенсі ми приречені на ефективну співпрацю.


Щодо НАЗК, на мою особисту думку співпраця з ними поступово погіршувалась з самого початку. По перше нам закрили доступ до бази декларацій, хоча по закону про НАБУ ми маємо прямий доступ туди.


Зараз ми вимушені по кожній окремій декларації їздити в НАЗК і отримувати дозвіл. По-друге НАЗК видає купу з юридичної точки зору необґрунтованих роз’яснень, які по кримінальним провадженням пов’язаним з недекларуванням майна по незаконному збагаченню


вони тільки вставляють нам палиці в колеса. Ці роз’яснення не дозволяють зібрати ту необхідну доказову базу, якої було в принципі з самого початку.


Спіймали і відпустили. Ось такі українські реалії боротьби з корупцією. Скільки б НАБУ не впіймало корупціонерів


українські суди їх просто відпускають, тому в Україні вирішили створити новий незалежний Антикорупційний суд.

Вищий антикорупційний суд буде займатись виключно справами, що відносяться до підслідності НАБУ.

Всі судді будуть набрані за результатами відкритого конкурсу, а за процесом відбору наглядатимуть міжнародні партнери України.


Більшість справ НАБУ саботують суди. Що значить саботують? Просто відкладають прийняття рішення. Розглядають ці справи надзвичайно довго, роками. Рік вже майже зачитується тільки обвинувальний акт стосовно екс-голови ДФС.

Ситуацію змінить АС, який за аналогом з НАБУ має гарантії незалежності.

Потенційне створення антикорупційного суду спочатку не отримало належної підтримки від українських політичних еліт.


Я хочу звернутись до усіх Вас, у ваших країнах є антикорупційний суд? Підніміть руку будь-ласка. А де існує антикорупційний суд?

Втім після численних консультацій з міжнародними партнерами, роботу в напрямі створення суду довелось продовжити.

У разі неприйняття закону про Антикорупційний суд, Європейський парламент пропонував припинити надання Україні макрофінансової допомоги. Під питанням були також і подальші відносини з іншими партнерами, такими як МВФ.

Врешті решт, парламент проголосував за потрібний закон.


Це є перемога! Перемога України! Перемога українського народу! Моя перемога як президента України!

Так, після створення Антикорупційного суду в Україні буде завершена побудова нової антикорупційної інфраструктури, яка може назавжди змінити правила гри в Україні.

Адже, якщо антикорупційні органи зможуть відійти від впливу політиків, а деякі зберегти свою незалежність, в Україні не буде політичних гарантій недоторканості.

Проте вже сьогодні зрозуміло, що до моменту створення антикорупційного суду може відбутись багато змін. Особливо це стосується НАБУ. На цей орган сьогодні скоюються численні нападки, за якими очевидно стоять впливові політики.

Наприклад, нещодавно в метрополітені з’явились сотні плакатів з головою НАБУ, про які цей орган навіть не здогадувався.

Це очевидно було зроблено для того, щоб викликати скепсис у суспільства.

Також нещодавно в той час, коли активісти вимагали відставки голови САП, до НАБУ увірвались мітингувальники, які вимагали відставки голови НАБУ. Пізніше журналісти знайшли звязок цих осіб з впливовими чиновниками із Уряду.


Досвід зарубіжних країн показує, що атаки системи у відповідь на діяльність антикорупційних інституцій є скрізь.


Це стосується і розвинених країн і країн, які лише запроваджують такі інституції, тобто це нормальна реакція системи, коли вона бореться у відповідь з тими хто бореться з нею. Очікувати атак на діяльність антикорупційних інституцій ще слід попереду. Вони були вони є і вони будуть.


Як цьому протидіяти?

По перше має бути чітка тверда позиція керівництва цих інституцій, вони мають відстоювати свої позиції і не здавати свої позиції, не відступати у критичних пріоритетних питаннях у діяльності своїх інституцій.


По-друге це - проективна підтримка громадян і громадських організацій. Наразі громадяни займають досить пасивну позицію.


І мені здається що наразі одними з найбільших союзників у підтримці діяльності цих інституцій є міжнародні організації та міжнародна спільнота взагалі, це і рівень посольств і урядів інших країн

Офіційно міжнародна спільнота багато в чому бачить проблеми у заявлених Україною реформах у боротьбі з корупцію. Втім партнери все ще готові підтримувати напрямок антикорупційних реформ в Україні.


Є просування вперед, хоча воно повільне, але є. Ми розуміємо, що альтернативи зробити крок назад і у вас і у нас немає, цей шлях треба пройти, ми готові пройти його разом з вами, бути поруч з вами, радитись, надавати експертну допомогу, фінансову допомогу щоб ви самі могли цей процес закінчити.


І є інші країни, у яких також були проблеми з корупцією, це також країни ЄС, які увійшли в ЄС, які вже за супроводу ЄС успішно долали корупцію, у нас є

преценденти і ми вірими, що Україна також стане прикладом успішної боротьби з корупцією.


0 – стільки корупціонерів опинилось за гратами, навіть після створення нових антикорупційних інституцій, що не може не викликати скепсису.


Втім сьогодні Україна дійсно близька для того щоб змінити цю ситуацію, і численні нападки на антикорупційні органи є реальним тому підтвердженням.


Але, чи не стане цей музей корупції знову оселею для якогось корупціонера?


Багато в чому це залежить від суспільства, оскільки у вирішальний момент бажаючих захистити антикорупційні інституції має бути не менше ніж бажаючих їх знищити.
