NOTICE TO BIDDERS

Notice is hereby given that sealed bids will be received by Neshoba County General Hospital until 2:00 p.m., on July 18, 2017 for the Project shown below. The location of receipt of bids will be the Conference Room at Neshoba County General Hospital, 1001 Holland Avenue Philadelphia, Mississippi 39350. Plans and Specifications Entitled: 2017 Roofing Replacement Neshoba County General Hospital Philadelphia, Mississippi Bid Packages Include:

- Roofing Bid Package The Bid Package contracts will be issued between the Owner and the successful Contractor. This package shall include all bonds and taxes as required by the contract documents and the State of Mississippi. Contract documents may be obtained thru the Architect as set out below:

a. Qualified Contractors, Subcontractors, and Material Suppliers may obtain one set of plans and specifications upon deposit of $50.00 per set. Contractors who do not submit a bid shall forfeit their deposit.

b. Partial Sets will not be issued. Proposals shall be submitted in duplicate only upon the blank proposal forms provided with the bid documents and must be accompanied by Proposal Security in the form of Certified Check or acceptable Bid Bond in the amount equal to at least five percent (5%) of the Base Bid: such security to be forfeited as liquidated damages, not penalty, by any bidder who fails to carry out the terms of the proposal, execute contract and post Performance and Payment Bond in the form and amount of 100% within the time specified. The Bid Bond, if used, shall be payable to the Owner. Bids on the Project must be received on or before the period scheduled for the Project and no bid withdrawn after the scheduled closing time for the Project for a period of sixty (60) days. All bids submitted in excess of $50,000.00 by a Prime or Subcontractor to do any work must comply with the Mississippi Contractors Act of 1985, by securing a Certificate of Responsibility from the State Board of Contractors. The Owner reserves the right to reject any and all bids and to waive irregularities. SECTION 001000 INSTRUCTIONS TO BIDDERS

1.

GENERAL

1.1

GENERAL REQUIREMENTS

A. Interpretations: Should a bidder find discrepancies in or omissions from the drawings or project manual or be in doubt as to their written meaning, he should immediately notify the Architect who then will send a written instruction or interpretation to all known holders of the documents. Neither the Owner nor the Architect will be responsible for any oral instructions.

B. Addenda: Any addenda to the drawings or project manual issued before

or during the time of bidding will be included in the proposal and become a part of the contract.

C. Substitutions: Refer to Section 01630, Substitutions and Product Options.

1.2

BIDDING

A. Method of Bidding: Lump sum, single bids will be received on: 1. Re-Roofing 2. Demolition and Removal of existing built-up roofing. Bids shall include specific construction and all work shown on drawings or specified herein.

B. Contracts: The bidder is specifically advised that any persons, firm or other

party to whom it is proposed to award a subcontract under this contract must be acceptable to the Owner. It is further required that the name of the subcontractors and their Certificate of Responsibility Number be noted on the proposal form in the blank spaces provided. Failure to list these will be sufficient grounds to reject the proposal.

1.3

CERTIFICATE OF RESPONSIBILITY

A. Certificate of Responsibility Number: Each contractor submitting a bid shall comply with Section 31-3-21 of the Mississippi Code of 1972, amended January 1, 1986, to read as follows:

All bids submitted for public or private projects where said bid is in excess of Fifty Thousand Dollars ($50,000.00) with respect to public projects and in excess of One Hundred Thousand Dollars ($100,000.00) with respect to private projects shall contain on the outside or exterior of the envelope or container of such bid the contractor's current certificate number, and no bid shall be opened or considered unless such contractor's current certificate number appears on the outside or exterior of said envelope or container, or unless there appears a statement on the outside or exterior of such

B. Evidence: No bid will be opened, considered, or accepted unless the above

information is given as specified. Sufficient evidence that said Certificate of Responsibility has been issued and is in effect at the time of receiving bids must be submitted when requested by the Owner or the Architect.

1.4

BID SECURITY

Each bid must be accompanied by the bidder's certified check or a bid bond, duly executed by the bidder as principal and having as Surety thereon, a surety company approved by the Owner and signed by an agent resident in Mississippi, in the amount of five percent (5%) of the bid. All bid bonds must be accompanied by an appropriate Power of Attorney designating the Mississippi resident agent.

OPENING OF BID

Refer to the Advertisement for Bids. 1.6

PREPARATION OF BID

A. Conditions of Work: Each bidder must fully inform himself of the conditions relating to construction of the project and employment of labor thereon. Failure to do so will not relieve a successful bidder of his obligation to furnish all material and labor necessary to carry out the provisions of his contract. Insofar as possible, the contractor must employ methods or means to cause no interruption of or interference with work of any other contractor.

B. Examination of Site: All bidders, including subcontractors, will visit the site

of the building, compare the drawings and project manual with any work in place and inform themselves of all conditions. Failure to visit the site will in no way relieve the successful bidder from furnishing any materials or performing any work required to complete work in accordance with drawings and project manual without additional cost to the Owner.

C. Laws and Regulations: The bidder's attention is directed to the fact that all

applicable state laws, municipal ordinances and the rules and regulations of all authorities having jurisdiction over construction of the project apply to the contract.

D. Obligation of Bidder: At the time of opening of bids, each bidder will be

presumed to have inspected the site and to have read and be thoroughly familiar with the drawings and the project manual, including all addenda.

1.7

PROPOSALS

A. Form: Make all proposals on forms provided and fill all applicable blank

spaces without interlineation, alteration or erasure and must not contain recapitulation of the work to be done. No oral, telegraphic or telephonic proposals will be considered. Any addenda issued during the bidding will be noted on the proposal forms.

B. Withdrawal: Any bid may be withdrawn prior to the above scheduled time

for opening of bids or authorized postponement thereof. Any bid received after the time and date specified will not be considered. Bids may not be withdrawn until 60 days after bid opening.

C. Submittal: Submit bids in duplicate (two) in an opaque sealed envelope

marked as follows:

Telegraphic Modifications: Any bidder may modify his bid by telegraphic communication at any time, provided such communication is received by the Owner prior to the scheduled closing time. Written confirmation must be received within two (2) days from the closing time or no consideration will be given the telegraphic modifications.

CONTRACT

Award of Contract: Contract will be awarded on the basis of the low base bid which

produces a total within available funds. The Owner reserves the right to waive irregularities and to reject any or all bids.

Disqualification of Bidder: The Owner reserves the right to award to other than the low bidder when, in the Owner's judgment, it is in his best interest to do so.

Three such reasons are: Bidder being in arrears on existing contracts. Bidder being in litigation with the Owner or the using agency. Bidder having defaulted on a previous contract.

The above is not an inclusive list.

Security for Faithful Performance: Simultaneously with his delivery of the executed contract, the Contractor will furnish a surety bond or bonds as security for the faithful performance of this contract and for the payment of all persons performing labor on the project under this contract and furnish materials in connection with this contract. The Surety on such bond or bonds will be a duly authorized surety company satisfactory to the Owner.

Time of Completion: Bidder must agree to commence work on or before a date specified in a written "Proceed Order" and to fully complete the project within 90 calendar days as indicated on the Form of Proposal and the Agreement between the Owner and Contractor.

Liquidated Damages for Failure to Enter into Contract:

The successful bidder, upon his failure or refusal to execute and deliver the contract and bond required within ten (10) days after he has received notice of the acceptance of his bid, will forfeit to the Owner as liquidated damages the security deposited with his bond.

1.9

BID DOCUMENTS DEPOSIT AND RETURN

The deposit amount is indicated in the Advertisement for Bids. One-half of the deposit will be refunded to all document holders upon return of the documents to the Architect in good condition no later than ten (10) days after the bid date. No partial sets of documents will be issued. Plan rooms will be issued one set of documents without charge if requested.

BID PACKAGE SUMMARY 1

PART 1- GENERAL 1.01 SUMMARY A. WORK EXECUTED IN THE CONTRACT

1. The Scope of Work included herein will be required of the selected Bidder. This information is complementary with the requirements of the other bid documents. The Scope of Work identified herein will become part of the Agreement between the Contractor and the Owner. The Scope of Work listed below shall include all labor, materials, equipment, supervision, insurance, payment and performance bonds, applicable taxes and all other work in accordance with the contract documents.

2. Contractor will be responsible their own Construction Facilities and Temporary Controls except as specifically identified in the plans and specifications.

3. The Contractor shall cooperate fully with Owner’s forces or separate contractors so work on those contracts may be carried out smoothly, without interfering with or delaying work under this Contract.

4. Work outside of the Construction Area shall be closely coordinated with Hospital Operations to prevent impacts to the existing facility operations.

5. All Contractor Project Supervision shall be approved by the Owner and the Architect. 6. The Contractor shall review specifications and include in its bid for “Owner Provided” the work

outlined to be performed by Contractor. 7. The Contractor will be responsible for repairs or damage to Owner provided work. 8. The cost of electricity will be paid for by NCGH. 9. Building permits are not required.

B. CONTRACTOR PROVIDED 1. Porta-Johns at Building location. Contractors will be responsible for temporary porta-

johns or holding tanks at job site trailers. 2. Power, Water and Sewer consumption costs will be provided by Owner at no cost to the

Project. Contractor will be responsible for all temporary facility and controls as required for their work.

3. Project Identification for operational purposes. 4. The Contractor and its subcontractors shall coordinate and cooperate fully as required by

the Owner.

C. ROOFING BID PACKAGE The Roofing Bid Package includes replacing existing roof as outlined on the plans and the specifications outlined herein to provide a complete system. This contractor shall provide all materials and installation.

The Project shall be constructed in one phase. The Project shall be completed within 90

calendar days from the Notice to Proceed. SECTION 005000

AGREEMENT FORM

PART 1 - GENERAL

1.1 DESCRIPTION:

A. Scope: The Agreement Form between the Owner and the Contractor shall be AIA Document A101, 2007, where the basis of payment is a stipulated sum.

B. Retainage: Until Final Completion of the Project, the Owner will retain five

percent (5%) of the amount due the Contractor on account of Progress Payments, in accordance with the laws of the State of Mississippi.

C. Copy: Contractors are presumed to be familiar with this document, a copy of

which may be obtained from the Professional or examined in his office. END OF SECTION

SECTION 006000

PERFORMANCE BOND

PART 1 - GENERAL

1.1 The Contractor will be required to provide the Owner with a performance bond. The performance bond shall remain in full force and effect, subject to the following conditions.

Whenever the Owner has performed its obligation but the Principal has defaulted under the terms of the contract, or any portion thereof, and the Owner has declared the Principal to be in default, the Surety shall promptly:

A. Remedy the default or;

B. Complete the contract in accordance with its terms and conditions or;

C. Procure the completion of the contract in accordance with its terms and conditions.

Even if there should be a succession of defaults, the Surety is responsible for completion of the contract. The Surety shall provide sufficient funds to pay the cost of completion of the contract in its entirety including other costs and damages for which the Surety may be liable there under, less the balance of the contract price. The term "balance of the contract price," as used in this paragraph, shall mean the total amount payable by Owner to Principal under the contract and any change orders thereto, less the amount paid by Owner to Principal.

1.2 LABOR AND MATERIAL PAYMENT BOND

The condition of this labor and Material Payment Bond is such that if Principal shall promptly make payments to all persons supplying labor or material used in the prosecution of the work under said contract, then this obligation shall be null and void; otherwise, it shall remain in full force and effect; however, the Owner shall not be liable for the payment of any costs or expense or any suit.

1.3 GENERAL CONDITIONS

The following conditions apply to all of the above mentioned bonds:

A. The Performance Bond is for an amount equal to the full amount of said contract.

B. The Labor and Material Payment Bond is for an amount equal to the full amount of said contract.

C. If any changes are made in the work, or any extensions of time are granted, or any

increases in the total dollar amount of the contract are made, such changes, extensions, increases, or other forbearance on the part of either the Owner or the Principal will not, in any way, release the Principal and Surety, or either of them, from their liability hereunder, or any portion thereof, notice to the Surety of any such change, extension, increase, or forbearance being expressly waived.

D. These bonds are governed by and shall be construed in accordance with

Mississippi Law. Any inconsistency with these bonds and any provisions of Mississippi Law shall be remedied by deleting the inconsistent portion of these bonds and leaving the remaining consistent portion in full force and effect.

A. Scope: The General Conditions of the Contract for Construction, AIA Document A201, 2007, Articles 1 through 14 inclusive, is a part of this contract and is incorporated herein as fully as if here set forth.

SECTION 008000 INSURANCE REQUIREMENTS

1.

GENERAL

A. The Contractors shall provide complete liability insurance coverage as stated below. "Builders Risk" insurance shall be provided by the Contractor.

B. The coverage shall be provided by carriers licensed to do business in the State

of Mississippi. 1.2 The following insurance requirements supersede the general conditions.

Liability insurance shall include all major divisions of coverage and be on a comprehensive basis including:

A. Premises - operations (including X-C-U) B. Independent contractor's protective C. Product and completed operations D. Contractual - including specified provision for all contractor's obligations E. Owned, non-owned and hire motor vehicle F. Broad form coverage for property damage

1.3 The insurance required by subparagraph 2. shall be written for not less than the

following, or greater if required by law.

1.4

OWNER'S LIABILITY INSURANCE

A. The Contractor shall pay for and maintain such insurance as will protect the Owner from his contingent liability to others for damages because of bodily injury, including death which may arise from operations under this contract and other liability for damages which the Contractor is required to insure under any provision of this contract. Certificate of this insurance shall be filed with Owner and will be the same limits set forth above.

1.5

PROPERTY DAMAGE

A. The contractor shall purchase and maintain property insurance upon the entire work at the site.

But limited to the work covered under this contract and the contract amount.

Such insurance shall be in a company or companies against which the Owner has no reasonable objection. This insurance shall include the interests of the Owner, the contractor, subcontractors, sub-subcontractors and material suppliers in the work and shall insure against the perils of fire and extended coverage and shall include "all risk" insurance for physical loss or damage including, without duplication of coverage, theft, vandalism and malicious mischief. If not covered under all risk insurance or otherwise provided in the Contract Documents, the contractor shall effect and maintain similar property insurance on portions of the work stored off the site or in transit when such portions of the work are to be included in an Application for Payment under sub-paragraph 9.3.2.

B. The form of policy for this coverage shall be completed value. C. If by the terms of this insurance any mandatory deductibles are required, or if

the contractor should elect, with the concurrence of the Owner, to increase the mandatory deductible amounts of purchase this insurance with voluntary deductible amounts, the contractor shall be responsible for payment of the amount of the deductible in the event of a paid claim.

D. The contractor shall file two (2) certified copies of all policies with the Owner

before exposure to loss can occur. If the Owner is damaged by the failure of the contractor to maintain such insurance and to so notify the Owner, then the Contractor shall bear all reasonable costs properly attributable thereto.

SECTION 009000 ARCHITECT'S SPECIAL CONDITIONS

PART 1 - GENERAL

1.1

OWNERSHIP OF DRAWINGS AND SPECIFICATIONS

The drawings and specifications and copies thereof furnished by the Architect are his property. All such copies shall be returned to the office of the Architect and shall not be used on any other work. The drawings and specifications are instruments of the Architectural Service rendered.

1.2

VERIFICATION OF DIMENSIONS

Before ordering any materials or doing any work, each contractor shall verify the dimensions and shall be responsible for the accuracy of such dimensions as they affect the work. No extra compensation will be allowed on account of differences between the dimensions shown on the drawings and actual dimensions.

1.3

PLANS AND SPECIFICATIONS

The specifications and the drawings are intended to be in agreement with each other, and to be mutually explanatory. They are also intended to be complementary and any work or material called for by either shall be performed and or furnished as if called for by both.

1.4

FIRES AND TRASH DISPOSAL

No open fires shall be permitted. Trash and construction debris shall be removed from the site and properly disposed by the contractor in a licensed landfill.

1.5

COLOR SCHEDULES

Color schedules will be prepared by the Architect after the contractor has furnished ALL

necessary samples and color chips from the actual suppliers and subcontractors. Delivery of this material to the Architect shall occur within 30 days after the Notice to Proceed.

1.6

CONSTRUCTION DOCUMENTS

The Architect shall furnish to the General Contractor without charge, 10 sets of plans and specifications.

1.7

WORKMANSHIP

All work as described or required shall be executed in a neat, skillful manner, in accordance with the best recognized trade practice. Only competent workmen (including the superintendent) who work and perform their duties satisfactorily shall be employed on the project, and when requested by the Architect, the Contractor shall discharge and shall not re-employ on the project, any person who commits trespass or who is, in the opinion of the

USE OF SITE AND FACILITIES

A. Contractor shall not allow tradesmen, technicians and laborers to enter other portions of the existing facilities except as predetermined and approved by the Owner and Architect.

B. Contractor shall provide portable toilets at all

times.

C. Security separation shall be provided to separate the new construction areas from the remaining portion of the site.

D. Existing utilities shall not be interrupted unless pre-approved by the Owner and the

Architect.

E. Parking for construction vehicles shall be in the designated area as agreed to with the Owner.

1.9

UTILITIES

A. The Owner will furnish utilities for construction (electricity and water). Contractor must use "as-is" or pay for any necessary modifications.

B. Start of Work: Work shall be started immediately upon issuance of a proceed order. Prior to this, all contracts and beginning documents will have been executed and insurance in force.

C. Time of Completion: The completion of this work is to be on or before the time

indicated in the Owner and Contractor Agreement.

D. Contractor's Duties:

1. Except as specifically noted, provide and pay for:

a. Labor, materials and equipment. b. Tools, construction equipment and machinery. c. Water, heat and utilities required for construction. d. Other facilities and services necessary for proper execution and

completion of work.

2. Pay legally required sales, consumer, use, payroll privilege and other taxes.

3. Remove and properly dispose all ACM asbestos containing materials as

6. Promptly submit written notice to Architect of observed variance of

contract documents from legal requirements. It is not the Contractor's responsibility to make certain that drawings and specifications comply with codes and regulations. Appropriate modifications to contract documents will adjust necessary changes. Assume responsibility for work known to be contrary to such requirements, without notice.

7. Enforce strict discipline and good order among employees. Do not

employ on work unfit persons or persons not skilled in assigned task.

A. Scope: To set forth procedures, conditions and responsibility for coordination of the total project.

supplier or distributor which illustrate some portion of the work; showing fabrication, layout, setting or erection details.

1. Prepared by a qualified detailer. 2. Identify details by reference to sheet and detail numbers shown on

contract drawings. 3. Minimum sheet size - 8-1/2" x 11". 4. Reproductions for submittals: One (1) set reproducible drawings and

one (1) set opaque prints. Electronic submittals are also acceptable in Adobe PDF format in lieu of reproducible drawings.

C. Product Data:

1. Manufacturer's standard schematic drawings: Modify drawings to delete information that is not applicable to the project. Supplement standard information to provide additional information applicable to the project.

2. Manufacturer's catalog sheets, brochures, diagrams, schedules,

performance charts, illustrations and other standard descriptive data: Clearly mark each copy to identify pertinent materials, products or models. Show dimensions and clearances required. Show performance characteristics and capacities, wiring diagrams and controls.

D. Samples: Physical examples to illustrate materials, equipment or

workmanship and to establish standard by which completed work is judged.

1. Office Samples: Of sufficient size and quantity to clearly illustrate functional characteristics of products or material with integrally related parts and attachment devices and full range of color samples. After review, samples remain the property of the Architect until completion of the construction project.

2. Field Samples and Mock-ups: Erect on project site at location

date, project title and number; Contractor's name and address; the number of each shop drawings, product data and samples submitted; notification of deviations from contract documents; and other pertinent data.

5. Submittals shall include: a. Date and revision dates. b. Project title and number. c. The names of: Architect, Contractor, supplier, manufacturer,

SECTION 015000 TEMPORARY FACILITIES AND CONTROLS

PART 1 - GENERAL 1.1

DESCRIPTION

A. Scope: Work required under this section consists of all temporary construction facilities, services and related items to complete the work indicated on the drawings and described in the project manual.

B. Standards:

1. Conform all temporary construction to or exceed the requirements of Chapter 33, Safeguards During Construction, of the International Building Code, 2006 Edition.

2. Refer to Section 00700 - General Conditions, Article10.1.1.

C. Materials: All materials required by the work of this section shall be as specified in the respective sections.

1.2

FACILITIES AND CONTROLS

A. Access: The Contractor shall provide an adequate access and/or roads to the site of the structure if required for the prosecution of work. He should also provide and maintain at least one temporary or permanent access to each working elevation to be permanently occupied. (See paragraph 8.A.1: Section 00900)

B. Hoisting Facilities: The Contractor shall be responsible for providing suitable

capacity and hoisting facilities for all people and materials. The use of hoisting facilities shall be by mutual agreement of the Contractor and the individual subcontractors.

C. Sanitation Facilities: The Contractor is responsible for furnishing adequate

temporary toilet facilities on the job site.

D. Drinking Water: The Contractor shall provide drinking water facilities for all workmen on the job including icing, when required, paper cups, etc., all maintained in a sanitary condition.

E. Fire Protection: The Contractor shall provide temporary fire protection requirements.

Subcontractors will be responsible for their own specialty requirements. (See Section 009000)

F. Storage: The Contractor shall coordinate the allocation of storage areas to the

various subcontractors.

G. Utilities: The Contractor shall make arrangements for all water, electricity (lighting

and power) and other utilities necessary for construction purposes. Water and power costs to be provided by the Owner.

SECTION 016300 SUBSTITUTIONS AND PRODUCT OPTIONS

PART 1 - GENERAL

1.1 DESCRIPTIONS

A. Scope: To set forth the procedure and conditions for substitutions and to give the product options available to the Contractor.

1.2 PRODUCT LIST

A. Within 30 days after date of contract, submit to the Architect five (5) copies of complete list of all products which are proposed for installation.

B. Tabulate list by each specification section.

C. For products specified under referenced standards, include with listing of each

product. 1. Name and address of manufacturer. 2. Trade name. 3. Model or catalog designation. 4. Manufacturer's data. 5. Performance and test data. 6. Reference standards.

1.3 CONTRACTOR'S OPTIONS

A. For products specified only by referenced standards, select any product meeting standards by any manufacturer.

B. For products specified by naming several (minimum of three) products or

manufacturers, select any product and manufacturer named.

C. For product specified by naming one or more products, but indicating the option of selecting equivalent products by stating "or equal" after specified product, Contractor must submit request, as required for substitution, for any product not specifically named.

D. For products specified by naming only one product and manufacturer, an

equivalent product will always be accepted if it is equal in all respects. The Contractor must submit a request for substitution as set forth in this section.

E. For products specified by naming only one product and manufacturer and

stating no substitutions will be accepted, there is no option and no substitution will be allowed.

4. Itemized comparison of proposed substitution with product or method specified.

5. Data relating to changes in construction schedule. 6. Accurate cost data on proposed substitution in comparison with product

C. In making request for substitution, Contractor represents:

1. He has personally investigated proposed product or method, and determined that it is equal or superior in all respects to that specified.

2. He will provide the same guarantee for substitution as for product or method specified.

3. He will coordinate installation of accepted substitution into work, making such changes required of work to be complete in all respects.

4. He waives all claims for additional costs related to substitution which consequently becomes apparent.

5. Cost data is complete and includes all related costs under his contract.

D. Substitutions will not be considered if:

1. They are indicated or implied on shop drawings or product data submittals without formal request submitted in accordance with this section.

2. Acceptance will require substantial revision of contract documents. 3. In the Architect's judgment, the product or material is not equal.

SECTION 017000 PROJECT CLOSEOUT

GENERAL

1.1

DESCRIPTION

Scope: The work required under this section consists of the final inspections and the submitting of all closeout documents and related items to complete the work indicated on the drawings and described in the project manual.

1.2

FINAL INSPECTIONS

A. Architect's Inspection: The Contractor shall make written request for a final inspection to the Architect; notice to be given ten (10) days prior to the inspection. A list of any deficiencies, compiled by the Architect, will be corrected by the Contractor. If, in his judgment, the project is not ready for a final inspection, the Architect may schedule another inspection.

B. Owner's Inspection: After the Architect has ascertained the project to be complete;

an Owner's inspection will be scheduled within ten (10) days thereafter. The Contractor will have ten (10) days after the Owner's acceptance to make any corrections of punch list items and to submit closeout documents.

C. Correction of Work before Final Payment: Contractor shall promptly remove from

the Owner's premises all materials condemned for failure to conform to the contract, whether incorporated in work or not, and the Contractor shall, at his own expense, replace such condemned materials with those conforming to the requirements of the contract. Failure to remedy such defects after ten (10) days written notice will allow the Owner to make good such defects and such costs shall be deducted from the balance due the Contractor or charged to the Contractor in the event no payment is due.

1.3 CLOSEOUT DOCUMENTS: Unless otherwise notified, the Contractor shall submit to the

Owner through the Architect, three (3) copies of the following:

A. Request for Final Payment.

B. Consent of Surety Company to Final Payment: AIA Document G707dated April 1970, completed in full by the bonding company.

C. Release of Liens and Certification that all Bills Have Been Paid: A sworn statement

and affidavit from the Contractor to the Owner stating that all bills for this job have been paid and that the Owner is released from any and all claims and/or damages will be required before final payment is made.

D. Guarantee of Work: Sworn statement that all is guaranteed against defects in

materials and workmanship for one (1) year from date of Owner's acceptance, except where specified for longer periods.

2. Within the guaranty period, if repairs or changes are requested in

connection with guaranteed work which, in the opinion of the Owner, are rendered necessary as a result of the use of materials, equipment or workmanship which are inferior, defective or not in accordance with the terms of the contract, the Contractor shall promptly, upon receipt of notice from and without expense to the Owner, place in satisfactory condition in every particular, all such guaranteed work, correct all defects within and make good all damages to the building, site, equipment or contents thereof which, in the opinion of the Owner, is the result of the use of materials, equipment or workmanship which are inferior, defective or not in accordance with the terms of the contract; and make good any work or materials or the equipment and contents of said buildings or site disturbed in fulfilling any such guaranty.

3. If, after notice, the Contractor fails to proceed promptly to comply with the

terms of the guaranty, the Owner may have the defects corrected and the Contractor and his Sureties shall be liable for all expense incurred.

4. All special guarantees applicable to definite parts of the work stipulated in

the project manual or other papers forming part of the contract shall be subject to the terms of this paragraph during the first year of the life of such special guaranty.

E. Project Record Documents: Furnish all other record documents as set forth in

Section 01720, Project Record Documents.

F. Additional Documents Specified Within the Project Manual: Provide all additional certificates, warranties, guarantees, bonds or documents as called for in the individual sections of the project manual. The Contractor is responsible for examining the project manual for these requirements.

PART 1 - GENERAL

1.1 DESCRIPTION

Scope: Maintain premises and public properties from accumulations of waste, debris and rubbish caused by operations. At completion of work, remove waste materials, rubbish, tools, equipment, machinery and surplus materials and clean all sight-exposed surfaces; leave project clean and ready for occupancy.

1.2 Dust control is the responsibility of the Contractor. All exterior windows in existing

exterior walls shall be dust sealed if they face the reroofing activities.

PART 2 - PRODUCTS

2.1 MATERIALS

Use only cleaning materials recommended by manufacturer of surface to be cleaned. Use cleaning materials only on surfaces recommended by the cleaning material manufacturer.

2.2 Cleaning materials shall be approved by the Owner.

PART 3 - EXECUTION

3.1 DURING CONSTRUCTION

Execute cleaning to insure that building, grounds and public properties are maintained free from accumulations of waste materials and rubbish. Wet down dry materials and rubbish to lay dust and prevent blowing dust. At reasonable intervals during progress of work, clean site and public properties and dispose of waste materials, debris and rubbish. Remove waste materials, debris and rubbish from site and legally dispose of at public or private dumping areas off Owner's property. Handle materials in a controlled manner with as few handlings as possible; do not drop or throw materials from heights. Schedule cleaning operations so that dust or other contaminants resulting from cleaning process will not fall on wet or newly painted surfaces.

3.2 FINAL CLEANING

Employ experienced workmen or professional cleaners for final cleaning. In preparation for substantial completion or occupancy, conduct final inspection of sight-exposed exterior surfaces. Remove grease, dust, dirt, stains, labels, fingerprints and other foreign materials from sight-exposed exterior finished surfaces.

, 2017, Paul Anderson Environmental began conducting an asbestos roof material survey for the Building contracted. It’s located at 1001 Holland Avenue in Philadelphia, Mississippi. The survey was performed to determine the presence and location of suspect asbestos containing material (ACM) in several different areas of the roof. The work was authorized by Mr. Bobbie Singleton with N.C.G.H. to provide asbestos inspection services for roofing renovation of the property. The survey was performed by a Certified Asbestos Inspector Paul Anderson MDEQ # ABI- 1686, Expiration 7/15/2017.

1.2 As outlined in the initial scope of services, I conducted the following:

Work Performed

Step 1: Preliminary walk-through and inspection of all accessible and affected areas around the building’s roof for the purpose of locating and documenting suspect ACM. Step 2: Development and implementation of a sampling scheme for all suspect ACM. Step 3: Performance of quality-assured analysis of the bulk samples obtained during the inspection, using polarized light microscopy (PLM). The analytical results of all samples can also be found at the end of this report. Step 4: Preparation and submission of this report.

2.0 DEFINITIONS ABATEMENT- The removal, repair, encapsulation, or enclosure of ACM. ASBESTOS- The asbestiform varieties of chrysotile, crocidolite, amosite, anthophylite, tremolite and actinolite. ASBESTOS CONTAINING MATERIAL (ACM)- any material which contains more than one percent asbestos by volume. COMPOSITE SAMPLE- A bulk sample of suspect homogeneous building material that consist of a mixture of equal quantities of the material collected from various locations within a homogenous or functional sampling area. ENCAPSULATION- The application of a coating to friable or nonfriable asbestos to prevent release. ENCLOSURE- The construction of an air-tight barrier around friable and nonfriable asbestos to prevent fiber release. FRIABLE- The condition of any ACM which when dry may be crumbled or reduced to powder by hand pressure. FUNCTIONAL SPACE- A room or specific area. HOMOGENEOUS AREA- An area of surfacing material, thermal system insulation, or miscellaneous material that is uniform in texture and color and appears identical in every other respect including relative date of insulation. HOMOGENEOUS MATERIAL- A material which may or may not extend through many areas, is uniform in color and texture and appears identical in all other respects, including relative date of installation. HVAC- System and/or component equipment associated with the heating, ventilation and air-conditioning of a building MISCELLANEOUS MATERIAL- A classification for suspect ACM such as resilient floor coverings, acoustical ceiling tile, transite products, etc. OPERATION AND MAINTENANCE PLAN (O&M)- A set of procedures undertaken to clean up previously released asbestos fibers, prevent future release of fibers by minimizing disturbance of damage to ACM, monitoring the condition of the ACM and retain all documentation relating to asbestos within the building.

POLARIZED LIGHT MICROSCOPY (PLM)- Method used to estimate the percent of asbestos by volume in a bulk sample. REMOVAL- Removal of the ACM and replacement with a non asbestos-containing material to provide the same function and fire rating, unless the removal is for the purpose of demolition.

RESPONSE ACTION- A method including removal, encapsulation, enclosure, repair, operation and maintenance that protects human health and the environment from friable ACM. SURFACING MATERIAL- A classification of suspect ACM which is applied to walls, ceilings, or structural members by a sprayed-on, troweled-on method such as fireproofing or decorative applications. SUSPECT MATERIAL- A type of building component that is known, or has been known to contain asbestos minerals. THERMAL SYSTEM INSULATION (TSI)- A classification of suspect ACM which covers piping, boilers, HVAC components, etc., to act as an insulator, not as a coating or sealant.

3.0 METHODS 3.1 Field Survey The survey procedure consisted of a complete visual and walk-through of the damaged areas and inspection of accessible roofing surfaces, and subsequent formulation of a sampling scheme. All roofing surfaces were examined for the presence of ACM. The survey was conducted by MDEQ certified asbestos inspector Paul Anderson (MDEQ Certification #ABI- 1686). All suspect materials were touched to determine their friability. If these materials could be broken and/or crumbled by hand pressure, it was deemed friable. Random and judgmental samples were collected from suspect materials throughout the structures. Survey and sampling procedures and protocols were conducted in accordance with U.S. Environmental Protection Agency (USEPA) specifications and recommendations, 40 CFR 763.107 - 763.109, 40 CFR 763.85 - 763.88, 1987, and EPA manuals 45/2-78-014 (part 1 and II) and 560/5-85-024. The Asbestos Hazard Emergency Response Act (AHERA), 40 CFR 763, guidelines are considered by most regulatory agencies, USEPA and the Occupational Safety and Health Administration (OSHA) to be state of the art for conducting asbestos inspections and assessments. 3.2 Laboratory Analysis Bulk samples of suspect homogeneous ACMs were collected during the inspection and subsequently submitted to CEI Labs located in Cary, North Carolina to determine the presence of asbestos minerals. The EPA recommended method of polarized light microscopy (PLM) and dispersion staining was used to determine the presence of type and contents.

5.0 SUMMARY/CONCLUSION: 5.1 FINDINGS: Based on the asbestos inspection and subsequent lab results, Asbestos Containing Materials (ACM) were detected. - All original homogeneous roof tar flashing located at, VENT HOODS, SKYLINE WINDOWS, &

RIDGE CAPS (BLACK and GRAY), should be considered as Asbestos containing materials (ACM).

- All perimeter roof tar flashing on lower roof does contain ACM.

*Note* It should be recognized that the roof is in good condition in the affected areas of renovation.

5.2 RECOMMENDATIONS: 1. Prior to any renovation and/or demolition that may disturb the positive Asbestos Containing Materials, asbestos abatement plans and guideline specifications should be developed. The asbestos abatement actions (removal) should be accomplished by an accredited and licensed asbestos abatement contractor and in a manner prescribed by the Environmental Protection Agency (EPA) Regulation 40 CFR parts 61.145 and 61.150, and Occupational Safety and Health Administration (OSHA), standard 29 CFR 1926.1101. All work shall be conducted following NESHAP & AHERA removal guidelines. A 10 day removal/demolition notification must be filed with the Mississippi Department of Environmental Quality (MDEQ). This can be filed by anyone familiar with the MDEQ guidelines for filing. 2. All asbestos abatement personnel should have received proper training as required for certification of asbestos workers or supervisors by the State of Mississippi. 3. Contractor shall obtain necessary permits and state license in conjunction with asbestos removal, hauling, and disposition, and furnish timely notification of such actions required by federal, state, regional, and local authorities. Notify the Mississippi Bureau of Pollution Control, Air Division and the Environmental Engineer in writing 10 DAYS prior to the

A. This section covers all operations in connections with demolition. Perform all excavating, filling, grading, and all other work necessary for the completion of the work specified herein and as shown on the drawings.

The Contractor shall familiarize himself with the existing site conditions in the best manner possible to verify the amount of demolition that will be required.

1.06 QUALITY ASSURANCE A. Installer Qualifications: Engage an experienced installer to perform Work of this Section who

has specialized in installing roofing similar to that required for this Project; who is approved, authorized, or licensed by the roofing system manufacturer to install manufacturer's product; and who is eligible to receive the standard roofing manufacturer's warranty.

B. Fire-Test-Response Characteristics: Provide roofing materials with the fire-test-response characteristics indicated as determined by testing identical products per test method indicated below by UL, FM, or another testing and inspecting agency acceptable to authorities having jurisdiction. Identify materials with appropriate markings of applicable testing and inspecting agency. 1. Exterior Fire-Test Exposure: Class C; complying with ASTM E 108, for application and

Store roofing materials in a dry, well-ventilated, weathertight location to ensure no significant moisture pickup and maintain at a temperature exceeding roofing system manufacturer's written instructions. Store rolls of felt and other sheet materials on end on pallets or other raised surfaces. Do not double-stack rolls. 1. Handle and store roofing materials and place equipment in a manner to avoid significant

or permanent damage to deck or structural supporting members. B. Do not leave unused felts and other sheet materials on the roof overnight or when roofing work

is not in progress unless protected from weather and moisture and unless maintained at a temperature exceeding 50 deg F (10 deg C).

C. Deliver and store liquid materials in their original undamaged containers in a clean, dry, protected location and within the temperature range required by roofing system manufacturer.

D. Protect roofing insulation materials from physical damage and from deterioration by sunlight, moisture, soiling, and other sources. Store in a dry location. Comply with insulation manufacturer's written instructions for handling, storing, and protecting during installation.

1.08 PROJECT CONDITIONS A.

PART 3 EXECUTION 3.01 EXAMINATION

A. Examine substrates, areas, and conditions under which roofing will be applied, with Installer present, for compliance with requirements.

B. Verify that roof openings and penetrations are in place and set and braced and that roof drains are properly clamped into position.

C. Verify that wood blocking, curbs, and nailers are securely anchored to roof deck at roof penetrations and terminations and match the thicknesses of insulation required. 1. Verify that wood nailer strips are located perpendicular to roof slope and are spaced

according to requirements of roofing system manufacturer. D. Do not proceed with installation until after the minimum concrete curing period recommended

by roofing system manufacturer. 1. Test concrete substrate for excessive moisture by pouring 1 pint (0.5 L) of roofing asphalt

at equiviscous temperature on deck at start of each day's work and at start of each roof area or plane. Do not proceed with roofing work if test sample foams or can be easily and cleanly stripped after cooling.

3.05 GENERAL INSTALLATION REQUIREMENTS A. Install modified bituminous membrane roofing system according to roofing system

manufacturer's written instructions and applicable recommendations of NRCA/ARMA's "Quality Control Recommendations for Polymer Modified Bitumen Roofing." 1. Install roofing system according to applicable specification plates of NRCA's "The NRCA

Roofing and Waterproofing Manual." B. Start installation of modified bituminous membrane roofing in presence of roofing system

manufacturer's technical personnel. C. Shingling Plies: Install modified bituminous membrane roofing system with ply sheets shingled

uniformly to achieve required number of membrane plies throughout. Shingle in direction to shed water. 1. Where roof slope exceeds 1/2 inch per 12 inches (1:24), run sheets of modified

bituminous membrane roofing parallel with slope. Backnail top ends of sheets to nailer strips.

D. Cant Strips: Install and secure preformed 45-degree cant strips at junctures of modified bituminous membrane roofing system with vertical surfaces or angle changes greater than 45 degrees.

E. Cooperate with inspecting and testing agencies engaged or required to perform services for installing modified bituminous membrane roofing system.

F. Coordinate installing roofing system components so insulation and roofing plies are not exposed to precipitation or left exposed at the end of the workday or when rain is forecast. 1. Provide cutoffs at end of each day's work to cover exposed ply sheets and insulation with

a course of coated felt with joints and edges sealed. 2. Complete terminations and base flashings and provide temporary seals to prevent water

from entering completed sections of roofing system. 3. Remove and discard temporary seals before beginning work on adjoining roofing.

G. Asphalt Heating: Heat roofing asphalt and apply within plus or minus 25 deg F (14 deg C) of equiviscous temperature, unless otherwise required by roofing system manufacturer. Do not raise roofing asphalt temperature above the equiviscous temperature range more than one hour before time of application. Do not exceed roofing asphalt manufacturer's recommended temperature limits during roofing asphalt heating. Do not heat roofing asphalt within 25 deg F (14 deg C) of flash point. Discard roofing asphalt maintained at a temperature exceeding 500 deg F (260 deg C) for more than 4 hours. Keep kettle lid closed, unless adding roofing asphalt. 1. Aggregate Surfacing: Limit temperature of asphalt flood coat to the minimum required for

proper embedment of aggregate and the maximum that will permit retention of required coating weight based on slope of surface.

2. Substrate-Joint Penetrations: Prevent roofing asphalt from penetrating substrate joints, entering building, or damaging roofing system components or adjacent building construction. If mopping is applied directly to substrate, tape substrate joints.

3.06 INSULATION INSTALLATION A. Coordinate installing roofing system components so insulation is not exposed to precipitation or

left exposed at the end of the workday. B. Comply with roofing system manufacturer's written instructions for installing

roofing insulation. C. Install tapered insulation under area of roofing to conform to slopes indicated and to Shop

Drawings. D. Install tapered edge strips at perimeter edges of roof that do not terminate at vertical surfaces. E. Install one or more layers of insulation under area of roofing to achieve required thickness.

Where overall insulation thickness is 2 inches (50 mm) or greater, install required thickness in 2 or more layers with joints of each succeeding layer staggered from joints of previous layer a minimum of 6 inches (150 mm) in each direction.

G. Nailer Strips: Where roof slopes are greater than 1/2 inch per 12 inches (1:24), mechanically fasten to deck 4-inch nominal- (89-mm actual-) wide, wood nailer strips of same thickness as insulation, spaced not more than 20 to 21 feet (6.0 to 6.4 m) apart. Run nailers perpendicular to slope of roof.

H. Install insulation with long joints of insulation in continuous straight lines with end joints staggered between rows, abutting edges and ends between boards. Fill gaps exceeding 1/4 inch (6 mm) with insulation. 1. Cut and fit insulation within 1/4 inch (6 mm) of nailers, projections, and penetrations.

I. Attached Insulation: Prime surface of plywood deck with asphalt primer at a rate of 3/4 gal./100 sq. ft. (0.3 L/sq. m), unless a greater weight is required by roofing system manufacturer, and allow primer to dry. Set each layer of insulation in a solid mopping of hot roofing asphalt.

3.07 BASE-PLY FELT INSTALLATION A. Install base-ply felts according to roofing system manufacturer's written instructions, starting at

low point of roofing system. End lap and shingle each base-ply felt to ensure number of base-ply felts covers the substrate at any point. Extend base-ply felts over and terminate beyond cants. Embed each base-ply felt in a continuous mopping of hot roofing asphalt, to form a uniform membrane without base-ply felts touching each other. 1. Install one base-ply felt. 2. Install 2 base-ply felts. 3. Install 3 base-ply felts.

3.08 ROOF MEMBRANE INSTALLATION A. General: Install modified bituminous membrane over area to receive roofing, according to

manufacturer's written instructions. Extend modified bituminous membrane over and terminate beyond cants. 1. Unroll sheet and allow it to relax for the minimum time period required by manufacturer.

B. Two-Ply, Modified Bituminous Membrane: Install 2 plies of modified bituminous membrane, consisting of a base ply and a finish ply, starting at low point of roofing system. 1. Base- and Finish-Ply Application: Adhere each ply to substrate in a solid mopping of hot

roofing asphalt applied at rate required by roofing system manufacturer. 2. Base- and Finish-Ply Application: Adhere each ply to substrate in cold adhesive, applied

within temperature range and at rate required by roofing system manufacturer. 3. Base- and Finish-Ply Application: Torch apply each ply to substrate.

C. Laps: Accurately align sheets, without stretching, and maintain uniform side and end laps. Stagger end laps. Completely bond and seal laps, leaving no voids. 1. Repair tears and voids in laps and lapped seams not completely sealed. 2. Apply granules, while asphalt is hot, to cover asphalt bead exuded at laps.

D. Install modified bituminous membranes with side laps shingled with slope of roof deck where possible. 1. Install modified bituminous membranes with side laps shingled in direction to shed water

on each large area of roofing, where slope exceeds 1/2 inch per 12 inches (1:24). 3.09 FLASHING AND STRIPPING INSTALLATION

A. Install modified bituminous membrane base flashing over cant strips and other sloping and vertical surfaces, at roof edges, and at penetrations through roof, and secure to substrates according to roofing system manufacturer's written instructions and as follows: 1. Prime substrates with asphalt primer if required by roofing system manufacturer. 2. Backer Sheet Application: Install base-sheet backer and mechanically fasten to substrate.

3.11 PROTECTING AND CLEANING A. Protect modified bituminous membrane roofing from damage and wear during remainder of

construction period. When remaining construction will not affect or endanger roofing, inspect roofing for deterioration and damage, describing its nature and extent in a written report, with copies to Architect and Owner.

B. Correct deficiencies in or remove modified bituminous roofing that does not comply with requirements, repair substrates, reinstall roofing, and repair base flashings to a condition free of damage and deterioration at the time of Substantial Completion and according to warranty requirements.

C. Clean overspray and spillage from adjacent construction using cleaning agents and procedures recommended by manufacturer of affected construction.

D. This Warranty is made subject to the following terms and conditions: 1. Specifically excluded from this Warranty are damages to work and other parts of the

building, and to building contents, caused by: a. lightning; b. peak gust wind speed exceeding <INSERT WIND SPEED> mph (m/sec); c. fire; d. failure of roofing system substrate, including cracking, settlement, excessive

deflection, deterioration, and decomposition; e. faulty construction of parapet walls, copings, chimneys, skylights, vents, equipment

supports, and other edge conditions and penetrations of the work; f. vapor condensation on bottom of roofing; and g. activity on roofing by others, including construction contractors, maintenance

personnel, and other persons whether authorized or unauthorized by Owner. E. When work has been damaged by any of foregoing causes, Warranty shall be null and void

until such damage has been repaired by Roofing Installer and until cost and expense thereof has been paid by Owner or by another responsible party so designated.

F. The Roofing Installer is responsible for damage to work covered by this Warranty but is not liable for consequential damages to building or building contents, resulting from leaks or faults or defects of work.

G. During Warranty Period, if Owner allows alteration of work by anyone other than Roofing Installer, including cutting, patching, and maintenance in connection with penetrations, attachment of other work, and positioning of anything on roof, this Warranty shall become null and void on date of said alterations, but only to the extent said alterations affect work covered by this Warranty. If Owner engages Roofing Installer to perform said alterations, Warranty shall not become null and void, unless Roofing Installer, before starting said work, shall have notified Owner in writing, showing reasonable cause for claim, that said alterations would likely damage or deteriorate work, thereby reasonably justifying a limitation or termination of this Warranty.

H. During Warranty Period, if original use of roof is changed and it becomes used for, but was not originally specified for, a promenade, work deck, spray-cooled surface, flooded basin, or other use or service more severe than originally specified, this Warranty shall become null and void on date of said change, but only to the extent said change affects work covered by this Warranty.

I. The Owner shall promptly notify Roofing Installer of observed, known, or suspected leaks, defects, or deterioration and shall afford reasonable opportunity for Roofing Installer to inspect work and to examine evidence of such leaks, defects, or deterioration.

J. This Warranty is recognized to be the only warranty of Roofing Installer on said work and shall not operate to restrict or cut off Owner from other remedies and resources lawfully available to Owner in cases of roofing failure. Specifically, this Warranty shall not operate to relieve Roofing Installer of responsibility for performance of original work according to requirements of the Contract Documents, regardless of whether Contract was a contract directly with Owner or a subcontract with Owner's General Contractor.

2.02 FABRICATION A. Accurately form sheet metal work with breaks straight and true, to conform with profiles

E. Aluminum which will contact masonry, mortar, concrete or a dissimilar metal shall be given a heavy coating of bituminous paint.

F. Surfaces to be covered with sheet metal shall be smooth and free of dirt and other foreign material prior to application of sheet metal. All projecting nails shall be driven flush.

G. Sheet metal work shall be installed plumb, level and in proper alignment. H.

Work shall be free of waves, buckles, sags or other defects. Anchorage shall be as required to provide secure anchorage for all parts of the work.

PART III - EXECUTION 3.01 INSTALLATION

A.B. Fasteners: All fasteners for aluminum flashing and counter flashing shall be stainless steel.

Finishes: Finish for all flashing sheet metal shall be mill finish aluminum.

C. Length of flashing sections: 10’-0” min. D. Lap of linear flashing: 2” min. with sealant.

SECTION 077200 ROOF ACCESSORIES

PART 1 GENERAL 1.01 SUMMARY

A.1.02 RELATED REQUIREMENTS

Furnish and install all roofing accessories as indicated on the drawings and as specified herein.

A. Drawings and general provisions of contract, including Division 00 and Division 01 specification sections, apply to this section.

1.03 SUBMITTALS A.

PART 2 PRODUCTS

Submit shop drawings and manufacturer's data sheets and color samples of roof accessories to the Architect for approval.

2.01 VENTS A. Vent caps shall be installed on all vents as manufactured by Josam Series 26700 or equal.

2.02 ROOF EXPANSION JOINTS A. Roof expansion joints shall be sheet metal fabrication as detailed on drawings.

2.03 ROOF DRAINS A. Overflow roof drains shall be equal to Josam model 21500-16 series with adjustable extension,

galvanized cast iron parts, deck clamp assembly and threaded outlet. Pipe size: 4”.PART 3 EXECUTION

3.01 INSTALLATION A. Install all roof accessories in accordance with manufacturer's current printed instructions and

with approved shop drawings and as detailed. Verify all flashing as provided by roofing manufacturer.

Provide 4 feet sq. 6 lb. lead roofing flashing. Install roof drain as detailed, extend lead flashing into drain and secure with flashing clamp.
