From the Editor . . . Now that spring is finally here, things at the Association Office are in full swing again . There are all sorts of events to keep everyone busy and entertained as

well. We have several events scheduled in April and May,including our Annual Election, Beautification Day, Community Yard Sale, Summer Kick Off, and more!

Spring always means that it is time for the Annual Election for our Board of Trustees. At this meeting, we will be electing seven new Board members. The Association Office will be accepting ballots until 5 PM on Tuesday, April 2nd. Please see pages 6 - 8 for more information about the upcoming election. If you have any questions, please feel free to call the Association Office at 703-729-6680.

Once again, the Association will be holding its Spring Community Yard Sale to help residents sell some of those buried treasures in their attics/garages/etc . We will be having our next Community Yard Sale on Saturday, May 11th, so you still have plenty of time to get ready for it. We will be advertising the sale locally to bring out lots of buyers! All of the details and the registration form can be found on page 19.

Staff and volunteers are now hard at work on plans for this year’s Summer Kick Off event. This year, it is scheduled for May 25th

Planning an Exterior Change or Modification to Your Property?

If you are making an exterior change/modification to your prop-erty, you must submit an Exterior Alteration Application, along with the applicable worksheets.

Please see the Architectural Standard and/or website to see if a worksheet is required for your project. Approval must be received from the Architectural Review Board before you start your project.

from 4 - 9 PM. This is always a great event for the entire family to attend! We will have several restaurants coming again this year with all of their specialties. There will be a live band playing throughout the evening. For the kids, there will be all kinds of rides, moonbounces, games, and much more! Zambelli Fireworkswill be back again with their incredible fireworks display at the end of the evening. (Please note that portions of Windmill Drive will be closed during the event, so you will need to plan ahead.)

We are still looking for lots of volunteers to help us with this event - we can’t do it without your help! If you are interested in helping (set up tents/tables/equipment, selling tickets, working security, running games, helping clean-up, etc.), we need you!! Please feel free to email [email protected] or call the Association Office at 703-729-6680 to volunteer.

The Board of Trustees is an all-volunteer resident group that is responsible for interpreting the covenants and rules governing Ashburn Farm. Board of Trustees meetings are held on the first Tuesday of each month at 7:00 pm at the Windmill Community Center located on Windmill Drive. All Ashburn Farm homeown-ers are encouraged to attend .

Ashburn FarmAssessments & General Information

Collection PolicyAssessments are due the first day of each month. Any installment of the annual assessment not paid to the Association within thirty (30) days after the due date shall be considered delinquent and a late charge of $25.00 shall be assessed to the Owner and posted to the Owner’s account for every thirty (30) days delinquent.

Home SalesEffective July 1, 1989, the Virginia General Assembly enacted a new law entitled the “Virginia Property Owner’s Association Act” . This act requires the seller of a home to make certain disclosures to the intended purchaser of their lot. All home sales in Ashburn Farm are subject to the Virginia Property Owner’s Association Act. A written request of the Association Disclosure Package and a check in the amount of: $225.00 for an electronic disclosure (on CD-R) for townhome/single family; $250 for a pa-per disclosure for townhome/single family; $100 for electronic or paper disclosure for condo; are required to begin processing. A rush fee of $50.00 may be paid to receive your disclosure within 3 days. Checks should be made payable to the Ashburn Farm As-sociation . A form is available on the website or at the Association Office. The completed package will be issued within 14 calendar days to the requesting party or agent. For further information, please contact the Association Office.

Board BriefsA complete draft of the BOT meeting minutes will be reviewed and voted on at the next BOT meeting. The complete set of minutes may be viewed at the Association Office.

At the regular BOT meeting held on March 5, 2019, the following items were discussed:

• President, Steve Lovejoy, called the meeting to order at 7:00 PM .

• A motion passed (6/0/0/1) to approve the February 5, 2019 minutes, as submitted.

APPEALS• 43021 Hedgeapple Court – Appeal of ARB Denial of Shed

– The homeowner addressed the Board regarding the appeal, stating that other homeowners in the area have installed sheds similar to the one for which he has submitted an EAA . Mr. Lovejoy noted the Board tries to remain consistent with enforcing the Standards. The home is built with a 6’ fence on the sides, and a 4’ fence on the rear plane. Hedgeapple Court is considered a “unique neighborhood” with regard to the Standards because of this fence standard, and small sheds of a certain style are allowed to be built on the sides of these homes . Mr . Cushman noted that the homes with simi-lar existing sheds installed them prior to the Architectural Standards being changed. A motion failed (1/6/0/0) to allow the proposed shed on the side of the home that exceeds 6’ in height, staying within the 40 square foot limit for the footprint. Mr. Lovejoy offered to let the homeowner see a sample of an approved shed that is located near the Windmill Pool, but the resident declined.

• 20982 Fernridge Way, Appeal of ARB Denial Lattice Screen – The resident addressed the Board regarding the 8’ lattice that was installed on her home to prevent the view of Ashburn Farm Parkway from the deck . The Architectural Standards only allow lattice that is a maximum of 8’ in any direction; hers is approximately 16’. She stated that her neighbor has similar lattice around their deck . A motion was made to allow the lattice, which exceeds 8’, on the prop-erty located at 20982 Fernridge Way. Duane Glass stated that the ARB is currently working on changes to the Archi-tectural Standards for decks . The Board agreed that it would be best to wait to rule on this appeal until after the ARB completes its work on the Standard changes. The motion was tabled for review until after the Standards are changed .

REPORTS• Architectural Review Board – Duane Glass stated that the

ARB is continuing to work on the Architectural Standard changes, including deck standards.

• Open Space Committee – Chairman, Bob Kuhfahl, stated that the Committee has been focused on the dog park proj-ect. The members are working on creating a proposal for

the Board to review. Letters will be sent out to homes that will be most-affected by the dog park, in order to get resi-dent feedback . The Committee is also working on the Beau-tification Day project, which is scheduled for April 27th.

• Budget & Finance – Steve Lovejoy stated that accounts receivable is at $67,000 – the lowest it has been in several years. He noted that there are two families on the list for the government furlough assistance .

• Manager’s Report – Mr . Cushman stated that the buzzards in Ashburn Farm are becoming an increasing problem in areas near Summerwood Circle and Hedgerow Terrace. Mr . Cushman noted that there are now turkey buzzards and black buzzards in the area. Buzzard “effigies” have been purchased to hang in some of the trees in these areas to scare the buzzards away. He will be working with an arborist to hang the effigies in the common area trees. The USDA recommends using the bird effigies along with noise harass-ment at dusk to help prevent the birds from roosting in the trees .

OLD BUSINESS• None .

NEW BUSINESS• Trash & Recycling Container Storage & Curbing Policy

Waiver Discussion – This issue was addressed during the Public Forum . A waiver is being considered for residents who are unable to move their trash and recycling contain-ers to and from the curb due to medical issues . This would give the resident the option of only using a bag at the curb for trash and recycling. Mr. Cushman will develop a formal policy and waiver for the Board to review at the next Board meeting .

• Parking Policy Update, Resolution 03052019 - The question has been raised regarding commercially licensed vehicles parking in townhome neighborhoods and how to identify those . There are several vehicles in Ashburn Farm that have dual rear wheels but are not commercial vehicles . A motion passed to honor the existing parking policy which allows dual rear wheel vehicles, with utility racks, but with no additional equipment .

EXECUTIVE SESSION• A motion passed (7/0/0/0) to adjourn the meeting to Ex-

ecutive Session at 10:35 PM .

• The Board returned from Executive Session at 11:27 PM. No votes were taken during Executive Session .

meeting at 11:30 PM .

The purpose of the meeting is to elect Trustees and conduct any other business that may properly be brought before the membership . The Trustees will hold a community forum to answer any questions you may have about the Association . Annual reports from the President, Steven Lovejoy, and the Committee Chairmen will highlight the meeting. This year, there are seven (7) open Board seats. Each candidate will have the

opportunity to introduce themselves and speak to the membership.

In the next few weeks, you will receive a ballot in the mail . Please take time to review the candidates and vote for seven Trustees . We will need to have a quorum of homeowners represented by ballot/proxy to be able to conduct the business of the Annual Meeting . It is very important for you to return the ballot/proxy if you cannot attend. Candidate profiles are included with this newsletter (see pages 7-8). They can also be

found on the Association website. We look forward to meeting you on the 2nd!

How can townhome residents procure a trash and/or recycling toter that complies with the County & AFHOA Standards?

The Association has been working with Patriot Disposal to provide hard-sided containers with tight-fitting, attached lids. An agreement has been made that facilitates townhome owners leasing a 32-gallon recycling and/or trash toter, for a one-time administrative fee of $20 for one container and $15 for a second. These containers will be replaced by Patriot for issues arising from normal use for the life of the service contract. There will be a replacement charge for each toter or bin that is lost, stolen, or damaged.

Please email Kristen Cornwell at [email protected] or call 703-729-6680 to order a toter. Provide your full name, address, the number of toters you need, and how you intend to pay the administrative fee, (added to your HOA account with Summit Management or by check, mailed in or dropped off at the Association Office). The first distribution of these containers is tentatively scheduled for the last week in April.

Association Members who would like additional toters should contact Patriot Disposal and lease them for $25 each.

NOTICE: The 18-gallon open-top recycling bins previously provided by Patriot Disposal to the townhomes will be collected and disposed of if put at the curb for collection, as they do not comply with the Association’s or the County’s

standard for storage or disposal of recycling or trash. This will begin April 1, 2019.

Candidate ProfilesDouglas W. BrewerOur family moved to Ashburn Farm 30 years ago and I have been actively involved in the community, both professionally and personally from the beginning . I am a licensed architect and have successfully run an architectural practice in Loudoun County for over 28 years. My wife, Janice, has worked in the community for over 30 years and my daughter

graduated from Broad Run High School and is currently a teacher in Loudoun County.

I have been fortunate to have experienced and participated in the positive growth and development of Ashburn Farm through the ever changing needs and demands of our community . I have served on the Board of Trustees for the past two years and have been a representative to the Open Space Committee. I was previously a member of the Architectural Review Board where I was the Chairman for five years and a member of the Ashburn Farm New Construction Committee .

Locally I have served as the President of the Broad Run Athletic Booster Club and was active at the Crossroads United Methodist Church (formerly AUMC) as Chairman of the Board of Trustees. Ashburn Farm has consistently been one of the most desirable communities in the region made possible in large part through the committed stewardship of the Board of Trustees and the support of the residents over the years.

If given the opportunity, I pledge to continue to serve our community by supporting the successful policies currently in place and looking for areas of improvement when beneficial to the long-term health of Ashburn Farm. I look forward to being able to utilize my finance and operational management skills to benefit Ashburn Farm.

Steven LovejoyMy wife and I have been residents of Ashburn Farm for twenty years and we have two teenagers attending Trailside middle and Stone Bridge high schools . My background is in Accounting and Finance and I have worked for several local government subcontractors and telecommunications companies.

Frequently I have volunteered to serve my community. I served as President,

Vice-President and Treasurer for my former HOA in Herndon. I have been a judge for Fairfax County science fairs and a coach for Dulles Little League baseball. The kids and I help with Beautification Day clean-up each April as well as Summer Kick-Off.

I joined the HOA Budget and Finance committee in 2009. My contribution has been analysis and understanding of our monthly financial results and communicating our annual budget requests to the Board of Trustees. I also have helped to evaluate and decide on process improvements.

In 2018 I was elected to the Board of Trustees and have served this year as President. With your support I will continue to provide leadership for our Ashburn Farm HOA. We are blessed to have a range of community amenities and services. I enjoy working with the Board, our HOA staff and many community volunteers to improve these offerings and best serve our homeowners .

Stephen LuboreI have lived here in Ashburn Farm for over 27 years. I raise.d two children here and now enjoy spending time with four of my grandchildren on a daily basis . The Farm has been a wonderful and nurturing place to raise a family and in which to enjoy my later years .

Thanks to the support of many neighbors, I have also enjoyed serving on the Ashburn Farm Association Board of Trustees for several terms . Most of that time, I have served as Treasurer of the Association. Since joining the Board, I have energetically worked to keep member assessments low through finding ways to improve the efficiency of operations, through prudently selecting Reserve Fund investment vehicles, and through preparing annual budgets that do not compromise services while providing the funds to necessary to increase community property values and to continue the high standard of services and amenities residents expect and enjoy. If reelected to the board, I will continue to do everything I can to keep assessments low and make sure the HOA wisely spends your money.

In addition to currently serving on the Board of Trustees, I have been active as a member of the Open Space and Budget and Finance Committees . As one of the longest serving Board Members, together with all of my additional experience serving our community, I feel that I have a unique perspective on community concerns that will keep Ashburn Farm as the top place to live in Loudoun County.

Candidate ProfilesRichard OakleyMy name is Richard Oakley, but you could call me Rich. I am a 30-year, retired law enforcement veteran and have lived in Ashburn Farm for fifteen years .

Before moving here, I lived in Franklin Farm, about 15 miles south. I loved living in Franklin Farm because

I found myself surrounded by pristine ponds, scenic paths, and an abundance of wildlife. It was my appreciation for the community that made me decide to serve on the Board of Trustees for five years .

While serving, I truly learned how the tireless efforts of me and my fellow board members were integral in maintaining the beauty and integrity of our community . That is why I also decided to serve as an Ashburn Farm Board of Trustee member from (insert years serving on Ashburn Farm Board of Trustees).

It is because of the Association and the cooperation of our community members that Ashburn Farm is one of the most sought-after communities in Loudoun County. Given that, there are many issues on the horizon that impact our community and I will guarantee my best efforts to help direct the future of Ashburn Farm. I would love the opportunity to serve our community again .

Shirley Tabor Currently, I am serving as a Board of Trustees (BOT) member and would enjoy doing so for another term. There’s a lot happening in Ashburn Farm which continues to give our residents the wonderful amenities they enjoy. Our beautiful pools, great tennis courts, lovely grounds and walking trails are just a few .

As a resident of Ashburn Farm for 27 years, I’ve enjoyed the use of these facilities, and have participated in the many wonderful functions the Homeowners Association has hosted. This is a fine community and I am proud to be a part of it.

In the past I have served on the Architectural Review Board (ARB), which guides the standards of our neighborhoods. As a Realtor, I understand how critical it is to maintain home values as well as the overall appearance of the community. My experience in this field as well as my membership on the ARB would be a focus of my service to the residents . I look forward to volunteering and working with the BOT to continue maintaining and improving Ashburn Farm.

I urge everyone to participate in attending the BOT meetings which are held on the first Tuesday of each month. We look forward to seeing you at the annual meeting on April 2, 2019.

David TigheMy family and I have lived in Ashburn Farm for the last 12 years and, after serving in the military for 28 years and living in multiple countries and states, we are happy to call Ashburn Farm our home!

During my time in the military I dedicated my career to helping and serving others, developing teams and creating change necessary to better the lives of our military members and their families. I began serving our community in October 2018 after being appointed to the Board of Trustees as the Board Secretary and have enjoyed working with the Home Owners Association and the community. With your support I wish to continue serving you and our community as a member of the Board of Trustees .

Approved BOT Resolution -Annual Meeting and Electronic Ballots

At the February 2013 BOT meeting, the Board members passed a resolution, Annual Election Resolution #02052013A, permitting electronic voting for the Board of Trustee election .

You will receive the traditional ballot via U.S. Mail, but you will also have the option of voting online again this year. Instructions will be provided along with the paper ballots to allow homeowners to register and cast their online votes .

You can review the resolution on our website at any time. The election will take place on April 2nd at 7pm at the Windmill Community Center . All residents are encouraged to attend .

The Association is a mixed community of single family homes, townhomes, apartments and condominiums; the latter having access to HOA-owned parking lots, whereas the single-family homes have VDOT streets and driveways. Please remember that the everyone in the community is your neighbor and to please be considerate of each other.

The Association received numerous reports of parking issues and concerns in 2018 and early-2019, and while the majority are related to open parking space monopolization, many of the concerns reported are ingress/egress issues, as well as other concerns that could be avoided by considering your neighbors and their guests in addition to your loved ones and guests when parking or storing a vehicle.

Be considerate and share the available parking spaces in townhome parking lots. The Association Parking Policy allows a vehicle to be parked in unassigned parking spaces for 72 hours. Please move your vehicle from the space within 72 hours, and allow the parking space to occupied

by someone else . Park additional or unused vehicles on VDOT streets and not in Association parking lots, to allow those with guests, injuries, etc. to also use convenient parking spaces.

Single family homeowners & residents, when parking on VODT streets be mindful that homes on those streets may also have to park additional vehicles driven by visiting guests or customers of an Association approved in-home business. When you’re expecting guests, please be considerate and share the available parking on VDOT streets. When parking on a VDOT street consider the needs and privacy of adjacent homes; maybe speak with them to see if they will be having guests over or ask if it would be inconvenient if you parked your extra vehicles along the curb in front of their home before doing so. Additionally, parking your car on the street and allowing your guests to use your driveway is also helpful as neighbors are used to seeing your vehicle and can contact you if there is an issue .

In the past, residents have expressed concerns that the less-burdensome “Annual Property Inspections” and the legally -required, more-detailed, “Resale Disclosure Inspections” provide slightly different results. This created some confusion & stress for Members selling a home. In an effort to address these concerns, the Association began using equal scrutiny on both the Annual Property Inspections and the Resale Disclosure Inspections.

Annual Property Inspections were a response by the Association to feedback from Association Members to better enforce the Association’s Covenants and Architectural Design & Maintenance Standards. The Association has existed as a planned community for over 30 years, and every property here requires both routine and comprehensive maintenance to keep the property in compliance with the Association Covenants & Architectural Standards. The inspection process is a complete review of each lot and the exterior of the structures therein, using the Association Covenants & Restrictions, as well as the Association’s Architectural Design & Maintenance Standards as the benchmark. For 2019, the Annual Property Inspections began in mid-March, and will continue through the summer and fall .

If you have made a modification to your home or an improvement to your lot, and you have not filed an Exterior Alteration Application with the Association Office, please do so as soon as possible to avoid receiving a violation for unapproved exterior modifications. The application is available on the Association website. www.ashbumfarmassociation.org. The exterior of the home, as well as any other structure or improvement to the property, such as a shed or fence, playhouse, or swing-set, will be visually inspected for maintenance issues (i.e., damage to the finish/paint, rotted wood, etc.) Simply put ... your lot should be tidy, and the exterior of any structures and/or exterior modifications therein should be maintained in good condition and clean. Property owners should perform a visual inspection of their home routinely and take steps to correct any blemishes or issues they see .

The Association is continuing its enforcement policy, providing an initial 90-day correction/compliance period to allow ample time for homeowners to obtain bids and complete the work. If you receive a violation letter from the Association, it is simply a first request to remedy the issue noted and will not result in fines if remedied prior to the 90-day compliance date provided.

The Association’s enforcement policy requires that any request for additional time be received by the Association’s Covenants Department within the initial 90-day compliance period, but does not allow the Association staff to grant open-ended extensions. Association staff can extend a first compliance date, if provided a signed & dated service contract to bring the home/property into full compliance with an approximate date of completion of not more than 45 additional days from the initial compliance date provided in the “First Notice” letter .

All other requests for additional time to comply with the Association’s Covenants & Architectural Standards must be appealed to the Board of Trustees at a regular business meeting. Board Appeal Forms are available on the HOA website, as well as in the Association Office and must be received at least 16 days before a Board Meeting to be heard at that meeting .

The Association’s property inspectors will post temporary signs at neighborhood/street entrances the week prior to the inspections beginning on those streets, stating “INSPECTIONS NEXT WEEK”. This serves as a means of public notice and satisfies the three-day notification requirement. The following week, those signs will be replaced with ones stating, “INSPECTIONS THIS WEEK”, and the inspections will be completed in those areas.
