WHEREAS there has been presented to the Town Board of the Town of Southold, Suffolk

County, New York, on the 9th

day of September, 2016, a Local Law entitled “A Local Law to

consider amending Southold Town Code Chapter 100 (Buildings, Unsafe; Property

Maintenance) to (i) restrict the placement of dumpsters on residential properties” and

WHEREAS the Town Board of the Town of Southold held a public hearing on the aforesaid

Local Law at which time all interested persons were given an opportunity to be heard, Now

Therefor Be It

RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local

law entitled, “A LOCAL LAW to consider amending Southold Town Code Chapter 100

(Buildings, Unsafe; Property Maintenance) to (i) restrict the placement of dumpsters on

residential properties” which reads as follows:

LOCAL LAW NO. _____ OF 2016

A LOCAL LAW entitled to “A LOCAL LAW to consider amending Southold Town Code

Chapter 100 (Buildings, Unsafe; Property Maintenance)

BE IT ENACTED by the Town Board of the Town of Southold as follows:

I. Purpose

The purpose of this amendment is to amending restrict the placement of dumpsters on residential

properties

II. Chapter 100 of the Code of the Town of Southold is hereby amended as follows:

§ 100-4 Standards.

A. Property maintenance.

(1) Surface and subsurface water shall be adequately drained to protect buildings and

structures, to prevent damage to adjacent property and to prevent the development

of stagnant ponds. Swimming pools, spas, hot tubs and other similar structures

erected for recreational use shall be maintained so as to avoid the stagnation of the

water therein.

(2) Landscaping shall be adequately maintained so that lawns, hedges, bushes, weeds

and trees do not become overgrown and unsightly so as to constitute an unsafe

condition or blight. At no time shall landscaping, hedges, bushes, weeds or trees

create an impediment to emergency and/or fire rescue vehicle access.

(3) Garbage, crates, rubbish, refuse or debris shall be kept inside a building or

buildings on the premises, or in an acceptable enclosed container, and shall be

regularly collected and removed from the premises.

(4) No dumpster shall be permitted in the front yard or side yard of a residential

property for more than two weeks, unless the property benefits from an open

and valid building permit. If the property benefits from an open and valid

building permit, said dumpster may remain in the front yard or side yard

until either the building permit expires, or a certificate of occupancy and/or

compliance is issued for the work described in the permit, whichever occurs

first. Thereafter, the dumpster must be removed. Properties used for

bonafide agricultural production shall not be subject to this provision.

(4) (5) Open wells, cesspools or cisterns shall be securely closed or barricaded to prevent

access by the public.

(5) (6) Junked or unregistered vehicles may not be located or stored in open view but

shall be stored in a suitable location inside a building or behind a fence outside of

public view.

(6) (7)Exterior facades shall at all times be kept free of graffiti or other defacement.

III. Severability

If any clause, sentence, paragraph, section, or part of this Local law shall be adjudged by any

court of competent jurisdiction to be invalid, the judgement shall not affect the validity of this

law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.

IV. Effective Date

This Local Law shall take effect immediately upon filing with the Secretary of State as provided

by law.

RESOLVED that the Town Board of the Town of Southold does hereby prepare and approve as

the Preliminary Budget of the Town of Southold for the fiscal year beginning on the 1st day of

January 2017, the itemized statement of estimated revenues and expenditures hereby attached

and made part of this resolution, and be it

FURTHER RESOLVED that this Town board shall meet at 4:00 PM, Wednesday, on the 9th

of November, 2016, at the Southold Town Hall for the purpose of holding a public hearing on

the 2017 Preliminary Budget, and after all persons attending said hearing shall have had an

opportunity to be heard in favor or against the 2017 Preliminary Budget as compiled, or for or

against any item and items therein contained, that said hearing be then recessed and thereafter

convened at 7:00 PM on said day for the same purpose; and be it

FURTHER RESOLVED that the Preliminary Budget will be available for viewing on the

Southold Town official website: www.southoldtownny.gov, and be it

FURTHER RESOLVED that the Town Clerk shall give notice of such hearings in the manner

provided for in Section 108 of the Town Law and that such notice be published in substantially

the following form:

NOTICE IS HEREBY GIVEN that the Preliminary Budget and Preliminary Capital Budget of

the Town of Southold, Suffolk County, New York for the fiscal year beginning on January 1,

2017 has been prepared and approved by the Southold Town Board and filed in the Office of the

Town Clerk at the Southold Town Hall, 53095 Main Road, Southold, New York, where they are

available for inspection and where copies may be obtained by any interested person during

business hours.

FURTHER NOTICE IS HEREBY GIVEN, that the Town Board of the Town of Southold will

meet and review said 2017 Preliminary Budget and 2017 Preliminary Capital Budget and hold a

public hearing thereon at the Southold Town Hall, 53095 Main Road, Southold, New York, in

said Town at 4:00 p.m. and at 7:00 p.m., on Wednesday, November 9, 2016, and at such

hearing any persons may be heard in favor of or against the 2017 Preliminary Budget and 2017

Preliminary Capital Budget as compiled, or for or against any item or items therein contained.

WHEREAS The Town Board of the Town of Southold held a public hearing on the 18th

October, 2016 at 7:31 o’clock p.m. to consider a “Local Law to Override the Tax Levy Limit

established by and set forth in General Municipal Law §3-c at which time all interested person

were heard, now there for be it

RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local

Law which reads as follows:

A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED BY AND

SET FORTH IN GENERAL MUNICIPAL LAW § 3-C

Section 1. Purpose

The purpose of this Local Law is to allow the Town of Southold to override the limit on the

amount of real property taxes that may be levied by the Town of Southold, Suffolk County, New

York pursuant to General Municipal Law 3-c and to allow the Town of Southold to adopt a town

budget for town purposes and any other special or improvement districts governed by the town

board for the fiscal year 2017 that requires a real property tax levy in excess of the “tax levy

limit” as defined by General Municipal Law § 3-c.

The Town of Southold has made significant efforts to reduce spending in an effort to avoid

piercing the tax levy limit, however, in order to account for the increase in costs to provide town

services and fund town operations for 2017, while at the same time maintaining the Town’s high

credit rating and general fund reserves, will likely require adoption of a budget in excess of the

tax levy limit.

Section 2. Authority

This local law adopted pursuant General Municipal Law § 3-c (5) which expressly authorizes a

local government’s governing body to override the tax levy limit by the adoption of a local law

approved by a vote of sixty percent (60%) of the Town Board.

Section 3. Tax Levy Limit Override

The Town Board of the Town of Southold, County of Suffolk, is hereby authorized to adopt a

budget for the fiscal year 2017 that requires a real property tax levy in excess of the limit

established by and set forth in General Municipal Law § 3-c.

Section 4. Severability

If a court determines that any clause, sentence, paragraph, subdivision, or part of this local law or

the application thereof to any person, firm or corporation, or circumstance is invalid or

unconstitutional, the court’s order or judgment shall not affect, impair, or invalidate the

remainder of this local law, but shall be confined in its operation to the clause, sentence,

paragraph, subdivision, or part of this local law or in its application to the person, individual,

form or corporation or circumstance, directly involved in the controversy in which such

judgment or order shall be rendered.

Section 5. Effective date

This local law shall take effect immediately upon filing with the Secretary of State
