How do I know how much rent I can expect?

Contact any of our Stewart & Watson propertydepartments and we will give you a recommendedmonthly rental figure taking into account theproperty and current market circumstances.

What does a tenant have to pay?

Before the start of the lease the tenant will pay onemonth’s rent in advance and a security depositequivalent to one month’s rent.

Who is responsible for payment of the CouncilTax?

The tenant will be responsible. In this way the tenantwill be able to claim any available reliefs or discountsapplicable to his or her circumstances. The landlordwill be responsible for payment during any voidperiods between tenancies.

Is it better to lease furnished or unfurnished?

That depends on market demand and the type ofproperty you have or the type of tenant you might belooking for. Ask Stewart & Watson for advice onyour individual case.

How long is a tenancy normally for?

We recommend a minimum of 6 months so that youcan set up a Short Assured Tenancy and gainmaximum control as landlord over the property.

Do I need to provide a list of contents?

Yes, you need an itemised list of all contents –otherwise you cannot be sure that you will geteverything back at the end of the lease!

What sort of furniture and contents do I need tomake available?

That is entirely up to you. Imagine that you weregoing to live temporarily for a few months in a rentedproperty and think about what you might need to bemade available if you did not take anything otherthan clothes and personal belongings with you. Thatwould be a good starting point – bear in mind thatthe better equipped the property is the more likelyyou are to get a better rent.

Who makes the final decision as to whether ornot to accept an application from a prospectivetenant?

You do ! It is your property after all.

Can I specify what the tenant can and cannot doin the property?

Yes, you can provide that there is to be no smokingin the property or that there are to be no pets.

Can I specify what kind of tenant I am preparedto have?

Yes, to a certain extent, but you must bear in mindthat you cannot be unlawfully discriminatory – ie,refuse any potential tenant on account of their race,religion, gender or such like.

Do I have to make adaptations to my propertyfor access and use by a disabled person?

Not at the outset at the moment. But if you have atenant who becomes disabled he or she may be ableto ask for adaptations to be carried out. In suchcircumstances it is envisaged that there would begrant assistance available.

Am I allowed to inspect my property?Yes, but subject to giving appropriate notice to thetenant in accordance with the terms of the tenancyagreement.

What happens if the tenant stops paying therent?This is always a difficulty. There is provision forterminating a lease and having a tenant removed fornon-payment of rent, however, unfortunately this isnot a speedy business and strict time limits have tobe observed in raising such proceedings. Thelegislation does tend unfortunately in some areas tofavour tenants – this arises from the days whentenants needed protection from oppressivelandlords. If you are unlucky to experience non-payment of rent we can guide you on what steps totake.

Can I be held responsible for anything done bymy tenants?Unfortunately yes. If the tenant is deemed to behavein a way which is deemed anti-social you can beasked by the local authority to take appropriateaction to have your tenant stop behaving in an anti-social way or to terminate the tenancy. And therewill be sanctions on you if you as a landlord do notco-operate.

Do I have to pay tax on the rent?Yes ! It is a form of income – but there areallowances which you can set off against the incomebefore calculating the tax due. If you are going to benon-resident in the UK, then special rules apply – wewill be pleased to provide you with further detailsshould you so wish.

Frequently Asked Questions about Leasing Residential Property

In these recent economic difficult times when most investments have haddisappointing returns, investment in residential property for leasing has held upits own. The letting market has proved itself to be a sound and profitable area in

which to invest.As mortgages have become difficult to secure, particularly for first time buyers and

with the increase in migrant workers moving to the North East of Scotland foremployment there has been an increasing demand for rented property such that incertain areas the demand far outstrips the supply.

Sharp minded investors have capitalised on this demand and in some cases havebuilt up a portfolio of properties for letting out.

In addition to the investor we have also seen a new category of landlord,sometimes referred to as the “reluctant landlord”. This type of landlord is the propertyowner who would ideally like to sell his property, usually his own home, but due topoor market circumstances is unable to find a buyer in a position to proceed with apurchase of the property.

After some time on the market with no immediate prospect of a sale, suchhomeowners will take the decision to lease out their property thereby allowing themto move on and at the same time ensure that any overheads are covered by the rentalincome. In this way the “reluctant landlord” is able not only to cover costs but in mostcases to make a profit.

And in those cases where the landlord has already bought another home andmoved out of the property the landlord need not worry about paying for utility servicesand Council Tax for a vacant property and does not have the worry in the wintermonths of freezing pipes and deterioration to the fabric of the property due to lack ofheating and airing.

A lot of demand for the private rented sectorproperties has of course arisen as a result of thelack of available properties in the social housingsector – eg, from local authorities. Under the “right to buy”legislation councils and housing associations over the lasttwenty years or so have sold off a lot of their housing stock atdiscounted prices.

The requirement under such legislation to sell housing stockat discounted prices led to a reluctance on the part of councilsand housing associations to build new housing stock – and this coupled withtightening budgets over the last few years means that there has been very littlereplacement, leading to an ever decreasing stock of housing in the social housingsector.

Over the last few years changes in landlord/tenant legislation have beenintroduced with a view to improving the quality of rented property in both the socialand private housing sector. These changes have of course brought around increasedresponsibilities for landlords and anyone considering investing in the letting marketshould take on board such responsibilities when making the decision to become alandlord.

Such responsibilities include the requirement to register the property and registeras a landlord with the local authority. There is also the need to meet certainstandards, known as the “repairing standards”. Becoming a landlord can no longerbe taken lightly, but so saying, providing you set up your property to a reasonablestandard and meet all the requirements of being a landlord it can be a profitableinvestment.
